We ask what type of neutralization techniques corporations apply to allegations of human rights abuses. We proceed by undertaking a Qualitative Content Analysis of 162 responses by ten extractives-sector firms over a period of 14 years. The firms were responding to accusations of human rights impacts documented by the Business and Human Rights Resource Centre. We use Garrett et al.’s :507–520, 1989) framework of neutralization techniques consisting of denial, justification, concession and excuse to examine the responses. During our QCA, we (...) observed emerging themes around self-promotion and evasive tactics. We contribute to existing literature by proposing ‘evasion’ as a novel neutralization technique, particularly in circumstances of corporate responses to accusations of wrongdoing. We argue that evasion occurs when firms refuse to engage in the debate brought forward in an accusation. In addition, we enrich our understanding of neutralization techniques by proposing subneutralization techniques in our analysis to diverge from that of other studies. We conclude by discussing the implications of the predominance of corporate narcissism and evasive neutralization techniques to the business and human rights movement and other international corporate responsibility standards. The illusion that Kant respects persons comes from ascribing contemporary meanings to purely technical terms within his second formulation of the categorical imperative, “[A]ct so that you treat humanity, whether in your own person or in that of another, always as an end and never as a means only”. When we realize that “humanity” means rational nature and “person” means the supersensible self (homo noumenon), we find that we are to respect, not human selves in all their diversity (homo phaenomenon), (...) but rational selves in all their sameness, in their unvarying conformity to the universal principles of pure practical reason. The comprehension of norms in complex social systems is one of the most active fields of research in agent-based modelling. This is faced with the challenge to comprehend the recursive interaction between inter- and intra-agent processes. In this article, a comparative analysis of selected cases of normative agent architectures will be given based on a review of theories of norms in the social sciences. This allows to identify the prerequisites for a representation of the cognitive processes of norm recognition. As (...) yet, there is no unequivocal concept for the design of normative agents. The Bible does not in general tell us to maximize or minimize anything. The Ten Commandments and the Sermon on the Mount do n·ot, for example, tell us to maximize the glory of God. Instead they say, do this, don't do that, where ‘this’ and ‘that’ are replaceable by the name for such categories of action as stealing, committing adultery, and loving thy neighbour.Until recently, at least, non-maximizing moralists have appeared irrational when confronted with such questions as: what if stealing (...) or lying will save a life? Because they exclude consideration of particular circumstances, the dicta of traditional morality seem myopic and prejudiced next to ‘end-state’ doctrines like utilitarianism, which require that careful empirical investigation accompany virtually every moral decision. To many, traditional morality seems sincere and straightforward, but lacking in intellectual respectability. (shrink)

ABSTRACT Apathy may be a Bad Thing, but it is not always bad in the cases and ways it is alleged to be. The charge that the apathetic are irrational often stems from an oversimplification of political decision‐making techniques. The apathetic need not, for example, simply deny the possibility of getting one's goals, or simply ignore the benefits of action. They may, instead, have learned from experience that an avidly desired and pursued goal is always more valued before than after (...) its attainment, and that setting a low initial value on a goal may actually increase its final value. If the values of various alternatives are adjusted in the light of such knowledge, apathy looks much more rational. But that is not the end of the story. The adjustments may be either (i) a conventional and involuntary discounting and surcharging of existing alternatives in the light of known preference patterns, or (ii) a ‘voluntary decision’to value or devalue a goal in order to obtain a certain result. The latter sort of adjustment requires the introduction of new alternatives into the decision problem, and revisions to our notion of when inaction is irrational. (shrink)

A procedure is given for the transformation of quantum mechanical operator equations into stochastic equations. The stochastic equations reveal a simple correlation between quantum mechanics and classical mechanics: Quantum mechanics operates with “optimal estimations,” classical mechanics is the limit of “complete information.” In this connection, Schrödinger's substitution relationsp x → -iħ ∂/∂x, etc, reveal themselves as exact mathematical transformation formulas. The stochastic version of quantum mechanical equations provides an explanation for the difficulties in correlating quantum mechanics and the theory of (...) relativity: In physics “time” is always thought of as a numerical parameter; but in the present formalism of physics “time” is described by two formally totally different quantities. One of these two “times” is a numerical parameter and the other a random variable. This last concept of time shows all the properties required by the theory of relativity and is therefore to be considered as the relativistic time. (shrink)

Sometimes people wonder why we should look at the morality of property at all. Property rights are taken to be legal constructs. Their validity rests, as Hume suggested, on their utility. In this context it makes little sense to focus on the specific provisions of property law and ask about their moral foundation. What has a foundation in morality is the whole system of property itself: laws, distributions, expectations, conventions. And the general usefulness of this arrangement is so large a (...) question, so fraught with uncertainty, that it is almost beyond serious discussion. (shrink)

Suppose that a scientific theory X is well confirmed, and either states or implies a statement like “classes exist”. Suppose, if the statement is not explicit but implied, that the specified systems are ‘accepted’ by two individuals, R and F, as the ‘best available'. Suppose, finally, that both R and F, in some yet to be explained sense of the word, ‘accept’ and use theory X to regulate their experience. Then we have something very like the situation discussed by Putnam (...) and van Fraassen in their debate over ‘fictionalism'. I will argue that, in this situation, there is a great mystery over what would separate a fictionalist F from a realist R. Neither Putnam nor van Fraassen seems to be conscious of the problems involved.Fictionalism, according to its opponent, Putnam, statesvarious entities presupposed by scientific and common sense discourse [are] merely “useful fictions”, or that we cannot, at any rate, possibly know that they are more than “useful fictions”. This article traces some of the transformation that the fields of folk psychology and anthropology underwent in the late nineteenth century. Ludwik Fleck, in developing his sociology of knowledge, drew on both of these fields; a legacy that makes it possible to conceive of his epistemology as a theory of communication. Fleck, in grounding his understanding of the relationship between sociality and communication on insights from these two disciplines, proposed the morphological concept of an organic formation of all scientific knowledge. Naturalising knowledge production in this manner, Fleck postulated a program of deciphering, reading, and translation that would relate all forms of knowledge back to the rules and conditions of its making. In this morphological conception of the processes of knowledge production, Fleck’s sociology bears significant similarities with the description of social institutions by French sociologists Marcel Mauss and Emile Durkheim, who also drew on insights from late-nineteenth-century folk psychology and anthropology. Les chercheurs notent que les sujets offrent des réponses incohérentes lorsqu’un même problème est formulé de plusieurs façons différentes. Mais quand doit-on estimer que deux problèmes sont «les mêmes»? Les sujets ne sont pas des chercheurs ni des experts en théorie de la décision. On ne peut s’attendre à ce qu’ils lisent les problèmes «comme il (...) faut». Peut-être découvrent-ils des sources d’utilité là où les chercheurs n’en soupçonnaient guère; peut-être changent-ils des valeurs qui «devraient» rester constantes. (shrink)

Amartya Sen argues that it is not, after all, irrational to reverse preferences when your choices are amplified by an ‘irrelevant’ alternative. He offers examples such as the agent who always picks the next-to-largest piece of cake. Given a choice between a larger and smaller piece, I will prefer the smaller one. But when a third and largest piece in added to my alternatives, I will now prefer the formerly largest piece over the smallest piece. This violates ‘contraction consistency’: a (...) third alternative should not have made any difference in my preferences regarding the first two. Such examples are shown to rely on descriptions which omit features crucial to choice. These features, and all identifying features relevant to my decision, should be included in the descriptions of the alternatives. An adequate description does not smuggle norms into the overt act of choice, but it does include the non-normative characteristics without which my decision-rules, if any, cannot be applied. When alternatives are adequately described, Sen’s inconsistencies disappear. The result is a clearer and more resillent, but also less aggressive notion of behavioral consistency. (shrink)
