Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Książka ta jest poświęcona analizie filozofii politycznej Johna Deweya osadzonej w kontekście kryzysu liberalizmu po pierwszej wojnie światowej. Jedną z dróg wyjścia z impasu, w jakim znalazła się myśl liberalna, był radykalny liberalizm reprezentowany przez takich intelektualistów, jak John Dewey, Bertrand Russell, Karl Polanyi i Karl Mannheim. Wymienieni myśliciele upatrywali szans na odrodzenie liberalizmu w odrzuceniu koncepcji wolnorynkowych i dialogu z myślą socjalistyczną. W pracy przedstawiono zręby ideologii radykalnego liberalizmu oraz stosunek lewicowych liberałów do innych ideologii, w szczególności zaś do (...) liberalizmu ekonomicznego i rewolucyjnego marksizmu. Osobny rozdział pracy poświęcony jest refleksji Johna Deweya na temat demokracji, która należy do najoryginalniejszych osiągnięć amerykańskiego filozofa. Przedstawiona interpretacja uwypukla związki myśli Johna Deweya z radykalizmem Nowej Lewicy oraz twórczością takich teoretyków, jak C. W. Mills Axell Honneth czy James Bohman. Drugim ważnym obszarem podejmowanych w pracy rozważań jest rekonstrukcja Deweyowskiej koncepcji myślenia jako rozwiązywania problemów. Pragmatyzm utrzymuje, że możliwe jest znalezienie mniej lub bardziej obiektywnych odpowiedzi na pytanie, co należy robić w danej problematycznej sytuacji. „Pragmatyczne oświecenie”, by posłużyć się terminem Hilarego Putnama, wyrzeka się oświeceniowego uniwersalizmu, ale nie rezygnuje całkowicie z roszczeń do obiektywności w dziedzinie rozstrzygnięć moralnych i politycznych. The present article analyzes Photius'Lexiconand Eustathius of Thessalonica'sCommentarii ad Homeri Iliademin order to trace the history and reconstruct the recipe of a dish called kandaulos/kandylos. It was a Greek delicacy, which appears to have been developed in Lydia before the middle of the VI th c. B.C. It is known to have been named after king Candaules, who ruled the Lydian territory in the VII th c. B.C. The dish was (via the Ionians) borrowed by the Helens and established itself (...) in Greece sometime in the V th c. B.C. It became popular in the Hellenistic periodThe testimony provided by Photius and Eustathius of Thessalonica contributes to our better knowledge of two varieties ofkandaulos/kandylos. The first was savoury and consisted of cooked meat, stock, Phrygian cheese, breadcrumbs and dill (or fennel). The other included milk, animal fat, cheese and honey. The dish is reported to have been costly, prestigious and indicated the social status of those who would eat it.Though there is much evidence suggesting its popularity in antiquity, we lack any solid proof thatkandaulos/kandyloswas eaten in Byzantine times. W dyskusji z Lindą Barclay Nussbuam odcina się od takiej interpretacji. Podkreśla pluralistyczny i uniwersalistyczny charakter swoich rozwiązań. Chce, aby konsensus oparty na teorii sprawności przekroczył bariery kultur, religii i narodowości. Stawia więc cele ambitniejsze niż sam Rawls, czołowy polityczny (...) liberał. Wskazuje też inne, poza Rawlsem, źródła idei liberalizmu politycznego. Piętnuje dostrzegany u Berlina i Raza brak szacunku wobec religii. (shrink)

In this paper, I discuss features of the interaction between a user and digital technology and how this transforms our contemporary experience of space and place. Analyzing this interaction is important for understanding global processes of displacement and creation of what Marc Augé calls non-places and their relation to technology in general. Drawing from Heidegger’s tool-analysis, I show that displacement is a structural element of the usage of absolutely ready-to-hand, access-providing digital devices. My main argument runs as follows: a) the (...) use of digital devices bypasses place directly in our activities; b) because of that, places themselves become more and more obsolete; and c) that leads to changes in how we conceive places and placefulness of technology. Instead, we think of the latter as immaterial, without a location. The immateriality of technology that we experience is reinforcing processes of displacement, as it allows them to continue thriving without being noticed and adequately conceptualized. (shrink)

This paper’s aim is to provide a new interpretation of Martha C. Nussbaum’s and Richard Rorty’s views on the ethical role of literature. I pursue this aim in a threefold manner. First of all, I shortly discuss and provide a critique of previous comparisons by other authors. Afterwards, based on the presented critique of other comparisons, I present concise summaries of their respective views. Finally, I propose a double context for interpreting and assessing their views together. The main claim of (...) the paper is the following: despite several differences in their philosophical underpinnings, Nussbaum’s and Rorty’s views on literature can be interpreted together using the context of John Rawls and Jacques Rancière. This interpretation consists of showing how uncovering a shared Rawlsian characteristic of Nussbaum’s and Rorty’s views paves a way for explaining how literature actually does ethical work, using some concepts of Rancière. Such a contextual reading allows for both a more thorough understanding of their respective projects and assessing their shared shortcomings. (shrink)

In this paper I consider the concept of an illocutionary rule - i.e., the rule of the form "X counts as 7 in context C" - and examine the role it plays in explaining the nature of verbal communication and the conventionality of natural languages. My aim is to find a middle ground between John R. Searle's view, according to which every conventional speech act has to be explained in terms of illocutionary rules that underlie its performance, and the view (...) held by Ruth G Millikan, who seems to suggest that the formula "X counts as Y in context C" has no application in our theorizing about human linguistic practice. I claim, namely, that the concept of an illocutionary rule is theoretically useful, though not explanatorily basic. I argue that using the formula "X counts as Y in context C" we can classify illocutionary acts by what Millikan calls their conventional outcomes, and thereby make them susceptible to naturalistic explanation. An idea which, like the Sun, brings out diffused things and facts from the darkness of fragmentary, in a sense undeveloped and almost empty existence and the absurdity of mutually-destructive objects, events and people.Yes—this idea is a path leading away from absurdity and the logical, or, rather, ontological partiality and particularism (hence, in a sense, social meaninglessness) of mutually-destructive and mutually-degrading “incomplete existences”.It is, of course, no new idea—it is present in the history of philosophy, anthropology and biology, and in quantum mechanics: complementarity. In the opening remark of Nicomachean Ethics VIII 1 Aristotle notices that the next step would be a discussion of philia, since it is a certain aretē or is associated with aretē (NE VIII 1 1155a 1–2). This article is an attempt to determine how the real object of philia and aretē are related from Aristotle’s point of view. The author performs a study into two sections. The first section is focused on the analysis of aretē and its various types, (...) in particular the human one. The second section is concentrated on the typology of philia, namely friendship and its particular kinds. The author shows that the relation between philia and aretē can be described in two ways: if both philia and aretē play the crucial role in leading a eudaimonic life, then philia is the aretological friendship and aretē—the human one, namely the whole consists of the aretē of character in the full sense and the practical wisdom on condition that the aretological friends equate eudaimonia with life focused on the political or practical activity, or even of the theoretical wisdom, providing that they identify it with the highest form of eudaimonic life, that is, the theoretical one. If, however, philia is to be a term said in many ways (pleonachōs legetai) and aretē is to be understood in a broad sense, that is, as “being good at something”, then philia can signify every kind of friendship, namely the aretological, the hedonistic and the utilitarian one, whereas aretē—qualification or skill that makes these friendships perform their functions well. The first possibility is that the relation between philia and aretē is limited to the aretological friendship at the expense of narrowing the meaning of aretē to the human one. The second possibility is that every kind of friendship is considered as the functional thing and, in consequence, defined by their proper function. From this point of view, all friendships are accompanied by appropriate aretai, namely by qualifications or skills that guarantee the perfect fulfillment of their proper function and, therefore, the achievement of the set goal by two persons in question. This paper differentiates between two readings of Aristotle’s argument that unity and being are not “genē” (UBANG for short). On the first reading – proposed by commentators such as Ackrill, Shields, Loux, and McDaniel – UBANG entails the proposition that there are no features that characterise all beings insofar as they are, referred to by its contemporary proponents, including McDaniel, as ‘ontological pluralism’. On the second reading – proposed here – UBANG does not entail this proposition. The paper argues that (...) only on the second reading does Aristotle’s argument secure its conclusion, that the second reading is, in fact, the correct reading of UBANG, and that anyone who thinks that UBANG succeeds and entails ontological pluralism probably equivocates between two different senses of ‘genos’. This chapter explores the axiological convergence between classical liberalism and Catholic Social Thought (CST). The chapter argues that CST and classical liberals should build on their complementary values to strengthen public support for liberal democracy and a free-market economy among Catholic voters and in society at large. Although populist regimes, especially far-right conservative nationalists, portray liberalism as an antithesis of Catholicism, this chapter shows that there is a broad consensus between the two traditions. Contrary to far-right populist positions, the chapter (...) argues that it is possible to maintain Catholic values in a liberal market democracy without denouncing one’s religious identity. The chapter emphasizes the importance of re-constructing a centrist tradition of Catholic liberal thought to mitigate populist assault on political, economic, and social freedoms. (shrink)

This paper explores the wandering during the Night of Culture, which I consider an essential practice for the people's experience of this event. Looking at this particular form of movement of those participating in this initiative between various event locations also allows us to see the implications of the Night of Culture for urban public spaces. The empirical base of the paper is the visual documentation of the events carried out during the Night of Culture during the 2023 edition. While (...) interpreting the material, I refer to the situationist theory of drift and then reconstruct the structure of the festival's wandering, its rhythm, the type of attention bestowed on the city by the participants, and the form of this ephemeral community. In conclusion, I propose that the atmosphere of places can be used to analyse the city-forming effects of the Night of Culture, to grasp better the specificity of the event and its risks and potentials. Traktuję więc jego propozycję filozoficzną nie jako obiekt jedynie muzealny, ale żywą myśl, z którą można i należy dziś podjąć dyskusję. Wynika to z przeświadczenia, że myślenie filozoficzne stanowi kontinuum i „rozmowa” z filozofami przeszłości może wnieść sporo do badań prowadzonych obecnie. System stworzony przez Witkiewicza nie był nigdy projektem jednorodnym, jego badania stanowiły raczej splot wątków, trudno jest wskazać jedno, dominujące zagadnienie. Jeśli jednak miałbym (...) wymienić taki leitmotiv jego filozofii, to byłby to problem istnienia ożywionego, upsychicznionego i cielesnego bytu, jakim jesteśmy my sami, a w przekonaniu Witkiewicza również wszystkie inne byty, z których składa się materia (stąd tylko pozornie) nieożywiona. Zawężając zakres tego zagadnienia, dochodzimy do klasycznego problemu psychofizycznego w wersji jednak dość oryginalnej z racji wspominanego odrzucenia materii martwej. O ciągłym zainteresowaniu problemem stosunku ciała do umysłu świadczy tytuł ostatniej większej rozprawy filozoficznej Witkiewicza: Zagadnienie psychofizyczne. Prezentowana praca jest próbą pokazania drogi, którą przebył polski filozof, poszukując odpowiedzi na pytanie o problem psychofizyczny, aż do swoistej wersji cielesno-biologicznego panpsychizmu. We study a class of finite models for the Lambek Calculus with additive conjunction and with and without empty antecedents. The class of models enables us to prove the finite model property for each of the above systems, and for some axiomatic extensions of them. This work strengthens the results of [3] where only product-free fragments of these systems are considered. A characteristic feature of this approach is that we do not rely on cut elimination in opposition to e.g. [5], (...) [9]. (shrink)

The aim of this paper was to analyze the relationship between attitudes toward physical activity and participation in water sports events and to recognize the main motives for involvement in these kinds of events. A written paper–pencil diagnostic survey was conducted among 394 participants in two traditional and two modern sports events on water held in Poland to ascertain whether innovative events are needed in society, and whether they cause an increase in interest in physical activity. The research results showed (...) that modern sports events on water did not have any more power to attract physically inactive people than traditional water events, did not produce a greater desire to lead an active lifestyle, and did not encourage people to more regularly practice water sports. Moreover, modern events, compared to traditional events, were only a one-time experience and the people who completed survey often wanted to return to traditional sports events which provided participants with greater positive emotions than a modern event. In the case of socio-demographical variables, there was no statistically significant relationship between gender and choice of modern or traditional event, but older people were more likely to choose a traditional event than younger people; modern water events were an attractive option primarily for young people under 30 years of age, furthermore, modern events more often attracted people who had completed higher education. However, it turned out that a modern event on water often attracted more people who had had no experience in this sport discipline rather than people who chose traditional water events. In a sense, modern events are therefore effective in promoting water sports in Polish society. We also distinguished five main groups of participants: healthy lifestyle managers, lovers of sports emotions, water sports malcontents, water sports enthusiasts, and neutrals to water sports. Additionally, we looked into gender-related motives for participation in modern and traditional water events: social and health-related motives proved to be more important for women and men who participated in modern water events. The research results presented in the article expand on the current state of knowledge about mass participation in sport, the impact of sporting events on the promotion of physical activity, and show the motivation behind participation in modern and traditional water sporting events. This paper discusses three different contemporary uses of philosophy and literature in non-philosophical and non-literary texts. Most often, both discourses are used as tools, and they are invoked instrumentally in popularizing literature or in teaching. Philosophy and literature can also be treated as a source or starting point for reflection outside its mother field, or even as a cause of various social and political processes. The most interesting usage of both discourses is to refer to them as the symptoms or (...) signs of the times allowing us to make diagnoses about the present. These uses of the two discourses show the similarities between literature and philosophy on a purely pragmatic level that is relevant to their contemporary functioning in a non-specialist sphere. The convergence in this regard is a testimony to the transformation of the position of both discourses in the contemporary humanities involving the loss of their privileged position. At the same time, literature and philosophy in this crisis situation are gaining new areas of influence in public discourse, realizing their cognitive and reflexive potential through their utilitarian use. This paper is a reflection on the legitimacy of commonly accepted opposition of the notions of “capitalism” and “socialism”. The leading thesis is that although they can be considered as antinomies, their real referents should not be treated analogously. Capitalism, as understood by its very name, emerged in the second half of the 19th century and evolved constantly from this moment, often changing its main features. Socialism, in contrast, was created as a notion opposing the capitalistic reality of the 19th (...) century. Yet it never really existed in this form. The actual economic system, referred to as “socialism”, was in fact a hybrid of capitalism and neo-feudal bureaucracy. (shrink)

In the first Critique, Kant raises two objections against Aristotle’s categories. Kant’s concern, in the first instance, is whether Aristotle generated all categories that there are and if he did not generate any spurious categories. However, for Kant, this is only a symptom of the second – deeper – flaw in Aristotle’s thinking. According to Kant, Aristotle generated his categories ‘on no common principle.’ This paper develops the two Kantian objections, offers an overview of Brentano's (1862. Von der Mannigfachen Bedeutung (...) des Seienden nach Aristoteles. Freiburg im Brisgau: Herder’sche Verlagshandlung.) reconstruction of Aristotle’s categories (which claims to have addressed them), develops three objections to this reconstruction, and recommends (Trendelenburg, A. 1846. Efforts to ban Autonomous Weapon Systems were both unsuccessful and controversial. Simultaneously the need to address the detrimental aspects of AWS development and proliferation continues to grow in scope and urgency. The article presents several regulatory solutions capable of addressing the issue while simultaneously respecting the requirements of military necessity and so attracting a broad consensus. Two much stricter solutions – regional AWS bans and adoption of a no first use policy – are also presented as fallback strategies in case (...) achieving AWS’ compliance with the Laws of Armed Conflict proved elusive. Together, the solutions presented form an outline of a flexible regulatory strategy able to adjust to different technological outcomes and providing a sensible compromise to solve the current deadlock on the AWS issue. In order to solve a system of nonlinear rate equations one can try to use some soliton methods. The procedure involves three steps: find a ‘Lax representation’ where all the kinetic variables are combined into a single matrix \, all the kinetic constants are encoded in a matrix H; find a Darboux–Bäcklund dressing transformation for the Lax representation \]\), where f models a time-dependent environment; find a class of seed solutions \ that lead, via a nontrivial chain of dressings \ (...) to new solutions, difficult to find by other methods. The latter step is not a trivial one since a non-soliton method has to be employed to find an appropriate initial \. Procedures that lead to a correct \ have been discussed in the literature only for a limited class of H and f. Here, we develop a formalism that works for practically any H, and any explicitly time-dependent f. As a result, we are able to find exact solutions to a system of equations describing an arbitrary number of species interacting through catalytic feedbacks, with general time dependent parameters characterizing the nonlinearity. Explicit examples involve up to 42 interacting species. (shrink)
