This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". At the same time, we emphasize, as displayed in Vieira's text, the "topoi", or universal values, that are the basis of Oswald Ducrot's argumentation theory. (shrink)

Parlare di “tecnontologia digitale” implica che il digitale porta alla luce l’homo technicus in maniera peculiare rispetto alla dimensione analogica. Non avviene un processo di smaterializzazione, bensì di ridefinizione della materia e di pervasività della dimensione digitale nei confronti della nostra corporeità e della nostra esistenza quotidiana. Viene proposta una lettura della relazione con la tecnologia digitale basata sulla fenomenologia della carne, traendo (...) spunto dalle riflessioni di Merleu-Ponty ne Il visibile e l’invisibile. Si mostra che la carne, tessuto comune della corporeità del mondo, rende possibile concepire la relazione tra tutti gli enti secondo un’ontologia piatta. Questo consente di vedere il rapporto con il digitale come compartecipazione e di riconfigurare il problema della responsabilità legato ai dispositivi, ai robot e alle piattaforme digitali. -/- In this paper the issue of technology in relation to its digital developments is addressed from an ontological point of view. The idea of “digital technontology” implies that the digital brings out the homo technicus in a unique way that differs from what happens in the analog dimension. What occurs is not a process of dematerialization, but a redefinition of the matter and a clear pervasiveness of the digital dimension in our corporeity and daily existence. This paper offers an interpretation of the relation between humans and digital technology based on the phenomenology of the flesh, taking inspiration from what Merleau-Ponty writes in The Visible and the Invisible. The idea of flesh, which is the common body of the world, allows us to conceive the relation among all beings according to a flat ontology. In this way, the relation between us and the digital can be seen as a form of involvement and the problem of responsibility concerning devices, robots, and digital platforms can be reconfigured accordingly. This paper aims to find, in Merleau-Ponty’s late thinking, a definition of the virtual which aligns with the latest advancements in digital technology while avoiding a reduction to the digital realm or a stark opposition to reality. The virtual is considered as a crucial characteristic in Merleau-Ponty’s late ontology, especially in The Visible and the Invisible, where a “virtual focus” or “virtual center” of the flesh is introduced. The argument posits that Merleau-Ponty’s monism of the flesh results in a dynamic (...) view of virtuality, with significant ontological implications that reshape the relationship between the digital and the analogue. Merleau-Ponty’s concept of the virtual is defined by several key features: it applies to a monist perspective on reality, to a dynamic relationality between dialectic poles, and to the fabric of reality. This interpretation of the virtual implies a divergence from the digital, as virtuality belongs to the whole spectrum of reality. (shrink)

This paper draws on previous research carried out by the author on the educative relationship between teacher and student in schools and universities, in order to enrich it with further studies and considerations on distance learning. The author uses the phenomenological method, assuming the point of view of both members of the relationship (student and teacher). The general characteristics of the relationship (reciprocity, asymmetry, and verticality) and the differences between the two parties involved (age and/or developmental stage, educational role, mastery (...) of the discipline, and institutional role) remain, but are articulated differently: this mainly happens, because in distance learning the perception of the body of the other person is partial or absent, hindering the phenomena of pairing and empathy. It is thus shown that distance learning cannot replace face-to-face teaching, however, it is able to support and supplement it. (shrink)

Segundo o autor do artigo, o estudo do tédio na obra de Kierkegaard tem sido objecto de relativamente pouco interesse, sobretudo quando comparado com a angústia, a melancolia, a ironia ou o desespero. A verdade, porém, é que o tédio constitui uma disposição fundamental, um limite extremo de uma forma da existência. Neste sentido, o artigo pretende fazer uma análise das principais formas que a disposição do tédio assume, e da sua particular relevância no interior do que, na obra de (...) Kierkegaard, se chama "estádio estético". Em ordem a esse fim, o autor analisa a relação que o tédio mantém com as possibilidades que a vida disponibiliza e, sobretudo, a sua peculiar relação com o nada. Mostra-se sobretudo que tipo de lucidez se pode considerar como efeito do tédio, qual o aspecto da vida que nele se torna patente e de que forma, por ele, o sujeito acaba por reconhecer estar constituído numa superioridade relativamente a tudo o que é finito. Assim, no centro deste estudo estão as determinações fundamentais de disposição e de finito, bem como, num segundo momento, o esboço de uma "anatomia comparada" das disposições fundamentais do sujeito humano, a saber, do tédio, da melancolia e da angústia. \\\ The study of boredom in Kierkegaard's work has attracted relatively little interest compared to the more visited themes of anxiety, melancholy, irony and despair. For Kierkegaard, boredom is a fundamental mood. And only when we are in this mood can we experience one of the extreme states of existence. For Kierkegaard, boredom manifests itself in what he terms the "aesthetic stage". With this premise in mind, the article explains the relationship boredom has with the possibilities life puts before us, but more importantly its peculiar relationship with nothingness. The article explores in particular the effect boredom has on lucidity and, more specifically, attempts to answer the question about the aspect of life that is better perceived when the subject is in a state of boredom. A crucial question, for example, is this: how does being in a state of boredom reveal to the human subject the fact that he/she is superior to everything that is finite? At the centre of the article are the notions of mood and finiteness, in accordance to which the author delivers what might be called a "comparative anatomy" of fundamental states of human existence such as boredom, melancholy and anxiety. Many prominent theories of moral responsibility rely on the notion of “tracing,” the idea that responsibility for an outcome can be located in (i.e., “traced back to”) some prior moment of control, perhaps significantly antecedent to the proximate sources of a considered action. In this article, I show how there is a problem for theories that rely on tracing. The problem is connected to the knowledge condition on moral responsibility. Many prima facie good candidate cases for tracing analyses appear to (...) violate the knowledge condition on moral responsibility. So, either we need to dispense with tracing approaches or we must refine our understanding of the knowledge condition or we are responsible less frequently than we suppose. (shrink)

In the last decades, Hegel’s mature political philosophy has come to be associated with some form of social or welfare liberalism. Challenging this line of interpretation, this study aims to show that his work harbours a more ambitious philosophical programme, grounded in a different vision of the modern state. However, this programme is only partly spelled out in the Philosophy of Right. While the conceptual logic that guides Hegel’s dialectical progression points beyond the modern liberal standpoint, some of his concrete (...) political choices are more conservative, and some are even opposed to the change of perspective I claim to be at stake in his work. In response to this tension, I undertake a systematic reconstruction of his social and political views, divided into two main parts. First, I highlight the critical dimension I take to be explicitly present in the Philosophy of Right but neglected or misrepresented in the secondary literature. I argue that the different stages of Hegel’s progression are not merely added to one another, but qualitatively transformed, and hence that his account of the state should not be read as a mere complement to the stage of civil society, but as a direct challenge to its underlying logic. Second, I draw the political and economic conclusions implicit in this line of approach. Shifting the focus from Hegel’s interpreters to Hegel himself, I show that the conscious pursuit of the common good he regards as essential to a rational state is not compatible with a capitalist production system nor with the constitutional monarchy he proposes. A true dialectical synthesis of the particular interests of individuals and the general interests of society entails nothing less than a comprehensive democratization of the economic and the political spheres. And the need for this transformation holds the key to Hegel’s enduring political relevance. (shrink)

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

What is Aristotle's considered view of animal self-motion? According to several scholars, Aristotle ends up rejecting this very notion as a result of his criticism of Plato's theory of a self-moving soul. Contrary to this still widespread assumption, the present study argues that his critical engagement with Plato is not confined to negative results, but achieves largely positive outcomes, which add up to a rich and nuanced picture of self-motion. Ferro makes his case by offering a novel reading of (...) a handful of controversial passages from De Anima and Physics VIII, where Aristotle reacts to three aspects of Plato's theory of self-motion: the claim that soul itself is a self-mover, the assumption that self-movers enjoy strong causal autonomy, and the link between motion, desire and soul partition. Through a careful reading of the relevant passages, which does justice to their proper context and significance, Ferro shows that Aristotle's critical re-appropriation of self-motion results in a largely coherent doctrine with major repercussions for Aristotelian psychology and philosophy of nature. Agli intervistati è stato chiesto se la filosofia insegnata a scuola riuscisse a mutare la loro visione del mondo e, soprattutto, le loro relazioni con gli altri. L’articolo si sviluppa in tre parti: la prima analizza le premesse metodologiche del libro, la seconda verte sul (...) cambiamento di Weltanschauung e sulle relazioni interpersonali, la terza sulla filosofia come disciplina scolastica. Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

Su objeción consiste en que los actos no pueden ser considerados cosas reales, sino solo el surgir de estas. A partir de dicha observación a la noología, González Fernández no solo da surgimiento a su praxeología (también conocida como hiparqueología), sino que su sistema filosófico comienza a ser cuestionado por no explicar (...) qué son, en el mundo de los hechos, los actos, más allá de la suposición de que ellos están ahí a pesar de ser invisibles. The paper argues against a commitment to metaphysical necessity, semantic modalities are enough. The best approaches to elucidate the semantic modalities are (still) versions of lingustic ersatzism and fictionalism, even if only developed in parts. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves revitalization. (...) What exactly is the role of empirical beliefs in moral reflective equilibrium (RE)? And if they have a part to play, can changes in our empirical beliefs effectuate changes in the moral principles we adopt? Conversely, can empirical beliefs be adjusted in light of certain moral convictions? While it is generally accepted that empirical background theory is of importance to the method of wide reflective equilibrium (WRE), this article focuses on a different aspect, namely the role of empirical beliefs that (...) is intrinsic to the coherence relation of moral beliefs in any (narrow or wide) conception of RE. First, it is shown that in the application of RE, empirical beliefs are crucial to the procedure of matching principles to considered judgments. Changes in our empirical beliefs may therefore upset the relevant coherence relation and motivate changes in the moral principles we adopt. This more detailed account of the interplay between empirical and moral beliefs can help evaluate the overall philosophical appeal of RE. Finally, it is argued that, at least in WRE, the relation between empirical and moral beliefs need not be a one-way street, that is, moral convictions can provide us with some epistemic means of adjudicating between competing empirical descriptions of the world. The book aims to set out in which respects concepts are properly studied in philosophy, what methodological role the study of concepts has in philoso-phy's study of the world. Many of the considerations in this book nowadays are placed under the headline ‘metaphilosophy’. In contrast to paradigmatic ordinary language philosophy the book endorses a representationalist theory of meaning and concepts, thus agreeing with many of its critics in philosophy and the cognitive sciences. In contrast to many of these critics and (...) supposedly the majority of cognitive scientists it endorses the viability of conceptual analysis as one method of philosophy. The book reflects on Frege's theory of concepts, because Frege's theory of sentential unity has barely been super-seded, and the problems arising from Frege's understanding of concepts are still alive. The central part of the book starts by reconsidering the approach and the idea of ordinary language philosophy. Although ordinary language philosophy cannot be the whole of analytic philosophy a proper understanding of conceptual analysis turns out to be one part of analytic philosophy. (shrink)

In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

The aim of our paper is to question the problem of artistic creation as a transfiguration of suffering. We will point out that health is always a state to be looked at with the eyes of a convalescent, and how in particular there can be no artistic creation that is not accompanied by a condition of suffering. Our interpretive key will be the faculty of perceiving nuances, a topic that often appears in Nietzsche’s later writings, and the relationship between the (...) nuance and the affirmative power of art. Finally, we will consider whether the taste for nuance is not itself a sign of a profoundly suffering nature, aristocratically devoted to detachment from all that is grossly general. (shrink)

The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. Plural definite descriptions across many languages display two well-known properties. First, they can give rise to so-called non-maximal readings, in the sense that they ‘allow for exceptions’. Second, while they tend to have a quasi-universal quantificational force in affirmative sentences, they tend to be interpreted existentially in the scope of negation. Building on previous works, we offer a theory in which sentences containing plural definite expressions trigger a family of possible interpretations, and where general principles of language use account for (...) their interpretation in various contexts and syntactic environments. Our theory solves a number of problems that these previous works encounter, and has broader empirical coverage in that it offers a precise analysis for sentences that display complex interactions between plural definites, quantifiers and bound variables, as well as for cases involving non-distributive predicates. The resulting proposal is briefly compared with an alternative proposal by Križ, which has similar coverage but is based on a very different architecture and sometimes makes subtly different predictions. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

Understanding what motivates employees is essential to the success of organizational objectives. Therefore, properly capturing and explaining the full range of such motivations are important. However, the classical and most popular theories describing employee motives have neglected, if not omitted entirely, the importance of the ethical and spiritual dimensions of motivation. This has led to a model of a person as self-interested, amoral, and non-spiritual. In this paper, we attempt to expose this omission and offer a more complete taxonomy of (...) motivations which include these dimensions. Although more work will need to be done to fully develop the ethical and spiritual dimensions of motivation, the expanded taxonomy will provide the foundations and serve as a guide for such further research. Furthermore, this new categorization of motivations brings out the full dimensions of being human, which promises to lead to improved management practices with regard to employees and foster greater human flourishing in the workplace. Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. I’ve been told that in the good old days of the 1970s, when Quine’s desert landscapes were regarded as ideal real estate and David Lewis and John Rawls had not yet left a legion of influential students rewriting the terrain of metaphysics and ethics respectively, compatibilism was still compatibilism about free will. And, of course, incompatibilism was still incompatibilism about free will. That is, compatibilism was the view that free will was compatible with determinism. Incompatibilism was the view that free (...) will was incompatible with determinism.1 What philosophers argued about was whether free will was compatible with determinism. Mostly, this was an argument about how to understand claims that one could do otherwise. You needn’t have bothered to talk about moral responsibility, because it was just obvious that you couldn’t have moral responsibility without free will. The literature was a temple of clarity. Then, somehow, things began to go horribly wrong. To be sure, there had been some activity in the 1960s that would have struck some observers as ominous. Still, it was not until the 1980s that those initial warning signs gave way to real trouble. The meanings of terms twisted. (shrink)

A growing body of evidence in cognitive psychology and neuroscience suggests a deep interconnection between sensory-motor and language systems in the brain. Based on recent neurophysiological findings on the anatomo-functional organization of the fronto-parietal network, we present a computational model showing that language processing may have reused or co-developed organizing principles, functionality, and learning mechanisms typical of premotor circuit. The proposed model combines principles of Hebbian topological self-organization and prediction learning. Trained on sequences of either motor or linguistic units, the (...) network develops independent neuronal chains, formed by dedicated nodes encoding only context-specific stimuli. Moreover, neurons responding to the same stimulus or class of stimuli tend to cluster together to form topologically connected areas similar to those observed in the brain cortex. Simulations support a unitary explanatory framework reconciling neurophysiological motor data with established behavioral evidence on lexical acquisition, access, and recall. (shrink)
