The United Kingdom is the first and so far only country to pass explicit legislation allowing for the licensed use of the new reproductive technology known as mitochondrial replacement therapy. The techniques used in this technology may prevent the transmission of mitochondrial DNA diseases, but they are controversial because they involve the manipulation of oocytes or embryos and the transfer of genetic material. Some commentators have even suggested that MRT constitutes germline genome modification. All eyes were on the United Kingdom (...) as the most likely location for the first MRT birth, so it was a shock when, on September 27, 2016, an announcement went out that the first baby to result from use of the intervention had already been born. In New York City, United States-based scientist John Zhang used maternal spindle transfer to generate five embryos for a woman carrying oocytes with deleterious mutations of the mitochondrial DNA. Zhang then shipped the only euploid embryo to Mexico, where it was transferred to the mother's uterus. Zhang's team's travel across international borders to carry out experimental procedures represents a form of scientific tourism that has not been properly ethically explored; it can, however, have seriously detrimental effects for developing countries. In Mexico, significant ethical and social issues have been raised by the COVID-19 pandemic. Some of the most pressing issues are the extent of restrictive measures, the reciprocal duties to healthcare workers, the allocation of scarce resources, and the need for research. While policy and ethical frameworks are being developed to face these problems, the gender perspective has been largely overlooked in most of the issues at stake. Domestic violence is the most prevalent form of violence against women, which can (...) be exacerbated during a pandemic: stress and economic uncertainty are triggers for abuse, and confinement limits access to support networks. Confinement also exacerbates the unfair distribution of unpaid labor, which is disproportionately assigned to women and girls, and highlights inequality in the overall labor market. Lack of security measures has resulted in attacks towards health workers, particularly female nurses, due to fear of contamination. Finally, resource results in lack of access to other health necessities, including sexual and reproductive health services. Research across all disciplines to face—and to learn from—this crisis should be done through a gender lens, because understanding the realities of women is essential to understand the pandemic’s true effects in Mexico and the world. The closely related debates concerning abortion, the protection of the embryo and stem cell science have captured the legislative agenda in Mexico in recent years. This paper examines some contemporary debates related to stem cell science and the legal and political action that has followed in the wake of the latest Supreme Court judgment on abortion, which debates are directly linked to the degrees of protection of the embryo stipulated in the Mexican Constitution. While some Mexican states have opted to (...) take no further action, others, where conservative political forces are in the majority, have been very active in seeking to ensure that their constitutions are amended to protect human life from conception onwards. This intense legislative activity has not, however, been repeated at the federal level, where there is currently no overarching national regulatory framework governing stem cell research. Although major efforts have been made by the conservative block within the Senate to bring forward legislative proposals for the prohibition of human embryonic stem cell research, and despite the public expression by the federal government of its commitment to encourage inward investment and innovation in the area of biotechnology, stem cell science has, so far, remained unregulated. The legislative challenge is to resist the pressure that has been injected by religious leaders and to act in accordance with the values and principles adopted by the community in the Mexican Constitution. In the final analysis, Mexico faces particular difficulties in accommodating conservative political forces on one hand, while recognising on the other its need, as an emerging economy, to promote a progressive approach to innovation in biotechnology. Introduction Hospital delirium is a frequent, serious, costly, and underrecognized acute disorder of attention and cognition. Therefore, the prevention of hospital delirium is not only desirable for patients, caregivers, healthcare professionals, and the health system itself, but also a moral duty. Objective To identify and synthetize the main ethical aspects that arise related to the prevention of hospital delirium in patients 65 years and older. Methods A scoping review was carried out in Embase, Medline, and Web of Science. Articles published (...) in English or Spanish analyzing any pharmacologic, non-pharmacologic, or multicomponent intervention for prevention of delirium in hospitalized patients aged 65 years and over were included. Results Twenty-seven studies were included. Based on the frequency of appearance and the relevance, our findings were organized into three main areas. The first one was related to the principle of nonmaleficence and collected findings about the iatrogenic causes of hospital delirium and the use of restraints systems. The second area analyzed the impact of delirium in patients, families, and healthcare professionals from a relational ethics perspective, and addressed the family presence as a factor to prevent delirium. Finally, the third area is related to the quality of care. Conclusion Prevention of delirium in hospitals is essential to avoid the discomfort and potential clinical complications of patients, as well as the suffering of their relatives, caregivers, and healthcare professionals. Policymakers and healthcare managers are encouraged to make the required efforts to prevent delirium in hospitalized older patients. (shrink)

This article provides current Schwartz Values Survey data from samples of business managers and professionals across 50 societies that are culturally and socioeconomically diverse. We report the society scores for SVS values dimensions for both individual- and societallevel analyses. At the individual- level, we report on the ten circumplex values sub- dimensions and two sets of values dimensions. At the societal- level, we report on the values dimensions of embeddedness, hierarchy, mastery, affective autonomy, intellectual autonomy, egalitarianism, and harmony. We discuss a recent approach to investigating cognitive control, which has the potential to deal with some of the challenges inherent in this endeavour. In a model-based approach, the researcher defines a formal, computational model that performs the task at hand and whose performance matches that of a research participant. The internal variables in such a model might then be taken as proxies for latent variables computed in the brain. We discuss the potential advantages of such an approach for the (...) study of the neural underpinnings of cognitive control and its pitfalls, and we make explicit the assumptions underlying the interpretation of data obtained using this approach. After presenting a brief history of philosophy in Hispanic-America since the XVI century, we discuss whether the idea of province and empire is applicable to contemporary Hispanic-American philosophy, investigate the form these ideas adopt in this region, and inquire into the ways in which provincialism i s present in philosophical work. Background Changes in health needs led to an increase in virtual care practices such as telemedicine. Nursing plays an essential role in this practice as it is the key to accessing the healthcare system. It is important that this branch of nursing is developed considering all the ethical aspects of nursing care, and not just the legal concepts of the practice. However, this question has not been widely explored in the literature and it is of crucial relevance in the new (...) concept of care. Objective The purpose of this scoping review is to identify the ethical aspects of the development of telemedicine from a nursing practice perspective. Methods A scoping review of the literature based on Arksey and O’Malley’s framework. The search was conducted in Scopus, PubMed/MEDLINE and CINAHL databases, from 2012 to 2022. A total of 1322 articles were retrieved, of which 12 met the inclusion criteria. Ethical considerations The research was conducted in accordance with the best scientific practices. Findings The most relevant aspects were the safety of the patient, the benefits for the user and the digital competence of the professionals. Informed consent and patient’s willingness to use new technologies were relevant to the practice, as was person-centered care and how telemedicine can influence the quality of the therapeutic relationship. Another relevant issue was the concern about professional competence for optimal outcomes. Conclusion It is necessary to further explore and develop the ethical aspects of the new practices, disassociating them from the legal aspects only. Professionals demand more training providing them with more competence and confidence. (shrink)

There is increasing interest in determining what impact having women in management positions may have on corporate social responsibility initiatives. Various authors suggest that gender equality practices should be factored into the broader framework of CSR. This paper examines how the presence of women on corporate boards, in top and middle management and as heads of CSR departments, influences gender equality practices in the field of CSR. Using information collected from companies that have signed up to Women's Empowerment Principles in (...) Spain, we show that the presence of women in the aforesaid posts has a positive impact on CSR activities with gender equality objectives. We thus supplement the justice, business and moral arguments with further arguments in support of the incorporation of women into not only corporate boards but all management positions. Finally, we provide a view of how gender equality can be included in the broader framework of CSR. (shrink)

This essay articulates a double helix at work in Badiou’s thought on politics as a condition of philosophy and philosophy as such by focusing on what Badiou calls “the Idea of communism” and we will call “the communism of the Idea.” The former refers to communism as an Idea par excellence, while the latter concerns the Idea as a philosophical communism. The first section of the essay unpacks the Idea of communism as a composite interaction of politics, history, and subjectivity (...) insofar as each of these elements cannot be taken in themselves. Contrary to post-ideology, Badiou condemns the claim that we should live without an ideological framework insofar as this asks us to live without an Idea. The second section will focus on the communism of the Idea as the result of Badiou’s broader philosophical project and its major Platonic gestures. Badiou’s broader concerns pertain to the commitment to live with an Idea as finite, infinite, and transfinite to the endpoint that philosophy itself is characterized to be destined for communism. The crux that anyone can become a serious philosopher if, to paraphrase Diotima in Plato’s Symposium, they gracefully lend themselves to the process of truths as their fundamental commitment. This article explores the philosophy of Alain Badiou from the vantage point of the concepts of the localization, delocalization, and relocalization of the void as thematized through literary arts, religion, emancipatory politics, and the subject of psychoanalysis. In short, these moments around the void characterize the processes through which truth is processed and seen through their full realization by a philosophical engagement across the various conditions in which these truths occur. The localization of a void is the naming of an (...) indiscernible element that is incommensurable to the rubric of constructible knowledge, sense and meaning which could saturate the space of truth. Thus, the naming that localizes the void acts as a subtraction of the invariant in the variance of situation such that across various points in space and time, we are still able to subtract the universal as the invariant not just as the fidelity to the localized truth but also as the resurrection of truth upon its relocalization at a different place and a different time. At its core, this article is concerned with truth, why truth is persistent, and why we have to struggle to articulate the truth that we are trying to be faithful to again and again with each instance that truth risks being covered-over and obscured. Automated legal reasoning and its application in smart contracts and automated decisions are increasingly attracting interest. In this context, ethical and legal concerns make it necessary for automated reasoners to justify in human-understandable terms the advice given. Logic Programming, specially Answer Set Programming, has a rich semantics and has been used to very concisely express complex knowledge. However, modelling discretionality to act and other vague concepts such as ambiguity cannot be expressed in top-down execution models based on Prolog, and in (...) bottom-up execution models based on ASP the justifications are incomplete and/or not scalable. We propose to use s(CASP), a top-down execution model for predicate ASP, to model vague concepts following a set of patterns. We have implemented a framework, called s(LAW), to model, reason, and justify the applicable legislation and validate it by translating (and benchmarking) a representative use case, the criteria for the admission of students in the “Comunidad de Madrid”. The concept of vital force – the immanent energy that promotes the processes of life in the body and in nature – has proved a source of endless fascination and controversy. Indeed, the question of what vitalizes the body has haunted humanity since antiquity, and became even more pressing during the Scientific Revolution and beyond. Examining the complexities and theories about vital force in Spanish modernity, Nicolás Fernández-Medina's Life Embodied offers a novel and provocative assessment of the question of (...) bodily life in Spain. Resumen: Este artículo estudia el poder de la visualidad en la política. Entre aquello que está permitido ver y aquello que está prohibido mostrar, el régimen escópico se define por la intervención del poder institucional respecto de la mirada del espectador. Este estudio se desarrolla entre la tradición filosófica y otras aportaciones multidisciplinares (estudios visuales, comunicación social, estética, historia del arte, teoría del arte) que evidencian a) el control político en los regímenes escópicos de la mirada del espectador; b) la (...) consolidación de una cultura visual que condiciona el modo de vida de los individuos y las sociedades; c) el dominio del espacio social por medio de la regulación del espacio visual; y d) la manipulación de los afectos por medio de la experiencia visual. En este estudio destacamos la apertura de la consciencia crítica en la modernidad a la estetización de la política. Abstract: This article studies the power of visual aesthetics in politics. Between what is allowed to see and what is forbidden to show, the scopic regime is defined by the intervention of institutional power on the viewer's gaze. This study is developed between the philosophical tradition and other multidisciplinary contributions (visual studies, social communication, aesthetics, art history, art theory) that show a) political control in the scopic regimes of the viewer's gaze; b) the consolidation of a visual culture that conditions the way of life of individuals and societies; c) the domain of social space through the regulation of visual space; and d) the manipulation of affects through visual experience. Se concentra en dos modos en los que esa relación y tensión entre identidad y diferencia se expresa y es considerada: la unidad conceptual y la multiplicidad sensible; la identidad del yo y la temporalidad.This article proposes a (...) reading of Kant’s Dog and the way that philosophy and literature are at stake in this book under the light of the problem of the relationship between identity and difference as addressed in Kantian criticism. Se trata de examinar el rendimiento del concepto de “ejecutividad” en la obra de Ortega y Gasset, en dos momentos clave: en 1914, cuando formula el programa de su filosofía de la razón vital en Meditaciones del Quijote y en los cursos de los años treinta, cuando inicia el despliegue de su filosofía de madurez, asumiendo las implicaciones historicistas de la razón vital. En el breve escrito “Ensayo de estética a manera de prólogo” reflexiona sobre un problema del arte sumamente (...) concreto: ¿qué cosa es el objeto de la estética? La respuesta le llevará a conectar un esbozo de teoría de la metáfora con cuestiones de epistemología y de filosofía primera. Y, lo que es más importante: Ortega se sirve aquí de tres conceptos llamados a tener en el desarrollo posterior de su obra una formulación decisiva: ejecutividad, intimidad y presencia. Esta es la razón de que persigamos el despliegue de dichos conceptos en las formulaciones de la vida humana y del yo personal cuando intente la sistematización de su filosofía en los referidos cursos de los años treinta y en las publicaciones a ellos asociadas.I will examine the concept of “executivy” in Ortega’s work in two important moments: in 1914 when he formulates the program of his philosophy of vital reason in Meditaciones del Quijote and in the courses of the 1930s when he initiates the unfolding of his late philosophy which assumes the historicist implications of vital reason. In the short essay “Ensayo de estética a manera de prólogo” he reflects about a problem in art that is extremely concrete: What is the object of aesthetics? The answer will take him to link an outline of a theory of metaphors with issues of epistemology and his primary philosophy. And, what is most important, Ortega uses three concepts that will have a decisive role in his later work: executivity, intimacy, and presence. This is the reason why I examine the unfolding of these concepts in the formulations of human life and of the I when he attempts the systematization of his philosophy in the said courses of the 1930s and the publications associated with them. Many of the actual bioethical discussions start from the assumption that we have absolute dominance/disposition over our body. Based on the thesis of autonomy, control over one's own life and the freedom to do anything, at least with one's body, the goodness or legitimacy of acts such as suicide and euthanasia are often justified. Considering the last statements, this paper seeks to approach the question of the nature of the disposition –main attribute of dominion or property– over the body. It (...) will be argued on the basis of Thomas Aquinas' theory and Immanuel Kant's exposition, often wrongly considered, in my opinion, as rival doctrines. Et comment remédier aux fractures qu'ils provoquent, sans pour autant imposer des dogmes (absolutisme) ni renoncer au discours critique (relativisme)? Le philosophe Alain est rarement considéré comme un penseur politique de premier plan. À tort. Ses réflexions en la matière, nombreuses, sont beaucoup plus profondes et autrement plus originales qu'on ne le croit généralement, et l'inventeur des Propos est bien davantage que le simple « philosophe du bonheur pour classe terminale » qu'on a coutume de présenter - et de citer, beaucoup plus que de lire. Circonstance aggravante, sa philosophie politique, quoiqu'authentiquement démocrate, apparaît dans le même temps viscéralement individualiste et (...) libérale ; ce qui s'avère être une tare rédhibitoire aux yeux de beaucoup d'intellectuels français, et ce qui a certainement joué un rôle non négligeable dans l'oubli presque complet dans lequel est tombé cet aspect de son oeuvre au XXe siècle, c'est-à-dire à l'époque tragique des totalitarismes et de l'État-roi. Or, c'est précisément cette dimension de la pensée d'Alain que nous entendons ici mettre en valeur, avec l'intime conviction que cette oeuvre politique a encore beaucoup de choses à nous apprendre et qu'elle mérite sans le moindre doute de figurer au panthéon des plus grands classiques de la pensée libérale. Justice for children meets specific obstacles when it comes to its realization due not only to the nature of rights and the peculiarities of children as subjects of rights. The conflict of interests between short-term and long-term aims, and the different interpretations a state can do on the question concerning how to materialize social rights policies and how to interpret its commitments on social justice play also a role. Starting by the question on why the affluent states do not seem (...) to be motivated enough to fully assume those duties of justice toward children —derived form recognizing children’s rights—, this article aims to explore and shed light on what psychology of motivation and moral psychology, and positive approaches could offer in relation to political and ethical challenges toward childhood. Hence this article advocates for the modification and enrichment of the philosophical discourse on children’s rights with what psychology has proved to have a more efficient impact in agents’ action and motivation. In doing so, practical philosophy could improve its role helping understand and eventually surpassing some akratic tendencies in the public sphere with respect to children’s rights. (shrink)

The well known conference of Paul Ricœur ‘Love and Justice’, pronounced when he received Leopold Lucas award in 1989, shows a dialectical tension between those two notions, and searches deeper in the philosophical –and even theological– basis that reveals love as rectification and safeguard of justice; without love, justice would be cruel, utilitarian and, paradoxically, unfair, remembering us the old Roman adage: “summum ius, summa iniuria”. Moreover, Levinas, in his “Talmudic Lesson on Justice”, compiled after in New Talmudic Readings, presents (...) a less intuitive position, but no less interesting: justice is the place of forgiveness and love, it becomes humane everything it touches, and that’s why it doesn’t need correction; a justice that needed love, had maybe never been true justice. Here lies a critic that complements and improves both, the theory exposed by Paul Ricœur and its Rawlsian basis. (shrink)

Ce livre a pour ambition de penser l'amour, d'en produire une pensée contemporaine. A cet effet, il articule deux axes a priori divergents. Il présente d'abord une lecture inédite des trois grandes pensées contemporaines sur l'amour : celles d'Emmanuel Levinas, de Jacques Lacan et d'Alain Badiou. Il développe ensuite une élaboration singulière qui traverse les très anciens enseignements du judaïsme biblique et talmudique. Il ne s'agit pas pour Jérôme Benarroch d'exposer une pensée historiquement reconnue du judaïsme sur le sujet, mais (...) de proposer une théorie de l'amour formulée dans le langage de la pensée contemporaine, à l'école de ses enjeux et questionnements. La méthode de cette élaboration consiste en un dialogue de la philosophie et de la psychanalyse avec ces divers et parfois paradoxaux enseignements traditionnels. Malgré leur hétérogénéité indiscutable, les pensées de Levinas, de Badiou et de Lacan partagent un même geste, qui apparaît presque comme une constante de la contemporanéité : le rejet de la figure de l'Un. Le livre soutient la thèse qu'en amour, l'Un n'est pas, mais qu'il doit advenir. Que l'unicité de chacun - de chaque sujet amoureux - advient par l'effort d'une construction éperdue de l'Un de l'amour. (shrink)

The happiness of non-identity: Michel Foucault’s search for self-loss beyond modern and Christian confession This article focuses on Michel Foucault’s notion of a ‘happy limbo of non-identity’, formulated in his epilogue to the diary of the ‘hermaphrodite’ Barbin (1838-1868). From the eighteenth century onwards, the incitement to put sex and gender into discourse has limited this freedom to be indeterminate. Using The Will to Knowledge and Confessions of the Flesh, Part I and IV of Foucault’s History of Sexuality, this article (...) describes five main features of modern and early Christian confessional practices. What similarities and differences are there? What is constituted and lost in these practices? Using Foucault’s suggestions in essays to enjoy sexual and other pleasures without confessing, it shows that he decouples ‘self-loss’ from negative Christian self-denial as well as from positive, modern self-constitution. Self-loss thus becomes the moment in which the self can transcend itself and explore new modes of subjectivation. (shrink)

En este trabajo se expone el debate entre Neurath y Horkheimer como ejemplo de recuperación de los aspectos políticos del Círculo de Viena, olvidados en la visión tradicional, que ayudarán a tener una mejor comprensión de las diversas posiciones de los miembros del Círculo. Se intenta mostrar que gran parte del debate se debe a las diferencias políticas entre los contendientes y a sus diferentes concepciones sobre la filosofía, la ciencia y la razón, pero no a la falta de intereses (...) políticos de Neurath y del Círculo de Viena. In this work we will summarize the Neurath-Horkheimer debate as an example of the recovery of the Vienna Circle's political aspects that were forgotten in the traditional view, so as to achieve a better understanding of the different positions assumed by the Circle's members. Our intention is to show that much of this debate stems from their political differences and the contenders' diverse conceptions of philosophy, science and reason, but not from the lack of political interests in Neurath and the Vienna Circle. Answers to the question, “What is a farm animal?” often revolve around genetics, physical attributes, and the animals’ functions in agricultural production. The essential and defining characteristics of farm animals transcend these limited models, however, and require an answer that avoids reductionism and encompasses a de-atomizing point of view. Such an answer should promote recognition of animals as beings with extensive mental and social capabilities that outline the extent of each individual animal’s existence and—at the same time—define the animals as (...) parts of wholes that in themselves are more than the sum of their parts and have ethological as well as ethical relevance. To accomplish this, the concepts of both anthropomorphism and sociobiology will be examined, and the article will show how the possibility of understanding animals and their characteristics deeply affects both ethology and philosophy; that is, it has an important influence on our descriptive knowledge of animals, the concept of what animal welfare is and can be, and any normative ethics that follow such knowledge. Social network sites are a new communication channel to convey CSR information. They are interactive channels that let users participate, spread content and generate positive and negative electronic word-of-mouth about companies that can dramatically affect their reputation and future business. To identify the factors behind this behaviour, we designed a causal model to explain the intention to both comment on and share a negative corporate social responsibility news posted on Facebook. We included the following as explanatory variables: social consciousness, environmental (...) consciousness, information usefulness, corporate image and attitude towards sharing and commenting on CSR news. We surveyed 208 Facebook users who evaluated a fictitious news item about an environmental issue. We observed that social and environmental consciousness influences the usefulness of information and the attitude towards behaviour, which may explain the eWOM intention of the specific news. However, corporate image can cause people to refrain from generating eWOM and spreading the news on their friend social network. (shrink)

Arrivé à un stade de ma vie qui m'engage à prendre du recul, je voudrais témoigner dans ce livre d'un certain sentiment de spiritualité, qui a émergé de mes recherches pour comprendre l'ordre caché des choses et le sens secret de la nature. Ce sentiment est né d'un émerveillement et d'une révélation sur la simplicité des codes naturels qui conduisent au jaillissement, dans l'espace et dans le temps, de formes d'une extrême diversité et d'une grande beauté. Une morphogenèse qui a (...) passionné des penseurs comme Pythagore, Benoît Mandelbrot ou Alan Turing, et qui se poursuit par le travail et l'oeuvre des hommes. Ce travail est désormais mis en cause par les extensions du corps et du cerveau humains que représentent l'intelligence artificielle et les robots... Aujourd'hui, il devient plus difficile de prédire les évolutions exponentielles auxquelles nous sommes confrontés dans les domaines scientifique, technologique, économique et politique. Mon message vise à alerter les prospectivistes, les politiques, les économistes, les scientifiques, non seulement sur la vitesse de ces évolutions, mais surtout sur les interdépendances émergentes entre intelligence artificielle, robotique, travail humain et modifications de l'" ADN " d'Internet. Mal comprises, ces évolutions peuvent engendrer des mouvements tels que le transhumanisme. Mieux intégrées à nos réflexions, elles peuvent en revanche mener à une nouvelle étape de l'évolution de l'humanité... (shrink)

The article develops, in a Hegelian key, a possible explanation of the role that the Protestant idea of subjective autonomy plays in the shaping of the American political imaginary, and its respective paradigm of democracy. The starting point is an important indication by James Doull, later developed by David Peddle, on the notion of internal consent for the acceptance of political institutions, originally formulated within the Calvinist tradition of the Covenant. In my opinion, this observation is correct but insufficient to (...) fully explain the conformation of the imaginary of the sovereignty of the Demos. Following Doull's own line, whose examination projects Hegelian philosophy, what is required, in my opinion, is to investigate the specific type of experience of American consciousness in the colonial period from the perspective of analysis that Hegel develops in the Phenomenology of the Spirit. À la fin du xixe siècle, l’armée française se présente comme la grande école censée transmettre aux conscrits les valeurs du « modèle militaro-viril ». Mais les soldats ont-ils toujours retenu cette « leçon de virilité »? Poser la question revient à s’interroger sur les réceptions différenciées de ce modèle en s’inspirant de quelques principes méthodologiques posés par les gender studies. Car avant d’être une représentation valorisée de masculinité, le modèle militaro-viril est une catégorie de genre dont l’usage s’inscrit dans (...) un rapport de force, qu’il s’agisse de justifier l’obéissance militaire, la domination masculine, raciale ou sociale. Ce modèle ne peut donc être considéré comme une représentation uniforme transmise à l’ensemble du contingent mais bien comme le produit toujours singulier d’une relation de pouvoir visant à naturaliser certains effets de domination et à susciter un désir d’identification. This paper offers a sympathetically critical discussion of one of the central features of Neil MacCormick’s last book, Practical Reason in Law and Morality (2008), namely, what he called ‘the Smithian Categorical Imperative’ (SCI). The SCI is presented by MacCormick as a synthesis of the best of Immanuel Kant and Adam Smith’s contributions to moral philosophy. The paper proceeds in three parts: the first two are dedicated to articulating and evaluating MacCormick’s understanding of Kant and Smith. The focus in these (...) two parts is on the following concepts: autonomy and universality in the case of Kant, and imagination and sympathy in the case of Smith. The third part then discusses the formulation and two applications of the SCI, the first of these relates to the practice of lying and breaking promises, and the second to the conjoined twins’ case. It is argued that MacCormick’s rapprochement between Kant and Smith in the form of the SCI is a genuinely important and original contribution to moral philosophy, and has important implications for theories of legal judgement. Nevertheless, the paper also considers whether, by modifying MacCormick’s interpretation of Kant and Smith (and especially the latter), we may be able to further extend MacCormick’s characteristically generous capacity to tread a middle path between otherwise antagonistic theoretical traditions. Este artículo es producto de una reflexión etnográfica sobre el proceso de cambio sufrido por una cultura del trabajo asociada a la explotación del carbón y su vinculación con la ciudad de Lota, ubicada en el centro sur de Chile, la que se constituye comohabitacional y de servicios junto con el desarrollo de la monoindustria desde la segunda mitad del siglo XIX. Por una parte, se analiza cómo, desde la condición laboral, social y de vida de los trabajadores y la (...) población, se configura un sujeto histórico con identidad laboral y de clase, el que genera un discurso teleológico que da paso a una visión utópica durante el ciclo de vida de la explotación del mineral. Por otra, se analiza cómo el fin de la explotación del mineral en 1997, tras el cierre de los yacimientos, hace que los sujetos transformen su utopía en ucronía; es decir, cómo el fin de la narrativa que movilizaba las acciones genera una temporalidad alternativa que no tiene tiempo real, lo que revela las dificultades para reestructurar la biografía y memoria de una comunidad especializada. This article is the result of an ethnographic observation of the process of change undergone by a labor culture associated to the coal mining and its relationship with the city of Lota, located in the center South of Chile a city that has been constituted as a residential and services center along with the development of the monoindustry, from the second half of the nineteenth century. On one hand, it analyzes how this has shaped an historical subject with labor and class identity considering the working, social and living conditions of the mining workers and the population. This historical subject generates a teleological discourse that leads to a utopianist vision during the service life of the mineral´s exploitation. On the other hand, we analyze how the end of the mining activity in 1997, after the coal mine´s closing, causes the subjects to transform their utopia into uchronia; that is to say, how the aim of the narrative that addressed the actions generates an alternative temporality that has no real time, which reveals the difficulties to reconstruct the biography and memory of a specialized community.
