Many have contended that non-classical logicians have failed at providing evidence of paraconsistent logics being applicable in cases of inconsistency toleration in the sciences. With this in mind, my main concern here is methodological. I aim at addressing the question of how should we study and explain cases of inconsistent science, using paraconsistent tools, without ruining into the most common methodological mistakes. My response is divided into two main parts: first, I provide some methodological guidance on how to approach cases (...) of inconsistent science; and second, I focus on a peculiar type of formal methodologies for the scrutiny of inconsistent reasoning, the _Paraconsistent Alternative Approach_ (henceforth, PAA) and argue that PAA can enhance a more accurate understanding of sensible reasoning in inconsistent contexts. Recently there has been a tendency on the part of some scientific realists to weaken their philosophical theses with respect to the success of science. Some of them have suggested that a satisfactorily realist standpoint should be a highly modest approach to scientific success, leaving many with the impression that scientific realism nowadays is nothing that we once thought it was. In light of that, the main concern of this paper is methodological, here I want to answer the question how (...) far can we push the boundaries of our realist commitments and still be in control of our philosophical claims. In particular, I deal with the issue of how a certain type of weak version of selective realism will necessarily allow for true contradictions, dialetheias –even if that is not desirable. Here I argue that if one presents a very weak characterization of selective realism, one that is in line with contemporary projects, this type of realism will not forbid the possibility of things such as dialetheias. I also claim that, if that is the case, we face the following dilemma: or our general characterization of selective realism is mistaken or selective realists cannot provide a satisfactory explanation of why and how to forbid dialetheias in science. Inconsistency toleration is the phenomenon of working with inconsistent information without threatening one’s rationality. Here I address the role that ignorance plays for the tolerance of contradictions in the empirical sciences. In particular, I contend that there are two types of ignorance that, when present, can make epistemic agents to be rationally inclined to tolerate a contradiction. The first is factual ignorance, understood as temporary undecidability of the truth values of the conflicting propositions. The second is what I call “ignorance (...) of theoretical structure”, which is lack of knowledge of relevant inference patterns within a specific theory. I argue that these two types of ignorance can be explanatory of the scientists’ rational disposition to be tolerant towards contradictions, and I illustrate this with a case study from neutrino physics. Two of the most important outcomes of The Contradictory Christ include: identifying Christ as an unproblematically contradictory being as well as laying the foundations of an investigation of the logical consequences of the existence of Christ, qua contradictory, within a particular 'theory'. In light of the enormous reluevance of Beall’s The contradictory Christ for the study of inconsistency, my main concern here is to explore the effect of some methodological choices behind Beall’s proposal -this in order to recognize in more (...) detail the scope of Beall’s contribution. To do so, I will focus on three main questions: 1. What is required for the identification of a contradiction? 2. How can we recognize a true contradiction from either an apparent or a temporal contradiction? 3. If we identify a true contradiction within a theory, where can we actually go from there? (shrink)

It has recently been argued by Davey (2014) that inconsistency is never tolerated in science, but only discretely isolated. But when talking about inconsistencies in science, not much attention has been paid to the inconsistencies between theory and observation. Here I will argue that inconsistency toleration actually takes place in science, and that when we examine actual inconsistent theories, inconsistencies between theory and observation look anything but homogeneous. I will argue, appealing to certain properties of empirical theories, especially holism, that (...) at least two sub-types of inconsistencies regarding theory and observation can be distinguished: those that satisfy a criterion of observational independence and those that do not. Like theories, reconstructions of episodes in the history of science can possess, or lack, certain virtues such that, when we face two or more different reconstructions of the same episode, we assume that we should choose the most “virtuous one”. However, we will argue that, with dissimilar reconstructions of the same episode, it is not always necessary to separate the “good ones” from the “wrong ones”, and that, as a matter of fact, each reconstruction could provide different but perhaps equally (...) relevant data about the episode, about science in general, and about particular philosophical theses. In order to help us to identify these benefits, we will present a criterion that guides the search for historiographical reinforcement of philosophical theses and we will use it to evaluate three different reconstructions of the same scientific episode. Nowadays there is a growing tendency in the philosophy of science to think that some phenomena cannot be exhaustively explained, or even described, by a single theory or a particular approach. Thus, we are occasionally required to use various approaches in order to give account of the phenomenon we are analyzing. And sometimes, we can appreciate this as an invitation to be pluralist in certain respects about our understanding of a particular aspect in science. -/- During the last decade applications (...) of pluralism have increased and led to several other relevant debates in the philosophy of science. By the strengthening of pluralism, new questions have emerged, and more importantly, new alternatives have been offered in dealing with problems about how to interpret the ontology and the ontological commitments of particular theories, or how to apply strategies to analyze and understand specific episodes from the history of science, or how to work within different, and sometimes incompatible, explanations about a particular phenomenon, among others. In general, pluralism seems to be a very rich and yet not enough explored path for the philosophy of science in general. -/- Today, it is recognized that, at least for methodological purposes, the application of pluralism to the study of science can offer a great number of benefits. One of them would be the opportunity of analyzing the role that some epistemic virtues -such as scope, fruitfulness, consistency, and simplicity, to name just a few- play in the scientific activity. From the different pluralist positions, a lot has been said about empirical adequacy, refutability and explanatory power yet consistency power, yet, consistency has not been equally dealt with. -/- As a matter of fact, the lack of consistency and its philosophical implications have been studied from an angle that does not necessarily involve a pluralism of any kind. At the moment, it is commonly accepted that inconsistencies are more frequent in scientific development that the traditional philosophy of science could have expected and the idea that inconsistency is not always a synonym of logical anarchy, as it was suggested in the classical literature of logic and the philosophy of science, has been gaining support. All this has been possible, mostly, thanks to the emergence of paraconsistent logics and the availability of case studies that show how inconsistency is not an uncommon phenomenon in science. -/- But pluralism does not necessarily entail inconsistency toleration nor vice versa. Accordingly the main motivation for this volume is to explore the links between pluralism and inconsistency toleration in science, in order to connect the reflections on inconsistency toleration with broader and major issues in philosophy of science. In order to do so, we will suggest two different lines of investigation: first, to focus on the implication of some pluralistic accounts in the philosophy of science, regarding inconsistency; and second to analyze the implications of some paraconsistent approaches regarding pluralism in science. Most scientific theories are globally inconsistent. Chunk and Permeate is a method of rational reconstruction that can be used to separate, and identify, locally consistent chunks of reasoning or explanation. This then allows us to justify reasoning in a globally inconsistent theory. We extend chunk and permeate by adding a visually transparent way of guiding the individuation of chunks and deciding on what information permeates from one chunk to the next. The visual representation is in the form of bundle diagrams. (...) We then extend the bundle diagrams to include not only reasoning in the presence of inconsistent information or reasoning in the logical sense of deriving a conclusion from premises, but more generally reasoning in the sense of trying to understand a phenomenon in science. This extends the use of the bundle diagrams in terms of the base space and the fibres. We then apply this to a case in physics, that of understanding binding energies in the nucleus of an atom using together inconsistent models: the liquid drop model and the shell model. We draw some philosophical conclusions concerning scientific reasoning, paraconsistent reasoning, the role of logic in science and the unity of science. (shrink)

It is shown that in a linearly ordered MV-algebra A , the implication is unique if and only if the identity function is the unique De Morgan automorphism on A . Modulo categorical equivalence, our uniqueness criterion recalls Ohkuma's rigidness condition for totally ordered abelian groups. We also show that, if A is an Archimedean totally ordered MV-algebra, then each non-trivial De Morgan automorphism of the underlying involutive lattice of A yields a new implication on A , which is not (...) isomorphic to the original implication. En el presente artículo se hace un recorrido por la idea de comunidada través de algunos pensadores contemporáneos que han tratado de repensar el estar en común asumiendo algunas de sus paradojas. Para autores como Roberto Esposito, Jean-Luc Nancy y Giorgio Agamben, pensar “la comunidad” implica reflexionarla a partir de las paradojas y contrasentidos que contiene, tanto anivel conceptual como a nivel de la realidad cotidiana. La paradoja central que resume tales contrasentidos es la que afirma que la comunidad es (...) realizable solo en la medida en que no lo es. Cercana a la paradoja de Russell, tal aporía nospermite reconocer la diferencia entre una comunidad que se hace cargo de sus contrasentidos e incoherencias, la comunidad de la crisis, y otra que al concebirse en términos unívocos y absolutos, es decir, que no se hace cargo de sus antinomias y contradicciones, nos lleva a lo que hemos llamado crisis de la comunidad. La recepción durante el siglo XX se preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa. Twentieth-century readers wondered if Nietzschean philosophy was apolitical, (...) impolitic, or anti-political; that is, if it could be assimilated by democracy or if it was antimodern, elitist, and reactionary. The Italian philosopher Robert Esposito has proposed reading Nietzsche's philosophy as forming and informing the biopolitical paradigm. Four readings of these biopolitics are discussed: as part of the paradigm of immunity, as thanatopolitics, as liberal and neoliberal, and as affirmative biopolitics. (shrink)

El caso Mendez v. Westminster es de suma trascendencia en el desarrollo del derecho a la igualdad y la supresión de la segregación racial. El caso propició la modificación de las leyes del Estado de California, aumentando el acceso igualitario de los niños a la educación. Pero sin duda su mayor influencia fue sobre la sentencia del caso Brown v. Board of Education, cuyas directrices se cimentaron en las consideraciones y alcances del caso Mendez.

El artículo se propone analizar la relación entre violencia y ley en la filosofía temprana de Hegel, rastreando el concepto de positividad en los textos de juventud en paralelo con el análisis de la libertad absoluta y el terror en la Fenomenología del Espíritu. Se plantea como tesis central que las nociones de desaparición y terror, presentadas en este artículo como dos momentos, diferenciados, en el análisis de dicha figura de la conciencia en la Fenomenología, no son otra cosa que (...) las caras más extremas, llevadas hasta sus últimas consecuencias en el mundo práctico, de lo que Hegel en sus escritos tempranos había ya desarrollado como las dos caras de la positividad. Las herramientas conceptuales que Hegel desarrolla a lo largo de sus escritos de Frankfurt, y que son puestas a prueba en la Fenomenología, resultan útiles para comprender el aspecto crítico de lo que Hegel presenta como el riesgo de una violencia radical, alojada en el corazón de una interpretación paradigmáticamente moderna de la soberanía, y de sus desarrollos conceptuales e históricos en las nociones modernas de derecho y acción de Estado que la presuponen. El interés de la presente compilación es el de recoger algunas de las principales reflexiones del pensamiento político contemporáneo. Se propone como tarea central el examen y la problematización de algunos presupuestos extendidos en la tradición de la filosofía occidental. Por medio de este cuestionamiento, se busca desestabilizar asunciones que atraviesan nuestros modos habituales de concebir el sujeto, la acción y el espacio políticos, y de comprender la manera como estos son configurados por el lenguaje. Es así como una amplia (...) gama de autores encuentra un espacio común de discusión: la urgencia de plantear alternativas tanto crítica como de compresión de lo político, que permitan movilizar nuevas maneras de concebir la acción y la configuración de nuestros modos de ser en común; alternativas que incluso pueden encontrarse ya allí, a la sombra de lo político, en sus recodos escondidos, silenciados; en lugares o motivos que tal vez han pasado desapercibidos por no hacer parte de un discurso e interpretación dominantes. En particular, interesa aquí rescatar aquellas reflexiones que abordan esta tarea desde tres ejes temáticos concretos: la pregunta por la relación entre ley y violencia, la necesidad de repensar el ser en común, y, por último, el problema de cómo concebir los pasajes y discontinuidades entre la singularidad de la contingencia histórica, cultural, lingüística, y la posibilidad o promesa de lo universal. This essay presents a possible interpretation of the concept of beauty in Kant’s Critique of Judgment, which was itself suggested by Kant in the two introductionsto the text and gained force among the Early German Romantics and Idealists, introducing an alternative point of view into the concept of beauty and the role it plays in the relationship between reason and sensibility, man and world. Through the analysis of the four moments of the Analytic of the Beautiful, beauty will manifest itself (...) as the realm in which a special encounter between human freedom and nature takes place. Therefore, and as an alternative to some traditional interpretations of Kant’s aesthetic investigation, which understand Kant’s judgment of taste exclusively on the basis of its subjective conditions, the judgment of beauty will present itself also in the relationship it establishes with the objects of nature. This paper offers a brief reply to William Morgan’s critique of my review of Andrei Marmor’s Social Conventions . Morgan’s principal critique is that I am wrong to think that the constitutive rules of games do not determine their aims and values. In particular, with regards to chess, Morgan argues that the rules of chess determine that the aim of playing chess is to win the game. I defend my position that one can play the game of chess without the (...) aim of winning - e.g. one can aim to play beautifully, and not, as Morgan suggests, only to win beautifully. More broadly, I argue for an account of games that is sensitive to the gap between playing and the game’s constitutive rules. Ultimately, the argument points to the descriptive priority for the social sciences of the concept of ‘play’ over the concept of games understood as ‘rule-governed domains’. (shrink)

In order to illuminate the very complex relationship between ethics and politics in the thought of Jacques Derrida, this paper stages the (dis)encounter between Hegel's and Derrida's notion of forgiveness. It will be shown how for these two authors forgiveness is closely related both with certain ‘impossibility’, and with the disclosure of a condition for rethinking the ethico-political realm. Both Hegel and Derrida seem to suggest that forgiveness opens up a realm in which something must remain ‘absolute’, that is to (...) say, ‘intact, inaccessible to law, to politics, even to morals’. And, for both, it seems to be precisely there, where something arrives at the verge of politics, that a thinking (and a re-thinking) of the ‘political’ becomes possible. The paper explores what kind of impossibility is staged in each case, and how can each one bring into light the risks and limits, but also the scope and significance of the other. (shrink)

El presente artículo tiene como tarea principal señalar algunos aspectos que hacen pertinente a la hermenéutica dentro del marco de la discusión política, defendiéndola de los ataques que se le han propugnado sobre todo desde una fi losofía de la conciencia crítica como la de Habermas, Adorno y algunos de sus seguidores. Se mostrará, a partir de Gadamer, cómo la hermenéutica responde a dichas críticas en el marco de su propuesta de la comprensión como tarea fundamental y como espacio político (...) primordial. Frente a una fi losofía que apela a la necesidad de una “toma de distancia” como punto de partida de la crítica, único lugar de una verdadera fi losofía y acción políticas, la hermenéutica de Gadamer presenta una alternativa que vale la pena ser rescatada: es en el diá-logo, en el espacio compartido de la comprensión, más que en la crítica, donde el hombre des-encubre las posibilidades de lo que es, donde se da la apertura de su libertad, y, por consiguiente, donde se desenvuelve, en la acción, antes que en la refl exión, el espacio de lo político. This paper explores the way in which Agamben takes part in the dialogue on “impolitical communities” that was inaugurated by J. L. Nancy and was soon followed by authors like M. Blanchot, J. Derrida and R. Esposito, among others. Although Agamben’s ontological exploration of ‘whatever being,’ followed later by the political idea of form-of-life, are still very close particularly to Nancy’s work, the article will show in which ways Agamben’s view of a political coming community explores different paths and moves (...) in unusual registers, that help to understand in new ways the kind of inoperativeness involved in a contemporary rethinking of community. The notion of experience of thought as potentiality and its relationship to that “tiny displacement” of the world which Agamben seems to connect with his idea of a coming community will play a central role in the analysis. This paper proposes to reflect self-critically on an ongoing research project entitled “Grammars of listening,” which started as a philosophical approach to the question of listening at the site of trauma and the challenges this kind of listening poses to our conceptions of memory and history, and has recently shifted to asking about the possible limitations to such a reflection when confronted with a decolonial perspective on temporality. I start by presenting a conceptual background for my inquiry, and asking what (...) kind of listening is required when trauma is considered as a colonizing form of violence – that is, when its effects are not only understood as an assault on life but on the conditions of production of sense that make life legible. Following the kind of challenges that such an understanding of trauma poses to the responsibility to listen to its testimony, the paper moves on to propose that only a decolonial approach to listening can truly do justice to the task of rendering testimonies of traumatic violence audible. By decolonizing the frameworks that organize and determine colonial and colonizing distributions of sense, I propose that grammars of lo inaudito understood as decolonial grammars contribute to resisting and disorganizing the criteria for legibility and audibility that colonizing forms of violence not only institute but constantly actualize in their attempt to perpetuate their silencing power.1. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

This paper argues that the exercise of the imagination requires us 1) to attempt to describe features of a certain practice that appear, at first blush, natural and obvious; 2) to understand that that which appears natural and obvious could be otherwise; and 3) to be open to the introduction of changes to that which appears natural and obvious. Imagination, in this sense, is quite different to creativity. The latter works on the basis of the introduction of variations to settled (...) phenomena. This exercise of creativity is important, but ultimately, it contributes principally to the stability and identity of a community and reinforces its most firmly established features. Imagination, on the other hand, is more difficult, for it strikes at the very heart of that which is settled. Changes to that which is settled may not only be resisted, but may also be violently opposed. And yet, it is precisely the very ability and willingness to be open to such changes that may be of the most ethical and political significance. These differences between creativity and imagination are illustrated in the context of the practice of philosophy. (shrink)

This paper considers the similarities between Adam Smith's device of the impartial spectator and the use of perspectival devices in common law reasoning. The paper adopts a reading of Smith's device as one involving the exercise of imaginative sympathy by an ordinarily virtuous, and culturally and historically situated, spectator who does not have a stake in the outcome of the scene being evaluated. The point here is to show that the impartial spectator is 1) a device of common, ordinary virtue (...) – both in the sense of being located in a culture at a specific point in time, and in the sense of possessing only moderate, achievable virtues ; and 2) a device that enables a focus on a situation, which requires imaginative work, emotional engagement and careful, particularised description. Having so modelled Smith's device, the paper shows the similarities between it and the use of perspectival devices in common law reasoning, specifically here via the ‘right-thinking member of society' test in defamation law. This paper discusses a much-neglected aspect of Neil MacCormick's theory of legal reasoning, namely what he calls ‘consequential reasoning’. For MacCormick, consequential reasoning is both an omnipresent feature of legal reasoning in England and Scotland, as well as being a valuable one. MacCormick articulates the value of consequential reasoning by seeing it as contributing to the forward-looking requirement of formal justice, ie, of deciding the instant case on grounds that one is willing to adopt when deciding future similar cases. This (...) paper situates consequential reasoning in the overall picture of legal reasoning MacCormick develops in Legal Reasoning and Legal Theory, going on to show the evolution of his view on consequential reasoning in later work, which culminates in Rhetoric and the Rule of Law. It is argued that MacCormick's later view of consequential reasoning, ie, of a process of testing possible rulings by evaluating the acceptability or unacceptability.. (shrink)

This paper argues that concepts of legality in legal theory can be profitably understood as being underwritten by modes of spatio-temporal objectification. In the first part of the paper, a scheme of such modes is provided, and a map of jurisprudential inquiries is thereby offered. In the second part of the paper, two concepts of legality – underwritten by two different modes of spatio-temporal objectification – are analysed. The analysis shows how both concepts of legality lead to different sets of (...) prescriptive resources as to the evaluation and design of legal systems. Finally, it is argued that the response of legal theory to practical challenges within the public sphere cannot afford to be based on any one concept of legality. Rather, we need to be pluralists about concepts of legality, recognising the limitations of any one such concept – represented, in this paper, by way of spatio-temporal objectification that underwrites those concepts. A crisis in legal theory can- not be claimed on the basis of any alleged lack of correspondence between any one concept of legality and reality. On the contrary, a crisis will ensue to the extent that legal theory becomes dominated by theoretical imperial- ism, namely, by the belief that any one concept of legality is capable of capturing the world as it is, and, therefore, also capable of standing as a foundation for a prescriptive agenda. The vice of theoretical imperialism in- duces anxiety over the identity of a discipline, and leads to a quelling of the very theoretical diversity that is required for an ethical response to the spe- cific complexity of the public sphere.Resumen:En este artículo se sostiene que los conceptos de legalidad, dentro de la teoría del derecho, pueden entenderse con mayor provecho si se piensa que están determinados por modos de objetivación espacio-temporal. En la primera parte se presenta un esquema de tales modos y, de esa manera, se ofrece un mapa de las investigaciones iusfilosóficas. En la segunda parte, se analizan dos conceptos de legalidad —determinados por dos modos diferentes de objetivación espacio-temporal—. El análisis muestra cómo ambos conceptos de legalidad conducen a diferentes conjuntos de fuentes prescriptivas para la evaluación y el diseño de los sistemas jurídicos. Finalmente, se sostiene que la respuesta de la teoría del derecho a los problemas prácticos del ámbito público no puede basarse en un solo concepto de legalidad. Por el contrario, es necesario ser pluralistas sobre los conceptos de legalidad y reconocer las limitaciones de cada uno de ellos —representados, en este ensayo, por la objetivación espacio-temporal que los suscribe—. No se puede asegurar que la teoría del derecho esté en crisis sobre la base de una presunta falta de correspondencia entre algún concepto de legalidad y la realidad. Por el contrario, aquella se generará en la medida en que la teoría del derecho llegue a estar dominada por un imperialismo teórico, a saber, por la creencia de que cualquier concepto de legalidad es capaz de capturar el mundo tal como es, y, por lo tanto, que es capaz de erigirse como fundamento para una agenda prescriptiva. El vicio de un imperialismo teórico induce una inquietud sobre la identidad de una disciplina, y conduce a sofocar la diversidad teórica que se requiere para dar una respuesta ética a la complejidad concreta del ámbito público. Critique has been a central theme in the German philosophical tradition since the eighteenth century. The main goal of this book is to provide a history of this concept from its Kantian inception to contemporary critical theory. Focusing on both canonical and previously overlooked texts and thinkers, the contributors bring to light alternative conceptions of critique within nineteenth- and twentieth-century German philosophy, which have profound implications for contemporary philosophy.
