L’objet de cette étude est de montrer les enjeux que posent aux droits de l’homme les lois bioéthiques de juillet 1994 en ce qui concerne l’application des biotechnologies à la reproduction. À cette fin, sont analysés des dispositifs juridiques mis en place dans la loi pour sélectionner des embryons et pour transformer leurs caractères génétiques. Ces résultats sont ensuite comparés aux procédés eugéniques employés en Occident dans la première moitié duxx e siècle. Cela conduit à récuser la catégorie d’eugénique pour (...) rendre compte du projet biopolitique des lois bioéthiques. En conclusion, il s’avère que les enjeux posés par cette législation aux droits de l’homme concernent le sort qu’elle a réservé à la notion d’homme et de sujet de droit. (shrink)

O mundo contemporâneo é o do exílio e não o da pátria, o da errância e não o do lugar. Razão pela qual nosso tempo foi denominado de “século breve”, em que os acontecimentos e os desaparecimentos de modos de vida e valores são acelerados, não permitindo o repouso para constituição de uma memória reparadora. Exílio, expatriamento e dispersão espacial são, pois, o emblema das migrações forçadas por guerras, perseguições políticas e diferentes formas de conflito, que produzem a “nostalgia do (...) inteiramente outro” diante da “vida mutilada”. Assim, a diferença entre duas figuras: a da viagem e a da partida, a odisseia e o êxodo, uma que vive no horizonte de um retorno, outra que anseia por uma pátria que não existe mais. A viagem contemporânea para uma terra de exílio tem algo de enigmático, pois populações inteiras atravessam os mares, assombradas pelos naufrágios e pela incerteza da chegada ou do encontro de um não lugar. Herdeiro problemático de um duplo trauma – o do extermínio dos judeus europeus durante o nazismo e, simultaneamente, o da expulsão dos palestinos de sua terra com a criação do Estado de Israel – Edward Saïd, um dos mais importantes intelectuais palestinos, refletiu sobre a questão da identidade em situações de exílio e estranhamento cultural, procedendo a uma genealogia do sentimento de desorientação, desrealização e perda de si que o exílio produz. Pois se, antes, cada um de nós tem o conforto de paisagens conhecidas, o aconchego do mundo entre os seus, o país estrangeiro representa a passagem do conhecido ao desconhecido, significa o enfrentamento de um incerto acolhimento, com incompreensões, desprezo e hostilidade do lugar a que se chegou. Reunindo, assim, sua formação de scholar em literatura nos Estados Unidos e de musicólogo e pensador geopolítico, Edward Saïd refletiu sobre a construção de um Oriente pelo Ocidente, pelo medium de escritores nos quais há a personagem fantasmada do Outro. Le présent article part d’une proposition de Giorgio Agamben issue du livre La communauté qui vient, consistant à penser une communauté non appropriable, c’est-à-dire, une communauté pour des individus ontologiquement indéterminés et qui ne pouvant pas être appropriés par les appareils du pouvoir. En ce sens, nous essayons de montrer comment la formation sociale conçue par Agamben peut dialoguer avec l’idée de multitude de Michael Hardt et Antonio Negri. À cette fin, sont exposées les similitudes entre la communauté « qui (...) vient » de Agamben et la multitude. En séquence, nous discutons le rôle individualisant de la loi et de la politique occidentale, comprises comme mécanismes hiérarchiques dont la fonction est précisément d’empêcher l’émergence de la multitude. A relação entre filosofia e cinema está cada vez mais presente nas reflexões dos filósofos contemporâneos. Muitos deles escreveram livros que unem pensamentos filosóficos e análises fílmicas. Em geral, esta interdiscursividade lhes permitiu pôr na berlinda a concepção de imagem pressuposta tanto na filosofia como no cinema. Trata-se de examinar as teorias e a análise que Gilles Deleuze e Jacques Rancière fizeram de Vertigo, de Alfred Hitchcock, para entender a relação que ambos estabeleceram entre filosofia e prática fílmica analítica. O (...) objetivo final é problematizar as conexões entre imagem e narrativa, que se revelam nessa junção e que fazem parte da tradição filosófica e cinematográfica. Ao mesmo tempo, propomos uma análise que considere o texto e a linguagem cinematográfica a partir da imagem, subvertendo desta forma a abordagem tradicional. (shrink)

Este artigo traz uma reflexão sobre como e por que a Guerra Guasu ou Guerra da Tríplice Aliança permanece na memória dos paraguaios como parte da identidade nacional. Partindo-se do pressuposto de que o Paraguai teve que atravessar por um processo de reconstrução simbólica após a derrota de 1870, se analisam as diferentes ressignificações dos mitos consagrados pelos revisionistas, ao longo do século XX, com o objetivo de identificar de que maneira esses mitos permearam as práticas políticas e culturais.

Este texto analisa três artigos que tratam sobre os ‘usos políticos do passado’ em diferentes momentos das histórias nacionais de El Salvador, Guatemala e Chile. O exame desses textos permite refletir sobre os caminhos escolhidos para a escrita das histórias nacionais durante os pós-guerras e como a hegemonia de uma interpretação histórica pode levar ao silêncio ou a deslocamentos de outras interpretações. Também é analisado o papel dos autores nessas disputas pela memória e história.

Neste trabalho de cunho teórico, buscamos analisar a dinâmica dos afetos na perspectiva filosófica de Baruch Espinosa. Ao projetar esse objetivo, procuramos trazer elementos que favoreçam análises da compreensão escolar como espaço de potencialização. Defendemos como considerações finais do estudo que essa perspectiva e entendimento são nucleares para o debate e compreensão da dinâmica dos afetos no processo de humanização.

Examina a relação entre a leitura e os programas computacionais de mineração de textos, no contexto das Humanidades Digitais (HD). Através da pesquisa bibliográfica e da reunião de fontes textuais relevantes para o argumento, esta relação é descrita sob a forma de uma simbiose entre o ser humano e o computador, nos termos propostos inicialmente por Asimov (2005). Uma concepção da leitura como operação da inteligência é posta em diálogo com o conceito e as aplicações da mineração de textos. En el presente trabajo examino la tesis de José María Sauca sobre la “liquidez constitucional” y las cláusulas de este tipo que identifica en la Constitución Española. Propondré analizarlas a la luz de la tesis de la cláusula alternativa tácita presentada por Kelsen.

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

Alfred Mele presents an influential argument for incompatibilism which compares an agent, Ernie, whose life has been carefully planned by the goddess Diana, to normal deterministic agents. The argument suggests both that Ernie is not free, and that there is no relevant difference between him and normal deterministic agents in respect of free will. In this paper, I suggest that what drives our judgement that Ernie is not free in the Diana case is that his actions are merely an extension (...) of Diana's—he is akin to a tool, which she uses solely for her own purposes, and his behaviour occurs only because of the interest Diana takes in its occurring. This contrasts with normal deterministic universes, in which normal agents are not such tools. (shrink)

Situations are powerful: the evidence from experimental social psychology suggests that agents are hugely influenced by the situations they find themselves in, often without their knowing it. In our paper, we evaluate how situational factors affect our reasons-responsiveness, as conceived of by John Fischer and Mark Ravizza, and, through this, how they also affect moral responsibility. We argue that the situationist experiments suggest that situational factors impair, among other things, our moderate reasons-responsiveness, which is plausibly required for moral responsibility. However, (...) even though we argue that situational factors lower the degree of our reasons-responsiveness, we propose that agents remain moderately reasons-responsive to the degree required for moral responsibility. Nonetheless, those affected by situational factors are arguably less morally responsible than those who are not subject to similar situational factors. We further evaluate an understanding of reasons-responsiveness which relativizes reasons-responsiveness to agents’ circumstances. We argue that the situationist data do not warrant this kind of divergence from Fischer’s and Ravizza’s account. We conclude by discussing what situationist experiments tell us about our relationship to non-reasons. (shrink)

Este artículo reflexiona acerca de las especificidades de la constitución de los monumentos conmemorativos en vínculo con la historia reciente. Para ello, la mirada se centrará en la noción de contramonumentos, entendiendo a estos últimos como aquellas producciones que, inicialmente de la mano de un grupo de artistas alemanes, desafían las premisas del monumento tradicional. En base a esto, se expone, en primera instancia el desarrollo histórico del monumento, destacando determinados sucesos que se consideran significativos dentro de la extensa cronología (...) en la que éste se inscribe; en un segundo momento, se recuperan una serie de reflexiones y debates que problematizan y cuestionan la efectividad de estos objetos culturales en relación a la evocación del pasado; y finalmente, se presentan y analizan un conjunto de producciones artísticas que se enmarcan dentro de lo que se reconoce como contramonumentos. En este sentido, se considera que la revisión de los aspectos formales, conceptuales y funcionales a partir de las cuales James E. Young definió en la década de los noventa a los contramonumentos, ilumina y habilita nuevas reflexiones sobre las diversas intervenciones, acciones de resistencia y producciones artísticas que se llevan a cabo en la actualidad, muchas de las cuales pueden ser pensadas como contramonumentos. La escritura para la reflexión pedagógica es una competencia profesional docente que debe ser desarrollada durante la formación inicial para que, posteriormente, pueda ser aplicada en diversos contextos educativos, enriqueciendo así el proceso de enseñanza y aprendizaje tanto del propio profesor como de los estudiantes con los que este interactúa. El ámbito de formación práctica es un espacio curricular donde esta competencia asume mayor preponderancia, pues el futuro profesor debe transferir diversos conocimientos teóricos hacia el ejercicio de aula. Bajo este (...) contexto, es posible reconocer la producción y circulación de ciertos géneros escritos específicos que dan cuenta de esta competencia. Esta investigación tiene como objetivo principal caracterizar, desde una perspectiva socioretórica, los géneros de reflexión pedagógica que escriben los estudiantes de dos carreras de pedagogía de una universidad chilena durante su formación práctica. Desde un enfoque metodológico cualitativo y con un diseño de Estudios de Casos Múltiples, se aplicaron dos instrumentos de recolección de datos: entrevistas semiestructuradas y focus group a profesores y estudiantes de la carrera de Educación Especial y Educación Parvularia. Entre los principales resultados destacan el reconocimiento de la escritura como un recurso que recoge la reflexión pedagógica de los profesores en formación; la utilización de determinados géneros pedagógicos en cada carrera y además la existencia de una progresión en el uso de estos de acuerdo a la complejidad y avance en el recorrido formativo del Plan de Estudios. The Coronavirus Disease 2019 pandemic prompted the need for a teleneuropsychology protocol for the cognitive assessment of older adults, who are at increased risk for both COVID-19 and dementia. Prior recommendations for teleneuropsychological assessment did not consider many of the unique challenges posed by COVID-19. The field is still in need of clear guidelines and standards of care for the assessment of older adults under the current circumstances. Advantages of teleneuropsychological assessment during the COVID-19 pandemic include reduced risk of contracting (...) the virus, eliminating travel time and reducing cost, and more rapid access to needed services. Challenges include disparities in technology access among patients, reduced control over the testing environment, impeded ability to make behavioral observations, and limited research on valid and reliable cognitive assessment measures. The aim of this perspective review is to propose a teleneuropsychological protocol to facilitate neuropsychological assessment utilizing a virtual platform. The proposed protocol has been successful with our clinical and research populations and may help neuropsychologists implement teleneuropsychology services without compromising validity or reliability. However, there is increasing need for research on teleneuropsychological assessment options for both clinical and research purposes. (shrink)

The central thesis developed in this paper is that sexual violence is a possibility founded in the — historical — constitutive conditions of the female body, which means that sexual violence against women is possible because of the availability of their bodies. The availability of the female body as a condition for rape is established in three principal moments: 1) The historical and spiritual determination of the subjective female identity as founded in the materiality of her own body —or her (...) reproductive specificity—. 2) The socially ambiguous configuration of the «femenine-I can» derived from the reproduction/sensuality difference; and, 3) The sexual rape as a reassertion of the gender availability in such a way that the rape sexualizes the gender as vulnerable, establishing or adding a wrapping meaning of feminity as something vulnerable. Being an other-body is being, originally, an available body, violable in essence, sexually vulnerable. (shrink)

Since 1981, Chilean universities experienced profound transformations outlined by what some authors call the New Public Management. Released to the market and mandated to modernize their management systems under an entrepreneurial spirit, the universities went from being providers of a social right, such as education, to becoming an institution that provides educational services. Under the figure of the self-entrepreneur, this article examines the transformations that Chilean university student movements have experienced in the last fifteen years. Specifically, the changes in their (...) demands, tactics and strategies of struggles are problematized, showing the performative effects of the neoliberal order on the subjectivities of the students and the way in which they link with the new teaching subjectivity. In this paper, I argue that some intentional actions are not triggered by proximal intentions; i.e. there are actions which are intentional, but lack relevant proximal intentions in their immediate causal history. More specifically, I first introduce various properties of intentions. I then argue that some actions are triggered by mental states which lack properties typically ascribed to intentions, yet these actions are still intentional. The view that all intentional actions are triggered by proximal intentions is thus false.

I argue that we do not intentionally and rationally shape our character and values in major ways. I base this argument on the nature of transformative experiences, that is, those experiences which are transformative from personal and epistemological points of view. The argument is roughly this. First, someone who undergoes major changes in her character or values thereby undergoes a transformative experience. Second, if she undergoes such an experience, her reasons for changing in a major way are inaccessible to her (...) beforehand. Third, if such reasons are inaccessible beforehand, she cannot act on them and thus cannot rationally and intentionally shape her character or values. I also explore some consequences of my argument, especially those related to control and responsibility. (shrink)

Libet’s timing experiments have resulted in some strong and unsavoury claims about human agency. These range from the idea that conscious intentions are epiphenomenal to the idea that we all lack free will. In this paper, I propose a new type of response to the various sceptical conclusions about our agency occasioned by both Libet’s work and other experiments in this testing paradigm. Indeed, my argument extends to such conclusions drawn from fMRI-based prediction experiments. In what follows, I will provide (...) a brief description of these experiments, sketch arguments one may be tempted to draw on their basis, and argue that such arguments rely on a questionable premise: that experimental subjects have relevant proximal intentions. Sobre la conducta irresponsable y apasionada de los travestis chilenos, Pedro Lemebel establece en Loco afán un catálogo de degradación corporal articulado con un lenguaje barroco. El efecto del SIDA en los años 80 y 90 sobre los (...) cuerpos marginales es una "colonización por el contagio" que traslada a la crónica arrabalera las torturas impuestas desde los 70 por la dictadura militar chilena que Roberto Bolaño convierte en performances gore en el relato descarnado de Estrella distante. Allí los aspectos góticos de la corporeidad decadente encuentran una formulación futurista en que la crueldad resulta alentada. En la complementariedad y la tergiversación de las estéticas, el cuerpo se desintegra en un espectáculo que combina lo grotesco y lo fúnebre. "Body is always an inconvenient", writes Susan Sontag on the conviction that it is an space of suffer rather than pleasure. The alternatives of illness trace a taxonomy in which the responsibility of the individual seems choice the organic failures. On the Chilean transvestites' irresponsive and passionate behavior, Pedro Lemebel establishes in Loco afán a catalog of body degradation articulated with baroque language. AIDS' effect in the 80 and 90 on marginal bodies is a "colonization by the contagion" that moves the torture imposed by Chilean military dictatorship since the 70 to the suburban chronicles that Roberto Bolaño makes performances gore in the discarnated narrative Estrella distante. There the gothic aspects of decadent corporality find a futurist formulation in which cruelty is encouraged. Este texto corresponde a una versión ligeramente extendida de la presentación leída en el lanzamiento del libro _La Universidad (im)posible_, publicado por Ediciones Macul, realizada el 10 de mayo de 2019 en el Salón Juan Gómez Millas de la UMCE. El volumen reúne la mayoría de los trabajos presentados en el Coloquio Internacional “La Universidad posible”, realizado en Santiago de Chile, entre el 18 y el 21 de abril de 2016, incluyendo contribuciones de quienes se hicieron parte de la convocatoria, (...) pero no pudieron estar presentes. Ampliando las resonancias de la fórmula nietzscheana que da nombre a la segunda de sus consideraciones intempestivas, en las que el golpe de martillo recae sobre la utilidad y el perjuicio de la historia para la vida, intentamos esbozar una clave de lectura que permita recorrer los diversos envites de este libro desde la atención al malestar que se aloja hoy en la universidad, anudado a su devenir corporativo y a la gramática de una existencia sofocada por el lenguaje_ _del neoliberalismo. Viendo resquebrajarse la idea que la universidad tenía de sí misma, su transformación exige a quienes la habitamos volver a tensar los hilos que la anudan con la vida y con la muerte, para no conceder simplemente a las prácticas que, por los poderes y lógicas que la asedian y conforman, esta institución actualmente alberga. Si la vida queda excluida de la universidad, como vislumbra Walter Benjamin en su ensayo temprano sobre _La vida de los estudiantes, _la tarea recae en activar las facultades de la contienda para inventarse una nueva, _otra _universidad posible, una en la que el pensamiento, la imaginación y el deseo puedan volver a rastrillar lo que queda de porvenir en la memoria de ese nombre. _Palabras Clave: _Universidad – Vida – Neoliberalismo – Crítica. Instituted in 2004, the Czech Republic research assessment has since changed on an annual basis. In this paper I examine how researchers in the Czech Republic negotiate research assessment. Using the concept of epistemic living spaces, I first set in context the Czech research assessment system and second explore the micro-politics of resistance in which researchers engage in their daily conduct. Empirically, I draw on individual and group interviews carried out with Czech researchers in the humanities, social sciences and natural (...) sciences, analyses of science policy documents including the Methodology for Evaluating Research, Development and Innovation Results, as well as public debates relating to research assessment, such as blogs and newspaper articles. The interviews were carried out between 2007 and 2010. Additional sources of data include participant observation at public events and seminars on the research and development system reform, research assessment and audit of the Czech system of research, development and innovation gathered between 2009 and 2011. As we know, the sacred books of the three religions are not characterized by a gender-friendly approach. In the very beginning of the Old Testament we find the tale of the Fall of Man, where the serpent tempts Eve, who in turn tempts Adam to commit the original sin: to eat the fruit of the Tree of Knowledge. Eve’s guilt is taken for granted, and rarely discussed. The question of Eve’s guilt was first taken up in Augustine’s De Genesi ad (...) Litteram, and was then later further systematized in Peter Lombard’s Sentences. Isotta Nogarola was a pioneer in taking this discussion beyond university walls, to the intellectual Veronese circles. When Isotta Nogarola pleads for Eve’s case in her Dialogue on the Equal or Unequal Sin of Adam and Eve, she may not be the first to defend Eve, but she has the merit of being a woman who is pleading for a woman’s case. We examine the background of this discussion in Isotta, focusing especially on the scholastic antecedents to this debate. Although most of the quotations cited by Isotta are attributed to early Christian and pagan authors—sources that are typical of humanistic literature—we will demonstrate that many of them are in fact taken from scholastic sources discussing original sin, which are the true immediate sources of Isotta’s dialogue.
