El presente libro recopila algunas de las mejores investigaciones presentadas en el “IX Coloquio Internacional de Estética y Arte” en La Habana en diciembre del 2015, redactadas ahora a modo de artículos. La estética y el arte a debate II está compuesto por 27 artículos y se encuentra dividido en cinco bloques que, de alguna manera, reflejan las temáticas centrales alrededor de las cuales giró el encuentro del 2015. En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. We talk about curatorship as a process in which someone carefully and thoughtfully chooses and organizes a way to present particular artworks to the public. Some have theorized that curating an art exhibit and exercising the selection and organization of artworks is very similar to telling a story. This analogy invites us to expand it and reflect on how it can help illuminate what historians do as storytellers of the past. The central point of this paper is to think of (...) historical work as a curatorial practice. This, in turn, allows us to understand the constructive enterprise that historians engage in and challenge a rooted and prevalent commitment in the historical discipline that the past is discovered rather than constructed. Historians as curators of the past select and organize undetermined materials that become determined when subsumed under a narrative that bestows the past with a particular meaning. The analogy also serves to clarify that no epistemic or metaphysical tension need exist between a notion of the real and an acknowledgment of narrative construction. (shrink)

A realistic axiomatic formulation of nonrelativistic quantum mechanics for a single microsystem with spin is presented, from which the most important theorems of the theory can be deduced. In comparison with previous formulations, the formal aspect has been improved by the use of certain mathematical theories, such as the theory of equipped spaces, and group theory. The standard formalism is naturally obtained from the latter, starting from a central primitive concept: the Galilei group.

En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. La técnica forma parte de la naturaleza del ser humano. Pertenece a su esencia desde su transformación de homo naturalis a homo faber. Siguiendo a Ortega y Gasset (1939), el ser humano como ser natural es un animal biológicamente menesteroso y necesitado ante los retos y dificultades que le presenta la naturaleza. Su salvación –la superación de los obstáculos que lo hubieran conducido casi con toda probabilidad a su extinción como especie– ha radicado en el desarrollado de su capacidad técnica. (...) Mediante ella el ser humano ha podido construir sobre la naturaleza un medio artificial. Es a ese medio al que el ser humano se viene “ajustando” desde su principio como tal ser humano. En ese proceso ha invertido el proceso de adaptación a la naturaleza común y corriente entre el resto de los seres vivos. El ser humano no se adapta a la naturaleza, sino que la naturaleza –filtrándose a través del medio artificial que dicho ser construye sobre ella– se adapta al ser humano. En resumen, la técnica le permite al ser humano construir un medio artificial –una supranaturaleza–. Es a ese medio al que se adapta, venciendo de este modo su estado de precariedad y superando así las limitaciones que le vienen impuestas por los dictados de la naturaleza a la hora de satisfacer sus necesidades. Sin técnica, en definitiva, no habría ser humano. Si esto es así, ¿debemos sujetar la técnica a control o debe ser autónoma? Técnicamente, todo cuanto pueda hacerse, ¿debe hacerse? No perdamos de vista a la hora de responder a estas cuestiones que, en la actualidad, las nuevas tecnologías están posibilitando alcanzar metas hasta hace poco tiempo impensables, ¿las limitamos? We better understand what it means to be a rational animal, the image of triune God, when we investigate why, exactly, “mindless persons” (amentes) are not exceptions or even outliers in Aquinas’s account of the creaturely dignity and perfectibility of the human being.Aquinas remarks with some regularity on persons afflicted with the condition amentia, which is variously and inconsistently interpreted (in translation) as “imbeciles,” “fools,” “madmen,” “lunatics,” “the demented,” or “the insane.” The amentes are persons who lack the use of reason in a profound and debilitating way; and, as I will show, the fact that we are sometimes found in this state informs Aquinas’s analysis of human nature and, in particular, Aquinas’s teaching on the good wrought by Christ for the members of his body. Our guiding question is this: Thinking with Aquinas, how do we account for the natural and supernatural happiness of those of us who lack the use of reason?My purpose in this article is to explore what Aquinas has to say about the happiness of persons who are baptized and [End Page 49] confirmed by the Church, and who have what neuro-psychologists would describe as a profound cognitive impairment. The question is particularly striking when we recall that, for Aquinas, the distinguishing aptitude of the human being (proper to our intellectual nature and coordinate with our creaturely perfection) is the operation of an incorruptible intellectual capacity—a capacity, however, that is only reduced from potentiality to act when the corruptible “internal sense organ” is disposed to receive, in terms of health and circumstance, a coordinated sense impression of material species. Thus, a further question emerges: According to Aquinas, what is the perfective effect of grace in this life upon the nature of a person who completely lacks the use of reason due to an organic corruption or disorder of the ‘internal sense organ’?The discussion is divided into five parts. I begin (part I) by locating those who “lack the use of reason” within the theological infrastructure of Aquinas’s moral psychology and I identify the main problematic. With respect to that problematic, the principal conceptual resources provided by Aquinas are then outlined and two challenges are identified (part II).The first challenge is methodological, concerning the speculative import of the sacramental life of the Church. Francisco de Vitoria’s Relectio de eo ad quod tenetur homo veniens ad usum rationis (1534) highlights for us (part III) a constellation of judgments relevant to interpreting Aquinas on these themes, in particular, Aquinas’s formulation of prerational intellectual acts vis-à-vis the participation and membership of “mindless persons” in the sacramental life of the Body of Christ.The second challenge is to show the continuity between Aquinas’s account of the human being and his practical remarks on those who lack the use of reason. Specifically, given the various ways that, and degrees to which, the human being can lack the use of reason, I trace (part IV) Aquinas’s analysis of the power and operation of intellect, focusing on the intellectual acts which can be impaired and, concurrently, the intellectual acts which cannot be impaired in a living human being. The paper defines a measure on the set of stable matchings in the marriage problem. This measure is based on the minimization of the envy difference between the sets of men and women, while preserving stability and selects stable matchings with the least conflict of interest between both groups of agents. The solution concept proposed is called Sex-equal Matching (SEM) and the paper also provides an algorithm to compute the set of SEM.

A partir de la Melancolía de Lucas Cranach de 1532, se indaga el linaje cartesiano de los vértigos de incertidumbre que sufre Antoine Roquentin, el protagonista de La náusea satreana. Se aborda en estas páginas cierto síndrome consistente en la dificultad de discernimiento entre cuanto sucede fuera de la conciencia y cuanto no es más que representación mental, para sostener que es esta ambigüedad la condición de posibilidad de la conciencia moderna, la de una conciencia sostenida en su misma contingencia.

This article positions punk rock pedagogy, or the educative dimensions of punk rock subculture, as an exemplar for combatting hate speech. This analysis contrast institutional efforts to protect free speech (which are rooted in free speech absolutism) with the ways by which punks protect one another from bigotry. This paper argues that the punk approach more closely reflects how free speech protections are framed in international human rights law.

En este artículo propongo una conexión entre la regla de reconocimiento de H. L. A. Hart y la tesis de contenidos mínimos de derecho natural del mismo autor. La regla de reconocimiento es comprendida como una regla convencional constituida por la práctica de los funcionarios judiciales encargada de aplicar criterios de validez, para determinar si las normas particulares pertenecen al sistema. Los contenidos mínimos de derecho natural constituyen la base de tendencias o instintos de los humanos en su búsqueda de (...) supervivencia. A partir de los planteamientos de Marmor y Raz, se propone que en la regla de reconocimiento los contenidos mínimos de derecho natural constituyen el primer filtro de evaluación de la validez de las normas jurídicas particulares sometidas a reconocimiento jurídico, lo cual aporta solidez y consistencia significativa a las tesis de la discrecionalidad y de la separabilidad de la teoría hartiana. Besides their ordinary cardinal and proportional meanings, many and few have been argued to allow for a ‘reverse proportional’ reading. This reading has later been characterised in two opposite directions: Cohen’s reading where the proportion \ matters and Herburger’s where it does not. We develop a compositional analysis that derives the correct truth conditions for both characterisations of Westerståhl-style sentences while maintaining conservativity, assuming a standard syntax/semantics mapping and reducing their context-dependence to mechanisms independently needed for degree constructions in general. In a nutshell, mirroring the decomposition of other degree expressions like tall, many is decomposed into the parametrized determiner many and the operator POS, where POS combines with a contextually salient comparison class C matching the alternatives triggered by some element X\ in the sentence. Non-reverse readings obtain when X\ is external to the original host NP and reverse readings when X\ is internal to the host NP. Cohen’s truth conditions for Westerståhl-style sentences are derived as a reverse proportional reading and Herburger’s interpretation as a sub-case of the non-reverse cardinal reading. (shrink)

This original study intertwining Latina feminism, existential phenomenology, and race theory offers a new philosophical approach to understanding selfhood and identity. Focusing on writings by Gloría Anzaldúa, María Lugones, and Linda Martín Alcoff, Mariana Ortega articulates a phenomenology that introduces a conception of selfhood as both multiple and singular. Her Latina feminist phenomenological approach can account for identities belonging simultaneously to different worlds, including immigrants, exiles, and inhabitants of borderlands. Ortega’s project forges new directions not only in Latina feminist (...) thinking on such issues as borders, mestizaje, marginality, resistance, and identity politics, but also connects this analysis to the existential phenomenology of Martin Heidegger and to such concepts as being-in-the-world, authenticity, and intersubjectivity. The pairing of the personal and the political in Ortega’s work is illustrative of the primacy of lived experience in the development of theoretical understandings of who we are. In addition to bringing to light central metaphysical issues regarding the temporality and continuity of the self, Ortega models a practice of philosophy that draws from work in other disciplines and that recognizes the important contributions of Latina feminists and other theorists of color to philosophical pursuits. This paper is concerned with Noun Phrases (NPs, henceforth) occurring in two constructions: concealed question NPs and NP subjects of specificational sentences. The first type of NP is illustrated in (1). The underlined NPs in (1) have been called ‘concealed questions’ because sentences that embed them typically have the same truth-conditional meaning as the corresponding versions with a full-fledged embedded interrogative clause, as illustrated in (2) (Heim 1979).

: The aim of this essay is to analyze the notion of "loving, knowing ignorance," a type of "arrogant perception" that produces ignorance about women of color and their work at the same time that it proclaims to have both knowledge about and loving perception toward them. The first part discusses Marilyn Frye's accounts of "arrogant" as well as of "loving" perception and presents an explanation of "loving, knowing ignorance." The second part discusses the work of Audre Lorde, Elizabeth Spelman, (...) and María Lugones in their attempts to deal with the issue of arrogant perception within feminism, and examines how Lugones's notion of "'world'-traveling" may help us deal with "loving, knowing ignorance." Ultimately, the author suggests that we need to become aware of instances of "loving, knowing ignorance," especially if we are to stay true to Third Wave feminism's commitment to diversity. (shrink)

This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. Resumo O propósito deste trabalho consiste em analisar criticamente uma recente proposta formulada por Needham no âmbito da Filosofia da Química. Este autor toma como essencialmente apropriado o modelo clássico de redução Nageliano. O objetivo fundamental deste trabalho consiste em avaliar certas implicações ontológicas desta tese neorreducionista. Em particular, a autora argumentará que a tese da redução interteórica formulada por Needham apresenta certas limitações, que advêm de uma atenção insuficiente a problemas ontológicos fundamentais. Sendo que estes emergem de uma análise (...) cuidada a algumas alegadas relações redutoras entre teorias. According to this proposal, Nagelian model of reduction is essentially appropriate. The primary aim of this paper is to evaluate certain ontological implications of this neo-reductionist thesis. Specifically, I will argue that Needham’s thesis of intertheoretic reduction has some limitations: the proposal does not pay attention to some fundamental ontological problems that emerge from a watchful analysis of some allegedly reductive relations between theories. There are two main approaches to the scopal properties of the N’-restrictors of which-phrases. One line attributes widest scope within the interrogative clause to the entire which-phrase, outside the question formation operator, often assumed to reside in C0. The result is Karttunen ’s question denotation --exemplified in --,1 whose distinctive feature is that the semantic contribution of the N’- restrictor of the which-phrase is represented outside the so-called question nucleus, i.e., outside the subformula “p=…”. The second main avenue interprets the (...) N’-restrictor of which-phrases somewhere inside the question nucleus, that is, under the scope of the question formation operator and possibly under other, further embedded operators. The outcome is Hamblin’s --or unselective binding—question meaning, as in. This paper will be concerned with this second line, which I will refer to as the base position line. (shrink)
