Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. El proceso de aprendizaje en un adulto es diferente al que ocurre en la etapa de la niñez; el adulto posee un piso de competencias al que es capaz de integrarla adquisición de nuevos conocimientos y asume su aprendizaje como un proceso electivo en función de sus motivaciones e intereses. El adulto como totalidad “bio-psico-sociológica” siente, vive, actúa y otorga significado a lo que aprende como parte de la realidad y del paradigma en el que se halla inserto. Considerar al (...) adulto descontextualizado de esta compleja realidad que representa, es cercenar su naturaleza y condenarlo a formarse en la incomprensión de su propia racionalidad. Concebir un proceso de autorregulación en el aprendizaje de un individuo, es reconocer en él la capacidad de tomar las riendas de ese ser que representa; reconocerlo capaz de asumir la responsabilidad para consigo, para con los otros, para con el todo del vivir y existir, respetando el proceso que lo revela como un ente, quees -por naturaleza propia- único e irrepetible. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. El consumo de energía y el crecimiento económico han llevado a la degradación del medio ambiente. Las centrales eléctricas son una de las principales fuentes de contaminación. Existe una necesidad de utilizar energías renovables para reducir el impacto ambiental. Sin embargo, en los países en desarrollo, la falta de recursos económicos limita la adopción de energías limpias. Las energías limpias, como la solar, eólica, hidroeléctrica y geotérmica, son fuentes sostenibles de energía. La energía hidroeléctrica puede ser controvertida debido a sus (...) impactos ambientales y sociales. La biomasa y el biogás también son fuentes de energía renovable. La eficiencia energética es otra área importante para reducir la dependencia de los recursos no renovables. El artículo discute la importancia de las energías limpias y el desarrollo sostenible en el Perú. Se menciona el potencial de la energía de las olas marinas, el bioetanol y el biodiesel como fuentes de energía renovable. También se abordan los impactos ambientales de los "negocios sucios" y las implicaciones socioeconómicas de las energías limpias. Se discuten los conflictos de interés y la regulación normativa en el país, así como las perspectivas futuras y la necesidad de un desarrollo energético estable y sostenible. Resumen: Nueva ilustración radical, obra con la que Marina Garcés ganó el Premio Ciudad de Barcelona 2017 en la categoría de ensayo, está estructurada en tres partes precedidas por un preámbulo: condición póstuma, radicalismo ilustrado y humanidades en transición. La primera se centra en el carácter insostenible del mundo contemporáneo, en el análisis de lo que hay después de la Modernidad y la Posmodernidad y en lo que la autora ha llamado “la catástrofe de tiempo”. En la segunda parte (...) se presentan los conceptos de “servidumbre cultural”, “analfabetismo ilustrado”, “neutralización de la crítica” e “inteligencia delegada”. The work is structured in three parts, preceded by a preamble: posthumous condition, illustrated radicalism and Humanities in transition. The first focuses on the unsustainable nature of the contemporary world, on the analysis of what there is after Modernity and Postmodernity and on what the author calls “the catastrophe of time”. The second part presents the concepts of “cultural servitude”, “enlightened illiteracy”, “neutralization of criticism” and “delegated intelligence”. This book collects seventeen essays published between 1984 and 2020, in which Marina Sbisà develops her distinctive approach to speech acts and related pragmatic phenomena. Drawing inspiration from the work of J. L. Austin, the essays examine the categories of speech act theory and apply these categories in the context of natural discourse and conversation, with the aim of providing an accurate analysis of how speech can be action. Sbisà devotes particular attention to normative aspects of language and language (...) use: speech acts reshape the normative context in which they occur by assigning or unassigning deontic properties to relevant parties. Emphasis is placed on the normative aspect of linguistically mandated presuppositions as well as the rational grounds of implicature. The conventionalist view of speech acts developed here turns on the role of intersubjective agreement in deontic updating, in a framework that shifts focus from single utterances to discursive sequences and conversational interaction. This view challenges the main tenets of a Gricean intentionalist understanding of speech act performance, paving the way for a theory of speech actions centred on the normatively transformative power of illocution. Throughout the essays, examples and applications are given to illustrate how the view put forward contributes to understanding the social and political dimensions of linguistic activity, such as hidden persuasive strategies, power imbalances both within and outside the context of conversation, and the relevance of language and discourse to gender issues. The presence of the past is of prime importance in today's Mexican society. According to José Fuentes Mares, among the “peoples of the world the Mexican is the one who lives history the most”. With regard to the unsatisfactory relations between Mexico and North America, the journalist Alan Riding asks himself: “How can a people who relish the past to the point of intoxication understand another that looks constantly to the future?” In the Republic of Mexico, according to him, “the (...) entire past of the country throws a dense shadow over the present”. Conforming to a universal custom, every country divides its present past into four groups (survival, residues, memories and history), but in few nations are the four groups as copious as in this one. Although Mexico is rapidly shedding many old customs and is selling residual objects to foreign collectors on the sly, its historical treasure is still enormous, perhaps the largest in the world. This paper explores the reception of Kant's understanding of consciousness by both Romantics and Idealists from 1785 to 1799, and traces its impact on the theory of religion. I first look at Kant's understanding of consciousness as developed in the first Critique, and then looks at how figures such as Fichte, Jacobi, Hölderlin, Novalis, and Schleiermacher received this theory of consciousness and its implications for their understanding of religion.

Philosophical Perspective on Cinema addresses the relationship between human existence and sensual reality. Applying metaphysical/existential reflection to cinema, the author explores the philosophical clarity that cinema can offer reflective persons about the human experience.

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. Dichos conceptos se asocian con movimientos y percepciones intelectuales que se producen en el contexto de una determinada forma de organización social ―que unos siguen llamando moderna, y otros, postmoderna. Más allá de esto, la existencia humana actual se caracteriza por el cambio (con sus incertidumbres y riesgos) y las desigualdades, de modo que el concepto de globalización ha sido visto como un (...) eufemismo del capitalismo. Y así, algunos entienden que es mejor hablar de mundialización, porque vendría a expresar el propio proceso de integración económica, política, social y cultural que viene viviendo el mundo, particularmente a partir del descubrimiento de América. Platón de Atenas, sin discusión uno de los grandes maestros de Occidente, y probablemente el verdadero fundador de la filosofía. Sus ideas encontraron eco en sus discípulos, sobre todo Aristóteles, que pese a haber formado una nueva escuela, y haber externado algún juicio crítico, fue un gran platónico. La influencia de Platón se siente a lo largo de la Edad Media y de la Modernidad, y aún la filosofía contemporánea se ve compelida a volver sobre sus pasos, a fin situar (...) correctamente sus temas y problemas. Imbuido de un sentimiento de respeto por la obra de Platón, visité la mayoría de sus diálogos, y consulté parte de la recepción hecha a la obra platónica, a fin forjarme una idea lo más acabada posible de la vida, la obra y las ideas de filósofo ateniense, discípulo de Sócrates, que legó a Occidente el primer gran sistema filosófico. In his book, 'History as a Science and the System of the Sciences', Thomas Seebohm articulates the view that history can serve to mediate between the sciences of explanation and the sciences of interpretation, that is, between the natural sciences and the human sciences. Among other things, Seebohm analyzes history from a phenomenological perspective to reveal the material foundations of the historical human sciences in the lifeworld. As a preliminary to his analyses, Seebohm examines the formal and material presuppositions of (...) phenomenological epistemology, as well as the emergence of the human sciences and the traditional distinctions and divisions that are made between the natural and the human sciences. -/- As part of this examination, Seebohm devotes a section to discussing Husserl’s formal mereology because he understands that a reflective analysis of the foundations of the historical sciences requires a reflective analysis of the objects of the historical sciences, that is, of concrete organic wholes (i.e., social groups) and of their parts. Seebohm concludes that Husserl’s mereological ontology needs to be altered with regard to the historical sciences because the relations between organic wholes and their parts are not summative relations. Seebohm’s conclusion is relevant for the issue of the reducibility of organic wholes such as social groups to their parts and for the issue of the reducibility of the historical sciences to the lower-order sciences, that is, to the sciences concerned with lower-order ontologies. -/- In this paper, I propose to extend Seebohm’s conclusion to the ontology of chemical wholes as object of quantum chemistry and to argue that Husserl’s formal mereology is descriptively inadequate for this regional ontology as well. This may seem surprising at first, since the objects studied by quantum chemists are not organic wholes. However, my discussion of atoms and molecules as they are understood in quantum chemistry will show that Husserl’s classical summative and extensional mereology does not accurately capture the relations between chemical wholes and their parts. This conclusion is relevant for the question of the reducibility of chemical wholes to their parts and of the reducibility of chemistry to physics, issues that have been of central importance within the philosophy of chemistry for the past several decades. Se establece la problemática respecto a la autenticidad de la obra de Platón y se opta por el criterio de que la polémica carece de sentido, pues su interés reside en que ellos han sido conocidos a lo largo de la historia de la filosofía como tales y que, en todo caso, de no ser escritos por Platón lo fueron por sus discípulos, cuestión que es suficiente en una época en la que no existe tan claramente la idea de autoría. (...) Se hace un recorrido por los métodos utilizados para ordenar los diálogos y un repaso de las clasificaciones más importantes. Finalmente se propone un método en dos direcciones: una considerada más filológica, consistente en fijar las obras se conocieron en cada momento histórico y otra, más filosófica, es la de establecer un marco teórico que reorganice los diálogos suponiendo que debe existir una lógica interna entre unos diálogos y otros, lo que supone un test para la teoría interpretativa de Platón que se proponga. While the philosophical study of shame has gained popularity, its application in the interpretation of the Hebrew Bible remains in its early stages. This paper delves into an analysis of shaming and unreasonable shame in the Book of Job, particularly in chapter 19. Through an examination of the Hebrew text and drawing on contemporary philosophical definitions of shame and shaming, I argue that Job perceives his friends, God, and the community to be employing shaming tactics against him, attempting to induce (...) feelings of shame, a sentiment Job considers unjustified. In his case, shame is deemed unreasonable because Job has not violated any cherished values that would warrant such an emotion. Additionally, I demonstrate that while Job senses God shaming him, the biblical character acknowledges that his deity is the sole entity aware of his innocence—God's eyes perceive accurately, in contrast to humans', which only assess outward appearances. The role of God as the perfect witness to Job's life is fulfilled in the epilogue of the book, where Yahweh vindicates Job from the shame he has endured by publicly denouncing the serious faults of his friends. Marina McCoy explores Plato's treatment of the rhetoric of philosophers and sophists through a thematic treatment of six different Platonic dialogues, including Apology, Protagoras, Gorgias, Republic, Sophist, and Phaedras. She argues that Plato presents the philosopher and the sophist as difficult to distinguish, insofar as both use rhetoric as part of their arguments. Plato does not present philosophy as rhetoric-free, but rather shows that rhetoric is an integral part of philosophy. However, the philosopher and the sophist are distinguished by (...) the philosopher's love of the forms as the ultimate objects of desire. It is this love of the forms that informs the philosopher's rhetoric, which he uses to lead his partner to better understand his deepest desires. McCoy's work is of interest to philosophers, classicists, and communications specialists alike in its careful yet comprehensive treatment of philosophy, sophistry, and rhetoric as portrayed through the drama of the dialogues. Los coordinadores honoran la memoria del catedrático y amigo nuestro Javier Hernández-Pacheco, que falleció en Sevilla en la mañana del 17 de noviembre de 2020, y le dedican los frutos de la monografía. * * * Cuarenta años atrás Moses I. Finley editó The Legacy of Greece: A New Appraisal en Oxford. Desde entonces, se han editado varios volúmenes al respecto. Con el pasar de las décadas, las armonías entre la sapientia de la Antigua Grecia y la filosofía clásica alemana (...) han ganado terreno reclamando la atención que merecen. Se levantan cada vez más puentes sobre ambos períodos y a diario se publican estudios que desgranan detalles fascinantes. La enorme influencia que tuvieron los antiguos sobre los filósofos idealistas, la mirada de los poetas que anhelaban ese ancestral esplendor, las ideas del pasado y su vigencia en el presente son algunas de las cuestiones estudiadas sobre la Grecia Antigua y la filosofía clásica alemana. ¿Por qué, entonces, surgió la idea de una monografía relacionada con la naturaleza? This paper explores three important criticisms of Kant's ethics by Friedrich Schleiermacher, all having to do with Kant's alleged failure to account for the value of the individual. These are: (1) Kant's formalism precludes him from specifying ends for the will, and without such ends, the moral perfection of the individual, and the genuine appreciation of the other in his or her individuality cannot become my end; (2) Kant cannot provide an adequate metaphysical grounding of the value of the individuals (...) comprising a community; (3) Kant cannot give an account of why members of a community should value the individual qua individual in relation to the community. In this paper I discuss these criticisms and their validity in detail. I show that understood properly, Kant has the resources to answer Schleiermacher's first criticism, and I show how Schleiermacher's own system sought to avoid the second and third problems. (shrink)

In Italien war die Rezeption von Jürgen Habermas über die Jahrzehnte konstant; bibliographischen Daten zufolge steht Italien nach Deutschland und den USA an dritter Stelle. Dennoch lautet unsere These, dass das Forschungsprogramm von Habermas in der italienischen scientific community marginal war – insofern ist im soziologischen Sinne Pierre Bourdieus eher von einem akademisch-wissenschaftlichen »Feld« zu sprechen, da es bezogen auf die Habermas-Rezeption keine Homogenität und Identität gibt.

Criticism is a staple of the scientific enterprise and of the social epistemology of science. Philosophical discussions of criticism have traditionally focused on its roles in relation to objectivity, confirmation, and theory choice. However, attention to criticism and to criticizability should also inform our thinking about scientific pursuits: the allocation of resources with the aim of developing scientific tools and ideas. In this paper, we offer an account of scientific pursuitworthiness which takes criticizability as its starting point. We call this (...) the apokritic model of pursuit. Its core ideas are that pursuits are practices governed by norms for asking and answering questions, and that criticism arises from the breach of these norms. We illustrate and advertise our approach using examples from institutional grant review, neuroscience, and sociology. We show that the apokritic model can unify several indices of criticizability, that it can account for the importance of criticizing pursuits in scientific practice, and that it can offer ameliorative advice to erstwhile pursuers. Marina Swat nutzt die sozialpädagogische Theorie der Lebensbewältigung, um die Handlungsfähigkeit jugendlicher Leistungssportler*innen differenziert zu analysieren. Ausgangspunkt dazu ist die Beobachtung, dass die sportlichen Karrieren der Jugendlichen entweder als besonders ‚wertvolle‘ Ressource im Lebenslauf betrachtet wird, die auch positive Effekte im Hinblick auf das Leben nach dem Leistungssport hat oder als Risiko für deren Lebenslauf, weil damit eine umfassende Orientierung am Leistungssport einhergeht und andere Teilbereiche des Lebenslaufs (z.B. Bildung) nachrangig werden. Im Ergebnis zeigen sich Spannungsmomente und Herausforderungen ebenso (...) deutlich wie die Gestaltungsspielräume, die sich in dieser Lebenswelt ergeben. (shrink)

We explore different ways in which the human visual system can adapt for perceiving and categorizing the environment. There are various accounts of supervised (categorical) and unsupervised perceptual learning, and different perspectives on the functional relationship between perception and categorization. We suggest that common experimental designs are insufficient to differentiate between hypothesized perceptual learning mechanisms and reveal their possible interplay. We propose a relatively underutilized way of studying potential categorical effects on perception, and we test the predictions of different perceptual (...) learning models using a two‐dimensional, interleaved categorization‐plus‐reconstruction task. We find evidence that the human visual system adapts its encodings to the feature structure of the environment, uses categorical expectations for robust reconstruction, allocates encoding resources with respect to categorization utility, and adapts to prevent miscategorizations.
