This study explores young people’s perceptions of their existential well-being during the transition after leaving care. We use the theoretical framework of ‘existential well-being,’ which is a relational approach. The study deploys participatory action research methodology and involves peer research with 74 young people leaving care aged 17–32 in Finland (2011–2012) and England (2016–2018). The data was gathered through semi-structured interviews and thematically analysed.We identified three inter-linking categories of existential well-being related to the basic issues of being a person: who (...) one is and where one belongs. Self-feeling involves the importance of how one feels about oneself and one’s physical and mental health and security. Self-realisation relates to one’s hopes and the means for making one’s own decisions in everyday life. Belonging concerns the confidence one expresses in one’s supportive social networks.The findings highlight that, alongside the practical issues of out-of-home care, attention should increasingly focus on young people's reflections on their own lives, and an ethics of care should be developed to better meet their needs. These findings argue for the need to further support young people’s psychosocial and mental health in child welfare policy and practice. (shrink)

This article looks at the relevance of the concept of self-determination to psychiatric patients by studying the existence, importance and manifestations of self-determination. The data were collected by interviewing long-term patients (n = 72) in one mental health care organization, which included a psychiatric hospital and an outpatient department. Self-determination was defined in terms of the right to decision-making, the right to information, the right of consent, the right to refuse treatment, and the right to be heard and taken into (...) account. It was found that, with the exception of the right to refuse and consent, these rights are indeed present in the practice of psychiatric nursing and that they are relevant and important to psychiatric patients. The patients typically gave ethical, practical and legal reasons for a psychiatric patient's right to self-determination. The main reasons why psychiatric patients said they lacked the right to self-determination were illness and staff authority. Recommendations for educational, clinical and methodological implications for the future in nursing are discussed. (shrink)

This article is concerned with the deprivation of patients’ liberty while undergoing psychiatric treatment, with special reference to the situation in Finland. It is based on a review of Finnish law, health care statistics, and empirical and theoretical studies. Relevant research findings from other countries are also discussed. In Finland, it is required that patients are cared for by mutual understanding with themselves; coercive measures may be applied only if they are necessary for the treatment of the illness, or for (...) safeguarding patients’ safety or the safety of others. Involuntary psychiatric hospitalization is closely regulated by the Mental Health Act. However, the rules concerning the deprivation of liberty during inpatient treatment (by seclusion, restraint and restricted leave) are formulated in very general terms. Therefore, Finnish psychiatric hospitals have their own policies concerning when and how seclusion may be used. The practice of seclusion and the use of restraint therefore vary among the psychiatric hospitals in Finland. (shrink)

The purpose of this study was to compare nursing students' perceptions of self-determination in elderly patients before and after clinical training in long term care institutions as a part of their course in gerontological nursing. A pre- post-test design was employed. The data were collected by questionnaires completed by students at one nurse education organization college in Finland (pre-test n ± 120, response rate 95%; post-test n ± 115, response rate 91%). The students' perceptions of elderly patients' self-determination were more (...) positive after their clinical training period concerning to what extent elderly patients are able to control their treatment and what kind of support they received from nurses to exercise their self-determination. The students' perceptions remained stable concerning how important self-determination is to elderly patients, and how willing and knowledgeable they are about using their self-determination. Ethics teaching, together with high quality clinical training placements, should be assured early during nursing studies. (shrink)

This study aims to describe and compare nurses' willingness to provide care for patients with HIV/AIDS and factors associated with this in three countries. An international cross-sectional survey was conducted among nurses working in medical, surgical and gynaecology units in Finland (n =427), Estonia (n =221) and Lithuania ( n =185) in early 2006. The response rates were 75% (n = 322) in Finland, 54% (n =119) in Estonia and 86% (n = 160) in Lithuania. A modified version of a (...) scale developed in 1994 by Dubbert et al. was applied. Our findings showed a general willingness of the nurse participants to provide care for patients with HIV/AIDS. However, this willingness varied both among and within countries and was also related to specific nursing interventions. The results underline the importance of providing education on ethical issues related to HIV/AIDS care in Europe and tailoring the content of this education to meet nurses' national educational needs. Research on nursing ideology and the ethics of child and adolescent psychiatric nursing care is limited. The aim of this study was to describe and explore the ideological approaches guiding psychiatric nursing in child and adolescent psychiatric inpatient wards in Finland, and discuss the ethical, theoretical and practical concerns related to nursing ideologies. Data were collected by means of a national questionnaire survey, which included one open-ended question seeking managers' opinions on the nursing ideology used in their area of practice. (...) Questionnaires were sent to all child and adolescent psychiatric inpatient wards (n = 69) in Finland; 61 ward mangers responded. Data were analysed by qualitative and quantitative content analysis. Six categories - family centred care, individual care, milieu centred care, integrated care, educational care and psychodynamic care - were formed to specify ideological approaches used in inpatient nursing. The majority of the wards were guided by two or more approaches. Nursing models, theories and codes of ethics were almost totally ignored in the ward managers' ideological descriptions. (shrink)

This article discusses nurses’ and elderly patients’ perceptions of the realization of autonomy, privacy and informed consent in five European countries. Comparisons between the concepts and the countries indicated that both nurses and patients gave the highest ratings to privacy and the lowest to informed consent. There were differences between countries. According to the patient data, autonomy is best realized in Spain, privacy in the UK (Scotland), and informed consent in Finland. For the staff data, the best results tended to (...) concentrate in the UK. The conceptual and methodological limitations of the study are identified and discussed. Implications of the results are divided into three areas: nursing practice, education and research. In practice, the analysis of patients’ values and the ethical sensitivity of nurses are important as part of ethically good care. In nurse education, students should learn to recognize ethical problems, generally and particularly, among vulnerable groups of patients. Multicultural international research is needed in this area. The focus of this article is perceptions of elderly patients and nurses regarding patients’ autonomy in nursing practice. Autonomy is empirically defined as having two components: information received/given as a prerequisite and decision making as the action. The results indicated differences between staff and patient perceptions of patient autonomy for both components in all five countries in which this survey was conducted. This article examines touch and its significance from an affect studies perspective. Touch makes our bodies more-than-one in a very concrete way, yet in body and affect research it has largely remained a philosophical abstraction, with few empirical explorations. Our theoretical deliberations are based on empirical material consisting of ‘touch biographies’ written by people of various backgrounds in the 2010s in Finland. The biographies are embodied-affective data, and our analysis of them offers a novel perspective on the ways touch forms (...) a part of affective relations and communal history. Touch works in and between bodies through affects in social bonds. Moreover, the exploration of touch biographies demonstrates that people draw upon different affective repertoires, and their experiences concerning touch are highly variable. The touch biographies highlight diverse and multi-temporal ways of attuning to, registering and recognising the social as it happens. Furthermore, our discussion opens up a new perspective on the study of affective privilege and inequality. (shrink)

The use of patient restrictions (e.g. involuntary admission, seclusion, restraint) is a complex ethical dilemma in psychiatric care. The present study explored nurses’ (n = 22) and physicians’ (n = 5) perceptions of what actually happens when an aggressive behaviour episode occurs on the ward and what alternatives to seclusion and restraint are actually in use as normal standard practice in acute psychiatric care. The data were collected by focus group interviews and analysed by inductive content analysis. The participants believed (...) that the decision-making process for managing patients’ aggressive behaviour contains some in-built ethical dilemmas. They thought that patients’ subjective perspective received little attention. Nevertheless, the staff proposed and appeared to use a number of alternatives to minimize or replace the use of seclusion and restraint. Medical and nursing staff need to be encouraged and taught to: (1) tune in more deeply to reasons for patients’ aggressive behaviour; and (2) use alternatives to seclusion and restraint in order to humanize patient care to a greater extent. The focus of this article is on elderly patients’ and nursing staff perceptions of informed consent in the care of elderly patients/residents in five European countries. The results suggest that patients and nurses differ in their views on how informed consent is implemented. Among elderly patients the highest frequency for securing informed consent was reported in Finland; the lowest was in Germany. In contrast, among nurses, the highest frequency was reported in the UK (Scotland) and the lowest in Finland. In (...) a comparison of patients’ and nurses’ perceptions, nurses had more positive views than patients in all countries except Finland. Patients with less need for nursing interventions in Greece and Spain gave their consent less often. The German and Greek patients were older, and the results also point to an association between this and their lower frequency of giving consent. In Spain, patients who were married or who had a family member or friend to look after their personal affairs were more likely to be included in the group whose consent was sought less often. Ethical issues in the care of elderly people have been identified in many countries. We report the findings of a comparative research project funded by the European Commission, which took place between 1998 and 2001. The project explored the issues of autonomy (part I), privacy (part II) and informed consent (part III) in nursing practice. Data were collected from elderly residents/patients (n = 573) and nursing staff (n = 887) in five European countries: Finland, Spain, Greece, Germany and the UK (...) (Scotland). Questionnaires were used as the data collection tool (self-completion questionnaires for staff, structured interviews for the elderly participants). Four basic nursing interventions in the care of elderly people were targeted: hygiene, fluid intake and nutrition, medication, and elimination. The data were analysed statistically. The results indicated differences within all five countries between staff and patient perceptions of autonomy, privacy and informed consent. There were also similar differences between individual countries. Conclusions were reached concerning practice, education and research. This article retraces the main instances at the root of Merleau-Ponty’s project of a « transcendental geology », a project announced in a working note of 1960. This project is linked to the complex intertwining of history and nature, which Merleau-Ponty thematizes as the two non-objectifiable dimensions that pose a challenge to reflexive thought. History and nature, both in their particular subjective manifestations as personal life or one’s own body, as well as in their broader sense as the history of (...) peoples or nature as a domain of the unbuilt, are characterized as unavoidable, as quasi-objects that are the soil of existence. It is in this direction that Merleau-Ponty’s interest in the “ultra-things” of Henri Wallon, those entities that the child can neither conceive nor imagine, seems to be heading. I propose that ultra-things are linked to inhabiting: they are the uninhabitable and the dimensions that cannot be renounced. This relationship with inhabiting restores the relational aspect of the problem of the unreflective in Merleau-Ponty and highlights the timeliness and urgency of the program of a transcendental geology as an ecology of thought and as an ecological philosophy. Marginalization has produced its own models of specialization in production which reflect in various countries and regions the needs of the ‘cores’ economy forces. This study aimed to describe and compare the views of nurses and older patients' relatives on factors restricting the maintenance of patient integrity in long-term care. The purposive sample comprised 222 nurses and 213 relatives of older patients in four Finnish long-term care institutions. The data were collected using a self-developed questionnaire addressing five sets of factors relating to patients, relatives, nurses, the organization and society. The maintenance of patient integrity was restricted by: (1) social factors, including lack of respect (...) for long-term geriatric care and lack of adequate resources; (2) patient factors relating to forgetfulness; and (3) factors relating to nurses and relatives in maintaining patient integrity. Better maintenance of patient integrity requires that more consideration is paid to issues of social respect and to the availability of adequate resources. Closer attention must be given to patients who are forgetful and unable to take part in decision making. (shrink)

The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

The formal delineation of the life principle or élan vital explains not only the origin of self-organisation in living systems, providing the basis for the first comprehensive dualist theory, but also is what makes the model empirically testable allowing this volume to make history. Il saggio muove da una ricostruzione storico-concettuale dell’interpretazione merleau-pontyana del manoscritto di Husserl Rovesciamento della dottrina copernicana nell’interpretazione della corrente visione del mondo, con cui Merleau-Ponty è in dialogo sin dalla Fenomenologia della percezione, per ripercorrere gli sviluppi del tema della Terra nell’avanzare della riflessione merleau-pontyana sul corpo-proprio, sull’organismo vivente, sulla dimensione carnale dell’essere. La proposta di un ritorno alla Terra, intesa come Boden irriducibile dell’esperienza, trova infatti il suo risvolto ontologico nell’idea di Spielraum, che già Husserl definiva come “ambito (...) di possibilità”, e che in Merleau-Ponty assume il senso di un margine di gioco sempre aperto nella carne. Boden e Spielraum, non a caso tematizzati da Merleau-Ponty in due corsi paralleli tenuti al Collège de France nell’anno 1959-1960, permettono una rivalutazione del vivente secondo un modello che, contro il riduzionismo meccanicista, privilegi la spontaneità e la contingenza, e aprono allo sviluppo dell’ontologia porosa che il filosofo andrà proponendo negli ultimi anni. Ricostruendo la funzione della riflessione sulla corporeità e sul rapporto del vivente al mondo-ambiente in questa maturazione, si argomenterà che la critica che Merleau-Ponty muove al dualismo empirismo-idealismo trovi nell’idea di Terra un momento chiave, che contribuisce ad orientarla in direzione di una filosofia della carne. Questo passaggio riconfigura la Natura stessa, pensata non già come un originario, ma in quanto ambito di possibilità processuale e transindividuale, come quel quasi-oggetto, come lo definiva, ancora, Husserl, che presenta un’irriducibile resistenza ad un pensiero di sorvolo, proprio in quanto è condizione del pensiero stesso e ancoraggio della vita tutta.This essay begins with a historico-conceptual reconstruction of the Merleau-Pontian interpretation of Husserl’s manuscript, “Foundational Investigations of the Phenomenological Origin of the Spatiality of Nature,” with which Merleau-Ponty is in dialogue from Phenomenology of Perception onward, and revisits the development of the theme of the Earth in the progression of Merleau-Ponty’s reflection on le corps propre, the living organism, and the carnal dimension of being. The proposal for a return to the Earth, taken as irreducible Boden of experience, indeed finds its ontological reverse side in the idea of Spielraum, which Husserl already defined as a “milieu of possibilities,” and which in Merleau-Ponty takes on the sense of a margin of play always open in the flesh. Boden and Spielraum, two notions that Merleau-Ponty does not thematize by chance in the two parallel courses given at the Collège de France over the years 1959-1960, enable a reassessment of the living being according to a model that, against mechanistic reductionism, privileges spontaneity and contingency, and opens to the development of the porous ontology that the philosopher would propose in his final years. Reconstructing the function of reflection on corporeality, and on the relationship of the living being with its milieu in the process, it will be argued that the criticism directed by Merleau-Ponty against the dualism of empiricism-idealism finds in the idea of the Earth a key moment that contributes to orienting him in the direction of a philosophy of the flesh. A startup ecosystem is a dynamic environment in which several actors, such as investors, venture capitalists, angels, and facilitators, are the protagonists of a complex interplay. Most of these interactions involve the flow of capital whose size and direction help to map the intricate system of relationships. This quantity is also considered a good proxy of economic success. Given the complexity of such systems, it would be more desirable to supplement this information with other informative features, and a natural choice (...) is to adopt mathematical measures. In this work, we will specifically consider network centrality measures, borrowed by network theory. In particular, using the largest publicly available dataset for startups, the Crunchbase dataset, we show how centrality measures highlight the importance of particular players, such as angels and accelerators, whose role could be underestimated by focusing on collected funds only. We also provide a quantitative criterion to establish which firms should be considered strategic and rank them. Finally, as funding is a widespread measure for success in economic settings, we investigate to which extent this measure is in agreement with network metrics; the model accurately forecasts which firms will receive the highest funding in future years. This essay builds on two questions: the relation of the child with the other and the child’s way of knowing, in which the resistance of the unreflected is not yet problematized. Through a reconstruction of Merleau-Ponty’s critique of Piaget’s idea of the child’s linear intellectual progression toward reflexive abstraction, I highlight the moment of unreflection by taking up the notion of ultra-thing, which Merleau-Ponty borrows from Henry Wallon. These ultra-things are entities with which the child entertains a vague relation and (...) which always remain at the horizon of her perception without yet being possessed in a representation or grasped in a concept. They include, for example, the sun, the sky, the Earth, the body as an object, existence before the birth of the child – uninhabitable dimensions or, to the contrary, ones that are necessarily inhabited. The concept of ultra-thing has not been sufficiently explored in Merleau-Pontian studies and its importance remains underappreciated. This essay thus formulates a hypothesis about the relation between ultra-things and hyper-reflection. (shrink)
