In this article, I examine the discourse around evil from the perspective of philosophical anthropology. Through an analysis of the religious symbolism of evil and an associated quest for a complete study of being, I intend in this article to explore fresh ways of establishing the relation between our rhetorical practices of evil and moral responsibility. I draw on Ricoeur’s work on the primary symbols of evil, which can be seen as a means for clarifying and extending our understanding of (...) evil and moral responsibility. I employ the concept of “the double intentionality of symbol” to advance an expressive-performative model of speaking about the full shape of moral responsibility. At stake in my paper is the possibility of recognizing the need to valorise subordinate resources of knowledge that might prevent us from studying and responding to the elusive reality of evil in intellectual abstraction. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

The Confucian doctrine of _tianxia_ outlines a unitary worldview that cherishes global justice and transcends social, geographic, and political divides. For contemporary scholars, it has held myriad meanings, from the articulation of a cultural imaginary and political strategy to a moralistic commitment and a cosmological vision. The contributors to _Chinese Visions of World Order_ examine the evolution of tianxia's meaning and practice in the Han dynasty and its mutations in modern times. They attend to its varied interpretations, its relation to (...) realpolitik, and its revival in twenty-first-century China. They also investigate tianxia's birth in antiquity and its role in empire building, invoke its cultural universalism as a new global imagination for the contemporary world, analyze its resonance and affinity with cosmopolitanism in East-West cultural relations, discover its persistence in China's socialist internationalism and third world agenda, and critique its deployment as an official state ideology. In an era of digital revolution, artificial intelligence, big data and augmented reality, technology has shifted from being a tool of communication to a primary medium of experience and sociality. Some of the most basic human capacities are increasingly being outsourced to machines and we increasingly experience and interpret the world through digital interfaces, with machines becoming ever more ‘social’ beings. Social interaction and human perception are being reshaped in unprecedented ways. This book explores this technologisation of the social and (...) the attendant penetration of permanent liminality into those aspects of the lifeworld where individuals had previously sought some kind of stability and meaning. Through a historical and anthropological examination of this phenomenon, it problematises the underlying logic of limitless technological expansion and our increasing inability to imagine either ourselves or our world in other than technological terms. After the outbreak of the Covid-19 pandemic, most states enacted new measures to constrain international mobility. By May 8th, 2020, more than 93% of the world’s population lived in states with special entry bans and more than three billion lived in countries whose borders were almost completely closed to non-citizens. Can such measures be justified? If so, would this undermine the open borders view? This paper examines these questions. It argues, first, that, although short-term entry bans and other similar measures (...) designed to protect public health can be justified, these bans need to be designed with a number of exemptions, in particular, for asylum seekers and refugees. Even in times of pandemic, completely closed borders are indefensible. It argues, second, that although extreme versions of the open borders position may have difficulty accepting this conclusion, other versions of the position can consistently justify special entry restrictions. The ever-growing acceptance and use of assisted human reproduction techniques has caused demand for “donated” sperm and eggs to outstrip supply. Medical professionals and others argue that monetary reward is the only way to recruit sufficient numbers of “donors”. Is this a clash between pragmatics and policy/ethics? Where monetary payments are the norm, alternative recruitment strategies used successfully elsewhere may not have been considered, nor the negative consequences of commercialism on all participants thought through. Considerations leading some countries to ban (...) the buying and selling of sperm, eggs and embryos are outlined and a case made that the collective welfare of all involved parties be the primary consideration in this, at times heated, debate. Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public (...) space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland. While there is an extensive literature on how the precautionary principle should be interpreted and when precautions should be taken, relatively little discussion exists about the fair distribution of costs of taking precautions. We address this issue by proposing a general framework for deciding how costs of precautions should be shared, which consists of a series of default principles that are triggered according to desert, rights, and ability to pay. The framework is developed with close attention to the pragmatics of (...) how distributions will affect actual behaviours. It is intended to help decision-makers think more systematically about distributional consequences of taking precautionary measures, thereby to improve decision-making. Two case studies—one about a ban on turtle fishing in Costa Rica, and one about a deep-sea mining project in Papua New Guinea—are given to show how the framework can be applied. (shrink)

In the years after the first circulation of Sidereus Nuncius, Galileo’s Padua anti-Copernican colleague, the staunch Aristotelian philosopher, Cesare Cremonini, published a book on ‘traditional’ cosmology, Disputatio de coelo in tres partes divisa which puzzled the Roman authorities of the Inquisition and the Index much more than any works on celestial novelties and ‘neo-Pythagorean’ astronomy. Cremonini’s disputation on the heavens has the form of an over-intricate comment of Aristotle’s conceptions, in the typi­cally argumentative style of Scholasticism. Nonetheless, it immediately raised (...) the concern of Cardinal Bellarmin, the Pope and other Inquisitors. At a close reading, Cremonini’s interpretation of Aristotle’s cosmos proved radically anti- Christian. It represented a radicalization of Pomponazzian Alexandrism. In fact, Cremonini did not only circulate Aristotelian principles used by Pom­ponazzi to argue for the soul’s mortality. He also wiped away all transcendence from the Aristotelian cosmos. In fact, he marginalized the function of the motive Intelligences by explaining heavenly motions through the action of animal-like inseparable souls although he did not erase nor reduced all Intelligences to only one, in accordance with Alexander. Also, he put at the center of Aristotle’s cosmos the idea of its eternity, a thesis which he explicitly connected with the rejection of the idea of God the Creator. Cremonini assumed that the univer­sal efficiens, that is the efficient cause of all motion and change in the world, is nothing but the first heaven. As a result of this radically naturalist reading of Aristotle, he banned God from the cosmos, reduced Him to the final cause of the world, and deprived Him of any efficiency and will. This essay on less ex­plored sources of Renaissance astronomical debates considers the institutional, cultural and religious setting of Cremonini’s teaching and conceptions. It as­sesses the reasons for his troubles with the religious authorities, and the politi­cal support he was granted by the Serenissima Republic of Venice inspite of the scandalous opinions he circulated as a university professor. My reconstruction of his views is based on the Disputatio de coelo of 1613 and later works, which are directly connected with cosmo-theological polemics with the religious au­thorities: his Apologia dictorum Aristotelis de quinta coeli substantia and the unpublished book De coeli efficientia, two manuscript copies of which are preserved in the libraries of Padua and Venice. A new translation of Liu Xiang’s 劉向 Lienü zhuan 列女傳 is long overdue.1 And most of the translation by Anne Behnke Kinney, Exemplary Women of Early China: The Lienü Zhuan of Liu Xiang, is very well done indeed. At the same time, Kinney has made a series of odd and clearly intentional choices when translating the classic, choices worth querying. Most importantly, she insists on translating the classic as if it directly addressed its readers, even if this insistence rides roughshod (...) over the language used in the text, and flies in the face of the early evidence about both the composition of the text and the literary outputs of the woman, Ban Zhao 班昭.. Over recent years religious conservatives in the United States have fervently contested the idea of a liberal, secular public sphere. This article urges scholars to consider that contest in light of the history of the New Christian Right (NCR) of the late 1970s and 1980s. NCR activists, intellectuals, lawyers, and government officials advanced a critique of Rawlsian political liberalism, one charging that public institutions were not the bastions of neutrality supposed by American liberals. Contrary to the U.S. Constitution’s ban on (...) an establishment of religion, this critique alleged, cultural elites and judges had lifted the “religion” of secular humanism up to a preferred status while attempting to purge the public sphere of Christianity. Focusing on a pair of federal court cases from the 1980s, this article considers one of the NCR‘s most fascinating strategies––defining as a “religion” the very secularism meant to contain religion to private life. Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

The dead donor rule originally stated that organ donors must not be killed by and for organ donation. Scholars later added the requirement that vital organs should not be procured before death. Some now argue that the DDR is breached in donation after circulatory determination of death programs. DCDD programs do not breach the original version of the DDR because vital organs are procured only after circulation has ceased permanently as a consequence of withdrawal of life-sustaining therapy. We hold that (...) the original rendition of the DDR banning killing by and for organ donation is the fundamental norm that should be maintained in transplantation ethics. We propose separating the DDR from two other fundamental normative rules: the duties to prevent harm and to obtain informed consent. (shrink)

When a physician employment relationship terminates, the physician–patient relationship may also be terminated by enforcement of a covenant not to compete, which typically forces the physician to leave the geographic area for a period of time. This gives rise to several ethical dilemmas. The public interest is compromised when enforcement of these covenants contributes to the shortage of physicians in the community, and individual patients are harmed when their physicians are no longer available. The authors undertook a unique study to (...) explore physician perspectives concerning the ethics of banning a physician from practice and the impact of the ban on both the physician and the physician’s patients. The results identified harmful effects that have not been raised in prior scholarly articles or reported court opinions. After reviewing the legal background of covenants not to compete, this paper presents the results of that study and concludes that resorting to the legal system for enforcement of covenants not to compete is not always the ethical course of action. Television advertisements depicting the use of electronic cigarettes have recently exposed minors to images of smoking behaviors. While these advertisements are currently legal, existing laws should be interpreted or expanded to ban the commercial depiction of smoking behaviors with any product that resembles a cigarette to shield minors from potentially influential advertising.

Martin Heidegger and Ernst Jünger rightly count among the signal examples of intellectual complicity with National Socialism. But after supporting the National Socialist movement in its early years, they both withdrew from political activism during the 1930s and considered themselves to be in “inner emigration” thereafter. How did they react to the end of National Socialism, to the Allied occupation and finally to the foundation of the Federal Republic of Germany in 1949? Did they abandon their stance of seclusion and (...) engage once more with political issues? Or did they persist in their withdrawal from the political sphere? In analyzing the intellectual relationship of Heidegger and Jünger after 1945, the article reevaluates the assumption of a “deradicalization” of German conservatism after the Second World War by showing that Heidegger's and Jünger's postwar positions were no less radical than their earlier thought, although their attitude towards the political sphere changed fundamentally. Many libertarians believe that self-ownership is a separate matter from ownership of extra-personal property. “No-proviso” libertarians hold that property ownership should be free of any “fair share” constraints, on the grounds that the inability of the very poor to control property leaves their self-ownership intact. By contrast, left-libertarians hold that while no one need compensate others for owning himself, still property owners must compensate others for owning extra-personal property. What would a “self” have to be for these claims to be (...) true? I argue that both of these camps must conceive of the boundaries of the self as including one's body but no part of the extra-personal world. However, other libertarians draw those boundaries differently, so that self-ownership cannot be separated from the right to control extra-personal property after all. In that case, property ownership must be subject to a fair share constraint, but that constraint does not require appropriators to pay compensation. This view, which I call “right libertarianism,” differs importantly from the other types primarily in its conception of the self, which I argue is independently more plausible. (shrink)
