Bayesian models of legal arguments generally aim to produce a single integrated model, combining each of the legal arguments under consideration. This combined approach implicitly assumes that variables and their relationships can be represented without any contradiction or misalignment, and in a way that makes sense with respect to the competing argument narratives. This paper describes a novel approach to compare and ‘average’ Bayesian models of legal arguments that have been built independently and with no attempt to make them consistent (...) in terms of variables, causal assumptions or parameterization. The approach involves assessing whether competing models of legal arguments are explained or predict facts uncovered before or during the trial process. Those models that are more heavily disconfirmed by the facts are given lower weight, as model plausibility measures, in the Bayesian model comparison and averaging framework adopted. In this way a plurality of arguments is allowed yet a single judgement based on all arguments is possible and rational. (shrink)

Rationale Treatment guidelines recommend a more conservative surgical approach than mastectomy for early stage breast cancer and a stronger emphasis on adjuvant therapy. Registry data at South Australian teaching hospitals have been used to monitor survivals and treatment in relation to these guidelines.Aims and objectives To use registry data to: (1) investigate trends in survival and treatment; and (2) compare treatment with guidelines.Methods Registry data from three teaching hospitals were used to analyse trends in primary courses of treatment of breast (...) cancers during 1977–2003 (n = 4671), using univariate analyses and multiple logistic regression. Disease-specific survivals were analysed using Kaplan–Meier product limit estimates and multivariable Cox proportional hazards regression.Results The 5-year survival was 79.9%, but with a secular increase, reaching 83.6% in 1997–2003. The relative risk of death (95% confidence limits) was 0.74 (0.62, 0.88) for 1997–2003, compared with previous diagnoses, after adjusting for tumour node metastasis stage, grade, age and place of residence. Treatment changes included an increase in conservative surgery (as opposed to mastectomy) from 51.7% in 1977–1990 to 76.8% in 1997–2003 for stage I (P < 0.001) and from 31.1% to 52.2% across these periods for stage II (P < 0.001). Adjuvant radiotherapy also became more common (P < 0.001), with 20.6% of patients receiving this treatment in 1977–1990 compared with 60.7% in 1997–2003. Radiotherapy generally was more prevalent when conservative surgery was provided, although also relatively common in mastectomy patients when tumour diameters exceeded 50 mm or when there were four or more involved nodes. The proportion of patients receiving chemotherapy increased (P < 0.001), from 19.6% in 1977–1990 to 36.9% in 1997–2003, and the proportion having hormone therapy also increased (P < 0.001), from 34.3% to 59.4% between these periods.Conclusions Survivals appear to be increasing and treatment trends are broadly consistent with guideline directions, and the earlier research on which these recommendations were based. Institutions in France are not yet well prepared to respond to allegations of scientific misconduct. Following a serious allegation in late 1997. INSERM,* the primary organization for medical and health-related research in France, began to reflect on this subject, aided by scientists and jurists. The conclusions have resulted in establishing a procedure to be followed in cases of alleged misconduct, and also in reinforcing the application of good laboratory practices within each laboratory. Guidelines for authorship practices and scientific assessment must (...) also be considered. Even though each institution must remain responsible for responding to allegations of scientific misconduct within its doors, INSERM would like to see national, European, and international co-ordination about the methods of such response. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Strong evidence shows that exposure and engagement with the natural world not only improve human wellbeing but can also help promote environmentally friendly behaviors. Human-nature relationships are at the heart of global agendas promoted by international organizations including the World Health Organization’s “One Health” and the United Nations “Ocean Decade.” These agendas demand collaborative multisector interdisciplinary efforts at local, national, and global levels. However, while global agendas highlight global goals for a sustainable world, developing science that directly addresses these agendas (...) from design through to delivery and outputs does not come without its challenges. In this article, we present the outcomes of international meetings between researchers, stakeholders, and policymakers from the United Kingdom and Brazil. We propose a model for interdisciplinary work under such global agendas, particularly the interface between One Health and the UN Ocean Decade and identify three priority research areas closely linked to each other: human-nature connection, conservation-human behavior, and implementation strategies. Berceville en vient, à propos du texte crucial de Rm 7,14-25 au « je » du discours de Paul tel que le perçoit S. Thomas. Tout en tenant compte de ce qu’en avaient dit les « Autorités », S. (...) Thomas n’en marquait pas moins ses « préférences » : ce texte, sur le bien difficile à faire et le mal qui se présente au « je », s’applique aussi bien au juste qu’au pécheur. En contrepoint, la lecture de Luther, en réaction contre le naturalisme de la Renaissance, se trouve au terme d’une transformation radicale de la raison et de la philosophie. La question est posée : est-il possible aujourd’hui de se mettre à l’école de Thomas le contemplatif sans rien perdre de l’attention inquiète que notre modernité porte à l’histoire où Dieu vient et fait grâce ?Although they are not voluminous, St. Thomas’s commentaries on Scripture are essential to his practical theology. After recalling the keys to reading and interpreting Biblical texts according to the customs and traditions of his time, G. Berceville arrives at St. Thomas’ interpretation of the “I” in the discourse of St. Paul in the crucial text of Rm 7, 14-25. While taking into account what the “Authorities had said,” St. Thomas nevertheless pointed out his “preferences.” This text, concerning the good which is difficult to do and the evil that presents itself to the “I”, can be applied to the just man as well as to the sinner. In contrast, Luther’s reading – a reaction against the naturalism of the Renaissance – came at the end of a radical transformation of reason and philosophy. This “reading” reveals both the strangeness of Thomas’ exegesis today, and Luther’s sensitivity to the historical dimension of man, which structures his “theological anthropology.” It also raises the question: Is it possible today to follow the school of Thomas the contemplative without losing the uneasy attention our modernity brings to history which God enters and saves? The task of computing a function F with the help of an oracle X can be viewed as a search problem where the cost measure is the number of queries to X. We ask for the minimal number that can be achieved by a suitable choice of X and call this quantity the query complexity of F. This concept is suggested by earlier work of Beigel, Gasarch, Gill, and Owings on “Bounded query classes”. We introduce a fault tolerant version (...) and relate it with Ulam's game. For many natural classes of functions F we obtain tight upper and lower bounds on the query complexity of F. Previous results like the Nonspeedup Theorem and the Cardinality Theorem appear in a wider perspective. (shrink)

In the chapter of Gilles Deleuze’s The Fold: Leibniz and The Baroque where Whitehead makes a surprising and crucial appearance, Deleuze chooses to introduce the English mathematician and philosopher as the successor, or “diadoche,” of what he describes as a somewhat secret school. The reason for the secrecy of this school is itself something of a mystery. Brock begins by highlighting and finding wanting the modern practice of “technology assessment” as epitomized in the establishment of the US Office of Technology Assessment in 1972. We live in a world, a milieu, of ever-multiplying new technologies and technological artifacts. “Technology assessment” attempts to evaluate their impacts as thoroughly as possible through scientific, managerial methods. Costs and benefits, benefits and harms, short-term and long-term, near and distant effects: how can we measure what we know and extrapolate to what we need to know?In part 1 Brock engages in some detail the thinking of Martin Heidegger, George Grant, and Michel Foucault on technology. Although Heidegger and Foucault in particular are not ultimate authorities for Brock, his chapters on their work provide a helpful philosophical critique of the inadequacies of today’s narrow managerial approaches to technological assessment. The real problems lie much deeper: in the ways technology reflects and restructures our whole way of thinking about life, materiality, subjects and objects, and means and ends.Having used Heidegger, Grant, and Foucault to unmask the complex reality of technology in the modern era, Brock turns in part 2 to Augustine, Karl Barth, and Bernd Wannenwetsch to try to build a Christian theological ethics of technology and work that will, in the end, provide a richer texture for our interactions with the questions raised by new technologies. In briefest terms, he argues that our questions and judgments about technology should arise within the church gathered for worship rather than within the management team gathered for measurement of effects. It could be said that in the former it is God who questions technology whereas in the latter technology and its servants constitute an implicit challenge to God and the world external to themselves.Brock’s study will be of particular interest to students of his primary six sources: Heidegger, Grant, Foucault, Augustine, Barth, and Wannenwetsch, whose ideas and quotations dominate the pages of this book. Without any doubt Christian Ethics in a Technological Age is a significant work that deserves careful consideration in graduate seminars and among specialists in the field; nonetheless, I have three criticisms. First, the work would have been much stronger if it demonstrated awareness and understanding of the work of Jacques Ellul, Carl Mitcham, Albert Borgmann, and other leading thinkers in this arena. Second, Brock’s writing style (long, complex Germanic sentence structures, eccentric vocabulary choices such as the recurrent use of “purchase”) gets in the way of successful communication—especially with the very managers and technologists he presumably would like to influence. Third, while sympathizing with his rejection of managerial formulas for analysis, some much more concrete and practical counsel on the implications of his position would have been [End Page 189] helpful. A comienzos de la década de los 80, el filósofo Gilles Deleuze aplicó la teoría de la imagen de Bergson expuesta en Materia y Memoria (1896) a la imagen cinematográfica con la intención de desarrollar nuevas herramientas conceptuales que, a través de un análisis de la historia del cine, permitieran poder delinear mejor tanto la relación cognoscitiva más allá de los presupuestos de sujeto-objeto, como una teoría de la comunicación pre-verbal no estructuralizada fonéticamente que superara definitivamente la concepción lacaniana del (...) lenguaje. Si bien dichos análisis pueden ser vistos también como el establecimiento de unos principios alternativos a las teorías del montaje tanto de Vertov como de Eizenshtéin, el interés primario de nuestro paper se centrará en la redefinición de las categorías espacio-temporales que conlleva esta nueva teoría del cine esgrimida por Deleuze. Concretamente analizaremos cómo la nueva tecnología cinematográfica, especialmente en su desarrollo europeo de la segunda postguerra (Godard, Fellini, Syberberg, Tarkovski) supone una comprensión temporal por completo ajena a cualquier comprensión de causalidad lineal, teleológica o no, de corte cronológico. Victor Zaslavsky, The Neo-Stalinist State: Class, Ethnicity and Consensus in Soviet Society, M.E. Sharpe, Inc. (New York, 1982). In social analysis, effective explanations alternate “thick description” with “thin description” (...) Zaslavsky's The Neo-Stalinist State and Feher's, Heller's and Markus’ Dictatorship over Needs, can be seen to track “actually existine socialism” down the respective paths of “thick” and “think” analysis. _Hegel and Deleuze_ cannily examines the various resonances and dissonances between these two major philosophers. The collection represents the best in contemporary international scholarship on G. W. F. Hegel and Gilles Deleuze, and the contributing authors inhabit the as-yet uncharted space between the two thinkers, collectively addressing most of the major tensions and resonances between their ideas and laying a solid ground for future scholarship. The essays are organized thematically into two groups: those that maintain a firm but nuanced disjunction (...) or opposition between Hegel and Deleuze, and those that chart possible connections, syntheses, or both. As is clear from this range of texts, the challenges involved in grasping, appraising, appropriating, and developing the systems of Deleuze and Hegel are varied and immense. While neither Hegel nor Deleuze gets the last word, the contributors ably demonstrate that partisans of either can no longer ignore the voice of the other. (shrink)

The article presents a comparative analysis of the theories of capitalism of Gilles Deleuze and Felix Guattari’s Anti-Oedipus and Moishe Postone’s Time, Labor, and Social Domination. What Postone calls abstract domination is similar to the capitalist axiomatic of the French philosophers. These works introduce theories concerning the historical specificity of capitalism, which, at the same time, make possible an immanent critique of this particular social form. The authors of these works agree on highlighting the historically specific aspects of capitalism that (...) make the latter different from other social forms. Likewise, they maintain a partially affirmative relation to this social form, in which contradictory historical emancipatory possibilities are developed. Therefore, the article draws a parallel between Postone’s idea of abstract social domination and Deleuze and Guattari’s capitalist axiomatic. It also aims at showing that the three authors introduce a critique of capitalism, which is based on their own historical and social developments, and which work in an immanent way and not with abstract normative standards. Popular Indian cinema provides a test case for examining the limitations of Gilles Deleuze's categories of movement-image and time-image. Due to the context-specific aesthetic and cultural traditions that inform popular Indian cinema, although it appears at times to be both movement- and time-image, it actually creates a different type of image. Analysis of Toofani Tarzan (1936) and Dilwale Dulhania Le Jayenge (1995) demonstrates how, alternating between a movement of world typical of the time-image, and a sensory-motor movement of character typical (...) of the movement-image, popular Indian cinema explores the potential fluxing of identities that emerge during moments of historical complexity. What does it mean to talk of the power of God in relation to the human self? The discourses generated by the Jewish and Christian tradition about the capacity for divinity have been mainly promulgated by men, and have more often than not served to exclude women cognitively, practically, and spiritually. As a result they have been made powerless in the face of God’s presence. It is possible to look to ideas developed in Hindu Tantra for comparative notions of power (...) (shakti) which can redeem the place of God for women. The path of divine consciousness is effectively illustrated by an imaginary and somatic awareness, by a devout attention to the play of light in the soul. In this paper I propose to read the assignment of energy and force within conceptions of divinity through the lens of a poststructuralist realization, using the work of Michel Foucault, Gilles Deleuze and Félix Guattari, and Luce Irigaray. This working paper is basically an exercise in metaphorical writing, and one reader has called it 'creative theology'. (shrink)

The aim of this article is to investigate and discuss the notions of difference and representation in Emmanuel Levinas and Gilles Deleuze, articulating such notions through the example of a university extension project involving the formation of a musical ensemble composed of autistic children. Our research involved a review of four major philosophical works—Emmanuel Levinas’ Totality and Infinity; Among Us: Essays On Alterity; and “The Concept Of Difference In Bergson”; and Gilles Deleuze’s Difference and Repetition--in addition to secondary references. The (...) main articulations of the investigation carried out in the project consist of aspects such as: taking responsibility for the autistic child through cultivating asymmetrical relationships, a process that takes place through sensibility, below any representation; and not totalizing the alterity involved while maintaining, at the same time, its radical difference. In addition, there is an emphasis in the work on the difference of each child, beyond his or her diagnostic identity, understanding that all participants are undergoing unique processes of differentiation, and that some differences are not more privileged than others, in that that such hierarchies are determined by power relations. Another contribution of this research is the emphasis on the intensive affective flows of children, and the construction of relationships of mutual affection, which increases the circulation of vital energy in each one. Finally, the results of the project are offered as guidelines for clinical practice, and for the cultivation of a politics of difference, as an alternative to hegemonic practices in autism studies in contemporary times.
