In a global economic landscape of hyper-commodification and financialisation, efforts to assimilate digital art into the high-stakes commercial art market have so far been rather unsuccessful, presumably because digital artworks cannot easily assume the status of precious object worthy of collection. This essay explores the use of blockchain technologies in attempts to create proprietary digital art markets in which uncommodifiable digital artworks are financialised as artificially scarce commodities. Using the decentralisation techniques and distributed database protocols underlying current cryptocurrency technologies, such (...) efforts, exemplified here by the platform Monegraph, tend to be presented as concerns with the interest of digital artists and with shifting ontologies of the contemporary work of art. I challenge this characterisation, and argue, in a discussion that combines aesthetic theory, legal and philosophical theories of intellectual property, rhetorical analysis and research in the political economy of new media, that the formation of proprietary digital art markets by emerging commercial platforms such as Monegraph constitutes a worrisome amplification of long-established, on-going efforts to fence in creative expression as private property. As I argue, the combination of blockchain-based protocols with established ambitions of intellectual property policy yields hybrid conceptual-computational financial technologies (such as self-enforcing smart contracts attached to digital artefacts) that are unlikely to empower artists but which serve to financialise digital creative practices as a whole, curtailing the critical potential of the digital as an inherently dynamic and potentially uncommodifiable mode of production and artistic expression. Scientific knowledge relies heavily on models, shaped by simplifying assumptions, with common categories being abstraction and idealization. This article aims to expose conceptual challenges inherent in conventional interpretations of these concepts, particularly in their practical application to scientific modeling. The primary hurdle emerges in applying these categories to real­world instances of scientific modeling, which we illustrate with examples of non­causal explanations. Key issues revolve around (i) the ambiguous distinction between abstraction and idealization and (ii) the application of the simplifying assumption (...) of abstraction. Our hypothesis posits that non­causal explanations face unintelligibility due to an unclear understanding of the role of simplifying assumptions in them. To test this, we analyze selected examples, ranging from (toy­)examples to real­world instances, scrutinizing the alignment with the standard notions of abstraction and idealization. Throughout, we investigate the influence of simplifying assumptions on these explanations, assessing their adherence or deviation from conventional concepts. (shrink)

Conceptual analysis as a method of inquiry has long enjoyed popularity in analytic philosophy, including the philosophy of science. In this article I offer a perspective on the ways in which the method of conceptual analysis has been used, and distinguish two broad kinds, namely philosophical and empirical conceptual analysis. In so doing I outline a historical trend in which non-naturalized approaches to conceptual analysis are being replaced by a variety of naturalized approaches. I outline the basic characteristics of these (...) approaches with illustrative examples, arguing that recent developments in the philosophy of science show that in order to achieve a more adequate understanding of scientific endeavour we need to prioritize the naturalized accounts of the method. Ce texte traite de piratage en ligne à travers la pratique du peer-to-peer au Québec, c’est-à-dire une forme d’échange non autorisé de produits culturels sur Internet (pratique appelée « piratage culturel »). Une approche strictement juridique de la pratique y voit un simple détournement de copyright, tandis que d’autres approches (mouvement Copyleft, Parti pirate, etc.) postulent qu’un gain social est généré par une telle circulation de l’information à grande échelle. Peu de recherches empiriques ont documenté toutefois les contenus circulant réellement (...) dans ces réseaux de piratage culturel. Une première étude canadienne utilisant l’observation directe amène donc un éclairage nouveau. L’étude montre que le peer-to-peer est régulièrement utilisé au Québec pour transmettre des œuvres du patrimoine national (musique, films, livres, émissions de télévision, etc.), dont plusieurs sont non disponibles autrement. Cela suggère que le piratage culturel ne se limite pas à l’acquisition gratuite ou au « vol » de produits culturels (plusieurs produits n’existent pas en magasin), ni ne dessert en soi la diversité culturelle (des produits québécois y sont largement échangés). La réflexion éthique sur le phénomène se situe dès lors sur deux plans : au plan individuel (avec l’ethos des « pirates ») et au plan collectif (avec le rôle du piratage culturel dans la circulation du patrimoine québécois). Enfin, la pratique pourrait contribuer à la constitution et à la circulation d’archives nationales accessibles sur Internet, dans le contexte d’une migration généralisée des produits culturels du format physique au format numérique. Initial moves to develop a new generation of commercial supersonic transports to succeed Concorde are already under way. Aircraft manufacturers promise a plane that will withstand both economic and environmental scrutiny. Yet, the crash of an Air France Concorde at Paris in July 2000 has caused further doubts about the viability of SSTs. This study revisits the previous debate surrounding Concorde to explore the potential for current initiatives to overcome the public’s anxiety of further environmental degradation. This article seeks, therefore, (...) to examine the role that environmental issues and campaign groups played in the development of the first generation of SSTs, concentrating on the influence of global environmental arguments on political decision making. Debate surrounding the global environmental impact of SSTs foreshadows later attention to human impact at the planetary scale. It provides the first illustration of the often complex links between attempted protection of the global environment and political and public perceptions of national vested interests. (shrink)

Resumen El configuracionismo latinoamericano es la propuesta consumada en la obra tardía del sociólogo mexicano Enrique de la Garza Toledo. Este artículo propone una aproximación genealógica y arqueológica de esta perspectiva en tres campos convergentes. En primer lugar, como teoría social que propone la categoría de subjetividad como mediación entre estructura y acción. En segundo lugar, como una epistemología constructivista con implicancias metodológicas para la investigación social. Y, finalmente, como una corriente en el campo de la sociología del trabajo que (...) ha devenido en los nuevos estudios laborales latinoamericanos. This article proposes a genealogical and archaeological approach to this perspective in three convergent fields. First, as a social theory that proposes the category of subjectivity as a mediation between structure and action. Secondly, as a constructivist epistemology with methodological implications for social research. And finally, as a school in the field of the sociology of work that has resulted in the new Latin American labour studies. The article also proposes moments of tension and lines of prospective based on the theoretical, epistemological and methodological development and the empirical studies promoted by De la Garza. Responding to criticism of my Vital Conflicts in Medical Ethics, this article corrects misrepresentations and answers objections. The core of the debate is the moral category of “direct killing” as opposed to “indirect.” The article argues that critics beg the question by simply presupposing, instead of argumentatively defending, the very physicalist understanding of “directness” which the book has shown to be untenable. This article clarifies the intentional meaning of “direct” and what it means to choose something as a means; it (...) also argues that this does not imply a subjectivist conception of morality, and refutes objections to the view that the moral evil of killing is constituted by its opposition to justice. It finally shows why this is essentially an argument against proportionalism and in defense of the core teaching of Veritatis splendor. Die Investiturstreit-Episode in der Alexias Anna Komnenes ist bemerkenswert detailliert. Neben der Kontroverse um die Simonie, wird auch die Frage der Rechtbzw. Unrechtmäßigkeit des Pontifikats Gregors VII. thematisiert, ebenso die Gegenkönigserhebung Rudolfs von Rheinfelden, die Schlacht an der Weißen Elster, der Tod des Gegenkönigs sowie das Bündnis zwischen Gregor VII. und Robert Guiscard. Der Normannenherzog ist der Anknüpfungspunkt der Autorin für die Ereignisse des Investiturstreits, der Grund dafür, dass dieser westliche Konflikt für sie von Bedeutung ist. Anna Komnenes Bericht erhält (...) jedoch auch Sondergut, Ereignisse, die sich nicht mit den westlichen Quellen in Einklang bringen lassen. Ein bedeutender Teil dieses Sonderguts ist insbesondere gegen Gregor VII. gerichtet, so etwa dessen Misshandlung der Gesandten Heinrichs IV., aber auch die suggerierte Teilnahme des Papstes an der Schlacht an der Weißen Elster. Diese antipäpstliche Tendenz dominiert die gesamte Episode. Sie wird nicht zuletzt an der Art und Weise deutlich, wie Anna Komnene das Aufeinandertreffen zwischen Gregor VII. und Robert Guiscard darstellt. Sie gestaltet die Begegnung als Herrschertreffen und übt somit massive Kritik an Papst Gregor VII., der sich demnach als weltlicher Herrscher geriert. Die Autorin gebraucht die stilistischen Mittel der Ironie und des Spotts, um Gregor in ein negatives Licht zu rücken. Sie präsentiert Gregor als Erfinder unmenschlicher Strafen, als überheblichen Barbaren, als Herrscher und Feldherrn, nie jedoch als einen sich seines Amtes würdig erweisenden Geistlichen. Der Umstand, dass Gregor VII. niemals beim Namen genannt, sondern anonym lediglich als 'Papst' bezeichnet wird, ist mehr als eine 'damnatio memoriae'. Durch Gregors Anonymisierung beschränkt sich die Kritik in der Alexias nicht auf das Individuum 'Gregor VII.', sondern sie wird im Gegenteil ausgeweitet auf die institutionelle Ebene des Papsttums. Die Schlechtigkeit und Boshaftigkeit Gregors VII., also des Papsttums überhaupt, in der Alexias verstärkt sich noch, wenn man diesem Verhalten dasjenige des konstantinopolitanischen Patriarchen gegenüberstellt. Ein Vergleich des in der Alexias geschilderten Verhaltensmusters des 'römischen Patriarchen' mit dem täglich erlebten Verhaltensmuster des 'konstantinopolitanischen' drängte sich dem Rezipienten der Alexias geradezu auf, so dass das päpstliche Verhalten als ὕβρις erscheinen musste.
