This article aims to research on Carl Schmitt’s foundations of the individual and his reserve of consciousness. Nowadays, the main researchers of Schmitt’s works asseverates that the German jurist was an antiliberal and, therefore, an antiindividualist. However, we argue that is possible to find not only a critique to liberal conception of the individual, but a purposeful conception through his reflections on criticism against authority and public authority. In order to demonstrate it, we propose an hermeneutical approach to his work (...) —mainly to The Leviathan in the State Theory of Thomas Hobbes and “The Visibility of the Church. A Scholastic Consideration”. Particularly, we attend the human action as the founder of the political order and the individual’s ability to criticize the authority. This article claims that Schmitt formulates a notion of individuality of a different sign than the liberal one and that is closely linked to the idea of Law, the institutionalstate framework and the community substrate. El objetivo de este artículo es indagar en la fundamentación schmittiana del individuo y de la reserva de conciencia. En la actualidad, buena parte de la recepción contemporánea considera al jurista renano como un antiliberal y, por lo tanto, como un antiindividualista. Sin embargo, nuestra hipótesis es que es posible encontrar en su obra no solo una crítica a la noción liberal de individuo, sino también una concepción propositiva a través de sus reflexiones sobre la crítica frente a la autoridad (...) y al poder público. Para demostrarla, se propone un abordaje hermenéutico-exegético de sus obras —principalmente, de las conferencias sobre El Leviatán en la teoría del Estado de Thomas Hobbes y del artículo "La visibilidad de la Iglesia. Una reflexión escolástica”— para indagar la acción humana como fundadora del orden político y las posibilidades del individuo de criticar a la autoridad. El artículo sostiene que Carl Schmitt formula una noción de individualidad de signo distinto a la liberal y que se vincula íntimamente con la idea de Derecho, el entramado institucional-estatal y el sustrato comunitario. El presente artículo es la primera traducción española de un artículo del jurista alemán Hermann Heller titulado "¿Liberalismo autoritario?", en el que pretende dar cuenta de una nueva forma de articulación política que se desarrolla al comienzo de los años 30 en Alemania y que combina el autoritarismo político con el liberalismo económico.

Randomized controlled trials test new drugs using various debiasing devices to prevent participants from manipulating the trials. But participants often dislike controls, arguing that they impose a paternalist constraint on their legitimate preferences. The 21st Century Cures Act, passed by US Congress in 2016, encourages the Food and Drug Administration to use alternative testing methods, incorporating participants’ preferences, for regulatory purposes. We discuss, from a historical perspective, the trade-off between trial impartiality and participants’ freedom. La sociedad del conocimiento y la introducción en los procesos de enseñanza-aprendizaje de las tecnologías de la información y la comunicación, están exigiendo de quienes nos dedicamos a la educación en el ámbito universitario, la utilización de nuevas estrategias didácticas y la reinvención de algunas antiguas o no tan nuevas. Se trata de dar respuesta a la demanda social de “aprender de otra manera” para mejorar la inserción de los nuevos egresados en su ámbito profesional. Esta nueva forma de aprender (...) debe tener en consideración las exigencias de los nuevos contextos de enseñanza-aprendizaje, donde el protagonismo de los estudiantes es un elemento esencial y la relación de lo aprendido con sus posibilidades de aplicación en el contexto profesional es el otro. Casualmente el modelo de formación basado en competencias desde el enfoque socioformativo coincide en ambos protagonismos y el portafolio como estrategia didáctica que puede utilizarse en este modelo puede ayudar a dotar de protagonismo al que aprende haciéndole tomar conciencia de que el aprendizaje no se produce de manera automática sino a través de una serie de pasos y etapas que a la vez que se van consiguiendo nos permiten reflexionar el proceso. Una vez llevado a cabo este proceso de reflexión general, puede aplicarse en el ámbito médico para iniciar al estudiante a tomar conciencia de su semejanza con el diagnóstico clínico. El artículo pretende mostrar la razón por la que la curaduría experimental puede ser considerada una práctica artística bajo la mira de teorías del arte contemporáneo. Para ello se presenta una genealogía de la curaduría experimental para, posteriormente, mostrar su semejanza con las produc-ciones artísticas contemporáneas en lo atenido a su relación con el espectador y su vínculo con los contextos sociales extraartísticos.

This study explores the effects of the shift to emergency remote teaching on teachers’ levels of well-being, emotions, and motivation. A total of 936 Spanish teachers participated in this nationwide survey from all educational levels, thus allowing comparison among levels, which is a novelty and strength of our study. Four aspects were explored: instructional adaptation to ERT; well-being changes and the main challenges in this regard; changes in emotions; and changes in motivation and the main factors. Importantly, we explored a (...) number of teacher characteristics for the three last aspects. Our results show that teachers felt the impact of ERT on their well-being, emotions, and motivation. Additionally, female teachers, teachers with students of low socioeconomic status, in public schools, and primary and secondary teachers were the most affected groups. This indicates that the impact of ERT differed and some populations of teachers are more at risk of suffering burnout because of ERT. (shrink)

El presente artículo pretende elucidar las insuficiencias de la denominada economía del bienestar a partir del enfoque de las capacidades de Amartya Sen y Martha C. Nussbaum. En el primer bloque presentamos los lineamientos fundamentales de ambas propuestas con el fin de concretar y dotar de autonomía sus respectivos modelos basados en el enfoque de las capacidades, contrastándolos con los modelos convencionales de medición de la calidad de vida relativa de la ciudadanía. En el segundo bloque incidimos en la justificación (...) de sus aportaciones para profundizar en la perspectiva de la capacidad desde una vertiente comparada, esto es, desde dos áreas de estudio (Sen desde el ámbito económico y Nussbaum desde el filosófico) que han aunado sus fuerzas e intereses bajo este paradigma. Panel de discusión del Cuerpo Académico de Estética y Arte realizado en los marcos del Tercer Coloquio Nacional de la Asociación Mexicana de Estudios en Estética, en el que fueron expositores los doctores José Ramón Fabelo Corzo, Gerardo de la Fuente Lora e Isabel Fraile Martín. El doctor Fabelo realizó una presentación general sobre los antecedentes del tema, su significación y perspectivas de desarrollo, en particular sobre las posibilidades de introducción de nuevas categorías, entre ellas la de la “colonialidad (...) del valer”. El doctor De la Fuente, por su parte, centró su intervención en las contradicciones que debe resolver la teoría de la colonialidad para no terminar realizando ella misma una apología a la colonialidad, refiriéndose al papel que en ello puede y debe desempeñar la estética. La doctora Fraile llama la atención sobre lo que podría considerarse el lado positivo de las relaciones de colonialidad que permitieron, entre otras consecuencias, un mutuo enriquecimiento cultural, algo que muestra mediante el análisis del traspaso de imaginarios visuales para los artistas de América Latina. Ha de diferenciarse entre dos tipos de curaduría, así llamadas “tradicional” y “experimental”. El presente texto tiene como objetivo acercarnos conceptualmente a la curaduría tradicional a través de la figura del curador, así como presentar el lugar en el que esta se inserta en el proceso de conformación y realización del valor artístico de las obras, todo ello desde la postura de la teoría pluridimensional del valor. La curaduría tradicional es aquella ligada a la concepción del museo en su acepción (...) moderna, que tiene como finalidad básica coleccionar, conservar y exhibir, con una narrativa cerrada y ceñida al discurso instituido sobre el arte, en general, y sobre las obras que se exhiben, en particular. Spirituality in Palliative Care Aimed at the ElderlyEspiritualidade no contexto de cuidados paliativos oncológicos a idososIn the last decade, spirituality has been studied in oncological palliative care for the elderly from quantitative, qualitative, and mixed perspectives. The study seeks to reveal the meaning of spirituality in this context. It reviews indexed literature from the MEDLINE database through PubMed between 2009 and 2019, which was accessed online, in full text, anonymously, and in English and Spanish. Revista Medicina Paliativa was manually searched. (...) The results include 50 subject-relevant articles and four categories. El presente trabajo recoge un análisis comparativo realizado entre diversos códigos y recomendaciones de buen gobierno tanto a nivel nacional como internacional. Durante el estudio, se ha revisado una amplia muestra de códigos de gobierno corporativo, prestando especial atención a los aspectos incluidos en los mismos relativos a la composición de los consejos de administración, la voluntariedad versus obligatoriedad de las recomendaciones, el tratamiento otorgado a las figuras de Presidente y CEO, etc., identificando las principales diferencias y similitudes entre ellos (...) y mostrando la evolución temporal de las distintas recomendaciones en los diferentes países e instituciones analizadas. Tras el análisis comparativo se observa que la mayoría de los códigos se orientan en la misma dirección, incluyendo apartados similares en todos ellos, aunque también existen pequeñas matizaciones específicas que los diferencian. This article offers a new interpretation of Mexico's transition to democracy that differs from the pessimistic and less culturally oriented ones that currently prevail. In the article I develop a normative model, which emphasizes the moral capacities of civil societies and their ability to inspire altruistic actions. I suggest that this approach is not only more compelling philosophically but also more plausible empirically. To demonstrate this, I reconstruct a series of events from Mexico's recent past. My discussion suggests that social (...) actors can reconfigure societal self-understandings through moral interventions in the public sphere and that such refigurations of the symbolic order are central for democratic transition. Este artículo se ocupa de las enseñanzas de Avicena en lo que respecta a los “sujetos” de las ciencias teoréticas —física, matemáticas y metafísica— tal y como se presentan en la Introducción al Libro de la Curación. Posteriormente, se muestra su influencia en el comentario de Tomás de Aquino al De trinitate, de Boecio, q. (...) 5, art. 1. A través de una comparación entre Avicena y Tomás se muestra la profunda influencia que tuvo Avicena en la comprensión tomista del rango de las tres clases de ciencias teoréticas. (shrink)

Many philosophers in the analytic tradition have recently sought to explore the question of the meaning of life. In the first part of this paper I subject two important approaches from this tradition – those of John Cottingham and Susan Wolf - to criticism. I then suggest that Cottingham and Wolf articulate certain assumptions about the meaning of life that are widely shared amongst analytic philosophers. As the aging population, including frail older people, continues to grow in Mainland China, quality of life and end-of-life care for frail older people has attracted much attention. Advance care planning is an effective way to improve end-of-life care for people with advanced diseases, and it is widely used in developed countries; however, it is a new concept in Mainland China. The effects of advance care planning and its acceptability in Mainland China are uncertain because of its culture-sensitive characteristics. The (...) objective of this article is to discuss the serious social issue of caring for frail older people and illustrate the possibility of implementing advance care planning in nursing homes in Mainland China through a review of relevant literature, which will focus on legislation, healthcare system engagement, public engagement, and cultural issues. Recommendations to promote and implement advance care planning include choosing nursing homes as a proper setting, establishing an ethical climate, and enhancing public awareness. (shrink)

ABSTRACT There is a growing acceptance of user rights models with regard to dependent populations such as nursing home residents, but classic theories of rights presuppose levels of human rationality and human agency often lacking in the case of highly dependent populations. While user rights models have strong advantages at a rhetorical level, the reduced capacity for dependent groups to assert their rights constitutes a significant structural limitation. Policies, practices and regulatory strategies developed on the assumption that very dependent groups (...) can indeed assert such rights thus proceed on a premise which is fatally flawed. (shrink)

The word ‘empowerment’ has become a popular term, widely used as an important claim, also within the health services. In this paper the concept's philosophical roots are traced from Freire and his ‘Pedagogy of the Oppressed’ to the philosophical thoughts of Hegel, Habermas, and Sartre. An understanding of the concept, as a way to facilitate coping and well‐being in patients through reflection and dialogue, emerges. Within an empowerment strategy the important claim on the nurse and the patient will be to (...) reveal the patient's own resources and limitations in times with sickness and reduced functionality to promote the patient's choice to act and cope. From this point of view an education‐programme for the frail elderly is outlined. If the nurse wants to empower the elderly patient she has to be willing to be educated through the dialogue with the patient, and to look for the patient's own meaning of being frail and elderly. The coping and self‐care solutions for the patient may then even be different from the preferences of the nurse, and this does not mean that the empowerment strategy is a failure or that the patient then has to continue without the assistance from the nurse. Within an empowerment strategy, in the Freirerian sense, the important thing is that both the patient and the nurse together critically reflect on the meanings of the sickness so that the patient can be able to make his own conscious choices. Few clinical situations arouse more emotion and drama and lead to more conflict in decision-making than cardio-pulmonary resuscitation . The procedure was described as potentially beneficial more than 40 years ago. However, its efficacy and place in the care of the frail elderly have taken a long time to be established. In the world of secular medical practice, there are many situations when CPR may be provided to elderly, frail and cognitively compromised individuals for whom its clinical benefit is questionable. (...) In those patients suffering from dementia, surrogates are responsible for decision-making, which complicates the process. When the clinical uncertainty is coupled with strong cultural and religious influences, as within Orthodox Judaism, the development of an acceptable approach to cardiac arrest is more challenging. A clinically sound, ethically defensible and religiously sensitive approach to CPR requires a deep understanding of all the factors involved in the decision-making process and may require periodic re-evaluation not only by clinicians but by religious scholars and leaders. How can we provide the best care for the growing population of older adults, many of whom are either very frail or very sick? The traditional medical model of care is focused on treatment of single diseases. This can work well for pneumonia, cancer, or diabetes in younger patients. It does not, however, work as well for frail older adults who have accumulated multiple chronic conditions and disabilities.
