Many healthcare goods, such as surgical instruments, textiles and gloves, are manufactured in unregulated factories and sweatshops where, amongst other labour rights violations, workers are subject to considerable occupational health risks. In this paper we undertake an ethical analysis of the supply of sweatshop-produced surgical goods to healthcare providers, with a specific focus on the National Health Service of the United Kingdom. We contend that while labour abuses and occupational health deficiencies are morally unacceptable in the production of any commodity, (...) an additional wrong is incurred when the health of certain populations is secured in ways that endanger the health and well-being of people working and living elsewhere. While some measures have been taken to better regulate the supply chain to healthcare providers in the UK, further action is needed to ensure that surgical goods are sourced from suppliers who protect the labour and occupational health rights of their workers. Previous studies have identified the critical role of the left fusiform cortex in visual word form processing, learning, and memory. However, this so-called visual word form area's other functions are not clear. In this study, we used fMRI and the subsequent memory paradigm to examine whether the putative VWFA was involved in the processing and successful memory encoding of faces as well as words. Twenty-two native Chinese speakers were recruited to memorize the visual forms of faces and Chinese words. Episodic (...) memory for the studied material was tested 3. h after the scan with a recognition test. The fusiform face area and the VWFA were functionally defined using separate localizer tasks. We found that, both within and across subjects, stronger activity in the VWFA was associated with better recognition memory of both words and faces. Furthermore, activation in the VWFA did not differ significantly during the encoding of faces and words. Our results revealed the important role of the so-called VWFA in face processing and memory and supported the view that the left mid-fusiform cortex plays a general role in the successful processing and memory of different types of visual objects. © 2010 Elsevier Inc. Over the last decade, our appreciation of the importance of the nucleolus for cellular function has progressed from the ordinary to the extraordinary. We no longer think of the nucleolus as simply the site of ribosome production, or a dynamic subnuclear body noted by pathologists for its changes in size and shape with malignancy. Instead, the nucleolus has emerged as a key controller of many cellular processes that are fundamental to normal cell homeostasis and the target for dysregulation in many (...) human diseases; in some cases, independent of its functions in ribosome biogenesis. These extra‐nucleolar or new functions, which we term “non‐canonical” to distinguish them from the more traditional role of the nucleolus in ribosome synthesis, are the focus of this review. In particular, we explore how these non‐canonical functions may provide novel insights into human disease and in some cases new targets for therapeutic development. (shrink)

ObjectiveThe objective of this study was to validate the computerized Symbol Digit Modalities Test in a Swiss pediatric cohort, in comparing the Swiss sample to the Canadian norms. Secondly, we evaluated sex effects, age-effects, and test–retest reliability of the c-SDMT in comparison to values obtained for the paper and pencil version of the Symbol Digit Modalities Test.MethodsThis longitudinal observational study was conducted in a single-center setting at the University Children’s Hospital of Bern. Our cohort consisted of 86 children aged from (...) 8 to 16 years. The cohort included both healthy participants and patients hospitalized for a non-neurological disease. Forty eight participants were assessed during two testing sessions with the SDMT and the c-SDMT.ResultsTest–retest reliability was high in both tests. A reliable change index was calculated for the SDMT and the c-SDMT corrected for practice effects. While a significant age effect on information processing speed was observed, no such effect was found for sex. When data on the c-SDMT performance of the Swiss cohort was compared with that from a Canadian cohort, no significant difference was found for the mean time per trial in any age group. Norm values for age groups between 8 and 16 years in the Swiss cohort were established.ConclusionNorms for the c-SDMT between the Swiss and the Canadian cohort were comparable. The c-SDMT is a valid alternative to the SDMT. It is a feasible and easy to administer bedside tool due to high reliability and the lack of motor demands. (shrink)

Amartya Sen argues that a conception of impartiality built upon “trans-positional objectivity” provides a potential remedy to conflicts of distributive justice by securing the most “reasonable reasons” in a debate. This article undertakes a critical analysis of Sen’s theory by contrasting it with Paul Ricoeur’s claim that impartiality is a normative concept and therefore that the demand faced within the arena of competing distributive claims is not one of providing the most reasonable reasons but of exposing and understanding the role (...) of convictions that underwrite normative frameworks, or ethical orders. -/- Amartya Sen soutient qu’une idée de l’impartialité qui se fonde sur une objectivité «trans-positionelle» offre un remède possible aux conflits de la justice distributive en s’assurant d’obtenir les «raisons» les plus «raisonnables» dans un débat. Cet article a pour intention principale de formuler une critique de l’hypothèse de Sen en la contrastant avec l’interprétation de l’impartialité proposée par Paul Ricœur. Selon Ricœur, l’impartialité est un concept normatif. Par conséquent, la tâche à assumer est de révéler et de comprendre le rôle des convictions qui établissent les bases des cadres normatifs et des systèmes éthiques, et non de procurer les raisons les plus raisonnables. L’amitié connaît un regain de faveur dans la Chine ancienne à partir des Song, avec l’attractivité sans précédent du système des examens mandarinaux dans les milieux savants. Mais quoi de plus éloigné, en apparence, du rapport égalitaire auquel nous associons l’amitié que le système foncièrement hiérarchisant que sont les examens? Le cas de la session de 1057 offre une vue exceptionnelle sur les possibilités du déploiement de l’amitié dans un contexte de sociabilité très hiérarchisée, à travers les rapports de l’examinateur (...) en chef Ouyang Xiu 歐陽修 (1007-1072), d’un des sous-examinateurs Mei Yaochen 梅堯臣 (1002-1060) et d’un jeune lauréat, Su Shi 蘇軾 (1037-1101). En croisant les perspectives de l’histoire littéraire, de l’histoire politique et de l’histoire administrative, nous nous demandons d’abord comment les échanges poétiques ont pu créer un cadre amical parmi les examinateurs dans un contexte institutionnel inévitablement tendu, et finalement favoriser une action commune. Nous nous interrogeons ensuite sur les circonstances qui ont permis à l’amitié déjà ancienne de Ouyang Xiu et Mei Yaochen de s’approfondir à la faveur d’un échange poétique, et dans quelle mesure le prestige de cet échange a pu accroître le renom de Mei Yaochen. Quant aux lettres de remerciement de Su Shi, nous examinons comment a pu se créer à travers elles une « affinité élective » entre les deux examinateurs et le jeune lauréat. (shrink)

In the Western media, stories about China seem to fall into one of two categories: China’s astounding economic development or its human rights abuses. As human rights discourses follow increasingly hegemonic conventions, especially with regard to China, many of their key assumptions remain unexamined. This special issue—the second in a two-part series beginning with “Cosmologies of the Human”—critically investigates the relationship between China and the human as it plays out in law, politics, biopolitics, political economy, labor, medicine, and culture. The (...) contributors interrogate the evolving meanings of “China” and “the human,” both inside China and internationally. The issue tracks the ways in which global discourses treat China—still officially socialist—as similar to, different from, and alternative to Western capitalist modernities. Several essays probe the modern theoretical underpinnings of human rights abuses in China, including a crucial distinction between “the human” and “the people.” Others review the impact of Maoism on Marxist debates in China and in the West, as well as the specific influences of Mao’s writings on French politics and theory in the 1960s. A visual dossier compares eight contemporary Chinese artists, directors, and public image-makers in order to discuss the figure of the human from Tiananmen Square to the 2008 Beijing Olympics. While many contributors discuss China and the West comparatively, the issue interrogates the universalizing claims of both Western and Chinese norms of the human by privileging the local, particular, and eccentric. In that I case Propertius' failure to observe historical sequence is peculiar; nor is it defended securely by I supposedly parallel passages. More damaging, however, is that 8 must describe the triumph of L. Aemilius Paullus in 167, two years after the accepted date of Ennius' death. Hertzberg and Postgate claimed that it alludes to the defeat of Demetrius of I Pharos by a L. Aemilius Paullus in 219 ; this is unlikely for some of the same reasons as the rival theory of Butler and Barber, which has found many adherents, that it refers to the victory over Antiochus' navy by L. A Study of the related words munia, munus, munis, and their derivatives will throw light on the original linguistic and juridical meaning of the ius municipi. It is agreed that these words all derive from a root *mei ‘to exchange' . Meillet-Ernout rightly point out that words derived from that root with the suffix -n- ‘ont servi a désigner des échanges régiés par l'usage, et plusieurs ont une valeur juridique'.

The ternary, not binary, Kripke-type relation on a set of possible worlds is an essential part of the semantics of entailment by Routley-Meyer [2]. The unpopularity of such approach among many logicians is due to its intuitive vague content and complexity. An attempt is made to use not one ternary relation but two binary relations and necessity of bibinarness is demonstrated. It is shown that both semantics are equal hence the soundness and completeness of the system R of entailment can (...) be established with the respect to the bibinary semantics. Furthermore, the ternary semantic with discrete matrix for Lukasiewicz system Lℵ0 , which was proposed in [3], could be transformed into the bibinary one and it leads to the conclusion of the completeness and soundness of Lℵ0 with the respect to the bibinary semantic. The brief consideration of the bibinary semantic intuitive content is added, which further logical study could be based on. (shrink)

Il a toujours refusé une pure érudition qui oublierait de se relier à une pensée philosophique. Et par là même, peut-être, il déborde le cadre strictement universitaire de la spécialisation, d'abord, (...) non seulement à l'intérieur du domaine grec, avec notamment son approche des présocratiques, mais surtout comme éditeur et interprète reconnu de Maine de Biran, et aussi par son goût de la littérature, que trahit une élégance stylistique heureusement toujours féconde. Comment témoigner d’une espérance religieuse dans le droit contemporain ? Par l’obéissance et l’humilité de l’inculturation, ou par l’objection et la résistance propre au signe de contradiction ? Si les périodes barbares du XXe siècle ont relancé l’analyse théologique de la tension entre ces deux voies, qu’en est-il aujourd’hui des contextes apparemment pacifiés de nos droits démocratiques ? Si le moment juridique y colonise progressivement la société, c’est au nom de sa nature de « droit commun » qu’il estime acquérir (...) de sa prétention croissante à la « neutralité ». À cet égard, la prise de parole religieuse dans l’espace public est aujourd’hui vivement débattue. Il serait cependant erroné de n’y viser que le seul moment de l’élaboration formelle de la loi. Cette prise de parole peut aussi viser les modalités d’application et de mise en contexte du droit. Cet article entend montrer l’importance de ce nouveau moment pour une prise de parole religieuse, entendue comme une troisième voie : celle de l’attestation évangélique au cœur de la pratique du droit. Semën [Simon] Liudvigovich Frank was born in Moscow, the son of a doctor. He studied law at Moscow University, joined a student Marxist group headed by P.B. Struve, and as a result was barred by the Russian authorities from living in any of the Russian “university cities.” He continued his university education at the Universities of Berlin and Munich. His first published work was a critique of Marx’s theory of value. Between 1902 and 1905 he divided his time among Berlin, (...) Munich, and Moscow. In 1902 he published his first philosophical essay, on Nietzsche’s doctrine of Fernstenliebe. He was a contributor—along with Nicolas Berdyaev, S.N. Bulgakov, and Struve—to three influential symposium volumes: Problemy idealizma [Problems of idealism], Vekhi [Signposts], and Iz glubiny [De profundis]. This last work was printed but its release was blocked by Soviet censorship. All of these works were originally published in Moscow; all of them have, in the past three or four years, been republished in Moscow, but for more than seventy years they were banned in the Soviet Union and could be reprinted only abroad. Cardinal Etchegaray argues here that the dialogue between church and state, with both parties rooted in sometimes conflicting absolute claims and values, has become more recently a wider-ranging dialogue between the church and a pluralist, relativist liberal society. The very definition of “liberal society” is open to argument, and the church may find elements to commend or oppose in any given definition. Since the nineteenth century the church has often found itself in opposition to various ideas of “liberty,” especially those (...) that represent an idolatry of absolute rights that push aside Christian spiritual and moral concerns. Now that liberalism has become the pervasive model for society, the church finds it may more easily express its critique, with the aim of making society more conducive to allowing people to become fully human. Indeed, the church provides a necessary check on the excesses of liberal society, particularly those of capitalism and democratic populism. Its essential point is the transcendent dimension of the human person—our connection with the divine. The pursuit of economic and political ends needs to be governed by a concern for the ethical, itself founded on the divine. Liberal society will only live up to its own highest aspirations through promoting self-mastery and an awareness that humanity’s freedom is ultimately found only in God. (shrink)

Nikolai Fedorovich Fedorov is one of the most original and as yet inadequately studied Russian thinkers. Neither a professional philosopher, nor a well-known scholar, nor a critical essayist, he led a kind of double existence while working as an ordinary civil servant, developing his original philosophy at his leisure in the hours free from his intensive daily work. Fedorov's life was one of selflessness and self-denial, not at all eventful outwardly. He graduated from the Gymnasium in Tambov and completed three (...) years of study in the Law Department of the Richelieu Lyceum in Odessa, after which he taught for a number of years in the Borovsk, Lipetsk, Podol'sk, and other regional schools. The quarter century he spent working in the Library of the Rumiantsev Museum in Moscow was the most stable period in Fedorov's life. Fedorov's ideas attracted the attention of outstanding cultural figures. F.M. Dostoevskii became acquainted with them in 1878 through Peterson, and on March 24 of that year he wrote: "I am essentially in full accord with these ideas. I read them as if they were my own." L.N. Tolstoy, who knew Fedorov personally, said, "I am proud to be living in the same times as such a man." V.S. Solov'ev, who also associated with Fedorov, wrote to him as follows in the mid-1880s: "Your ‘project’ is the human spirit's first advance along the path of Christ since the advent of Christianity. As for me, I can only acknowledge you as my teacher and spiritual father." A.M. Gorky was especially impressed by the activism in Fedorov's views. But none of this precludes the many and very essential divergences of these authors from Fedorov. One can find some links with his ideas in A.N. Belyi, V. Ia. Briusov, N.A. Zabolotskii, V.V. Maiakovskii, A.P. Platonov, M.M. Prishvin, I.L. Sel'vinskii, O.D. Forsh, and V.N. Khlebnikov. The artist B.N. Chekrygin drafted a large fresco entitled The Resurrection of the Dead [Voskreshenie mertvykh] and a philosophical work entitled The Synod of the Resurrecting Museum [Sobor voskreshaiushchego muzeia], both inspired by Fedorov's teachings.
