Landmark Supreme Court rulings determine American law by adjudicating among competing reasonable interpretations of basic political rights. Jeremy Waldron argues that this practice is democratically illegitimate because what determines the content of basic rights is a bare majority vote of an unelected, democratically unaccountable, elitist body of nine judges. I argue that Waldron's democratic critique of judicial review has implications for real-world reform, but not the implications he thinks it has. He argues that systems of legislative supremacy over the judiciary (...) are democratically preferable to the American one. I provide reasons why his argument is unsound and explain that, properly construed, Waldron's premises support implementing a system where ordinary citizens chosen by lottery participate in a deliberative mini-public to vote on which reasonable interpretation of a basic political right will become the law of the land. This study compares and analyzes separate court rulings in three countries on “mini-cup jelly” (a firm jelly containing konjac and packaged in bite-sized plastic cups) from a food ethics perspective. While the Korean and US courts decided that the mini-cup jelly was defective, and that the manufacturers or importers were liable for damages in these cases, the Japanese court took an opposing stance in favor of the manufacturer. However, from an absolute and fundamental viewpoint, the jelly was unacceptable, (...) ethically as well as legally, because it was unsafe, unwholesome, and unfit for children’s consumption. I argue that the ignoring or sidelining of fundamental principles of food ethics, especially “respect for life,” was at the core of these cases. If the manufacturers and importers had considered and prioritized the principles of food ethics over and above big sales and profits, the choking accidents could have been prevented. To conclude, it is very important to minimize risks by applying the principles of food ethics at the outset before any accidents can occur. (shrink)

This paper argues that the recent 'mini-renaissance' in Marxist educational sociology as propounded in particular by Rikowski (1996, 1997) is fatally flawed, not only denying the sui generis (autonomous) properties of the educational system but also precluding practical social theorising per se . The reason for this centres on the adoption of a universal internal relations social ontology, which results in the reduction of concrete social reality to the narrow abstraction of the omnipresent 'Capital Relation'. At the same time, (...) such theorising remains conspicuously silent on the issue of the feasible alternatives to capitalism implied by the (albeit flawed) explanatory critiques of such recent Marxist theorising within the sociology of education. We offer a new proposal for cosmic singularity resolution based upon a quantum cosmology with a unitary bounce. This proposal is illustrated via a novel quantization of a mini-superspace model in which there can be superpositions of the cosmological constant. This possibility leads to a finite, bouncing unitary cosmology. Whereas the usual Wheeler–DeWitt cosmology generically displays pathological behaviour in terms of non-finite expectation values and non-unitary dynamics, the finiteness and unitarity of our model are formally guaranteed. For classically singular (...) models with a massless scalar field and cosmological constant, we show that well-behaved quantum observables can be constructed and generic solutions to the universal Schrodinger equation are singularity-free. Key features of the solutions of our model include a cosmic bounce due to quantum gravitational effects, a well-defined FLRW limit far from the bounce, and a super-inflationary epoch in the intermediate region. Furthermore, our model displays novel features including: i) superpositions of values of the cosmological constant; ii) a non-zero scattering length around the big bounce; and iii) bound ‘Efimov universe’ states for negative cosmological constant. The last feature provides a new platform for quantum simulation of the early universe. A companion paper provides detailed interpretation and analysis of particular cosmological solutions. (shrink)

This effective physics is found to be compatible with an effective period of cosmic inflation well below the Planck scale. The detailed effective physics of this Rayleigh-scattering limit is provided via: i) an exact analytical treatment of the model in the de Sitter limit; and ii) numerical solutions of the full model. In this mini-review, we summarized the results of 12 visual mismatch negativity studies that attempted to use this component as a tool for investigating differences between non-clinical samples of participants as well as the possibility of automatic discrimination in the case of specific categories of visual stimuli. These studies investigated the effects of gender, the effects of long-term differences between the groups of participants, and the effects of short-term states, as well as the vMMN effect elicited by artworks as (...) a special stimulus category. Work stress is consistently linked with the deterioration of cognitive and mental health, limitations in everyday workplace performance, and an increased risk of developing diseases. A common thread binding these consequences appears to be stress-associated alterations in neuropsychological functions and affective domains, especially those reliant on hippocampal, prefrontal, and amygdala brain area. Although research broadly supports the claim that the practice of mindfulness meditation for the reduction of the consequences of stress and the promotion of health exert positive effects on (...) workplaces, the precise neuropsychological benefits of Mindfulness-based interventions in the context of organizations remain elusive. In this review, we will analyze the impairments imposed by stress on the brain areas and functions and the benefits of MBIs from a neuropsychological point of view. This is significant since there is a centrality of cognitive functions in core processes necessary for work achievements, such as emotion regulation, problem-solving, and learning. The promotion of wellbeing is a responsibility shared between workers and organizations. Developing healthy environments allows workers to exercise greater control over their work, face work challenges, work productively and develop their talent. (shrink)

Multi-stakeholder initiatives (MSIs)—private governance mechanisms involving firms, civil society organizations, and other actors deliberating to set rules, such as standards or codes of conduct, with which firms comply voluntarily—have become important tools for governing global business activities and the social and environmental consequences of these activities. Yet, this growth is paralleled with concerns about MSIs’ deliberative capacity, including the limited inclusion of some marginalized stakeholders, bias toward corporate interests, and, ultimately, ineffectiveness in their role as regulators. In this article, we (...) conceptualize MSIs as deliberative systems to open the black box of the different elements that make up the MSI polity and better understand how their deliberative capacity hinges on problems in different elements. On the basis of this conceptualization, we examine how deliberative mini-publics—forums in which a randomly selected group of individuals from a particular population engage in learning and facilitated deliberations about a topic—can improve the deliberative capacity of MSIs. Combining games with mobile commerce applications has been a trend in recent years. Mobile commerce is attracting a large number of people, especially females, to play mini games on the platform. The gamification of mobile commerce may affect users’ platform satisfaction. This study aims to explore the intention of female users to play mobile commerce games and its impact on platform satisfaction. We collected data from females in China who played mobile commerce games and then used a structural equation (...) model to test the various hypotheses we made. The results showed that game use intention fully mediated the impact of performance expectation, hedonic motivation, and social influence on platform satisfaction. Effort expectation had no significant impact on game use intention but had a positive impact on platform satisfaction. Game use intention had a positive impact on platform satisfaction. The frequency of playing games and the amount of money spent on the platform were positively correlated with game use intention. Females over 25 years old preferred to play mobile commerce games. This study provides a theoretical reference and practical enlightenment and makes a specific contribution to the development of mobile commerce platform and the application of gamification. However, this study has limitations in terms of test samples, research methods and research content, and further research on mobile commerce is required in the future. (shrink)

Using the analytic framework of normative logic presented in Fisher, Lovell, and Valero-Silva, provided here are five original business ethics mini-cases that may be used to teach and practice case analysis. We have taken the six questions that are used in the analytic framework of normative logic to solve ethical problems and have adapted them to seven steps that can be applied to conflict resolution of mini-cases in class. Then the adapted normative logic model has seven steps: Describe (...) the “fundamental needs of humankind” as they relate to the case, e.g. caring, supporting, reciprocity, fairness, trust; Explain the established norms, values, and laws that can be seen to apply in this case; State in brief the facts of the situation; Examine the network of circumstances that preceded the situation ; Generate at least three alternative positions and actions open to the actor in the case; Speculate on the hypothesized consequences of the different positions or actions the actor in the case may take; and Choose among the alternative positions the actor in the case might take and give your informed and judged reason for making that choice. A suggested answer is provided for one case, which could be reproduced as a class handout for students to examine after having done their own analysis and having discussed the case as a class. In response to a collection of essays in Jonathan Kvanvig's (1996) Warrant in Contemporary Epistemology: Essays in Honor of Plantinga's Theory of Knowledge, Alvin Plantinga notices that certain Gettier-style examples undermine his (1993b) canonical account of epistemic warrant as delineated in Warrant and Proper Function. In hopes to clarify how his account survives Gettier's purchase, he (1996; 2000) argues that a belief has warrant sufficient for knowledge only when produced in a favorable cognitive mini-environment. In Warranted Christian Belief Plantinga (...) (2000) specifies a condition required for a cognitive mini-environment's favorability. I argue that this condition falls prey to counterexample. Then I investigate a possible solution, which I reason fails as well. (shrink)

This essay focuses on recent proposals to confer decisional status upon deliberative minipublics such as citizen juries, Deliberative Polls, citizen’s assemblies, and so forth. Against such proposals, I argue that inserting deliberative minipublics into political decision-making processes would diminish the democratic legitimacy of the political system as a whole. This negative conclusion invites a question: which political uses of minipublics would yield genuinely democratic improvements? Drawing from a participatory conception of deliberative democracy, I propose several uses of minipublics that could (...) enhance the democratic legitimacy of political decision-making in current societies. Life history theory is a fruitful source of testable hypotheses about human individual differences. However, this field of study is beset by unresolved debates about basic concepts and methods. One of these controversies concerns the usefulness of instruments that purport to tap a unidimensional life history factor based on a set of self-reported personality, social, and attitudinal variables. Here, we take a novel approach to analyzing the psychometrics of two variants of the Arizona Life History Battery: the Mini-K and (...) the K-SF-42. Psychological network analysis generates models in which psychological variables comprise the nodes of a network, while partial correlation coefficients between these variables comprise the edges of the network. Centrality indices operationalize each node’s importance based on the pattern of the connections in which that node plays a role. Because childhood environments are hypothesized to influence adult LH, we tested the hypothesis that among the Mini-K items, and the K-SF-42 scales, those that tap relationships with parents are central to the networks constructed from these instruments. In an MTurk sample and an undergraduate sample that completed the Mini-K, and an MTurk sample that completed the K-SF-42, this hypothesis was falsified. Indeed, the “relationships with parents” items were among the most peripheral in all three networks. We propose that network analysis, as an alternative to latent variable modeling, offers considerable potential to test hypotheses about the input-output mappings of specific evolved psychological mechanisms. Democratic theorists often place deliberative innovations such as citizen's panels, consensus conferences, planning cells, and deliberative polls at the center of their hopes for deliberative democratization. In light of experience to date, the authors chart the ways in which such mini-publics may have an impact in the “macro” world of politics. Impact may come in the form of actually making policy, being taken up in the policy process, informing public debates, market-testing of proposals, legitimation of public policies, building confidence (...) and constituencies for policies, popular oversight, and resisting co-option. In Europe the elderly population is projected to increase from 18.5% (93.9 million) in 2014 to 28.7% (149.1 million) by 2080. In the USA it is estimated that by the year 2030 more than 20% of the population will be aged 65 years or over. This specific population is at high risk of unrecognised or untreated psychiatric illnesses and suicide. It is well known that completed suicide rate increases with age in both men and women. Although elderly people attempt suicide (...) less often than other age groups, they show a higher completion rate. Generally the methods chosen by elderly are more lethal, the intent is more serious, they are more determined and they show fewer warning sign than the younger population. A recent systematic review and meta-analysis of psychosocial intervention following self-harm in adults found that cognitive behavioural therapy was the most effective in these patients. Unfortunately there have been few reported trials of other potentially effective interventions. Because the scientific literature on psychosocial suicide prevention interventions in the elderly is still scant we decided to conduct a mini-review in order to take stock of the situation. Studies were identified through electronic searches of the Cochrane library, MEDLINE, Scopus and Web of Science databases. PRISMA guidelines were followed and only 7 articles met the inclusion criteria. No firm conclusions can be drawn about this topic because there is still little data and studies used inconsistent outcome measures and designs. Nonetheless, the existing data suggests that psychosocial interventions are promising. (shrink)
