Recent defenders of metaethical constructivism (like Christine Korsgaard, Sharon Street, Aaron James, and Carla Bagnoli) argue that this view can be shown to represent a new, free-standing alternative to familiar approaches in metaethics. If they are correct, traditional discussions in metaethics have overlooked an important position, one that is supposed to adequately explain the nature of our ethical thinking and practice while avoiding the kinds of objections that traditional views struggle with. However, what form constructivism should take and whether constructivists (...) can make good on this ambitious claim remains extremely controversial. This article starts out with a brief account of the origins of contemporary discussions of constructivism. It then moves on to canvass the main motivations and arguments for constructivism along with the various ways in which the view has been interpreted. In the second half of the article, it introduces a serious challenge to the ambitious claim that constructivism represents a new, free-standing approach in metaethics and concludes by entertaining a very recent proposal that this challenge might overlook. John Rawls’s 1980 Dewey Lectures are widely acknowledged to represent the locus classicus for contemporary discussions of moral constructivism. Nevertheless, few published works have engaged with the significant interpretive challenges one finds in these lectures, and those that have fail to offer a satisfactory reading of the view that Rawls presents there or the place the lectures occupy in the development of Rawls's thinking. Indeed, there is a surprising lack of consensus about how best to interpret the constructivism of these (...) lectures. In this paper, I argue that the constructivism presented in the Dewey Lectures is best understood as involving the view that moral truth is correspondence with procedurally-determined, stance-dependent facts. Employing Rawls’s discussion of rational intuitionism as a foil, I defend this reading against textual discrepancies from within the lectures, as well as those one finds across Rawls’s other works. In addition to settling interpretive disputes, I draw out the ways in which this understanding of Kantian constructivism fits within the broader comparative project in ‘moral theory’ that Rawls inherits from Sidgwick. Patient preference predictors aim to solve the moral problem of making treatment decisions on behalf of incapacitated patients. This commentary on a case of an unrepresented patient at the end of life considers 3 related problems of such predictors: the problem of restricting the scope of inputs to the models (the “scope” problem), the problem of weighing inputs against one another (the “weight” problem), and the problem of multiple reasonable solutions to the scope and weight problems (the “multiple reasonable models” (...) problem). Each of these problems poses challenges to reliably implementing patient preference predictors in important, high-stakes health care decision making. This commentary also suggests a way forward. Nathaniel J.P. Barron offers the first book length account in English of Ernst Bloch's contribution to a Marxist philosophy of language. It is ambitious both in situating Bloch's ideas in the broader Marxist engagement with language as it currently exists, and in using Bloch's utopian categories to challenge that engagement. Twentieth-century developments in logic and mathematics have led many people to view Euclid’s proofs as inherently informal, especially due to the use of diagrams in proofs. In _Euclid and His Twentieth-Century Rivals_, Nathaniel Miller discusses the history of diagrams in Euclidean Geometry, develops a formal system for working with them, and concludes that they can indeed be used rigorously. Miller also introduces a diagrammatic computer proof system, based on this formal system. In 'The duty to miscegenate', I harness John Stuart Mill's 19th century theory of social freedom to explain and to dismantle contemporary racialised and gendered injustice. In the first chapter—Social stigmatisation: 'a social tyranny'—I argue that persons racialised-and-gendered-as-black-women were, in the past, unjustly stigmatised by legal penalties against 'miscegenation' and are still, today, unjustly stigmatised by white male avoidance of cross-racial marriage and companionship. In the second chapter—Encounters that count: 'a foundation for solid friendship'—I argue that we can dismantle this (...) stigmatisation, by engaging in regular and frequent cross-racial commensality with persons racialised-and-gendered-as-black-women. In the third chapter—White right: 'a right to avoid'—I argue that, although we have a right to avoid commensal encounters with others, we do not have a right to avoid persons we racialise as black. This article examines the change which occurred in discussions of cultural transmission between the Enlightenment and the liberal outlook of the nineteenth century. The former is exemplified mainly by eighteenth-century historical discussions, the latter by the thought of Alexis de Tocqueville. An interest in the influence of advanced Western cultures on seemingly inferior non-Western societies was consistent throughout the eighteenth and nineteenth centuries. It was manifested mainly in discussions of the barbarian conquest of the Roman Empire on the one hand, (...) and of European colonial policies on the other. The sources discussed here evinced a clear Eurocentric chauvinism, yet were inherently non-racial in nature. While many Enlightenment intellectuals retained a generally positive view of cultural transmission, Tocqueville's post-revolutionary outlook was more pessimistic. (shrink)

Radical contextualists have observed that the content of what is said by the utterance of a sentence is shaped in far-reaching ways by the context of utterance. And they have argued that the ways in which the content of what is said is shaped by context cannot be explained by semantic theory. A striking number of the examples that radical contextualists use to support their view involve sentences containing color adjectives ("red", "green", etc.). In this paper, I show how the (...) most sophisticated analysis of color adjectives within the explanatory framework of compositional truth conditional semantics—recently developed by Kennedy and McNally (Synthese 174(1): 79-98 2010)—needs to be modified to handle the full range of contextual variation displayed by color adjectives. This paper analyzes what may have been a mistake by pianist Thelonious Monk playing a jazz solo in 1958. Even in a Monk composition designed for patterned mayhem, a note can sound out of pattern. We reframe the question of whether the note was a mistake and ask instead about how Monk handles the problem. Amazingly, he replays the note into a new pattern that resituates its jarring effect in retrospect. The mistake, or better, the mis-take , was “saved” by (...) subsequent notes. Our analysis, supported by reflections from jazz musicians and the philosopher John Dewey, encourages a reformulation of plans, takes, and mis-takes as categories for the interpretation of contingency, surprise, and repair in all human activities. A final section suggests that mistakes are essential to the practical plying and playing of knowledge into performances, particularly those that highlight learning. (shrink)

Fictionalists about a kind of disputed entity aim to give a face-value interpretation of our discourse about those entities without affirming their existence. The fictionalist’s commitment to non-realism leaves open three options regarding their ontological position: they may deny the existence of the disputed entities (anti-realism), remain agnostic regarding their existence (agnosticism), or deny that there are ontological facts of the matter (ontological anti-realism). This paper outlines a method of adjudicating between these options and argues that fictionalists may be expected (...) to hold preferences between them. The typical arguments and motivations for fictionalism lead naturally to a practice-based metaontological framework under which our practices regarding a kind of disputed entity might inform our ontological beliefs about those entities. When that framework is applied to fictionalism, it is found that the usual motivations for fictionalism lead naturally, though not decisively, to ontological anti-realism. And, where there are reasons against ontological anti-realism, fictionalism leans more toward anti-realism than agnosticism. (shrink)

Ernest Lepore and Kirk Ludwig correctly observe that Donald Davidson’s account of radical interpretation is in tension with his Swampman thought experiment. Nonetheless, I argue, they fail to see the extent of Davidson’s tension—and so do not handle it adequately—because they fail to appreciate that the thought experiment pits two incompatible response-dependent accounts of meaning against one another. I take an account of meaning to be response-dependent just in case it links the meaning of terms in an a priori manner (...) to the responses that a suitable subject under suitable conditions could or did have to those terms. That Davidson proposes two such accounts is deeply problematic for his program. After explaining the sense in which Davidson endorses two incompatible response-dependent accounts of meaning, I use that explanation to resolve the tension myself. (shrink)

Epistemic feelings like tip-of-the-tongue experiences, feelings of knowing, and feelings of confidence tell us when a memory can be recalled and when a judgment was correct. Thus, they appear to be a form of metacognition, but a curious one: they tell us about content we cannot access, and the information is supplied by a feeling. Evaluativism is the claim that epistemic feelings are components of a distinct, primitive metacognitive mechanism that operates on its own set of inputs. These inputs are (...) heuristics that correlate with the presence of mental content that can’t be accessed directly. I will argue that evaluativism is unmotivated, unsupported, and ill-conceived. I will critique the philosophical and empirical arguments for evaluativism and conclude that there is no reason to posit a distinct mechanism to explain epistemic feelings. I will conclude, however, that epistemic feelings may constitute a nonconceptual form of metacognition, which if true is a significant claim. (shrink)

However, largely because of the way in which it tries to limit case analysis, this system ends up being inconsistent, as shown here. MoatsIntroductionAs recent events have woefully displayed, armed rebellion is not a topic of merely theoretical interest.1 While theory seemingly has very little impact on the citizens participating in armed rebellions, theory still remains of paramount importance, providing crucial criteria to evaluate, restrain, apply, and respond to such force. Criteria such as legitimate authority, just cause, right intention, necessity, proportionality, and likelihood of (...) success have been offered by thinkers advocating "just war" theory from across diverse political, philosophical, and religious backgrounds, garnering widespread agreement over the centuries. Contemporary scholars who identify as "historically oriented" just war thinkers have continued to defend that historical tradition as a sufficient and substantial guide for contemporary practice.2 Yet some have questioned whether the it can provide useful aid for dealing with contexts of political tyranny. In a 2013 article, Valeria Morkevičius describes [End Page 175] Western culture as divided over the moral permissibility of armed rebellion, with advocates basing their views on the Enlightenment ideas found in John Locke and Jean-Jacques Rousseau, whereas traditional just war theorists have generally denied a right to armed rebellion.3 In Morkevičius's perspective, she argues that there can be justified use of armed force against tyranny and calls upon other scholars to help create a "just rebellion theory" that would "radically reimagine" traditional just war thinking.4 She claims that there is a "lack of a systematic and rigorous ethical framework for evaluating the justness of rebellions"5 and that "a new theory of just rebellion—a systematic way of evaluating the justness of real world rebellions, of determining appropriate state responses to domestic rebellions, and of weighing the pros and cons of intervention" is needed.6In line with Morkevičius' sentiments, the last ten years has seen the increasing rise of self-proclaimed just war revisionists.7 Jeff McMahan, the figurehead for this movement, claims that the classical just war criteria "can no longer stand."8 McMahan argues that traditional just war theory has [End Page 176] depicted war as a morally sui generis category of violence in which unique moral principles apply.9 The moral asymmetry of war is also reinforced by a "statist" and "collectivist" orientation that overrides the importance of individuals and their rights of life, liberty, property, and other fundamental goods. Instead of seeing war as a distinct category of violence, McMahan argues that war and self-defense are morally symmetrical. Further, he argues that combatants should be depicted as individuals distinct from their political or collective identity.10 In other words, McMahan offers a theory of war oriented around individuals and their rights based in the concept of justified self-defense.11 Extending McMahan's theory, Cécile Fabre has particularly targeted the criterion of legitimate authority as morally problematic.12 Rejecting the exclusive authorization of armed force by political authorities, she argues in favor of an individual's right to war, and by extension the right to rebellion.13 Therefore, given the historical just war tradition's emphasis on the criterion of legitimate authority (i.e., the restriction of armed force [End Page 177] to established authorities) and resistance to support armed rebellions due to the lack of recognized political leaders, revisionists conclude that traditional just war thinking is inadequate for providing contemporary guidance in the context of rebellion.14To challenge revisionist claims, I analyze Thomas Aquinas's ingenuity and relevance for future "just rebellion" thinking. First, I argue that classical just war thinking is not as antithetical to armed rebellion as suggested.15 One just rebellion theory has coexisted alongside the classical formation of just war theory, albeit often neglected or ignored by contemporary thinkers.16 It is well known that Aquinas formalized the Augustinian classical just war theory revolving around the criteria of legitimate authority, just cause, and right intention. Much less known, however, is the fact that Aquinas also crafted criteria for justified armed rebellions. It aims to show the central importance of these concepts for enactive theory while exposing a potentially troublesome ambiguity in their definition. Most definitions of enactive normativity are purely proscriptive, but it seems that enactive theories of cognitive agency and experience demand something more. BackgroundThe terminal illness of late-stage Alzheimer’s and related dementias is progressively cruel, burdensome, and can last years if caregivers assist oral feeding and hydrating. Options to avoid prolonged dying are limited since advanced dementia patients cannot qualify for Medical Aid in Dying. Physicians and judges can insist on clear and convincing evidence that the patient wants to die—which many advance directives cannot provide. Proxies/agents’ substituted judgment may not be concordant with patients’ requests. While advance directives can be patients’ last resort (...) to attain a peaceful and timely dying consistent with their lifelong values, success depends on their being effective and acceptable. A single flaw can provide opponents justification to refuse the directive’s requests to cease assisted feeding.AimThis article considers 24 common advance directive flaws in four categories. Process flaws focus on how patients express their end-of-life wishes. Content flaws reflect drafters’ selection of conditions and interventions, and how they are described. Inherent flaws can make advance directives unacceptable to authorities concerned about premature dying. Strategies are needed to compel physicians to write needed orders and to prevent third parties from sabotaging these orders after they are implemented. The article includes excerpts from “dementia-specific” directives or supplements that exemplify each flaw—mostly from the US and Europe. No directive critiqued here included an effective strategy to resolve this long-debated bioethical conflict: the past directive requests “Cease assisted feeding” but the incapacitated patient apparently expresses the desire to “Continue assisted feeding.” Some opponents to the controversial request, cease assisted feeding, use this conflict as a conceptual wedge to practice hard paternalism. This article proposes a protocol to prevent this conflict from emerging. These strategies may prevent authorities from requiring patients to fulfill authorities’ additional clinical criteria as a prerequisite to honor the requests in patients directives.ConclusionThis critique of flaws may serve as a guide to drafting and to selecting effective and acceptable advance directives for dementia. It also poses several bioethical and clinical questions to those in authority: Does your paternalistic refusal to honor patients’ wishes respect their self-determination? Protect vulnerable patients from harm? Force patients to endure prolonged suffering? Violate the principles of bioethics? Violate the very foundation of patient-centered care? (shrink)

This article conducts a mixed-method content analysis of Chinese and American news media coverage of Google DeepMind’s Go playing computer program, AlphaGo. Drawing on humanistic approaches to artificial intelligence, combined with an empirically rigorous content analysis, it examines the differences and overlap in coverage by the Chinese and American press in their accounts of AlphaGo, and its historic match with Korea’s Lee Sedol in March, 2016. The event was not only followed intensely in China, but also made the front page (...) of The New York Times. This article finds that the Chinese press was more likely than the American press to frame AlphaGo as non-threatening, which the authors attribute to cultural differences and the two countries' different understandings of Go. In addition to quantitatively identifying similarities and differences in the framing of AlphaGo, this paper also investigates the underlying and evolving contestations over what constitutes the “human” and the “machine.” It concludes by discussing the implications of the study’s findings as well as outlining avenues for further research.
