Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

Business ethics is an eclectic blend of intellectual traditions that seeks to examine the question of "what should I do in my businessrelationships." This paper attempts to widen this discussion by proposing an alternative view of the nature of ethical behaviour: ethical behaviour as a situated social accomplishment. From an ethnomethodological perspective, norms and rules have the status of interpretive aids whieh are used to negotiate an acceptable meaning for a situation; norms and rules are constituted by, and in part (...) constitute, the situations in which they occur. While most work in business ethics has tended to reify ethical practices, this paper stresses the contingent and situational nature of ethical decision making. In addition to presenting an ethnomethodological perspective, this paper discusses the methodological ramifications of this perspeetive through an examination of three ethnographic studies of situated rule usage. ObjectiveBasic combat training is a kind of necessary high-intensity training to help each military recruit convert into a qualified soldier. In China, both the physical fatigue and passive psychological state have been observed in new recruits during BCT. However, after same-intensity training, the degree of fatigue and passive mood vary among recruits. Therefore, this study aimed to explore the effect of BCT on mood state of recruits with different physical fitness levels from a perspective of fatigue.Materials and methodsBefore and after (...) BCT, the degree of fatigue and mood state of participants were evaluated via the Borg Rating of Perceived Exertion Scale and Profile of Mood States Questionnaire immediately after 20 push-ups as RPE and POMS scores [total mood disturbance, passive mood and positive mood ]. The participants were divided into two groups according to the RPE score measured after BCT: group 1: RPE score after BCT < 13 and group 2: RPE score after BCT ≥ 13.ResultA total of 564 recruits were included. After BCT, in group 1, TMD and passive mood Ttension, Tfatigue, Tdepression, Tconfusion declined significantly, but positive mood both increased significantly ; while in group 2, only Tanger and Testeem increased significantly.ConclusionBCT could alleviate passive mood and add to positive mood for recruits with better physical fitness, while had no ameliorative effects on or even deteriorate most of the passive mood for recruits with worse physical fitness. Myelin oligodendrocyte glycoprotein antibody-associated disease is an immune-mediated demyelinating disease of the central nervous system that is present in both adults and children. The most common clinical manifestations are optic neuritis, myelitis, acute disseminated encephalomyelitis, and brainstem syndrome. Cerebral cortical encephalitis is a rare clinical phenotype of myelin oligodendrocyte glycoprotein antibody-associated disease, which usually begins with seizures, headaches, and fever, and may be misdiagnosed as viral encephalitis in the early stages. Herein, we report two typical MOG antibody -positive patients presenting (...) with CCE, both of whom presented with headache, fever, seizures, and who recovered completely after immunotherapy. In addition, we performed a systematic review of the present literature from the perspectives of population characteristics, clinical symptoms, MRI abnormalities, treatments, and prognosis. Among the patients reported in 25 articles, 33 met our inclusion criteria, with the age of onset ranging from 4 to 52 years. Most of the patients had seizures, headache, fever, and unilateral cortical lesions on brain MRI. For acute CCE, 30 patients were treated with high-dose intravenous methylprednisolone, and the symptoms of most patients were completely relieved after immunotherapy. This study reported our experience and lessons learned in the diagnosis and treatment of MOG-Ab-positive CCE and provides a systematic review of the literature to analyse this rare clinical phenotype. Suspicion of “physics envy” surrounds the standard statistical toolbox used in the empirical sciences, from biology to psychology. Mainstream methods in these fields, various lines of criticism point out, often fall short of the basic requirements of measurement. Quantitative scales are applied to variables that can hardly be treated as measurable magnitudes, like preferences or happiness; hypotheses are tested by comparing data with conventional significance thresholds that hardly mention effect sizes. This article discusses what I call “shmeasurement.” To “shmeasure” is (...) to fail to apply quantitative tools to quantitative questions. We “shmeasure” when we try to measure what cannot be measured, or, conversely, when we ask binary questions of continuous measurements. Following the critics of standard statistical tools, it is argued that our statistical toolbox is indeed less concerned with the measurement of magnitudes than we take it to be. This article adds, however, that measurement is not all there is to scientific activity. Most techniques of proof do not resemble measurement as much as voting—a practice that makes frequent use of numbers, figures, or measurements, yet is not chiefly concerned with assessing quantities. Measurement is only one among three functions of the scientific toolbox, the other two being collating observations and deciding which hypotheses to relinquish. I thus make a plea for “shmeasurement”: the mismeasure of things starts to make more sense once we take into account the nonquantitative side of scientific practice. (shrink)

This article analyses the gazes, looks, stares and glares in Laurence Anyways, and examines their affective, interpretive, and symbolic qualities, and their potential to create viewer empathy through affect. The cinematic gaze can produce sensations of shame and fear, by offering a sequence of varied “encounters” to which viewers can react, before we have been given a character onto which we can deflect them, thus bypassing the representational, narrative and even the sympathetic power of the medium to create “raw”, apparently (...) unmediated sensations. Through the point-of-view shot and direct address, the viewer is the object of the gazes it receives, and experiences their hate and rejection before actually being presented with the film's narrative object of the gaze – the film's protagonist, a transgender woman named Laurence. It examines how the viewer, after being affected, interprets and misinterprets the emotions behind the gazes, and then cognitively attaches the gazes' importance... (shrink)

Now it cannot be denied, I think, that this argument has the appearance of being sound, that is, both true in its premises and valid in its conclusion. But one surely ought to harbor suspicions concerning an argument which establishes the most momentous of all conclusions upon nothing more than a few propositions. In this paper I shall attempt to show that these suspicions are well-founded by pointing out that the above "proof" derives whatever force it has from an equivocation.
