BackgroundAmidst expanding roles in education and policy making, questions have been raised about the ability of Clinical Ethics Committees (CEC) s to carry out effective ethics consultations (CECons). However recent reviews of CECs suggest that there is no uniformity to CECons and no effective means of assessing the quality of CECons. To address this gap a systematic scoping review of prevailing tools used to assess CECons was performed to foreground and guide the design of a tool to evaluate the quality (...) of CECons.MethodsGuided by Levac et al’s (2010) methodological framework for conducting scoping reviews, the research team performed independent literature reviews of accounts of assessments of CECons published in six databases. The included articles were independently analyzed using content and thematic analysis to enhance the validity of the findings.ResultsNine thousand sixty-six abstracts were identified, 617 full-text articles were reviewed, 104 articles were analyzed and four themes were identified – the purpose of the CECons evaluation, the various domains assessed, the methods of assessment used and the long-term impact of these evaluations.ConclusionThis review found prevailing assessments of CECons to be piecemeal due to variable goals, contextual factors and practical limitations. The diversity in domains assessed and tools used foregrounds the lack of minimum standards upheld to ensure baseline efficacy.To advance a contextually appropriate, culturally sensitive, program specific assessment tool to assess CECons, clear structural and competency guidelines must be established in the curation of CECons programs, to evaluate their true efficacy and maintain clinical, legal and ethical standards. IntroductionClinical ethics committees (CECs) support and enhance communication and complex decision making, educate healthcare professionals and the public on ethical matters and maintain standards of care. However, a consistent approach to training members of CECs is lacking. A systematic scoping review was conducted to evaluate prevailing CEC training curricula to guide the design of an evidence-based approach.MethodsArksey and O’Malley’s methodological framework for conducting scoping reviews was used to evaluate prevailing accounts of CEC training published in six databases. Braun and Clarke’s (...) thematic analysis approach was adopted to thematically analyse data across different healthcare and educational settings.Results7370 abstracts were identified, 92 full-text articles were reviewed and 55 articles were thematically analysed to reveal four themes: the design, pedagogy, content and assessment of CEC curricula.ConclusionFew curricula employ consistent approaches to training. Many programmes fail to provide CEC trainees with sufficient knowledge, skills and experience to meet required competencies. Most programmes do not inculcate prevailing sociocultural, research, clinical and educational considerations into training processes nor provide longitudinal support for CEC trainees. Most CEC training programmes are not supported by host institutions threatening the sustainability of the programme and compromising effective assessment and longitudinal support of CEC trainees. While further reviews are required, this review underlines the need for host organisations to support and oversee a socioculturally appropriate ethically sensitive, clinically relevant longitudinal training, assessment and support process for CEC trainees if CECs are to meet their roles effectively. How do words and images function hermeneutically? How does hermeneutic practice work? Answering these questions and more, Nicholas Davey develops the hermeneutical foundations of creative practice. In doing so, he not only uncovers the significance of philosophical hermeneutics for the arts and the humanities, but defends the humanities as a whole from the current scepticism inspired by deconstruction and post-structuralism. Taking Gadamer's language ontology as its cue, this pioneering volume not only addresses certain weaknesses that Davey observes in Gadamer's (...) thought but further takes Gadamerian thinking beyond Gadamer himself. In particular, Davey investigates the productive value of negativity that is central to hermeneutics and to wider spheres of creative learning. Advocating a renewed confidence in hermeneutics and the humanities, Negative Hermeneutics and the Question of Practice reveals how hermeneutical thinking provides a map of the dynamics within creative practice, eliminating the need for an externally imposed 'theory' of the arts. Postmodern culture is usually defined as an age of mechanical reproduction and mechanical degeneration characterized by the eradication of performative aura. This article argues that a crucial distinction should be made between the `anti-auratic' arguments of mainstream 20th-century cultural theory (discussed here in terms of the writings of Benjamin, Baudrillard and Virilio), and the regenerative auratic tradition in 20th-century avant-garde performance (discussed here in terms of the successive explorations of the multimediated body in the work of the Italian Futurist Marinetti, (...) the French sound poet Henri Chopin and the Australian cybernetic body artist, Stelarc). If Baudrillard's and Virilio's most extreme hypotheses argue that postmodern technology reduces the body to the condition of the handicapped, Marinetti, Chopin and Stelarc all demonstrate how technological modifications of the body reinforce the impact of installation art and performance art exploring (and manifesting) individual identity. Significantly, the most interesting subtexts in Benjamin's, Baudrillard's and Virilio's arguments all qualify their accounts of the alleged `death' of aura, and in Baudrillard's case now emphasize the ways in which photography `rediscovers' aura. Resource development takes place through the transformation of social institutions. The moral dimension is of crucial importance in the evolution of associated management regimes. More than just a code of ethics, moralities are predicated on what is understood to be ‘the good’. Recognition of the good requires a rhetoric beyond those of power and interest. Hans Jonas’s establishment of an ethics of responsibility entails the simultaneous rejection of the modern notion of progress and the recovery of a form of “metaphysical speculation” that aids man in his search for an objective standard of value. Looking mostly at Jonas’s philosophical biology in The Phenomenon of Life and Mortality and Morality, this paper shows how Jonas’s thought on value judgments rests upon his critique of progress and science. The ethics of perfectibility and progress, Jonas shows, leads to (...) a predicament in which the modern mind must navigate between the dangers present in the hubristic hopes of technological progress and the nihilism he finds in the thought of Martin Heidegger. Jonas’s philosophical biology serves as a critique of these positions that opens up an alternative orientation toward nature—one that grounds not only the ethics of responsibility but the uniquely human activity of reflection. The critique of progress serves, then, as a propaedeutic to the ethics of responsibility and the recovery of an image of man as the reflective animal. Such a recovery of metaphysical speculation from the dogmas of the physical sciences helps encourage a “new humility” in the face of man’s technological power. Jonas hopes to replace man’s desire for self-overcoming with the fear that his “Promethean immoderation” will lead to the biosphere's destruction. This fear acknowledges the limits of man’s knowledge and is thereby accompanied by a posture of Socratic ignorance and the reengagement with the philosophia perennis. That is, a less hubristic ethical theory depends upon a modest philosophical stance toward the whole. Only on the grounds of this epistemological modesty can we hope to proceed into the future with both caution and wisdom. (shrink)

This is a review of a lecture series by Gillian Rose on Frankfurt School critical theory, which was delivered at the University of Sussex in 1979 and is now published under the title Marxist Modernism, edited by James Gordon Finlayson and Robert Lucas Scott.

This is an introductory book that targets the reader who has the ambition to apply economic analysis but may be missing a technical introduction to its mathematical techniques or seeks a structured elaboration of its philosophical principles. The book juxtaposes economic analysis with moral philosophy, political theory, egalitarianism, and other methodological principles and then passes to the details of methods such as model-building, derivatives, differential equations, statistical tests, and the use of computer programs.

Humanity is confronted by immense global problems. In order to learn how to tackle them we need a new kind of academic inquiry, rationally organized and devoted to helping us resolve our problems of living in increasingly cooperatively rational ways.

The chapter sets forth a conceptual model of a comparative institutional approach to law and economics that can help make the meaningful alternatives known to society. The driving force behind such an approach is the need to come to grips with the interrelations between legal and economic processes. Consistent with the thrust of old and new institutional economics, institutional structure cannot merely be assumed away or taken as given; rather, institutions must be the subject of study involving a comparison of (...) the effects of institutional alternatives on our environment, natural resources, and use of land. The chapter includes a discussion of the i) constitutional, ii) institutional, and iii) economic-impact stages of choice, focusing on four different means of social control that serve to allocate society’s scarce resources, namely the market sector, the public sector, the communal sector, and the openaccess resource sector. Environmental, natural resource, and land-use examples are included in the analysis of each stage of choice in exploring the consequences of fashioning remedies within the market sector, the public sector, the communal sector, or leaving resources in the open-access resource sector. It presents a perspective that avoids the rhetorical policy stance of “government versus the market” by showing that economic performance is driven by i) law, ii) technology and iii) social norms. In this, the state stands as an essential complement to the market sector, the public sector, and the communal sector and not a substitute for them; each exists through the active role of government not by government forbearance.Ce chapitre présente un modèle conceptuel d’une approche institutionnelle comparative en analyse économique du droit, aidant à faire connaître d’autres alternatives à la société. Cette approche permettra d’approfondir, les interrelations entre les processus économiques et juridiques. Selon les principes de l’ancienne et de la nouvelle économie institutionnelle, la structure des institutions ne peut pas être supposée donnée ou absente de l’analyse. Plutôt, les institutions doivent être l’objet d’étude, et l’on doit s’attacher à comparer les effets des différentes alternatives sur l’environnement, les ressources naturelles et l’utilisation de la terre. Ce chapitre contient une discussion des étapes de choix constitutionnels, institutionnels et des impacts économiques. Il se concentre sur quatre moyens différents de contrôle social, qui servent à allouer des ressources rares de la société, notamment le marché, le secteur public, le secteur de communautés, le secteur des ressources d’accès libre. In, Love and Politics Jeffery L. Nicholas argues that Eros is the final rejection of an alienated life, in which humans are prevented from developing their human powers; Eros, in contrast, is an overflowing of acting into new realities and new beauties, a world in which human beings extend their powers and senses. Nicholas uniquely interprets Alasdair MacIntyre's Revolutionary Aristotelianism as a response to alienation defined as the divorce of fact from value. However, this account cannot address alienation (...) in the form of the oppression of women or people of color. Importantly, it fails to acknowledge the domination of nature that blackens the heart of alienated life. Alienation must be seen as a separation of the human from nature. Nicholas turns to Aristotle, first, to uncover the way his philosophy embodies a divorce of human from nature, then to reconstruct the essential elements of Aristotle's metaphysics to defend a philosophical anthropology based on Eros. Love and Politics: Persistent Human Desires as a Foundation for Liberation presents a critical theory that synthesizes MacIntyre's Revolutionary Aristotelianism, Frankfurt School Critical Theory, and Social Reproduction Theory. As those authors do in a number of their works, Nick Pappas adopts a light and playful tone to treat a serious topic. This contrast helps bring out the truth, in an approachable style that requires no prior exposure to philosophy and heavy intellectual work.

Many philosophers think the non-identity problem undermines the ability for future generations to have been wronged by past ones. This problem has prompted a number of responses, some of which purport to vindicate the relevant claims of wrongdoing. However, I argue that a closely related issue remains even for those convinced by these responses. It is commonly thought that wrongdoing makes certain retrospective attitudes, such as resentment, fitting toward the wrongdoer. In this paper, I shift a familiar problem of future (...) generations from wrongdoing to the fittingness of retrospective attitudes, and I show that a narrative sense of identity provides one means of addressing the puzzle of how these attitudes can be fi tting in non-identity cases. Jaegwon Kim’s argument against non-reductive physicalism is well known. Many philosophers take Kim’s argument to also apply to emergentism. But this does not necessarily follow. In this paper, I will first briefly show why Kim’s argument against non-reductive physicalism need not apply to emergentism. Next, I will present a physicalistic account of emergentism offered by Jason Megill in his paper “A Defense of Emergence.” This will be followed by an examination of some of the limitations of Megill’s account, in particular, (...) his failure to adequately account for the causal powers of higher level physical properties independent of realization. Finally, I will offer a suggestion on how Megill might avoid the difficulties raised by appealing to the concept of wide realization espoused by Robert Wilson in his paper “Two Views of Realization.” The overarching theme of the paper centers on the idea that the realization requirement is where the action is, in terms of making emergentism compatible with physicalism, and is capable of being tinkered with by the emergentist and physicalist alike. This thesis concerns the content of mental representations. It draws lessons for philosophical theories of content from some empirical findings about brains and behaviour drawn from experimental psychology (cognitive, developmental, comparative), cognitive neuroscience and cognitive science (computational modelling). Chapter 1 motivates a naturalist and realist approach to mental representation. Chapter 2 sets out and defends a theory of content for static feedforward connectionist networks, and explains how the theory can be extended to other supervised networks. The theory takes forward Churchland’s (...) state space semantics by making a new and clearer proposal about the syntax of connectionist networks − one which nicely accounts for representational development. Chapter 3 argues that the same theoretical approach can be extended to unsupervised connectionist networks, and to some of the representational systems found in real brains. The approach can also show why connectionist systems sometimes show typicality effects, explaining them without relying upon prototype structure. That is discussed in chapter 4, which also argues that prototype structure, where it does exist, does not determine content. The thesis goes on to defend some unorthodox features of the foregoing theory: that a role is assigned to external samples in specifying syntax, that both inputs to and outputs from the system have a role in determining content, and that the content of a representation is partly determined by the circumstances in which it developed. Each, it is argued, may also be a fruitful way of thinking about mental content more generally. Reliance on developmental factors prompts a swampman-type objection. This is rebutted by reference to three possible reasons why content is attributed at all. Two of these motivations support the idea that content is partly determined by historical factors, and the third is consistent with it. The result: some empirical lessons for philosophical theories of mental content. (shrink)

The innocent are immune. We must never, that is, make the object of any violent attack those who bear no responsibility for doing wrong to others; and only with grave reason and in extreme circumstances should we be prepared to cause them any incidental harm as we press home a violent attack against those who are its legitimate objects. This principle of the immunity of the innocent seems almost self-evidently true. This is not to say that the principle is incapable (...) of further development and articulation, unsusceptible of marginal qualification, or underivable from deeper principles. It does however mean that any moral theory which denies this principle altogether will be something that only a fool or a knave could accept. (shrink)
