Decolonizing Time: Work, Leisure, and Freedom demonstrates the importance of time as a central category for political theory. The historical struggle over the control of time is of analytical, moral, and practical significance, such that any project aiming to establish a meaningful relationship between freedom and equality must begin by reconceptualizing time. Whereas the labor movement's original fight for time sought to limit the length of the working day, the fight for time today must address the new realities of the (...) colonization of time, which increasingly extends beyond work to free time and leisure. Decolonizing Time reconsiders discretionary time as a measure of freedom through the concept of temporal autonomy as developed through the Aristotelian-Marxist, critical, and feminist theory traditions. Two important criticisms of contemporary liberalism turn to Aristotle's political thought for support that which advocates participatory democracy, and that sympathetic to the rule of a virtuous or philosophic elite. In this commentary on Aristotle's politics the author explores how Aristotle offers political rule as an alternative to both the rule of aristocratic virtue and an unchecked participatory democracy. In this book, Mary P. Nichols argues for the centrality of the idea of freedom in Thucydides' thought.

Scholars have recently argued that in the Symposium Plato is critical of Socrates and falls closer than his philosophic spokesman to the side of poetry in the old quarrel between philosophy and poetry. Contrary to such interpretations, I argue that on the basis of his experience of a philosophic life, Socrates responds to the poets Plato presents in that dialogue, offering a superior understanding not only of Love but of poetry itself. Far from self-sufficient, but like Love “dwell[ing] always in (...) need” and generating through teaching, Socrates both requires and supports political life. The state between poverty and resource that accounts for the pursuit of wisdom and its self-generation through questioning others also accounts for the ongoing human activities that keep political communities alive and flourishing. At issue is not simply Plato’s attitude toward Socrates, but the very nature of philosophy and its relation to the political community. (shrink)

This book takes a fresh look at Socrates as he appeared to three ancient writers: Aristophanes, who attacked him for his theoretical studies; Plato, who immortalized him in his dialogues; and Aristotle, who criticized his political views. It addresses the questions of the interrelation of politics and philosophy by looking at Aristophanes' Clouds, Plato's Republic, and Book II of Aristotle's Politics--three sides of a debate on the value of Socrates' philosophic life. Mary Nichols first discusses the relation between Aristophanes and (...) Plato, showing that the city as Socrates' place of activity in the Republic resembles the philosophic thinktank mocked in Aristophanes' Clouds. By representing the extremes of the Republic's city, Plato shows that the dangers attributed by Aristophanes to the city are actually inherent in political life itself. They were to be moderated by Socratic political philosophy rather than Aristophanean comedy. Nichols concludes by showing how Aristotle addressed the question at issue between Plato and Aristophanes when he founded his political science. Judging Plato's and Aristophanes' positions as partial, Nichols argues that Aristotle based his political science on the necessity to philosophy of political involvement and the necessity to politics of philosophical thought. In order to better understand the meaning of Socrates’ philosophic life, Nichols explores the theme of caring that is prominent in Socrates’ Apology. What is the relation between the examined life that he says is the only one worth living for a human being and the care he claims and shows for others, especially the young of Athens? Nichols discusses Socrates’ illustrations of philosophic caretaking from the Symposium, Phaedrus, and Theaetetus, both his own caretaking activities as well as his teachings (...) about love and generation, the art of words, and midwifery. Finally, she argues that the god who “commands” an answer to his oracular riddle, as Socrates interprets it in the Apology, serves as a model for the union of questioning and caretaking central to Socrates' life of philosophizing. Through his presentation of Socrates, Plato therefore offers an alternative to the Eleatic Stranger’s view of divine and human care in the Statesman that forms a backdrop to Socrates’ defense in the Apology. In this article, I set out a theoretical framework for analyzing fictional copyright protection of fictional characters in literature. Using this framework, I argue that the two most prominent approaches that U.S. courts have adopted with respect to fictional character copyright (the Nichols test and the Sam Spade “Story Being Told” test) are unsustainable. The idea of distinct delineation that came out of Nichols may be understood in two ways: on one view, fictional characters are distinctly delineated if they deviate (...) from a literary type. On the other view, they are distinctly delineated if they are attributed a sufficient number of properties in the fictions where they appear. Both views succumb to serious objections, while the test in Sam Spade is no better. The failure of the two judicial tests suggests that, instead of asking questions about fictional character copyrightability, courts should instead focus on the substantial similarity question. In the last part of the paper, I draw a distinction between two types of fictional character copyright infringement cases (transformations and transfers), and suggest that a Nichols-type substantial similarity analysis is all that is required in transformation situations. Although the focus of this article is U.S. law, the issues discussed and the analyses proposed may prove helpful in addressing fictional copyright in other jurisdictions as well. (shrink)

An implication of this claim is that all of God's work within time and history—in man's linearly conception of (...) time and history—is meaningful. For, as perfect order himself God's work is neither random nor coincidental. God's perfect understanding means that he is able, colloquially speaking, "to connect the dots" perfectly. Thus, the historical particulars of the New Testament events are not random and coincidental, but they connect perfectly within God's plan.In terms of biblical events, then, what are the significances of the time periods during which, and places at which, they occurred? "Why was Jesus born on a particular date, at a particular time, and in a particular manger in Bethlehem? Why was the womb of Mary, Mater Dei, chosen at that exact time, and at that exact place? Why did Jesus stand on that particular mountain and not upon another? There are perfect answers to all of those questions and more, for, as Proverbs declares in this vein: "The LORD has made everything for a purpose" (16:4).In Deep Mysteries: God, Christ, and Ourselves, Father Aidan Nichols, O.P., meditates on questions related to the potential reasons for some of the historical particulars of "the principal Christological mysteries." (41).Attempting to understand how all of the parts of the New Testament fit together perfectly in an historical sense—as God's mind would see it—is a fascinating intellectual endeavor. The primary difference between the innocent inquirer and the vain one, however, is that the former understands that God's reason is infinite and that only the First Mover has the ability to see and to put together all particulars. Thomas Aquinas elucidates the essence of the endeavor to connect the particulars when, in reference to man's ability to understand "the truth of faith," he argues: "Yet it is useful for the human reason to exercise itself in such arguments, however weak they may be, provided only that there be present no presumption to comprehend or to demonstrate. For to be able to see something of the loftiest realities, however thin and weak the sight may be, is... a cause of the greatest joy" [Summa contra gentiles I, ch. 8).Posing the question of what the particulars of history might mean brings immediately another question. Although there are high hopes for these technologies, there are many unknowns including the extent to which these new transportation tools can realistically and reliably improve driver safety and affect the subjective driving experience. The concept of community of persons, which focuses on both persons and the whole, helps understand solidarity. The latter is based on the social nature of persons. Community of persons and solidarity seems to be able to move away from the individualist perspective or the individualism-collectivism dichotomy. Using autopraxeography in a pragmatic constructivism epistemological paradigm, this article aims to explore how organizations can develop solidarity in a workplace. The experience presented takes place in a bank. It shows that communities of (...) persons with employees and customers are both ethical and financially efficient. These communities build a dialogue between persons and organizations. Nevertheless, it is impossible to force solidarity because it could generate derision that is contrary to the wished goal. Finally, while this model is based on solidarity, it focuses solely on internal solidarity. (shrink)

In Plato, ‘Becoming like God’ constitutes the telos of the philosophical life. Our ‘likeness to God’ is rooted in the relationship of the divine paradeigma to its image established in the generation of the Cosmos. This relationship makes knowledge and virtue possible, and informs Plato’s theory of education. Related concepts preexist in Judeo-Christian and other traditions and continue to inform our thought on moral and ethical issues, particularly as regards our understanding of what it means to be human. From the (...) idea of ‘likeness to God’, emerges the tradition of philosophical mysticism which has its roots in Plotinus, whose aim is union of the individual soul with its ultimate principle (henosis, unio mystica). The task of realizing virtue in daily life appears opposed to assimilation to the divine, because the latter requires a stripping away of finite determinations, and preoccupation with particular things, in order that we may escape from the multiplicity of sensible and even intelligible reality. This article considers the opposition between ‘worldly’ and ‘otherworldly’ virtue, as well as previously neglected aspects of ‘likeness to God’ and ‘becoming like God’ in Plato and Plotinus, and explores their continued relevance for pedagogical theory and practice today.
