Slavná kniha Elementární formy náboženského života francouzského sociologa Émile Durkheima je jedním z nejdůležitějších příspěvků k sociologii náboženství. Po řadu let byla vychvalována a citována, stejně jako kritizována a zavrhována. Kniha se stala chartou celé řady sociálně vědních badatelů, zejména těch, kteří se zaměřovali na studium společnosti a náboženství. V roce 1966 však vyšel článek amerického antropologa Clifforda Geertze nazvaný „Nábo- ženství jako kulturní systém", v němž autor tvrdil, že Durkheimova teorie náboženství, stejně jako teorie náboženství Sigmunda Freuda, Bronislawa Malinowského (...) a Maxe Webera, by měla být překonána dokonalejší teorií náboženství. Touto dokonalejší teorií měla být Geertzova teorie. Porozuměl však Geertz Durkheimově teorii dostatečně, aby nás to opravňovalo k tvrzení, že Durkheim byl na poli teorie náboženství překonán? In the philosophy of memory, singularism is the view that episodic memories are singular mental states about unique personally experienced past events. In this paper, I present an empirical challenge to singularism. I examine three distinct lines of evidence from the psychology of memory, concerning general event memories, the transformation of memory traces and the minimized role temporal information plays in major psychological theories of episodic memory. I argue that singularist views will have a hard time accommodating this evidence, facing (...) a problem of transitional gradation. I then look at some potential consequences for the larger debate, highlighting the way in which singularism has featured in three important recent arguments in the philosophy of memory. (shrink)
According to contextualist accounts, the truth value of a given knowledge ascription may vary with features of the ascriber's context. As a result, the following may be true: "X doesn't know that P but Y says something true in asserting 'X knows that P'". The contextualist must defend his theory in the light of this unpleasant but inevitable consequence. The best way of doing this is to construe the context sensitivity of knowledge ascriptions not as deriving from an alleged indexicality (...) of the word "know" nor from its vagueness or ambiguity, but rather from a distinct semantic feature of the word "know", namely its unspecificity. In light of the development of “CRISPR” technology, new promising advances in therapeutic and preventive approaches have become a reality. However, with it came many ethical challenges. The most recent worldwide condemnation of the first use of CRISPR to genetically modify a human embryo is the latest example of ethically questionable use of this new and emerging field. Monotheistic religions are very conservative about such changes to the human genome and can be considered an interference with God’s creation. Moreover, these (...) changes could cause perpetual changes to future generations. The Muslim scholars establish their decisions by addressing five foundations of Islamic law i.e. “maqāṣid al sharı̄`a”; the purposes of the law. These are dın̄, nafs, nasl, `aql and māl. To achieve this, the five principles should all be met before approval of an experiment like the Chinese embryo modifications; Qaṣd which is achieved in this case as it aims to protect the embryo from HIV. Yaqın̄ and Ḍarar were not satisfied as they require strong scientific certainty of the procedures, and evidence of safety. Ḍarūra by which the alternatives being compared; in this case more established and proven safe alternatives to protect the HIV transmission from the father are available, so this principle is not met. The final principle is `Urf, by which the social context of using any contemporary technology should be taken in consideration, and clearly this was not achieved. Collectively, germline changes are rejected from an Islamic perspective until the five principles are fulfilled. In the Chinese Twins gene editing case, there was clearly no justification or support for it according to the Muslim Jurisprudence laws. These laws and approaches can serve as an ethical checklist for such controversial research, especially in early stages of the research. (shrink)
The basic idea of conversational contextualism is that knowledge attributions are context sensitive in that a given knowledge attribution may be true if made in one context but false if made in another, owing to differences in the attributors’ conversational contexts. Moreover, the context sensitivity involved is traced back to the context sensitivity of the word “know,” which, in turn, is commonly modelled on the case either of genuine indexicals such as “I” or “here” or of comparative adjectives such as (...) “tall” or “rich.” But contextualism faces various problems. I argue that in order to solve these problems we need to look for another account of the context sensitivity involved in knowledge attributions and I sketch an alternative proposal. (shrink)
In a recent paper, Cheng and Werning (2016) argue that the class of episodic memories constitutes a natural kind. Endorsing the homeostatic property cluster view of natural kinds, they suggest that episodic memories can be characterized by a cluster of properties unified by an underlying neural mechanism for coding sequences of events. Here, I argue that Cheng & Werning’s proposal faces some significant, and potentially insurmountable, difficulties. Two are described as most prominent. First, the proposal fails to satisfy an important (...) normative constraint on natural kind theorizing, not providing the requisite theoretical resources for arbitration between rival taxonomies of memory. Second, the proposal is in a direct tension with a foundational principle of the HPC view: the rejection of essentialism. This has far-reaching consequences, threatening to undermine the coherence of the proposal. (shrink)
My aim in the paper will be to better understand what faultless disagreement could possibly consist in and what speakers disagree over when they faultlessly do so. To that end, I will first look at various examples of faultless disagreement. Since I will eventually claim that different forms of faultless disagreement can be modeled semantically on different forms of context-sensitivity I will, in a second step, discuss three different semantic accounts that all promise to successfully accommodate certain forms of context-sensitivity: (...) Indexical Contextualism, Nonindexcal Contextualism and Radical Relativism . Focussing on the controversy between Indexical and Nonindexical Contextualists the remainder of the paper will be devoted to the question which theory is best suited to handle what kind of disagreement. Otto Neurath's thesis concerning the structure of protocol sentences is central to the famous Protocol Sentence Debate in the Vienna Circle. However, its precise nature is far from easy to discern in Neurath's writings. So far, only Thomas Uebel has attempted a closer analysis of Neurath's contribution to the debate. I argue that Uebel's interpretation is problematic in some respects and propose a novel analysis, which hopefully brings into a clearer light Neurath's position in the Protocol Sentence Debate as well (...) as his relevance to contemporary philosophies of science. My aim in this paper is to motivate and defend a version of epistemic contextualism; a version, that is, of what came to be called attributor or ascriber contextualism. I will begin by outlining, in the first part, what I take to be the basic idea of and motivation behind the version of epistemic contextualism that I favor. In the second part, a couple of examples will be presented in order to illustrate the contextualist point. Since epistemic contextualists commonly claim (...) that knowledge ascriptions are context-sensitive, the third part of the paper will be concerned with the phenomenon of context-sensitivity at a more general level. A more detailed inquiry into the context-sensitivity natural language expressions exhibit will prove helpful in order to counter the objection that postulating context-sensitivity in the case of knowledge ascriptions is an ad-hoc-maneuver. Given that epistemic contextualism is partly an epistemological thesis, party a linguistic thesis, the remainder of the paper will be devoted to the question of how to semantically model the kind of context-sensitivity exhibited by knowledge ascriptions. The upshot will be that there are two different ways of semantically accommodating the context-sensitivity at issue. Both call for a more or less drastic departure from epistemological and semantic orthodoxy. (shrink)
Do we need defeasible generalizations in epistemology, generalizations that are genuinely explanatory yet ineliminably exception-laden? Do we need them to endow our epistemology with a substantial explanatory structure? Mark Lance and Margaret Little argue for the claim that we do. I will argue that we can just as well do without them – at least in epistemology. So in the paper, I am trying to very briefly sketch an alternative contextualist picture. More specifically, the claim will be that although an (...) epistemic contextualist should commit himself to epistemic holism he can nevertheless appeal to epistemic principles other than defeasible generalizations in order to provide his epistemology with a structure. Short-term memory search, as investigated within the Sternberg paradigm, is usually described as exhaustive rather than self-terminated, although the debate concerning these issues is still hot. We report three experiments employing a modified Sternberg paradigm and show that whether STM search is exhaustive or self-terminated depends on task conditions. Specifically, STM search self-terminates as soon as a positive match is found, whereas exhaustive search occurs when the STM content does not contain a searched item. Additionally, we show that task conditions (...) influence whether familiarity- or recollection-based strategies dominate STM search performance. Namely, when speeding up the tempo of stimuli presentation increases the task demands, people use familiarity-based retrieval more often, which results in faster but less accurate recognition judgments. We conclude that STM search processes flexibly adapt to current task conditions and finally propose two-phase model of STM search. (shrink)
Comments and reports on synthetic biology often focus on the idea that this field may lead to synthetic life or life forms. Such claims attract general attention because “life” is a basic concept that is understood, interpreted and explained in multiple ways. While these different understandings of life may influence the ethical assessment of synthetic biology by experts and the public, this field might, in turn, influence how academics or the public view life. We suggest in this paper that synthetic (...) biology provides an opportunity to discuss and compare different views and explanations of the world, starting from the concept of life. We argue that a narrow focus on just one interpretation of this concept may be harmful and that people will benefit from being aware of a diversity of understandings of life because they provide answers to different questions. Moreover, the confrontation among views is important for the development of reasoning abilities, and a nuanced view on our world will be useful for integrating scientific findings and their implications into a wider context. At the same time, we should not only consider other understandings of life for our own benefit but also because a moral attitude of respect for and toleration toward others implies permission to express and maintain their views. For these reasons, we suggest that a diversity of views on life should be included in public education and in public engagement events on synthetic biology. Moreover, they should be on the research agenda of technology assessment studies within the ELSA or RRI frameworks. (shrink)
Kantian deontology is one of three classic moral theories, among virtue ethics and consequentialism. Issues in medical ethics are frequently addressed within a Kantian paradigm, at least – although not exclusively – in European medical ethics. At the same time, critical voices have pointed to deficits of Kantian moral philosophy which must be examined and discussed. It is argued that taking concrete situations and complex relationships into account is of paramount importance in medical ethics. Encounters between medical or nursing staff (...) and patients are rarely symmetrical relationships between autonomous and rational agents. Kantian ethics, the criticism reads, builds on the lofty ideal of such a relationship. In addition to the charge of an individualist and rationalist focus on autonomy, Kantian ethics has been accused of excluding those not actually in possession of these properties or of its rigorism. It is said to be focussed on laws and imperatives to an extent that it cannot appreciate the complex nuances of real conflicts. As a more detailed analysis will show, these charges are inadequate in at least some regards. This will be demonstrated by drawing on the Kantian notion of autonomy, the role of maxims and judgment and the conception of duties, as well as the role of emotions. Nevertheless the objections brought forward against Kantian moral theory can help determine, with greater precision, its strengths and shortcomings as an approach to current problems in medical ethics. Nanomedicine plays a prominent role among emerging technologies. The spectrum of potential applications is as broad as it is promising. It includes the use of nanoparticles and nanodevices for diagnostics, targeted drug delivery in the human body, the production of new therapeutic materials as well as nanorobots or nanoprotheses. Funding agencies are investing large sums in the development of this area, among them the European Commission, which has launched a large network for life-sciences related nanotechnology. At the same time government (...) agencies as well as the private sector are putting forward reports of working groups that have looked into the promises and risks of these developments. This paper will begin with an introduction to the central ethical themes as identified by selected reports from Europe and beyond. In a next step, it will analyse the most frequently invoked ethical concerns–risk assessment and management, the issues of human identity and enhancement, possible implications for civil liberties (e.g. nanodevices that might be used for covert surveillance), and concerns about equity and fair access. Although it seems that the main ethical issues are not unique to nanotechnologies, the conclusion will argue against shrugging them off as non-specific items that have been considered before in the context of other biomedical technologies, such as gene therapy or xenotransplantation. Rather, the paper will call on ethicists to help foster a rational, fair and participatory discourse on the different potential applications of nanotechnologies in medicine, which can form the basis for informed and responsible societal and political decisions. Free and informed consent is generally acknowledged as the legal andethical basis for living organ donation, but assessments of livingdonors are not always an easy matter. Sometimes it is necessary toinvolve psychosomatics or ethics consultation to evaluate a prospectivedonor to make certain that the requirements for a voluntary andautonomous decision are met. The paper focuses on the conceptualquestions underlying this evaluation process. In order to illustrate howdifferent views of autonomy influence the decision if a donor's offer isethically acceptable, three cases (...) are presented – from Germany, theUnited States, and India. Each case features a person with questionabledecision-making capacity who offered to donate a kidney for a siblingwith severe renal insufficiency. Although the normative framework issimilar in the three countries, different or sometimes even contraryarguments for and against accepting the offer were brought forward. Thesubsequent analysis offers two explanations for the differences inargumentation and outcome in spite of the shared reference to autonomyas the guiding principle: (1) Decisions on the acceptability of a livingdonor cannot simply be deducted from the principle of autonomy but needto integrate contextual information; (2) understandings of the wayautonomy should be contextualized have an important influence on theevaluation of individual cases. Conclusion: Analyzing the conceptualassumptions about autonomy and its relationship to contextual factorscan help in working towards more transparent and better justifieddecisions in the assessment of living organ donors. Living organ donation has developed into an important therapeutic option in transplantation medicine. However, there are some medico-ethical problems that come along with the increasing reliance on this organ source. One of these concerns is based on the observation that many more women than men function as living organ donors. Whereas discrimination and differential access have been extensively discussed in the context of cadaveric transplantation and other areas of health care, the issue of gender imbalance in living organ donation has (...) received less attention. This paper presents relevant data from the Eurotransplant and UNOS transplantation systems and discusses possible explanations for the documented gender discrepancies. The conclusion calls for are view of existing practice guidelines in order to secure effective protection of particularly vulnerable potential donors and an equitable donor-recipient-ratio in living organ donation. Dubrovačko zakonodavstvo, već od ranije pod prevladavajućim utjecajem Crkve, bilježi značajne promjene u pozicioniranju žene u društvu, dok nove misaone orijentacije snažno utječu i na kulturni život. Tako se u Dubrovniku pojavljuju i prve pjesnikinje, a konstruira se i prvi mit o ženi, onaj o Cvijeti Zuzorić. Upravo njen suvremenik i dragi prijatelj Nikola Vitov Gučetić, svojim (...) radovima svjedoči novu mogućnost – ženski glas uklopljen u filozofski koncept i promoviran potpisom uglednog Dubrovčanina. Gučetić otvara prostor svog ljetnikovca, zaštićenog mjesta za »časna proučavanja«, dvjema ženama za njihove razgovore o ljepoti i ljubavi, a posvetu objavljenim Dijalozima upućuje još jednoj »vrlo dičnoj i prepoštovanoj gospoji«, Cvijetinoj sestri Niki. Time svojoj supruzi Maruši Gundulić i Cvijeti Zuzorić posredovano daje glas, ali i ime. Bioethics in a globalized world is meeting a number of challenges – fundamentalism in its different forms, and a focus on economic growth neglecting issues such as equity and sustainability, being prominent among them. How well are we as bioethicists equipped to make meaningful contributions in these times? The paper identifies a number of restraints and proceeds to probe potential resources such as the capability approach, care ethics, cosmopolitanism, and pragmatism. This article tries to present a broad view on the values and ethicalissues that are at stake in efforts to rationalize health policy on thebasis of economic evaluations (like cost-effectiveness analysis) andrandomly controlled clinical trials. Though such a rationalization isgenerally seen as an objective and `value free' process, moral valuesoften play a hidden role, not only in the production of `evidence', butalso in the way this evidence is used in policy making. For example, thedefinition of effectiveness of medical treatment or (...) health care serviceis heavily dependent on dominant individual or social views about thegoals of the particular treatment or service. There is also a concernthat a reliance on EBM in health policy will occur at the expense ofwidely shared social values like equity and solidarity. Moreover, thereis a concern that when economic considerations and rational proceduresbecome more influential, various `outside' groups third parties likeinsurance companies and policy makers will get a stronger influence onmedical practice which may lead to a change in the patient-providerrelationship. The authors conclude that social values and patientpreference should be explicitly addressed when health policy making isbased on economic and other scientific evidence. (shrink)
Conducting empirical research on gender in medical ethics is a challenge from a theoretical as well as a practical point of view. It still has to be clarified how gender aspects can be integrated without sustaining gender stereotypes. The developmental psychologist Carol Gilligan was among the first to question ethics from a gendered point of view. The notion of care introduced by her challenged conventional developmental psychology as well as moral philosophy. Gilligan was criticised, however, because her concept of âtwo (...) different voicesâ may reinforce gender stereotypes. Moreover, although Gilligan stressed relatedness, this is not reflected in her own empirical approach, which still focuses on individual moral reflection. Concepts from social psychology can help overcome both problems. Social categories like gender shape moral identity and moral decisions. If morality is understood as being lived through actions of persons in social relationships, gender becomes a helpful category of moral analysis. Our findings will provide a conceptual basis for the question how empirical research in medical ethics can successfully embrace a gendered perspective. (shrink)

The legislature of Dubrovnik, already under the prevalent influence of the Church, witnessed significant changes in the social positioning of women, while the novel intellectual orientations exerted powerful influence on its cultural life. Accordingly, it was in Dubrovnik that the first-ever poetesses emerged, and that the first-ever female myth was constructed; namely that of Cvijeta Zuzorić. The work of her contemporary and dear friend, Nikola Vitov Gučetić, bears witness to the then novel possibility – woman voice embedded in a philosophical concept, and promoted by the signature of this reputable citizen of Dubrovnik. Gučetić opened the doors of his villa, a sheltered place for »honourable study«, to two women for their talks of beauty and love, and dedicated the published Dialogues to yet another »respectable and most fair lady«, Cvijeta’s sister Nika. With this he gave his wife Maruša Gundulić and Cvijeta Zuzorić not only mediate voice, but also a name. In the stylistic encounter of the poetical and philosophical, in the interlacement of the actor and interpreter, in the bridging from gods to God, Gučetić traces the trails of authority from a well-known philosophical tradition, opting for a reflection on love »in the spirit of Plato« already in his subtitle.This paper unveils women presented via a feminine voice, and compares them with Gučetić’s attitudes articulated in his Upravljanje obitelji , a work published some ten years or so after his Dijalog o ljepoti and Dijalog o ljubavi . Close attention is given to Gučetić’s thematisation of the concept of love and the strength of arguments used in solving the mysteries of the power, source and complexity of love. (shrink)
This essay seeks to answer the questions of which children in the contemporary world have been targeted and killed "unintentionally”or "at random" by the Brazilian State. In order to understand the place of children in this “war” we rely on the work, among others, of Achille Mbembe, Maurizio Lazzarato and Peter Pál Pelbart. Our text is structured in six sections. First, we take up the concepts of biopolitics, biopower and necropolitics, in an attempt to specify the type of governmental power (...) that is exercised nowadays. Biopower is understood, not only as a military or political concept, but also in relation to a “biological” war against blacks, against certain sexualities, against some women and against some children. We than show how the construction of the universal idea of “child” excludes children who do not belong to this representation, which is, in general, disseminated as being the only image of a child. This diffusion of a single, universal notion of “child” is made through countless discursive and audiovisual imagery, and excludes black children and all those who diverge from or “flee” the hegemonic way of representing, thinking and writing about what a child is. Finally, we verify that the dead children are black and poor and we demonstrate the importance of children's political participation in social life. (shrink)
Recent literature reported that judgments of semantic coherence are influenced by a positive affective response due to increased fluency of processing. The presented paper investigates whether fluency of processing can be modified by affective responses to the coherent stimuli as well as an automaticity of processes involved in semantic coherence judgments. The studies employed the dyads of triads task in which participants are shown two word triads and asked to solve a semantically coherent one or indicate which of the two (...) is semantically coherent. Across two studies in a dualtask paradigm we show that a) attentional resources moderate insight into semantically coherent word triads, whereas b) judgments of semantic coherence judgments are independent of attentional resources. We discuss implications of our findings for how people might form intuitive judgments of semantic coherence. (shrink)
