How are social protections evolving in the developing world, particularly as those nations confront the challenges of globalization? Scholars in this special issue examine the challenges, continuity, and changes in social protections across the developing world over the last few decades. The common theme that emerges from this informative group of papers is that developing nations are confronting unique politico-economic difficulties as well as opportunities for the development of their welfare programs. This is a vastly understudied topic. The studies in (...) this issue tackle some of the unanswered questions of the globalization–social protection debate in developing economies, with a particular focus on how politics plays into the relationship. Risks and burdens in the study participation, as well as an adequate risk-benefit balance, are key concepts for the evaluation of clinical studies by research ethics committees. An adequate assessment and continuous monitoring to ensure compliance of risks and burdens in clinical trials have long been described as a central task in research ethics. However, there is currently no uniform and solid theoretical approach to risk assessment by RECs. Regulatory standards of research ethics such as the Declaration of Helsinki provide (...) only minimal guidance on how risk decisions are considered. Due to discrepancies in the existing literature and guidance documents, adequate risk assessment by RECs remains to be elusive. In this article, we address current definitions of risk and present our own concept of aggregate risk definition. Moreover, we highlight the concept of benefit, the standard of reasonableness with respect to ethics literature and different approaches of risk-benefit assessment. In order to present a comprehensive theoretical approach of risk assessment by RECs, further understanding of the definitions of risk may improve adequate decision-making tasks by RECs. To improve the process of risk assessment by RECs, a dynamic framework will be illustrated, showing step-by-step risk assessment functions. This approach may be a promising tool to ensure adequacy in risk assessment by RECs. (shrink)

Cet ouvrage est l'hommage qu'une des deux filles de Jean Klein (1912-1998), Nita, comédienne et artiste, a décidé de rendre à son père, un des plus célèbres maîtres spirituels du XXe siècle, pour le centième anniversaire de sa naissance. Jean Klein a été philosophe et un maître spirituel remarquable auteur d'une oeuvre (...) essentielle qui a infuencé de nombreux enseignants contemporains comme Eric Baret, Jean-Bouchart D'Orval, Francis Lucille, Jean-Marc Mantel etc. Même si Jean Klein n'appartenait à aucune école, sa quête de la vérité a rencontré l'Advaïta Vedânta (Non-Dualité) dont il a dit lui-même que " ce n'est pas un système, une religion, une technique. Ce n'est même pas une philosophie, c'est simplement la vérité. " Mais Jean Klein était aussi violoniste (il pratiqua toute sa vie le violon) et s'intéressait à toutes les formes d'art : au théâtre, à la peinture (il était ami de Hans Hartung), à la danse (son autre fille, Malavika, est professeur de danse indienne). Il s'agit donc dans ce livre d'une rencontre entre l'intuition d'un artiste et la recherche indienne de la vérité, recherche plus orientée vers la perception globale de la Réalité que vers les certitudes offertes par le savoir. Nita Klein nous invite à découvrir comment la spiritualité authentique conduit à la création artistique ; comment, dans l'art du théâtre, l'interprétation d'un personnage, peut atteindre à la vérité, quand la personnalité du comédien consent à s'effacer. Researchers studying human behavioral genetics have made significant scientific progress in enhancing our understanding of the relative contributions of genetics and the environment in observed variations in human behavior. Quickly outpacing the advances in the science are its applications in the criminal justice system. Already, human behavioral genetics research has been introduced in the U.S. criminal justice system, and its use will only become more prevalent. This essay discusses the recent historical use of behavioral genetics in criminal cases, recent advances (...) in two gene variants of particular interest in the criminal law, MAOA and SLC6A4, the recent expert testimony on behalf of criminal defendants with respect to these two gene variants, and the future direction of behavioral genetics evidence in criminal cases. For the average person, genetic testing has two very different faces. The rise of genetic testing is often promoted as the democratization of genetics by enabling individuals to gain insights into their unique makeup. At the same time, many have raised concerns that genetic testing and sequencing reveal intensely personal and private information. As these technologies become increasingly available as consumer products, the ethical, legal, and regulatory challenges presented by genomics are ever looming. Assembling multidisciplinary experts, this volume evaluates the (...) different models used to deliver consumer genetics and considers a number of key questions: How should we mediate privacy and other ethical concerns around genetic databases? Does aggregating data from genetic testing turn people into products by commercializing their data? How might this data reduce or exacerbate existing healthcare disparities? We will focus on the theory of complete concept in the philosophy of Leib-niz. We will not emphasise the epistemological aspects, but rather will concentrate on the metaphysical implications of this theory. Some questions requiring an answer will be: are there two individual substances of the same kind? What is the nature of a substance that is only possible? What kind of notion has the unactualised possible? What is the nature of the relationship between individual substance and the complete no-tion? (...) In order to answer these questions, we will present in the first part of the paper the concept of individual substance, in the second part, we will focus on the problem whether the possible objects have or have not a complete concept, and in the third part we will give some additional arguments to support our answer. Background: Ethics consultants (ECs) are increasingly expected to possess core knowledge and skills. Few data address whether ECs actually possess recommended core knowledge. We aimed to measure pediatric ECs’ understanding of ethical principles, identify knowledge gaps, and explore associations between experience/training and knowledge in pediatric ethics consultations. Methods: We identified the 2 ECs most knowledgeable in pediatric ethics from each of 45 freestanding children's hospitals and an equal number of general teaching hospitals in the United States. This yielded a sample (...) of 159 eligible pediatric ECs. Pediatric ECs were sent a survey measuring ethics training, characteristics of the ethics consultation service, and EC knowledge, as assessed by a previously validated scale entitled the Test of Residents’ Ethics Knowledge for Pediatrics (TREK-P). Of 102 completed surveys received, 99 were used in the analysis. Results: Seventy-three percent of ECs had completed ≥1 formal training modality, most commonly bioethics mini-courses, master's degrees, or certificate programs (20–30% each). Respondents infrequently received salary support (32%) or had a budget (28%) to support ethics work. The median TREK-P score was 19 (interquartile range [IQR] 17–21). Forty percent of subjects scored ≥20, surpassing the threshold of adequate performance proposed in previous work. Median scores were significantly higher among ECs with formal training in ethics but did not differ significantly by other variables. In secondary analyses, high scores (≥20) were significantly more common among ECs receiving salary support (55% vs. 33%, p = 0.04) and who had formal ethics training (47% vs. 22%, p = 0.02). Items pertaining to privacy, genetic testing, and assent, were answered incorrectly by >33% of ECs. Conclusions: High scores on a validated ethics knowledge scale were more common among ECs with salary support or formal ethics training. The study highlights knowledge gaps that warrant consideration as EC becomes a professionalized endeavor. (shrink)

The rise of neurotechnologies, especially in combination with artificial intelligence (AI)-based methods for brain data analytics, has given rise to concerns around the protection of mental privacy, mental integrity and cognitive liberty – often framed as “neurorights” in ethical, legal, and policy discussions. Several states are now looking at including neurorights into their constitutional legal frameworks, and international institutions and organizations, such as UNESCO and the Council of Europe, are taking an active interest in developing international policy and governance guidelines (...) on this issue. However, in many discussions of neurorights the philosophical assumptions, ethical frames of reference and legal interpretation are either not made explicit or conflict with each other. The aim of this multidisciplinary work is to provide conceptual, ethical, and legal foundations that allow for facilitating a common minimalist conceptual understanding of mental privacy, mental integrity, and cognitive liberty to facilitate scholarly, legal, and policy discussions. Diese Studien zu Plessner stellen das Philosophie-Konzept seiner Anthropologie in den Mittelpunkt und heben es als Ausdruck der Moderne heraus. Exzentrizität ist eine Bestimmung des Citoyens, nicht des homo sapiens. Plessners Postulat, die Unergründlichkeit des Menschen verbindlich zu nehmen, ist ein Plädoyer, die unaustauschbare Individualität und Wandelbarkeit der Person zu wahren. Solcher Schutz der Würde wäre überflüssig, wären Personen nicht verletzbar. Weil Plessner dies ernst nimmt, ist das moderne Versprechen von Autonomie nicht Autarkie, sondern Souveränität: Handeln als Ausdruck der Unentscheidbarkeit (...) von Macht und Ohnmacht. Plessners Einzigartigkeit liegt darin, dass dies auch sein eigenes Philosophieren auszeichnet, das durch ein Augenzwinkern gebrochen ist: Man kann, aber man muss den Menschen nicht als Exzentriker ansprechen. Nur wenn man es tut, nimmt man ihn als Würdigen. (shrink)

Die politische Ideengeschichte kennt nicht viele Autoren, die derart umstritten sind, wie der Abbé Sieyés: Für manche Interpreten ist er Wegbereiter des Jakobiner-Terrors, für andere dagegen der Vater des parlamentarischen Regierungssystems unserer Zeit. Der vorliegende Band unterzieht diese und ähnliche Klischees einer kritischen Prüfung.

Da nur der einzelne Mensch, nicht aber etwas ihn (seinen individuellen Leib im Sinne Jean Amérys) Überschreitendes frei sein kann, darum, so lautet Sartres logisch nicht zu widerlegendes Urteil, kann keinem Objekt eine in diesem selbst angelegte Fähigkeit, Entscheidungen zu fällen, zugesprochen werden. Wenn ein Subjekt einem ihm Äußeren – etwa Gott, der Natur, dem Staat, dem Kapital oder dem Schönen, dem Glück oder sonst etwas –, eine derartige Autonomie zuschreibt, belügt es sich, meint Sartre: um der Angst vor seiner (...) Freiheit Herr zu werden und sich für seine Taten nicht verantwortlich fühlen zu müssen. Wenn man Adornos Ästhetik dieser Subjektbestimmung konfrontiert, läßt sich jedoch zeigen, daß, so sehr Sartre logisch im Recht sein mag, die Kritik im Grunde darauf zielen muß, genau jenes für Sartre Unmögliche dennoch zur Darstellung zu bringen: um die Verkehrungen erkennen zu können, dank derer das Kapital als automatisches Subjekt, als Souverän, agieren kann. Der Souveränitätsbegriff Immanuel Kants wird in diesem Sammelband aus drei unterschiedlichen Perspektiven beleuchtet. Zu Beginn werden seine rechtlichen Bedingungen untersucht: im Allgemeinen die Kantische Rechtsauffassung und im Besonderen der Prozess des Übergangs vom Naturzustand, in dem alle Individuen souverän sind, zum bürgerlichen Zustand, laut dem die Souveränität allein dem Staat gehört. Der zweite Abschnitt enthält eine ausführliche Analyse des Begriffes, sei es als innere (die staatliche Verfassung) oder äußere Souveränität (die internationalen Beziehungen). Der abschließende Teil beschäftigt sich mit dem Begriff (...) der Politik als praktische Durchsetzung des Rechtes - und deshalb indirekt auch der Souveränität - auf dem Gebiet der Wirklichkeit, mit enger Verbindung zur Moral und Geschichte. Durch diese Analysen schlägt das Buch eine sowohl wissenschaftliche wie unkonventionelle Darstellung des politischen Denkens Kants vor, die dem Leser zugänglich gemacht wird. (shrink)
