In the Kuhnian and Post-Kuhnian Philosophy of Science, it is widely accepted that scientific revolutions always involve the replacement of an old paradigm by a new paradigm. This article attempts to refute this assumption by showing that there are paradigm-constellations that conform to the relation of a scientific revolution in a Kuhnian sense without a paradigm-replacement occurring. The paradigms investigated here are the linguistic paradigms of Generative Grammar and Construction Grammar that, contrary to Kuhn’s (...) conception of a sequence of paradigm-replacements, are reconstructed as coexisting competing paradigms. By choosing linguistic paradigms, Kuhn’s assumption that paradigm-led research takes place only in the natural sciences is implicitly challenged, and an insight into linguistic theory-construction largely underrepresented in the philosophy of science is given. In the domain of evolutionary cognitive archaeology, the early body ornaments from the Middle Stone Age/Palaeolithic are generally treated as mere by-products of an evolved brain-bound cognitive architecture selected to cope with looming social problems. Such adaptive artefacts are therefore taken to have been but passive means of broadcasting a priori envisaged meanings, essentially playing a neutral role for the human mind. In contrast to this epiphenomenalist view of material culture, postphenomenology and the Material Engagement Theory have been making a (...) case for the active role of artefacts on the count that they can actually shape and restructure the human mind. By bringing these dissenting voices together, the paper at hand employs an enactive way of thinking in order to challenge the epiphenomenalist take on early body ornaments. In fact, two variants of enactivism are presented, each advancing a unique explanation of how the engagement of early humans with body ornaments transformed their minds along the two postphenomenological categories of embodied and hermeneutic cognition. Our theoretical frameworks specifically seek to explore how early beadworks could have scaffolded the creation of semiotic categories and the development of cognitive processes. Despite relying on inherently different premises, both theories suggest that beads fostered the emergence of an epistemic apparatus which thoroughly transformed the way humans engaged with the world. Having concurred on the ornaments’ transformative effects, we ultimately conclude that the epiphenomenalist paradigm best be replaced with an enactive approach grounded on the dictates of postphenomenology and the MET. For many years the prevailing paradigm for medical decision making for children has been the best interest standard. Recently, some authors have proposed that Mill’s “harm principle” should be used to mediate or to replace the best interest standard. This article critically examines the harm principle movement and identifies serious defects within the project of using Mill’s harm principle for medical decision making for children. While the harm principle proponents successfully highlight some difficulties in present-day use of the best (...) interest standard, the use of the harm principle suffers substantial normative and conceptual problems. A medical decision-making framework for children is suggested, grounded in the four principles. It draws on the best interest standard, incorporates concepts of harm, and provides two questions that can act as guide and limit in medical decision making for children. (shrink)

This paper attempts to examine the paradigm shift in ASEAN from a state-based to a people-based organization. We argue that by adopting a people-based organization, ASEAN now enters an era of Neo-Communitarianism replacing the Old Communitarianism of the old generation of ASEAN. By using communitarian perspectives, we look at the continuities and changes in ASEAN with regard to how it deals with issues involving their members. Three important issues namely the debates on intervention principle; the adoption of the three (...) pillars of the ASEAN Community; and the inclusion of human rights are seen as the signposts where ASEAN departs from their Old to a Neo-Communitarianism. Although there have been a lot of challenges to the realization of the people-based organization, we see that the dynamics of debates and the active participation of the community in the debates show good prospects for the new paradigm to realize. In this paper, we use debate on the formation of ASEAN Intergovernmental Commission on Human Rights (ICHR), to show the involvements of people in setting the agendas for the future ASEAN. (shrink)

The citation index of Thomas Kuhn’s work may strike any imagination. “The Structure of Scientific Revolutions” is undoubtedly a twentieth-century record-breaker in the field of philosophy of science in terms of such a scientometric parameter. But such fame has been bitter in many ways and placed a heavy burden on the author. For several decades he has been the target of the harshest and most severe criticism. Often the concept of “normal science” and the “scientific revolution” as a “Gestalt switch” (...) was declared ridiculous and absurd. The paper analyses three lines of criticism of Kuhn’s concept: the first came from practicing scientists, the second from specialists in the philosophy of science, and the third from the field of social epistemology. Reproaches about the political bias of Kuhn’s concept were taken to extremes, since his views were widely popular. In our opinion, Kuhn should be called a victim of spontaneous hypercriticism. This circumstance did not allow him to improve the original model of scientific revolutions. In this respect, replacing the concept of “paradigm” with the concept of “disciplinary matrix” was a step backwards, not forwards. However, it is impossible to deny that in the field of the historiography of science, he acted as a real reformer. With the courage of Don Quixote, he defended the rights of historical reconstruction, the preservation of the historical past of science, which should not be completely assimilated within the framework of the modern system of knowledge. His motto was – “penetrate the minds of other people who lived in the past.” He boldly argued that in the process of historical development, science changes not only ideas about the object of knowledge, but also the reference of its ideas and concepts. Such a formulation of the question has not yet been fully reflected in modern epistemological concepts. (shrink)

A common current refrain laments that multiculturalism has failed as a policy model and that it should be replaced by interculturalism. In this article, we present a critical analysis of the backgrounds and targets of multiculturalism and interculturalism. While multiculturalism concerns rights, equality and justice, interculturalism relates to social cohesion, shared participation and practices. Instead of merely juxtaposing these two paradigms, we illustrate the extent to which they are both different and complementary, as well as why they should be implemented (...) simultaneously. Intercultural and multicultural policies can be mutually reinforcing, in addition to adjusting or compensating for possible undesirable outcomes. By emphasising their complementarities, we go beyond the arguments of those who would expel multiculturalism in favour of interculturalism, as well as those who believe that multiculturalism already incorporates the merits of interculturalism. We also demonstrate the presence of both multicultural and intercultural aspects in the ‘civic integration’ policies that are being implemented with increasing rigour in several countries of immigration. This paper identifies the ethical issues involved with women's advertising, and argues that ads can be successful in generating sales without portraying women as things or as mere sex objects, and without perpetuating various weakness stereotypes. A paradigm shift in advertising appears to be at hand. This new model replaces images of women as submissive or constantly in a need of alteration, with a move to reinstate beauty as a natural thing, not an unattainable ideal. This paper also reviews (...) general ethical issues of the advertising industry, including: (1) that advertising equates the pursuit of material gain with human happiness; (2) that advertising pushes its own values, artificial or false as they may be, as to what is "good" for the consumer; (3) that advertising plays on physical appetites and the body; (4) that advertising strives to bypass rational thinking, by desensitizing the viewer and playing on group dynamics. Sudden enlightenment is awakening to be attained all at once. Hyun-Eung, a Korean Buddhist monastic, has proposed a new interpretation that sudden enlightenment is the revolutionary awakening of the dynamical and indivisible structure of cognitive subject and objects. I argue that Hyun-Eung’s ‘revolutionary enlightenment’ is achieved through a ‘paradigm shift’ in Thomas Kuhn’s sense as presented in his The Structure of Scientific Revolutions. Enlightenment is obtained when one’s essentialist and realist worldview is replaced, through a revolutionary change of (...) class='Hi'>paradigm shift, by a new perspective based on the Buddhist teaching of dependent arising and emptiness. Prior to enlightenment, each person views oneself as a separate and independent individual who has her own essence. However, when our perspective on self and the world changes with the understanding of dependent arising and emptiness, it becomes clear that no one and nothing can exist independently of conditions. Everything comes into existence, abides, and passes out of existence only in dependence on conditions. Sudden enlightenment requires a revolutionary change in one’s perspective of self and the world. I conclude that this concept of revolutionary enlightenment aptly explains the features of sudden enlightenment. (shrink)

The field of Artificial Intelligence (AI) has undergone many transformations, most recently the emergence of data-driven approaches centred on machine learning technology. The present article examines that paradigm shift by using the conceptual tools developed by Thomas Kuhn, and by analysing the contents of the longest running conference series in the field. A paradigm shift occurs when a new set of assumptions and values replaces the previous one within a given scientific community. These are often conveyed implicitly, by (...) the choice of success stories that exemplify and define what a given field of research is about, demonstrating what kind of questions and answers are appropriate. The replacement of these exemplar stories corresponds to a shift in goals, methods, and expectations. We discuss the most recent such transition in the field of Artificial Intelligence, as well as commenting on some earlier ones. (shrink)

The philosophy of Thomas Kuhn proposes that scientific progress involves periods of crisis and revolution in which previous paradigms are discarded and replaced. Revolutions in how mental health problems are conceptualised have had a substantial impact on the work of mental health nurses. However, despite numerous revolutions within the field of mental health, the biological paradigm has remained largely dominant within western healthcare, especially in orientating the understanding and treatment of psychosis. This paper utilises concepts drawn from the philosophy (...) of Thomas Kuhn to explore the impact of what Kuhn terms ‘anomalies’ within the dominant biological paradigm: the anomaly of the meaningful utterance, the anomaly of complex aetiology and taxonomy and the anomaly of pharmacological inefficacy in recovery. Recent commentaries by Verheijde et al, Evans and Potts suggesting that donation after cardiac death practices routinely violate the dead donor rule are based on flawed presumptions. Cell biology, cardiopulmonary resuscitation, critical care life support technologies, donation and transplantation continue to inform concepts of life and death. The impact of oxygen deprivation to cells, organs and the brain is discussed in relation to death as a biological transition. In the face of advancing organ support and replacement technologies, the reversibility (...) of cardiac arrest is now purely related to the context in which it occurs, in association to the availability and application of support systems to maintain oxygenated circulation. The 'complete and irreversible' lexicon commonly used in death discussions and legal statutes are ambiguous, indefinable and should be replaced by accurate terms. Criticism of controlled DCD on the basis of violating the dead donor rule, where autoresuscitation has not been described beyond 2 minutes, in which life support is withdrawn and CPR is not provided, is not valid. However, any post mortem intervention that re-establishes brain blood flow should be prohibited. In comparison to traditional practice, organ donation has forced the clarification of the diagnostic criteria for death and improved the rigour of the determinations. (shrink)

Philosophers have had surprisingly little to say about the concept of a victim although it is presupposed by the extensive philosophical literature on rights. Proceeding in four stages, I seek to remedy this deficiency and to offer an alternative to the two current paradigms that eliminates the Othering of victims. First, I analyze two victim paradigms that emerged in the late 20th century along with the initial iteration of the international human rights regime – the pathetic victim paradigm and (...) the heroic victim paradigm. Holocaust victims are quintessential instances of the pathetic victim paradigm. They are marked by passivity and innocence in the face of overpowering force and unspeakable humanly inflicted suffering. Aung San Suu Kyi is an exemplar of the heroic victim paradigm – prisoners of conscience, in Amnesty International’s terms. Because heroic victims face off against the repressive power of the state to fight injustice, they are by no means passive, but they must be innocent of wrongdoing – that is, they must use nonviolent means of dissent – to qualify as heroic victims. Second, I problematize the asymmetrical conceptions of innocence that underwrite the two victim paradigms. Whereas the pathetic victim paradigm identifies innocence with passivity, the heroic victim paradigm countenances agentic victims and adverts to a universalist, absolutist stance on the limits of the legitimate use of state power to ascribe innocence to heroic victims. Both conceptions of innocence are out of keeping with well established social and legal practices regarding what constitutes coercive force and innocent victimhood. Consequently, there is reason to be skeptical of the two victim paradigms. Third, I identify two kinds of human rights violations and two categories of victims that AI defends despite their failure to fit the two paradigms – women trafficked into sex work and prisoners on death row. In many cases, women forced to do sex work are not innocent girls who are ignorant of the trafficking system and who helplessly fall prey to smugglers. They are desperately poor women who for that reason are willing to take enormous risks to try to relieve their own and often their families’ deprivation and suffering. Although these women act nonviolently for irreproachable reasons, they lack the public political agendas that characterize heroic victims. Unless non-fulfillment of subsistence rights is recognized as a form of overpowering force that inflicts severe, avoidable suffering, these women do not qualify as pathetic victims either. The victim paradigms pose an even greater obstacle to recognizing that the death penalty is a human rights violation and that death row prisoners are victims. Because a jury concluded that these individuals committed heinous, violent crimes, they are excluded by the heroic victim paradigm. Only if death row prisoners can be proven (usually through DNA evidence) not to have committed the crimes for which they were convicted can these individuals qualify as pathetic victims. In the absence of any reason to believe that they are innocent and especially if they are unrepentant, they are widely regarded as brutal victimizers of others who deserve no sympathy for, let along relief from, the suffering they “brought on themselves.” Finally, I confront the Othering of victims that results from the two victim paradigms, which leads many victims to eschew the label, thereby opting out of human right discourse. I propose revisions in the victim paradigms that eliminate the real-world exclusions they sponsor as well as the Othering of victims of human rights abuses. In particular, I endorse greater attention to what people and the institutions they create do to other people, and I favor a presumption that unnecessary and severe humanly inflicted suffering is a human rights violation. Moreover, I reject the innocence criterion embedded in the two paradigms and urge that it be replaced by a burdened agency criterion. These modifications better align the concept of a victim with a realistic understanding of human subjectivity and agency and allow for a more capacious understanding of who is a bearer of human rights and under what conditions right-holders become victims of rights violations. After Copernicus (1473–1543) and the ongoing development of contemporary cosmization, a new epistemological paradigm of post-religious humility is replacing religious versions. In the 100th year of Kuhn/Lakatos, this article explores the differences between religious and post-religious paradigms of humility as a formative aspect of human knowing. Although post-religious humility does not necessarily strive to criticize earlier paradigms of humility, an implicit critique is often present. In accordance with Kuhnian/Lakatosian theory, this article is not about psychological traits or personality characteristics; (...) rather, both types of humility as epistemological paradigms exist at the nascent stage of knowledge development. In retrospect, various thinkers throughout the Renaissance and Enlightenment demonstrate flux and conflict between the two paradigmatic humilities, and various theorists also struggle to articulate the emerging paradigm. The overall trajectory radicalizes the abandonment of anthropomorphism and positivistic assumptions about certainty. Historically, post-religious humility also intersected with society’s perception of science’s “progress” and a deeper embrace of finitude and mortality than was possible earlier. Movements like transhumanism, as well as phenomena of technological prowess and remarkable achievements in modern scientific research, do not contradict the new humility’s role. Whether religious or post-religious, postpositivistic civilization increasingly experiences that the new paradigm repositions the sociological and cognitive place where humility can now comfortably reside. Preface The status of sovereignty as a highly ambiguous concept is well established. Pointing out or deploring, the ambiguity of the idea has itself become a recurring motif in the literature on sovereignty. As the legal theorist and international lawyer Alf Ross put it, “there is hardly any domain in which the obscurity and confusion is as great as here.” 1 The concept of sovereignty is often seen as a downright obstacle to fruitful conceptual analysis, carried over from its proper (...) setting in history to “plague and befog contemporary thought.” 2 . . . So contested is the concept that, rather than pursuing the contestation, many political theorists think we should give up so protean a notion. Granting that the debate on the relevance of sovereignty frustratingly oscillates between claims that it will either continue to exist or that it is about to disappear, forgetting it altogether, and thereby escaping this seemingly endless argument, can easily appear as the most urgent task for political theory . The following argument makes a case that the “urgent task” is not the abandonment of the concept of sovereignty, but an understanding of its essential philosophical nature as an integrated and evolving expression of practical reason. Sovereignty is neither ambiguous nor obscure once its fundamental presuppositions are laid bare and its many philosophical and historical manifestations shown to be the product, in actuality, of a single, dialectally dynamic but integrated set of metaphysical elements. This is the first of three arguments describing the evolution of international law as a manifestation of practical reason through an application of philosophical method to the source , locus , and scope of the concept of sovereignty. It moves from a dialectic balance favoring utility to a balance dominated by legal right to a dialectic of duty to humanity and nature. All three arguments are meant to be a contribution to the new field of International Legal Philosophy as defined by Phillip Allott. 4 This field combines a sensitivity to legal practice with an effort to understand the underlying philosophical determinants of empirical choice and behavior. One purpose of international legal philosophy is to “remove” from the minds of those who study the law what Diderot defined as “the sophism of the ephemeral,” and what Allott calls “the disempowering idea that what xii Preface happens to exist now is inevitable and permanent.” 5 A core imperative is to “reunderstand what it is to be a thinking being” 6 and to rediscover the dialectic between the private and the public as it determines, and is redetermined by, legal practice. This requires a “revolution in the human mind” 7 so that we may transcend the current dependence on positivist methods and empirical fact as an end-in-itself, and try to understand the underlying and more constant and essential ideas and inherent dialectics that constitute the substructure or “metaphysics” of international law. I will approach this “revolution” with the use of R. G. Collingwood’s philosophical method 8 and the philosophy of David Hume, applied to international law as an expression of practical reason. The goal of philosophical method is the construction of a comprehensive policy argument (CPA) for a public policy or legal issue. In addition to the conventional use of empirical models and their logic of investigation in the study of policy and law, CPA requires that an underlying philosophical logic of concepts be deciphered to identify the ideas within the issue, and their definition, overlap, and systematic interdependence. Philosophical method is a means with which to interpret and understand competing systematic and complete conceptual logics, existing at the core of an issue and pertinent to policy change. Philosophical method is therefore not meant to be a replacement for the empirical investigation of a policy or legal issue, or the use of scientific method in social studies. Rather, it is a complimentary and prerequisite method that seeks to transcend the limitations of positivism and present a more complete understanding of the philosophical presuppositions of positivist ideas like power, interest, or strategic rationality. Philosophical method is meant to be used with the facts of the policy or legal issue to match an illuminating logic of concepts with a pertinent logic of investigation . Within the CPA, the use of philosophical method and the metaphysics of a policy or legal issue is assumed to be critical to the full understanding of the overlapping concepts, dialectics, and scale of forms that determine, and are determined by, the empirical context of the policy or legal topic. Specifically, instead of utilizing bits and pieces of various theoretical arguments to address narrowly focused empirical questions, as positivism prescribes, I will address the evolution of international law as practical reason in three phases. Each will be approached through a single integrated logic of philosophical concepts from a particular philosopher (i.e., David Hume, G. W. F. Hegel, Immanuel Kant). This philosophically holistic approach to the law is based on the assumption that only through the use of a single integrated argument in legal analysis can sovereignty, or any concept, be understood as a truly systematic and logical whole. A complete philosophical paradigm has a dialectic integrity and systematic logic that can more adequately describe the evolving essence of a concept like sovereignty. This approach also has the advantage of generating a number of distinct holistic descriptions of the law through the application of different philosophical systems, one at a time, to its factual structure. 9 Positivism does not seek Preface xiii holism, and rejects the idea that “theory” has such a characteristic. The essential or comprehensive substructure of any idea is therefore ignored in a method that recommends the observation of empirical problems through the use of whatever hodgepodge of theoretical elements is seen fit to frame its superstructure. This failure to deal with metaphysics has retarded both an essential understanding of international law as a species of legal system, and any holistic and dialectical conceptualization of its inherent concepts, like sovereignty. A second positivist convention expects modern theorists to create new theory rather than to refine and apply that of existing philosophy. This predisposition is driven by the positivist goal of discovery that ignores refinement as a possible purpose of philosophical analysis. Collingwood argues that philosophy must take that set of ideas already known and utilize existing systematic philosophical arguments to refine them so that they evolve closer to their essence as concepts. Considering this imperative, the idea of sovereignty can be assumed to have had valid usage for hundreds of years, over which time, the concept has evolved to mean different things, each a refinement of the definition that preceded it. Transcending positivism means that the scholar’s search is not for “new” material, but to decipher the metaphysical essence of a concept as it has been made manifest over time and context. These manifestations are rooted, and refined from, the known terms of that concept’s inherent idea(s). Rather than depending exclusively on positivism and its conventions, my work utilizes, in addition to Collingwood, the intact philosophical systems of Hume, Hegel, and Kant to trace the refinement of international law as a product of human practical reason. These paradigms, or integrated systems of logical concepts, will be applied to legal practice individually, so that each CPA can be deciphered separately. This provides a set of integrated and logically intact paradigms for the evolutionary stages of practical reason in international law. Because each argument is applied systematically, a deeper understanding of the source, locus, and scope in the development of law in general, and international law in particular, is possible where it is not with the application of various disconnected components of many theories. Each CPA based on Hume, Hegel, or Kant can then be used to describe a distinct context that its logic of concepts best illuminates; specifically, the (1) genesis, (2) contemporary dilemmas, and (3) future of the international legal system. By widening the perspective of international lawyers and policymakers, they can more easily perceive the dialectic of ideas that has created, and is refined by, the legal practice in which they participate. We also move toward Allott’s goal of “human self-perfecting.” 10 And, in addition, by providing a more complete knowledge of the origins of legal practice and its evolution, we illuminate the practical possibilities for what we might “choose to be” 11 in the future. To achieve this, the essential metaphysical elements of state sovereignty and its inherent evolutionary scale of forms will be deciphered and described. This will transform what appears to be a multitude of definitions and xiv Preface practical realizations of the concept of sovereignty into a set of interdependent manifestations of a single substructure, made of a single set of dialectic elements. The interpretation of international law through practical reason sorts and integrates a diverse and discordant literature and defines state sovereignty as a single concept evolving on a scale of forms that allows it to exhibit diverse character traits, all arising from different combinations of common and essential metaphysical elements. This approach, compared to positivist methods and legal realism, allows one to transcend current agreement that sovereignty is, at best, a narrowly focused set of empirical characteristics or, at worst, “organized hypocrisy.” 12 This method also encourages the scholar and practitioner to understand the predispositions and pitfalls of the concept of sovereignty, as well as its potential future paths, more effectively. The use of philosophical method to create policy paradigms out of preexisting philosophical systems and apply these to international law will be called Philosophical-Policy & Legal Design . This approach allows the use of preexisting and complete philosophical arguments that provide an adequate logic of concepts to chart the evolution of the idea of sovereignty along its scale of forms. An examination of the source of practical reason in human social convention with the employment of a philosophical-policy drawn from Hume’s logic of concepts about human nature will demonstrate this new approach. Why Hume? Because, up to now, without an adequate substructure we have arguments, like Brunne é’ s and Troope’s, 13 that may correctly identify international law as an “interactional” system, but cannot present any argument as to why it is, where this empirical reality comes from, or what its implications are for the future. Comparatively, Hume provides a logic of philosophical concepts that answers these concerns. First, he fulfills the requirements for a fuller understanding of the origin and evolution of law from social convention and the dependence of social convention on the human imperative for society. Second, he offers a more adequate delineation of the overlapping concepts of the law in terms of the ideas and institutions that deal with norms and justice (e.g., principle, process, practice, rule, power, interest). Third, he provides a fundamental understanding of the essential dialectics at the core of a conceptualization of the law with both unconscious and conscious human participation (i.e., passion. Transoral laser microsurgery applies to the piecemeal removal of malignant tumours of the upper aerodigestive tract using the CO2 laser under the operating microscope. This method of surgery is being increasingly popularised as a single modality treatment of choice in early laryngeal cancers (T1 and T2) and occasionally in the more advanced forms of the disease (T3 and T4), predomi- nantly within the supraglottis. Thomas Kuhn, the American physicist turned philosopher and historian of science, coined the phrase ‘paradigm shift’ (...) in his groundbreaking book The Structure of Scientific Revolutions. He argued that the arrival of the new and often incompatible idea forms the core of a new paradigm, the birth of an entirely new way of thinking. This article discusses whether Steiner and col- leagues truly brought about a paradigm shift in oncological surgery. By rejecting the principle of en block resection and by replacing it with the belief that not only is it oncologically safe to cut through the substance of the tumour but in doing so one can actually achieve better results, Steiner was able to truly revolutionise the man- agement of laryngeal cancer. Even though within this article the repercussions of his insight are limited to the upper aerodigestive tract oncological surgery, his willingness to question other peoples’ dogma makes his contribution truly a genuine paradigm shift. In recent years, the psychology of reasoning has been undergoing a paradigm shift, with general Bayesian, probabilistic approaches replacing the older, much more restricted binary logic paradigm. At the same time, dual processing theories have been gaining influence. We argue that these developments should be integrated and moreover that such integration is already underway. The new reasoning paradigm should be grounded in dual processing for its algorithmic level of analysis just as it uses Bayesian theory for its (...) computational level of analysis. Moreover, we propose that, within the new paradigm, these levels of analysis reflect on each other. Bayesianism suggests a specific theoretical understanding of dual processing. Just as importantly, the duality in processing carries over to duality in function; although both types of processes compute degrees of belief, they generate different functions. (shrink)

Classifying species as ‘native’ or ‘alien’ carries prescriptive force in the valuation and management of ‘nature’. But the classification itself and its application are contested, raising philosophical and geographical questions about place, space, rights, identity and belonging. This paper discusses leading critiques of the native/alien paradigm, including its conceptual fluidity, dichotomous rigidity and ethical difficulties, as well as the incendiary charge of xenophobia. It argues that valorizing ‘native nature’ as inherently the ‘best nature’ is not only obsolete but impracticable (...) in the Anthropocene, and that the preeminence of biogeographic origins should be replaced with a pragmatic focus on species’ behavior. Knauff and Gazzo Castañeda (this issue) critique the "new paradigm" – a framework that replaces logic with probabilities – on the grounds that there existed no "old” paradigm for it to supplant. Their position is supported by the large numbers of theories that theorists developed to explain the Wason selection task, syllogisms, and other tasks. We propose some measures to inhibit such facile theorizing, which threatens the viability of cognitive science. Environmental protection activities in industry have rapidly increased in number over the last years. Additionally, surveys of environmental activities have identified a change in the kind or in the approaches used to environmental problem solving. A new paradigm ‘Clean Technology’ has been developed which gradually seems to replace the ‘Clean-up Technology’ paradigm and the older ‘Dilute and Disperse’ paradigm. The new ‘Clean Technology’ paradigm brings with it not only a new way of looking at environmental protection, (...) but also a range of ‘rules’ guiding the application of technology and the design of technological systems. Here I explore the aesthetic implications of this new paradigm, the central implication being that scientific cognitivism, when combined with the new paradigm in ecology, may require updating the qualities associated with positive aesthetics. After reviewing Allen Carlson's defense of both scientific cognitivism and the positive aesthetics thesis, I show how the significantly different conceptual framework that the new paradigm in ecology provides will require equally significant adjustments to how we aesthetically appreciate nature. I make two suggestions. (...) First, the new paradigm in ecology suggests that aesthetic appreciation should focus on natural processes, which will require a more theoretical approach to aesthetic appreciation. Second, because the new paradigm appeals to aesthetic qualities such as imbalance, disorder, and disharmony to make the natural world intelligible, these qualities are consistent with an updated positive aesthetics thesis and should therefore replace the qualities associated with the old paradigm. Collectively, these two suggestions imply that the beauty of nature is dynamic and chaotic rather than stable and orderly. (shrink)

This article puts into perspective the practice of financial regulation in contemporary financial markets, while a new normative order has emerged. This order, heralded by algorithmic technologies, changes the conditions for the exercise of regulation: to date, it has not yet been fully acknowledged nor understood by regulatory bodies. Computer code, replacing speech and writing, induces a changeover from one normative order to another in contemporary markets: the norm, previously explicated with recourse to interpretation, is now replaced by an order (...) characterized by calculation. Such paradigm change is identified based on a discussion of works by Gilles Deleuze. In so doing, it contributes to the developing research programme in the cultures of high-frequency trading (Lange et al. 2016) and also points at broader issues for conceptualising financial regulation. Its aim was to replace Russell's paradigm by " a general theory of definite descriptions, of which definite mass descriptions, definite plural descriptions, and Russellian definite singular count descriptions are species. … We have an account of the generic ‘the’ along these same lines. " By now his theory has attained the status of a new paradigm. Even a casual trawl of the literature throws (...) up over a score of citations and endorsements, and no rebuttals of its central contention that the primary use of ‘the’ is to indicate totality . We shall argue that it is wrong for mass description, wrong for singular description, wrong for plural description and wrong for generic ‘the’. Sharvy would have approved: his obituary says that his car displayed the slogan ‘Subvert the Dominant Paradigm’.He follows Russell in treating descriptions as incomplete symbols, but nothing in his paper turns on this aspect of it, and we can bypass the issue by considering them in the context of complete sentences. Where Russell translates F into the predicate calculus as Formula Sharvy translates it as Formula Here ≤ is supposed to stand for some or other species of part of relation. His other governing idea is of a predicate's being cumulative. G is cumulative if any number of things that satisfy G have a sum, i.e. a least upper bound with respect to ≤ which also satisfies G. The meanings of ≤, sum and cumulativity vary according to the different kinds of description, which we take in the order in which Sharvy presents them. This paper aims to develop a strong account of recognition. It begins with a Hegel-inspired account of recognition as a fundamental desire that drives humanity. This account establishes recognition as fundamental to the initial subject formation of independent self-consciousnesses as agents. I offer the lord-bondsman dualism to provide a critique of domination as oppositional to securing the means for recognition. This entails that, as history progresses the world ought to move towards universally adopting mutual recognition relationships without domination. I adopt (...) this goal as an ideal form of recognition. In Chapter 2, I apply this recognitional framework to gender. Through analyzing four theories of gender, I find the recognition of identity has a significant role in shaping the self-consciousness’ self-determination. Recognitional dialogue can enable one to learn new parts of the self, but often forms of recognition dominate and constrain what identity can be. Thus, I explore three prominent methods of harmful recognition in Chapter 3: domination, intelligibility, and misrecognition. I view these harmful recognition methods as undermining mutual recognition relationships through examples such as recognizing deprecating self-images of minority groups and overwriting self-determinations through wrongful or lack of recognition. Despite these difficulties, I propose solutions such as an unintelligibility account which focuses on enabling mutual recognition relationships within group identities rather than society. In Chapter 4 I apply this robust recognitional framework to technology, which I understand as a locus for contemporary problems with recognition. I discuss technologies’ recognitional role as mirrors for humans, that often reflect yet threaten to replace us. I turn to understanding data as a technology that enables harmful recognition in the present day. I find technology is not neutral regarding recognition relationships, but can uphold mutual or harmful recognition depending on how it is used. With my account of recognition developed, I return to the goal of universally achieving mutual recognition relationships. I employ Halberstam’s account of failure to offer hope for achieving mutual recognition despite the many forms of harmful recognition. (shrink)

Though numerous disciplines are cultivating pedagogical relationships with the emerging field of digital humanities, philosophy appears to be among the least interested in what digital humanities has to offer. This is a missed opportunity. Through a proper pedagogical framing of both fields, I argue that philosophy educators would benefit from building a pedagogical relationship with digital humanities. First, I outline digital humanities methods and teaching practices, then I identify several core educational aims and teaching methods in philosophy, which I conceptualize (...) in terms of a creative art. Ultimately, I argue that digital humanities practices would enhance philosophy’s education aims by making philosophy more relevant and accessible to students’ needs, by fostering active learning, by establishing more equitable, collaborative participation, and by balancing skill-development with philosophical creation. The goal of this essay is not to replace traditional philosophy pedagogy, but rather to supplement it to better support modern students’ needs. (shrink)

However, there is an ideological commitment to general equilibrium that justifies “free enterprise” with only minimal state intervention that may still sustain neoclassical economics despite the growing evidence of Kuhnian anomalies. Using aesthetics as its organizing lens, Hip Hop Heresies attends to the ways that hip hop cultural production in New York City from the 1970s through the first fifteen years of the 21st century produced hip hop cultural products (film, visual art, and music) that offer "queer articulations" of race, gender, and sexuality that are contrary to hegemonic ideas and representations of those categories in (...) hip hop production, as well as in writing about hip hop culture. Although the AI paradigm is useful for building knowledge-based systems for the applied natural sciences, there are dangers when it is extended into the domains of business, law and other social systems. It is misleading to treat knowledge as a commodity that can be separated from the context in which it is regularly used. Especially when it relates to social behaviour, knowledge should be treated as socially constructed, interpreted and maintained through its practical use in context. The meanings of (...) terms in a knowledge-base are assumed to be references to an objective reality whereas they are instruments for expressing values and exercising power. Expert systems that are not perspicuous to the expert community will lose their meanings and cease to contain genuine knowledge, as they will be divorced from the social processes essential for the maintenance of both meaning and knowledge. Perspicuity is usually sacrificed when knowledge is represented in a formalism, with the result that the original problem is compounded with a second problem of penetrating the representation language. Formalisms that make business and legal problems easier to understand are one essential research goal, not only in the quest for intelligent machines to replace intelligent human beings, but also in the wiser quest for computers to support collaborative work and other forms of social problem solving. Just War Theory (JWT) replaced an older "warrior code," an approach to war that remains poorly understood and dismissively treated in the philosophical literature. This paper builds on recent work on honor to address these deficiencies. By providing a clear, systematic exposition of "Honor War Theory" (HWT), we can make sense of paradigm instances of warrior psychology and behavior, and understand the warrior code as the martial expression of a broader honor-based ethos that conceives of obligation in terms of (...) fair competition for prestige. Far from being a romantic and outmoded approach to war, HWT accounts for current conflicts and predicts moral intuitions that JWT either rejects or cannot comfortably accommodate. So although it is not recommended as a replacement for JWT, there is good reason think that a fully mature, realistic, and yet properly normative theory of war ethics will incorporate a variety of insights from HWT. Enactivists frequently argue their account heralds a revolution in cognitive science: enactivism will unseat cognitivism as the dominant paradigm. We examine the lines of reasoning enactivists employ in stirring revolt, but show that none of these prove compelling reasons for cognitivism to be replaced by enactivism. First, we examine the hard sell of enactivism: enactivism reveals a critical explanatory gap at the heart of cognitivism. We show that enactivism does not meet the requirements to incite a paradigm shift (...) in the Kuhnian sense—there is no internal crisis in cognitivism. Nor does it provide inherently better explanations of cognition as some have claimed. Second, we consider the soft sell of enactivism: enactivism provides a more attractive, parsimonious, or clear-eyed lens on cognition. This move proves to boil down to a misunderstanding of how theories are selected in science. Instead we lend support to a broader and more desirable way to conceive of enactivism, the recent proposal that enactivism is a philosophy of nature. We explain how a philosophy of nature does more than support a single research paradigm by integrating scientific questions into a cohesive picture. (shrink)

Over recent years, the psychology of concepts has been rejuvenated by new work on prototypes, inventive ideas on causal cognition, the development of neo-empiricist theories of concepts, and the inputs of the budding neuropsychology of concepts. But our empirical knowledge about concepts has yet to be organized in a coherent framework. -/- In Doing without Concepts, Edouard Machery argues that the dominant psychological theories of concepts fail to provide such a framework and that drastic conceptual changes are required to make (...) sense of the research on concepts in psychology and neuropsychology. Machery shows that the class of concepts divides into several distinct kinds that have little in common with one another and that for this very reason, it is a mistake to attempt to encompass all known phenomena within a single theory of concepts. In brief, concepts are not a natural kind. Machery concludes that the theoretical notion of concept should be eliminated from the theoretical apparatus of contemporary psychology and should be replaced with theoretical notions that are more appropriate for fulfilling psychologists' goals. The notion of concept has encouraged psychologists to believe that a single theory of concepts could be developed, leading to useless theoretical controversies between the dominant paradigms of concepts. Keeping this notion would slow down, and maybe prevent, the development of a more adequate classification and would overshadow the theoretical and empirical issues that are raised by this more adequate classification. The paper discusses this year’s Nobel Prize in physics for experiments of entanglement “establishing the violation of Bell inequalities and pioneering quantum information science” in a much wider, including philosophical context legitimizing by the authority of the Nobel Prize a new scientific area out of “classical” quantum mechanics relevant to Pauli’s “particle” paradigm of energy conservation and thus to the Standard model obeying it. One justifies the eventual future theory of quantum gravitation as belonging to the newly established quantum (...) information science. Entanglement, involving non-Hermitian operators for its rigorous description, non-unitarity as well as nonlocal and superluminal physical signals “spookily” (by Einstein’s flowery epithet) synchronizing and transferring some nonzero action at a distance, can be considered to be quantum gravity so that its local counterpart to be Einstein’s gravitation according to general relativity therefore pioneering an alternative pathway to quantum gravitation different from the “secondary quantization” of the Standard model. So, the experiments of entanglement once they have been awarded by the Nobel Prize launch particularly the relevant theory of quantum gravitation grounded on “quantum information science” thus granted to be nonclassical quantum mechanics in the shared framework of the generalized quantum mechanics obeying rather quantum-information conservation than only energy conservation. The concept of “dark phase” of the universe naturally linked to the very well confirmed “dark matter” and “dark energy” and opposed to its “light phase” inherent to classical quantum mechanics and the Standard model obeys quantum-information conservation, after which reversible causality or the mutual transformation of energy and information are valid. The mythical Big Bang after which energy conservation holds universally is to be replaced by an omnipresent and omnitemporal medium of decoherence of the dark and nonlocal phase into the light and local phase. The former is only an integral image of the latter and borrowed in fact rather from religion than from science. Physical, methodological and proper philosophical conclusions follow from that paradigm shift heralded by this year’s Nobel Prize in physics. For example, the scientific theory of thinking should originate from the dark phase of the universe, as well: probably only approximately modeled by neural networks physically belonging to the light phase thoroughly. A few crucial philosophical sequences follow from the break of Pauli’s paradigm: (1) the establishment of the “dark” phase of the universe as opposed to its “light” phase, only to which the Cartesian dichotomy of “body” and “mind” is valid; (2) quantum information conservation as relevant to the dark phase, furthermore generalizing energy conservation as to its light phase, productively allowing for physical entities to appear “ex nihilo”, i.e., from the dark phase, in which energy and time are yet inseparable from each other; (3) reversible causality as inherent to the dark phase; (4) the interpretation of gravitation only mathematically: as an interpretation of the incompleteness of finiteness to infinity, for example, following the Gödel dichotomy (“either contradiction or incompleteness”) about the relation of arithmetic to set theory; (5) the restriction of the concept of hierarchy only to the light phase; (6) the commensurability of both physical extremes of a quantum and the universe as a whole in the dark phase obeying quantum information conservation and akin to Nicholas of Cusa’s philosophical and theological worldview. Two influential approaches to conceptualising the relationship between public and private law have suggested that the distinction between them should be abandoned. The first, as exemplified by Oliver, suggests that the distinction should be abandoned in favour of fusion based on the notion of commonality. The second, as exemplified by Teubner, rejects fusion, arguing for the replacement of the distinction with a concept capturing the multi-dimensional complexity of law in multiple social contexts: `polycontexturality'. This article focuses primarily on exploring (...) conceptual puzzles presented by Oliver's `commonality thesis', and argues for a reconceptualisation of the relationship between public and private law as multi-layered. Monolithic and rigidly binary concepts alike should be replaced by a complex set of relationships – a position broadly supportive of Teubner's. However, it is argued that the relationships between public and private law are to be seen as existing on a spectrum, or even on an overarching meta-spectrum, in which the existence of distinctive `archetypal conceptual paradigms' influence as `meta-spectrum extremities'. This presents a limited caveat to Teubner's thesis. I suggest that explicit theoretical attention to both the implications of polycontexturality and the existence of the archetypal conceptual paradigms as meta-spectrum extremities might avoid occluding important distinctions and nuances within a fusion that tends illegitimately to subsume private law within a public law paradigm. Such an analysis, I argue, could enhance the coherence of the law in complex, multi-dimensional cases at the troubled borderline between public and private law. (shrink)

This collection of essays explores the metaphysical thesis that the living world is not made up of substantial particles or things, as has often been assumed, but is rather constituted by processes. The biological domain is organised as an interdependent hierarchy of processes, which are stabilised and actively maintained at different timescales. Even entities that intuitively appear to be paradigms of things, such as organisms, are actually better understood as processes. Unlike previous attempts to articulate processual views of biology, which (...) have tended to use Alfred North Whitehead’s panpsychist metaphysics as a foundation, this book takes a naturalistic approach to metaphysics. It submits that the main motivations for replacing an ontology of substances with one of processes are to be found in the empirical findings of science. Biology provides compelling reasons for thinking that the living realm is fundamentally dynamic, and that the existence of things is always conditional on the existence of processes. The phenomenon of life cries out for theories that prioritise processes over things, and it suggests that the central explanandum of biology is not change but rather stability, or more precisely, stability attained through constant change. This edited volume brings together philosophers of science and metaphysicians interested in exploring the consequences of a processual philosophy of biology. The contributors draw on an extremely wide range of biological case studies, and employ a process perspective to cast new light on a number of traditional philosophical problems, such as identity, persistence, and individuality. Replacing logical coherence by effectiveness as criteria of rationality, Gigerenzer et al. show that simple heuristics can outperform comprehensive procedures (e.g., regression analysis) that overload human limited information processing capacity. Although their work casts long overdue doubt on the normative status of the Rational Choice Paradigm, their methodology leaves open its relevance as to how decisions are actually made.

To talk about simple concepts presupposes that the notion of concept has been aptly explicated. I argue that a most adequate explication should abandon the set-theoretical paradigm and use a procedural approach. Such a procedural approach is offered by Tichý´s Transparent Intensional Logic (TIL). Some main notions and principles of TIL are briefly presented, and as a result, concepts are explicated as a kind of abstract procedure. Then it can be shown that simplicity, as applied to concepts, is well (...) definable as a property relative to conceptual systems, each of which is determined by a finite set of simple (‘primitive’) concepts. Refinement as a method of replacing simple concepts by compound concepts is defined. (shrink)

The purpose of this study is to identify and explain a religious paradigm in Targum Qohelet (TgQoh). Targum Qohelet is dated to a period between 500 CE and 1101 CE. This study concludes that the most probable setting for this Targum was the beit midrash (the house of study). A paradigmatic research approach is used to identify the range of translation components to explain the translation method employed in TgQoh and the rationale behind it. This research approach reveals how (...) the translator(s) used their interpretative ability to create a completely different thought-world when compared with the original Hebrew Text. Various subparadigms emerge as a network of connected religious beliefs to form a cogent systematic rabbinic theology of a perfect world order to replace the pessimism of the Hebrew base text. The Aramaic version reflects a complete solution to the existential problems raised by Biblical Qohelet. It seeks to provide humankind with guidelines for creating a ‘perfect world’ both on earth and in the afterlife. The use of a paradigmatic analysis based on the concept of a ‘perfect world’ provides an ideal model for analysing the translation strategy of TgQoh and understanding its method of rendering. Contribution: The application of paradigmatic methodology bridges the gap between the relatively secular nature of the Hebrew version of Qohelet (Ecclesiastes) and the overwhelmingly and inescapable theological forms of the Aramaic targum. The paradigms in the Aramaic translation identify how the targum applied rabbinic ideology to explain the meanings that lies behind the original Hebrew text of Qohelet. The paradigms, when taken together reveal how the cynical nature of Hebrew Qohelet was changed into a rabbinical guide for righteous living, here described as ‘perfect world’. (shrink)

Notions of uniform and gradual evolution have been replaced in some circles by biological and paleontological models that postulate that periods of rapid change punctuate long periods of evolutionary stasis. This new theory, called punctuated equilibria (or PE for short), may have implications for paradigms in scholarly disciplines other than the sciences. Whereas old evolutionary models exerted great influence upon historians, sociologists, anthropologists, and students of religion for more than a century, the new model may provide heuristic paradigms for research (...) that correlate more adequately with the current observations of scholars. We therefore provide suggestions for deployment of this new scientific paradigm in history and anthropology. In particular, this model can explain the rise of the Israelite state and the religious ethos in the Hebrew Bible, two major concerns of today's socioscientific study of biblical materials. Discusses the conditions of possibility for intercultural and comparative philosophy, and for crosscultural communication at large. This innovative book explores the preconditions necessary for intercultural and comparative philosophy. Philosophical practices that involve at least two different traditions with no common heritage and whose languages have very different grammatical structure, such as Indo-Germanic languages and classical Chinese, are a particular focus. Lin Ma and Jaap van Brakel look at the necessary and not-so-necessary conditions of possibility of interpretation, comparison, and other forms (...) of interaction and how we can speak of similarities and differences in this context. The authors posit that it is necessary to dissolve the question of universalism versus relativism by replacing the ideal language paradigm with a paradigm of family resemblances and that it is not necessary to share a common language to engage in comparison. The colonial period of Christian expansion was plagued by practices and systems that exploited non-European indigenous populations for the endgame interests of enriching the treasuries of European imperial powers and promoting Eurocentrism. Anderson Jeremiah has written an important paper that explains how the concepts of race and the caste system in South Asia functioned in the context of colonial Christian expansion, and argues that postcolonial Christian actors should prioritise intentionally replacing dehumanising forms of missional activity with the four ethically decolonising (...) paradigms of radical resistance, solidarity, hospitality, and joy in service of promoting racial justice in future global society. My response focuses on Jeremiah's ethical paradigm of hospitality, and engages with the challenge of applying this paradigm. In order for this hospitality paradigm to be applied in ways that lead to optimal missional outcomes, it must answer several questions, especially those linked to the existence of contesting hospitality-focussed frameworks and sociocultural attitudes endorsed by contemporary Christian agents and communities whose norms of hospitality appear radically different. The terms “paradigm” and “paradigm shift” originated in “The Structure of Scientific Revolutions” by Thomas Kuhn. A paradigm can be defined as the generally accepted concepts and practices of a field, and a paradigm shift its replacement in a scientific revolution. A paradigm shift results from a crisis caused by anomalies in a paradigm that reduce its usefulness to a field. Claims of paradigm shifts and revolutions are made frequently in the neurosciences. (...) In this article I will consider neuroscience paradigms, and the claim that new tools and techniques rather than crises have driven paradigm shifts. I will argue that tool development has played a minor role in neuroscience revolutions. (shrink)

Should evolution replace rational choice as the guiding paradigm for game theory? Evolutionary game theory provides an intriguing perspective from which to critique the hyper-rational assumptions of classical economic game theory. In contrast to economic game theory, evolutionary game theory is better suited to descriptive rather than normative domains. It is argued that a pluralism of paradigms holds the best promise for theoretical innovation in game theory.

In the critical assessment of the rise of what Jameson has termed the modern centred subject … the lived experience of individual consciousness as a monadic and autonomous centre of activity, significant attention has been devoted to the impact of the institutions of the late eighteenth century ‘bourgeois cultural revolution’ such as the family and the school. Less consideration has been given in this history of regulated subjectivity to the emergence within key centres of cultural production of the discourse of (...) maternity and its lasting consequences for the understanding and representation of the mother–child bond as a matrix of both affectional relations and infant development. The late eighteenth century reconfiguration of the family as, in Jameson's words a private space within the nascent public sphere of bourgeois society intensified the ‘separation of the spheres’ begun in the early modern period and further formalised the zoning of the domestic experience as the defining site of emotional specialisation and individual growth. In the culture of early romanticism, this differentiation of domestic roles elevated children as the primary objects of a new regime of intergenerational care, replacing disciplinary control with intimate nurture and valorising a particular construction of motherhood as the ethical base of domestic piety and social stability beyond even the semantic reach of reason. Understanding the cultural processes by which this important ideological shift reshaped the paradigm of parent–child relations in industrial society – radiating beyond the realm of the family into the wider systems of childcare and education – enables us better to discern its continuing influence on perceptions of family life and motherhood today and to critically evaluate its potential contribution to changing conceptions of the place of the family in contemporary democratic society.
