El presente artículo tiene el objetivo de analizar el libro de viajes de uno de los corresponsales que el periódico británico The Morning Chronicle envió para cubrir la Primera Guerra Carlista. John Moore, Poco Mas, como hicieron muchos otros periodistas contemporáneos, utiliza sus notas tomadas en el campo de batalla y sus reflexiones para publicar, años más tarde, una visión personal del conflicto que, además, refleje las características de un país y una sociedad diferente a la propia, con sus peculiares (...) costumbres y su reacción ante un conflicto que estaba mermando su población, agotando sus recursos y destruyendo su valiosísimo acervo cultural. The debate concerning the so-called U.S. Health and Human Services Contraception Mandate has been adequately framed, in the academic field, within the traditional ethical doctrine on cooperation with evil. This principle will allow us to conclude whether employers may ethically comply with the onerous existing law or not. The discussion has been quite heated, because the practical conclusions authors have reached vary widely, depending on which interpretation of the theory they rely on. In this paper, some of these explanations are (...) addressed and analyzed from the standpoint of the Thomistic theory of action, which is now the most common point of view. This work concludes that, although the Contraception Mandate will most likely be repealed by the current U.S. administration, as things once stood, compliance with it may have been ethically licit in some cases. This book explores secession from three normative disciplines: political philosophy, international law and constitutional law. The author first develops a moral theory of secession based on a hypothetical multinational contract. Under this contract theory, injustices do not determine the existence of a right to secede, but the requirements to exercise it. The book’s second part then argues that international law is more inclined to accept and advance a remedial right approach to secession. Therefore, justice as multinational fairness is to be (...) fully institutionalized under the constitutional law of liberal democracies. The final part proposes constitutionalizing a qualified right to secede with the aim of fostering recognition and accommodation of national pluralism as well as cooperation and compromise between majority and minority nations. This text explores a set of key concepts in Marxist theory as developed and read by Lacan, demonstrating links and connections between Marxist thought and Lacanian practice. The positions of authors who are critical of the notion of human rights, like Michel Villey and Alasdair MacIntyre, as well as that of those who try to justify their existence and explain their nature, like Jacques Maritain, John Finnis, and others, are carefully explained and evaluated. This book is the first to deal (...) in detail with this contemporary discussion and therefore represents an important contribution to the bibliography on the philosophy of human rights, as well as to the bibliography on the Thomistic tradition. In this article we discuss the political thought of the French philosopher Simone Weil. In particular, we analyse two fundamental elements of her critique of Marxism, namely her reflections on the phenomenon of power and her critique of the theory of the unlimited development of productive forces. We do so in dialogue with two of the pioneers of the ecosocialist critique of Marx in Spain: Manuel Sacristán and Francisco Fernández Buey, both readers of Weil. Este artículo presenta un acercamiento a la noción de “cultura” usando el concepto de “habitualidad”, que proviene de la filosofía genética de Husserl 1. Se explicará como Husserl construye sobre él la noción de “mundo-hogar” para definir lo que es una cultura, insistiendo en el problema de la “extrañeza” que opera dos culturas diferentes. Finalmente estas nociones se usarán para entender el tipo de relación entre dos mundos-hogar en el caso de un conflicto intercultural.This paper presents an approach to the (...) notion of “culture” using the concept of“habituality”, which comes from Husserl´s genetic philosophy. It will be explained also how Husserls builds upon it the notion of “home-world” to define what is a culture, emphasizing the problem of the “strangeness” that operates between two diferent cultures. The dialogical principle, the organizational recursivity principle and the hologramatical principle, are the three principles can help us to think the complexity. The first one allows us to think how the duality can stay in the breast of the unit. The second lead us to the understanding of how the products and the effects are, at the same time, causes and products of what produces them. The third, and perhaps the most beautiful of three, refers that the part itself is (...) not only in the everything but rather the everything is also in the part. Three images can help us to clarify these principles: first, the process of mating of the hens produces hens, which produces the process of mating of the hens; second, the hens put eggs of where to come out more hens than put more eggs; third, a hen egg is a hen in potential. The configuration of a psychology of complexity is related with the application of this principles for the analysis of the social reality in several addresses: a) to win complexity in the explanatory and descriptive environments, opening diverse ways of thinking and novel investigation lines, accepting that the theories of the complexity have been related inevitably with the sciences of the behavior; b) to understand that the daily life can be studied from four optics that deserve recognition in the epistemological level of the social psychology: fuzzyness, catastrophic, fractal and chaotic; c) to recognize that reality demands scientific explanations complex and leave the simplicity; d) to renovate the psychology from their base and not from the obedience and the academic subjection. Se examinan las diversas modalidades de la nada como casos de pérdida del sentido y falta de consumación del conocimiento: la nada como noúmeno y su relación con el fenómeno, así como la conexión trascendental de ambos. Aunque la nada pone en jaque al concepto de sentido, este se encuentra supuesto antes de todo tipo de pregunta por el ser, y se constituye en el trasfondo de las condiciones trascendentales que posibilitan el conocimiento.

Este artículo explora la posibilidad de que las constituciones contemporáneas puedan ser interpretadas de manera armónica, es decir, irenista. Las objeciones más importantes a las que una concepción irenista de la constitución debería hacer frente son las objeciones de la incoherencia y de la inestabilidad. La primera afirma que la armonía no es posible porque se dan conflictos normativos entre los diversos componentes de las constituciones contemporáneas. La segunda afirma que no es posible una armonía de tipo universalista. Una concepción (...) irenista con visos de ser plausible debería poder ser capaz de dar una respuesta a cada una de estas objeciones. (shrink)

Según una sofisticada versión del llamado rule of law, las reglas del derecho deben ser generales, en el sentido de que deben regular clases de casos, no situaciones particulares. La posibilidad de prever cuáles van a ser las decisiones jurídicas depende, entre otras cosas, de este carácter general de las normas. Pero junto a la previsibilidad y certeza que aporta, el carácter general de las reglas puede tener un reverso negativo: en algunas ocasiones, cuando se aplican a algunas circunstancias particulares, (...) lo que parecía funcionar de forma satisfactoria en la teoría o en abstracto, proporciona soluciones inadmisibles (inadmisibles con arreglo a alguna concepción de la justicia). Esos casos son conocidos como casos recalcitrantes. En este artículo propongo una manera de entender el razonamiento jurídico-práctico que mitiga ese reverso negativo de las reglas generales conservando buena parte de la certeza que aportan. (shrink)

Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

concepts typically are defined in terms of lacking physical or perceptual referents. We argue instead that they are not devoid of perceptual information because knowledge of real-world situations is an important component of learning and using many abstract concepts. Although the relationship between perceptual information and abstract concepts is less straightforward than for concrete concepts, situation-based perceptual knowledge is part of many abstract concepts. In Experiment 1, participants made lexical decisions to abstract words that were preceded by related and unrelated (...) pictures of situations. For example, share was preceded by a picture of two girls sharing a cob of corn. When pictures were presented for 500 ms, latencies did not differ. However, when pictures were presented for 1,000 ms, decision latencies were significantly shorter for abstract words preceded by related versus unrelated pictures. Because the abstract concepts corresponded to the pictured situation as a whole, rather than a single concrete object or entity, the necessary relational processing takes time. In Experiment 2, on each trial, an abstract word was presented for 250 ms, immediately followed by a picture. Participants indicated whether or not the picture showed a normal situation. Decision latencies were significantly shorter for pictures preceded by related versus unrelated abstract words. Our experiments provide evidence that knowledge of events and situations is important for learning and using at least some types of abstract concepts. That is, abstract concepts are grounded in situations, but in a more complex manner than for concrete concepts. Although people's understanding of abstract concepts certainly includes knowledge gained from language describing situations and events for which those concepts are relevant, sensory and motor information experienced during real-life events is important as well. Various modes of non-being are examined as (...) cases of loss of sense and as a lack of consummation of knowledge: non-being as noumena and its relationship with the phenomena, as well as the transcendental connection between them. Although non-being makes the concept of sense doubtful, it is presupposed before any kind of question regarding being and it is constituted in the background which belongs to the transcendental conditions which make knowledge possible. A script concordance test was developed as an innovative tool for assessing ethical reasoning ability. An SCT of 12 medical ethical vignettes were constructed from the UNESCO Casebook on Human Dignity and Human Rights. The vignettes were reviewed by a panel of 15 medical experts before administration to a panel of 18 clinicians. The clinician’s answers were used to constitute the scoring key. The SCT was then administered to first and final year medical students. Data were analysed using SPSS. Internal (...) consistency was assessed using Cronbach’s alpha. SCT performance was tested for association with sex, year of study and race by comparing the mean SCT scores between categories within each variable. Internal consistency as measured by Cronbach’s alpha values, ranging from 0.597 to 0.902, indicated high intra-vignette reliability for 10 of the vignettes. Inter-vignette reliability was high at 0.797. Mean SCT scores were not significantly different between students of different gender, year of study and ethnicity. However, each vignette was able to distinguish between overall poor and good test performers. The SCT was able to differentiate between students with varying degrees of ethical reasoning ability. Early Christian writers defined idolatry around the monotheistic distinction between proper worship of the creator and vain worship of the creature, which they had inherited from Hellenistic Judaism. Despite the remarkable consensus about the validity of this theological analysis, the medieval synthesis was under severe strain throughout the early modern period, mainly because of the concept's extended range of application in the new contexts of religious controversy. In all these cases, deciding what practices constituted idolatry was open to debate. By (...) the eighteenth century, libertine writers could retain the concept of superstition at the expense of that of idolatry, which Voltaire (himself an anti-Christian deist) denounced as meaningless. En cada contexto son diversas las formas de ser niña y niño. El objetivo de este artículo es reflexionar sobre los significados que implica el “ser migrante” para las niñas y los niños peruanos en Chile, considerando los procesos de integración social desde la perspectiva generacional y cómo cambia el concepto de infancia en contextos transnacionales. Mediante observación participante y entrevistas semiestructuradas con 16 niñas y niños peruanos, de 9 a 16 años de edad, se concluye que existe cierta idealización (...) de las formas de expresión de la infancia en Perú. Mientras que en Chile, las niñas y los niños migrantes sienten que las diferencias con sus pares chilenos se transforman en relaciones de desigualdad, conflicto y negociación. Además, la inserción escolar promueve la integración a determinados modelos de infancia construidos normativamente desde el mundo adulto y chileno, que dejan poco espacio para la diversidad cultural de las infancias transnacionales.
