Libertarian philosophy asserts that only the initiation of physical force against persons or property, or the threat thereof, is inherently illegitimate. A corollary to this assertion is that all forms of speech, including fraudulent advertising, are not invasive and therefore should be considered legitimate. On the other hand, fraudulent advertising can be viewed as implicit theft under the theory of contract: if a seller accepts money knowing that his product does not have some of its advertised characteristics, he acquires the (...) property title to the customer’s money without voluntary consent, which is theft. The balance between these two logical extensions of property rights—the right of free speech and the right of contract—lies somewhere in the area of communication philosophy, and can be explained through understanding the role of communication in human interactions. Advertising is a form of communication that may convey important information about the conditions of the proposed contract. These conditions are expressed in particular words that may have different meanings in different circumstances. Therefore to determine whether a particular example or “misinterpretation” is mere sophistry or a type of fraud, the judicial system has to approach each issue on a case-by-case basis. The border between legal and illegal should be determined by precedents and by expectations based on commonly accepted definitions of terms—what people commonly understand by the words and other forms of communication they use. EM seus últimos anos, o filósofo se dedicava à elaboração de uma trilogia da qual este livro seria o primeiro volume. INfelizmente, apenas o primeiro volume foi deixado em estado de manuscrito, não havendo indicações sobre os demais. O Leitor verá neste livro incompleto, editado e organizado por Vladimir Safatle, o movimento vivo de uma experiência de pensamento em plena operação. These surviving spouses, partners, relatives, and friends, in addition to coping with the death of a loved one, must also deal with the loved one's decision to die, thus severing the relationship. C. Rationale, aims and objectives Given the increasing prevalence of cataract and demand for cataract extraction surgery, patients must often wait to undergo this procedure. We validated a previously developed priority scoring system in terms of clinical variables, pre-intervention health status, appropriateness of surgery and gain in visual acuity (VA) and health-related quality of life (HRQoL).Methods Explicit prioritization criteria for cataract extraction created by a variation of the Research and Development (RAND) and University of California Los Angeles appropriateness methodology were retrospectively (...) applied to a prospective cohort of 5257 patients on waiting lists to undergo cataract by phacoemulsification at 17 hospitals in Spain. Demographic data, clinical data and data related to surgical technique were collected by trained ophthalmologists. Patients were evaluated by their ophthalmologist before the intervention and 6 weeks afterward. They also completed, by mail, the Visual Function Index (VF-14) before the intervention and 3 months afterward.Results High-priority patients experienced greater improvement in VA and HRQoL than those classified as intermediate or low-priority (P < 0.0001), even after adjusting by VA and the VF-14 score at baseline. The time to intervention was the same for high-priority patients as it was for intermediate and low-priority patients.Conclusions The priority score we developed identified patients most likely to experience the greatest improvements from cataract extraction. Use of this tool could provide a fairer and more rational way to prioritize patients for cataract extraction. (shrink)

Resumen Este artículo muestra que la pintura de Tiziano contiene en el fondo un esquema dialéctico de tensión entre elementos opuestos: jovial/trágico, clásico/cristiano, puñal/refugio. Esta tensión alimenta la intersección de estructuras significativas que caracteriza a toda obra de arte. Esta dialéctica explica el sentido último que tiene la pintura para Tiziano. Centramos esta dialéctica en la obra Desollamiento de Marsias, obra que enseña que la pintura, el arte en general, para Tiziano abre heridas, es un puñal, pero también es un (...) abrigo donde el que refugiarnos del horror del mundo. Abstract This article shows that Titian's painting contains at its core a dialectical scheme of tension between opposing elements: jovial/tragic, classical/christian, dagger/refuge. This tension feeds the intersection of meaningful structures that characterize every work of art. This dialectic explains the ultimate meaning of painting for Titian. We focus this dialectic on the work The Flaying of Marsyas, a work that teaches that painting, art in general, for Titian opens wounds, it is a dagger, but it is also a shelter in which to take refuge from the horror of the world. En este artículo analizo la interpretación de Hegel de la filosofía política platónica (particularmente la República) en determinados pasajes de dos obras puntuales: los Fundamentos de la filosofía del derecho y las Lecciones sobre Platón. Considero dos ejes específicos de análisis: la propiedad privada y la libertad subjetiva. El objetivo del artículo es señalar la relación que Hegel establece con Platón o, al menos, con República. Muestro que, en realidad, en este diálogo existen ciertos matices con respecto a los dos (...) ejes mencionados; estos matices implican diferencias de análisis respecto de la lectura hegeliana. In this paper, I respond to what I have called an epistemological objection to a dialetheist approach to the doctrine of the Incarnation, of which one example is Beall’s contradictory Christ. I discuss Anderson’s book Paradox in Christian theology, in which the author claims to account for the rationality of the doctrine of the Incarnation as a merely apparently contradictory doctrine, and I present my model, based on Anderson’s model, according to which the doctrine has the possibility to be rational (...) by understanding it as genuinely contradictory. I show that this model fits perfectly well with the criteria that, according to Anderson, any model for the rationality of a paradoxical doctrine should meet. Beall does not address the problem of the rationality of the doctrine in his works about the contradictory Christ, and he asserts that he is not interested in it. However, I think that if he wants to make his theory more robust, less suspicious, and more convincing for theologians, philosophers, and ordinary people, he should consider this problem. (shrink)

Out of the broad variety of Cusanus' work, this book discusses six of his writings, careful not to isolate them from the whole of his work. It instead presents them against the maturation of Cusanus' thinking as it developed from his first sermons up to his shortest philosophical text De apice theoriae. The texts in question are De docta ignorantia, De coniecturis, Idiota de mente, De beryllo, Trialogus de possest and De apice theoriae. In the search for God, or rather (...) in Cusanus' lifetime eff orts to have his spirit touch the fi rst principle and the basis of all things, new perspectives on the world and man within would open up for Cusanus. Respecting this basic intention of Cusanus' thinking, the author primarily deals with Cusanus' ontotheological (metaphysical) claims and, in their context, turns his attention to the cosmological, or anthropologico-gnoseological opinions. In my comment on Katerina Ierodiakonou’s paper, I outline my understanding of the programme of De anima and how it bears on Aristotle’s discussion of the transparent in De anima 2.7, in contrast with his discussion of the transparent in De sensu 3. I then explore Aristotle’s notion of transparency and sketch an alternative to Ierodiakonou’s interpretation of Aristotle’s views as to how colours are generated in physical objects. At the end, I raise two objections to Alexander’s interpretation of the (...) transparent as discussed by Ierodiakonou. (shrink)

Este artigo discute como os clipes Mandume, Boa Esperança e Eminência Parda do rapper de Emicida, realizam um retorno à ferida colonial e apontam opacidades históricas, opressões e exclusões daí derivadas, como forma de conduzir a uma releitura afetiva e resistente do/no tempo e instigar ações estéticas de re-existência. Para isso, realizamos uma análise audioverbovisual dos clipes procurando observar a construção desse discurso a partir de três categorias analíticas: retorno memorialístico, corporalidade desumanizada e vida livre da violência e da morte.

This paper is a response to Haze’s brief argument for the falsity of the theory that instantial terms refer arbitrarily, proposed by Breckenridge and Magidor in 2012. In this paper, I characterise instantial terms and outline the theory of arbitrary reference; then I reconstruct Haze’s argument and contend that it fails in its purpose. Haze’s argument is supposed to be a _reductio ad absurdum:_ according to Haze, it proves that a contradiction follows from the most basic tenets of the theory (...) of arbitrary reference. I will argue, however, that the contradiction in question follows not from these tenets, but from the surreptitious use that Haze makes of a self-referential expression. I conclude, consequently, that Haze’s argument is nothing more than an illustration of the well-known fact that self-referential expressions produce paradoxical results. (shrink)

Traxler, Pickering, and Clifton found that ambiguous sentences are read faster than their unambiguous counterparts. This so-called ambiguity advantage has presented a major challenge to classical theories of human sentence comprehension because its most prominent explanation, in the form of the unrestricted race model, assumes that parsing is non-deterministic. Recently, Swets, Desmet, Clifton, and Ferreira have challenged the URM. They argue that readers strategically underspecify the representation of ambiguous sentences to save time, unless disambiguation is required by task demands. When (...) disambiguation is required, however, readers assign sentences full structure—and Swets et al. provide experimental evidence to this end. On the basis of their findings, they argue against the URM and in favor of a model of task-dependent sentence comprehension. We show through simulations that the Swets et al. data do not constitute evidence for task-dependent parsing because they can be explained by the URM. However, we provide decisive evidence from a German self-paced reading study consistent with Swets et al.'s general claim about task-dependent parsing. Specifically, we show that under certain conditions, ambiguous sentences can be read more slowly than their unambiguous counterparts, suggesting that the parser may create several parses, when required. Finally, we present the first quantitative model of task-driven disambiguation that subsumes the URM, and we show that it can explain both Swets et al.'s results and our findings. (shrink)

Concern with elective-death decisions usually focuses on individuals' competence and understanding of their situations and prospects. If problematic influences on individuals are considered, they almost invariably have to do with matters such as depression and the effects of medication. Too little attention is paid to how individuals, as subjects, are products of both external cultural and social influences on them, and of internal efforts and needs that determine their subjectivity.
