In this article, we comment upon and provide an arts-informed example of an emotive-focused reflection of a health care practitioner. Specifically, we use poetry and photographic imagery as tools to un-earth practitioners’ emotions within agonizing and traumatic clinical encounters. In order to recognize one’s own humanness and authentically engage in the art of medicine, we immerse ourselves in the first author’s poetic and photographic self-reflection. The poem and image are intended to inspire interpretation and meaning based on the reader’s own (...) professional and/or personal context. The last line of the poem is “I take off the gloves. A discussion concerning whether to conceive Artificial Intelligence systems as responsible moral entities, also known as “artificial moral agents”, has been going on for some time. In this regard, we argue that the notion of “moral agency” is to be attributed only to humans based on their autonomy and sentience, which AI systems lack. We analyze human responsibility in the presence of AI systems in terms of meaningful control and due diligence and argue against fully automated systems in medicine. With (...) this perspective in mind, we focus on the use of AI-based diagnostic systems and shed light on the complex networks of persons, organizations and artifacts that come to be when AI systems are designed, developed, and used in medicine. BackgroundUnder COVID-19 pandemic, many organizations developed guidelines to deal with the ethical aspects of resources allocation. This study describes the results of an argument-based review of ethical guidelines developed at the European level. It aims to increase knowledge and awareness about the moral relevance of the outbreak, especially as regards the balance of equity and dignity in clinical practice and patient’s care. MethodAccording to the argument-based review framework, we started our research from the following two questions: what are the ethical (...) principles adopted by the ethical guidelines produced at the beginning of the COVID-19 outbreak related to resource allocation? And what are the practical consequences in terms of 'priority' of access, access criteria, management of the decision-making process and patient care?ResultsTwenty-two ethical guidelines met our inclusion criteria and the results of our analysis are organized into 4 ethical concepts and related arguments: the equity principle and emerging ethical theories; triage criteria; respecting patient’s dignity, and decision making and quality of care.ConclusionFurther studies can investigate the practical consequences of the application of the guidelines described, in terms of quality of care and health care professionals’ moral distress. A Sociedade da Transparência, o controle psicopolítico, a digitalização e a crise da democracia são temas que ressurgem associados ao fenômeno do aprisionamento digital nas redes. Fenômeno em que se debatem entre si a informação produzida pela dinâmica da transparência e o holismo do Big Data. (...) We use hyperbolic towers to answer some model-theoretic questions around the generic type in the theory of free groups. We show that all the finitely generated models of this theory realize the generic type $p_{0}$ but that there is a finitely generated model which omits $p^{}_{0}$. We exhibit a finitely generated model in which there are two maximal independent sets of realizations of the generic type which have different cardinalities. Argumentation theorists often disagree about which scheme best represents a given type of argument. Unfortunately, authors sometimes become involved in fruitless pseudo-agreement because they fail to perceive that their supposedly competing schemes are means for achieving different practical or theoretical goals. This paper explains some of the different purposes that an argument scheme may serve, and it indicates how the relevant type of pseudo-disagreement may be avoided.

The paper provides a qualified defence of Bruce Waller’s deductivist schema for a priori analogical arguments in ethics and law. One crucial qualification is that the schema represents analogical arguments as complexes composed of one deductive inference but also of one non-deductive subargument. Another important qualification is that the schema is informed by normative assumptions regarding the conditions that an analogical argument must satisfy in order for it to count as an optimal instance of its kind. Defenders and opponents of judicial review under charters of rights often share political ideals, and yet disagree deeply on the best means to pro- mote them or on the proper way to balance them in the event of conflict. In his most recent book, Wil Waluchow attempts to provide a theory of judicial review which deals adequately with the popular ideals of stability and adaptability. The cornerstone of his argument is the notion of community morality - that which enables constitutional (...) adjudicators to develop charter law (adaptability) while remaining loyal to democratic and rule of law principles (stability). The aim of this paper is to offer a critique of the notion of community morality; in particular, the aim is to challenge the assumption that the morality of the members of modern plural societies is as uniform as Waluchow’s theory requires it to be.Resumen:Los defensores y oponentes de la figura del judicial review que se lleva a cabo a través de la defensa de las garantías individuales en ocasiones comparten puntos de vista en relación con los ideales políticos, sin embargo, existen profundos desacuerdos en cuanto a la mejor forma de promocionarlos o en cuanto a la manera apropiada de decidir casos concretos en casos de conflicto. En su más reciente libro, Wil Waluchow intenta proporcionar una teoría del judicial review que atienda adecuadamente los ideales comunes de estabilidad y adaptabilidad. El punto medular de su argumento es la noción de la moralidad de la comunidad—aquella que permite a los jueces constitucionales desarrollar las garantías y derechos (adaptabilidad) mientras que se continúa leal a los principios de democracia y Estado de derecho (estabilidad)—. BackgroundThis study aims to quantitatively and qualitatively evaluate the activities of a Bioethics Unit (BU) 5 years since its implementation (2016–2020). The BU is a research unit providing empirical research on ethical issues related to clinical practice, clinical ethics consultation, and ethical education for health care professionals (HPS).MethodsWe performed an explanatory, sequential, mixed-method, observational study, using the subsequent qualitative data to explain the initial quantitative findings. Quantitative data were collected from an internal database and analyzed by descriptive analysis. Qualitative evaluation (...) was performed by semi-structured interviews with 18 HPs who were differently involved in the BU’s activities and analyzed by framework analysis.ResultsQuantitative results showed an extensive increment of the number of BU research projects over the years and the number of work collaborations with other units and wards. Qualitative findings revealed four main themes, concerning: 1. the reasons for contacting the BU and the type of collaboration; 2. the role of the bioethicist; 3. the impact of BU activities on HPs, in terms of developing deeper and more mature thinking; 4. the need to extend ethics support to other settings. Overall, our results showed that performing both empirical bioethics research and more traditional clinical ethics activities at the same unit would produce an impetus to increase collaboration and spread an 'ethical culture' among local HPs.ConclusionsOur findings contribute to a growing body of literature on the models of clinical ethics support services and the role of empirical research in bioethics internationally. They also prepare the ground for the implementation of a multidisciplinary Clinical Ethics Committee (CEC) that aims to support the BU’s ethics consultation service within the local context. Anglo-American authors have paid little attention to a subtle distinction that has important jurisprudential implications. It is the distinction between sources of law and the legal norms which can be derived from sources by means of interpretation. The distinction might also be rendered as a threefold one, separating sources of law from legal norms and both of these from that which mediates their relation, namely, methods of legal interpretation. From Gadamer's Habilitation thesis, “Plato’s dialectical ethics. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will become Gadamer's (...) philosophical hermeneutics, fully emancipated from Heideggerian tutelage. Advance care planning (ACP) is considered a pivotal aid in the decision‐making process, especially for many people living with dementia, who inevitably will lose the capacity to make decisions at the end of life. In Italy, ACP has been recently regulated by law 219/2017, leading to the investigation of how physicians deal with ACP in dementia. In order to comprehend the perception of physicians who provide care for patients with dementia regarding ACP and to describe their difficulties and needs, this (...) study presents the results of a qualitative research study performed within a local health authority in northern Italy. Data were collected by semi‐structured interviews with 11 physicians dealing with patients with dementia and were analysed using interpretative phenomenological analysis. Four superordinate themes were identified, describing both the difficulties and challenges perceived by physicians in performing shared ACP in their daily activities. This study demonstrates that physicians experience troubles synchronizing the time of shared ACP with the more rapid development of dementia. Results also suggest that further training about communication on ACP is urgently required to ease the implementation of shared ACP. A broader involvement of institutions and other professionals is also important in spreading ACP among healthcare institutions. (shrink)

“Deductivism” is a broad label for various theories that emphasize the importance of deductive argument in contexts of rational discussion. This paper makes a case for a very specific form of deductivism. The paper highlights the dialectical importance of advancing deductively valid arguments in natural-language reasoning. Sections 2 and 3 explain the various forms that deductivism has taken. Section 4 makes a case for a particular form of deductivism. Section 5 discusses the value of deductive argument in law. I claim that these arguments, unlike modern sceptical arguments, are supposed to establish mere counterfactual rather than epistemic possibilities. Ordinary arguments from authority have the following structure: A says p; A is authoritative on such things; so p. Legal actors use such arguments whenever they ground their decisions on the sheer “say-so” of legislators, judges, scholars, expert witnesses, and so on. This paper focuses on arguments appealing to the authority of scholars, “doctrinal” or “dogmatic” legal scholars in particular. Appeal to doctrinal authority is a puzzling feature of legal argumentation. In what sense are doctrinal scholars “authorities”? Is p, as (...) advanced by a scholar, descriptive or prescriptive? In the current debate in political philosophy, the so-called communitarian thinkers intend to offer an alternative to the dominant liberal thought. The ideal of ethicalcommunity as way of life in society in which intersubjective relationships are ruled by laws conceived as public laws, reintroduces the question of virtue in the scope of social and political life, with the requirement of an ethical style of doing politics.

Four hundred seventy-six nuclear power plants are in operation or under construction around the world. Are concepts for designing and operating plants safely sufficient? Conventional approaches are premised on expectations of predictability and control of radiation release and on assumptions that plant operations are closed systems. Field observations in the industry find, however, that the periodic necessity to refuel, test safety equipment, and continuously upgrade plant designs introduces challenges to control not originally calculated. The social and cultural contexts of markets, (...) regulation, and work systems create additional contingencies. In this dynamic environment, reactor operations produce invaluable data about the states of the entire technology and organizational system. Rereading these dynamics as "experiments" suggests an alternative epistemol ogy that synthesizes science's values of doubt, discovery, and documentation with engineering's values of efficiency, optimization, and problem solving. This redefines plant-based risk handlers as ethologists, geologists, and anthropologists of an ecology of visible and invisible hazards. (shrink)

O principal ponto de desacordo sobre a abordagem kantiana do problema da verdade é se ela pode ser compreendida nos moldes da filosofia contemporânea como coerentista ou como correspondentista. Primando por uma consideração sistemática da argumentação de Kant em confronto com a literatura existente sobre o problema, este trabalho defende a segunda alternativa. Sustentase a tese de que a definição da verdade como a “concordância do conhecimento com o seu objeto” é cogente em todo o percurso do pensamento kantiano e (...) que, nessa acepção, a verdade culmina por ser abordada não a partir de uma teoria estabelecida, mas como um problema cuja solução não pode ser dada nos limites da filosofia crítico-transcendental. Pondera-se, primeiramente, a literatura que situa Kant quer como coerentista quer como correspondentista e sistematiza-se a segunda alternativa em quatro grupos: a leitura ontológica, a leitura isomórfica, a leitura “consequencialista” e a leitura regulativa. Num segundo momento, em atenção ao período pré-crítico, argumenta-se que a alternativa coerentista deixa de se confirmar já nessa mesma época e que, na década de 1750, Kant descarta uma suposta teoria correspondentista isomórfica. Num último momento, considera-se a argumentação crítica e defende-se que a mesma concebe a verdade como um problema fundamental que não cabe ao tratamento de uma teoria correspondentista concebida de modo “consequencialista” ou regulativo. There is a remarkable difference between that which Anglo-American legal philosophers more or less unanimously regard as their subject matter and that which prominent Continental writers have emphasized as one of the main topics for jurisprudential discussion. The latter have often directed their attention to something quite specific: not law or the aforementioned law-related phenomena, but the study of law, or legal scholarship. In particular, Continental writers have been interested in legal scholarship as it is characteristically produced by law teachers. (...) Some phrases that may be used to describe this type of scholarship are “doctrinal legal scholarship”, “legal dogmatics”, and “legal science in a narrow a sense”. This paper explains why Anglo-American theorists should keep their minds open to the idea that jurisprudence may take the doctrinal study of law as its subject matter. It also attempts to explain what doctrinal legal scholarship is, and thus engages in precisely the type of jurisprudential inquiry that it is out to promote. (shrink)

Critics of Hartian legal positivism have characterized it as an error theory about judicial discourse —more precisely, about judicial argument in contexts of disagreement about proper interpretive methodology—. The critics have also suggested that Hartian positivism, like error theories in other areas of philosophy, is to be presumed false. The purpose of this paper is to give a precise account of the nature and extent of the error assigned to judges by Hartian positivists. It will be argued that Hartian positivism, (...) even if it can be understood as a form of error theory, should not be likened to, say, error theories in metaethics, where the relevant error is pervasive and mysteriously enduring.Resumen:Los críticos del positivismo jurídico hartiano han caracterizado este enfoque como una teoría del error sobre el discurso judicial —concretamente sobre la argumentación judicial en el contexto de desacuerdos relacionados con una metodología de interpretación apropiada—. Los críticos también han sugerido que el positivismo hartiano, al igual que otras teorías del error en otros campos de la filosofía, ha de ser tomada por falsa. El propósito de este artículo es ofrecer una explicación más cuidadosa de la naturaleza y alcance del error que los positivistas hartianos atribuyen a los jueces. Se argumentará que el positivismo hartiano, aun cuando pudiera ser entendida como una forma de teoría del error, no debería ser relacionada con, por ejemplo, teorías del error en metaética, donde el error relevante es omnicomprensivo y misteriosamente permanente. This paper approaches legal argumentation from a rhetorical perspective. It discusses the nature of the audiences that are targeted by judges in the legal process. Judicial opinions reach diverse groups of people with very different attitudes and expectations: other judges, lawyers, litigants, concerned citizens, etc. One important way in which these groups differ is that some of them are more likely to be persuaded by legalistic, precedent or statute-based arguments, while others expect judges to decide on grounds of justice or (...) equity. So, judges face the challenge of determining whether they should select particular groups for special attention, or whether they have alternative rhetorical means to approach the problem of audience diversity. One strategy that is likely to be recommended by rhetorical scholars is that judges should not try to accommodate the various preferences of their actual readership, but that they should rather invoke an idealized audience or some version of Chaïm Perelman’s universal audience. However, the paper tries to show that the universal audience is of limited value for a discussion about how judges ought to proceed in the face of audience diversity. In particular, the idea of a universal audience does not help judges to make the choice between a legalistic or an equity-based approach to legal decision-making. By showing that this is so, the paper also raises doubts about the common thought that to invoke the universal audience in law is to appeal to natural law. (shrink)

The paper begins with an understanding of modernity in terms of an anthropological turn that characterizes Western culture from the seventeenth century. The figures of Descartes and Hobbes indicate, respectively, the discovery of subjectivity and the invention of the individual. Then reflects on the problem of God in philosophical discourse: the attitude of faith is thematized in the understanding of man as image of God and the world as rational structure teleologically ordered toward God. Finally, the paper proposes the understanding (...) of religious experience and of human contingency in terms of an experience of meaning, in which the human being can open himself to the attitude of radical faith as recognition of what gives meaning to the existence of each. Este artigo reflete sobre a passagem da categoria Discussão à categoria Objeto na Lógica da filosofia e sobre a retomada da Discussão pelo Objeto. Essas categorias são ilustradas, respectivamente, pelas atitudes de Sócrates e de Platão. Minha hipótese é que se o Sócrates da Discussão é uma criação de Platão do Objeto, então a retomada da Discussão pelo Objeto constitui um caso único na Lógica da filosofia em que a antiga categoria é produzida pela nova e a nova atitude, gerada (...) pela antiga, a ultrapassa e a conserva na ação.
