Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. The tragic crash of Air New Zealand's flight TE-901 into Mt. Erebus in Antarctica provides a fascinating case for the exploration of the notion of corporate moral responsibility. A principle of accountability that has Aristotelian roots and is significantly different from the usual strict intentional action principles is examined and defined. That principle maintains that a person can be held morally accountable for previous non-intentional behavior that has harmful effects if the person does not take corrective measures to adjust his (...) ways of behavior so as not to produce repetitions. Measurement of scientific productivity is difficult. The measures used (impact factor of the journal, citations to the paper being measured) are crude. But these measures are now so universally adopted that they determine most things that matter: tenure or unemployment, a postdoctoral grant or none, success or failure. As a result, scientists have been forced to downgrade their primary aim from making discoveries to publishing as many papers as possible—and trying to work them into high impact factor journals. Consequently, scientific (...) behaviour has become distorted and the utility, quality and objectivity of articles has deteriorated. Changes to the way scientists are assessed are urgently needed, and I suggest some here. (shrink)

In the last few years, the U.S. health care system has seemingly been gripped by “back to the nineties” fever. But there is a notable change in professional debates about how to better control health care costs. Discussion of health care rationing, which was hotly debated in the nineties, has become much more muted.Is health care rationing passé? I contend that debates about health care rationing have waned not because the need to ration has dwindled nor because ethical debates about (...) how or whether to ration have been resolved. They have declined because the word “rationing,” and unrelated concepts such as cost‐effectiveness analysis, have been replaced by terms—“parsimony,” “value,” and “CER”—that are not burdened by emotional and historical baggage.Sometimes the best way to promote healthy moral debate is to turn to new words that don't carry the burden of past debates. It is argued that causal understanding originates in experiences of acting on objects. Such experiences have consistent features that can be used as clues to causal identification and judgment. These are singular clues, meaning that they can be detected in single instances. A catalog of 14 singular clues is proposed. The clues function as heuristics for generating causal judgments under uncertainty and are a pervasive source of bias in causal judgment. More sophisticated clues such as mechanism clues and repeated interventions (...) are derived from the 14. Research on the use of empirical information and conditional probabilities to identify causes has used scenarios in which several of the clues are present, and the use of empirical association information for causal judgment depends on the presence of singular clues. It is the singular clues and their origin that are basic to causal understanding, not multiple instance clues such as empirical association, contingency, and conditional probabilities. (shrink)

It may seem that there is no need to review such a well-known book. This is the second edition of Peter Singer's text, Practical Ethics. The first edition has been widely used and influential; indeed for many it defines the field of applied ethics. The field is lucky; rarely is such popular work so carefully argued, so factually well informed and so well written. In addition, it is unusual for the author of a basic text to be so daring. (...) Peter Singer deserves credit for placing the interests of animals and famine victims on the agenda of applied ethics, and for making that agenda so prominent in public fora. But it behooves us to scrutinize carefully the power of definitive works as well. What sets the agenda is, for that very reason, more difficult to assess critically. (shrink)

ABSTRACT The just distribution of benefits and burdens of healthcare, at least in the contemporary Philippine context, is an issue that gravitates towards two opposing doctrines of welfarism and ‘free enterprise.’ Supported largely by popular opinion, welfarism maintains that social welfare and healthcare are primarily the responsibility of the government. Free enterprise (FE) doctrine, on the other hand, maintains that social welfare is basically a market function and that healthcare should be a private industry that operates under competitive conditions with (...) minimal government control. I will examine the ethical implications of these two doctrines as they inform healthcare programmes by business and government, namely: (a) the Devolution of Health Services and (b) the Philippine Health Maintenance Organization (HMO). I will argue that these doctrines and the health programmes they inform are deficient in following respects: (1) equitable access to healthcare, (2) individual needs for premium healthcare, (3) optimal utilisation of health resources, and (4) the equitable assignment of burdens that healthcare entails. These respects, as considerations of justice, are consistent with an operational definition of ‘power’ proposed here as ‘access to and control of resources.’. (shrink)

This article argues that, strictly speaking, from its inception with the ancient Greeks and for all time, philosophy and science are identical and consist in an essential relationship between a specific type of understanding of the human person as possessed of an intellectual soul capable of being habituated and a psychologically-independent composite whole, or organization. It maintains, further, that absence of either one of the extremes of this essential relationship cannot be philosophy/science and, if mistaken for such and applied to (...) the workings of cultural institutions, will generate anarchy within human culture and make leadership excellence impossible to achieve. Finally, it argues that only a return to this “common sense” understanding of philosophy can generate the leadership excellence that can save the West from its current state of cultural and civilizational anarchy. When people make judgments about the effects of a perturbation on populations of species in a food web, their judgments exhibit the dissipation effect: a tendency to judge that effects of the perturbation weaken or dissipate as they spread out through the food web from the locus of the perturbation. In the present research evidence for two more phenomena is reported. Terminal locations are points in the food web with just a single connection to the rest of the web. Judged (...) changes tended to be higher for species at terminal locations than for species the same distance from the perturbation but at nonterminal locations. Branches are points in the web where a route splits into two or more routes. Judged changes tended to be lower for species following branching points than for species the same distance from the perturbation but not following branching points. It is proposed that the findings can be explained as effects of a mental model employing concepts of influence and resistance. Under this model a perturbation is a change in energy level at a point in the system that acts as an influence affecting the rest of the system. The basic concepts in this model are domain‐general and on that basis it is predicted that the dissipation effect should be found in judgments of any physical system to which notions of influence and resistance can be applied. This book establishes that the ancient Greeks had a prevailing method of doing philosophy which was rooted in philosophical realism. Through extensive historical and philosophical analysis, it demonstrates that this method was challenged in ancient times by an apocryphal notion of philosophy which eventually became confused with philosophical reasoning, and was passed on to posterity through the work of Christian theologians until it was called into question by leading thinkers of the thirteenth century. It shows how this thirteenth-century challenge influenced (...) the growth of the Renaissance humanist movement and how this movement, in turn, passed on to modernity the same apocryphal notion of philosophy as a rhetorical theology of allegorical prefiguration. Although knowledge of torture and physical and psychological abuse was widespread at both the Guantanamo Bay detention facility and Abu Ghraib prison in Iraq, and known to medical personnel, there was no official report before the January 2004 Army investigation of military health personnel reporting abuse, degradation, or signs of torture. Mounting information from many sources, including Pentagon documents, the International Committee of the Red Cross, Amnesty International, Human Rights Watch, etc., indicate that medical personnel failed to maintain medical records, (...) conduct routine medical examinations, provide proper care of disabled and injured detainees, accurately report illnesses and injuries, and falsified medical records and death certificates. Medical personnel and medical information was also used to design and implement psychologically and physically coercive interrogations. The United States military medical system failed to protect detainee's human rights, violated the basic principles of medical ethics and ignored the basic tenets of medical professionalism. (shrink)

Our main result on computability is: For any n ≥ 2 and any computable (recursive) k-coloring of the n-element sets of natural numbers, there is an infinite homogeneous set X with X'' ≤ T 0 (n) . Let IΣ n and BΣ (...) n denote the Σ n induction and bounding schemes, respectively. Adapting the case n = 2 of the above result (where X is low 2 ) to models of arithmetic enables us to show that RCA 0 + IΣ 2 + RT 2 2 is conservative over RCA 0 + IΣ 2 for Π 1 1 statements and that $RCA_0 + I\Sigma_3 + RT^2_{ , is Π 1 1 -conservative over RCA 0 + IΣ 3 . It follows that RCA 0 + RT 2 2 does not imply BΣ 3 . In contrast, J. Hirst showed that $RCA_0 + RT^2_{ does imply BΣ 3 , and we include a proof of a slightly strengthened version of this result. On the whole, certainly, the book provides an invaluable overview of the Thomistic universe for anyone working on Aquinas's cosmology, metaphysics, or even ethics. Blanchette is to be commended for his clear and orderly presentation of the material, especially the many subdivisions within the chapters. The quotations of Thomistic texts are almost all in English, well translated by Banchette himself. The placing of key phrases in Latin within parentheses helps in some measure to overcome the lack of the original text in the footnotes. Finally, the book's selected bibliography as well as its indices (index of names, analytical index, and index of citations) render the book an even more useful tool. According to the author, this book, Freedom and Creation in Three Traditions, is a comparative work designed "to illustrate the worth of explicitly tradition-directed inquiry, as well as the fruitfulness of comparative inquires in philosophical theory" (6). In addition, among other things, the author contends that, "because the pressure of comparative perspectives demands that we mine hitherto unsuspected reaches of what we have thought we know," not only the author but also the "traditional disciplines of philosophy and theology may each be enriched by the forays of such inquiry" (6). Specifically, the three traditions to which Burrell is referring are the Jewish, Islamic, and Christian; and, as the title of this book suggests, the central topics of consideration used as the basis for a comparison among these traditions are the respective notions of freedom and creation. In order to achieve his goals, Burrell places his discussion within the general context of the notion of creation, which, as he rightly observes, "is notoriously difficult to classify" (7). In so doing, he divides the work into nine chapters; which he entitles as follows: 1) "The Context: Creation"; 2) "On 490 BOOK REVIEWS Characterizing the Creator"; 3) "On Characterizing Creation"; 4) "On Characterizing the Relation: Jewish, Christian, Muslim"; 5) "God's Acting in the World God Creates"; 6) "Creatures Acting in a Created World"; 7) "On the Relations between the Two Actors"; 8) "Sin and Redemption"; 9) "The God Realized in Renewed Creation." Having placed his discussion within the general context of the notion of creation, Burrell begins his analysis by comparing and contrasting this notion in St. Thomas and Moses Maimonides vis-a-vis the necessitarianism of Aristotle as interpreted by lbn Sina. In so doing, Burrell stresses that what predominates in both Maimonides and Aquinas is a notion of God as a "free originator" of all creation not in relation to an "exegesis of the opening chapters of Genesis" but in relation "to the rest of the Bible and the subsequent tradition of Judaism and Christianity" (12). This "distillation" having been noted, Burrell then examines the distinctive features of the notion of creation as this is influenced by the "faith assertion " of the three respective religious traditions-Jewish, Christian, and Islamic. Within Judaism Burrell finds emphasis placed upon the need to interpret creation against the background of the "covenant" with Israel (19). In Aquinas and Barth he understands this activity to be interpreted against the background of the relation of the Father to His Eternal Word (19-21); and within Islam he finds the regulating theme in the conviction of God's absolute sovereignty vis-a-vis the created order.
