Conçues pour des biens ayant une consistance matérielle, nombre d'infractions pénales ont été sollicitées ces dernières années pour s'appliquer à des biens immatériels tels qu'un numéro de carte bancaire, un projet de borne informatique, du temps de travail ou encore des données informatiques. Au-delà de la matière répressive, l'ambition de cet ouvrage est de se livrer à une étude plus générale de l'adaptation du droit au développement de l'immatériel pour déterminer jusqu'où l'on peut juridiquement aller dans sa prise en compte. (...) C'est un fait indéniable que l'immatériel prend une place de tout premier plan dans la société contemporaine. Le droit des siècles passés connaissait, certes, déjà l'incorporalité, mais nul doute que les potentialités actuelles ouvrent des perspectives nouvelles. L'ouvrage propose tout d'abord de préciser la notion d'immatériel en recourant à des approches non juridiques. Le point de vue du philosophe et celui du physicien peuvent fournir des clés pour percer un concept que le juriste pourra ensuite aborder de manière pragmatique. S'agissant de l'appréhension juridique de l'immatériel, deux mouvements peuvent être observés. D'une part, l'immatériel est un objet que le droit s'efforce d'intégrer ; d'autre part, il est un outil que le droit peut exploiter. Sur le premier point, il s'agit d'examiner comment le droit parvient à s'adapter à l'émergence de nouvelles formes d'objet et surtout d'identifier les limites qui ne pourront ou ne devront pas être dépassées. Même lorsque l'on s'intéresse à des matières qui ont été conçues pour régir l'immatériel, telle que la propriété intellectuelle, on observe en effet que tout objet ne peut être saisi et on devine alors que de telles limites doivent a fortiori exister lorsque l'on est en présence de branches du droit qui n'étaient originairement pas destinées à s'appliquer à de tels biens et qui ne peuvent y parvenir qu'au terme d'une adaptation. Sur le second aspect, il s'agit d'observer les perspectives qu'ouvre l'immatériel comme moyen d'accéder au droit et de mettre en relation les acteurs de la scène juridique. Là aussi, certains aspects ne sont pas totalement nouveaux et si la prolifération des contrats conclus par voie électronique ne constitue que le développement récent du phénomène ancien des contrats à distance, la dématérialisation des procédures et des échanges entre professionnels du droit va être relayée par un accès direct du justiciable aux services judiciaires qui est de nature à changer de manière significative le mode de relation au juge et à l'institution judiciaire. Philippe Fournier | : Le point de départ de ma proposition est que la responsabilité est un terme plus approprié que la vertu pour désigner les exhortations au devoir civique dans l’ère contemporaine. De même, à défaut de voir l’implication citoyenne comme l’expression de la rationalité individuelle ou de la conscience morale dans la sphère publique, je propose de comprendre la responsabilité comme une matrice discursive et gouvernementale qui perpétue des modèles comportementaux bien spécifiques. J’entends ainsi démontrer que (...) la responsabilité est devenue une modalité indispensable du « gouvernement de la conduite » au sein d’une rationalité néolibérale. En plus de constituer une série de dispositions morales qui remédierait aux failles et aux lacunes de l’individualisme libéral, la responsabilité se matérialise dans les incitations à une citoyenneté active et participe de ce fait à la rationalisation du retranchement de l’État de la sphère sociale. Comme l’illustrent des courants aussi divers que le néoconservatisme, le communautarisme et l’économie sociale, la responsabilité se présente moins comme une solution de rechange aux créneaux du néolibéralisme qu’une série de techniques et de standards comportementaux visant à compléter et renforcer l’application élargie d’une logique micro-économique. Je montrerai que le recours à la notion de responsabilité est particulièrement visible dans les politiques d’aide sociale et au sein des nouveaux partenariats entre l’État, le milieu communautaire et les communautés locales. En effet, l’aide étatique est de plus en plus conditionnelle à la démonstration de certaines dispositions morales et psychologiques comme la volonté, la ténacité et la probité. L’article se divise en quatre parties. La première s’attarde à définir brièvement la « gouvernementalité », concept initialement développé par Michel Foucault. La deuxième se penche sur des travaux plus contemporains, notamment ceux du sociologue britannique Nikolas Rose qui se préoccupe de la responsabilité en tant que modalité gouvernementale au sein du néolibéralisme. La troisième partie met en relief les particularités du néolibéralisme américain. En vue de cerner les pratiques et discours associés à la responsabilité de façon plus précise, la dernière partie examine l’un des principaux programmes d’aide sociale aux États-Unis, l’Aid to Families with Dependent Children, devenu le Temporary Assistance for Needy Families en 1996, des années 1980 jusqu’à aujourd’hui. | : Our point of departure is that responsibility is a more appropriate term than virtue to designate the contemporary exhortations to civic duty. Instead of seeing civic engagement as a means to express individual rationality or moral conscience in the public sphere, this paper suggests that we should understand responsability as a discursive and governmental matrix that perpetuates specific behavioral standards. More specifically, the article aims to show that responsability has become an indispensable instrument of rule within a neoliberal rationality of government. As well as pointing to a range of moral dispositions that can offset neoliberalism’s shortcomings, the notion of responsibility is mobilised in the repeated public calls to active citizenship and plays a strategic role in the discursive justification of the state’s withdrawal from the social sphere. As illustrated by strands of thought as diverse as neoconservatism, communitarianism and social economy, responsibility is less an alternative to neoliberal tenets than a series of techniques and behavioral standards that complement and reinforce the extension of a microeconomic logic to all spheres of human activity. The appeals to responsibility are particularly visible in contemporary social policies and in the strategic partnerships between the state, community organisations and local communities. Indeed, state assistance has become increasingly conditional on the demonstration of aptitudes and moral qualities like earnestness, tenacity and willpower. The article proceeds in four parts. The first part briefly defines governmentality, a concept initially developed by Michel Foucault. The second part explores Nikolas Rose’s work on advanced liberalism and takes a look at contemporary articulations of responsibility. The third part examines the specificities of American neoliberalism. In order to identify the practices and discourses linked to the notion of responsibility, the final part of the article looks at one of the main social programs in the United States, namely the Aid to Families with Dependent Children, renamed the Temporary Assistance for Needy Families in 1996, from the early 1980s to our day. Discovering high-utility itemsets (HUIs) consists of finding sets of items that yield a high profit in customer transaction databases. An important limitation of traditional high-utility itemset mining (HUIM) is that only the utility measure is used for assessing the interestingness of patterns. This leads to finding several itemsets that have a high profit but contain items that are weakly correlated. To address this issue, this paper proposes to integrate the concept of correlation in HUIM to find profitable itemsets that are (...) highly correlated, using the all-confidence and bond measures. An efficient algorithm named FCHM (fast correlated high-utility itemset miner) is proposed to efficiently discover correlated high-utility itemsets (CHIs). Two versions of the algorithm are proposed: FCHM|$_{all\text{-}confidence}$| and FCHM|$_{bond}$|⁠, which are based on the all-confidence and bond measures, respectively. An experimental evaluation was done using four real-life benchmark datasets from the HUIM literature: mushroom, retail, kosarak and foodmart. Results show that FCHM is efficient and can prune a huge amount of weakly CHIs. (shrink)

This article aims to expose the main governmental shifts in recent American history (1961-2000) by examining two programs: the Assistance to Families with Dependent Children (AFDC) and the Agency for International development (US-AID). Through the exploration of primary and secondary sources, we analyse the production, organisation and circulation of governmental practices in the realms of both domestic and foreign policy. In the American context, practices of government typically revolve around freedom, efficiency models and individual responsibility. Throughout the analysis, we find (...) that the general critiques which have guided reforms and experiments in both areas converge around the same elements. This testifies to the fact that the reflexions and technical models directed at the optimal management of populations are more far-reaching than they first appear. Moreover, the historical transformations in welfare and foreign aid practices bear out the increasingly disciplinary nature of the administration and objectification of the poor, both within the United States and internationally. Is there any ethical justification for limiting the reproductive autonomy and not make assisted reproductive technologies available to certain prospective parents? We present and discuss the results of an interdisciplinary clinical ethics study concerning access to assisted reproductive technologies (ART) in situations which are considered as ethically problematic in France (overage or sick parents, surrogate motherhood). The study focused on the arguments that people in these situations put forward when requesting access to ART. It shows that requester’s arguments are based (...) on sound ethical values, and that their legitimacy is at least as strong as that of those used by doctors to question access to ART. Results reveal that the three implicit normative arguments that founded the law in 1994, which are still in force after the bioethics law revision in July 2011—the welfare of the child, the illegitimacy of a “right to a child,” and the defense of the so called “social order”—are challenged on several grounds by requesters as reasons for limiting their reproductive autonomy. Although these results are limited to exceptional situations, they are of special interest insofar as they give voice to the requesters’ own ethical concerns in the ongoing political debate over access to ART. This article investigates the concept of the ground truth as both an epistemic and technical figure of knowledge that is central to discussions of machine vision and media techniques of visuality. While ground truth refers to a set of remote sensing practices, it has a longer history in operational photography, such as aerial reconnaissance. Building on a discussion of this history, this article argues that ground truth has shifted from a reference to the physical, geographical ground to the surface of (...) the images echoing earlier points raised by philosopher Jean-Luc Nancy that there is a ground of the image that is central to the task of analysis beyond representational practices. Furthermore, building on the practices of pattern recognition, composite imaging, and different interpretational techniques, we discuss contemporary practices of machine learning that mobilizes geographical earth observation datasets for experimental purposes, including tests such as “fake geography” as well as artistic practices, to show how ground truth is operationalized in such contexts of AI and visual arts. The Clinical ethics centre in Paris offers its services equally to doctors and patients/proxies. Its primary goal is to re-equilibrate doctor–patient roles through giving greater voice to patients individually in medical decisions. Patients are present at virtually all levels, initiating consults, providing their point of view and receiving feedback. The implications of patients' involvement are threefold. At an operational level, decision-making is facilitated by repositioning the debate on ethical grounds and introducing a dynamic of decisional partnership, although contact with patients (...) can make it difficult to deny their demands and set the limits of our role. Ethically, it reinforces patients' autonomy and grants them a place of veritable ethics ‘actors’, with the danger that this may become excessively autonomy oriented. Finally, at a collective level, the programme fulfils its political purpose in promoting patients' rights and the ideal of démocratie sanitaire, but complicates balancing individual demands with collective values. A pilot center for clinical ethics in France opened with the establishment of the “Centre d'éthique clinique” at Cochin Hospital in Paris, September 2002. Unlike the longer history in the United States of providing ethics consultation for ethical issues deriving from physician–patient interactions, this center marks a new development in bringing clinical ethics to Europe.

The aim of this paper is twofold. The first is an interpretative one as I wish to provide a detailed account of Husserl’s conception of experiential justification. Here Ideas I and Introduction to Logic and Theory of Knowledge: Lectures 1906/07 will be my main resources. My second aim is to demonstrate the currency and relevance of Husserl’s conception. This means two things: Firstly, I will show that in current debates in analytic epistemology there is a movement sharing with Husserl the (...) basic idea that certain experiences gain their justificatory force simply from their distinctive phenomenal character. Secondly, I shall reveal the benefits of Husserl’s specific version of this view. Thus, one of my aims is to show that debates in current analytic epistemology could profit from adopting certain Husserlian elements. More precisely, I will defend Husserl’s claim that perceptual experiences are justifiers due to their self-giving phenomenal character as opposed to the currently popular view that it is the phenomenology of pushiness that makes them justifiers. In his influential paper “Grasping the Third Realm,” John Bengson raises the question of how we can non-accidentally grasp abstract facts. What distinguishes successful intuition from hallucinatory intuition? Bengson answers his “non-accidental relation question” by arguing for a constitutive relationship: The intuited object is a literal constituent of the respective intuition. Now, the problem my contribution centers around is that Bengson’s answer cannot be the end of the story. This is because, as Bar Luzon and Preston Werner have recently pointed (...) out, this answer leads to the follow-up question of why certain intuitional experiences are constituted by the facts, but others are not. My objective is to answer this question by specifying precisely what is epistemically defective about intellectual hallucinations. My result is that, in stark contrast to perception, intellectual hallucinations are epistemically defective in the sense that something is overlooked. In successful intuition, by contrast, all relevant possibilities/scenarios are considered/imagined. This has crucial epistemological implications. In particular, I argue that intuitions exhibiting a certain phenomenology cannot fail to successfully grasp abstract facts. I call this the non-accidental correctness thesis, which constitutes the main thesis of this paper. (shrink)

Solar radiation management (SRM) may help to reduce the negative outcomes of climate change by minimising or reversing global warming. However, many express the worry that SRM may pose a moral hazard, i.e., that information about SRM may lead to a reduction in climate change mitigation efforts. In this paper, we report a large-scale preregistered, money-incentivised, online experiment with a representative US sample (N = 2284). We compare actual behaviour (donations to climate change charities and clicks on climate change petition (...) links) as well as stated preferences (support for a carbon tax and self-reported intentions to reduce emissions) between participants who receive information about SRM with two control groups (a salience control that includes information about climate change generally and a content control that includes information about a different topic). Behavioural choices are made with an earned real-money endowment, and stated preference responses are incentivised via the Bayesian Truth Serum. We fail to find a significant impact of receiving information about SRM and, based on equivalence tests, we provide evidence in favour of the absence of a meaningfully large effect. Our results thus provide evidence for the claim that there is no detectable moral hazard with respect to SRM. [Open access]. (shrink)

Advance directives have been hailed for two decades as the best way to safeguard patients’ autonomy when they are totally or partially incompetent. In many national contexts they are written into law and they are mostly associated with end-of-life decisions. Although advocates and critics of ADs exchange relevant empirical and theoretical arguments, the debate is inconclusive. We argue that this is so for good reasons: the ADs’ project is fraught with tensions, and this is the reason why they are both (...) important and deeply problematic. We outline six such tensions, and conclude with some positive suggestions about how to better promote patients’ autonomy in end-of-life decision. We argue that ADs should continue to be an option but they cannot be the panacea that they are expected to be. (shrink)

In current debates, many philosophers of science have sympathies for the project of introducing a new approach to the scientific realism debate that forges a middle way between traditional forms of scientific realism and anti-realism. One promising approach is perspectivism. Although different proponents of perspectivism differ in their respective characterizations of perspectivism, the common idea is that scientific knowledge is necessarily partial and incomplete. Perspectivism is a new position in current debates but it does have its forerunners. Figures that are (...) typically mentioned in this context include Dewey, Feyerabend, Leibniz, Kant, Kuhn, and Putnam. Interestingly, to my knowledge, there exists no work that discusses similarities to the phenomenological tradition. This is surprising because here one can find systematically similar ideas and even a very similar terminology. It is startling because early modern physics was noticeably influenced by phenomenological ideas. And it is unfortunate because the analysis of perspectival approaches in the phenomenological tradition can help us to achieve a more nuanced understanding of different forms of perspectivism. The main objective of this paper is to show that in the phenomenological tradition one finds a well-elaborated philosophy of science that shares important similarities with current versions of perspectivism. Engaging with the phenomenological tradition is also of systematic value since it helps us to gain a better understanding of the distinctive claims of perspectivism and to distinguish various grades of perspectivism. The Truth and Reconciliation Commission of Canada made it clear that understanding the historical, social, cultural, and political landscape that shapes the relationships between Indigenous peoples and social institutions, including the health care system, is crucial to achieving social justice. How to translate this recognition into more equitable health policy and practice remains a challenge. In particular, there is limited understanding of ways to respond to situations in which conventional practices mandated by the state and regulated by its legal apparatus (...) come into direct conflict with the values and autonomy of Indigenous individuals, communities, and nations. In this paper, we consider two cases of conflict between Indigenous and biomedical perspectives to clarify some of the competing values. We argue for the importance of person‐ and people‐centered approaches to health care. These value conflicts must be understood at multiple levels to clarify their personal, social, cultural, and political dimensions. Taking into account the divergence between epistemic cultures and communities allows us to understand the multiple narratives deployed in decision‐making processes in clinical, community, and juridical contexts. Recognizing the knowledge claims of Indigenous peoples in health care can help clinicians avoid reinforcing the divides created by the structural and institutional legacy of colonialism. This analysis also provides ways to adjudicate conflicts in health care decision‐making by disentangling cultural, political, medical, and pragmatic issues to allow for respectful dialogue. Insofar as the engagement with cultural pluralism in health care rights is conducted with reciprocal recognition, the medical community and Indigenous peoples can address together the difficult question of how to integrate different epistemic cultures in the health care system. En 1988, la fouille sous‑marine du port de Thasos permettait l’extraction d’un imposant carreau de marbre, en même temps que d’autres blocs entassés en avant de la jetée antique. Cet essai développe une analyse critique de la mondialisation basée sur des recherches de terrains entreprises dans la décennie 2010 à Cuba, plus particulièrement à La Havane. L’enseignement de la mondialisation dans les universités anglo-saxonnes au Canada et en Grande-Bretagne dans les années 2000 se caractérisait par une peur de l’homogénéisation de la culture, puis de l’application d’une approche ethnographique pour l’exploration du processus d’appropriation culturelle engendrée par les interactions entre le local et le transnational. Des recherches de terrain ont (...) cependant montré, parfois de manière concrète, comment la vision de la mondialisation composée de systèmes de circulations fluides et sans tension était utopique et non pertinente dans le contexte cubain (et probablement dans tous les pays de l’hémisphère Sud). L’histoire du « dossier dubstep » racontée ici permet d’illustrer le sentiment de décalage tel qu’exprimé par des DJs et producteurs de musique électronique à La Havane et leur désir d’entrer dans la danse. Enfin, cet essai jette un regard critique sur une vision fluide des échanges, souvent associée au concept de circulation et, par extension, au phénomène de la mondialisation. (shrink)

Quelle politique peut-on faire quand on est un idiot? Loin d'être saugrenue, c'est bien la question qu'on est conduit à se poser inévitablement en lisant l'oeuvre de Gilles Deleuze. L'"idiot" joue, en effet, un rôle incontournable et essentiel dans la philosophie de Deleuze. Il est le personnage conceptuel qui fait tenir cette philosophie dans sa consistance propre. Il se situe à la charnière de l'image de la pensée que le philosophe invoque et suppose plus ou moins implicitement et de la (...) création de concepts qu'il produit explicitement. Aussi, faire de la philosophie, tout comme agir et penser politiquement, c'est toujours une manière de faire l'idiot. Les conséquences de cette approche sont capitales, du fait des questions posées à la réflexion politique classique centrée sur le Droit et l'Etat, du fait aussi des problématiques qui se voient invalidées dans ce champ. La place qui revient au contrôle et au bio-pouvoir, aux zones d'indétermination et aux espaces lisses, permet de prendre une saine distance vis-à-vis de la politique "majoritaire" et de faire apparaître, comme déjà de vieux clichés, bon nombre de thèmes et de concepts revendiqués par les organisations alternatives, mondialistes et subversives récentes. C'est une tout autre idée de la politique, centrée sur les devenirs, que nous invite à méditer la politique deleuzienne de l'idiot. Elle nous ouvre à d'autres espérances, nouvelles, en lien avec un "peuple absent" qui naîtrait avec chaque devenir. (shrink)

Animal research suggests that central serotonergic neurons are involved in behavioral suppression, particularly anxiety-related inhibition. The hypothesis linking decreased serotonin transmission to reduced anxiety as the mechanism in the anxiolytic activity of benzodiazepines conflicts with most clinical observations. Serotonin antagonists show no marked capacity to alleviate anxiety. On the other hand, clinical signs of reduced serotonergic transmission (low 5-HIAA levels in the cerebrospinal fluid) are frequently associated with aggressiveness, suicide attempts, and increased anxiety. The target article attempts to reconcile such (...) human and animal findings by investigating whether anxiety reduction or increased impulsivity is more Likely to account for animal behavioral changes associated with decreased serotonergic transmission. The effects of manipulating central serotonin in experimental anxiety paradigms in animals (punishment, extinction, novelty) are reviewed and compared with the effects of antianxiety drugs. Anxiety seems neither necessary nor sufficient to induce control by serotonergic neurons on behavior. Further evidence suggests that behavioral effects of anxiolytics thought to be mediated by decreases in anxiety are not caused by the ability of these drugs to reduce serotonin transmission. Blockade of serotonin transmission, especially at the level of the substantia nigra, results in a shift of behavior toward facilitation of responding. This behavioral shift is particularly marked when there is competition between acting and restraining response tendencies and when obstacles prevent the immediate attainment of an anticipated reward. It is proposed that serotonergic neurons are involved not only in behavioral arousal but also in enabling the organism to arrange or tolerate delay before acting. Decreases in serotonin transmission seem to be associated with the increased performance of behaviors that are usually suppressed, though not necessarily because of the alleviation of anxiety, which might contribute to the suppression. Feeling anxious and presenting self-determined motivations about returning to sport after a break may impair sport performance and increase the risk of sustaining an injury. Hence, the aim of this study is to explore differences in anxiety and motivation to return to sport according to gender, expertise, training status before and during the lockdown, and athletes’ availability at the time of the lockdown. A total of 759 competitive athletes completed the cross-sectional study. Participants were invited to state their expertise, training (...) status before and during the lockdown, and whether they were injured at the start of the lockdown. Additionally, participants filled out psychometric self-report measures of anxiety and motivation to return to sport. Due to non-normal distributions in the TFAI and SMS scores, non-parametric group comparisons were performed to compare participants for each categorical variable: non-parametric correlation tests were also performed to test the associations between continuous variables. Group comparisons showed higher scores of anxiety for females, younger athletes, athletes practicing and competing at the highest level, and athletes without a training program during the lockdown. Moreover, results suggested lower motivation scores for older athletes, experts, athletes practicing and competing at a lower level, and athletes without a training program during the lockdown. Additionally, participants who were injured at the start of the lockdown reported higher scores of cognitive anxiety to return to sport than non-injured participants. The results of this study suggest that elite athletes may have suffered from external pressures to return to sport during the lockdown. Additionally, participants with a training program during the lockdown seemed to be less anxious and more self-determined to return to sport after the lockdown. Future studies may focus on the impact of cognitive behavioral interventions on anxiety and motivation to return to sport. (shrink)
