This article examines the question of whether private obstetric care in South Africa can be saved in view of the escalation in medical and legal costs brought about by a dramatic increase in medical negligence litigation. This question is assessed with reference to applicable medical and legal approaches. The crux of the matter is essentially a question of affordability. From a medical perspective, it seems that the English system as well as American perspectives may be well suited to the SA (...) situation. Legal approaches are assessed in the context of the applicable medicolegal framework in SA, the present nature of damages and compensation with reference to obstetric negligence liability, as well as alternative options to the present system based on fault. It is argued, depending on constitutional considerations, that a system of damages caps for noneconomic damages seems to be the most appropriate and legally less invasive system in conjunction with the establishment of a state excess insurance fund. Fascism, according to the Deleuzo-Guattarian perspective and new materialist viewpoints, can be conceived of in terms of desire. In mediating desire’s pure flows, the schizoanalytical programme attempts to bypass what Deleuze calls ‘the strange detour of the other’ (B, 356). In this respect, concepts developed in Gilles Deleuze and Félix Guattari’s Capitalism and Schizophrenia cycle are critical to the project of the problematic of desire, the other and (neo-)fascism. In this chapter, we explore how Deleuzo-Guattarian anti-fascist concepts, such as the (...) Body without Organs (BwO), together with new materialist approaches towards vital materialism, may help us to ‘keep an eye on all that is fascist, even [the fascist] inside us’ (TP, 165). Such a critical-creative analysis, we argue, is needed to distinguish contemporary vitalist new materialisms from so-called Lebensphilosophien (philosophies of life) and frame the rise of neoliberal capitalism-supported regimes of neo-fascism. Superman and Batman are close friends and colleagues in the Justice League. But they are very different, especially when it comes to their views on humanity and their opinions of human nature. This chapter discusses the philosophy of Thomas Hobbes and G.W.F. Hegel to better understand these friends’ difference of opinion on humanity and human nature. Superman's view of human nature is much more optimistic than that of Batman and Hobbes. The author claims that Superman and Batman have radically different (...) views on human nature, the state, and society. So perhaps the difference between Superman and Batman is not simply that the former thinks that people are inherently good, whereas the latter believes they are inherently bad. In this article, I discuss manuscript material written by Petrus van Musschenbroek related to his first experiments with the Leiden jar. Despite the importance of the discovery of the Leiden jar for the history of electricity and the questions that still surround its discovery, a detailed treatment of this manuscript material is lacking in the literature. The main aim of this paper is to provide an outline of the manuscript material and to contextualize van Musschenbroek’s first experiments with the Leiden (...) jar. I show how the experiment fits within his research program on electricity and I discuss van Musschenbroek’s initial reactions to and analysis of the phenomenon. Before doing so, I first provide a short overview of the treatment of the early history of the Leiden jar in the secondary literature. After that, I discuss van Musschenbroek’s treatment of the topic of electricity in the textbooks he published in the years before the discovery of the device. Van Musschenbroek repeatedly emphasized that not enough experimental results were available for an informed theoretical treatment of the phenomenon of electricity to be possible. I then turn to the manuscript material, where I give a general description of the contents of the manuscript and van Musschenbroek’s experimental practice. The manuscript material further confirms recent work on the Leiden jar by Silva and Heering, and provides new insights into the way van Musschenbroek himself reacted to the discovery. (shrink)

Most philosophers of economics are hostile towards neoclassical economics in general and general equilibrium theory in the vein of Arrow and Debreu in particular. Especially the latter’s dismissal is justified by pointing out its lack of direct relevance for an understanding of real economies. Many recommend a more pragmatic approach along the lines of Keynes instead. The criterion of scientific legitimacy underlying this approach derives from a philosophy of science developed along the lines of Popper and Lakatos. They, however, neglect (...) the importance of conceptual problems and of the choice of adequate ‘language-systems’ in science. Since these conceptual and ‘linguistic’ aspects may be able to explain and to justify the rationale of the Arrow-Debreu approach, I recommend the more balanced philosophies of Carnap and Laudan, in which conceptual as well as empirical problems are allowed for, as a framework for methodological appraisal. I explain why such a balanced view is obstructed for most philosophers of economics and advocate a moderate pluralism leaving room for different theories, methodologies and language-systems, depending on the scientific aims that are pursued. In this study the relationship of religiosity and value priorities is differentiated, based on a multidimensional measurement of different contents of religiosity. The structure of values is conceptualized using Schwartz' two orthogonal dimensions of Self-transcendence vs. Self-enhancement and Openness to change vs. Conservation. The relations between these two dimensions and eight religious contents, ranging from open-minded to more close-minded forms of religiosity, were tested in a sample of church attenders , gathered in Germany. The results show, that depending on the (...) content of religiosity, different values are preferred . The results indicate the importance of the content of religiosity for predicting value-loaded behaviors. (shrink)

Vladimir Putin’s legitimation of Russia’s brutal war of aggression against Ukraine raises questions about traditional understandings of nation and empire. Should we contrast the two in terms of values and practices? In this case, Putin uses both nationalist and Imperialist rhetoric to justify his actions. My essay questions how we understand nation and empire using the example of the Austro-Hungarian Empire. How did this empire develop laws, institutions and administrative practices to manage conflicts and claims around language use and nationalism? (...) How did Austria’s governments rule a multi-lingual, multi-confessional society effectively, without resorting to brutal policies of nationalization? When nationalist conflicts arose in different settings, how and why did they originate? I conclude that in European terms, Imperial Austria and even nationalist Hungary apparently managed daily-life issues around diverse language use and religious practice far more humanely and effectively than did the successor nation states after 1918. Questions about the naturalness or unnaturalness of homosexuality are as old as the hills, and the answers have often been used to condemn homosexuals, their behaviors, and their relationships. In the past two centuries, a number of sciences have involved themselves in this debate, introducing new vocabularies, theories, arguments, and data, many of which have gradually helped tip the balance toward tolerance and even acceptance. In this book, philosophers Pieter R. Adriaens and Andreas De Block explore the history and (...) philosophy of the gay sciences, revealing how individual and societal values have colored how we think about homosexuality. The authors unpack the entanglement of facts and values in studies of male homosexuality across the natural and human sciences and consider the extent to which science has mitigated or reinforced homonegative mores. Finally, psychiatrists, who had initially pathologized homosexuality, eventually appealed to its naturalness or innateness to normalize it. Discussing findings from an array of sciences--comparative zoology, psychiatry, anthropology, evolutionary biology, social psychology, developmental biology, and machine learning--this book is essential reading for anyone interested in what science has to say about homosexuality. William of Moerbeke was a prolific medieval translator of Aristotle and other ancient philosophical and scientific authors from Greek into Latin, and he played a decisive role in the acceptance of Aristotelian philosophy in the Latin world. He is often criticized for an allegedly deficient translation method. However, this book argues that his approach was a deliberate attempt to allow readers to reach the correct understanding of the source texts in accordance with the medieval view of the role of the (...) translator. William's project to make all genuine works of Aristotle - and also of other important authors from Antiquity - available in Latin is framed against the background of intellectual life in the 13th century, the deliberate policy of his Dominican order to reconcile Christian doctrine with worldly knowledge, and new trends in book production that influenced the spread of the new translations. William of Moerbeke's seemingly modest acts of translation started an intellectual revolution, the impact of which extended from the Middle Ages into the early modern era. Bezugnahmen auf 'Wahrheit und Methode' bilden langst eine Art 'Koine' der Selbstverstandigung des Fachs. Der aus einem Kolloquium im Deutschen Literaturarchiv Marbach hervorgegangene Band bilanziert diesen Bestand: Im ersten Teil diskutieren Jean Grondin, Dieter Teichert, Norbert Groeben, Tilmann Koppe u.a. Gadamers Theorievorschlage und deren Rezeption durch so wirkungsmachtige Literaturwissenschaftler wie Hans-Robert Jauss, E.D. Hirsch und Frank Kermode. Hassin recently proposed the “Yes It Can” (YIC) principle to describe the division of labor between conscious and unconscious processes in human cognition. According to this principle, unconscious processes can carry out every fundamental high-level cognitive function that conscious processes can perform. In our commentary, we argue that the author presents an overly idealized review of the literature in support of the YIC principle. Furthermore, we point out that the dissimilar trends observed in social and cognitive psychology, with respect to (...) published evidence of strong unconscious effects, can better be explained by the way how awareness is defined and measured in both research fields. Finally, we show that the experimental paradigm chosen by Hassin to rule out remaining objections against the YIC principle is unsuited to verify the new default notion that all high-level cognitive functions can unfold unconsciously. This article has two general aims. It first of all critically reconsiders the empirical turn’s dismissal of transcendentalism in the philosophy of technology, in particular through the work of Ihde and Verbeek, and defends the continuing relevance of the notion of the transcencental in thinking about technology today, illustrating this mainly through a reading of Stiegler’s understanding of the human condition as a technical condition and his view of human (noetic) evolution as proceeding from a process of technical exteriorization. The (...) crucial issue that is missed by postphenomenology and the empirical turn is that technology itself in its empiricity occupies the (periodically changing) place of the transcendental. It thus fails to consider the transcendental operativity of technical artifacts within its own empiricist stance. Secondly, it argues for the continuing importance and usefulness of the idea of Technology with a capital T, equally discarded by the representatives of the empirical turn, in particular against the emerging backdrop of the Anthropocene as the age of decisive anthropogenic forcing of the planet and the growing dominance of what has recently been called the technosphere in Earth system science. With Stiegler I show that a proper, inherent dynamic of technology must be acknowledged historically, anthropologically, techno-evolutionarily as well as (techno)phenomenologically. I conclude by demonstrating that our time of planetary crisis summons us to redirect our attention to technology from the empirical to the transcendental, and from the micro-level to the macro-level again. Teaching is an important aspect of scientific practice. However, it has only recently become the subject of detailed historical and philosophical analyses. In this paper, I argue that Joseph Rouse’s philosophy of scientific practice has important implications for the study of scientific education. Rouse’s dynamic conception of scientific knowledge entails that education should occupy a central place in our analyses of scientific practices, as it is crucial in guaranteeing their temporal extension and sustenance. However, Rouse’s reconceptualization of scientific knowledge also (...) has implications for our understanding of scientific education itself. I will work out these implications, focussing on Rouse’s non-subject-centered account of scientific practices. More generally, I show how Rouse’s philosophy of science entails that the study of scientific education should take the form of an integrated history and philosophy of scientific education. (shrink)

Much of its moral, political, and social philosophy is concerned with the turbulent processes of embracing modern identities while protecting ancient cultures.

Studies in experimental philosophy claim to document intuition variation. Some studies focus on demographic group-variation; Colaçoet al., for example, claim that age generates intuition variation regarding knowledge attribution in a fake-barn scenario. Other studies claim to show intuition variation when comparing the intuition of philosophers to that of non-philosophers. The main focus has been on documenting intuition variation rather than uncovering what underlying factor(s) may prompt such a phenomenon. We explore a number of suggested explanatory hypotheses put forth by Colaçoet (...) al., as well as an attempt to test Sosa's claim that intuition variance is a result of people ‘filling in the details’ of a thought experiment differently from one another. We show (i) that people respond consistently across conditions aimed at ‘filling in the details’ of thought experiments, (ii) that risk attitude does not seem relevant to knowledge ascription, (iii) that people's knowledge ascriptions do not vary due to views about defeasibility of knowledge. Yet, (iv) we find no grounds to reject that a large proportion of people appear to adhere to so-called subjectivism about knowledge, which may explain why they generally have intuitions about the fake-barn scenario that vary from those of philosophers. When experimental philosophers carry out studies on thought experiments, some participants are excluded based on certain exclusion criteria, mirroring standard social science vignette methodology. This involves excluding people that do not pay attention or who miscomprehend the scenario presented in thought experiments. However, experimental philosophy studies sometimes exclude an alarmingly high number of participants. We argue that this threatens the external and internal validity of the conclusions being drawn and we show how a simple visualization of thought experiments can reduce (...) exclusion rates significantly. Furthermore, we argue that focus should not merely be on how many are excluded, but also why they are excluded, and we highlight the role of comprehension questions in this regard. Philosophical thought experiments often rely on the acceptance of certain key premises that may be regarded contestable, and asking comprehension questions involving such key assumptions could be problematic as that may result in some participants being inadvertently excluded from the study, potentially creating a selection bias.
