La prééminence que le libéralisme accorde aux libertés individuelles apparaît parfois comme un obstacle à la mise en œuvre de politiques environnementales contraignantes. Chez Rawls, cette prééminence s’incarne dans le principe de priorité de la liberté : on ne peut restreindre une des libertés de base qu’au nom de la liberté – et donc pas, semble-t-il, pour protéger l’environnement. Il est ici montré que ce principe, retouché à la suite d’une critique de Herbert L. A. Hart, autorise et même exige (...) plus de politiques écologiques qu’il n’y paraît. En outre, deux modestes aménagements internes de la théorie permettent d’en autoriser et exiger plus encore : considérer un environnement de qualité comme un bien premier, et un droit à un environnement de qualité comme une liberté de base. This article addresses the prioritization questions that arise when people attempt to institutionalize reasonable ethical principles and create guidelines for microlevel decisions. I propose that this instantiates an incommensurability problem, and suggest two different kinds of practical solutions for dealing with this issue.

Luc Faucher Dans cet article, je soulèverai un problème qui a été négligé jusqu’ici dans les écrits portant sur la philosophie de la psychiatrie au sujet du Research Domain Criteria : le fait que l’initiative découle des priorités de recherche du National Institute of Mental Health et que l’orientation de celles-ci ne permet pas de traiter certains aspects des conditions des patients qui sont jugés essentiels par ceux-ci. Après avoir démontré l’existence de ce problème, je vais tenter de voir par (...) quel moyen on pourrait l’éviter. Pour ce faire, je considérerai un programme, européen cette fois, le Roadmap for Mental Health Research in Europe et sa méthode pour intégrer une diversité de voix, dont celles des patients, dans le processus d’établissement des priorités de recherche. Je me livrerai ainsi à un exercice d’épistémologie sociale comparée en montrant comment certaines caractéristiques organisationnelles d’un des programmes possèdent des vertus épistémiques qui font défaut à l’autre et comment une plus grande justice épistémique pourrait être obtenue par l’implantation de certains mécanismes qui permettent à la voix des patients d’être entendue. This article addresses some ambiguities and normative problems with the concept of mature care in professional relationships and in health care priorities. Mature care has recently been introduced in the literature on care ethics as an alternative to prevailing altruistic conceptions of care. The essence of mature care is an emphasis on reciprocity, where the mature agent has the ability to balance the concerns of self with those of others and act from a principle of not causing harm. Our basic (...) claim is that the prevailing concept of mature care does not capture the real nature of professional relationships and role obligations in health care. As the focus of attention in professional care is and must be the patient’s particular medical and care needs, such care must principally be altruistic. Furthermore, we argue that mature care cannot adequately address moral conflict in health care without accepting some more principle-based approaches and a richer notion of partiality. (shrink)

To address substandard working conditions in global value chains, companies have adopted private regulatory systems governing worker rights. Scholars agree that without onsite factory audits, this private regulation has limited impact at the point of production. Companies, however, audit only a subset of their suppliers, severely restricting their private regulatory attempts. Despite the significance of the placement of suppliers inside or outside firms’ “responsibility boundaries” and despite scholars’ having called for more research into how firms prioritize what suppliers to audit, (...) few, if any, systematic studies have examined the topic. This is problematic, as the placement of firms’ responsibility boundaries determines what suppliers and workers are included in firms’ private regulatory attempts. Based on a study of 12 Swedish firms and the theory of moral disengagement, this paper starts to fill this research gap by exploring how firms’ responsibility boundaries are placed. The paper illustrates how firms’ responsibility boundary placement is best described as a patchwork with firms defining and delimiting their responsibilities differently. The paper also demonstrates that three supplier types are particularly likely to be placed inside firms’ responsibility boundaries, while a fourth type is likely be placed outside. (shrink)

Cet article est une comparaison de certaines affirmations ontologiques sur la nature de la matière première chez le platonicien de la Renaissance Marsilio Ficino et sur la nature de l’espace chez Frane Petrić, platonicien du XVIème siècle issu de la ville de Cres. J’y soutiens que les philosophies naturelles des deux platoniciens se ressemblent à deux égards, notamment en ce qui concerne le statut ontologique du substrat le plus fondamental du monde matériel. D’abord, Ficino comme Petrić soutiennent l’existence fondamentale de (...) la matière et de l’espace. Chapter 20 of Plotinus’ treatise VI, 2 [43] has received particular attention because it seems to deal with the Intellect. However, the connection of this chapter with chapter 19 is problematic insofar as the latter deals with the ways in which species are generated by the first genera. Our aim will be to show that chapter 20 can only be understood in the light of the notion of genus. More precisely, Plotinus’ aim in this chapter is to demonstrate the priority (...) of the genus over its species by means of the theory of double activity. In order to demonstrate this point, the notion of Intellect is introduced by Plotinus as a model (παράδειγμα) to conceive this priority. We will study successively these two chapters to justify this point, insisting on the link between them as well as on the reinterpretation of some key Aristotelian concepts. This study also shows that the use of the comparison with science allows Plotinus to justify the primacy of the intelligible totalities that are the Soul and the Intellect as well as the generation of their respective parts, the particular souls and the particular intellects. La priorité que la phénoménologie classique accorde à la première personne se voit déplacée de différentes manières par les penseurs post-phénoménologiques, dont Jacques Derrida. L’article a pour but d’indiquer la fonction stratégique qu’occupe dans la pensée derridienne la figure du témoin, que ce soit en tant que tiers qui déstabilise la métaphysique de la présence dans ses premiers écrits mais surtout, comme figure spéculative dans l’œuvre tardive, entre foi et savoir. Des remarques dispersées de Derrida sur le témoignage, on peut (...) dégager une petite grammaire du témoignage, avec ses trois paradoxes constitutifs: la substituabilité de l’insubstituable, la fondation de l’infondable, la répétition de l’irrépétible. En faisant apparaître la logique constitutive du témoignage, Derrida indique comment la figure du témoin en appelle à une complication de la phénoménologie, qu’on peut résumer par la notion de remédiation. Current planetary defense policy prioritizes a probability assessment of risk of Earth impact by an asteroid or a comet in the planning of detection and mitigation strategies and in setting the levels of urgency and budgeting to operationalize them. The result has been a focus on asteroids of Tunguska size, which could destroy a city or a region, since this is the most likely sort of object we would need to defend against. However a complete risk assessment would consider not (...) only the probability of an impact but also the magnitude of its consequences, which in the case of an object of Chicxulub size could be the end of civilization or even human extinction. This paper argues that a planetary defense policy based on a complete (or one could say genuine) risk assessment would justify expenditures much higher than at present. (shrink)

This article introduces a new pragmatic framework for dual character concepts and their expressions, offering an alternative to the received lexical‐semantic view. On the prevalent lexical‐semantic view, expressions such as “philosopher” or “scientist” are construed as lexical polysemes, comprising both a descriptive and a normative dimension. Thereby, this view prioritizes established norms, neglecting normative expressions emerging in specific contexts. In contrast, the pragmatic view integrates pragmatic modulation as a central element in explaining context‐dependent dual character concepts and expressions. ABSTRACT Catherine Malabou builds on neuroscience to offer a theory of the plasticity of the brain, arguing that trauma holds transformative potential. This article argues, however, that her theory prioritizes resilience in the face of episodic moments of violence and trauma, which undertheorizes the trauma of chronic conditions experienced by racialized, particularly Black, subjects. Instead, this article turns to Christina Sharpe’s theory of wake work and, more specifically, Black annotation and Black redaction, to demonstrate how, in the wake of transatlantic (...) slavery, there is space for the collective disruption of symbolic structures to generate openings for imagining and circulating alternative possibilities to the hegemonic institutions of the past and present. Contrasting Malabou’s focus on the transformation of the brain during episodic violence and trauma, this article contends that Sharpe may demonstrate the possibility of plasticity in form and the symbolic in quotidian experiences and practices. Cette étude essaye d’établir qu’il y a deux notions très différentes de « fondation » à l’œuvre dans les Recherches logiques de Husserl. Dans la IIIème Recherche, où le terme est formellement introduit, lorsqu’il se demande quels sont les contenus qui peuvent exister d’une manière autonome (indépendants) et lesquels peuvent exister uniquement en tant que moments d’autre chose (dépendants), Husserl suit ce que j’appelle un « modèle ontologique ». Selon ce modèle, le concret possède une priorité sur à l’abstrait qui (...) est fondé en lui. Dans la VIème Recherche, en revanche, Husserl s’oriente principalement sur un « modèle gnoséologique » qui voit le complexe comme fondé sur ce qui est relativement simple, étant donné que les expériences d’ordre supérieur (telles les perceptions de types d’objets plus complexes) sont « fondées sur » des expériences plus simples, bien qu’elles ne puissent pas y être réduites. L’exemple principal ici est celui des intuitions catégoriales : fondées sur les intuitions sensibles, elles n’y sont pas réductibles. Mais cette distinction entre deux sens différents du terme de « fondation » peut également nous aider à mieux comprendre de nombreuses thèses husserliennes plutôt controversées. Par exemple, elle peut nous permettre de mieux comprendre dans quelle mesure faire l’expérience d’un être humain comme un tout se fonde sur l’expérience d’un corps physique, et cela même si l’étant que nous rencontrons inclut à la fois des aspects corporels et des aspects spirituels – les deux étant vus, d’une manière essentielle, comme des moments de cette unique personne qui fait l’objet de notre expérience. Law, Economics, and Morality examines the possibility of combining economic methodology and deontological morality through explicit and direct incorporation of moral constraints into economic models. Economic analysis of law is a powerful analytical methodology. However, as a purely consequentialist approach, which determines the desirability of acts and rules solely by assessing the goodness of their outcomes, standard cost-benefit analysis is normatively objectionable. Moderate deontology prioritizes such values as autonomy, basic liberties, truth-telling, and promise-keeping over the promotion of good outcomes. It (...) holds that there are constraints on promoting the good. Such constraints may be overridden only if enough good is at stake. While moderate deontology conforms to prevailing moral intuitions and legal doctrines, it is arguably lacking in methodological rigor and precision. Eyal Zamir and Barak Medina argue that the normative flaws of economic analysis can be rectified without relinquishing its methodological advantages and that moral constraints can be formalized so as to make their analysis more rigorous. They discuss various substantive and methodological choices involved in modeling deontological constraints. Zamir and Medina propose to determine the permissibility of any act or rule infringing a deontological constraint by means of mathematical threshold functions. Law, Economics, and Morality presents the general structure of threshold functions, analyzes their elements and addresses possible objections to this proposal. It then illustrates the implementation of constrained CBA in several legal fields, including contract law, freedom of speech, antidiscrimination law, the fight against terrorism, and legal paternalism. Neoclassical and Austrian/evolutionary economic paradigms have different implications for integrating corporate social responsibility (corporate citizenship) and competitive strategy. porter's "Five Forces" model implicitly rests on neoclassical theory of the firm and is not easily reconciled with corporate social responsibility. Resource-based models of competitive strategy do not explicitly embrace a particular economic paradigm, but to the extent their conceptualization rests on neoclassical assumptions such as imperfect factor markets and profits as rents, these models also imply a trade-off between competitive advantage and (...) corporate social responsibility. Differences in Austrian/evolutionary economic model's assumptions about equilibrium, profits, and other economic concepts allow this paradigm to embrace alternative views of strategy such as the activities or dynamic capabilities views. These alternative views of strategy focus on learning and adaptation; they align more easily with corporate social responsibility. In practice this alignment comes about because social engagement facilitates the learning and adaptation that are a source of competitive advantage. Among the many business arguments for CSR such as improved employee morale/productivity or brand differentiation, this view prioritizes innovation. (shrink)

Selon Deleuze, l'art est nécessaire au philosophe pour penser sa propre condition. En effet, pour échapper à la représentation qui dénature et assujettit la pensée, la philosophie exige un détour par l'art qui transforme à la fois l'exercice de la pensée et les conditions de l'expérience. L'usage (...) de l'art, c'est ce que fait l'art. L'art capte des forces (il rend visibles des forces invisibles) et transforme, à la fois, l'artiste et le corps social (il bouleverse les manières de sentir et de penser). Cette nouvelle manière de penser et d'user de l'art déborde le cadre habituel des études esthétiques. Il s'agit ici d'établir une périodisation de la question de l'art dans l'oeuvre de Deleuze, en fonction des problèmes qu'il pose. On retiendra trois périodes qui sont trois philosophies de l'art : la première accorde la priorité à la littérature ; la deuxième opère le passage du littéraire au sémiotique, en mettant en lumière le rôle politique de l'art ; et la troisième élabore une sémiotique de l'image, à partir de la peinture et du cinéma. In On the Difficulty of Living Together, Manuel Cruz launches a nuanced study of memory and forgetting, defining their forms and uses, political meanings, and social and historical implications. Memory is not an intrinsically positive phenomenon, he argues, but an impressionable and malleable one, used to advance a variety of agendas. Cruz focuses on five memory models: that which is inherently valuable, that which legitimizes the present, that which supports retributive justice, that which is essential to mourning, and that which (...) elicits renunciation or revelation. His methodical approach makes sense of memory's positive and negative effects, its contradictions, and its tensions. Cruz shows us that remembering is not necessarily an end in itself, nor is it a supreme value, immune to external influence. The exercise of memory guarantees nothing, though many insist it is a progressive act preventing the repetition of past mistakes. Tying the making of memory to the movements of history, Cruz prioritizes memory's political dimensions over its philosophical aspects and helps us remember its myriad uses. (shrink)

Mais peut-on dire de Dieu qu'il est libre sans questionner la liberté propre à l'homme? Entre l'absolue liberté de l'absolu et la difficile liberté de l'homme, laquelle a la priorité? An ICU and Palliative Care specialist featured in the Netflix documentary Extremis offers a framework for a better way to exit life that will change our medical culture at the deepest level In medical school, no one teaches you how to let a patient die. Jessica Zitter became a doctor because she wanted to be a hero. She elected to specialize in critical care--to become an ICU physician--and imagined herself swooping in to rescue patients from the brink of death. Agent-based models (ABMs) are one of the main sources of evidence for decisions regarding mitigation and suppression measures against the spread of SARS-CoV-2. These models have not been previously included in the hierarchy of evidence put forth by the evidence-based medicine movement, which prioritizes those research methods that deliver results less susceptible to the risk of confounding. We point out the need to assess the quality of evidence delivered by ABMs and ask the question of what is the risk that (...) assumptions entertained in ABMs do not include all the key factors and make model predictions susceptible to the problem of confounding. This chapter introduces W.E.B. Du Bois’s original political thought and his strategies for political advocacy. It is limited to explaining the pressure he puts on the liberal social contract tradition, which prioritizes the public values of freedom and equality for establishing fair and inclusive terms of political membership. However, unlike most liberal theorists, Du Bois’s political thought concentrates on the politics of race, colonialism, gender, and labor, among other themes, in order to redefine how political theorists and activists should build (...) a democratic polity that is truly free and equal for all. Additionally, this chapter defines some key concepts Du Bois developed to scrutinize a white-controlled world that does not welcome black and brown persons as moral equals. These trailblazing concepts include: the doctrine of racialism, double consciousness, and Pan-Africanism. Finally, this chapter defends Du Bois’s contributions to black feminist thought and American labor politics, which inspired major social justice movements in the twentieth century, in which he played a notable role. Within the United States, the most prominent justification for criminal punishment is retributivism. This retributivist justification for punishment maintains that punishment of a wrongdoer is justified for the reason that she deserves something bad to happen to her just because she has knowingly done wrong—this could include pain, deprivation, or death. For the retributivist, it is the basic desert attached to the criminal’s immoral action alone that provides the justification for punishment. This means that the retributivist position is not reducible (...) to consequentialist considerations nor in justifying punishment does it appeal to wider goods such as the safety of society or the moral improvement of those being punished. A number of sentencing guidelines in the U.S. have adopted desert as their distributive principle, and it is increasingly given deference in the “purposes” section of state criminal codes, where it can be the guiding principle in the interpretation and application of the code’s provisions. Indeed, the American Law Institute recently revised the Model Penal Code so as to set desert as the official dominate principle for sentencing. And courts have identified desert as the guiding principle in a variety of contexts, as with the Supreme Court’s enthroning retributivism as the “primary justification for the death penalty.” While retributivism provides one of the main sources of justification for punishment within the criminal justice system, there are good philosophical and practical reasons for rejecting it. One such reason is that it is unclear that agents truly deserve to suffer for the wrongs they have done in the sense required by retributivism. In the first section, I explore the retributivist justification of punishment and explain why it is inconsistent with free will skepticism. In the second section, I then argue that even if one is not convinced by the arguments for free will skepticism, there remains a strong epistemic argument against causing harm on retributivist grounds that undermines both libertarian and compatibilist attempts to justify it. I maintain that this argument provides sufficient reason for rejecting the retributive justification of criminal punishment. I conclude in the third section by briefly sketching my public health-quarantine model, a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. I argue that the model is not only consistent with free will skepticism and the epistemic argument against retributivism, it also provides the most justified, humane, and effective way of dealing with criminal behavior. The view that narrative artworks can offer insights into our lives, in particular, into the nature of the emotions, has gained increasing popularity in recent years. However, talk of narrative often involves reference to a perspective or point of view, which indicates a more fundamental mechanism at work. In this article, I argue that our understanding of the emotions is incomplete without adequate attention to the perspectival structures in which they are embedded. Drawing on Bennett Helm’s theory of emotion, I (...) argue that the narrative view fails to take into account the influence of perspective on the emotions. In order to address this gap in our understanding of the emotions, I highlight a mode of engagement with literature that prioritizes the perspectival features of a work. Focusing on lyric poetry, I argue that non-narrative artworks are those best placed to highlight this fundamental aspect of our emotional experiences. (shrink)

It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...) to belong to the non-representational wing of cognitive science, predictive processing has a representational profile. And secondly, because they exhibit different explanatory strategies: while Sensorimotor Enactivism prioritizes the interactions of the embodied agent, predictive processing has internalist commitments. The aim of this paper is to address these concerns and show that a predictive approach to Sensorimotor Enactivism is viable. More specifically, I focus on the Free-Energy approach, a theory that falls within the ballpark of predictive processing. In this paper I argue for the following claims. I argue that both Sensorimotor Enactivism and the Free-Energy approach may be understood for some systems in representational terms. The non-representational reading of Sensorimotor Enactivism is not mandatory and neither is the representational reading of the Free-Energy approach. Sensorimotor Enactivism is, in this respect, compatible with both representational and non-representational interpretations of the FEA. So, the position towards representations of these frameworks should not stand in the way of a predictive approach to Sensorimotor Enactivism. I also show that the Free-Energy approach allows for an account that prioritizes the interaction of the embodied agent with the environment. This is the explanatory strategy followed by Sensorimotor Enactivism. To justify this strategy and following other proponents of Sensorimotor Enactivism, I argue that by referring to the interactions of the embodied agent a better account of the phenomena in question is provided. On this basis, I claim that Sensorimotor Enactivism and the Free-Energy approach are compatible in what concerns their explanatory strategy as well. One of the most frequently voiced criticisms of free will skepticism is that it is unable to adequately deal with criminal behavior and that the responses it would permit as justified are insufficient for acceptable social policy. This concern is fueled by two factors. The first is that one of the most prominent justifications for punishing criminals, retributivism, is incompatible with free will skepticism. The second concern is that alternative justifications that are not ruled out by the skeptical view per (...) se face significant independent moral objections (Pereboom 2014: 153). Despite these concerns, I maintain that free will skepticism leaves intact other ways to respond to criminal behavior—in particular incapacitation, rehabilitation, and alteration of relevant social conditions—and that these methods are both morally justifiable and sufficient for good social policy. The position I defend is similar to Derk Pereboom’s (2001, 2013, 2014), taking as its starting point his quarantine analogy, but it sets out to develop the quarantine model within a broader justificatory framework drawn from public health ethics. The resulting model—which I call the public health-quarantine model (Caruso 2016, 2017a)—provides a framework for justifying quarantine and criminal sanctions that is more humane than retributivism and preferable to other non-retributive alternatives. It also provides a broader approach to criminal behavior than Pereboom’s quarantine analogy does on its own since it prioritizes prevention and social justice. -/- In Section 1, I begin by (very) briefly summarizing my arguments against free will and basic desert moral responsibility. In Section 2, I then introduce and defend my public health-quarantine model, which is a non-retributive alternative to criminal punishment that prioritizes prevention and social justice. In Sections 3 and 4, I take up and respond to two general objections to the public health-quarantine model. Since objections by Michael Corrado (2016), John Lemos (2016), Saul Smilanksy (2011, 2017), and Victor Tadros (2017) have been addressed in detail elsewhere (see Pereboom 2017a; Pereboom and Caruso 2018), I will here focus on objections that have not yet been addressed. In particular, I will respond to concerns about proportionality, human dignity, and victims’ rights. I will argue that each of these concerns can be met and that in the end the public health-quarantine model offers a superior alternative to retributive punishment and other non-retributive accounts. The medical profession contains five “spheres of morality”: clinical care, clinical research, scientific knowledge, population health, and the market. These distinct sets of normative commitments require physicians to act in different ways depending on the ends of the activity in question. For example, a physician-scientist emphasizes patients’ well-being in clinic, prioritizes the scientific method in lab, and seeks to maximize shareholder returns as a board member of a pharmaceutical firm. Physicians increasingly occupy multiple roles in healthcare and move between them (...) frequently, creating the possibility of conflict between the ethical obligations of their various roles. This paper examines the entire moral landscape of medicine through the lens of role morality. It develops a novel framework that helps physicians recognize how their moral commitments depend on the nature and context of the situation, clarifies ethical conflicts that physicians face, and concludes with ideas for resolving these conflicts. It would be unwise to dismiss the possibility of human brain organoids developing sentience. However, scepticism about this idea is appropriate when considering current organoids. It is a point of consensus that a brainstem-dead human is not sentient, and current organoids lack a functioning brainstem. There are nonetheless troubling early warning signs, suggesting organoid research may create forms of sentience in the near future. To err on the side of caution, researchers with very different views about the neural basis of (...) sentience should unite behind the “brainstem rule”: if a neural organoid develops or innervates a functioning brainstem that registers and prioritizes its needs, regulates arousal, and leads to sleep-wake cycles, then it is a sentience candidate. If organoid research leads to the creation of sentience candidates, a moratorium or indefinite ban on the creation of the relevant type of organoid may be appropriate. A different way forward, more consistent with existing approaches to animal research, would be to require ethical review and harm-benefit analysis for all research on sentience candidates. (shrink)

The texts written by Huayan thinkers are characterized by rather unintelligible expressions that identify the one with the many. Such an identity thesis can be justified by the fact that all individual objects in the world are based on the common principle of emptiness (Skt. śūnyatā). But we need to take into consideration the fact that Huayan thought emerged from the typical Chinese attitude that appreciates the inherent value of every phenomenal object. Thus the relationship between the one and the (...) many in Huayan thought can be understood in terms of the parts and the whole composed of such parts. Generally speaking, Buddhist literature in the early phase seems to represent the so-called mereological reductionism because it aims at revealing that the concept of “I” or “person” as a whole is illusory. Huayan thought points out, however, that the parts and the whole are equally significant and mutually dependent. Furthermore, it identifies the parts with the whole by showing the existence of parts of an object is a necessary and sufficient condition for that of the object as a whole. It is important to note here that Huayan thought does not simply indulge in metaphysical speculations but emphasizes its soteriological purport that an initial stage of practice contains its whole process. Although Huayan thought has been often dubbed as a philosophy of totality and considered to uphold totalitarianism, such a misunderstanding could be redressed by a survey conducted in this paper. Furthermore, since Huayan thought does not posit a singular and ultimate cause but prioritizes each and every individual, it should be seen as having a profound practical significance in this polarized society. 화엄사상가들의 저작에서 우리는 일(一)과 다(多) 사이에 동일성의 관계가 성립한다는 다소 이해하기 어려운 표현을 자주 발견한다. 그러한 동일성의 관계는 모든 개별적 사물들이 공(空)이라고 하는 공통된 이치에 기반하고 있기 때문에 성립하는 것이기도 하지만, 그 관계를 해석하는 데 있어서 우리는 모든 현상적 대상들의 고유한 가치를 인정하는 중국적 태도에서 화엄사상이 출현했다는 점을 고려할 필요가 있다. 따라서 화엄사상에서 일과 다 사이의 관계는 어떠한 하나의 현상적 대상 전체와 그것을 구성하는 부분들 사이의 관계를 가리킨다고 볼 수 있다. 일반적으로 초기불교의 문헌에서는 여러 요소들이 결합된 총체로서의 ‘나’ 또는 ‘인간’이라는 개념의 허구성을 지적하기 위하여 전체를 부분들로 환원하여 전체라는 것이 개념적 허구임을 보이는 부분론적 환원주의(mereological reductionism)를 채택하는 경향이 있었다. 그러나 화엄사상은 부분과 전체가 모두 유의미할 뿐만 아니라 아니라 상호 의존적임을 지적하고, 더 나아가 어떤 대상의 부분들은 그 대상 전체의 성립을 위한 필요충분조건임을 보임으로써 부분과 전체를 동일시한다. 그러나 화엄사상의 이러한 입장은 순전히 형이상학적 사변에만 머물지 않고 수행의 최초의 단계에 그것의 전과정이 포함되어 있다는 실천론적 의미를 내포하고 있다는 점에 유의해야 한다. 이러한 고찰을 통해 우리는 화엄사상을 흔히 전체성의 철학(philosophy of totality)이라고 규정함으로써 그것을 마치 전체주의를 옹호하는 것처럼 오도하는 경향을 바로잡을 수 있을 것이다. 또한 화엄사상은 어떠한 단일하고 궁극적인 원인을 상정하지 않고 각각의 개별자들을 우선시한다는 점에서 다원화된 사회에서 더욱 적합한 실천론적 의미를 가지고 있다고 할 수 있다. Sociology has largely followed Durkheim’s lead in ignoring the question: why do people die by suicide? This negation prioritizes a positivist, structuralist approach and stymies sociology’s contribution by closing off a wide range of tools sociologists might employ. An interpretivist turn in suicide studies accompanied by the growing adoption of qualitative methodology has opened up an array of opportunities to produce insights lost in a Durkheimian approach, but has yet to confront their own weaknesses. There are a number of important links and similarities between public health and safety. In this extended essay, Gregg D. Caruso defends and expands his public health-quarantine model, which is a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. In developing his account, he explores the relationship between public health and safety, focusing on how social inequalities and systemic injustices affect health outcomes and crime rates, how poverty affects brain (...) development, how offenders often have pre-existing medical conditions (especially mental health issues), how involvement in the criminal justice system itself can lead to or worsen health and cognitive problems, how treatment and rehabilitation methods can best be employed to reduce recidivism and reintegrate offenders back into society, and how a public health approach could be successfully applied within the criminal justice system. Caruso's approach draws on research from the health sciences, social sciences, public policy, law, psychiatry, medical ethics, neuroscience, and philosophy, and he delivers a set of ethically defensible and practically workable proposals for implementing the public health-quarantine model. The essay begins by discussing recent empirical findings in psychology, neuroscience, and the social sciences that provide us with an increased understanding of the social and neurological determinants of health and criminal behavior. It then turns to Caruso's public health-quarantine model and argues that the model provides the most justified, humane, and effective approach for addressing criminal behavior. Caruso concludes by proposing a capability approach to social justice grounded in six key features of human well-being. He argues that we cannot successfully address concerns over public health and safety without simultaneously addressing issues of social justice—including the social determinants of health (SDH) and the social determinants of criminal behavior (SDCB)—and he recommends eight general policy proposals consistent with his model. The dramatic events of the crisis have reignited debates on the independence of central banks and the scope of their mandates. In this article, I contribute to the normative understanding of these developments by discussing John Rawls’s position in debates of the 1950s and 1960s on the independence of the US Federal Reserve. Rawls’s account of the central bank in his property-owning democracy, Democratic Central Banking, assigns authority over monetary policy directly to the government and prioritizes low unemployment over price (...) stability. I contrast DCB with Central Bank Independence, which requires that the central bank is independent of the government and pursues low inflation. I evaluate DCB by asking whether justice as fairness requires democratic control of the central bank and argue that it does not. Instead, so I argue, the choice between DCB and CBI should be justified in terms of the difference principle. By reflecting on central banking in a property-owning democracy, I cast new light on the Rawlsian realistic utopia of a just capitalist society, while also investigating democratic objections to today’s independent central banks. To what extent should we focus on implicit bias in order to eradicate persistent social injustice? Structural prioritizers argue that we should focus less on individual minds than on unjust social structures, while equal prioritizers think that both are equally important. This article introduces the framework of transactive memory into the debate to defend the equal priority view. The transactive memory framework helps us see how structure can emerge from individual interactions as an irreducibly social product. If this is right, (...) then debiasing interventions are structural interventions. One upshot is that the utility of the individual versus structural distinction is not apparent for the purposes of intervention. (shrink)

ABSTRACT:While tone at the top is widely regarded as an important predictor of ethical behavior in organizations, we argue that recent research overlooks the various conflicting ethical tones present in many multi-organizational work settings. Further, we propose that the resolution processes promulgated in many firms and professional associations to reconcile this conflict reinforce the tone at the bottom or a tone at the top of the employee’s organization, and that both of these approaches can conflict with the tone at the (...) top of other important organizations such as professional and regulatory organizations. Here we adapt Integrative Social Contract Theory’s priority rules to propose a multi-tone reconciliation process which prioritizes conflicting ethical tones based upon features of the organization and the effects on society. Using three contextualizations, we demonstrate the effectiveness of the multi-tone reconciliation process over current processes. We conclude with recommendations for future research and implications for practice. (shrink)

Many accounts of the historical development of neurological criteria for determination of death insufficiently distinguish between two strands of interpretation advanced by advocates of a "whole-brain" criterion. One strand focuses on the brain as the organ of integration. Another provides a far more complex and nuanced account, both of death and of a policy on the determination of death. Current criticisms of the whole-brain criterion are effective in refuting the first interpretation, but not the second, which is advanced in the (...) 2008 President's Council report on the determination of death. In this essay, I seek to further develop this second strand of interpretation. I argue that policy on determination of death aligns moral, biological, and ontological death concepts. Morally, death marks the stage when respect is no longer owed. Biologically, death concerns integrated functioning of an organism as a whole. But the biological concepts are underdetermined. The moral concerns lead to selection of strong individuality concepts rather than weak ones. They also push criteria to the "far side" of the dying process. There is a countervailing consideration associated with optimizing the number of available organs, and this pushes to the "near side" of death. Policy is governed by a conviction that it is possible to align these moral and biological death concepts, but this conviction simply lays out an agenda. There is also a prescription—integral to the dead donor rule—that lexically prioritizes the deontic concerns and that seeks to balance the countervailing tendencies by using science-based refinements to make the line between life and death more precise. After showing how these concerns have been effectively aligned in the current policy, I present a modified variant of a "division" scenario and show how an "inverse decapitation problem" leads to a conclusive refutation of the nonbrain account of death. The United Nations Global Compact is one of the largest transnational governance schemes. Its success or failure, however, is a matter of debate. Drawing on research in cognitive linguistics, we argue that when evaluators discuss the UNGC, they apply the metaphorical concept of the family: the UNGC corresponds to the “family,” the UNGC headquarter to the “parent” and the business participants of the UNGC to the “children” of the family. As a corollary, evaluators’ implicit understanding of how a family is (...) best organized sets different benchmarks against which the governance structure of the UNGC is assessed. We describe two ideal models of “educating” UNGC business participants. Critics of the UNGC adopt a “strict father” model of transnational governance based on the idea that the proper education of inherently “bad” business firms necessitates obedience, discipline and punishment in case firms are non-compliant. In contrast, the UNGC’s advocates follow a “nurturant parent” model, which prioritizes empathy, learning and nurturance to support the moral development of “good” business firms. We develop the “UNGC-as-family” metaphor, explore its implications for transnational governance and discuss under what conditions these idealized models can serve as appropriate guidelines for TGSs. Specifically, we posit that following the behavioral prescriptions of the “strict father” model may, under certain conditions, jeopardize the organizational embedding and institutionalization of UNGC principles, and explain when and why it may be in the best interest of the UNGC and civil society to embrace the instructions of the “nurturant parent” model of transnational governance.
