Thirty years after the publication of Dominique Janicaud’s criticism of what he termed the “theological turn” of phenomenology in France, what is the state of the debate? This paper addresses that question, by examining the phenomenology of revelation in Marion, Lacoste, and others, in turn replying to various arguments that have been advanced against the theological turn and on behalf of methodological atheism. This paper argues that those who emphasise that designers and engineers need to plan for obsolescence are too conservative. Rather, in addition to planning for obsolescence, designers and engineers should also think carefully about what they could do in order delay obsolescence. They should so this by thinking about the design itself, thinking of ways in which products could be useful and appealing for longer before becoming obsolete, as well thinking about the wider context in terms of the marketing (...) of products, and also the social and legal. The paper also considers objections that these suggestions are unrealistically idealistic, failing to recognise the economic realities. I respond to these objections appealing to research in advertising, psychology, cognitive linguistics, philosophy, history, and economics, as well as drawing on the Statement of Ethical Principles developed by the Royal Academy of Engineering and the Engineering Council. In three respects, ethics can be marked by the category of the ‘priceless’. Its key reference point, ‘human dignity’, was described by Kant as the exact opposite to what can be priced in equivalents. As an enterprise, ethics is ‘priceless’ as a commitment of the human spirit which goes beyond and against the attitude of success calculation. Yet, an understanding of ethics as unconditional recognition and the anticipatory, asymmetric, innovative praxis (Helmut Peukert) that expresses it have a cost. Where does (...) the motivation to forego, for example, ethically problematic therapies, originate? How can respect for what is priceless be sustained in the face of the relentless spread of market categories diagnosed, among others, by Jürgen Habermas and Paul Ricoeur, against which religions may raise a delaying veto? Only a Christology that can adequately conceptualise the experience of the graciousness and superabundance of God’s gift is able to support the increasingly counter-cultural conviction of something beyond our disposition. Delay in seeking medical services is common in elderly populations, which leads to disease progression and life difficulty. This study aims to assess the prevalence of delay in medical visits and treatment and define associated effects and factors in patients with senile cataract, which may help obtain a better understanding of late-life psychopathology and provide the basis for interventions. Patients aged more than 60 years were prospectively recruited in Zhongshan Ophthalmic Center. All participants were diagnosed with binocular senile (...) cataract and decided to have primary surgery in ZOC. The distributions of the popularity of delaying outpatient visits and treatment, the degrees of visual impairment, the influences on quality of life, and the reasons for delaying treatment among participants were accessed by the descriptive statistics. Factors associated with the perceptions of cataract treatment were accessed using a binary logistic regression model. A total of 400 senile patients aged from 60 to 94 years were enrolled. At diagnosis, 82 participants had a low vision with monocular acuity of both eyes below 0.05. All participants have felt that their normal lives were affected, and 64 participants felt that their lives were affected severely. Only 17 participants have sought for medical services immediately after feeling vision loss, and 294 participants have felt vision loss since a year ago before seeking medical help. A total of 298 participants have delayed the surgery time, and 229 patients delayed it for more than 12 months. There were 147 participants delaying surgery on account of no knowledge about it and 114 participants delaying surgery because of fear. There are a high proportion of elderly patients with senile cataract delaying their outpatient visits and surgery treatment, whose normal lives were severely affected. Increasing medical service propaganda about cataract and other common diseases in elderly populations would probably be helpful for improving perceptions of diseases and decreasing medical delays. Public needs to draw more attention to the healthy and medical status of the elderly ocular patients. (shrink)

Bearing on mind the idea of the proverb “Justice Delayed is Justice Denied” Macedonian Legislator within the new Code of Criminal Procedure has introduced several legal mechanisms for accelerating the criminal procedure. The most important instruments among them, by all means, are the Guilty Plea and Sentence Bargaining. In this article, the author elaborates the practical implementation of these CPC’s provisions and performs analysis of its implementation by the Basic Court Skopje 1 in Skopje, as the biggest and most caseload-burdened (...) court in Macedonia, and by the Public Prosecution Office in Skopje. The analysis discovered several weak points, which should be properly addressed, both through theoretical scrutiny and through introduction of amendments to the CPC or through production of a general opinion by the Supreme Court. Only through these amendments to the legal provisions of the CPC can be expected to have improved court practice in a manner which would accentuate the real/just benefits of these instruments for accelerating of the criminal procedure. Several conclusions and suggestions for improvement or specific issues, which were determined as problematic were developed, such as: tackling the impact of a guilty plea by one of the codefendants to the other codefendants who did not plead guilty; treatment of the altered statement by one of the codefendants during the plea agreement and its use against the other codefendant; and the burden of proof and amount of evidence which is necessary to support the sentence bargaining process. Brain death certification can be a clinically and ethically challenging affair. Healthcare workers are expected to refer patients for brain death certification to identify potential organ donors, but family members may be ill-prepared for this turn of events. Already distraught families may not appreciate delays in brain death certification, but such delays are common because of the need to manage the patient’s altered physiological state to allow testing. Opportunities for donation are sometimes lost because of the unnecessary delay. With (...) focus on an opt-out organ donation law, we discuss causes of delays in brain death certification, and the ethical issues faced by clinicians in using tests to certify patients. To resolve the issues, we argue for the use of supplementary confirmatory tests as part of a more protocol-driven approach to brain death certification to avoid delays. Ein Topos in institutionellen Stellungnahmen zu „Genome Editing am Menschen“ ist die Forderung nach einem Moratorium. Dieses soll einerseits dazu dienen, zu einer angemessenen Risikoabklärung zu gelangen, und andererseits einer gesellschaftlichen und ethischen Diskussion hinreichend Raum zu geben, um zu entscheiden, ob die vom Moratorium betroffenen Eingriffe überhaupt grundsätzlich erwünscht sind. Dabei scheint das Moratorium eine kompromisshafte Lösung zu sein, auf die sich die Mitglieder in weltanschaulich pluralen Ethikgremien verständigen können. Die Analyse der zu Genome Editing in den Jahren 2015 (...) bis 2018 verfassten Stellungnahmen zeigt jedoch ein deutlich komplexeres Bild: Was als konsensuale Kompromissformel erscheint, stellt sich als vielfach konflikthaftes Lösungsmodell dar. Umstritten ist in den unterschiedlichen Moratoriumsmodellen der Umfang (was alles ist vom Moratorium betroffen?), die Dauer (gibt es ein konkretes Datum, bis zu dem das Moratorium gilt?), der Zweck (dient es bloß der Risikoabschätzung oder auch der ethischen und/oder gesamtgesellschaftlichen Diskussion?) und die Frage, was für eine Maßnahme am Ende des Moratoriums getroffen werden soll. Zudem ist zwischen impliziten und expliziten Moratorien zu unterscheiden und zu untersuchen, was mit dem Moratoriumsvorschlag jeweils nicht verursacht werden soll (zum Beispiel die Grundlagenforschung einschränken). Am Ende der ethischen Analyse zeigt sich, dass mit klarer bestimmten Moratoriumsforderungen ein stärkeres Bewusstsein des Aufschub-Charakters dieser spezifischen Empfehlung einhergeht. So lässt sich auch das Ethos der Verantwortlichkeit – gegenüber jetzt Lebenden sowie künftigen Generationen – besser realisieren. (shrink)

Biotechnological advance is speeding the development of drugs. The approval processes for new drugs will inevitably involve a regulatory agency in making political-economic and scientific choices. Interests of specific patients and the public in general are to be considered, and enormous stakes are involved for companies concerned. A medical regulatory authority must be at once insulated from and responsive to many different mixes of singular and general interests and pressures. Access to new drugs can be spurred by the press of (...) patient advocacy groups, but if there are well organized groups to monitor the testing and approval process for such as AIDS or cancer drugs there is often no similar group to represent patient needs. If there is no organized patient advocacy group, compassionate responsibility by a medical regulatory authority is indeed called for. Delay in the approval of new drugs for fighting severe blood infections raises the question of how to insure the compassionate responsibility of a regulatory authority. (shrink)

As things stand today, whether we like it or not, industry funding is on the upswing. The whole enterprise of medicine in booming, and it makes sense for industry to invest more and more of one's millions into it. The pharmaceutical industry has become the single largest direct funding agency of medical research in countries like Canada, the United Kingdom and the United States. Since the goals of industry and academia differ, it seems that conflicts of interest are inevitable at (...) times. The crucial decision is whether the public welfare agenda of academia, or the corporate research agenda of industry, should occupy center stage when they conflict. There is enough evidence to show that funding by industry is very systematic, and results that are supportive of the safety and efficacy of sponsor's products alone get the funds. It is no surprise, therefore, that one finds very few negative drug trials reports published, and whatever are, are likely to be by rival companies to serve their commercial interests. Renewed and continued funding by industry decides the future prospects of many academic researchers. At the same time there is now evidence that pharmaceutical companies attempt suppression of research findings, may be selective in publishing results, and may delay or stymie publication of unfavourable results. This is a major area of concern for all conscientious researchers and industry watchers. Industry commonly decides which clinical research/trial gets done, not academia, much though the latter may wish to believe otherwise. It finds willing researchers to carry this out. This can be one area of concern. Another area of pressing concern is when industry decides to both design and control publication of research. It makes sense for researchers to refuse to allow commercial interests to rule research reporting. Research having been reported, the commercial implications of such reporting is industry's concern. But, doctoring of findings to suit commerce is to be resisted at all costs. In this even pliant researchers need have no fear, for if they indeed publish what will work, the concerned sponsor will benefit in the long run. The only decision academia has to make is refuse to comply with predestined conclusions of sponsors for the 'thirty pieces of silver'. Instead do genuine research and make sixty for themselves. The useful rule of thumb is: Keep the critical antenna on, especially with regard to drug trials, and more especially their methodology, and study closely the conflict of interest disclosed, and if possible undisclosed, before you jump on the band wagon to herald the next great wonder drug. There are three important lessons to be learnt by academia in all academia-industry relationships: i) Lesson number one: incorporate the right to publish contrary findings in the research contract itself. Which means, it makes great sense for academia to concentrate on the language and contractual provisions of sponsored research, to read the fine print very closely, and protect their research interests in case of conflict. ii) Lesson number two: a number of lawsuits successfully brought up against industry recently reflect earnest attempts by patient welfare bodies and others to remedy the tilt. It will result in a newfound confidence in academia that augurs well for academia industry relationship in the long run. Hence the second lesson for academia: do not get browbeaten by threats of legal action iii) Lesson number three: Academia should keep itself involved right from inception of the clinical trial through to ultimate publication. And this must be an integral part of the written contract. The time to repeat cliches about the exciting future of the academia-industry connect is past. A concerted effort to lay a strong foundation of the relationship on practical ethical grounds has become mandatory. (shrink)

Although employed throughout health-related rhetoric and research today, prevention it is an ambiguous and complicated category when applied to mental and behavioral health. It is analyzed here, along with four ethical issues arising when public health preventative methods and goals involve mental health: age of intervention; resource priorities between prevention and treatment; substantive issues in preventive pedagogies and trade-offs framed by differences of approach. Illustrations include some of the most widespread and ambitious recent preventive models: those aiming to avert subsequent (...) mood disorders of depression and anxiety; those that would curb self-harming behavior, and efforts to anticipate and avoid or delay psychosis. To suppose that public mental health can be entirely modeled on other public health programs is mistaken. Instead, it must proceed with awareness of the particular features typifying many mental disorders. These include features of the disorders themselves; the preliminary nature of scientific knowledge about them; the contested applicability of traditional disease models to them; the dearth of established research data available about preventive interventions currently in place or proposed; and the effects of stigma and discrimination on any such interventions. Patient referral management is an integral part of clinical practice. However, in low-resource settings, referrals are often delayed. The World Health Organization categorizes three types of referral delays; delay in seeking care, in reaching care and in receiving care. Using two case studies of maternal referrals (from a low-resource state in India), this article shows how a culture of downstream blaming permeates referral practice in India. With no referral guidelines to follow, providers in higher-facilities evaluate the clinical decision-making of (...) their peers in lower-facilities based on patient outcome, not on objective measures. The fear of punitive action for an unfavorable maternal outcome is a larger driving factor than patient safety. The article argues for the need to formulate an ecosystem where patient responsibility is shared across the health system. In conclusion, it discusses possible solutions which can bridge communication and information gap between referring facilities. (shrink)

If the present generation refuses to bear the burden of mitigating global heating, could we motivate sufficient action by shifting that burden to our descendants? Several writers have proposed breaking the political impasse by funding mitigation through public debt. Critics attack such proposals as both unjust and infeasible. In fact, there is reason to think that some debt financing may be more equitable than placing the whole burden of mitigation on the present generation. While it might not be viable for (...) all countries to take this route simultaneously, a vanguard state, or group of states, could use public debt to fund an ambitious programme to develop inexpensive forms of clean low- or no-emission technology. This would ensure that vanguard actor or set of actors a leading role in those sectors while at the same time benefiting future generations around the world. -/- Key policy insights: (a) Debt-financed clean technology research can shift part of the burden of greenhouse gas mitigation to our descendants, breaking the political impasse of inaction or delayed action. (b) Far from being an injustice to future generations, this could actually be fairer than expecting the present generation to bear the full burden of mitigation. (c) Such an initiative may be most feasible if pursued by a vanguard actor. (shrink)

The rapid development of Internet technology has facilitated the dissemination of information that can threaten national security and public health, and effectively controlling the process of public opinion communication is an important topic in contemporary social network research. This paper establishes an official information-controlled public opinion propagation model based on the delay, latency, and conversion of public opinion communication under the control of official information. According to the influence and importance of the network nodes, we theoretically derive the attitude (...) conversion probability of the nodes, making the model more in line with the actual situation. Through actual cases, we analyzed the important influence of official information on the public opinion communication process and provided a theoretical basis for the government and relevant departments to supervise and correctly guide the public opinion network, which has certain practical significance. Sagvolden, Johansen, Aase, and Russell (Sagvolden et al.) examine attention-deficit/hyperactivity disorder (ADHD) at levels of analysis ranging from neurotransmitters to behavior. At the behavioral level they attribute aspects of ADHD to anomalies of delay-of-reinforcement gradients. With a normal gradient, responses followed after a long delay by a reinforcer may share in the effects of that reinforcer; with a diminished or steepened gradient they may fail to do so. Steepened gradients differentially select rapidly emitted responses (hyperactivity), and they limit (...) the effectiveness with which extended stimuli become conditioned reinforcers, so that observing behavior is less well maintained (attention deficit). Impulsiveness also follows from steepened gradients, which increase the effectiveness of smaller, more immediate consequences relative to larger, more delayed ones. Individuals who vary in the degree to which their delay gradients are steepened will show different balances between hyperactivity and attention deficit. Given the range of ADHD phenomena addressed, it may be unnecessary to appeal to additional behavioral processes such as extinction deficit. Extinction deficit is more likely a derivative of attention deficit, in that failure to attend to stimuli differentially correlated with extinction should slow its progress. The account suggests how relatively small differences in delay gradients early in development might engender behavioral interactions leading to very large differences later on. The steepened gradients presumably originate in properties of neurotransmitter function, but behavioral interventions that use consistently short delays of reinforcement to build higher-order behavioral units as a scaffolding to support complex cognitive and social skills may nonetheless be feasible. This study assessed the validity of instrument including various negative psychological and physical behaviors of commuters due to the public transport delay. Instruments have been mostly evaluated by parametric method of item response theory. However, the IRT has been characterized by some restrictive assumptions about the data, focusing on detailed model fit evaluation. The Mokken scale analysis, as a scaling procedure is a non-parametric method, which does not require adherence to any distribution. The results of the study show that (...) in most regards, our instrument meets the minimum requirements highlighted by the MSA. However, the instrument did not adhere to the minimum requirements of the “scalability” for two variables including “stomach pain” and “increased heart rate”. So, modifications were proposed to address the violations. Although MSA technique has been used frequently in other fields, this is one of the earliest studies to implement the technique in the context of transport psychology. (shrink)

Responses to the COVID-19 pandemic have been widely criticized for being too delayed and indecisive. As a result, the precautionary principle has been endorsed, applauded, and proposed to guide future responses to global public health emergencies. Drawing from controversial issues in response to COVID-19, especially in Vietnam, this paper critically discusses some key ethical and legal issues of employing the precautionary principle in public health emergencies. Engaging with discussions concerning this principle, especially in environmental law where the precautionary principle first (...) appeared as a guiding principle with objective content(s), this paper formulates the precautionary principle as ‘in dubio pro salus’, which is about advising, justifying and demanding states to proactively prepare for scenarios arising out of any public health emergency. It distinguishes the precautionary principle into moderate and hard versions. A moderate version largely takes a holistic approach and fulfils a series of criteria specified in this paper, while a hard version either permits restrictive measures to be deployed primarily on a hypothetic basis or expresses an instrumental mentality. The hard version should be rejected because of the ethical and legal problems it raises, including risk-risk tradeoffs, internal paradoxes, unjustified causing of fear and unreasonable presupposition. The focus of this article is to explain why there is still no qualified digital signature in Denmark as defined by the EU eSignatures Directive nor any other nationwide eID even though Denmark had an early start in eGovernment, and a high level of e-readiness compared to other nations. Laying out the technological, organizational and legal dimensions of eID in Denmark, and comparing these with a number of other European countries made it possible to explain this paradox. Thus, the three (...) main reasons for the special route development has taken in Denmark seems to be concerns over privacy, lack of intergovernmental coordination and lack of cooperation between public and private sector. However, with the recent tender on digital signatures won by the PBS and the roll-out of the NemID it seems that Denmark will finally—after twenty years of delay—have an eID which can be widely used in the public as well as the private sector. Ethics committees like Institutional Review Boards and Research Ethics Committees are typically empowered to approve or reject proposed studies, typically conditional on certain conditions or revisions being met. While some have argued this power should be primarily a function of applying clear, codified requirements, most institutions and legal regimes allow discretion for IRBs to ethically evaluate studies, such as to ensure a favourable risk-benefit ratio, fair subject selection, adequate informed consent, and so forth. As a result, ethics committees typically make (...) moral demands on researchers: require them to act in a way the committee considers ethically right or appropriate. This paper argues that moral demands are legitimate only if publicly justifiable; and as a result, committee decisions are subject to a public justification requirement. Ethics committees can permissibly request for more information, changes to the research protocol or that the research is delayed or even stopped only if these demands are publicly justifiable. This latter claim is in turn justified on the basis that moral demands to φ are permissible only if we are in a position to know that the addressee ought to φ and that we are in a position to know a proposition only if it is publicly justifiable. This argument suggests that ethics committees must consciously and explicitly appeal to public reasons in their decision-making. In cases where public reasons cannot be offered, committees would not be permitted to reject a given study or make approval conditional on an amendment. (shrink)

This paper focuses on the debate about the utilization of new reproductive technologies in Brazil, and the paths taken in the Brazilian National Congress in an attempt to draw up legislation to regulate the clinical practice of human assisted reproduction. British documents, such as the Warnock Report and Human Fertilization and Embriology Authority (HFEA) are used for thorough reference. The analysis of the Law Projects in the National Congress, the Resolution by the Federal Medicine Council, Resolution 196/96 and documents by (...) the Ministério Público (Public Prosecution Office), suppled the bases for the discussion. The principal question involved is the observation of different technical and moral prientations that influence the conduct of the issue in the legislative process. It is possible to observe that the main focus of the projects relates to the rights and interests of the children, to those possibly benefited by the technique and to embryo reduction. Very little attention has been directed to the issues of sexual and reproductive rights and to the health of the women submitted to the new reproductive techologies. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:SACRIFICE AND THE PUBLIC SPHERE Colin Jager University ofMichigan The Inscription on the Memorial to Irish Freedom in Parnell Square, Dublin, reads: "O generations of freedom, remember us, the generations of the vision." The irony, of course, is that the generations of freedom to whom the inscription is addressed have yet to be born. Or rather: they/we are partly a generation of freedom, while remaining also and of necessity (...) a generation of vision. Freedom—always partial and imperfect where it exists at all—remains bound up with vision. And violence (so the memorial tells us) is never far from vision. Is itpossible to conceive ofa public sphere free from violence? This is the question I address here with the help ofHannah Arendt. I begin by describing Arendt's distinction between the public and private realms and summarizing Seyla Benhabib's interpretation ofthese categories. Arendt, ofcourse, valued the public sphere ofcontestation that she associated with the Greek world; for her, the private realm of the household should remain completely separate from public life—the private was a place ofmere necessity, devoted solely to maintaining the physical body. According to Benhabib, we can follow Arendt in thinking of the public sphere as a place of contestation and hence of potential pain, or we can allow the concerns of the private into the public realm, and thus work to create a public sphere based on association and potential solidarity. Working out of the communicative theories of Jürgen Habermas, Benhabib tries to pull Arendt toward Habermas by emphasizing what she calls Arendt's "reluctant modernism": those elements ofher thought that move away from a sharp distinction between public and private and tend toward association and solidarity. And yet—this is the conviction that motivates this essay—history tells us that we cannot simply exchange one for the other. The poignancy ofmy epigraph springs, I think, precisely from our 58Colin Jager realization that vision never modulates easily into freedom. The monument's inscription, the very fact of its existence, links vision indissolubly with bloodshed and sacrifice, while imagining freedom as a peaceful realm beyond violence, a place ofharmony and solidarity for which the "generations ofthe vision" were willing to sacrifice themselves. Yet we are not that generation of freedom. We have not shed the burden of vision and history, for history is never simply behind us. What the eighty bloody years since the Easter uprising have taught us, if anything, is that the coming offreedom is always delayed and that the hopes for a peaceful transition from vision to freedom, agon to association, revolution to democracy, are forever marred by the reality ofa world where there is more than one vision and where continued sacrifices in the name ofvision seem to bring us no closer to peace, or to freedom. Who is the monument for, then? We must conclude that it is for us who remain somewhere between vision and freedom, forced by our own monuments to acknowledge that history that continues to infect our present. If agon and association, vision and freedom, inevitably bleed into each other, then we cannot talk realistically about one simply replacing the other. In this regard Arendt's work is crucial because it teaches us that movement from an agonistic Greek public to an associative modern public is accomplished only at the cost of displacing the distributive violence of the Greek world onto a figure ofsuffering. The necessity ofsuch suffering is the element that Benhabib, with her emphasis on the ideal communicative community, misses. Therefore, highlighting suffering helps us to understand Arendt: the suffering figures scattered through her work are the only way to make sense of her crucial notions of storytelling and forgiveness. More generally, highlighting suffering helps us understand what is at stake in any Utopian theory of the public sphere: envisioning the transition from an agonistic public sphere, defined by its relationship to violence, to a nonviolent associative public sphere of peace and communicative ethics is impossible wiüiout acknowledging those who pay the price for such a passage. This paper illustrates the importance of monitoring health facility-level information to monitor changes in maternal mortality risks. The annual facility-level maternal mortality ratios (MMRs), complications to live births ratios and case fatality ratios (CFRs) were computed from data recorded during 2007 and 2009 in 31 upgraded public sector health facilities across Pakistan. The facility-level MMR declined by about 18%; both the number of Caesarean sections and the episodes of complications as a percentage of live births increased; and CFR based on (...) Caesarean sections and episodes of complications declined by 29% and 37%, respectively. The observed increases in the proportion of women with complications among those who come to these facilities point to a reduction in the delay in reaching facilities (first and second delays; Thaddeus & Maine, 1994); the decrease in CFRs points to improvements in treating obstetric complications and a reduction in the delay in receiving treatment once at facilities (the third delay). These findings point to a decline in maternal mortality risks among communities served by these facilities. A system of woman-level data collection instituted at health facilities with comprehensive emergency obstetric care is essential to monitor changes in the effects of any reduction in the three delays and any improvement in quality of care or the effectiveness of treating pregnancy-related complications among women reaching these facilities. Background: The United States symbolizes democracy in the new world and contributes to global prosperity. Nevertheless, incrementalism is a historically dominant national approach to public policy implementation that delays democracy and undermines human dignity. Human flourishing and national development are endangered by slow-moving democratic changes. This necessitates a social justice framework that traces the exploitation of incrementalism and the consequences of opportunity gaps. Objectives: This study aims to construct a grounded theory to address and answer the following research question: Are (...) anti-democratic concepts part of a process or strategy that hinders democratic change, and what reinforces it, if anything? Methods: Two categories emerged from a grounded theory of democratic social change. This combination of anti-democratic tenets and democratic principles led to abductive reasoning to fill the research gap. Results: The key finding was the existence of a systematic approach that led to democracy while simultaneously disempowering the same group through legal and extralegal means. Two processes hinder democracy: incrementalism and an anti-democratic demoralizing process. A constructivist social justice grounded theory was developed to analyze and evaluate public policy for barriers and facilitators of democracy. A thorough analysis and evaluation of the impact and consequences of public policy is recommended to better understand how such policies impede democracy and influence American perceptions of justice. In Western countries today, a growing number of women delay motherhood until their late 30s and even 40s, as they invest time in pursuing education and career goals before starting a family. This social trend results from greater gender equality and expanded opportunities for women and is influenced by the availability of contraception and assisted reproductive technologies. However, advanced maternal age is associated with increased health risks, including infertility. While individual medical solutions such as ART and elective egg freezing (...) can promote reproductive autonomy, they entail significant risks and limitations. We thus argue that women should be better informed regarding the risks of advanced maternal age and ART, and that these individual solutions need to be supplemented by a public health approach, including policy measures that provide women with the opportunity to start a family earlier in life without sacrificing personal career goals. This article discusses the alleged anti-corruption effects of procurement reforms by presenting the European Act on Public Procurement and the increasing number of appeals filed by suppliers due to perceived misevaluations of tenders and perceived impairments of transparency. The delays and costs that arise from this right to appeal are studied in the Swedish context with the aim of contributing to the debate on corruption in two ways. First, instead of using the modern definition of corruption, the ancient definition is (...) introduced to explain anti-corruption efforts, focusing on corruption as deviations from a pristine standard as opposed to corruption as the abuse of public power for private gain. Second, it will be argued that the fight against corruption in the practical implementation of the European Act on Public Procurement jeopardizes efficiency and might devaluate competence. However, striving for the total elimination of corruption–an evil that has to be fought disregarding the consequences–is integral in the war against it. (shrink)

Traditionally, phenomenology has understood the self in light of intentionality and hence the world. However, contemporary French phenomenology—as represented here by Jean-Luc Marion—contends that this view of subjectivity is open to challenge: our mode of existence is not simply one of “being-in the-world.” I develop this claim by examining Marion’s reformulation of the reduction. Here, the phenomenon of vanity is key. I first present Husserl’s and Heidegger’s own formulations of the reduction. Following Marion, I show that the blow of vanity (...) neutralizes both, by undercutting the respective questions to which they respond. For, in response to vanity’s own question—“What’s the use?”—neither the transcendental nor ontological reductions have a reply. Vanity consequently renders the Heideggerian distinction between authenticity and inauthenticity existentially moot. To establish this, I evaluate how existing interpretations of authenticity overlook the phenomenon of vanity. Phenomenology, I urge in conclusion, should shift its attention to the horizons opened by Marion’s erotic reduction. (shrink)

Prokaryotic genomes of endosymbionts and parasites are examples of naturally evolved minimal cells, the study of which can shed light on life in its minimum form. Their diverse biology, their lack of a large set of orthologous genes and the existence of essential linage (and environmentally) specific genes all illustrate the diversity of genes building up naturally evolved minimal cells. This conclusion is reinforced by the fact that sometimes the same essential function is performed by genes from different evolutionary origins. (...) Nevertheless, all cells perform a set of life‐essential functions however different their cell machinery and environment in which they thrive. An upcoming challenge for biologists will be to discern, by studying differences and similarities in current biodiversity, how cells with reduced genomes have adapted while retaining all basic life‐supporting functions. In this essay, I argue that genuine responsibility and ethical self-understanding are possible without narrative—or, at least, that narrative is not always sufficient. In §2, I introduce and clarify a distinction between our ontological subjectivity and everyday practical identity—one made famous by Heidegger and Sartre. On the basis of this distinction, in §3 I argue that narrative is unable to ground ethical choice and decision. For, although acting in light of practical identities is something we do, it cannot wholly capture (...) what it is to be who we are. Irrespective of whatever worldly projects and identities we press into, something about our subjectivity always remains unchanged. Narrative identity, which trades merely on practical identity, thus obscures this ontological dimension of life wherein human action, decision, choice, and responsibility truly originate. By way of conclusion, in §4, I briefly examine depictions of the narrative life found within the authorships of Dostoevsky, Kierkegaard, and Voltaire, illustrating how self-narrative at times invites self-deception and annuls responsibility. A life of genuine responsibility demands more than what the most candid and best intentioned of self-narratives can supply us. Living the good life, I shall intimate, is thus not something that involves mere narrative. It depends, rather, on inwardness. (shrink)

Taking up phenomenology’s problem of intentionality in the wake of Husserl, Jean-Paul Sartre in the introduction to Being and Nothingness says, «All consciousness, as Husserl has shown, is consciousness of something […] All consciousness is positional in that it transcends itself in order to reach an object, and it exhausts itself in this same positing». Continuing down the page, Sartre notes in turn that intentionality itself is only possible insofar as it is aware of itself. Just as an unconscious intentionality (...) is unthinkable, so too all consciousness is self-consciousness. As he thus explains, «the necessary and sufficient condition for a knowing consciousness to be knowledge of its object, is that it be consciousness of itself as being that knowledge». To pose Husserl’s problem of intentionality, hence, is to pose with it the question of self-consciousness. Sartre asks: “What is this consciousness of consciousness?” Sartre’s question— the question, in short, of what it is to be conscious of oneself—in what follows shall be ours as well. (shrink)

Stigma can influence the prevention and identification of fetal alcohol spectrum disorder, a leading cause of developmental delay in North America. Understanding the effects of public health practices and policies on stigma is imperative. We reviewed social science and biomedical literatures to understand the nature of stigma in FASD and its relevance from an ethics standpoint in matters of health practices and policies. We propose a descriptive model of stigma in FASD and note current knowledge gaps; discuss the ethical (...) implications of stigma based on two distinct criteria ; and describe two cases and the concerns associated with inadvertent stigmatization by public health initiatives for FASD. We recommend further empirical and ethical analyses to examine whether public health policies and practices inadvertently stigmatize and impact the success of public health initiatives and programs for FASD. What and how is the work of art? This paper considers Heidegger’s venerable question by way of a related one: what exactly is the essence of the painting? En route to critiquing the Heideggerian conception of the work of art as that which discloses a world, I present Michel Henry’s competing aesthetic theory. According to Henry, the artwork’s task is not to disclose the exteriority of the world, but rather to express the interiority of life’s pathos—what he calls transcendental self-affectivity. (...) To clarify Henry’s view, I examine his analysis of the abstract painting of Kandinsky, after which I illustrate the significance of Kandinsky’s abstractionism by showing how the representational paintings of Paul Signac, Andrew Harrison, Alphonse Osbert, and Henry Ossawa Tanner attempt to express the invisibility of subjectivity. I then reveal how Heidegger’s account of the work of art in terms of world disclosure overlooks the work’s task of exalting life. In closing, I accordingly suggest that Henry’s view of painting—which locates its essence in Life rather than the world—not only presents a competing position to the Heideggerian view of the origin of the work of art worthy of our attention, but one that explains how art can contribute to overcoming our age’s nihilism. This essay addresses the questions of whether the givenness of God is something possible, intelligible—and, if so, what such givenness might involve. In the interest of situating these questions in historical context, I first summarize Kant’s, Hegel’s, and Habermas’s respective accounts of the relationship between belief in God and philosophical knowledge. I then further situate critical philosophy’s appropriation of God by way of a discussion of how some of this appropriation’s fiercest critics—existentialists such as Sartre, Shestov, and Kierkegaard—object to its (...) gambit of using God to serve moral and cultural goals even as it denies God’s actual existence. Though this objection is a salient one, it leaves something to be desired. For although the existentialists may demonstrate what is misguided about the philosophers’ God, they do not have anything especially compelling to say about whether or how God can be given experientially. I address this aporia by exploiting what I take to be a happy intersection between the phenomenological conception of the saturated phenomenon and two moods—agape love and ecstatic joy—the mystical tradition frequently attributes to the nature of divine givenness. I argue that, when mystical experience is situated within the framework of saturated phenomena rather than within the Kantian enclosures of phenomenality, two intriguing possibilities emerge. First, it seems plausible that the religious experience of the mystic can, in principle, involve the very givenness of God that Kant and his heirs denied to be possible. Second, though phenomenology has yet to provide a complete positive portrait of the religious life, the mystical tradition emerges as a legitimate, invaluable source with which such a phenomenological portrait might begin. As the greatupheaval in Kant's thought took place in 1769, and as thisupheaval had as one of itsmain characteristicsthe rejection of (...) sensibility as the sole source of knowledge,2 it is easy to infer that Kant's reading of the NE may have been one of the elements prompting him to adopt his new solution. It is not the ambition of this paper to answer that difficult question: rather it is an attempt towards clearing the ground for an answer to it, by inquiring into the early reactions of philosophical circles, especially German, to the appearance of the NE. It is an obvious principle in Leibniz' metaphysics that all knowledge stems from the interior of the soul, or monad: from this point of view, it may correctly be stated that for Leibniz all knowledge is innate. It is equally obvious in our day that Leibniz held that there is a basic distinction between the way we know necesstwy and universal truths, emerging from the soul's intellect, and the way we know contingent and particular truths, emerging from the soul's sensibility. Therefore, from a psychological and exoteric point of view (as in the NE) the first kind of truths may be called innate (par excellence), while the second may be called acquired. As it happened, the works of Leibniz published prior to 1765 almost exclusively represented the general metaphysical point of view, and this led to a fatal distortion of his thought by his followers. The interpretations of Leibniz were from the very beginningm and still are in our day---profoundly influenced by the fact that many of Leibniz' works were not published in his lifetime, but appeared (and still shall appear) posthumously during more than two centuries. Consequently the distinction between the origin of necessary and the origin of contingent truths was generally overlooked.
