Welfare conditionality (WC) is a crucial ingredient of social policies around the world. Welfare conditionality demands that recipients meet specific behavioral goals to either access the benefit for the first time or retain the benefit's ongoing advantages. This article argues that any justification of WC must seriously consider procedural protections (PPs) and how they shape the policy's outcome. Procedural protections are institutional principles and mechanisms that guarantee fairness in the administrative decision-making process. This essay normatively evaluates appeal procedures—a key component (...) of PPs—in the context of conditional cash transfer programs (CCTs) implemented during the last two decades in Latin America. It explains why CCTs often fail to provide their recipients with adequate appeal procedures to protect them against administrative errors and poor decision making. These plans can be unfair redistributive programs not because of the type of conditionalities they promote but, rather, due to the limited PPs they provide. (shrink)

This article aims to carry out an analysis of the publications about subjective wellbeing that have been developed in Chile. To reach such an objective, all the publications indexed in the main databases were gathered. The analysed variables were: type of research according to its thoroughness, epistemological stance, disciplinary areas of the researchers and characteristics of the journal. The data were analysed through univariate descriptive statistics and analysis of multiple correspondences. The main results indicate that the first publications start in (...) the decade of 2000, and are concentrated in the disciplinary field of psychology, basically using a quantitative research methodology, with correlational analyses, transversal, non-experimental and macro-subjective levels. En el presente artículo se realiza un análisis de las publicaciones sobre el bienestar subjetivo desarrolladas en Chile. Para hacerlo se acopió el total de publicaciones indexadas en las principales bases de datos. Las variables analizadas fueron: tipo de investigación según su profundidad, enfoques epistemológicos, áreas disciplinarias de los investigadores y características de las revistas. Los datos se analizaron a través de estadística descriptiva univariada y análisis de correspondencias múltiples. Los principales resultados indican que las primeras publicaciones se inician a partir de la década del 2000, se concentran en el campo disciplinario de la psicología, fundamentalmente con enfoque cuantitativo, los análisis son de tipo correlacional, transversal, no experimental y de niveles macro-subjetivos. One of the pleasures of watching Saturday Night Live (SNL) comes from knowing the show is live. The not‐ready‐for‐prime‐time‐players, their guest hosts, the unannounced walk‐on cameos, the house band, and the guest musicians are all in New York at the very moment the show airs, offering us a mocking, postmodern representation of reality through absurd (and sometimes very juvenile) humor. From guest hosts spoofing themselves in sketches, to the various impersonations of cultural figures, to the parody commercials to the pseudo‐news (...) of “Weekend Update,” SNL humorously captures the present and reflects it back to us, satirically revealing the hidden realities we all experience. This chapter explores if Plato (427–347 BCE) and his Cave Myth, and Jean Baudrillard (1929–2007) and his conception of simulacra, can help us better understand the nature of SNL's reality. (shrink)

Currently, humanity is experiencing an explosive growth in technological objects designed to improve the body and mind. The main objective of this article is to review two recent classificatory and explanatory systems to cognitive enhancement cybernetic technologies, including both wearable and implantable artifacts that reorganize human embodiment or extend the mind. I argue that an outdated model of the cognitive sciences serves as the basis for these revised systems and taxonomies. Taking an embodied approach to the cognitive sciences, I propose (...) an alternative focus to classify cognitive enhancement cybernetic technologies. Specifically, by adopting a non-orthodox enactive approach to embodied cognition, I propose a new classificatory system that redefines the notion of the cybernetically enhanced human, restricting it to a purely cognitive context. As populations grow and arable land becomes increasingly scarce, large-scale long- term land leases are signed at a growing rate. Countries and investors with large amounts of financial resources and a strong agricultural industry seek long-term land leases for agricultural exploitation or investment purposes. Leaders of financially poorer countries often advertise such deals as a fast way to attract foreign capital. Much has been said about the short-term social costs these types of leases involve, however, less has been said about (...) the normative dimension of their long-term environmental impact. We therefore will focus on the likely impact such deals have for soil conservation, by (1) briefly introducing the basics of long-term leasing arrangements by comparing land leases to the renting of buildings, (2) explaining from a soil sciences perspective the difficulties in assessing the current value of an estate and in calculating the damages of soil erosion and degradation, and (3) show how difficult it is to incentivize the conservation of soil quality when one cannot sufficiently and cost-effectively valorize existing environmental capital and eventual future damages. Attempting to oblige tenants through contracts to invest in sustainable stewardship has limited potential when liability payments do not reflect true costs and are hard to enforce. (shrink)

The susceptibility of online learning to cheating behavior remains a contentious and unresolved issue. A cross-sectional explanatory research design was utilized to test the hypothesized factors influencing academic cheating in online learning. Our study involved 562 participants, selected through a non-probability sampling technique, who were surveyed using online questionnaires designed to measure the identified factors. We tested the hypotheses by utilizing path analysis through the partial least square regression approach within the SMART-PLS software. The demographics such as gender and age (...) of the students, along with the roles of teachers and school administration significantly influenced the students’ instances of self-reported academic cheating. The students’ attitude toward academic cheating emerged as an important factor in predicting cheating behaviors. The paper concludes with recommendations for future research explorations into other potential factors that may contribute to academic dishonesty in online learning. (shrink)

Republican theorists have paid little attention to the normative problems of secession conflicts. So far, there is no such thing as a democratic republican theory of right of secession ; nor any comprehensive analysis of current TRS has ever been undertaken from a democratic republican point of view. This article tries to fill this second gap as a first step in order to fill that first one. In doing so, it shows how secession conflicts pose threats for two core democratic (...) republican values: freedom and inclusion. The threats are, concretely, those of exclusion, blackmailing minorities, arbitrary permanent majorities, and instability. The article also shows how, due to their respective pro-unionist or pro-secessionist biases, no current TRS seems to be able to handle those threats; and briefly outlines how a democratic republican TRS, based on a non-unilateralist logic, could be developed. We study some aspects of the emergence of _lógos_ from _xáos_ on a basal model of the universe using methods and techniques from algorithmic information and Ramsey theories. Thereby an intrinsic and unusual mixture of meaningful and spurious, emerging laws surfaces. The spurious, emergent laws abound, they can be found almost everywhere. In accord with the ancient Greek theogony one could say that _lógos_, the Gods and the laws of the universe, originate from “the void,„ or from _xáos_, a picture (...) which supports the unresolvable/irreducible lawless hypothesis. The analysis presented in this paper suggests that the “laws„ discovered in science correspond merely to syntactical correlations, are local and not universal. (shrink)

The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

This article answer what could be the distinction that the Stoics established between philosophy and the kata philosophian logos, according to the report by D.L., VII, 39-41. In this place I distance from the scholars who consider that the distinction is ontological, this is, that the kata philosophian logos refers to the discursive presentation of Stoic dogmas, whose nature is incorporeal, while the philosophy refers to a disposition of the soul, whose nature is corporeal. I rather propose that both are (...) dispositiones or states of the rational part of the soul and that the difference is in the degree of perfection that they have accomplished. (shrink)

The forfeiture thesis is posed as an independent thesis in moral philosophy according to which agents forfeit (or lose) rights if they perform certain act-types. According to many, this thesis plays a crucial role in the justification of (legal) punishment. In this paper, I argue that the forfeiture thesis is unnecessary – we can simply dismiss it without any substantive loss. Echoing an aspect of the specificationist approach to rights, the reason is that we may replace the forfeiture thesis with (...) an exception clause in the very content of the right not to be subjected to hard treatment: P has no right not to be subjected to hard treatment simpliciter, but a right not to be subjected to hard treatment unless P performs an act-type φ – e.g., murdering an innocent person. This alternative has substantive advantages over the forfeiture thesis, which, in turn, shows that the former cannot be reduced to the latter. (shrink)

Um marco sobre a questão do tempo na História da Filosofia, o livro XI das Confissões de Agostinho de Hipona (354–430) ainda hoje recebe interpretações. O presente artigo menciona pontos que já apresentei noutro texto sobre o tempo como espelho da alma, no entanto ele recebe o acréscimo de dois pontos que mudam a ênfase de minha interpretação prévia: (1) a citação a Josué e (2) a escolha de Deus creator ominum para exemplificar a relação, via tempo, entre ser humano, (...) Deus e o mundo. Mediante a análise textual do livro XI, a seguinte conclusão será encaminhada: embora Agostinho não recuse a existência do tempo como uma realidade independente das vivências humanas, ele privilegia outro aspecto do tempo, medular nas Confissões, a saber, a relação humana com o tempo em correspondência com a intenção da vontade pela qual a vida humana é governada. Em Agostinho, o tempo da vida se compromete com a ética, e reflete o modo como a vontade habita a vida. Tempo e alma, nas Confissões, são interdependentes a ponto de a experiência humana do tempo ser um espelhamento da vontade. (shrink)

The aim of this paper is to explore the interaction between aesthetic properties and cognitive value in serial television. This study is based on a survey focused specifically on one television series: the second season of My Brilliant Friend, created by Saverio Costanzo. The survey was designed with the aim of getting respondents to express their perceptions of the relationship between the aesthetic qualities of the series and their assessment of it in cognitive terms. The responses obtained in the survey (...) offer a clear answer to the key question of concern for this article. The vast majority of respondents (more than 90% in almost all cases) believe that aesthetic and cognitive qualities mutually influence one another. Additionally the qualitative results invite us to further explore interactionism conceptually: the cognitive content is taken as a criterion for evaluating the season’s aesthetic value overall, suggesting a link between meaning and narrative form. Kitcher has proposed an ideal-theory account—well-ordered science (WOS)— of the collective good that science’s research agenda should promote. Against criticism regarding WOS’s action-guidance, Kitcher has advised critics not to confuse substantive ideals and the ways to arrive at them, and he has defended WOS as a necessary and useful ideal for science policy. I provide a distinction between two types of ideal-theories that helps clarifying WOS’s elusive nature. I use this distinction to argue that the action-guidance problem that WOS faces (...) remains even under the aims/means distinction, because the WOS’s failure is more basic than critics have suggested. In this paper, we raise two points. First, any rights‐based theory should provide a method by which to guide reasoning in addressing conflicts of rights. The reason, we argue, is that these theories must provide guidance on what should be done. Second, this method must contain two key recommendations: (1) We should try to find a deliberative mechanism through which none of the rights is simply eliminated from the scene; (2) these rights may be balanced against each other to define (...) which right should prevail, but without considering non‐rights‐interests as if they were rights in the process. These recommendations instantiate two crucial principles that underlie our common intuitions on rights, namely, the principle that rights deserve equal respect and the principle that rights should be taken seriously. In this paper I propose a series of arguments in order to show that it is preferable for analytic philosophy to be practiced in different languages. In the first section, I show that the analytic tradition includes people developing their philosophical work in different natural languages. In the second section, I will address the question of the role of language in thought, and more specifically in philosophical thought, concluding that it is preferable to allow for the use of different languages (...) as a vehicle for philosophical ideas. Finally, I make some suggestions regarding changes that could be made in academic practices to better allow a plurality of languages and voices within the analytic tradition. (shrink)

Dans cet article, je propose une exploration du phénomène du témoignage. Mon but est de montrer que la perspective phénoménologique rend possible une approche intégrative du témoignage, compris comme un phénomène qui engage la structure existentielle du sujet, articulant les relations entre langage, présence, mémoire, vérité et temporalité. Le témoin n’est pas seulement celui qui témoigne, mais d’abord celui qui affronte, dans sa présence expérientielle, un événement dont le sens est bouleversant et institue ainsi le sujet comme témoin : soit (...) comme « témoin endurant » si l’enjeu est d’abord le soi le plus propre du témoin, ou comme « témoin oculaire»s’il s’agit principalement de l’autre. Le témoignage trouve sa signification particulière dans la tension qui se creuse entre le pôle ontologique, où le témoin est compris comme « être là » en présence de l’événement sur le plan expérientiel, et le pôle herméneutique, où le témoin est convoqué devant les autres au niveau du langage. Une autre différence doit être tracée entre le « témoin-confessant », lorsque le témoignage porte précisément sur ce que le témoin a enduré soi-même, et le « témoin-tiers », dont le témoignage porte sur ce que l’on a principalement observé sans le subir soi-même. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Resumen El objetivo fundamental de este artículo es el de analizar la representación que realiza la filósofa española María Zambrano del mito de Antígona y proyectarla en los debates contemporáneos en torno a la recuperación de los cuerpos de víctimas humanas en contextos post-violencia. Más allá del entramado lingüístico mítico-religioso en el que La tumba de Antígona parece situarse, desentrañaremos los diferentes estratos semánticos y filosóficos subyacentes a la relectura que Zambrano propone de la heroína tebana. Ello nos permitirá destacar (...) la potencialidad política subversiva del gesto de Antígona al abarcar a sujetos históricos tradicionalmente marginados del espacio público. Abstract This article aims to analyzing and projecting María Zambrano's representation of Antigone’s myth within contemporary debates about the recovery of the bodies of human victims in post-violence contexts. Beyond the mythic-religious framework in which The Tomb of Antigone seems to be located, it will be unraveled the different semantic and philosophical layers underlying Zambrano's re-reading of the Theban heroine. This will pave the way towards highlighting the subversive political potential of Antigone's gesture by embracing historical subjects traditionally marginalized from the public space. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

This paper argues for a revised concept of authenticity entailing two demands that must be balanced. The first demand moves authenticity from the position of a strictly self-regarding virtue towards the position of a fully social virtue, acknowledging the crucial feature of steadiness, i.e. self-consistency, as being precisely what we ‘naturally’ lack. Nevertheless, the value of personal authenticity in a modern, open society comes from the fact that it brings about not only steadiness, but also the public development of a (...) variety of existential options that can be understood as Millian ‘original experiments in living’. Thus the second demand of authenticity is a demand for ‘experimental’ authenticity which covers the whole spectrum of technologies of the self, from Nietzschean ‘brief habits’, to the use of enhancement technologies. El presente texto tiene como propósito analizar teórico-conceptualmente las prácticas pedagógicas de la ética implementadas por los docentes en la universidad tradicional y la universidad popular en los años 2010 – 2020. Teniendo en cuenta, primero, las características inherentes de la universidad tradicional tanto en sus orígenes y principios fundamentales; segundo, las practicas pedagógicas de la ética en el rol docente; y tercero, el advenimiento, desarrollo y propuesta de la Universidad popular. Mediante este análisis fue posible develar los paralelismos entre (...) sus divergencias y puntos de encuentro con base en la ética-práctica del rol docente, para el mejoramiento continuo tanto de esta área del conocimiento como de los demás saberes en general. The much-discussed “claimability objection” holds that it is unjustified to believe that all individuals have a human right to subsistence because the bearers of the correlative duties are not sufficiently determined. This argument is based on the so-called “claimability-condition”: S has a right to P if and only if the duty-bearer is sufficiently determined. Practice-based theorists defend the human right to subsistence by arguing that if we take the existing human rights practice seriously, there is no indeterminacy about the allocation (...) of duties. In this paper, I challenge this (apparently compelling) defense of the human right to subsistence with a dilemma. If the claimability condition is true, the practice-based defense fails to undermine the claimability objection because the duty-bearer is determined in some, but not all, cases. If practice-based theorists reject the claimability condition, they generate an account of human rights that is problematic from the practical perspective because it may contain duties that are unable to guide action. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. Barnes (2014) has argued in this journal for the following conditional: If there is any metaphysical indeterminacy, this must be at the most fundamental level of reality. To argue for this claim, Barnes relies on two principles that I shall call bivalent completeness and determinate link. According to the former, a complete description is a bivalent assignment of truth values to every sentence. The determinate link, instead, establishes that the determination relation between levels of reality preserves determinacy from one level (...) to another. In response to Barnes’ conclusion, Eva (2018) has recently pointed out that bivalent completeness is question begging. In this paper, I will first show why Eva's line of reasoning can be resisted. My aim will then be to present a stronger case against Barnes’ argument by challenging the determinate link. In the presence of metaphysical indeterminacy, the link between fundamental and derivative facts might itself be the locus of indeterminacy. I will conclude by showing that Barnes and Eva make many unwarranted assumptions regarding both indeterminacy and fundamentality. The logical space around the connection between these two notions appears to be much wider than what they seem to be aware of, or so I will argue. (shrink)
