Legal terminology is deemed a key feature of legal discourse and a pivotal constituent of competence evaluation and quality control in the translation of legal texts. Problems of terminology unequivocally prove the need for analysing factors governing changing situations as well as macro-textual parameters and measures for the sake of making strategic decisions at a micro-level. There have been a lack of translation methodology among practitioners and trainees and a lack of a practical operational model that comprises all the primary (...) measures and criteria for analysing translation. The present paper seeks to test the efficacy of the integrative model proposed by Prieto Ramos The Ashgate Handbook of Legal Translation, Ashgate Publishing Limited, Surrey, 2014) in surmounting terminological problems of Arabic-English legal translation through applying the said model to the translation of the three Arabic Islamic legal terms: ‘bayʿu al-tawliya’, ‘bayʿu al-wafāʾi wal-amāna’ and ‘takhliya’ into legal English. The present paper claims that the integrative model proposed by Prieto Ramos The Ashgate Handbook of Legal Translation, Ashgate Publishing Limited, Surrey, 2014) proves useful and fruitful in coping with terminological incongruencies and particularly successful in surmounting problems of rendering legal terms from legal Arabic into legal English. This paper addresses the relation between explicitation and translation expertise in the rendition of nominalisation and participles in the legal Qurʾānic verses specific to purification and prayer. It uses a corpus-based method: _The Qurʾānic Arabic Corpus_. The paper argues that most of the expert Qurʾān translators explicitate in rendering nominalisation and participles in the legal verses specific to purification and prayer into English in the said corpus. They explicitate in the form of both addition and specification with varying degrees as (...) the former is adopted twice as much as the latter. The paper claims that most explicitations specific to the rendition of nominalisation and participles in the legal Qurʾānic verses peculiar to purification and prayer in the corpus have been superfluous, albeit justifiable. This may confirm the relation between explicitation and translation expertise in _The Qurʾānic Arabic Corpus_ in the sense that although the meaning of nominalisation and/or participles is wholly translated into English, the Qurʾān translators still explicitate through addition or specification to further facilitate the comprehension process. This paper offers a baseline for examining explicitation exercised on nominalisation and participles in the legal Qurʾānic verses particular to purification and prayer, which may have implications for future studies conducted on the same topic in other similar legal contexts. Certain religious texts are deemed part of legal texts that are characterised by high sensitivity and sacredness. Amongst such religious texts are Islamic legal texts that are replete with Islamic legal terms that designate particular legal concepts peculiar to Islamic legal system and legal culture. However, from the syntactic perspective, Islamic legal texts prove lengthy and condensed, with an extensive use of coordinated, subordinate and relative clauses, which separate the main verb from the subject, and which, of course, carry a (...) heavy load of legal detail. The present paper seeks to examine the syntactic features of Islamic legal texts and the syntactic translation implications involved through studying three Islamic legal Arabic excerpts and their English translations. The paper argues that amongst the syntactic features of Islamic legal texts are nominalisation, participles, modals and complex structures. It also claims that the syntactic translation implications are indeed syntactic features of legal English, which are sentence combining versus sentence break, nominalisation, wh-deletion, passivisation, modals and multiple negations. Moreover, nominalisation, modality and complex structures are features of both Islamic legal texts and legal English, albeit with varying degrees. (shrink)

Translating metaphor is a thorny issue within translation studies in general, and within legal religious texts in particular. The present paper addresses translating Quranic explicit and implicit metaphors in legal and non-legal Quranic verses into English. It seeks to explore and analyse the most appropriate translation procedure(s) for translating Quranic explicit and implicit metaphors, which may ensure full conveyance of the ST image and explanation thereof. It uses the Quranic Arabic Corpus to compare and contrast seven translations of Quranic explicit (...) and implicit metaphors in an attempt to find out the similarities and differences between them and the translation procedures adopted by each of them based on Newmark’s [3] types of procedures. The paper argues that one of the most appropriate translation procedures for translating Quranic explicit and implicit metaphors resides chiefly in a combination of literalism and sense-for-sense translation. This may also apply to the translation of the part of the ellipted vehicle mentioned in the verse if the implicit metaphor is personification-based. Such combination ensures keeping the source language image intact in the target text, while uncovering the sense thereof. This would facilitate comprehensibility of the Quranic translated metaphor and make it accessible to both the expert as well as the layman alike. This paper offers a baseline for translating Quranic explicit and implicit metaphors in legal and non-legal Quranic verses into English, which may have implications for translating Quranic explicit, implicit and other types of metaphor in legal and non-legal Quranic verses into other similar Endo-European languages. Legal translation is viewed as “a category in its own right” (Weston in An English reader’s guide to the French legal system. Berg, Oxford, (1991, p. 2). It is a kind of translation of the language used for specific purposes (Zhao in J Transl Stud 4:28, 2000). Legal translation requires accuracy in relaying the substance of the message, while respecting the form thereof as well as the genius of the target language (Zhao in J Transl Stud 4:19, 2000; Sarcevic in (...) New approach to legal translation. Kluwer Law International, Hague, 1997, p. 52). As generally accepted worldwide, precision is deemed of paramount importance in legal translation. With this in mind, the present paper deals chiefly with the concept of how legal translation can correctly be tested in order to ensure precision and validity for application and implementation. The paper will argue that the main goal of legal translation and the major criterion against which the precision of legal translation should be tested is to reproduce the same legal effect in the target text as that conveyed in the source text regardless of the method(s) used in the translation process. Two thought experiments are discussed which suggest, first, a geometric interpretation of the concept of a (say, vector) potential (i.e., as a kinematic quantity associated with a transformation between moving frames of reference suitably related to the problem) and, second, that, in a quantum treatment one should extend the notion of the equivalence principle to include not only the equivalence of inertial forces with suitable “real” forces, but also the equivalence of potentials of such inertial forces and the potentials of (...) suitable real forces. The two types of cancellation are physically independent of each other, because of the Aharonov-Bohm effect. Finally, we show that the latter effect itself can be understood “geometrically” as a kinematic effect arising upon the transformation between the two reference frames. (shrink)

Such norms of inquiry are needed for a rationality requirement of science, which also presupposes a partial agreement on (acceptance of, respect for) these norms between scientists and their social environment. How do we ready ourselves to intervene responsively in the contingent situations that arise in co-designing to make change? How do we attune to group dynamics and respond ethically to unpredictable developments when working with 'community'? Participatory Design can contribute to social transitions, yet its focus is often tightly tuned to technique for designing ICT at the cost of participatory practice. We challenge PD conventions by addressing what happens as we step into a situation to alter it with others, an (...) aspect of practice that cannot be replicated or interchanged. We do so to argue that practices of readiness are constituted by personal histories, experiences, philosophies and culture. We demonstrate this political argument by giving reflexive accounts of our dimensions of preparation. The narratives here are distinct, yet reveal complementary theories and worldviews that shape PD ontologies. We have organized these around the qualities of punctuation and poise as a way to draw out some less easily articulated aspects of PD practice. (shrink)

The counseling process involves attention, emotional perception, cognitive appraisal, and decision-making. This study aimed to investigate cognitive appraisal and the associated emotional processes when reading short therapists' statements of motivational interviewing (MI). Thirty participants with work injuries were classified into the pre-contemplation (PC,n= 15) or readiness stage of the change group (RD,n= 15). The participants viewed MI congruent (MI-C), MI incongruent (MI-INC), or control phrases during which their electroencephalograms were captured. The results indicated significant Group × Condition effects in the (...) frontally oriented late positive complex (P600/LPC). The P600/LPC's amplitudes were more positive-going in the PC than in the RD group for the MI congruent statements. Within the PC group, the amplitudes of the N400 were significantly correlated (r= 0.607–0.649) with the participants' level of negative affect. Our findings suggest that the brief contents of MI statements alone can elicit late cognitive and emotional appraisal processes beyond semantic processing. (shrink)

Seguido, examinaremos cómo ha sido abordado dentro de algunos opúsculos de filosofía de la historia de Kant; allí veremos que tal concepto comúnmente decanta en la idea de avance, gracias al mejoramiento de las disposiciones naturales o al perfeccionamiento de la moralidad. Si bien, lo anterior resulta (...) de suma importancia, consideramos que el debate podría potencializarse dejando de lado cuál disposición es la que finalmente se torna perfectible, esto considerando que avanzar y ubicar fines morales supone además un juicio reflexionante, concepto desarrollado en la Crítica del discernimiento, el cual desde el presente nos permite interpelar y plantearnos un futuro. A cross-sectional study to ascertain what the Singapore population would regard as material risk in the anaesthesia consent-taking process and identify demographic factors that predict patient preferences in medical decision-making to tailor a more patient-centered informed consent. A survey was performed involving patients 21 years old and above who attended the pre-operative evaluation clinic over a 1-month period in Singapore General Hospital. Questionnaires were administered to assess patients’ perception of material risks, by trained interviewers. Patients’ demographics were obtained. Mann–Whitney U (...) test and Kruskal-Wallis one-way analysis of variance was used. Statistical significance was taken at p < 0.05. Four hundred fourteen patients were eligible of which 26 refused to participate and 24 were excluded due to language barrier. 364 patients were recruited. A higher level of education, being employed and younger age group are factors identified in patients who wanted greater participation in medical decisions. Gender, marital status, type of surgery, and previous surgical history did not affect their level of participation. The complications most patients knew about were Nausea, Drowsiness and Surgical Wound Pain. Patients ranked Heart Attack, Death and Stroke as the most significant risks that they wanted to be informed about in greater detail. Most patients wanted to make a joint decision with the anaesthetist, instead of letting the doctor decide or deciding for themselves. Discussion with the anaesthetist is the preferred medium of communication compared to reading a pamphlet or watching a video. Age and educational level can influence medical decision-making. Despite the digital age, most patients still prefer a clinic consult instead of audio-visual multimedia for pre-operative anaesthetic counselling. The local population appears to place greater importance on rare but serious complications compared to common complications. This illustrates the need to contextualize information provided during informed consent to strengthen the doctor-patient relationship. (shrink)

Although activated spinal cord glia contribute importantly to neuropathic pain, how nerve injury activates glia remains controversial. It has recently been proposed, on the basis of genetic approaches, that toll-like receptor 4 may be a key receptor for initiating microglial activation following L5 spinal nerve injury. The present studies extend this idea pharmacologically by showing that TLR4 is key for maintaining neuropathic pain following sciatic nerve chronic constriction injury. Established neuropathic pain was reversed by intrathecally delivered TLR4 receptor antagonists derived (...) from lipopolysaccharide. Additionally, -naltrexone, -naloxone, and -naloxone, which we show here to be TLR4 antagonists in vitro on both stably transfected HEK293-TLR4 and microglial cell lines, suppressed neuropathic pain with complete reversal upon chronic infusion. Immunohistochemical analyses of spinal cords following chronic infusion revealed suppression of CCI-induced microglial activation by -naloxone and -naloxone, paralleling reversal of neuropathic pain. Together, these CCI data support the conclusion that neuron-to-glia signaling through TLR4 is important not only for initiating neuropathic pain, as suggested previously, but also for maintaining established neuropathic pain. Furthermore, these studies suggest that the novel TLR4 antagonists -naloxone and -naloxone can each fully reverse established neuropathic pain upon multi-day administration. This finding with -naloxone is of potential clinical relevance. This is because -naloxone is an antagonist that is inactive at the -opioid selective receptors on neurons that produce analgesia. Thus, these data suggest that -opioid antagonists such as -naloxone may be useful clinically to suppress glial activation, yet -opioid agonists suppress pain. (shrink)

Purpose Interdisciplinary linkage of information is an emerging topic to create knowledge by collaboration of experts in diverse domains. New insights can be found by using the combined techniques and information when people have the chance to discuss and communicate on a common basis. Design/methodology/approach This paper describes RMS Cloud, an information management system which allows distributed data sources to be searched using dynamic joins of results from heterogeneous data formats. It is based on the well-known Mediator architecture, but reverses (...) the connection of the data sources to grant data owners full control over the data. Findings Data owners and learners are enabled to retrieve information and to cross-connect domain-extrinsic knowledge and enhances collaborative learning with a search interface that is intuitive and easy to operate. Originality/value This novel architecture is able to connect to differently shaped data sources from interdisciplinary domains into one common retrieval interface. (shrink)

THE OCCASION FOR THE ESSAYS RESPONDING TO MANAGING DIVERSITY IN academe follows in response to a challenge issued by Miguel De La Torre in a 2006 plenary panel regarding the invisibility of minority scholars' work in SCE publications. That 2006 panel, which included presentations by De La Torre, Melanie Harris, Gabriel Salgado, and Darryl Trimiew, stimulated discussions in both the Women's Caucus and the meeting of the Board of Directors; this set of essays from a 2008 plenary session and a (...) concurrent session held later in the meeting is the result of those earlier discussions. The two sessions both address diversity: these essays feature minority voices presenting specific proposals for how minority scholarship should and should not be used by majority and other minority scholars; the concurrent session featured a discussion by majority scholars on what whites must do to diversify the society. Our hope is that these essays and the discussions they generate will shed more light on this extremely complex and important issue for the SCE and the institutions in which members work. (shrink)
