Ludwik Fleck’s rediscovery, initiated by Thomas Kuhn, was prominently related to its sociological emphasis. But while this emphasis as such resonated with the sociological circles within science studies, Fleck’s actual sociological position was criticized for lacking clear boundaries to psychology and philosophy, and eventually for inconsistency. This article agrees with the former judgement and rejects the latter. It introduces as core and key to Fleck’s own sociology the thought style of Völkerpsychologie, and the sociology Georg Simmel developed from this tradition.

Die vorliegende Studie rekonstruiert historisch versiert den Problemzusammenhang von Freiheit und Notwendigkeit im Deutschen Idealismus und prazisiert den systematischen Losungsansatz Schellings um das Jahr 1809. Diese Neuinterpretation der Freiheitsschrift berucksichtigt auch die theologischen Fragen und die im Hintergrund wirksame Tradition des (Neu-)Platonismus.

In his book “Medical Philosophy: Conceptual issues in Medicine”, Mario Bunge provides a unique account of medical philosophy that is deeply rooted in a realist ontology he calls “systemism”. According to systemism, the world consists of systems and their parts, and systems possess emergent properties that their parts lack. Events within systems may form causes and effects that are constantly conjoined via particular mechanisms. Bunge supports the views of the evidence-based medicine movement that randomized controlled trials (RCTs) provide the best (...) evidence to establish the truth of causal hypothesis; in fact, he argues that _only_ RCTs have this ability. Here, we argue that Bunge neglects the important feature of patients being open systems which are in steady interaction with their environment. We show that accepting this feature leads to counter-intuitive consequences for his account of medical hypothesis testing. In particular, we point out that (i) the confirmation of hypotheses is inherently stochastic and affords a probabilistic account of both confirmation and evidence which we provide here; (ii) RCTs are neither necessary nor sufficient to establish the truth of a causal claim; (iii) testing of causal hypotheses requires taking into account background knowledge and the context within which an intervention is applied. We conclude that there is no “best” research methodology in medicine, but that different methodologies should coexist in a complementary fashion. (shrink)

Jeanne Fichtner-Egloff analysiert die Epoche um 1900 in Japan und zeigt, dass sie als Übergang in ein neues Selbstverständnis in der Kunst zu verstehen ist. Mit den um 1910 herausgegebenen Schriften des Bildhauers und Schriftstellers Takamura Kōtarōs wurde zum ersten Mal die uneingeschränkte Ausdrucksfreiheit der subjektiven Empfindung eines Künstlers propagiert. Mit diesem Verständnis schien plötzlich ein allgemein gültiges Konzept von Kunst als autonome Schöpfung zu existieren, das sich an die Ideen der fauvistischen Künstler in Frankreich anlehnte. Gleichzeitig entstanden in (...) den Städten erste private Galerien und Messen und es bildeten sich eigenständige Künstlergruppen, die selbst Ausstellungen organisierten, ohne sich offiziellen Begutachtern zu unterwerfen. Diese Entwicklung erzeugte ein interessantes Spannungsfeld zwischen traditionellen Kunstauffassungen und neu rezipiertem westlichen Gedankenguts. (shrink)

Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. This chapter explores the relationship between republican democracy and justice by comparing Philip Pettit's notion of neo-republicanism with that of Immanuel Kant. It begins by describing a republican, political conception of justice as nondomination and explaining why the discourse of republicanism and that of theories of justice often remain at odds with one another. It then considers the basis of a republican conception of justice as nondomination and locates it within the principle of justification, along with Pettit's idea of autonomy (...) and respect. It also examines the notions of ‘arbitrariness’ and ‘domination’ as well as Pettit's ‘negative republicanism’ and its emphasis on legally and politically secure freedom of choice. The chapter argues that a Kantian interpretation of modern republicanism is more convincing than Pettit's ‘negative republicanism’. (shrink)

Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously. Superando l’alternativa tra teorie “ideali” e teorie “realiste”, Rainer Forst dimostra in questo libro come i concetti di normatività e potere siano strettamente correlati: il potere si basa, infatti, sulla capacità di influenzare, determinare ed eventualmente restringere lo spazio delle giustificazioni. The chapter outlines an abstract theoretical framework that is currently (re-)emerging in the course of a theoretical convergence of several disciplines. In the first section, the fundamental problem of perception theory is formulated, namely, the generation, by the perceptual system, of meaningful categories from physicogeometric energy patterns. In the second section, it deals with basic intuitions and assumptions underlying what can be regarded as the current Standard Model of Perceptual Psychology and points out why this model is profoundly inadequate for (...) dealing with the fundamental problem of perception theory. In the third section, it discusses a level of analysis that promises to be fruitful for dealing, in conformity with established procedures of the natural sciences, with the problem of perceptual “meaning” and the problem of what constitutes a “perceptual object.” In the fourth section, it outlines a theoretical perspective on basic principles of the perceptual system which centers on the notions of complex data types and conceptual forms, and draws an entirely different theoretical picture of the role of the sensory input than traditional accounts. The final section focusses on the issue of material qualities and discusses, within the general theoretical framework outlined, some observations and results on the perception of certain material properties, namely, lustrous and glassy appearances. Philosophers and ethicists have long neglected moral questions that arise from our interaction with non-human animals. Most assumed that human beings have a higher moral status than other animals, and that it is therefore morally permissible to use non-human animals as a source of food, clothing, and entertainment, and for scientific purposes. In recent decades, however, that assumption has been challenged, and the moral status of non-human animals is now the subject of a lively and controversial academic debate.Advances in sciences, (...) particularly the advent of evolutionary theory, made us realize that human beings and other animals are more similar than different, and force us to rethink our place in nature. We are no longer justified in thinking of ourselves as the crown of creation. We now understand that we are just one species among others, and we must ask ourselves anew – with an open and critical mind and without bias – which values and principles should guide our interaction with non-human animals, and how we should weigh our interests against those of other animals.Recognizing this important trend in moral thinking, the Bangladesh Journal of Bioethics invited me to edit a special issue on animal ethics. The interest was so great that one issue became two, of which this is the first. I am grateful to Professor Shamima Parvin Lasker and Ms. Tahera Ahmed for giving me the opportunity to serve as a guest editor, and for their assistance during the editing process. I also thank our contributors for choosing this journal to publish their excellent work, and the reviewers for their insightful comments and suggestions.This, the first special issue on animal ethics contains the following five articles:Robin Attfield and Rebekah Humphreys (“Justice and Non-Human Animals”) challenge the widely held belief that non-human animals are not included within the scope of the principles of justice, and suggest that the interests of non-human animals sometimes take precedence over the interests of human beings. The implications of their argument for our interaction with other animals are profound: E.g., it is a matter of justice and fairness to prevent avoidable and unnecessary animal suffering, rather than a mere matter of compassion.Eric X. Qi (“Special Relations, Special Obligations, and Speciesism”) develops an account of the moral significance of special relations, and uses it to argue for a modest form of speciesism that steers a middle ground between anti-speciesism and crude speciesism. Unlike anti-speciesists, he maintains that species co-membership grounds special moral obligations among the members of the same species. In contrast to crude speciesists, however, he holds that our special obligations to fellow human beings do not warrant that we always attach more weight to their interests than to the comparable interests of non-human animals.Yamikani Ndasaukaand Grivas M. Kayange (“Existence and Needs: A case for the equal moral considerability of non-human animals”) argue that the existentialist view that human beings have a higher moral status than other animals rests on a weak foundation. They consider a number of arguments that have been made in support of this view and conclude that none of them holds up to critical scrutiny. They then suggest that human beings and other animals in fact deserve equal moral consideration, and – drawing from Martin Heidegger and Abraham Maslow – ground that claim in two important commonalities between them.Sreetama Chakraborty (“Animal Ethics: Beyond Neutrality, Universality, and Consistency”) explains how the postmodern approach to animal ethics departs from the traditional approach, particularly its emphasis on the principles of neutrality, universality, and consistency, and draws attention to the pernicious hierarchy of domination that separates human beings from other animals. Building on the insights of postmodernism, she takes first steps towards a new, non-anthropocentric paradigm, in the hope to achieve a sustainable balance between human interests and the interests of non-human animals.Gabriel Vidal Quiñones (“Singerian Vegetarianism and the Limits of Utilitarianism: A path towards a Meaning Ethics”) takes a critical look at Peter Singer’s utilitarian argument for vegetarianism, and argues that the conceptual resources of utilitarianism only allow for an incomplete moral understanding of our relationship with other animals. What is lacking, he suggests, is an ethical vision. He argues that, without an ethical vision, human action threatens to degenerate into mere automatism without meaning. He proposes a “meaning ethics” that he thinks is better equipped to help us decide how we ought to treat other animals.I hope you, dear reader, will enjoy reading through this remarkable collection of articles as much as I enjoyed putting it together. Colour has long been a source of fascination to both scientists and philosophers. In one sense, colours are in the mind of the beholder, in another sense they belong to the external world. Colours appear to lie on the boundary where we have divided the world into 'objective' and 'subjective' events. They represent, more than any other attribute of our visual experience, a place where both physical and mental properties are interwoven in an intimate and enigmatic way. -/- The last (...) few decades have brought fascinating changes in the way that we think about 'colour' and the role 'colour' plays in our perceptual architecture. The chapter argues from an ethology-inspired internalist perspective that ‘colour’ is not a homogeneous and autonomous attribute, but rather plays different roles in different conceptual forms underlying perception. It discusses empirical and theoretical evidence that indicates that core assumptions underlying orthodox conceptions are grossly inadequate. The assumptions pertain to the idea that colour is a kind of autonomous and unitary attribute. It is regarded as unitary or homogeneous by assuming that its core properties do not depend on the type of (...) ‘perceptual object’ to which it pertains and that‘colour per se’ constitutes a natural attribute in the functional architecture of the perceptual system. It is regarded as autonomous by assuming that it can be studied in isolation of other perceptual attributes. More generally, the chapter argues on the bases of corresponding empirical and theoretical evidence that perception cannot be understood as the ‘recovery’ of physical world structure from sensory structure by input-based computational processes. Rather, the sensory input serves as a kind of sign for biologically relevant aspects of the external world that activates biologically given conceptual forms with their internal parameters. Although the sensory input is a causally necessary requirement for the activation of conceptual forms, the perceptual computations triggered are under the control of an internal programme based on a set of conceptual forms. The chapter deals with the notion of phenomenal realness, which was first systematically explored by Albert Michotte. Phenomenal realness refers to the impression that a perceptual object is perceived to have an autonomous existence in our mind-independent world. Perceptual psychology provides an abundance of phenomena, ranging from amodal completion to picture perception, that indicate that phenomenal realness is an independent perceptual attribute that can be conferred to perceptual objects in different degrees. The chapter outlines a theoretical framework that appears particularly (...) well-suited for dealing with corresponding phenomena. According to this framework, perception can be understood as a triggering of conceptual forms by sensor inputs. It is argued that the attribute of phenomenal realness is based on specific types of internal evaluation functions which deal with the segregation of causes conceived as ‘external’ from those conceived as ‘internal’. These evaluation functions integrate different internal sources of ‘knowledge’ about the potential causes for the activation of conceptual forms and provide markers by which conceptual forms can be tagged as ‘external world objects’. The chapter deals with misconceptions in perception theory that are based on the idea of slicing the nature of perception along the joints of physics and on corresponding ill-conceived ʹpurposesʹ and ʹgoalsʹ of the perceptual system. It argues that the conceptual structure underlying the percept cannot be inferentially attained from the sensory input. The output of the perceptual system, namely meaningful categories, is evidently vastly underdetermined by the sensory input, namely physico-geometric energy patterns. Thus, the core task of perception theory (...) is to understand the internal conceptual structure with which our perceptual system is endowed. The conceptual structure underlying the semantic distinctions that characterise the output of the perceptual system can, by conceptual necessity, only be expressed by a logical language that is strictly more powerful than the logical language by which sensory notions can be expressed. Consequently, the internal structure underlying perceptual meaning – including core notions such as ‘Gestalt’ or ‘perceptual object’ – cannot be derived, by whatever kind of general inductive machinery, from the sensory input, or, more generally, from experience. In this paper we compare two micro foundations for modelling human behaviour and decision making. We focus on perfect strategic rationality on the one hand and a simple reinforcement mechanism on the other hand. Iterated prisoner’s dilemmas serve as the play ground for the comparison. The main lesson of our analysis is that in the space of all possible 2 × 2 PDs different micro foundations do matter. This suggests that researchers can not safely rely on the assumption that implementing (...) simple models of decision making will yield the same results that may be obtained when more sophisticated decision rules are built into the agents. This paper discusses C.G. Hempel's contention according to which universal laws fulfil the same 'theoretical function' in natural and historical science. To this end, the author differentiates between system ·building and genetically structured sciences. Their modes of presentation are respectively hierarchically ordered theory and narrative. These two basic ways of arranging our knowledge are led back to a difference in explanation, of a pragmatic, not logical nature, that is, to the difference between subsumtion and ascription. Whereas in the systematic organization (...) of knowledge, the basic underlying theory sets the exact conditions, under which a fact can be described as explained, such an epistemological directive function of laws is not to be found in genetic organization. This paper sets out the notion of a current “biopolitical turn of digital capitalism” resulting from the increasing deployment of AI and data analytics technologies in the public sector. With applications of AI-based automated decisions currently shifting from the domain of business to customer (B2C) relations to government to citizen (G2C) relations, a new form of governance arises that operates through “algorithmic social selection”. Moreover, the paper describes how the ethics of AI is at an impasse concerning these larger societal (...) and socioeconomic trends and calls for an ethics of AI that includes, and acts in close alliance with, social and political philosophy. As an example, the problem of Predictive Analytics is debated to make the point that data-driven AI (Machine Learning) is currently one of the main ethical challenges in the ethics of AI. (shrink)

Do individuals accept a moral point of view - if they are completely oriented towards their natural preferences and interests? The present article outlines the context of discussion concerning this question within moral philosophy and the social science. In addition it suggests a game-theoretical model with the help of which the question can be answered positively.

Rainer Friedrich legt eine kohärente, historisch und systematisch angelegte, Rekonstruktion von Kants Vernunftrecht vor. Er zeigt, dass Kant den Gedanken eines allgemein-gesetzgebenden Willens im Staat auch für die Begründung individueller Eigentumsrechte fruchtbar macht und dass Kant die Notwendigkeit des Rechtszustandes nicht aus dem natürlichen Privatrecht ableitet, sondern aus dem angeborenen Menschenrecht der Freiheit.

Die Studie zeigt, dass es eine Verkürzung des aufklärerischen Diskurses wäre, betrachtete man das Vorurteil nur als einen der von der Aufklärung anvisierten Angriffspunkte. Der Vorurteilsdiskurs wird vielmehr zum Modus der Selbstaufklärung der Aufklärung. Im literarischen und popularphilosophischen Nachdenken über das Vorurteil erschüttern anthropologiebasierte Argumente die rationale Gewissheit, mit der Vorurteile kritisiert und durch Wahrheit ersetzt werden sollten. Fragen nach der Funktion von Vorurteilen und nach Wegen, mit ihnen umzugehen, ersetzen philosophische Begriffe und Typologien.
