The Canadian law governing informed consent was significantly influenced by the decision of its Supreme Court in Reibl v. Hughes, a case that involved a physician’s failure to warn the patient about the risk of stroke after carotid endarterectomy. Even though most Canadian plaintiffs after Reibl have continued to lose informed consent cases, it is likely that the judgement in this case has significantly influenced the manner in which physicians now approach the discussion of risk while obtaining consent not only (...) in Canada but also in several other jurisdictions.The development of informed consent law in the United States similarly became one of the drivers for change in physicians’ practices of information disclosure to their patients. The effect of Reibl on clinical practice is an outstanding example of the law’s positive influence on medical practice, especially in protecting patient autonomy during collaborative medical decision-making. Although pioneering studies using statistical methods in geographical data analysis were published in the 1930s, it was only in the 1960s that their increasing use in human geography led to a claim that a ‘quantitative revolution’ had taken place. The widespread use of quantitative methods from then on was associated with changes in both disciplinary philosophy and substantive focus. The first decades of the ‘revolution’ saw quantitative analyses focused on the search for spatial order of a geometric form within an, (...) often implicit, logical positivist framework. In the first of three reviews of the use of quantitative methods in human geography, this progress report uncovers their origin with regard to the underlying philosophy, the focus on spatial order, and the nature of the methods deployed. In her recent, provocative essay “What Is the Point of Equality?”, Elizabeth Anderson argues against a common ideal of egalitarian justice that she calls “ luck egalitarianism” and in favor of an approach she calls “democratic equality.”1 According to the luck egalitarian, the aim of justice as equality is to eliminate so far as is possible the impact on people’s lives of bad luck that falls on them through no fault or choice of their own. In the ideal luck egalitarian (...) society, there are no inequalities in people’s life prospects except those that arise through processes of voluntary choice or faulty conduct, for which the agents involved can reasonably be held responsible. Anderson asserts that the adherents of luck egalitarianism, which can be elaborated in many different ways, include John Roemer, Erik Rakowski, Thomas Nagel, Ronald Dworkin, Gerald Cohen, Richard Arneson, and Philippe Van Parijs.2 In contrast, according to the democratic equality conception, justice as equality requires an end to oppressive social relationships. In the ideal society of democratic equality, the social conditions of everyone’s freedom are secured, each stands to every other in a relationship of fundamental equality, including equal respect, and all have real freedom to participate in democratic self-government. This essay examines several possible rationales for the egalitarian judgment that justice requires better-off individuals to help those who are worse off even in the absence of social interaction. These rationales include equality (everyone should enjoy the same level of benefits), moral meritocracy (each should get benefits according to her responsibility or deservingness), the threshold of sufficiency (each should be assured a minimally decent quality of life), prioritarianism (a function of benefits to individuals should be maximized that gives priority to (...) the worse off), and mixed views. RICHARD RORTY has written one of the most important and challenging books to be published by an American philosopher in the past few decades. Some will find it a deeply disturbing book while others will find it liberating and exhilarating—both, as we shall see, may be right and wrong. Not since James and Dewey have we had such a devastating critique of professional philosophy. But unlike James and Dewey, who thought that once the sterility and artificiality of professional—and indeed (...) much of modern philosophy since Descartes—had been exposed, there was an important job for philosophers to do; Rorty leaves us in a much more ambiguous and unsettled state. I will examine Rorty’s book from a variety of perspectives, beginning with a general overview and then moving to more finely meshed descriptions. My aim is not only to illuminate the power and subtlety of Rorty’s analysis and to show its inner unity, but to locate basic issues that are left unresolved. (shrink)

Prystowsky people fight not because they are different, but because they are the same, Girard has shown us how "violence is a great leveler of men" and has helped us to understand the serious consequences that either follow or can follow from mimetic rivalry (Violence 79). For example, he has helped us see how the internal violence occurring in a community in which differentiation has broken down finds its outlet in scapegoating, that mechanism by means of which a community in conflict with itself attempts to save itselfby sacrificing an expendable, arbitrary victim (who lacks a champion but whose real guilt or innocence is irrelevant) onto whom the collective victimizers have projected their own guilt, their own mimetically-oriented self-hatred—their own "sins," we might say. Among other things, Girard's critique of the mimetic rivalry characteristic of what we might call "the conflicted communal Self" also sheds light on the nature of the violence and victimization that we find in the history of Christian persecution of Jews. Without referring to Girard's ideas, the eminent historian Léon Poliakov nevertheless captures a Girardian view of this tragic history when he writes that "to massacre first, and then, from fear of revenge, to accuse afterward; to attribute to the victims one's own aggressive intentions; to impute to them one's own cruelty: from country to country and from century to century, under various disguises, this is the device we find" (106-7). In the present essay, I will attempt to show that such vengeance-laden acts of Christian persecution of Jews, of the Jew-as-Other, derive from antisemitic Christians' mimetic rivalry with Jews—an "I" for an "I," as this essay's title would suggest—and that underlying this rivalry is the introjection ofreal or imagined Jewish self-hatred.2 1 hope to demonstrate that this projected intra-victimization is marked, in part, by Christians' mimetic appropriations of fantasized or real acts of Jewish self-incrimination, punishment, or more generalized suffering. Ultimately, I will try to provide support for the idea that, despite its obvious promise and appeal of love, peace, and brotherhood, Christianity cannot wrest itself entirely from its moorings in real or fantasized Jewish self-hatred, that is, in an appropriation of enacted or imagined Judaism against itself. This essay reexamines the idea of paternalism and the basis for finding it objectionable in light of recent writings on “libertarian paternalism.” Suggestion: to qualify as paternalistic, an interference that restricts someone’s liberty or interferes with her choice-making with the aim of helping the individual must be contrary to that very individual’s will. A framework for determining the justifiability of paternalistic action is proposed, under the assumption that the individual has a personal prerogative, up to a point, to engage in (...) less than maximally beneficial action. Beyond that point, the content of the will of the individual disposed against interference can extinguish the presumptive wrongness of paternalism. (shrink)

The development of a defensible and fecund notion of emergence has been dogged by a number of threshold issues neatly highlighted in a recent paper by Jaegwon Kim. We argue that physicalist assumptions confuse and vitiate the whole project. In particular, his contention that emergence entails supervenience is contradicted by his own argument that the ‘microstructure’ of an object belongs to the whole object, not to its constituents. And his argument against the possibility of downward causation is question-begging and makes (...) false assumptions about causal sufficiency. We argue, on the contrary, for a rejection of the deeply entrenched assumption, shared by physicalists and Cartesians alike, that what basically exists are things (entities, substances). Our best physics tells us that there are no basic particulars, only fields in process. We need an ontology which gives priority to organization, which is inherently relational. Reflection upon the fact that all biological creatures are far-from-equilibrium systems, whose very persistence depend upon their interactions with their environment, reveals incoherence in the notion of an ‘emergence base’. Golsan Texas A &M University Although the Girardian concept of the scapegoat and its attendant phenomena have a number of obvious implications for the study of fascism, to date the connection has been addressed only in broadly theoretical terms. In Des Choses cachées and in subsequent works, René Girard has alluded to modern political scapegoating such (...) as the Nazi persecution of the Jews as examples of mass victimizations where the enormous number of victims represents an effort to compensate for the failure of the scapegoating process itself in the wake of Christian revelation.1 While the victims are initially vilified, they are not sacralized after their sacrifice, and order is maintained only so long as a steady stream of victims is forthcoming. As Andrew McKenna explains in Violence and Difference, "with the passing of the sacred order, of the sacred tout court, sacrifice becomes less and less capable of uniting the community and therefore demands more and more victims... the decline of symbolic violence brings an increase of real victims; their quantity mounts in inverse proportion to the ritual efficacy of sacrifice, and victimage appears more and more gratuitous" (159-60). Moreover, McKenna continues, victimage of this sort becomes increasingly untraceable, rootless, and it is this aspect of official Nazi anti-Semitism, for example, which allowed many Nazis in their postwar trials to proclaim their innocence for their roles in the Final Solution by insisting that they were "only following orders" (162-3). 1 See Things Hidden 128-9. Drieu, Céline: French Fascism173 These observations certainly help to illuminate the role of scapegoating in Nazi racial politics and in the Holocaust in particular. They are less helpful, however, in understanding other paradigms of fascism in which antiSemitism did not play as central a role or in cases in which fascist ideology was not synonymous with government policy or political hegemony. The role of scapegoating in Italian Fascism, for example, is more difficult to ascertain than it is in Nazism because anti-Semitism was less crucial as a means of establishing social cohesiveness, at least until Nazi influence became predominant during World War II (Soucy xviii). In France, the presence of a number of fascist movements from the twenties through the end of the Occupation, and the absence of an autonomous fascist state during the same period, make the task of assessing the role of scapegoating even more difficult. This is especially true in light of the fact that a number of French fascist movements were not anti-Semitic, at least until it became expedient to be so to curry favor with the Nazis. In French Fascism: The First Wave, Robert Soucy notes that during the interwar years, fascist groups including "the Jeunesse Patriotes, the Croix de Feu and the Faisceau... welcomed Jews into their ranks" (xviii). The lack of a consistent attitude towards the Jews is, in fact, just one of several points of divergence among French fascists and fascist groups prior to World War Two. As a result, historians and political theorists who have studied French fascism have strongly disagreed as to its origins as well as its basic ideology. In Neither Right nor Left: Fascist Ideology in France, Zeev Sternhell argues that "the history of fascism can be described as a continuous attempt to revise marxism and create a national form of socialism" (20). Soucy, on the other hand, insists that on many of the most important social and political issues, including "taxation, government spending, nationalization, property rights, class conflict, religion, education, and foreign policy, French Fascism was overwhelmingly conservative" (xi). Other historians, especially among the French themselves, have gone so far as to insist that there is no such thing as French fascism, that such a creature, if it existed at all, was merely an import, a watered-down version of Nazism or Italian Fascism.2 If no consensus as to the nature or even the existence of French fascism can be reached by analyzing the programs...
