Nosso objetivo neste trabalho é, em primeiro lugar, apresentar o modelo de liberalismo proposto por John Stuart Mill como relevante para o construtivismo da teoria política de John Rawls. Para tal, vamos mostrar que o contratualista americano em alguma medida subscreve o liberalismo do utilitarista inglês. Vamos aproximar ambos os autores no tocante ao método intuicionista e verificar se ainda há alguma vantagem no consequencialismo de Mill. Para Rawls, um procedimento intuicionista é ligado a um conjunto de princípios que não (...) pode ser reduzido. Mill se encaixa na definição, portanto, na medida em que advoga um tipo de hedonismo, característica que o americano descarta, por poder ser listada como teoria moral abrangente. Mesmo assim, precisamos verificar até que medida é possível considerar o utilitarismo de Mill como tendo influenciado o liberalismo de Rawls. Assim, levaremos em conta que ele autorizou, pelo menos parcialmente, um método intuicionista e mostraremos que isso se deu por influência da filosofia política de Mill. Fica assim admitido que o apelo à intuição está na base da teoria da justiça, mas tudo somado pode ficar perfeitamente claro onde reside o equilíbrio lógico proposto por Rawls. Mesmo com o desacordo final, é possível notar a influência do projeto liberal do londrino em torno da teoria política que resultou na _Teoria da Justiça_. Restará ainda tentar saber se realmente é possível se afastar de um consequencialismo e se há alguma vantagem teórica em se manter filiado a uma teoria política e ética como a de Mill do ponto de vista jurídico institucional. Isso porque o consequencialismo com um viés estritamente constitucional, como aquele sugerido por Rawls, não parece ser capaz de solucionar um problema jurídico externo ao hermético sistema teórico proposto nas teorias da justiça contemporâneas. Literature has been philosophically understood as a practice in the last thirty years, which involves “modes of utterance” and stances, not intrinsic textual properties. Thus, the place for semantics in philosophical inquiry has clearly diminished. Literary aesthetic appreciation has shifted its focus from aesthetic realism, based on the study of textual features, to ways of reading. Peter Lamarque’s concept of narrative opacity is a clear example of this shift. According to the philosophy of literature, literature, like any other art form, (...) does not compel us to engage realistically with it. Against this trend, this paper argues for the distinction between two kinds of opacity, defending textual opacity as a necessary condition for literary opacity. In this sense, examples in literary criticism properly illustrate not a peripheral role of meaning in literary appreciation, but arbitrariness in interpretation, which involves semantic concerns. So the assumed interest in the specific ways in which literature embeds meaning in fictional narrative works. (shrink)

This paper revisits some foundational questions concerning the abstract representation of a discourse context. The context of a conversation is represented by a body of information that is presumed to be shared by the participants in the conversation – the information that the speaker presupposes a point at which a speech act is interpreted. This notion is designed to represent both the information on which context-dependent speech acts depend, and the situation that speech acts are designed to affect, and so (...) to be a representation of context that is appropriate for explaining the interaction of context and the contents expressed in them. After reviewing the motivating ideas and the outlines of the apparatus, the paper responds to a criticism of the framework, and considers the way it can help to clarify some phenomena concerning pronouns with indefinite antecedents. This collection of papers (including three completely new ones) by one of the foremost philosophers in epistemology transcends two of the most widely misunderstood positions in philosophy--foundationalism and coherentism. Audi proposes a distinctively moderate, internalist foundationalism that incorporates some of the virtues of both coherentism and reliabilism. He develops important distinctions between positive and negative epistemic dependence, substantively and conceptually naturalistic theories, dispositional beliefs and dispositions to believe, episodically and structurally inferential beliefs, first and second order internalism, and rebutting as (...) opposed to refuting skepticism. These contrasts are applied not only to rational belief, but to rational action and the rationality of desires and intentions. The overall position is a pluralist, moderately rationalistic, internalist theory of justification and a partly externalist conception of knowledge. However, by virtue of offering a theory of rationality as well as an account of knowledge and justified belief, it will interest philosophers of ethics, science, and the social sciences and teachers and students of epistemology. O PROCEDIMENTO DE ARRECADAÇÃO DO ICMS: O CONFAZ E A REGULAÇÃO DO SERVIÇO DE TV POR ASSINATURA.

The future of awake bruxism assessment will incorporate physiological data, possibly electromyography of the temporal muscles. But up to now, temporal muscle contraction patterns in awake bruxism have not been characterized to demonstrate clinical utility. The present study aimed to perform surface EMG evaluations of people assessed for awake bruxism to identify possible different subtypes. A 2-year active search for people with awake bruxism in three regions of the country resulted in a total of 303 participants. Their inclusion was confirmed (...) through non-instrumental approaches for awake bruxism: self-reported questionnaire and clinical exam, performed by three experienced and calibrated dentists. Also, 77 age- and sex-matched healthy controls were recruited. Temporalis surface EMG was performed with a portable device. EMG signals were sent to a computer via Bluetooth 4.0 at a sampling rate of 1,000 Hz. Digital signal processing was performed using the commercial neuroUP software, transformed in RMS and then normalized for peak detection, in a 10 min session. Cluster analysis revealed three distinct subtypes of awake bruxism: phasic, tonic, and intermediate. Individuals with a predominance of EMG peaks/min were classified as the “phasic” subtype. Those with the highest EMG rest power were classified as the “tonic” subtype. There was also an “intermediate” subtype, when both variables remained low. Characterization of awake bruxism physiology is important for future establishment of instrumental assessment protocols and treatment strategies. (shrink)

What kind of mental state is episodic memory? I defend the claim that it is, in key part, imagining the past, where the imagining in question is experiential imagining. To remember a past episode is to experientially imagine how things were, in a way controlled by one’s past experience of that episode. Call this the Inclusion View. I motive this view by appeal both to patterns of compatibilities and incompatibilities between various states, and to phenomenology. The bulk of the paper (...) defends the account against four objections. Imagining and remembering seem to differ in whether they are active or passive, in the forms of singular content they involve, in their relations to observation and in their relations to belief. I argue that these differences can be accommodated, and some even explained, once we flesh out what else is involved in episodic memory, in addition to imagining the past. (shrink)

Texto que vem demonstrar a correlação entre disciplinas tidas, por vezes, como díspares, no caso a linguística e a matemática, e como existe um real enlaçamento entre as mesmas, principalmente no campo analítico. O autor vem discorrer sobre uma epistemologia respeitosa pelas categorias próprias a cada conhecimento, de modo a tornar o desenvolvimento lógico-científico numa abordagem multidisciplinar, congregando várias áreas, principalemente, nesse caso, a inguística e a literatura, como fomentadoras de uma estruturação lógico-analítica ímpar ao cientista.

This paper aims at the construction of a structural coupling between object-oriented philosophy and Whitehead’s philosophy of organism by making a case for the primacy of the ontological principle through the proposal of a social object hypothesis. The social object here differs from traditional renderings of sociology, which are centered on humans’ activity and personalities, by way of recuperating Tarde’s social theory of associations. This theory provides us with a non-anthropocentric reading of sociality. This hypothesis will be furthered by the (...) introduction of the systemic category of internal/external, or system/environment, as a self-enclosure feature of social objects. Equipped with these two notions, we will discuss Graham Harman’s paper “Whitehead and Schools X, Y, and Z,” while rerouting his assessments to our own social object hypothesis. The final idea is to propose an alliance through the conception of a macro-ontological approach to philosophy of organism. We intend to show that this is not only coherently feasible regarding Whitehead’s own categoreal scheme, but also meets the requirements of being a real object in object-oriented ontology’s directives. Na crise estrutural do capital, iniciada na década de 1970, foi inaugurado o chamado capitalismo neoliberal, no cerne do qual o tema da formação política parece ter assumido destacada importância. Em sua radicalidade emancipatória, a formação política encontra-se inextrincavelmente vinculada à luta dos movimentos sociais populares, atravessando, portanto, a totalidade das atividades desenvolvidas pelos sujeitos coletivos em movimento. O objetivo do artigo é tecer algumas considerações sobre o tema da formação política no interior dos movimentos sociais populares. Para tanto, lançaremos (...) mão de uma pesquisa bibliográfica ancorada em alguns breves relatos de militantes colhidos através de entrevistas semiestruturadas, a partir do nosso trabalho militante no seio da luta social. Alguns desses relatos constituem igualmente resultados parciais da nossa pesquisa de mestrado no Programa de Pós-Graduação em Educação Brasileira da Universidade Federal do Ceará (UFC). O título da pesquisa é: Práxis político-educativa do sujeito potencialmente revolucionário nas associações de moradores: a experiência da Associação de Moradores do Bairro da Serrinha (AMORBASE). O campo empírico da pesquisa é o território Serrinha, situado na periferia da cidade de Fortaleza, capital do estado do Ceará. O artigo encontra-se fundamentado nos pressupostos do materialismo dialético tal como formulado por Marx e Engels (2007). No artigo, a formação política, no interior dos movimentos sociais populares é compreendida como um fenômeno mais abrangente e mais denso complexamente articulado uma vez que atravessa a totalidade das atividades organizadas pelos sujeitos coletivos em movimento. This article intends to be a simple guide to understand how Hoppe built the Argumentation Ethics. In my early studies of libertarian ideas, and of Argumentation Ethics in particular, I could not find a unique text that would explain how Hoppe put the necessary bricks together to build the Ethics. As I was curious about this issue, I assumed others would also like to know it. To write this article, I reviewed the main literature on Argumentation Ethics, starting with Kinsella’s (...) Concise Guide [9]. Then, I interviewed Stephan Kinsella and Prof. Walter Block. Finally, I synthesized the main ideas from the literature and the interviews elaborating an interpretative model, presented in this article. (shrink)

It is almost unanimously accepted that Kant denies resultant moral luck—that is, he denies that the lucky consequence of a person’s action can affect how much praise or blame she deserves. Philosophers often point to the famous good will passage at the beginning of the Groundwork to justify this claim. I argue, however, that this passage does not support Kant’s denial of resultant moral luck. Subsequently, I argue that Kant allows agents to be morally responsible for certain kinds of lucky (...) consequences. Even so, I argue that it is unclear whether Kant ultimately endorses resultant moral luck. The reason is that Kant does not write enough on moral responsibility for consequences to determine definitively whether he thinks that the lucky consequence for which an agent is morally responsible can add to her degree of praiseworthiness or blameworthiness. The clear upshot, however, is that Kant does not deny resultant moral luck. (shrink)

Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

In this paper, we intend to demonstrate that the asylum request process can have its semantic and politic structures evidenced from an access via philosophy of language. In order to elucidate the normative nature of this social practice and to take a critical stance in relation to the treatment given to the refuge interview as it has been done in our country, we resort to certain concepts developed by the so called later Wittgenstein. Looking for a more complete treatment of (...) our object of study, we also turn to the authors of Bakhtin’s Circle, which explore communicational dimensions that the Viennese philosopher did not properly explore – with special emphasis on “value accents”. In order to collect empirical evidence relevant to our purposes, a field research was carried out with professionals and volunteers involved in the asylum request interviews. The resulting reports provided us with more basis for the considerations we make about the normative fragility of the interview language game and the intricate value system that guides the interaction between interviewer, interpreter and interviewee. This paper provides an overview of the history of the notion of essence in 20th century analytic philosophy, focusing on views held by influential analytic philosophers who discussed, or relied on essence or cognate notions in their works. It in particular covers Russell and Moore’s different approaches to essence before and after breaking with British idealism, the (pre- and post-)logical positivists’ critique of metaphysics and rejection of essence (Wittgenstein, Carnap, Schlick, Stebbing), the tendency to loosen the notion of logical necessity (...) to accommodate certain metaphysical truths in Wittgenstein and others, Quine’s logical rehabilitation of metaphysics and criticism of de re modality, the modal view of essence promoted by the development of quantified modal logic (C. I. Lewis, Barcan Marcus, Kripke) and direct reference theory (Barcan Marcus, Kripke, Putnam), and the emergence of the notion of metaphysical necessity (Kneale, Kripke), and finally Fine’s re-establishment of a Neo-Aristotelian, hyperintensional notion of essence in contemporary metaphysics. In the Western world it is usually taken as given that we all want happiness, and our educational arrangements tacitly acknowledge this. Happiness, Hope, and Despair argues, however, that education has an important role to play in deepening our understanding of suffering and despair as well as happiness and joy. Education can be uncomfortable, unpredictable, and unsettling; it can lead to greater uncertainty and unhappiness. Drawing on the work of Søren Kierkegaard, Miguel de Unamuno, Fyodor Dostoevsky, Simone Weil, Paulo Freire, (...) and others, Peter Roberts shows why these features of educational life need not be feared; to the contrary, they can be seen as a source of hope and human fulfilment. After years of negotiating an education system dominated by the language of competition, performance, and economic advancement, students and teachers often long for something different; they seek not just measurable success but also opportunities to ask searching questions of themselves and the world they encounter. Happiness, Hope, and Despair makes an important contribution toward meeting this need. In this essay I sketch some vices of virtue ethics, draw on inference about the philosophical source of the vices, and conclude with a recommendation concerning future efforts in moral theory construction. The source of the vices, I argue, lies in a mononomic or single-principle strategy within normative theory construction, a reductionist conceptual scheme which distorts certain integral aspects of our moral experience. My recommendation is that this strategy be abandoned, for the moral field is not unitary -- mononomic methods (...) are not the best tools for moral theorists. (shrink)

Philosophers often consider problems of free will and moral luck in isolation from one another, but both are about control and moral responsibility. One problem of free will concerns the difficult task of specifying the kind of control over our actions that is necessary and sufficient to act freely. One problem of moral luck refers to the puzzling task of explaining whether and how people can be morally responsible for actions permeated by factors beyond their control. This chapter explicates and (...) assesses skeptical, compatibilist, and libertarian approaches to moral luck. First, I argue that what makes the above problems of free will and moral luck distinct is largely their emphasis on different kinds of luck. Second, I describe and evaluate skeptical arguments from constitutive and circumstantial luck that it is impossible to act freely. Third, I explicate and assess various support and implication relationships between various kinds of compatibilism and libertarianism, on the one hand, and causal, constitutive, circumstantial, and resultant moral luck, on the other. BackgroundAlthough values have increasingly received attention in psychiatric literature over the last three decades, their role has been only partially acknowledged in psychiatric classification endeavors. The review process of the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders received harsh criticism, and was even considered secretive by some authors. Also, it lacked an official discussion of values at play. In this perspective paper we briefly discuss the interplay of some values in the scientific and non-scientific debate around (...) one of the most debated DSM-5 category proposals, the Attenuated Psychosis Syndrome. Then, we point out some ethical consequences of a facts-plus-values perspective in psychiatric classification.DiscussionDifferent stakeholders participated in the APS-debate and for analytical purposes we divided them into four groups: researchers in the field of high-risk mental states; the DSM-5 Psychotic Disorders Work Group; patient, carers and advocacy groups; and external stakeholders, not related to the previous groups, but which also publicly expressed their opinions about APS inclusion in DSM-5. We found that each group differently stressed the role of values we examined in the APS-debate. These values were ethical, but also epistemic, political, economic and ontological. The prominence given to some values, and the lack of discussion about others, generated divergent positions among stakeholders in the debate.SummaryAs exemplified by the APS discussion, although medicine is primarily an ethical endeavor, values of different kinds that take part in it also shape to a large extent the profession. Thus, it may be strategic to openly discuss values at play in the elaboration of diagnostic tools and classificatory systems. How important is luck in economic success? No question more reliably divides conservatives from liberals. As conservatives correctly observe, people who amass great fortunes are almost always talented and hardworking. But liberals are also correct to note that countless others have those same qualities yet never earn much. In recent years, social scientists have discovered that chance plays a much larger role in important life outcomes than most people imagine. In Success and Luck, bestselling author and New York Times economics (...) columnist Robert Frank explores the surprising implications of those findings to show why the rich underestimate the importance of luck in success--and why that hurts everyone, even the wealthy.
