BackgroundThe theory and practice of ethics consultations (ECs) in health care are still characterized by many controversies, including, for example, the practice of giving recommendations. These controversies are complicated by an astonishing lack of evidence in the whole field. It is not clear how often a recommendation is issued in ethics consultations and when and why this step is taken. Especially in a facilitation model in which giving recommendations is optional, more data would be helpful to evaluate daily practice, ensure (...) that this practice is in line with the overarching goals of this approach and support the development of standards.MethodsWe analyzed all consultations requested from an EC service working under a facilitation approach at a maximum-care university hospital in Germany over a period of more than 10 years. Our aim was to better understand why—and under what circumstances—some consultation requests result in a recommendation, whereas others can be sufficiently addressed solely by facilitated meetings. We especially wanted to know when and why clients felt the need for clear advice from the EC service while in other cases they did not. We compared ethics consultations in terms of the differences between cases with and without recommendations issued by the ethics consultants using χ2 difference tests and Welch’s t-test.ResultsA total of 243 ECs were carried out between September 2008 and December 2019. In approximately half of the cases, a recommendation was given. All recommendations were issued upon the request of clients. When physicians asked for an EC, the consultation was significantly more likely to result in a recommendation than when the EC was requested by any other party. ECs in cases on wards with ethics rounds resulted in comparably fewer recommendations than those in wards without ethics rounds. When interpersonal conflicts were part of the problem or relatives were present in the meeting, clients less frequently asked for a recommendation.ConclusionFrom the client’s point of view, there does not seem to be only one “right” way to provide ethics consultations, but rather several. While facilitated meetings are obviously appreciated by clients, there also seem to be situations in which a recommendation is desired (especially by physicians). Further empirical and theoretical research is needed to validate our single-center results and re-evaluate the role of recommendations in ethics consultations. (shrink)

The centrality of models such as inflationary models in cosmology, general-circulation models of the global climate, the double-helix model of DNA, evolutionary models in biology, agent-based models in the social sciences, and general-equilibrium models of markets in their respective domains is a case in point (the Other Internet Resources section at the end of this entry contains links to online resources that discuss these models). The statement that masks were not introduced on the Roman stage until after the time of Terence is still repeated by editors and has the support of Pauly Wissowa as well as Daremberg and Saglio ; it may, in fact, be regarded as generally accepted. Yet so long ago as 1912 A. S. F. Gow put forward strong arguments on the opposite side; his article, though mentioned with respect in Bursian and referred to by Schanz-Hosius , has not yet (...) been satisfactorily answered, so far as I am aware. Gow did not claim that a final solution of this problem could be attained on our present evidence, but he did show that the orthodox position is open to attack. Er ist wohl der berühmteste Text zum Thema und wurde nicht zuletzt von A. Einstein begeistert gewürdigt. Die vorliegende Neuausgabe enthält den Originalartikel sowie weitere, teilweise recht ausführliche Ergänzungen, die Pauli im Jahre 1956 für die englische Ausgabe schrieb. Eine Reihe von Anmerkungen des Herausgebers dienen darüber hinaus als Lesehilfen und zeigen Verbindungen zu modernen Entwicklungen auf.

Scientific discourse is rife with passages that appear to be ordinary descriptions of systems of interest in a particular discipline. Equally, the pages of textbooks and journals are filled with discussions of the properties and the behavior of those systems. Students of mechanics investigate at length the dynamical properties of a system consisting of two or three spinning spheres with homogenous mass distributions gravitationally interacting only with each other. Population biologists study the evolution of one species procreating at a constant (...) rate in an isolated ecosystem. And when studying the exchange of goods, economists consider a situation in which there are only two goods, two perfectly rational agents, no restrictions on available information, no transaction costs, no money, and dealings are done immediately. Their surface structure notwithstanding, no competent scientist would mistake descriptions of such systems as descriptions of an actual system: we know very well that there are no such systems. These descriptions are descriptions of a model-system, and scientists use model-systems to represent parts or aspects of the world they are interested in. Following common practice, I refer to those parts or aspects as target-systems. What are we to make of this? Is discourse about such models merely a picturesque and ultimately dispensable façon de parler? This was the view of some early twentieth century philosophers. Duhem (1906) famously guarded against confusing model building with scientific theorizing and argued that model building has no real place in science, beyond a minor heuristic role. The aim of science was, instead, to construct theories, with theories understood as classificatory or representative structures systematically presented and formulated in precise symbolic.. (shrink)

Multinational corporations are operating in complex business environments. They are confronted with contradictory institutional demands that often represent mutually incompatible expectations of various audiences. Managing these demands poses new organizational challenges for the corporation. Conducting an empirical case study at the sportswear manufacturer Puma, we explore how multinational corporations respond to institutional complexity and what legitimacy strategies they employ to maintain their license to operate. We draw on the literature on institutional theory, contingency theory, and organizational paradoxes. The results of (...) our qualitative longitudinal study show that managing corporate legitimacy is a dynamic process in which corporations adapt organizational capacities, structures, and procedures. Die Frage nach der Seinsweise der realen Welt gehört zu den zentralen und am meisten umstrittenen Themen der europäischen Philosophie. Weder die Argumente des Idealismus noch die des Realismus haben das Problem gelöst. Auch die Frage nach dem Wesen und dem Schicksal des Menschen und seiner Stellung in der Welt ist nicht ablösbar von der Grundfrage nach dem Wesen der Natur und der Existenzweise der realen Welt. Eine kritische Prüfung der Problemsituation ergibt, daß die seit mehr als zweihundert Jahren herrschende (...) Neigung, das Problem der Existenz der Welt erkenntnistheoretisch aufzufassen, eine Verschiebung und Verfälschung des eigentlichen Problems mit sich gebracht hat, das kein erkenntnistheoretisches, sondern im Kern ein echt metaphysisches ist. Contract cheating – outsourcing student assignments for a fee – presents a growing threat to the integrity of higher education. As contract cheating is based on students purchasing assignments that are original, traditional plagiarism detection tools remain insufficient to detect contract cheating. Part of the problem is that proving contract cheating is difficult. As a result, instructors may find it hard to prosecute students. To help address the problem, this conceptual paper builds upon extant scholarship on contract cheating and argues (...) that a novel evidence-based approach is needed. Such an approach should allow instructors to detect and prosecute cases of contract cheating effectively and efficiently. The paper then presents an outline of such an approach and calls it the “Doping Test” approach as it mimics some aspects of doping testing in professional sport. (shrink)

A visible role in the theoretical discourses on education has been played in the last couple of decades by the constructivist epistemologies, which have questioned the basic assumptions of realist epistemologies. The increased popularity of interpretative approaches especially has put the realist epistemologies on the defensive. Basing itself on critical realism, this article discusses the ontological and epistemological commitments of educational research and its consequences for text interpretation. The aim of this book is to present and analyze philosophical conceptions concerning mathematics and logic as formulated by Polish logicians, mathematicians and philosophers in the 1920s and 1930s. It was a remarkable period in the history of Polish science, in particular in the history of Polish logic and mathematics. Therefore, it is justified to ask whether and to what extent the development of logic and mathematics was accompanied by a philosophical reflection. We try to answer those questions by analyzing (...) both works of Polish logicians and mathematicians who have a philosophical temperament as well as their research practice. The Codification of Islamic Criminal Law in the Sudan: Penal Codes and Supreme Court Case Law under Numayrī and al-Bashīr. By Olaf Köndgen. Studies in Islamic Law and Society, vol. 43. Leiden: Brill, 2018. Pp. xii + 480. $171, €149.

A study examined the journalistic codes of ethics from 23 countries involved in the Conference on Security and Cooperation in Europe (CSCE), using descriptive and interpretative content analysis. The contents of the 24 codes from the 23 countries were divided into explicit categories on the basis of a 17-part classification scheme, including: "truth, ""acquisition of facts, ""professional secrecy, ""freedom of information, ""professional integrity, ""human rights," and "values." Results indicated that: (1) the most important principle in all the codes was represented (...) by truth; (2) the general rule on acquisition and checking of facts was that journalists should use open and honest means to acquire information; (3) confidentiality of sources must be maintained; and (4) freedom of information figures prominently in nearly all of the codes. Findings suggest the development among the CSCE countries of some sort of basic, universal model of journalistic codes where the accent is on truth, freedom of information, and protection of the individual. Studies like this one point to the increasing urgency for research on the "new Europe" and its rapidly changing cultural landscape. This is the second of three parts of an introduction to the philosophy of climate science. In this second part about modelling climate change, the topics of climate modelling, confirmation of climate models, the limits of climate projections, uncertainty and finally model ensembles will be discussed.

Determinism and chance seem to be irreconcilable opposites: either something is chancy or it is deterministic but not both. Yet there are processes which appear to square the circle by being chancy and deterministic at once, and the appearance is backed by well-confirmed scientific theories such as statistical mechanics which also seem to provide us with chances for deterministic processes. Is this possible, and if so how? In this essay I discuss this question for probabilities as they occur in the (...) empirical sciences, setting aside metaphysical questions in connection with free will, divine intervention and determinism in history. Humans grasp discrete infinities within several cognitive domains, such as in language, thought, social cognition and tool-making. It is sometimes suggested that any such generative ability is based on a computational system processing hierarchical and recursive mental representations. One view concerning such generativity has been that each of the mind’s modules defining a cognitive domain implements its own recursive computational system. In this paper recent evidence to the contrary is reviewed and it is proposed that there is only one supramodal (...) computational system with recursion in the human mind. A recursion thesis is defined, according to which the hominin cognitive evolution is constituted by a recent punctuated genetic mutation that installed the general, supramodal capacity for recursion into the human nervous system on top of the existing, evolutionarily older cognitive structures, and it is argued on the basis of empirical evidence and theoretical considerations that the recursion thesis constitutes a plausible research program for cognitive science. In this first part about observing climate change, the topics of definitions of climate and climate change, data sets and data models, detection of climate change, and attribution of climate change will be discussed.

Why do systems prepared in a non-equilibrium state approach, and eventually reach, equilibrium? An important contemporary version of the Boltzmannian approach to statistical mechanics answers this question by an appeal to the notion of typicality. The problem with this approach is that it comes in different versions, which are, however, not recognised as such, much less clearly distinguished, and we often find different arguments pursued side by side. The aim of this paper is to disentangle different versions of typicality-based explanations (...) of thermodynamic behaviour and evaluate their respective success. My conclusion will be that the boldest version fails for technical reasons, while more prudent versions leave unanswered essential questions. (shrink)

Roman Ingardens Werk über das Kausalproblem führt entscheidend über den Problemstand hinaus, wie er von John Stuart Mill und seinen Nachfolgern gekennzeichnet und seither kaum mehr verändert worden war. Anknüpfend an deren Analyse von Bedingungszusammenhängen unternimmt Ingarden es, die Bereiche und Verteilungen ursächlicher Beziehungen im Sinne relativ isolierter Systeme innerhalb des einen Weltzusammenhanges zu interpretieren. Es gelingt ihm mittels einer formalen Analyse, verschiedene Typen möglicher kausaler Beziehungen zu unterscheiden und insbesondere das Determinismusproblem aus der leidigen Alternative "Zufall oder Notwendigkeit" (...) herauszuführen. The present collection takes stock of posthumanism and its theoretical development and impact in the field of Anglophone literary and cultural studies, with a particular focus on its role in education and the practice of teaching English. Posthumanism informs work in environmental or ecological criticism, climate change research, or human-animal studies - and poses an educational challenge since it also affects curricular and pedagogic theory and practice. Moreover, humanist idea(l)s of subject formation and individually acquired competences have a direct bearing (...) on conceptions of education. This is why the volume interrogates the potentials and pitfalls of posthumanist pedagogies and its connections with digitization, multiliteracies, non-European and non-anthropocentric thinking, and the role of literature pedagogy more generally, presenting case studies of teaching the posthuman from primary to tertiary levels.
