The beginning of the twenty-first century saw an apparent change in language in public discourses characterised by the rise of so-called “essentially oxymoronic concepts”, i.e., mainly oxymora and paradoxes. In earlier times, these rhetorical figures of speech were largely reserved for the domain of literature, the arts or mysticism. Today, however, many new technologies and other innovations are contributing to their rise also in the domains of science and of law. Particularly in law, their inherent contradictory quality of combining apparently (...) antagonistic suppositions challenges the traditional dualistic mode of reasoning and binary logic. As reflected in terms like fake news, alternative facts or conspiracy theories, these concepts are seen as a threat to the rule of law and legal certainty and have been described as harbingers of an age of disinformation or post-truth. The challenge posed by these apparently contradictory concepts requires a closer look at the premises that guide our legal thinking and a more integrated theory of the senses and their role in law, as captured by the terms “legal synaesthesia” and “legal semiotics”. It also calls for an inquiry into the mind’s functioning generally and how it processes information in the creative process of decision making, linking thoughts and actions as well as facts and fictions. Based on the qualification of “fake news” as an oxymoron, this article critically examines the deficiencies in a dichotomous distinction between fact and fiction exemplified by information about the pandemic of coronavirus disease 2019 in an attempt to clarify the principal issues for a global regulatory debate regarding “fake news”. In 2021, 193 Member States at UNESCO’s General Conference adopted the Recommendation on the Ethics of Artificial Intelligence as the first important step towards a future global standard-setting instrument on the subject. The text reflects an emerging consensus among the international community about the growing ethical concerns with artificial intelligence (AI). Among these concerns are also serious risks and dangers attributed to the manipulative effects of AI, which can be further exacerbated by the creative combination of AI with other innovative (...) technologies or applications, such as brain–computer interfaces (BCIs), functional magnetic resonance imaging (fMRI), robotics, and big data. The risks for individuals and society as a whole caused by manipulation through AI are already well known and have recently also been addressed by the European Union having released a proposal for an Artificial Intelligence Act (AIA). Among multiple risks related to AI, the AIA singles out the specific dangers related to AI systems that deploy “subliminal techniques beyond a person’s consciousness to materially distort a person’s behaviour in a manner that causes or is likely to cause that person or another person physical or psychological harm”. The present article thus aims to highlight the known and potential dangers related to AI systems manipulating human thoughts and behaviour through subliminal and supraliminal means and methods. To this end, it advocates the joint study of law and the senses captured by the concept of legal synaesthesia to correspond to the need for an interdisciplinary debate covering the complexity of the links between AI, related technologies, human perception based on the senses and the mind, as well as the role and instruments of law in the future organization of societies in this world. Regulating the Creative Economy Drastic changes have occurred throughout the past century and the world community is struggling to find the exact concepts to describe, understand and, possibly, govern them. One of the concepts used to describe these changes is the so-called "creative economy". Even though the concept is becoming more frequently used, it lacks a precise definition and its meaning remains elusive. Moreover, the proliferation of related concepts, such as the "experience economy", the "cultural economy", the "knowledge-based economy" and (...) the "creative and cultural industries", further obscures its precise scope and meaning. These concepts are, however, no less elusive, particularly because they are of a dual or oxymoronic character, which variably combines aspects of culture, creativity and intellectual creation on the one hand with those of the economy, business, trade and commerce on the other.In sum, the conceptual uncertainties also translate into major difficulties in finding appropriate regulatory responses in the sphere of law. The aim of the present article is therefore to cast light on the meaning of the concept of the creative economy with a view to paving the way for its better and more efficient regulation in the legal sphere. To this end, the first part offers a comprehensive interpretative analysis of the "creative economy" with a view to establishing its value to the present global governance debate. Based on the evidence that designates the creative economy as an evolving concept requiring a multidisciplinary model for the formulation of an adequate approach in law- and policymaking, the second part discusses some of the creative economy's major implications in the sphere of law. In this regard, several regulatory examples appear to advocate the abandonment of the conventional in favour of a more holistic method of regulation. The article concludes with some recommendations that are deemed useful for further debate and research in this area, which ultimately may contribute to the formulation of the kind of creative laws that are needed for the successful regulation of the creative economy in the future. PurposeThe purpose of this paper is to present a case study of the creation of a Knowledge Zone in Curaçao to provide an insight into how a Knowledge Zone is established. After devising a vision, strategic alliances were formed. This created synergy and momentum, giving the project and process a life of their own.Design/methodology/approachThe project of creating a K‐Zone is based on a theoretical framework which draws upon the notion of a creative class, and how it can be attracted to (...) a specific location. It also deploys change management methodology, which describes how change is implemented. The theory states that creativity will drive the economy in the future and that societies that are able to attract the creative class will excel. It is not clear what attracts the creative class but it is believed that a certain life style, concentrations of peers and virtual and physical connectivity are essential. To create these conditions some changes must be implemented and these changes are often resisted in the beginning.FindingsKnowledge Zones can be created if there is a clear shared vision, leadership and alliances that forge synergies. The project was started in 2010 by the UNA under the presidency of Dr Miguel Goede, the Rector Magnificus of the University of the Netherlands Antilles. With the support of the Board of Supervisors, the UNA entered/sought alliances with the nearby Carmabi Research Institute and the neighbouring school for nurses, which opened a new school building within the designated zone. The UNA also provided the impetus to start a campaign to construct a new hospital that was planned for the area neighbouring the university and to start a school of medicine. But the breakthrough came when the local telecom provider, United Telecommunication Services, decided to provide the university with dedicated internet connections that were capable of the highest speed available on the island.Originality/valueThe paper contributes to a framework for understanding the creative economy of Small Islands Developing States in the Caribbean and how change can be implemented in these settings. The potential of mitigating the spreading rate and consequences of the coronavirus disease 2019 currently depends on adherence to sanitary protocols. The current study aimed to investigate the role of fatalism and comparative optimism for adherence to COVID-19 protocols. We also tested whether these factors are directly associated with adherence or associated through attitudinal mediation. The results were based on a web survey conducted among university students in Tehran, Iran. The respondents completed a multidimensional measure of fatalism and measures of (...) comparative optimism, attitudes toward COVID-19 health measures, and adherence. The estimated structural equation model explained approximately 40% of the total variance in attitudes toward COVID-19 protocols and adherence. As expected, high internality was associated with stronger adherence, whereas luck was associated with weaker adherence. Comparative optimism was more strongly associated with adherence than fatalism, and somewhat unexpectedly comparative optimism was associated with stronger adherence. Analyses of direct and indirect effects suggested that fatalism was mainly mediated through attitudes, whereas comparative optimism had both direct and mediated effects. The findings are discussed in relation to the role of these social psychological factors for COVID-19 mitigation. (shrink)

This research aims to examine the specific risk of companies and their effectiveness in various stages of the company life cycle on state and nonstate ownership. For this purpose, the specific risk was estimated using Fama and French three-factor models, and the research objective was examined by considering the data panel model during the period 2015 to 2020 in a statistical sample consisting of 136 companies active in the Tehran Stock Exchange. For this purpose, the main contribution of research is (...) evaluation of the effect of specific risk in different stages of the life cycle of companies admitted to the Tehran Stock Exchange. Therefore, the main valuable advantage to helping stock managers is assessing the impact of government ownership and nongovernment ownership on the specific risk of companies at different stages of the life cycle. Also, presenting a model to show the effects of dependent and independent variables in order to evaluate the impact of government and nongovernment ownership. The research results confirmed that the specific risk of the company in the stages of introduction, growth, and decline is higher compared to the stages of maturity and stagnation of the life cycle of companies listed on the Tehran Stock Exchange. Because the coefficients of virtual variables related to the life cycle stages of the company are estimated to be significant. Also, the finding confirmed that government ownership significantly affects the relationship between firm risk and life cycle stages in companies listed on the Tehran Stock Exchange. Because, the coefficient of variable state ownership is negative and significant, indicating a lower specific risk in state-owned companies than in nonstate-owned companies. (shrink)

BackgroundThe acceptance or practical application of the do-not-resuscitate order is substantially dependent on internal or personal factors; in a way that decision-making about this issue can be specific to each person. Moreover, most nurses feel morally and emotionally stressed and confused during the process decision-making regarding DNR order. Therefore, the purpose of the present study was to evaluate nurses’ attitudes towards DNR order in a systematic review.MethodsThis critical survey was conducted using a systematic review protocol. To this end, the most (...) relevant articles published in domestic and foreign databases with no time limits until October 2018 were searched. The inclusion and exclusion criteria were articles on DNR order, studies about nurses’ attitudes, descriptive and analytical research papers, as well as those with download links and full texts. The given articles were also assessed in terms of their quality and their main results were extracted.ResultsOf the total number of 1663 articles searched in the process of systematic review to investigate nurses’ attitudes towards DNR order, 88 articles were included in the full-text review step and finally 10 articles, meeting the inclusion criteria, were found. Assessing the quality of articles included in this review showed that 8 articles, in general, were of good quality and 2 studies were characterized with moderate quality. The main factors associated with nurses’ attitudes towards DNR order were grouped into three categories of (1) nurses’ attitudes towards DNR order, (2) guidelines for DNR order, and (3) decision-making by patients and their families about DNR order. In most of the studies examined, nurses’ attitudes towards DNR order were reported positive.ConclusionIt seemed that nurses were willing to get involved in DNR order and each hospital was recommended to develop a written DNR policy directing individuals and avoiding their confusion in this respect. Summary In October of 2018 a new trilingual Achaemenid inscription from Naqsh-e Rostam was discovered and in March of 2019 a detailed investigation of it with linguistic and historical commentary was published online in ARTA. The inscription includes a previously unknown Old Persian verb, a-f-r-[?]-a-t-i-y, which the first publishers Soheil Delshad and Mojtaba Doroodi read as *ā-fra-yāti (perhaps “he comes forward to”) or *ā-fra-θāti (“he speaks forth to”). They conclude that “an Old Persian verb with the meaning ‘to greet, (...) to bless’ (etc.) seems to be called for”. It is clear that as a result of this discovery we get an Old Persian verb which could refer to an act which the Greek verb προσκυνεῖν may have described relating to the Persians. This new evidence stimulates further discussion about the practice and meaning of proskynēsis at the royal court in the Achaemenid Empire. My article shows that all literary and pictorial evidences on proskynēsis may be divided into two groups: 1) Greek authors’ information that represents proskynēsis mainly as prostration before the King; 2) Persian bas-reliefs that depict the scenes with proskynēsis as a hand-kissing gesture. It is supposed that the previously unknown Old Persian verb (like προσκυνεῖν in Ancient Greek usage) refers not only to specific gestures, but relates to a model of behaviour (‘salutation’, ‘obeisance’, ‘greeting’, ‘worship’, ‘respect’ etc.). It is argued that Achaemenid officials performed proskynēsis before the King as hand-kissing, while the rest of the people bowed down, kneeled or prostrated. Exceptions were made only for members of the royal family who did not perform proskynēsis, but kissed the King and got a kiss from him. (shrink)

In medieval epics such as the Byzantine Digenis Akritis and the Persian Šāhnāme, dragons are usually considered to be mere opponents of the hero. But the symbolism attached to them is far from being exclusively that of a monstruous creature fighting a good hero. The motif of the three-headed dragon combines an allegorical meaning with a mythological framework. The confrontation between a dragon and an apparently weaker protagonist like a maiden or a younger son highlights the latters’ inner strength and (...) intelligence, while dangerously revealing the dragon’s possession of these human qualities. On an axiological level, the dragon’s symbolism displays the same variety: the dragon is a malevolent creature, and the archetype of the enemy, but also serves as an auxiliary to sound out men’s hearts, as in Fereydūn’s trial of his three sons. The dragon furthermore symbolizes power when painted on banners. When united to its celestial foe, the dragon’s lineage leads to the birth of the greatest hero of the Persian epic, Rostam. Thus the dragon ultimately guarantees the world’s balance between good and evil. (shrink)
