Recent developments in theories for responsible innovation have focused on the importance of actively accounting for values in our technological designs. Leading among these theories is that of Value Sensitive Design which attempts to guide the design process on the basis of evaluative analysis. However, values often come into conflict and VSD has been criticized for not providing a proper method to resolve such inevitable conflicts. This paper examines three such methods and argues that although each has its merits, they (...) all fail to account for a common source of value conflicts known as value incommensurability. Drawing on literature from the field of axiology, this paper argues that by incorporating the evaluative relation of ‘parity’ each of these three methods, and the VSD framework in general, will be able to properly understand the relation which holds between conflicting design options stemming from the incommensurable of values and be able to guide designers in making rational decision in the face of such conflicts. Understanding the nusus and the interpretation of their texts has been at the center of the activities of many schools and ulama in fiqh studies, and as a result, each school of usool has sought to find a method suitable for their own understanding in order to understand and interpret the nusus in a sahih way. For this purpose, fiqh schools have developed some unique methods. It can be said that the main differences among the hukms that fiqh schools rely (...) on are generally due to these methodological differences. One of the efforts to understand and interpret through the linguistic structures and patterns of the nusus is tawīl. For this reason, it is necessary to know conceptions of tawīl in order to accurately determine the hukm giving methods of fiqh schools. In this context, the thought of Zâhiri Ṭawīl, which is based on the zâhiri meaning of the words in the language and aims to solve the meaning pattern of the nusus within the framework of the rules of the language, is important. To this end, the tawīl understanding of Ibn Hazm (d. 543/1148), one of the leading ulama of Zâhiri thought, has an important position in the determination of their understanding of fiqh and usool. For this purpose, by searching the works of Ibn Hazm, how his understanding of tawīl, which he used as a method, is reflected in his fiqh thought, will be examined through his fiqhi inferences. The Qur’an used their language when addressing the societies. The Qur'an especially, on the one hand, has used the language they use to convey its messages to its interlocutors in a correct and understandable way, on the other hand, it has used a unique style without departing from the natural structure of the language in unseen matters due to the nature of religious language. Therefore, it is necessary to take into account the words of the texts in order to understand and interpret the language used. The word tawīl was used by the ilm circles in the first period to mean the same as the word tafsir and in naming the works written as the Qur’an tafsir, the word tawīl was preferred instead of tafsir. Mâturîdî, the writer of the first dirayah tafsir, which points to the distinction between tafsir and tawīl, defines the word tafsir as 'to express exactly what is the meaning and purpose of the Qur'an, which is the divine word' and states that tafsir can be done only by the the Ṣaḥābah who knows Quran and Sunnah well. According to one of the many theses about the origin of language, it is God given. In other words, language has been taught to man by a supreme power (Allah). Ibn Hazm also defends this view. According to Ibn Hazm, the basic elements / elements of the language were taught by Allah to Adam (a.s), and then people developed this language in proportion to their needs. Therefore, the indications of the words depend on the declarations of God and linguistic experience. As a matter of fact, Allah has attributed new meanings to words such as salat, allegiance, hajj and similar words used for other meanings in the custom of language, and the new meanings attributed to them are accepted as the truth for the meanings of these words. Usûlists who adopted the method of fuqaha in usool, in the methods of istinbat of hukm out of sharii dalils, have generally made the taqseem of the words in terms of the meaning they were given to as âm, khâs, mushtarak and muavval while their taqsseem in terms of the words’ being used or not in the sense they were given was haqiqat, majaz, sarih and kinayah. Compared to other schools, the issue of tawīl has a different meaning according to the Zâhirî usûlists and faqih who base on the zâhiri khitab. Since the zâhir of the nusus is primary and essential, there should be a certain usool, principle and rule to give up the zâhir of the nusus and to switch to another possible meaning. Ibn Hazm states that there are different opinions among the usûlists about whether the imperative form is indicant of hukm. He also says that according to some Hanafi, Malikî and Shafii usûlists, as long as there is no evidence showing that it is wujub, tahrim, nedb, ibahâ and karahah, then the imperative form cannot be views as indicating a hukm. In this paper we provide the first comprehensive insight into corporate community involvement activities of companies in Turkey. Drawing upon an extensive database compiled from corporate websites and archive documents in addition to a primary survey of 77 of Turkey’s largest companies, we examine the pattern of corporate community activities in Turkey and juxtapose these against existing evidence for other countries and distinctive elements of Turkey’s institutional environment. Our analysis highlights the historical role played by leading philanthropists in stimulating corporate (...) community involvement activities in Turkey and shows that overall giving is very heavily concentrated among the largest givers. We also highlight the concentration of giving among consumer good producers, suggesting a clear strategic rationale for the majority of CCI activity in Turkey, the very low levels of giving by foreign owned and controlled companies, and the strong orientation of CCI in Turkey to projects concerned with education, healthcare and the arts. Prior research has tended to focus on the influences upon how much organizations contribute to charitable or community cases paying relatively little attentionto the recipients of these donations or how firms develop preferences in respect of them. This study, in order to fill these gaps in the literature, focuses on two main aspects of CCI within 500 biggest companies situated in Turkey. Firstly, it aims to explore how companies manage their CCI activities. The type and level of the managers who (...) are the decision makers and the departments from which CCI decisions are taken will be examined. This helps to understand the potential objectives and strategic importance of giving. Also it shows whether a firm has a stable orientation to CCI, or a more ad hoc orientation. Secondly, it aims to analyze the preferences of companies in respect of the area of priorities and exclusions. We argue that institutional environments can shape the CCI activities. Exploring the local conditions of the countries can give reasons for investment in specific areas. (shrink)

Prior research that analyses the cross-firm variation in the prevalence of women on corporate boards has tended to emphasise the importance of firm and industry-level factors, such as firm size, the quality of corporate governance, and the proximity to final consumers. In contrast, very little research has explored the role of national institutional factors for this important phenomenon. In this study, we explore the relative importance of country, industry, and firm-level factors in explaining the cross-firm variation in the proportion of (...) directorships occupied by female directors. Findings indicate that while all levels of influence are significant, country-level effects are a highly-important and under-researched antecedent of the presence of women on corporate boards. Calendars, as old as humanity itself, emerged out of the attempt to break down time in units and give meaning to life and time. As far as Islam is concerned, calendar as a subject gain more importance because identifying daily and yearly rituals and performing the rituals related to time on their specific time is an essential part of Islamic religious life. With a circulation of three million yearly and more than ten million readers, the calendar printed by the Presidency (...) for Religious Affairs of Turkey is a significant instrument in forming, changing and maintaining religious perceptions. We were led to do such a study by the lack of academic studies regarding this aspect of the calendars. The study is based on the texts placed on the frontal and back sides of the calendars printed and distributed by the Presidency for Religious Affairs in the years of 2002, 2007 and 2011. The texts have been analysed by the textual analysis method and the changes in religious perceptions have been pointed out. Unlike the expected institutional continuity, when the three periods compared, it is observed that considerable perception changes have taken place; many subjects have been left out while many have been introduced into the calendars. The study found out that as the years progressed and the periods passed, the calendars also changed dramatically. The most apparent change occurred in the calendars was global understanding in choosing or replacing the subjects. This means that the 2007 and 2011 calendars have excluded some national and spiritual values that were thought to be outmoded globally but included in the 2002 calendar. This also signifies a breaking point in religious perceptions of the Presidency for Religious Affairs. (shrink)

On May 13, 2014, a fire due to the combustion of accumulated methane gas in the Soma Eynez Mine in Turkey killed 301 miners. This case chronicles the events on the day of the accident and investigates the factors leading up to it. It depicts the chaos and confusion resulting from missing emergency protocol, inadequate responses of major stakeholders such as safety experts in the mine, company executives, and the political leadership at the ministry and prime ministry levels. It shows (...) how the interplay of a culture of leniency towards mining safety, insufficient mining policies and even less effective inspections coupled with nepotism and the local population’s desperation for work, all led to serious neglect in a major mine resulting in needless deaths. The Soma Eynez Mine disaster highlights how corporate greed fed into breaches of mining protocol and ethical conduct, eventually leading to the bankruptcy of a mining conglomerate and the imprisonment of 14 men. Research is an integral part of evidence-based practice in the emergency department and critical care unit that improves patient management. It is important to understand the need and major obstacles for conducting research in emergency settings. Herein, we review the literature for the obligations, ethics and major implications of emergency research and the associated limiting factors influencing research activities in critical care and emergency settings. We reviewed research engines such as PubMed, MEDLINE, and EMBASE for the last two decades using (...) the key words “emergency department”, “critical care”, “research”, “consent”, and “ethics” as the search terms. Research within emergency settings is slow or non-existent due to time and financial constraints as well as the lack of a research tradition. There are several barriers to conducting research studies in emergency situations such as who, what, when, and how to obtain patient consent. The emergency environment is highly pressurized, emotional, and overburdened. The time taken for research is a particular risk that could delay the desired immediate interventions. Ethical issues abound, particularly relating to informed consent. Research in emergency settings is still in its infancy. Thus, there is a strong need for extensive research in the emergency setting through community awareness, resource management, ethics, collaborations, capacity building, and the development of a research interest for the improvement of patient care and outcomes. We need to establish a well-structured plan to assess and track the decision-making capacity, consider a multistep enrolment and consent strategy, and develop an integrated approach for recruitment into studies. Hüseyin Atay’ın akademik çabasının merkezinde, insanı, içine doğduğu geleneğin tahakkümüne karşı akıl ve Kur’an’a dayanarak özgürleştirme ve özgünleştirme amacı bulunmaktadır. Onun temel motivasyonunu, Müslümanların içinde bulunduğu mevcut durumdan rahatsız olması ve bu duruma bir çözüm üretme amacı oluşturmaktadır. O, bu çabasıyla mevcut Müslüman düşünce geleneğinin hak ve hakikat zeminine dayanıp dayanmadığını tahkik ve tespit etmeyi hedeflemektedir. Söz konusu tahkik sürecinin metodolojisini din ile kültür ayrımı oluşturmaktadır. Bu bağlamda Atay’ın halkın, ulemanın ve Kur’an’ın dini şeklinde yaptığı tasnif, geleneksel din (...) anlayışları içerisinde meşrulaşan yanlışların tespiti ve ayıklanmasına imkân sağlayacak niteliktedir. Ona göre Kur’an, akla, ilme, fıtrata, yaşamın farklı boyutlarında insanın karşılaşabileceği problemlere çözüm sunan bir din getirmektedir. Bu yapısıyla Kur’an, insanlara akıl ve fıtrat temelinde iradi davranışlarını şekillendirmesi için doğru-yanlış, maruf-münker, sevap-günah kavramları ile belirlenmiş bir ahlak önerisinde bulunmaktadır. Akıl ile din arasında tam bir mutabakat olduğunu kabul eden Atay’ın din anlayışının sacayağını bilgi, iman ve ahlak oluşturmaktadır. Ona göre İslam’ın getirdiği tüm iyilikler ve güzellikler din, dil, renk, etnik köken, coğrafya farkı gözetmeksizin herkesi kuşatacak şekilde adalet ve hakkaniyete, hukuk ve ilkeye göre davranmayı gerektirmektedir. Kur’an’ın amacının, insan ve onun mutluluğu olduğunu belirten Atay, insanın kendini gerçekleştirmesi ve mutluluğu elde etmesinin iki boyutu olduğunu belirtmektedir. Bu boyutlardan ilki, birey olarak insanın yetkinleşmesi; ikincisi ise toplum içinde hem cinsleri ile olan ilişkisinde adalet temelinde kendi varlığını gerçekleştirebilmesidir. Atay, birey olarak insanın yetkinleşmesini, kendi varlığını borçlu olduğu yaratıcıyı bilmesi, tanıması, O’nun dışında hiçbir varlık önünde eğilmemesi ve kendisini özgür kılan Allah’ın verdiği onuru korumasına bağlamaktadır. Toplumsal boyutta insanın yetkinleşmesinin ise yaşamsal fonksiyonlarını gerçekleştirmek ve ihtiyaçlarını gidermek amacıyla insanın hem cinsleriyle ve doğayla kurduğu ilişkide adalet ilkesine uygun davranmasıyla mümkün olacağını belirtmektedir. Bu çalışma Hüseyin Atay’ın, Kur’anî ilkelerden hareketle “İslam” kelimesi üzerine bina ettiği ahlak anlayışını irdelemeyi amaçlamaktadır. Bu çerçevede, Atay’ın bireysel ve toplumsal boyutuyla ahlaki özne olan insanın yapıp etmelerine yön veren, ahlakın kesişim noktasını oluşturan bilgi ve iman arasındaki ilişkiye dair görüşleri, Kur’an’da insan doğasına uygun bir formda sunulan ahlakî kök değerler çerçevesinde ele alınmıştır. In this study the relationship between philosophy and literature is explored by means of an examination of ideas about language, the subject and ethics in the work of Friedrich Nietzsche, Robert Musil and Oğuz Atay.

In this study, the classification of Zaydī fuqahā’ that emerged in the mutaaḫḫirūn period of Zaydī fiqh and related terms are examined. The book named Bulūgh al-arab wa-kunūz al-dhahab fī-maʿrifat al-madhhab, which has great importance among the studies aiming to present the Zaydī fiqh accumulation as a uniform doctrinal structure was taken as a basis in the processing of the subject. After an introduction in which Zaydī fiqh studies are evaluated in their relationship with the subject, the issue is handled (...) under three main headings. In the first title, the author and his work are introduced, and in the second and third titles, the methods and terms used in the classification of the Zaydī fukahâ are examined. The author of the work is ʿAlī b. ʿAbd Allāh al-Shaharī (d. 1190/1776) who lived during the period of the Qāsimī dynasty (al-dawla al-Qāsimiyya) in Yemen. The most important feature of the work, which was prepared using many sources that were attributed importance among the Zaydī literature, is that it was the most comprehensive of all that had written on madhhab doctrine until then. The first part of the work explains that the right madhhab to be followed is Zaydiyya. In the second part, the classes of the Zaydī fuqahā’, which is the subject of our study, are explained. The fuqahā’ classes are primarily divided into two parts: al-salaf al-ṣāliḥīn and al-ḫalaf al-ṣāliḥīn. The first dates back to the beginning of the 3rd/10th century. This class is divided into two parts, as al-sābiqūn and al-mutaaḫḫirūn. The sābiqūn starts with ʿAlī b. Abī Ṭālib, his two sons al-Ḥasan and Ḥusayn and ends with the sons of twelve imams who are their descendants. Zayd b. ʿAlī (d. 122/740) is one of the twelve imams. The most important of the faqīhs in the part of mutaaḫḫirūn, which started with al-Qāsim b. Ibrāhīm al-Rassī (d. 246/860), are the six imams called ahl-al-nuṣūṣ or aʾimma al-nuṣūṣ. The reason why they are named as such is that their words were taken as a basis in determining the views of the sect on the field of uṣūl and furūʿ l-fiqh. al-Qāsim al-Rassī is at a point where all the knowledge of the Prophet's family and the principles agreed upon by sābiqūn, reach him through many channels. al-Hādī Yaḥyā b. al-Ḥusayn (d. 298/911), grandson of al-Qāsim, is the most important imam in terms of his position in the madhhab. The ḫalaf al-ṣāliḥīn is also divided into two parts as ahl l-taḥṣīl and ahl l-naẓar. The first part also referred to as muḥaṣṣilūn or aʾimma al-taḥṣīl, has no subcategories. The second part is divided into two sub-sections as ahl l-taqrīr and mudhākirūn. The muḥaṣṣilūn class starts with those who catch up with the last class of ahl al-nuṣūṣ and ends with ʿAbd Allāh b. Ḥamza (d. 614/1217), one of the three important imams. Two other important imams of muḥaṣṣilūn are Aḥmad b. al-Huṣayn (d. 411/1020) and his brother Yahyā b. al-Husayn (d. 424/1032). It is the fiqh activity of the jurists of this class, called taḥṣīl l-madhhab, that brought Zaydī fiqh, which was fiqh of imams (madhāhib l-aʾimma) in its first period, into a single madhhab and to its classical form in the last period. Mudhākirūn jurists lived at the same time as the ahl-t-taqrīr. This period is about 700 years from the beginning of the 6th/12th century, which is the last century of the muḥaṣṣilūn class, to the end of the 12th/18th century, when Shaharī lived. The roles of the ahl al-taqrīr in the madhhab mostly consist of reviewing the works of the ahl-l tahṣīl, approving the correct ones, and correcting the wrong ones. That's why they are so named. The author of Kitāb l-Azhār, Aḥmad b. Yaḥyā l-Murtaḍā (d. 840/1437), is one of the prominent jurists among the ahl l-taqrīr. The majority of Zaydi fuqahā’ belong to the muẕākirūn class. These are the lowest class of the ahl-al-naẓar. As an important result reached in the study, it is possible to express the following: There is a difference between some of the knowledge and opinions in modern Zaydī studies, which include the same subject as Shaharī's work, in terms of the classification of Zaydī fuqahā’ and the terms used. Therefore, the findings and conclusions based on this work should be confirmed by new studies on other Zaydī classics, and existing opinions on Zaydī jurisprudence should be reviewed. (shrink)
