The notion of a non-renounceable right is an integral part of recent liberal reconciliatory attempts to justify apparently paternalistic policies, such as compulsory insurance or providing people with certain goods irrespective of their subjective preferences, non-paternalistically. However, non-renounceable rights cannot be justified non-paternalistically. A critical scrutiny of the liberal reconciliatory arguments in question reveals this and points towards a plausible paternalist justification of the policies in question.

G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so-called ‘first-person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their relative (...) standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

According to the influential disrespect account of what paternalism is, and why it is wrong, paternalism involves an anti-egalitarian, disrespectful attitude on the part of the paternalist: X (the paternalist) assumes an attitude of superiority when interfering in Y's matters for Y's good. Pace this account, the article argues that an important, although somewhat overlooked, form of paternalism is not, all things considered, insulting. This form of paternalism focusses on people's occasional lack of appropriate self-respect or their failure to see (...) themselves as equals or to stand vis-à-vis others as such. (shrink)

This paper concerns Philippe Van Parijs's case for an unconditional basic income. It argues that given central egalitarian commitments - to wit, equal concern and respect; endowment-insensitivity ; ambition-sensitivity; and neutrality - endorsed by Van Parijs, a basic income does not appear to be a requirement of justice. The core claim defended is that there is a serious tension between and the idea of an unconditional basic income.

The use of tanning beds has been identified as being among the most significant causes of melanoma and non-melanoma skin cancer. Accordingly, the activity is properly seen as one that involves profound harm to self. The article examines paternalistic reasons for restricting sunbed usage. We argue that both so-called soft and hard paternalistic arguments support prohibiting the use of sunbeds. We make the following three arguments: an argument from oppressive patterns of socialization suggesting that the autonomous nature of the conduct (...) in question is questionable; an argument from so-called evaluative delusions in which individuals attach incorrect weights to some of their values; a strictly hard paternalistic argument appealing to the harm in itself pertaining to the use of sunbeds. In the luck egalitarian literature, one influential formulation of luck egalitarianism does not specify whether equalities that do not reflect people’s equivalent exercises of responsibility are bad with regard to inequality. This equivocation gives rise to two competing versions of luck egalitarianism: asymmetrical and symmetrical luck egalitarianism. According to the former, while inequalities due to luck are unjust, equalities due to luck are not necessarily so. The latter view, by contrast, affirms the undesirability of equalities as well as inequalities insofar (...) as they are due to luck. The symmetrical view, we argue, is by far the more compelling, both by internal luck egalitarian standards and in light of the external rightist emphasis on choice and responsibility to which luck egalitarianism may partly be seen as a response. Our main case for the symmetrical view is that when some people, against a background of equal opportunities, do not exercise their responsibility to the same degree as others, they cannot justifiably call for equalizing measures to be put in place. Indeed, such measures would be positively unfair. The symmetrical view, accordingly, rejects compensation in such cases, whereas the asymmetrical view, implausibly, enjoins it. We also examine two objections to this argument. First, that this view fails to qualify as genuinely egalitarian, instead collapsing the notion of equality into the notion of desert. Second, that the opposing asymmetrical view, in contrast to the symmetrical view, can draw support from its compatibility with sufficientarian concerns. Both objections are rebutted. We conclude that luck egalitarians are best served by endorsing the symmetrical, luck-neutralizing stance. (shrink)

Deceased organ donation is widely considered as a case of easy rescue―that is, a case in which A may bestow considerable benefits on B while incurring negligent costs herself. Yet, the policy implications of this observation remain unclear. Drawing on Christopher H. Wellman’s samaritan account of political obligations, the paper develops a case for a so-called opt-out system, i.e., a scheme in which people are defaulted into being donors. This paper examines the striking similarity between Kierkegaard’s and Mead’s theories of the self as relation, reflection and process as well as the normativity behind these theories. It is claimed that the theologian and the social psychologist share the view that the human being is an ethical being because its self is a dual relation; it relates to itself and in this relating it relates to an Other. Thus, regardless of their diverging views on the nature of this Other, they (...) both define that of becoming a self as an unavoidable task: the task of standing in an ethical relation to oneself and to the Other. It is argued that differences in professions can be overcome: while reading Kierkegaard in the light of Mead helps to underline the relational character of Kierkegaard’s ethical notions, reading Mead in the light of Kierkegaard underlines the normative aspect of Mead’s social psychology. ABSTRACTIn this article, the intention is twofold. To introduce and substantiate Søren Kierkegaard’s notion of love and to put this notion in relation to the Romantics. The article is divided into six sections. I first offer a brief description of Kierkegaard’s view on the Romantics, his affections and his disagreements. Secondly, I will introduce Kierkegaard’s own notion of love that rest partly on Plato’s view on eros as passion, partly on the biblical definitions of love in 1 John and Matthew. (...) Thirdly, I will present Kierkegaard’s notion of love as a double urge to love and to be love and contrast this double-bound urge with Anders Nygren’s notion of eros and agape and C. S. Lewis’ differentiation between Need-Love and Gift-Love. In the fourth section, I will discuss the relation between human and divine love. In the fifth section, I will introduce Kierkegaard’s notion of being in love as preferential love. And finally, in the sixth paragraph, I will address Kierkegaard’s view on neighbor love. (shrink)

Any great new theoretical framework has an epistemological and an ontological aspect to its philosophy as well as an axiological one, and one needs to understand all three aspects in order to grasp the deep aspiration and idea of the theoretical framework. Presently, there is a widespread effort to understand C. S. Peirce's (1837–1914) pragmaticistic semeiotics, and to develop it by integrating the results of modern science and evolutionary thinking; first, producing a biosemiotics and, second, by integrating it with the (...) progress in cybernetics, information science, and system theory to create a cybersemiotics. In this paper, we focus on the understanding of the evolution of the universe that Peirce produced as an alternative to the mechanistic view underlying classical physics and try to place man in an evolving universe as a creative, aesthetical agent. It is true that modern non-equilibrium physics has made a modern foundation for a profound physical understanding of the basic evolutionary processes in the universe. But science still has not produced a theory that can explain how the creativity of the universe could produce signification, interpretation, and first-person consciousness. To this end, Peirce's thoughts on agapastic evolution coupled with the aesthetically influence of the growth of ideas and reasonableness on man could make a contribution. (shrink)

As a spiritual autobiography, Kierkegaard's The Point of View for My Work as an Author stands among such great works as Augustine's Confessions and Newman's Apologia pro Vita Sua. Yet Point of View is neither a confession nor a defense; it is an author's story of a lifetime of writing, his understanding of the maze of greatly varied works that make up his oeuvre. Upon the imminent publication of the second edition of Either/Or, Kierkegaard again intended to cease writing. Now (...) was the time for a direct "report to history" on the authorship as a whole. In addition to Point of View, which was published posthumously, the present volume also contains On My Work as an Author, a contemporary substitute, and the companion piece Armed Neutrality. This paper discusses Wittgenstein's take on the problem of other minds. In opposition to certain widespread views that I collect under the heading of the “No Problem Interpretation,” I argue that Wittgenstein does address some problem of other minds. However, Wittgenstein's problem is not the traditional epistemological problem of other minds; rather, it is more reminiscent of the issue of intersubjectivity as it emerges in the writings of phenomenologists such as Husserl, Merleau-Ponty, and Heidegger. This is one sense in which (...) Wittgenstein's perspective on other minds might be called “phenomenological.” Yet there is another sense as well, in that Wittgenstein's positive views on this issue resemble the views defended by phenomenologists. The key to a proper philosophical grasp of intersubjectivity, on both views, lies in rethinking the mind. If we conceive of minds as essentially embodied we can understand how intersubjectivity is possible. (shrink)

Stages on Life's Way, the sequel to Either/Or, is an intensely poetic example of Kierkegaard's vision of the three stages, or spheres, of existence: the esthetic, the ethical, and the religious. With characteristic love for mystification, he presents the work as a bundle of documents fallen by chance into the hands of "Hilarius Bookbinder," who prepared them for printing. The book begins with a banquet scene patterned on Plato's Symposium. (George Brandes maintained that "one must recognize with amazement that it (...) holds its own in this comparison.") Next is a discourse by "Judge William" in praise of marriage "in answer to objections." The remainder of the volume, almost two-thirds of the whole, is the diary of a young man, discovered by "Frater Taciturnus," who was deeply in love but felt compelled to break his engagement. The work closes with a letter to the reader from Taciturnus on the three "existence-spheres" represented by the three parts of the book. Stages on Life's Way not only repeats themes, characters, and pseudonymous authors of the earlier works but also goes beyond them and points to further development of central ideas in Concluding Unscientific Postscript. This paper examines Heidegger's critique of Husserl in its earliest extant formulation, viz. the lecture courses Ontologie from 1923 and Einführung in die phänomenologische Forschung from 1923/4. Commentators frequently ignore these lectures, but I try to show that a study of them can reveal both the extent to which Heidegger remains committed to phenomenological research in something like its Husserlian form, and when and why Heidegger must part with Husserl. More specifically, I claim that Heidegger rightly criticizes Husserl's account of (...) 'equipmental objects', and that he is especially unsatisfied with the terminology in which Husserl presents his phenomenological analyses, not only of 'equipment', but of other types of entities as well. However, it will also emerge that Heidegger's own phenomenological work presupposes the performance of what Husserl calls the 'epoch ', the method of 'bracketing' natural knowledge. In this way, Heidegger's sometimes very severe critique must be understood as an internal critique. (shrink)

The introduction of the concept of capital inCapital– with the words ‘we find’ – has provoked a great deal of discussion about the precise relation between the categories of simple circulation and the concept of capital. In this article, I argue that Marx derives the concept of capital by way of an analysis of the immanent contradictions of money, and that this dialectical derivation can be understood as a conceptual movement in which the concepts of money and capital progressively change (...) their modal status. Furthermore, I examine the development of this transition to capital throughout Marx’s writings from the period 1857 to 1872, arguing that the same arguments can be found in all the relevant writings.
