This brief tour of American law has demonstrated a little of the breadth and currency of legal liability actions which affect nursing. As health care changes and nursing roles change with it, so too will the nature of liability in this area. The American penchant for litigation is such that the chances of disentangling nurses from the continued onslaught of negligence litigation seem remote.

Critics of SRI have said little about the integrity of corporate representations resulting in screening inclusion or exclusion. This is surprising given social and environmental accounting research that finds corporate posturing and deception in the absence of external verification, and a parallel body of literature describing corporate "greenwashing" and other forms of corporate disinformation. In this paper I argue that the problems and challenges of ensuring fair and accurate corporate social reporting mirror those accompanying corporate compliance with law. This study examined cognitive representations of routine action, through the assessment of level of agency, in individuals with sub-clinical checking. The level of agency stems from Action Identification Theory [Vallacher, R. R., Wegner, D. M. . Levels of personal agency: Individual variation in action identification. Journal of Personality and Social Psychology 57, 660–671], which states that how actions are usually identified reflects the predominant accessibility of internal representation . Furthermore, this framework proposed that altered action regulation is related to low-level (...) of agency . In the current study, the main result indicated that checking symptoms were related to a low-level of agency, that is, individuals with sub-clinical checking identified habitual actions on the basis of instrumental aspects. This seems to indicate that checkers may act with a lack of goal representations. The results are discussed in terms of the role of low-level of agency in checking phenomena and related cognitive dysfunction. (shrink)

Research on self-agency emphasizes the importance of a comparing mechanism, which scans for a match between anticipated and actual outcomes, in the subjective experience of doing.This study explored the “feeling of doing” in individuals with checking symptoms by examining the mechanism involved in the experienced agency for outcomes that matched expectations. This mechanism was explored using a task in which the subliminal priming of potential action-effects generally enhances people’s feeling of causing these effects when they occur, due to the unconscious (...) perception of a match between primed and observed outcomes. The main result revealed a negative relationship between checking and self-agency for observed outcomes that were primed prior to actions. This suggests that checking individuals fail to grasp the correspondence between actual outcomes of their actions and expected ones. We discuss the possible role of undermined self-agency in checking phenomena and its relationship with cognitive dysfunction. (shrink)

Efforts to institutionalize ethics in corporations have been discussed without first addressing the desirability of norm conformity or the possibility that the means used to elicit conformity will be coercive. This article presents a theoretical context, grounded in models of social control, within which ethics initiatives may be evaluated. Ethics initiatives are discussed in relation to variables that already exert control in the workplace, such as environmental controls, organizational controls, and personal controls.

Ethicists and legal theorists have proposed models of corporate culpability that shift the standard of guilt determination from vicariousattribution of individual action and intention to an assessment of culture, policies, as well as organizational action and inaction. This paper briefly reviews four prominent models of corporate culpability, arguing that each makes claims that extend well beyond the limits of existing law. As an alternative to these models, a constructive corporate fault is described that relies on both objective and subjective reasonableness (...) judgments. Rankings of countries by perceived corruption have emerged over the past decade as leading indicators of governance and development. Designed to highlight countries that are known to be corrupt, their objective is to encourage transparency and good governance. High rankings on corruption, it is argued, will serve as a strong incentive for reform. The practice of ranking and labeling countries "corrupt," however, may have a perverse effect. Consistent with Social Labeling Theory, we argue that perceptual indices can encourage the loss (...) of needed investment and, thus, contribute to higher rates of corruption within unfavorably ranked countries. In effect, corruption indices may inhibit foreign direct investment, the effect of which is to encourage the status quo in terms of corruption ranking. Using an experimental study design, we test the effects of country corruption rankings on the assessment of country investment desirability and find ranking exposure causes shifts in country investment desirability for 10 of 12 countries studied. These findings suggest that corruption rankings, which are based on perceptions of corruption, may cause country isolation and a reduction in legitimate means of investment. (shrink)

Psychopathy is characterized by pronounced emotional deficits, yet individuals with psychopathic traits generally understand the law and the likely punishments for violating it. Vitacco, Erickson, and Lishner (2013) suggest that because of this appreciation, there is no question that psychopaths are criminally responsible. We make the modest argument that increasing psychological and neurological evidence calls into question whether conventional assumptions about an offender’s culpable states of mind hold true for psychopaths. It is likely, we suggest, that a wide range of (...) deficits found in psychopaths impair their ability to calculate risks of harm and utilize information about the consequences of their behavior. This response to Professor Hasnas recasts the apparent divergence between the legal and ethical obligations of managers in light ofthe rhetorical claims and counterclaims that accompany the interaction between regulators and the regulated. It is argued that this divergence is more apparent than real, and that the convincing but often empty rhetorical statements that accompany reforms should be seen in context and largely disregarded. The Greenberger-Horne-Zeilinger state is the most famous example of a state with multiparticle entanglement. In this article we describe a group theoretic framework we have been developing for understanding the entanglement in general states of two or more quantum particles. As far as entanglement is concerned, two states of n spin-1/2 particles are equivalent if they are on the same orbit of the group of local rotations (U(2)n). We consider both pure and mixed states and calculate the number of independent (...) parameters needed to describe such states up to this equivalence. We describe how the entanglement of states in a given equivalence class may be characterized by the stability group of the action of the group of local rotations on any of the states in the class. We also show how to calculate invariants under the group of local actions for both pure and mixed states. In the case of mixed states we are able to explicitly exhibit sets of invariants which allow one to determine whether two generic mixed states are equivalent up to local unitary transformations. Ubiquitous computing is a new kind of computing where devices enhance everyday artefacts and open up previously inaccessible situations for data capture. ‘Technology paternalism’ has been suggested by Spiekermann and Pallas (Poiesis & Praxis: Int J Technol Assess Ethics Sci 4(1):6–18, 2006) as a concept to gauge the social and ethical impact of these new technologies. In this article we explore this concept in the specific setting of UK road maintenance and construction. Drawing on examples from our qualitative fieldwork we (...) suggest that cultural logics such as those reflected in paternalistic health and safety discourse are central in legitimising the introduction of ubiquitous computing technologies. As such, there is little doubt that paternalism plays an essential role in people’s reasoning about ubiquitous computing in this setting. We argue, however, that since discourses such as health and safety are used by everyone (including both managers and workers) in the organisation to further their own aims, technologies transcend purely paternalistic conceptualisations and instead become a focal point for ongoing struggles for control between those deploying and using them. This means that the benefits and costs of such new technologies become harder to define from an ethical and social perspective. (shrink)

Yet critics argue such programs are cosmetic. Here we studied bank employees before and after the introduction of formal ethics training—an important component of formal ethics programs—to examine the effects of training on ethical organizational culture. Two years after a single training session, we find sustained, positive effects on indicators of an ethical organizational culture (observed unethical behavior, (...) intentions to behave ethically, perceptions of organizational efficacy in managing ethics, and the firm’s normative structure). While espoused organizational values also rose in importance post-training, the boost dissipated after the second year which suggests perceptions of values are not driving sustained behavioral improvements. This finding conflicts with past theory which asserts that enduring behavioral improvements arise from the inculcation of organizational values. Implications for future research are discussed. Obgleich (...) die Ratio von den Vorschriften der logischen Hermeneutik ausgeht, beruht sie auf einer Aufwertung der Themen der antiken Rhetorik und konzipiert die Hermeneutik als eine auf die Mittel-Zweck-Rationalität gestützte Technik, der die Aufgabe zukommt, die besten Mittel für das Verstehen von Texten und Reden festzulegen. Die heilige Hermeneutik von Zur Linden zeichnet sich durch wenigstens vier innovative Aspekte aus: 1. Den Vorschlag einer allgemeinen Hermeneutik probabilistischer Art. 2. Eine eingehende Untersuchung der verschiedenen Sinnbegriffe und ihrer Wechselbeziehungen. 3. Die Kritik am Besserverstehen als Auslegungsziel. Seine autorbezogene Texthermeneutik stellt sich noch heute als originelle, beachtenswerte Leistung dar. In 1735 Johann Georg Zur Linden published his "Ratio meditationis hermeneuticae imprimis sacrae methodo systematica proposita" in Jena. His work was the result of an unexpected alliance between the Wolffian Enlightenment and Pietism, after the fierce clash between these two trends which had culminated in Wolff’s banishment from Halle. In the years that followed a new cultural figure appeared, the Enlightener-Pietist, or vice versa, who was to dominate the high and late Enlightenment and of whom Zur Linden was one of the first examples. Although the Ratio takes as its starting-point the rules of logical hermeneutics, it is based in an evaluation of the themes of classical rhetoric, and conceives hermeneutics as a technique, grounded in means-end rationality, the task of which is to determine the best method for understanding texts and speech. Zur Linden’s sacred hermeneutic theory is distinguished by at least four innovative aspects: 1. The proposal of a general hermeneutics of a probabilistic type. 2. An intensive examination of the different concepts of sense and their interrelationships. 3. The critique of better understanding as the goal of exegesis. The critical points of the text should not be obliterated in favour of its consistency. 4. The possible lack of agreement between what the author intends to say and what he actually says. For Zur Linden the sense of the text takes undoubted precedence and constitutes the only possible access to the author’s sense. His author-related textual hermeneutics can still be seen today as an original and noteworthy achievement. (shrink)

Increasing evidence from psychology and neuroscience suggests that emotion plays an important and sometimes critical role in moral judgment and moral behavior. At the same time, there is increasing psychological and neuroscientific evidence that brain regions critical in emotional and moral capacity are impaired in psychopaths. We ask how the criminal law should accommodate these two streams of research, in light of a new normative and legal account of the criminal responsibility of psychopaths.

This essay discusses the instructional value of mathematical proofs using different interpretations of the analysis cum synthesis method in Apollonius’ Conics as a case study. My argument is informed by Descartes’ complaint about ancient geometers and William Thurston’s discussion on how mathematical understanding is communicated. Three historical frameworks of the analysis/synthesis distinction are used to understand the instructive function of the analysis cum synthesis method: the directional interpretation, the structuralist interpretation, and the phenomenological interpretation. I apply these interpretations to the (...) analysis cum synthesis method in order reveal how the same underlying mathematical activity occurs at different levels of scale: at the level of an individual proof, at the level of a collection of proofs, and at the level of a single line within a proof. On the basis of this investigation, I argue that the instructive value of mathematical proof lies in engendering in the reader the same mathematical activity experienced by the author themselves. The Russian invasion of Ukraine on February 24, 2022, has already caused large amounts of greenhouse gas (GHG) emissions and will continue to do so for many years after hostilities have ceased mainly because of the emissions linked to the rebuilding of destroyed or damaged housing, public buildings, infrastructure, factories, and the like. My aim in this paper is to discuss how in a time of climate emergency such emissions of war should impact the political morality of states initiating, continuing, (...) and ending war (through a just and enduring peace) as understood by just war theory (JWT). My point of departure is a study by Lennard de Klerk and six co-authors detailing the emissions of the first year of the Russo-Ukrainian war. (shrink)

A study is reported which focused on the problem-solving strategies employed by expert electronics engineers pursuing a real-world task: integrated-circuit design. Verbal protocol data were analysed so as to reveal aspects of the organisation and sequencing of ongoing design activity. These analyses indicated that the designers were implementing a highly systematic solution-development strategy which deviated only a small degree from a normatively optimal top-down and breadth-first method. Although some of the observed deviation could be described as opportunistic in nature, much (...) of it reflected the rapid depth-first exploration of tentative solution ideas. We argue that switches from a predominantly breadth-first mode of problem solving to depth-first or opportunistic modes may be an important aspect of the expert's strategic knowledge about how to conduct the design process effectively when faced with difficulties, uncertainties, and design impasses. Wason's standard 2-4-6 task requires discovery of a single rule and leads to around 20% solutions, whereas the dual goal (DG) version requires discovery of two rules and elevates solutions to over 60%. We report an experiment that aimed to discriminate between competing accounts of DG facilitation by manipulating the degree of complementarity between the to-be-discovered rules. Results indicated that perfect rule complementarity is not essential for task success, thereby undermining a key tenet of the goal complementarity account of DG (...) facilitation. The triple heterogeneity account received a good degree of support since more varied triple exploration was associated with facilitatory DG conditions, in line with this account's prediction that task success is associated with the creative search of the problem space. The contrast class account (an extension of Oaksford & Chater's, 1994, iterative counterfactual model) was also corroborated in that the generation of descending triples was demonstrated to be the dominant predictor of DG success. We focus our discussion on conceptual ideas relating to the way in which iterative counterfactual testing and contrast class identification may work together to provide a powerful basis for effective hypothesis testing. This paper seeks to defend the thesis that this American project of military hegemony has a variety of global security costs of such combined magnitude that there is a strong prima facie case against the resort to armed force by the United States, so that its wars might be wrong even when there is a just cause. My thesis is based on the jus ad bellum principle of proportionality.

This article explores the plausibility of some intuitions and counter intuitions about the anti-corruption efforts of MDBs and international organizations leveraging the power of the private sector. Regulation of a sizable percentage of global private sector actors now falls into a new area of international governance with innovative institutions, standards, and programs. We wrestle with the role and value of private sector partnerships and available informal and formal social controls. Crafting proportional informal controls (e.g., monitoring, evaluations, and sanctions) and proper (...) incentives to cooperative games across networks are the lynchpins of successful collective action programs. Ambivalence with informal social controls or effective incentives, we argue, risks far too much deference to private sector interests. (shrink)

Stanovich & West's dual-system represents a major development in an understanding of reasoning and rationality. Their notion of System 1 functioning as a computational escape hatch during the processing of complex tasks may deserve a more central role in explanations of reasoning performance. We describe examples of apparent escape-hatch processing from the reasoning and judgement literature.

The first reason is that it lies at the very origin of classical philosophy which could be described as resulting directly from the way in which Plato and Aristotle succeeded in separating the (...) realm of rhetoric from the realm of philosophy. The second reason arises out of the way in which Durkheim, the founder of French academic sociology, thought it necessary to establish a clear distinction between sociology and pragmatism. This was done in a course given at the Sorbonne during the academic year 1913–14. The course could be considered a direct answer to the lectures on pragmatism given by William James at the Lowell Institute in Boston in 1906–7 (Durkheim 1955).From the very beginning of his talk, Durkheim expresses an extremely ambivalent point of view. On the one hand, pragmatism, better than any other doctrine, allows one to feel the necessity of reforming or renovating the type of "traditional rationalism" that dominated the French intellectual atmosphere of the time. On the other hand, it represents a real threat for this same rationalist tradition. Is it not a declaration of war that pragmatism launches on rationalism when William James writes that "against [End Page 326] rationalism as a pretension and a method pragmatism is fully armed and militant" (1975, 32)? In the face of this attack Durkheim declares that what is at stake are the very foundations of French culture: "Our whole French culture is essentially based on rationalism. Here the eighteenth century lives on. Thus, a radical negation of rationalism would constitute a danger: it would imply a complete disruption of our national culture. The whole French spirit would have to be transformed if the form of irrationalism that pragmatism represents were to be admitted" (1955, 28). Durkheim adds that this threat is not limited to the French tradition: "Not only our culture but the whole of the philosophical tradition has been, since the very beginnings of philosophical speculation—apart from a single exception that will be dealt with later—of a rationalist tendency. Therefore it is toward the disruption of all this tradition that one would have to proceed if pragmatism were valid" (1955, 28).Durkheim insists that what pragmatism tends to destroy is the "cult of truth," the fact that there are judgments that are necessary, which he will allude to throughout his analysis as corresponding to a dogmatic conception of truth that is repeatedly criticized by William James. Despite its strengths, Leech et al.'s model fails to address the important benefits that derive from self-explanation and task feedback in analogical reasoning development. These components encourage explicit, self-reflective processes that do not necessarily link to knowledge accretion. We wonder, therefore, what mechanisms can be included within a connectionist framework to model self-reflective involvement and its beneficial consequences.

The development of art marketing as a new field of management occurs in a context of great confusion as to what constitutes the very definition of art, one aspect of this confusion being nothing else but the confusion between art and marketing itself. This confusion leads to conflicts between those who consider that art should be defined by a clear aesthetic criterion and those who accept the absence of such a criterion as a legitimate consequence of the principle of freedom (...) which applies both to the creation of the artist and to the taste of the public. This state of confusion does not seem to be experienced in the same way in France where it has tended to be considered as a symptom of crisis in the world of art and in the United States where it has raised as a dominant force in contemporary art. Hence the confusion of art and marketing varies as a function of time (as shown by the emergence of a new field of management) and of space (as shown by the comparison of the French and American cases). It will be proposed that it is possible to account for these historical fluctuation thanks to an institutional approach based on the notion of system of legitimacy. We shall propose the essentially dynamic institutional foundations of modernity leading to the proliferation of innovations which consequences are ever more difficult to anticipate as a reason why, in America, philosophers coming from the analytic tradition found it meaningful to address questions such as “What is art” (Arthur Danto) or “When is there art” (Nelson Goodman”) expressing the need to go beyond pragmatism as expressed by John Dewey’s Art as Experience to promote a positive attitude towards contemporary art, while, in France confusion between art and marketing has been commonly considered negatively as the sign of the triumph of the most radical form of rhetoric, i.e. sophism. The Theory Theory (TT) versus Simulation Theory (ST) debate is primarily concerned with how we understand others’ mental states. Theory theorists claim we do this using rules that are akin to theoretical laws, whereas simulation theorists claim we use our own minds to imagine ourselves in another’s position. Theorists from both camps suggest a consideration of individuals with autism spectrum disorders (ASD) can help resolve the TT/ST debate (e.g., Baron-Cohen 1995; Carruthers 1996a; Goldman 2006). We present a three-part argument that (...) such research has so far been inconclusive and that the prospects for studies of ASD to resolve the debate in the near future remain uncertain. First, we discuss evidence indicating that some individuals with ASD can perform effectively on tests of mental state understanding, which questions what ASD can tell us regarding theorising or simulation. Second, we claim that there is compelling evidence that domain-general mechanisms are implicated in mental state reasoning, which undermines how ASD might inform the TT/ST debate given that both theories appeal to domain-specific mindreading mechanisms. Third, we suggest that neuroscientific evidence for an assumed role of the mirror neuron system in autism also fails to arbitrate between TT and ST. We suggest that while the study of ASD may eventually provide a resolution to the TT/ST debate, it is also vital for researchers to examine the issues through other avenues, for example, by examining people’s everyday counterfactual reasoning with mental state scenarios. En el presente trabajo se pone de relieve una tesis del último Kuhn que ha sido, y aún es, desatendida: el carácter no universal del lenguaje. Luego de ubicarla en los textos y contextos teóricos donde aparece, se intenta aclararla a partir de algunos de sus textos posteriores. En este afán, el trabajo presente en primer lugar muestra, cómo, deben ser modificadas algunas de las propuestas filosóficas atribuidas al Kuhn clásico para poder comprender esta tesis y en segundo lugar, intenta (...) dar cuenta muy brevemente de ciertas innovaciones filosóficas del último Kuhn. Además, se comparan algunas de esas nuevas tesis de Kuhn con sus posibles -aunque nunca explicitados- interlocutores, a saber: N. Chomsky y J. Fodor. This paper draws attention to one of the theses of the Later Kuhn, which has been ignored: the non-universal character of language. After locating the thesis in the texts and theoretical contexts in which it appears, it is attempted to be clarified in view of some of his later texts. In regard of this, the paper firstly shows, how some of the philosophical proposals attributed to the Early Kuhn must be modified in order to understand it. Secondly, a very brief account for certain philosophical innovations in the Later Kuhn is attempted to be given. In addition, some of Kuhn's new theses are compared with his most likely, even if never explicit, interlocutors, namely N. Chomsky and J. Fodor. (shrink)

Misinformation about the novel coronavirus is a pressing societal challenge. Across two studies, one preregistered, we assess the efficacy of two ‘prebunking’ interventions aimed at improving people’s ability to spot manipulation techniques commonly used in COVID-19 misinformation across three different languages. We find that Go Viral!, a novel five-minute browser game, increases the perceived manipulativeness of misinformation about COVID-19, improves people’s attitudinal certainty in their ability to spot misinformation and reduces self-reported willingness to share misinformation with others. The first two (...) effects remain significant for at least one week after gameplay. We also find that reading real-world infographics from UNESCO improves people’s ability and confidence in spotting COVID-19 misinformation. Limitations and implications for fake news interventions are discussed. (shrink)

Although Freud's merits may be readily acknowledged in the year of his 150th birthday, recent findings on repression-related phenomena cannot be accommodated by his classic conception, on which Erdelyi's theory is built. This point is illustrated by discussing the role of inhibitory processes. The unified theory of repression should be elaborated to generate falsifiable predictions on the reported phenomena.

Ernest Mandel theorised the capitalist world economy as an articulated system of capitalist, semi-capitalist and precapitalist relations of production, linked to each other by capitalist relations of exchange and domination by the capitalist world market. This seems to be an interesting starting point for an historically well-founded theory, building on and going beyond Marx's work, of the worldwide expansion of the capitalist mode of production from its origins to the present. In his attempt to formulate his theory, Mandel did not (...) succeed in resolving all difficulties, however. His main works – Marxist Economic Theory and Late Capitalism – show a number of dangling loose ends. The central question is whether these loose ends are merely technical difficulties or whether they reveal fatal flaws in the theory as a whole. In order to come a step closer to answering this question, a conference was organised in Amsterdam, November 2003. This introduction formulates the five, closely interrelated issues that were highlighted at this conference. (shrink)

We applaud many aspects of Elqayam & Evans' (E&E's) call for a descriptivist research programme in studying reasoning. Nevertheless, we contend that normative benchmarks are vital for understanding individual differences in performance. We argue that the presence of normative responses to particular problems by certain individuals should inspire researchers to look for converging evidence for analytic processing that may have a normative basis.
