BackgroundHospitalized older adults frequently have impaired cognition and must rely on surrogates to make major medical decisions. Ethical standards for surrogate decision making are well delineated, but little is known about what factors surrogates actually consider when making decisions.ObjectivesTo determine factors surrogate decision makers consider when making major medical decisions for hospitalized older adults, and whether or not they adhere to established ethical standards.DesignSemi-structured interview study of the experience and process of decision making.SettingA public safety-net hospital and a tertiary referral (...) hospital in a large city in the Midwest United States.ParticipantsThe study included 35 surrogates with a recent decision-making experience for an inpatient aged 65 or older.MeasurementsThe key factors that surrogates considered when making decisions. Interview transcripts were coded and analyzed using the grounded theory method of qualitative analysis.ResultsSurrogates considered patient-centered factors and surrogate-centered factors. Patient-centered factors included: respecting the patient’s input, using past knowledge of the patient to infer the patient’s wishes, and consider ing what is in the patient’s best interests. Some surrogates expressed a desire for more information about the patient’s prior wishes. Surrogate-centered factors included: surrogate’s wishes as a guide, surrogate’s religious beliefs and/or spirituality, surrogate’s interests, and family consensus.ConclusionOur study indicates that surrogate decision making is more complex than the standard ethical models, which are limited to considerations of the patient’s autonomy and beneficence. Because surrogates also imagine what they would want under the circumstances and consider their own needs and preferences, models of surrogate decision making must account for these additional considerations. Surrogates’ desire for more information about patients’ preferences suggests a need for greater advance care planning. (shrink)

Dva pjesnika, hrvatski Nikola Šop i slovenski Gregor Strniša – premda ih razlikuje pripadnost epohi i miljeu – imaju zajednički nazivnik: obojica su metafizički pjesnici i, u toj pjesničkoj dimenziji, obojica se bave relativnošću vremena i prostora, to jest vremenitošću i bezvremenošću, prostornošću i besprostornošću, koje nisu ništa drugo nego sinonimi za pojmove ljudskog i božanskog. Obojicu pjesnika dubinski motiviratraganje za Posljednjom Istinom. U Šopa ta potreba vuče porijeklo iz njegove osobne tragedije, iz strahovite nesreće koja ga je onesposobila na (...) gotovo trideset godina života i duboko mu obilježila vjeru, nagnavši ga da traga za Bogom novim putovima teologije, filozofije i kozmologije. Strnišin je pristup metafizičkom problemu kontroliraniji, nastaje iz potreba racionalnog i intelektualnog karaktera. To je bjelodano i iz načina na koji se dva pjesnika približavaju Einsteinovoj misli: Šop se približava Einsteinovu modelu svemira isključivo putem vlastite pjesničke intuicije, dok ga Strniša otvoreno preispituje u svojoj prozi, poput one naslovljene Relativnostna pesnitev, u kojoj se prvenstveno usredotočuje na problem pjesničkoga stvaranja.Although the epochs and milieus they belong to differ, the Croatian poet Nikola Šop and the Slovenian poet Gregor Strniša share a common denominator – both are metaphysical poets and, in respect of this poetic dimension, they both tackle the relativity of time and space, i.e. temporality and timelessness, and spatiality and spacelessness, which are nothing other than synonyms for the concepts of human and divine. Both poets are profoundly motivated by the search for the Final Truth. In Šop this need stems from his personal tragedy, from a horrendous accident that disabled him for almost three decades and deeply impressed his faith, having driven him to seek God on the paths of theology, philosophy and cosmology. On the other hand, Strniša’s approach to metaphysical issues is somewhat more controlled, and issues from the needs of his rational and intellectual character. This is also evident in the fashion in which the two poets approach Einstein’s thought: Šop nears Einstein’s model of universe exclusively through his own poetic intuition, while Strniša openly reflects on it in his prose, as in his Relativnostna pesnitev , in which he primarily centres on the problem of poetic creation. En este artículo, nos preguntamos si es pertinente un análisis del personaje de Medea de Eurípides, y más concretamente, de su filicidio, a la luz de la doctrina aristotélica de la acción. Resulta dudoso, y quizás equívoco, hablar de "responsabilidad" (en sentido aristotélico) en el caso de la heroína, ya que sus motivaciones, como las de todo héroe trágico, tienen un doble signo: enfrentado a una ἀνάγκη superior, también desea lo que está forzado a hacer. Además, Medea no es una (...) mujer común: es un personaje ontológicamente complejo que participa, más de lo que frecuentemente se ha enfatizado, del plano divino. In this article we wonder if it is pertinent to analyse the character of Euripides' Medea and, more precisely, her filicide, in the light of Aristotle's doctrine of action. With regard to the heroine, it is doubtful and perhaps confusing to talk about "responsibility" (in Aristotelian terms) because her motivations, as all tragic heroes', are two-sided: faced to a superior ἀνάγκη he wants what he is forced to do as well. In addition, Medea is not an ordinary woman: she is an ontologically complex character that has a share in the divine level, a share which is more crucial than what has usually been emphasized. El disco en mención musicalizaba varios poemas del malogrado poeta Miguel Hernández y un poema de Miguel de Unamuno. De regreso a mi apartamento de soltero, puse el disco y de inmediato quedé impactado por la belleza de las interpretaciones. A ciência experimental se concentra de forma peculiar, embora não exclusiva, no exame dos componentes materiais presentes na natureza e em suas relações quantitativas. Esta abordagem tem sido extremamente bem-sucedida, mesmo que haja lacunas e perplexidades a serem superadas, que, por sinal, também fazem parte do modus operandi da investigação experimental. Entretanto, se esta investigação é necessária para compreender a totalidade da natureza, ela já não é suficiente, o que é também corroborado por um sentimento de incompletude presente nas teorias. Assim, existem razões justificáveis para se investigar a presença de uma estrutura não conceptualizável apenas em termos quantitativos chamada Realidade Velada pelo físico Bernard d'Espagnat, que pode ser assimilada à composição transcendental clássica de ser e essência, desde que este último elemento da composição, a essência, seja equivalente à estrutura forma-matéria, ou estrutura hilemórfica (aqui, matéria deve ser assimilada à matéria prima). Ora, a existência de tal estrutura reposicionaria a filosofia da natureza como conhecimento complementar ao da ciência experimental no sentido de que ele daria uma contribuição metafísica qualitativa relevante à pesquisa do que está além do limiar essencialmente quantitativo, conquanto necessário, oferecido pelas ciências da natureza. In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. In this short, dense essay, Jean Cavaillès evaluates philosophical efforts to determine the origin - logical or ontological - of scientific thought, arguing that, rather than seeking to found science in original intentional acts, a priori meanings, or foundational logical relations, any adequate theory must involve a history of the concept. Cavaillès insists on a historical epistemology that is conceptual rather than phenomenological, and a logic that is dialectical rather than transcendental. His famous call (cited by Foucault) to abandon "a (...) philosophy of consciousness" for "a philosophy of the concept" was crucial in displacing the focus of philosophical enquiry from aprioristic foundations toward structural historical shifts in the conceptual fabric. This new translation of Cavaillès's final work, written in 1942 during his imprisonment for Resistance activities, presents an opportunity to reencounter an original and lucid thinker. Cavaillès's subtle adjudication between positivistic claims that science has no need of philosophy, and philosophers' obstinate disregard for actual scientific events, speaks to a dilemma that remains pertinent for us today. His affirmation of the authority of scientific thinking combined with his commitment to conceptual creation yields a radical defense of the freedom of thought and the possibility of the new. In Alfonso de Cartagena's 'Memoriale virtutum' (1422) María Morrás and Jeremy Lawrance offer a new edition from the manuscripts of a compilation of Aristotle's Nicomachean Ethics addressed by the major Castilian intellectual of the day, bishop Alfonso de Cartagena, to the heir to the throne of Portugal, crown prince Duarte. The work was a speculum principis, an education for the future king in the virtues suitable to a statesman; Cartagena's choice of Aristotle was thus a significant index of the advent (...) of new Renaissance ideas. This edition shows how the "memorial" throws light on the ideological transformation of society those ideas would bring, setting new ethical guidelines for the ruling class at the crossroads between medieval feudalism and Renaissance absolutism. Abstract:During the early 19th century, a peculiarly systematic way of organizing books emerged in Germany. This systematization, which purported to be a rational organization of subject matter, was an outgrowth of the philosophy of Hegel. This article attempts to outline Hegel's organizational practice. It argues that Hegel's encyclopedia was a reaction against the Enlightenment encyclopedia, and that it attempted to restore the systematic mindset of pre-modern reference books. Yet it did this, not in a straightforward fashion, but by developing a (...) method for organizing material that both stresses the interconnectedness of knowledge and promises to be highly scalable. In its attempt to trace the Hegelian organizational method, this article revisits and calls attention to a forgotten work in Hegel scholarship by Michael John Petry, who was the first writer to seriously stress the importance of classification in Hegel's work. This article is an attempt to demonstrate that Hegelianism and information organization can be brought into fruitful and mutually beneficial dialogue. (shrink)

Attempts to think anew about philosophical questions from the perspective of breath and breathing. As a physiological or biological matter, breath is mostly considered to be mechanical and thoughtless. By expanding on the insights of many religions and therapeutic practices, which emphasize the cultivation of breath, the contributors argue that breath should be understood as fundamentally and comprehensively intertwined with human life and experience. Various dimensions of the respiratory world are referred to as “atmospheres” that encircle and connect human existence, (...) coexistence, and the world.
