Nachgelassene Fragmente 1884 In 1959 two Italian scholars, Giorgio Colli (Piza) and Mazzino Montinari (Florence ), decided to make a new Italian translation of Nietz.sche's works. But the confusion surrounding the publication.of the posthumous fragments, particularly in the wake of the Schlechta-Edition controversy, caused the two men to question existing German editions. Montinari's visit to the Nietzsche Archive in Weimar in 1961 confirmed their growing conviction that the only way to eliminate the inaccuracies and BOOK REVIEWS 129 omissions with respect to the late fragments was to work from the original manuscripts. Since they had to go to Weimar anyway, they reasoned, why not take the bull by the horns and attempt a truly critical German edition of all of Niet.z.sche's writings as well? Now that nine of the planned thirty volumes of the German edition have been published, in particular IV, 4 (commentary to Section IV) and VIII, 2 (posthumous fragments of 1887-1888), it appears that the editors have an excellent chance of achieving not only a critical, but a definitive edition of Nietzsche's works. 1 Volumes IV, 4 and VIII, 2 are of special importance to our evaluation as, more than the other volumes published thus far, they reveal the critical and innovative features of the edition. It will pay to examine them in some detail. The first thing we encounter in volume IV, 4 is a statement of editorial principles. We learn that with regard to works which Nietzsche himself had published, both first editions and later editions approved by Nietzsche were consulted--a double-check was needed since Nietzsche with his bad eyesight was a poor proofreader. In the case of obvious printing errors that were retained through all the printed editions, final manuscripts were also referred to; usually several, as the scribes occasionally misunderstood Nietzsche when he dictated to them. The procedure is careful but it is also selective. What is to assure us that the editors made the right selection? This problem is dealt with in the 380 pages which collate all the variants found in the principal manuscripts and editions. Whenever possible, the reason for having variants is given. The explanation of the critical apparatus is a model of painstaking thoroughness. So far authenticity and objectivity have been achieved to a high degree. However, a principal difficulty in editing Nietzsche's works is chronology, determining the order in which the fragments and manuscripts were written. How did the editors proceed here? There is a section eighteen pages long on manuscript chronology and genesis in which the editors detail their reasoning and conclusions. To back this up there are two additional sections: (1) a page-by-page inventory of every manuscript used, summarizing the content of each page and listing such facts as the designation number, the presumed scribe, the kind... This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to (...) abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. Finally, it contains interviews with and letters to members of his family, colleagues and students. (shrink)

This paper examines the role of management's earnings preannouncements on judgments about its trustworthiness by nonprofessional investors. We predict that management's preannouncement decision and the resulting direction of the earnings surprise influence investors' ethical judgments about management's trustworthiness; these judgments, in turn, are associated with investors' other investment related judgments. We test our predictions in an experiment in which MBA students make investment-related judgments under four different preannouncement strategies. Consistent with our predictions, the results of our study show that managers' (...) preannouncement decisions are significantly associated with investors' evaluations of management's trustworthiness. Specifically, holding the size of the earnings surprise constant, we find that judgments of management's trustworthiness are damaged more following a negative as opposed to a positive earnings surprise, and the release of a preannouncement compared to when management does not issue a preannouncement. Also consistent with our predictions, we find that evaluations of management's trustworthiness are significantly and positively associated with judgments of the attractiveness of the firm's equity as an investment. Based on our findings, we encourage further research to explore whether managers understand the trust implications associated with their preannouncement decisions and the extent to which this understanding influences their disclosure decisions. This article presents the results of an experiment that completely measures the utility function and probability weighting function for different positive and negative monetary outcomes, using a representative sample of N = 1,935 from the general public. The results confirm earlier findings in the lab, suggesting that utility is less pronounced than what is found in classical measurements where expected utility is assumed. Utility for losses is found to be convex, consistent with diminishing sensitivity, and the obtained loss-aversion coefficient of (...) 1.6 is moderate but in agreement with contemporary evidence. The estimated probability weighting functions have an inverse-S shape and they imply pessimism in both domains. These results show that probability weighting is also an important phenomenon in the general population. Women and lower educated individuals are found to be more risk averse, in agreement with common findings. In contrast to previous studies that ascribed gender differences in risk attitudes solely to differences in the degree utility curvature, however, our results show that this finding is primarily driven by loss aversion and, for women, also by a more pessimistic psychological response toward the probability of obtaining the best possible outcome. A version of nonstandard analysis, Internal Set Theory, has been used to provide a resolution of Zeno's paradoxes of motion. This resolution is inadequate because the application of Internal Set Theory to the paradoxes requires a model of the world that is not in accordance with either experience or intuition. A model of standard mathematics in which the ordinary real numbers are defined in terms of rational intervals does provide a formalism for understanding the paradoxes. This model suggests that in (...) discussing motion, only intervals, rather than instants, of time are meaningful. The approach presented here reconciles resolutions of the paradoxes based on considering a finite number of acts with those based on analysis of the full infinite set Zeno seems to require. The paper concludes with a brief discussion of the classical and quantum mechanics of performing an infinite number of acts in a finite time. (shrink)

On semantics and the process of word-generated knowledge in Hindu philosophy.

T. Adorno stands out among the theorists of the Frankfurt School for his interest in profound philosophical problems. For many years he actively participated in the work of the Frankfurt Institute for Social Research, and at one time also headed it. Among his associates he occupies not only a very typical, but in a certain sense an exclusive position.

Decision‐aiding software is probably the most important technological innovation from the perspective of lawyer decision‐making, as contrasted to efficient office management. That kind of technological breakthrough can be helpful to lawyers in negotiating settlements favorable to their clients without expensive litigation. The technology makes use of benefit‐cost analysis, multi‐criteria decision analysis, spreadsheet software, and especially super‐optimizing analysis whereby plaintiffs, defendants, and other parties can all come out ahead of their best initial expectations simultaneously. Decision‐aiding software can also be helpful to (...) lawyers in evaluating alternative precedents, statutes, regulations, and other legal policies to arrive at versions favorable to their clients without an expensive adoption campaign. It is my contention here that the chapter “Of Power,” in John Locke’s An Essay Concerning Human Understanding, is not a metaphysical pronouncement upon the liberty-necessity debates but more along the lines of what those like James Harris portray it to be: a description of our experience of freedom of the will. It is also prescriptive since it is descriptive of the right use of the will. My claims are based upon two key pieces of evidence that are responses to (...) William Molyneux’s oft noted critique of the first edition of the chapter: 1) an admission by Locke in his correspondence: at least part of the reason he is attempting to avoid metaphysical pronouncements is that trying to reconcile divine and human agency is too difficult; and 2) the theological message of “Of Power”—the truly free agent is reasonable, and the truly reasonable agent will have her eyes fixed on the afterlife, thus aiming for herself to be a slave and determined, therefore, by her ever-cultivated desire for righteousness and not by her fleshly desires—and his development of it throughout the chapter eludes sectarian categorization by the avoidance of theological issues that are not unrelated to the metaphysical question of human free agency. To frame his chapter otherwise makes him out to be a theological novice or, perhaps, unconcerned with the religious background of his readership. (shrink)

John Martin Fischer's The Metaphysics of Free Will is devoted to two major projects. First, Fischer defends the thesis that determinism is incompatible with a person's control over alternatives to the actual future. Second, Fischer defends the striking thesis that such control is not necessary for moral responsibility. This review essay examines Fischer's arguments for each thesis. Fischer's defense of the incompatibilist thesis is the most innovative to date, and I argue that his formulation restructures the free will debate. To (...) defend his second thesis Fischer relies upon examples designed to show that an agent is responsible for an unavoidable action. I criticize Fischer's account of these examples, but I also maintain that my criticisms do not compromise his theory of responsibility. I raise several other difficulties for Fischer's theory of responsibility, and I close by offering some suggestions about how he might further defend it. (shrink)

In late December 1998, Renada Daniel-Patterson's father offered to donate a kidney to his daughter and ignited a controversy in the bioethics community. Renada had been born with only one kidney, which began to fail early in her childhood. At age 6, Renada had to receive dialysis three times a week. She was unable to attend school or venture very far from home. This pattern continued until Renada was 13, when Mr. Patterson called from prison to offer her his kidney. (...) Renada was surprised to hear from her father, who was serving 12 years at California State Prison for burglary and drug convictions. Mr. Patterson was determined to be a compatible donor, and the family proceeded with the transplant operation. As a result of this surgery, Renada was able to live the life of a healthy girl for 2 years. Because the medication to prevent rejection of the transplanted organ made her feel ill and bloated and caused her to develop a hump on her back, Renada gradually began to skip doses. As a result, her donated kidney began to fail. It was under these circumstances that David Patterson offered to donate his second kidney to his daughter in 1998. (shrink)

IN 1983 THE STUTTGART PUBLISHING FIRM OF PHILIPP RECLAM brought out a slim volume containing an introduction and seven essays by Robert Spaemann, then Professor of Philosophy at the University of Munich. Entitled Philosophische Essays, it presents and illustrates Spaemann’s philosophical project: to understand the phenomenon of modernity, to criticize the deficiencies of modern thought, and to preserve what is good in modernity by rehabilitating the teleological understanding of nature that modernity largely rejected. A second edition in 1994 included three (...) more essays. As little of Spaemann’s work has yet appeared in English, the aim of this paper is modest: to present as clearly and accurately as possible his position in the Philosophische Essays. (shrink)

The intensive process of differentiation of knowledge that has in the past decade come to include philosophy has had the results, inter alia, that ethics, esthetics, and empirical sociology have undergone a kind of secondary "branching off" from the philosophy of society and culture . On the level of teaching this had the consequence that a department of esthetics and ethics was carved out of the department of historical materialism at the Philosophical Faculty of Moscow University, and was subsequently divided (...) into departments of esthetics and ethics, respectively. It was thus that the independent department of ethics made its appearance for the first time in the history of Moscow University. This occurred in 1969, and recently the department of Marxist- Leninist ethics marked its modest first decade. (shrink)

In this issue of the Hastings Center Report, Daniel Brudney suggests that clinicians have an overly deferential attitude toward their patients’ surrogate decision-makers that is rooted in a wrongful investment of moral authority. He maintains that surrogate decision-makers have no moral right to decide for their loved ones and that their value in the decision-making process is limited to their knowledge of their loved one's preferences. If operationalized, Brudney's framework would ease the way for clinicians to remove a surrogate who (...) cannot provide information relevant to the patient's preferences and to resort to a paternalistic model of decision-making. Brudney fails to consider that the value of the surrogate does not flow from the surrogate, but rather from the patient's moral claim to have decisions made for him or her by a loved one. This claim recognizes that surrogates have intrinsic value through their relationship to and knowledge of the patient. Bioethics consultation services can assist clinical teams in engaging with the human crowd that surrounds each patient and navigating conflicting values and goals. This relational approach embraces the “mire and blood” that is endemic to relationships and clinical encounters. (shrink)

WERTZ What was David Hume's reception in the British idealistic tradition? In this paper, I shall contribute a short chapter on this question by examining Hume's place in R. G. Collingwood's thought.1 Such an examination has been lacking in the literature, so what follows is a comprehensive study of Collingwood's use of Hume (...) throughout all of R.G.'s writings. I shall mainly focus on two main, unrelated discussions of Hume: first is the theory of the imagination which primarily occurs in The Principles of Art, and second is the set of relations between human nature and human history which is principally found in The Idea of History. These sections will be followed by a section on minor discussions and omissions and a conclusion. It is a common misconception that Collingwood (1889-1943) has little to offer Hume scholarship, and I wish to amend that here. Actually, Collingwood has good insights into the nature of the imagination and its role in human understanding, besides instructive thoughts on Hume on human nature and history, even though his discussion of the latter is flawed. This essay serves both historical and philosophical purposes. It is to sample Hume's place in early twentieth century British idealism at a time when he began to emerge as an important philosophical figure worthy of careful study. (By "idealism," I mean the philosophical movement which takes ideas to be an irreducible part of the world and whose program is opposed to both materialism and realism.) So Collingwood's portrait is historically interesting. But over and above this, it carries significant philosophical amendments, S. K. Collingwood has mostly been studied as a philosopher of history or as an aesthetician, but not in toto from the perspective of one of the historical figures to whom he is deeply indebted. Such a view affords a portrait of Hume that is instructive and rewarding. The comparison of Hume and Collingwood lead us to finer appreciation of both philosophers. Let us first look at Collingwood's positive contribution. Imagination Collingwood begins his analysis by declaring his intentions: I shall...try to show that there are such things, to be with what Hume (whose account of them I shall take as my starting-point) called 'ideas' as distinct from 'impressions'. I shall try to show that there is a special activity of mind correlative to them, and that this is what we generally call imagination, as distinct from sensation on the one hand and intellect on the other. (PA 170-71, emphasis added) Why would Collingwood start with Hume's distinction between impressions and ideas? Undoubtedly, this means that Collingwood is willing to accept the validity of the distinction and to build on it. Isn't this a strange place for an idealist to begin? Not really. When we look at British philosophy at the turn of this century, we find idealists preoccupied with the distinction,2 so it is not extraordinary to find Collingwood utilizing it to some extent. Like most Oxford students of the time, Collingwood read Locke, Berkeley, and Hume in his undergraduate program. Consequently we find them in the problems he addresses. "It was Hume who first perceived the [Lockean] problem [of confusing sensation with imagination]," Collingwood attributes, "and tried to solve it by distinguishing ideas from impressions" (PA 200). In detail: He [Hume] was right when he laid it down that the immediate concern of thought is not with impressions but with ideas; that it is ideas, not impressions, that are associated with one another and thus built up into the fabric of knowledge; and that ideas, though 'derived' from impressions, are not mere relics of them like an after-taste of onions or an after-image of the sun (as Lockeans like Condillac supposed), but something different in kind: different, if not in what he...
