Obesity is a public health problem in the United States. Experts have identified the regulation of food marketing as a policy strategy to address obesity and poor nutrition. However, the First Amendment can be a barrier to reducing exposure to problematic food marketing. In recent years, courts have become increasingly protective of speech, and particularly of “commercial speech,” or advertising, which can make it more difficult to regulate certain marketing practices.

In their article “The Civil Rights of Health,” Harris and Pamukcu offer a framework connecting civil rights law to unjust health disparities with the aims of creating broader awareness of subordination as a root cause of health inequities and inviting policymakers to create new legal tools for dismantling it. They close with a call to action. Here, we take up their call and propose cooperative enterprises as a health justice intervention. The most common approach to understanding the semantics of the concept of pain is third-person thought experiments. By contrast, the most frequent and most relevant uses of the folk concept of pain are from a first-person perspective in conversational settings. In this paper, we use a set of linguistic tools to systematically explore the semantics of what people communicate when reporting pain from a first-person perspective. Our results suggest that only a pluralistic view can do justice to the way we (...) talk about pain from a first-person perspective: The semantic content of the folk concept of pain consists of information about both an unpleasant feeling and a disruptive bodily state. The (...) Inconvenience of Other People ostensibly repeats this structure while reattributing the role of fantasy. The premise here is that attachments to other people act in disservice to the fantasy of personal sovereignty. Of course, both texts argue for collectivity and for a recasting of the ordinary that structures current fantasies. But while Cruel Optimism builds around the unavoidable condition of fantasy, Inconvenience takes relations within the present as its fundamentally unavoidable condition, specifically the drive to be in relation even though such relations are inconvenient. "People" in the work's title stands for any attachment, any person or thing to which we exist in relation. To be part of the world is to be constantly taking in and living with the objects around us. This constant process of adjustment generates constant friction with our fantasy of sovereignty, or control, over ourselves. In Berlant's words, "inconvenience is another way of pointing to the experience of nonsovereign relationality," making our inconvenience drive the urge to maintain and explore those nonsovereign relations despite the uncomfortable friction they produce (18). Berlant's final monograph investigates the complexities of living with that inconvenience as well the potential for "loosening [those inconvenient objects] and becoming loose with them" in order to make that inconvenience generative of new perspectives and approaches (150).The prospect of overhauling our relationship with inconvenience takes place on multiple registers, both in terms of the affective states that guide the experience of inconvenience and the frameworks that determine its expression in the world. For Emerson, it stands for "the separation within the nonsovereign relation [of the commons] that makes linking possible" (Berlant 94). Spahr takes a more critical approach, continuing Emerson's use of the term while shining light on the glitches that emerge when any analogy is examined too closely. Acknowledging the rhetorical gymnastics required to "figure equally valued social being" within "imperialist capitalist infrastructures" reveals every possible analogy as both grossly oversimplifying and only temporarily comprehensible (105). Considered by many to be one of the major influences on modern Humanistic Judaism, Felix Adler (1851-1933) was a professor of political and social ethics and a social reformer who founded the Ethical Culture movement. First published in 1903 "Life and Destiny" contains quotations from Adler's lectures for the New York Society for Ethical Culture in its early years. It covers such things as the meaning of life, religion, immortality, moral ideas, the ethical outlook, and related topics.

Extant research provides compelling conceptual and empirical arguments that company-external as well as company-internal CSR efforts positively affect employees, but does so largely in studies assessing effects from the two CSR types independently of each other. In contrast, this paper investigates external–internal CSR jointly, examining the effects of consistent external–internal CSR strategies on employee attitudes, intentions, and behaviors. The research takes a social and moral identification theory view and advances the core hypothesis that inconsistent CSR strategies, defined as favoring external (...) over internal stakeholders, trigger employees’ perceptions of corporate hypocrisy which, in turn, lead to emotional exhaustion and turnover. In Study 1, a cross-industry employee survey indicates that inconsistent CSR strategies with larger external than internal efforts increase employees’ turnover intentions via perceived corporate hypocrisy and emotional exhaustion. In Study 2, a multi-source secondary dataset demonstrates that inconsistent CSR strategies increase firms’ actual employee turnover. Combined, the two studies demonstrate the importance of taking into account the interests of both external and internal stakeholders of the firm when researching and managing CSR. (shrink)

This is only the most recent incarnation of the fear of fat (...) Black women, which Sabrina Strings shows took root more than two hundred years ago. Strings weaves together an eye-opening historical narrative ranging from the Renaissance to the current moment, analyzing important works of art, newspaper and magazine articles, and scientific literature and medical journals—where fat bodies were once praised—showing that fat phobia, as it relates to Black women, did not originate with medical findings, but with the Enlightenment era belief that fatness was evidence of “savagery” and racial inferiority. The author argues that the contemporary ideal of slenderness is, at its very core, racialized and racist. Indeed, it was not until the early twentieth century, when racialized attitudes against fatness were already entrenched in the culture, that the medical establishment began its crusade against obesity. An important and original work, Fearing the Black Body argues convincingly that fat phobia isn’t about health at all, but rather a means of using the body to validate race, class, and gender prejudice. Food poverty and food waste are two major contemporary food system problems, which have gained prominence amongst both scholars and policy-makers, due to recent economic and environmental concerns. In this context, the culturally dominant perspective portrays charitable food redistribution as a “win–win solution” to confront food poverty and food waste in affluent societies, although this view is contested by many scholars. This paper applies the notions of framings and flat/sharp keyings to unpack the different narratives entailed by public discourses on (...) food waste and food poverty in Italy. The aim is to problematize the representation of the recent anti-waste/pro-donations law as the optimal policy measure to effectively rectify both food poverty and food waste. The paper argues that the widespread public support for the law reflects the interpretation of charitable food redistribution as a consensus frame, standing for the convergence between flat positions and is reinforced by confusion on terms and responsibilities. Indeed, the strength of the law lies in the capacity to reconcile different positions and bring actors together around a short-term objective, whose foundations have deep roots in the common ethics. However, if the debate is to be moved forward, trade-offs between different framings of problems at stake should be explicitly navigated when designing policy instruments. (shrink)

According to an oft-repeated narrative, while Kant maintained racist views through the 1780s, he changed his mind in the 1790s. Pauline Kleingeld introduced this narrative based on passages from Kant’s Metaphysics of Morals and “Toward Perpetual Peace”. On her reading, Kant categorically condemned chattel slavery in those texts, which meant that he became more racially egalitarian. But the passages involving slavery, once contextualized, either do not concern modern, race-based chattel slavery or at best suggest that Kant mentioned it as a (...) cautionary tale for labor practices in Europe. Overall, Kant never explicitly considered chattel slavery as a moral problem to be addressed on its own. Rather, he treated it primarily in terms of its function in human history. If he ended up expressing some qualms about its practices, it was likely because they threatened to deepen intra-European conflicts and undermine the prospect of perpetual peace. The humanity of the enslaved “Negroes” was never part of the reasoning. This was not a casual oversight on Kant’s part. It reflects the complexity of his philosophical system: everything he did or did not say about chattel slavery begins to make sense once we connect his philosophy of history and his depiction of “Negroes” as natural slaves. This article describes the results of qualitative research into the moral issues faced by social work professionals working in projects targeted at teenage mothers. The research is part of the tradition of empirical and practice-driven ethics. The main questions were: How does morality become visible in the social services for teenage mothers and how do social workers deal with the moral dimension of their work? (How) can education, training and peer review offer space for moral reflection? Interviews and group meetings (...) ('focus groups') were held to answer these questions. Nineteen professionals (front-line professionals as well as professionals in executive roles) participated in the research. The findings describe the moral issues and the moral actions of professionals and the organizational context respectively. The results reveal that the everyday practice of social work professionals can raise complex issues inherent to their work and that there is often no explicit reflection on the moral dimension of these issues. The authors argue that there needs to be greater focus on the complexity of moral issues and elaborate on three dimensions of this complexity. (shrink)

Although pain is one of the most fundamental and unique experiences we undergo in everyday life, it also constitutes one of the most enigmatic and frustrating subjects for many scientists. This book provides a detailed analysis of why this issue is grounded in the nature of pain itself. It also offers a philosophically driven solution of how we may still approach pain in a theoretically compelling and practically useful manner. Two main theses are defended: (i) Pain seems inscrutable because there (...) exists no property that is commonly shared by all types of pain and that is at the same time particular to pain, setting it apart from other bodily sensations. This applies irrespective of whether we consider the psychological dimensions, neural networks, causal relations or biological functions of pain. Consequently, it is impossible to refer to ideal far-reaching and ideal distinct generalizations on the matter of pain. (ii) Despite this challenge, by focusing on the resemblance relations that hold across pains, we can generate scientific progress in explaining, predicting and treating pain. In doing so, the book aims to provide a clear conceptual basis for interdisciplinary communication and a useful heuristic for future research. (shrink)

Kant scholars have paid relatively little attention to his raciology. They assume that his racism, as personal prejudice, can be disentangled from his core philosophy. They also assume that racism contradicts his moral theory. In this book, philosopher Huaping Lu-Adler challenges both assumptions. She shows how Kant's raciology--divided into racialism and racism--is integral to his philosophical system. She also rejects the individualistic approach to Kant and racism. Instead, she uses the notion of racism as ideological formation to demonstrate how (...) Kant, from his social location both as a prominent scholar and as a lifelong educator, participated in the formation of modern racist ideology. As a scholar, Kant developed a ground-breaking scientific theory of race from the standpoint of a philosophical investigator of nature or Naturforscher. As an educator, he transmitted denigrating depictions of the racialized others and imbued those descriptions with normative relevance. In both roles, he left behind, as one of his legacies, a worldview that excluded non-whites from such goods as recognitional respect and candidacy for cultural and moral achievements. Scholars who research and teach Kant's philosophy therefore have an unshakable burden to take part in the ongoing antiracist struggles, through their teaching practices as well as their scholarship. And they must do so with a pragmatic attention to nonideal social realities and a deliberate orientation toward substantial racial justice, equality, and inclusion. Lu-Adler pushes the discourse about Kant and racism well beyond the old debates about whether he was racist or whether his racism contaminates his philosophy. By foregrounding the lasting legacies of Kant's raciology, her work calls for a profound reorientation of Kant scholarship. (shrink)

In this paper, we argue that the concept of environmental scaffolding can contribute to a better understanding of our affective life and the complex manners in which it is shaped by environmental entities. In particular, the concept of environmental scaffolding offers a more comprehensive and less controversial framework than the notions of embeddedness and extendedness. We contribute to the literature on situated affectivity by embracing and systematizing the diversity of affective scaffolding. In doing so, we introduce several distinctions that provide (...) classifications of different types of environmentally scaffolded affectivity. Furthermore, we differentiate eight dimensions that allow us to evaluate the quality and effectivity of scaffolds in particular applications. On that basis, we develop a taxonomy using paradigmatic examples of affective scaffolding. This taxonomy enriches the current debate by emphasizing distinctions that are often conflated and by identifying fields of application that are commonly overlooked. (shrink)

The primary example is forking in a simple theory, but o-minimal theories are also known to have an interesting independence relation. Our approach in this paper is to treat independence relations as mathematical objects worth studying. We discuss the implementation of Responsible Research and Innovation (RRI) within a project for the development of an AI-supported exergame for assisted movement training, outline outcomes and reflect on methodological opportunities and limitations. We adopted the responsibility-by-design (RbD) standard (CEN CWA 17796:2021) supplemented by methods for collaborative, ethical reflection to foster and support a shift towards a culture of trustworthiness inherent to the entire development process. An embedded ethicist organised the procedure to instantiate a collaborative learning effort and implement RRI (...) in a translational context. Within the interdisciplinary setting of the collaboration and with the support of a technoethicist, we successfully identified relevant, project-specific challenges and developed a roadmap with derived actions, thus meaningfully integrating RRI into the development process. We discuss the methodological procedure in terms of its effectiveness and efficiency, the allocation of responsibilities and roles, particularly regarding potential frictions in the interdisciplinary context with embedded ethics, and the challenges of the translational context. We conclude that the responsibility-by-design standard effectively established a productive workflow for collaborative investigation and work on ethical challenges. We reflect on methodological difficulties and propose possible avenues to our approach. (shrink)

Bodily sensations, such as pain, hunger, itches, or sexual feelings, are commonly characterized in terms of their phenomenal character. In order to account for this phenomenal character, many philosophers adopt strong representationalism. According to this view, bodily sensations are essentially and entirely determined by an intentional content related to particular conditions of the body. For example, pain would be nothing more than the representation of actual or potential tissue damage. In order to motivate and justify their view, strong representationalists often (...) appeal to the reliable causal covariance between bodily sensations and certain kinds of bodily conditions or to the corresponding biological function that these bodily sensations are supposed to fulfill. In this paper, I argue on the basis of recent empirical research that arguments from reliable causal covariance and biological function cannot motivate the introduction of corresponding intentional content. In particular, I argue that bodily sensations are caused by a heterogeneous class of physiological and psychological factors and their biological functions are too diverse to be reduced to the representation of a particular bodily condition. Responses are available to strong representationalists, but they either require substantial alterations to their core assumptions or incur a significant empirical burden. (shrink)

Niche construction denotes the alteration, destruction, or creation of environmental features through the activities of an organism, modifying the relation between organism and environment. The concept of niche construction found application in various fields of research: evolutionary biology, enculturation, ontogenetic development, and local organism-environment coordination. This is because it provides a useful tool emphasizing different aspects of the dynamic interplay between organisms and their actively constructed environment. Traditionally, niche construction is considered a positive mechanism in the complementarity of organism and (...) environment. In contrast, this paper sheds light on the dark side of niche construction, that is, the different manners in which organisms may modify environmental features that are in some way or another harmful to them. First, the paper introduces a paradigmatic distinction of four kinds of niche construction as commonly addressed in recent literature, using more or less extended spatio-temporal scales as the distinguishing feature. Second, the paper elaborates on the concept of negative niche construction, providing normative criteria of (mal)adaptation that are suitable for the evaluation of environmental alterations, given the chosen spatio-temporal scale. Of particular interest are inter-scale conflicts: those cases of environmental constructions which appear adaptive concerning one spatio-temporal scale but maladaptive concerning another. Third, the paper distinguishes the concept of niche construction as a valuable instrument to better understand central aspects of modern medicine and the entangled contribution of evolutionary, socio-cultural, personal, and situational aspects to different health issues, using chronic pain as an illustrative case study. Die Leitfragen dieser wahrheitstheoretischen Interpretation lauten: Welche Rolle spielt die Wahrheitsfrage in der ‚Kritik der reinen Vernunft‘ generell und in den einzelnen Abteilungen der Untersuchung? Welche Wahrheitskonzeption vertritt Kant, mit welchen Argumenten und welche Kritik konkurrierender philosophischer Positionen ist damit verbunden? Alle Hauptabteilungen der Kritik der reinen Vernunft werden in diesem Lichte erklärt, geprüft und kommentiert. Entgegen der verbreitenden Tendenz, den Wahrheitsbegriff bei der Interpretation der Kritik der reinen Vernunft in den Hintergrund treten zu lassen, wird demonstriert, dass sich deren (...) zentrale Philosopheme in wahrheitstheoretischer Perspektive erschließen. Indem sie die Wahrheitsfrage als Schlüssel zum adäquaten Verständnis der Kritik der reinen Vernunft erweist, eröffnet die Arbeit ein neues Verständnis der Kritik der reinen Vernunft und der kantischen Transzendentalphilosophie. In recent years, the societal and personal impacts of pain, and the fact that we still lack an effective method of treatment, has motivated researchers from diverse disciplines to try to think in new ways about pain and its management. In this paper, we aim to develop an enactive approach to pain and the transition to chronicity. Two aspects are central to this project. First, the paper conceptualizes differences between acute and chronic pain, as well as the dynamic process of (...) pain chronification, in terms of changes in the field of affordances. This is, in terms of the possibilities for action perceived by subjects in pain. As such, we aim to do justice to the lived experience of patients as well as the dynamic role of behavioral learning, neural reorganization, and socio-cultural practices in the generation and maintenance of pain. Second, we aim to show in which manners such an enactive approach may contribute to a comprehensive understanding of pain that avoids conceptual and methodological issues of reductionist and fragmented approaches. In her article the author shows the relevance of the concept of compromise for protestant ethics after 1945. Coming from the current discussion about the significance of compromise in the german society today she asks for the role of compromises for community building and as a guarantee for plurality in the civil society nowadays. The author illustrates the relation between compromise, plurality and democracy in protestant ethics after World War II by presenting an article of the German pastor Eberhard Müller, (...) who was the founder of the Protestant Academy of Bad Boll in Wuerttemberg/west-germany in 1945. In his article compromise, published in the Evangelisches Soziallexikon (Protestant Encyclopedia of social ethics, Kreuz-Verlag Stuttgart) 1954 Müller emphasizes his conviction, that after the ideology of Nazi-Germany only a culture of communication and exchance, a culture, that is based on compromises could anchor an understanding of democracy in the young German society. In the face of massively increased technological complexity, it is striking that so many of today’s computational and networked things follow design ideals honed decades ago in a much different context. These strong ideals prescribe a presentation of things as useful tools through design and a withdrawal of aspects of their functionality and complexity. Beginning in the mid-twentieth century, we trace this ‘withdrawal program’ as it has persisted in the face of increasing computational complexity. Currently, design is in a dilemma (...) where computational products can be seen as brilliantly designed and engaging to use yet can also be considered very problematic in how they support hidden agendas and often seem less than trustworthy. In this article, we analyse factors shaping this emergent ethical dilemma and reveal the concept of _a widening rift_ between what computational _things actually are and do_ and _the ways in which they are presented as things for use_. Against this backdrop, we argue that there is a need for a new orientation in design programs to adequately address this deepening rupture between the aesthetics and ethics in the design of computational things. Kant develops a concept of savagery, partly characterized by laziness, to envision a program for human progress. He also racializes savagery, treating native Americans, in particular, as literal savages. He ascribes to this “race” a peculiar physiological laziness, a supposedly hereditary trait of blunted life power. Accordingly, while he grants them the same “germs” for perfections as he does the civilized Europeans, he allows them no prospect of actually fulfilling any such perfection. For the road to perfection must be paved (...) through industry, a condition that Kant denies to the “savages” by racializing their alleged laziness. This case will shed new light on the debated relation between Kant’s moral universalism and his racism. (shrink)

A testimony is somebody else’s reported experience of what has happened. It is an indispensable source of knowledge. It only gives us historical cognition, however, which stands in a complex relation to rational or philosophical cognition: while the latter presupposes historical cognition as its matter, one needs the architectonic “eye of a philosopher” to select, interpret, and organize historical cognition. Kant develops this rationalist theory of testimony. He also practices it in his own work, especially while theorizing about race as (...) a subject of natural philosophy. In three dedicated essays on this subject, he treats race from the standpoint of a philosophical investigator of nature (Naturforscher), who (as Kant puts it in the first Critique) learns from nature “like an appointed judge who compels witnesses to answer the questions he puts to them.” This view underwrites Kant’s use of travel reports (a type of testimony) in developing and defending his theory of race. This article examines how the so-called disembodied criminal subject is given structure and form through the law of homicide and assault. By analysing how the body is materialised through the criminal law’s enactment of death and injury, this article suggests that the biological positioning of these harms of violence as uncontroversial, natural, and universal conditions of being ‘human’ cannot fully appreciate what makes violence wrongful for us, as embodied entities. Absent a theory of the body, and a consideration of corporeality, (...) the criminal law risks marginalising, or altogether eliding, experiences of violence that do not align with its paradigmatic vision of what bodies can and must do when suffering its effects. Here I consider how the bionic body disrupts the criminal law’s understanding of human violence by being a body that is both organic and inorganic, and capable of experiencing and performing violence in unexpected ways. I propose that a criminal law that is more receptive to the changing, technologically mediated conditions of human existence would be one that takes the corporeal dimensions of violence more seriously and, as an extension of this, adopts an embodied, embedded, and relational understanding of human vulnerability to violence. Pain is often used as the paradigmatic example of a phenomenal kind with a phenomenal quality common and unique to its instantiations. Philosophers have intensely discussed the relation between the subjective feeling, which unites pains and distinguishes them from other experiences, and the phenomenal properties of sensory, affective, and evaluative character along which pains typically vary. At the center of this discussion is the question whether the phenomenal properties prove necessary and/or sufficient for pain. In the empirical literature, sensory, affective, (...) and evaluative properties have played a decisive role in the investigation of psychophysical correspondence and clinical diagnostics. This paper addresses the outlined philosophical and empirical issues from a new perspective by constructing amultidimensional phenomenal spacefor pain. First, the paper will construe the phenomenal properties of pains in terms of a property space whosestructurereflects phenomenal similarities and dissimilarities by means of spatial distance. Second, philosophical debates on necessary and sufficient properties are reconsidered in terms of whether there is a phenomenal space formed of dimensions along which all and only pains vary. It is concluded that there is no space of this kind and, thus, that pain constitutes aprimitivephenomenal kind that cannot be analyzed entirely in terms of its varying phenomenal properties. Third, the paper addresses theutilityof continued reference to pain and its phenomenal properties in philosophical and scientific discourses. It is argued that numerous insights into the phenomenal structure of pain can be gained that have thus far received insufficient attention. (shrink)

Control measures, such as “lockdowns”, have been widely used to suppress the COVID-19 pandemic. Under some conditions, they prevent illness and save lives. But they also exact an economic toll. How should we balance the impact of such policies on individual lives and livelihoods (and other dimensions of concern) to determine which is best? A widely used method of policy evaluation, benefit–cost analysis (BCA), answers these questions by converting all the effects of a policy into monetary equivalents and then summing (...) them up. A different method, social welfare analysis, proceeds by determining the effects of a policy on individual wellbeing and then applying an aggregation formula to them to evaluate the overall effects of a policy. In this chapter, we survey these methods and argue that social welfare analysis has important advantages. One crucial advantage is that it enables ethical considerations relating to the impact of policies on individual wellbeing and its distribution to be incorporated into policy assessments in a transparent way. We illustrate this with a simple numerical model for evaluating pandemic policies that vary in terms of the stringency of the controls that they impose on individual behaviour, showing how the evaluation depends on the ethical significance accorded to their impact on the wellbeing of different age and income groups.
