In this empirical study, we present two new models that are corporate ethics based. The first model numerically quantifies the corporate value index (CV-Index) based on a set of predefined parameters and the second model estimates the market-to-book values of equity in relation to the CV-Index as well as other parameters. These models were applied to Canadian companies listed on the Toronto Stock Exchange (TSX). Through our analysis, we found statistically significant evidence that corporate values (CV-Index) positively correlated with firm (...) performance. The results are even more significant for firms with low market-to-book values. Our empirical findings suggest that corporate ethics is vital for management, employees, shareholders, stakeholders, and the community at large. In addition, we have tested and confirmed five hypotheses that are used to illustrate corporate ethics behavior and performance. (shrink)

In this research work, we formulate the phenomena of the financial system in the fractional framework to describe the complex nature of finance. The basic definitions and ideas of the Caputo-Fabrizio fractional operator are listed. We introduce a novel numerical technique for the dynamical behaviour of our fractional model. The oscillatory and chaotic behaviour of the model is studied with the variation of various input parameters on the model. We have shown that there exists strong oscillatory and chaotic behaviour in (...) the system; moreover, we highlighted the impact of fractional-order parameter on the model. The conditions for the local complex behaviour of the system are analyzed with the impact of certain parameters on the macroeconomic. Our findings suggest that the values of initial conditions, fractional order, and input parameters can lessen the chaos of the proposed financial system. (shrink)

In this paper, a positive organizational ethics -based framework is informed by the microfinance and socially responsible investing movements to capture the process of sustainable financial innovations. Both of these movements are uniquely characterized by the formation of positive ethical networks to develop sustainability innovations in response to external crises. The crisis–PEN–innovation framework proposed makes four contributions to the POE literature: positions corporate sustainability through a POE lens; formalizes the PEN construction through POE theory; proposes PENs are mobilized to respond (...) to external crises; and demonstrates how PENs facilitate sustainability innovations. The theoretical framework is tested using theory-guided process tracing in the sustainable banking sector to understand how sustainability innovations were realized. PurposeThis paper scrutinizes the impact of socioeconomic, political, legal and religious factors on the internal ethical values of human rights organizations worldwide. The authors aim to examine the Code of Ethics for 279 HROs in 67 countries and the social and legal settings in which they operate.Design/methodology/approachUsing the framework of protect, respect and remedy, the authors look for keywords that represent the human rights lexicon in these three areas. In the protection of human rights, the authors select the terms: peace, (...) transparency, freedom and security. For the respect of humans, the authors use the terms: dignity, equality, respect and rights. Sources of remedies come from justice and ethics. The analysis seeks to determine what political economy settings drive the ethical value choices of the organizations. Those choices are proxied by those keywords they mention in their Code of Ethics.FindingsThe analysis show that the scope of ethical values mentioned are higher when the HRO is in a country with more domestic violence, lower income inequality, French civil or Islamic legal origin and higher trust in politicians. In regard to the determinants of the ten keywords individually, the authors conclude that the status of the socioeconomic, political, religious and legal settings impact with local HROs mention each of the keywords: peace, justice, transparency, dignity, equality, ethics, respect, freedom, security and rights.Research limitations/implicationsThe analysis is based on HROs that have a webpage in English and list the employee Code of Conduct.Originality/valueThis study is the first to examine the Code of Ethics for HROs. Disclosure of health information is a sensitive matter, particularly in the context of serious illness. In conservative societies—those which predominate in the developing world—direct truth disclosure undoubtedly presents an ethical conundrum to the modern physician. The aim of this study is to explore the truth disclosure practices of physicians in Jordan, a developing country. In this descriptive, cross-sectional study, 240 physicians were initially selected by stratified random sampling. The sample was drawn from four major hospitals in Amman, Jordan. A closed-ended (...) questionnaire was distributed and completed by self-report. A total of 164 physicians completed the questionnaire. Thirty-seven physicians usually withheld the diagnosis of “serious illness” from patients, while 127 physicians usually divulged the information directly. Among the latter, 108 physicians made exceptions to their disclosure policy. Specialists were more likely to withhold health information. Non-disclosure was primarily motivated by request from the patient’s family. In twenty cases, non-disclosure was undertaken independently. In conclusion, most respondents opt to disclose the truth; however, the vast majority of these respondents make exceptions. Instances of non-disclosure are primarily motivated by sociocultural constructs. (shrink)

The Arabic original of the ninth-century Kitāb al-Nawāmīs has not been discovered, save for three incomplete chapters. We have access to a fuller version only through a Latin translation, often known as the Liber vaccae, a title derived from its notorious experiments which involve the gruesome slaughter and mutilation of a cow to magically produce a rational animal or bees. Recent research on the Liber vaccae has focused mostly on its reception in medieval and early modern Europe. By contrast, the (...) present article explores the Indo-Arabic tradition to which Kitāb al-Nawāmīs belongs, as a re-orientation of the Liber vaccae established on two levels: textual and theoretical. Section I, on 'Texts and Practices', introduces ʿUyūn al-ḥaqāʾiq of Abū al-Qāsim al-ʿIrāqī, a text on magical practices which contains 26 chapters that correspond to sections in the Liber vaccae, affording us a glance into the Arabic reception of Kitāb al-Nawāmīs and bringing us closer to the Arabic original. The textual connection is established further by highlighting parallels between the experiments of the Liber vaccae / Kitāb al-Nawāmīs and other texts on natural magic, namely Ghāyat al-ḥakīm of Maslama al-Qurṭubī and Kitāb al-Sumūm by Ibn Waḥshiyya. Section II investigates the theoretical bases of the Liber vaccae / Kitāb al-Nawāmīs, by associating its content with the theories of spontaneous and artificial generation in Kitāb al-Tajmīʿ attributed to Jābir ibn Hayyān, Ghāyat al-ḥakīm, Kitāb al-Sumūm and, finally, another work by Ibn Waḥshiyya, al-Filāḥa al-nabaṭiyya. Jābir's and al-Qurṭubī's works have been studied in relation to the Liber vaccae by David Pingree, Maaike Van der Lugt, Sophie Page and William Newman; their findings are re-evaluated here in light of the texts of Ibn Waḥshiyya and al-ʿIrāqī. The Egyptian Sufi poet Mohammad ibn Sa‘îd al-Bûsîrî’s (d. 695/1296) work called Qasîdah al-Hamziyah, in which he tells the life of the Prophet, has attracted great attention in Muslim societies. The eulogy, which is met with interest by scholars dealing with the field of poetry and literature, is a text read in daily life in mawlid, ceremonies praising the Prophet, dhikr rings in sufi lodges, hadith lesson circles, and prayers. More than a hundred commentaries, annotations, tahmis, tastir and translations have (...) been written on the work. While many of these studies on Qasîdah al-Hamziyah have been conducted by renowned scholars, there are also scholars who have worked on the eulogy but are not mentioned in biographical sources. The subject of this study is one of the commentaries written about the eulogy and whose name is not found in the biographical sources. The name of the work written by Abdullah al-Shazelî al-Bahrî is Al-Cavâhir al-Seniyye fî Sharh al-Hamziyah. In this article, information was given about the name of the work, its belonging to the author, the date of copyright, its reason, the method of commentary, its style, its content, the sources used, and its features. Also, the critical edition of the three couplets’ commentary was written as a highly representative example. (shrink)

With the mobility and ease of connection, wireless sensor networks have played a significant role in communication over the last few years, making them a significant data carrier across networks. Additional security, lower latency, and dependable standards and communication capability are required for future-generation systems such as millimeter-wave LANs, broadband wireless access schemes, and 5G/6G networks, among other things. Effectual congestion control is regarded as of the essential aspects of 5G/6G technology. It permits operators to run many network illustrations on (...) a single organization while maintaining higher service quality. A sophisticated decision-making system for arriving network traffic is necessary to confirm load balancing, limit network slice letdown, and supply alternative slices in slice letdown or congestion. Because of the massive amount of data being generated, artificial intelligence and machine learning play a vital role in reconfiguring and improving a 5G/6G wireless network. In this research work, a hybrid deep learning method is being applied to forecast optimal congestion improvement in the wireless sensors of 5G/6G IoT networks. There are two types of stock price manipulation examined in the theoretical literature: insider trading, which involves private information that is true and the public spreading of fraudulent false information. While there is a large empirical literature on insider trading, this is the first empirical article to examine the impact of false, fraudulent public information on stock prices and trading volume. We find that such false information, even after being denied by a credible source such as the SEC, generates both (...) abnormal returns and abnormal trading volume. We also find that the effects of the false information on security returns and volume can be persistent for at least 2 weeks. In addition, we show that perpetrators of false news attacks can make potentially large profits from such market manipulations. (shrink)

The adoption of mobile payment and mobile banking is low in several countries, despite its associated benefits. The present study examines the impact of Pakistani consumers’ financial skills and digital literacy on their intention to adopt m-payment/m-banking using the Technology Acceptance Model. The data were collected from 454 individual smartphone users residing in Punjab province via an online and offline questionnaire survey. Structural equation modeling was used to analyze the consumers’ data. Muslims living in England are living in a predicament. On the onehand, they have to face the reality that the laws governing the family institutionare secular in nature. This poses a threat to their identity and freedom ofreligion. On the other hand, they are commanded by Islam to settle theirdisputes according to its laws and principles. However, this is unrealistic,simply due to the fact that the only recognized legal system in England isthe English Law. To circumvent this situation, certain Muslim (...) scholars andcommunities have established quasi-judicial courts, acting in the capacity ofmediators, counsellors, arbitrators and even judges, in order to settle maritaldisputes. These courts, known as Shariah councils, provide a modern approachto alternative dispute resolution, whereby Muslim families and individualscan have their disputes resolved amicably. It was also set up as a response forMuslims to adapt to life under the English secular laws in which they live in,that do not afford them the right of having a Sharʑah-based institution. Onesuch Shariah council offering a modern approach to settling marital disputesamicably is the Islamic Council of Europe. The researcher conducted anin-depth interview with the said council and was able to collect a couple ofarbitrational cases and analysed them in order to give a better understandinginto its inner workings, its structural set-up and operation. Muslims in the U.S. are increasingly looking to integrate into its society while trying not to lose their identity as Muslims. They find themselves in a dilemma when it comes to the issue of congratulating and even partaking in the festivals of non-Muslims in the U.S. This issue has gained prominence and momentum after the event of 9-11, in which the Muslims wanted to show and prove their tolerance and acceptance towards others while trying to hold onto and maintain the (...) core principles of Islam. For this reason, this topic is a hotly debated issue in the U.S. and the West in general and a cause of division and confusion amongst Muslims. However, in order to justify their position and feel that they are following the teachings of Islam, they turned to the Islamic scholars, both in the West and the Muslim world, regarding the permissibility or prohibition of congratulating and partaking in non-Muslim festivals. This paper employs a qualitative methodology to analyse the fatāwā of permissibility and its effects on the Muslims living as minorities in the U.S. This qualitative method will give readers an insight, through a questionnaire that was conducted by the researchers, into how the Muslims in the U.S. perceive the issue of congratulating and/or partaking in the religious festivals of the non-Muslims. Based on the Lotka–Volterra system, a pest-natural enemy model with nonlinear feedback control as well as nonlinear action threshold is introduced. The model characterizes the implementation of comprehensive prevention and control measures when the pest density reaches the nonlinear action threshold level depending on the pest density and its change rate. The mortality rate of the pest is a saturation function that strictly depends on their density while the release of natural enemies is also a nonlinear pulse term depending on (...) the density of real-time natural enemies. The exact impulsive and phase sets are given. The definition and properties of the Poincaré map corresponding to the pulse points on the phase set are provided. We investigate the existence and stability of boundary and interior order-1 periodic solution. The theoretical analysis developed in the present paper combined with nonlinear controlling measures as well as nonlinear action threshold methods and techniques laid the foundation for the establishment and analysis of other state-dependent feedback control models. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

Internet-of-Things (IoT) creates a significant impact in spectrum sensing, information retrieval, medical analysis, traffic management, etc. These applications require continuous information to perform a specific task. At the time, various intermediate attacks such as jamming, priority violation attacks, and spectrum poisoning attacks affect communication because of the open nature of wireless communication. These attacks create security and privacy issues while making data communication. Therefore, a new method autoencoder deep neural network (AENN) is developed by considering exploratory, evasion, causative, and priority (...) violation attack. The created method classifies the transmission outcomes used to predict the transmission state, whether it is jam data transmission or sensing data. After that, the sensing data is applied for network training that predicts the intermediate attacks. In addition to this, the channel access algorithm is used to validate the channel for every access that minimizes unauthorized access. After validating the channel according to the neural network, data have been transmitted over the network. The defined process is implemented, and the system minimizes different attacks on various levels of energy consumption. The effectiveness of the system is implemented using TensorFlow, and the system ensures the 99.02% of detection rate when compared with other techniques. (shrink)

Since 2005, Malaysia has established several biobanks to keep in line with the advancement of biomedical research and development of biobanks in other countries such as the UK and the USA. Despite the establishment of several biobanks in Malaysia, little is known about the informed consent approach in biobanking research and its ethical challenges. This study aims to identify the approach in obtaining informed consent in the Malaysian biobanking for research and explore its ethical challenges. Using non-probability purposive sampling, an (...) in-depth interview with the key informants was conducted in Klang Valley. Based on the interviews, broad consent is the main approach used in obtaining informed consent in biobanking for research in Malaysia and five major ethical challenges were identified. These challenges include the informants’ opinion on the current informed consent approach, understanding participants’ rights, the role of the research ethics committee, biobanking governance in Malaysia, and informants’ knowledge and awareness. Exposure of the banking system to the Global Financial Crisis attracted attention to the study of riskiness and spillover. This paper studies the pattern of systemic risk and size effect in the Indian banking sector. Based on market capitalization, three public sector banks and three from the private sector were taken. Data are taken from the year 2007 to 2020. The analysis is done through quantile- CoVaR and TENET measure. State variables like Indian market volatility and global risk measures negatively (...) influence the Indian banks’ returns. Liquidity risk is a crucial aspect of private banks. Public banks experience public confidence even in the distress period. Large banks like HDFC and SBI bank offer the highest degree of systemic risk contribution. The role of private banks in transmitting systemic risk has been intensifying since 2015. Small-sized banks like PNB and BOB have become significant receivers and transmitters of risk. (shrink)

People with learning disability sometimes display challenging behaviour. This can be managed by use of antipsychotic medication or behavioural therapy or both. There is no solid evidence, however, that these therapies are safe and effective. A randomised controlled trial of antipsychotic medication has been proposed to deliver such evidence. However, this presents difficult issues in the ethics of research with learning disabled people. In particular, is a trial the most efficient and fairest way to evaluate practice in this area? Background and ObjectivesThe purpose of this study was to draw the attention toward the implications of COVID-19 and the related restrictions imposed worldwide especially in Pakistan. The primary objective was to highlight the levels of psychological distress, anxiety, family violence, suicidality, and well-being due to COVID-19 and the secondary objective was to associate it to social demographic factors.Materials and MethodsIt is designed as a cross-sectional study by employing an online questionnaire in the English language and obtaining responses using a snowball (...) sampling technique. We used three validated measures including Kessler Psychological Distress Scale, Generalized Anxiety Disorder index and World Health Organization Well-Being Index.ResultsA sample of 420 participants was recruited from across Pakistan, with most participants were females, students and belonging to Punjab. Nearly one-fourth of the participants scored above the minimum value set for moderate or high psychological distress. There was a higher prevalence of distress among females and resident of province Punjab. The majority of individuals reported that they were living with their family and more than half were neutral regarding their satisfaction with their living conditions. 40.5% believed that the lockdown has had a negative impact on their mental health. 31.4% have reported that they themselves have experienced abuse from a family member. 48.6% scored high on the GAD-7 scale and low wellbeing score was found among 80.2%. Students were found to be more vulnerable to mental illness and anxiety.ConclusionWith the lockdown restrictions, psychosocial distress has become prevalent in Pakistan. (shrink)

Tax payments stimulate business enterprises to choose tax management through tax avoidance activities, which is the legal practice to reduce the amount of tax payable. In developing economies, taxation is considered more critical for budget and revenues of a country. This paper investigates whether various business strategies influence corporate tax avoidance decisions of firms by adopting business strategies. Besides, it explores how gender diversity can ease this relationship. This study has chosen a sample of organizations from non-financial sector in Pakistan. (...) The time frame is 5 years, including once a year. The present model employed a generalized moment method and tested the proposed hypothesis to draw the results. The study has taken the size, leverage, and business profitability as control variables of firms. The study outcomes by using the GMM method demonstrate that the presence of female directors reduces tax avoidance behavior in prospector companies. This study provides insight into future research for stakeholders, government officials, tax authorities, and policymakers. The findings offer valuable recommendations and practical insights and implications. Health Level 7 (HL7) is an international standards development organisation in the domain of healthcare information technology. Initially the mission of HL7 was to enable data exchange via the creation of syntactic standards which supported point-to-point messaging. Currently HL7 sees its mission as one of creating standards for semantic interoperability in healthcare IT on the basis of its flagship “version 3” (v3). Unfortunately, v3 has been plagued by quality and consistency issues, and it has not been able to keep pace (...) with recent developments either in semantics and ontology or in computer science and engineering. HL7’s response has been to develop its “Services-Aware Interoperability Framework” (SAIF), which is intended to provide a foundation for work on all aspects of standardization in HL7 henceforth. We here summarise the major design principles that must be satisfied by a semantic interoperability framework – principles relating both to static semantics and to computational behaviour. We then assess the SAIF in light of these principles. We conclude that the SAIF is not in a position to support the needed reform of the HL7 v3 family of standards. (shrink)

İbn Arabî, dış gerçeğin ötesine geçen, ancak ona (dış gerçekliğe) ayrılmaz bir şekilde bağlı olan Kur’an’ı bu şekilde okumasıyla, Kur'an'ın tasavvufi tefsir geleneğini kendi tarzında sürdürür ve birincil amacını Fusûs’un her bölümünde uygular: Her ikisinin de meşruiyetini korurken, Kur'an'ın zâhir ve bâṭını arasındaki antitezi vurgulamak ve hatta bâṭına ancak ẓâhir yoluyla erişilebileceğini iddia edecek kadar ileri gitmek. Bu makale, bu karşılıklı bağımlı bilgi ('ilm)/hikmet (hikma) antitezinin en açık örneklerini bulduğumuz ve belirli nedenlerle seçilmiş Fusûs'un dört bölümünü detaylı şekilde incelemektedir: Adem bölümü, Fusûs'un ilk bölümü olduğu için seçilmiştir ve bu bölümde İbn Arabî'nin eserin tamamına yönelik amacı ve yaklaşımı net şekilde belirginleşir. Lût ve Hârûn bölümleri, Endülüs'ün ikili hermenötik ilkesinin en bariz örneklerini oluşturdukları için seçilmiştir. Son olarak, İbn Arabî metnin tahiriyle çelişiyor gibi görünse bile, aslında birincil zahiri modele dayanan daha gelişmiş bir yorum modelini açıkladığı için Nûh bölümü seçilmiştir. Âdem bölümünde İbn Arabi, Adem ile ilişkilendirilen en tutarlı Kur'anî betimlemenin insanlığın babası olduğu için onun insanlığının olduğunu öne sürer. Oysa onun hikmeti ilahi vasfıdır. Bunun nedeni, İlahi en katıksız ve tam ifadesini ancak insanda bulabilmesidir. Diğer taraftan, Nuh'un Kuranî sembolü ise kavminin büyük çoğunluğunun boğulduğu tufandır. Sufî’ye göre (İbn Arabî) onun hikmeti, şeyleri yüzdürmesidir- subbūḥiyya/sebūḥiyya hikmeti. İbn Arabî için boğulma bir ölüm nedeni olmaktan çok bir yaşam kaynağı olmuştur. Lut'un Kur'an'daki en kalıcı imgesi, kavminin günahını dizginlemedeki yetersizliğinden dolayı güçsüzlüğüdür. İbn Arabî, ama yine de onun hikmetinin güç olduğunu söylüyor. Son olarak, Hârûn, Kuran'da Mûsâ'ya itaat eden biri olarak tasvir edilir. Kardeşine yardım etmesi, yükünü taşımasına yardım etmesi için kendisine peygamberlik verildi. Mûsâ, Sina'ya gidip onu sorumlu bıraktığında bile, o sadece Mûsâ'nın yardımcısı rolünü yerine getirir ve ona tabidir. Oysa onun hikmeti itaatin, liderliğin antitezidir. (shrink)

The complex relations between Islam and modern science have so far mostly been examined by thinkers at the conceptual level. The wider interaction of religious scholars and preachers with the general public on science issues is an unexplored area that is worthy of examination, for it often is characterized by a literalistic approach. I first briefly review literalism in its various forms. The classical Islamic jurisprudential school of Zahirism, widely regarded as bearing the flag of juristic literalism, is also briefly (...) presented. I then address specific science-related issues currently being discussed in literalistic ways by many religious scholars and preachers in their general-public discourse. I focus on the practical case of the determination of crescent-based Islamic months and holy occasions, the conceptual issue of evolution (biological and human), and the rule for the consumption of meat by slaughter of animals. In the last part of the essay I propose a constructive alternative to the literalistic mode: the Maqasidi (objectives-based) approach. This rather old method has seen some revival lately, mainly among Islamic jurists concerned with solving the new issues of modern times, especially for Muslims living in the West, but this approach has not yet been applied to science-related issues. I present the main ideas of this method and show their relevance and usefulness to science-related topics. (shrink)

Dervish lodges and cults were among the important elements of the Ottoman social life and in those times, they had spread to nearly all city centers, towns and villages. Dervish lodges served as non-formal educational institutions for people from all ages and all segments of the society. In addition to education, these structures also played important roles in political, economic, social and military life of the Ottoman Empire. In general, wise people and scholars contributed to the development and dissemination of (...) Islamic sciences in general, and specifically, mystic thought. As a matter of fact, it was determined that there were a great number of Dervish lodges that were founded or supported by shaykh al-Islam (the chief justice), kādī (judge), scholars and mudarrisīn (teachers) in the history of sufism. One of them was Mullah Çelebi Dervish Lodge, which was founded in the 16th Century by Mehmed Vusuli Efendi, who belonged to the Ilmiya class (d. 998/1590). Until today no detailed studies have been conducted on lodges, which continued their existence until 1925. For this reason, this article will be the first study that deals with the dervish lodges in the light of archive sources. In this article, which was written to shed light on the course of our sufi cultural history, the prominent names, shaykhs and physical status of the Dervish lodges, especially Mehmed Vusuli Efendi, who was the founder of these lodges, will be dealt with.Summary: Our country, which hosts scientific moral centers like dervish lodges, school, madrasa and masjids, has a rich historical cultural treasure. As it is already known, the above-mentioned institutions had an important place in the life of Ottoman social life. Dervish lodges and madrassas were considered as science and wisdom centers because there is no distinction between zāhir (exterior) and bātin (interior) in our tradition. Under then-present conditions, the institutions that were needed most were supported. In this sense, the sultans and scholars cared about the dervish lodges, which were the places where sciences were studied contributing to the construction of these structures. One of these was Mullah Çelebi Dervish Lodge, which was founded in the center of Eyupsultan by the Ottoman man of letter, poet and scholar, Mehmed Vusuli Efendi (d. 998/1590).Mullah Çelebi Dervish Lodge is located in the Debbaghane/Tabakhane (Tannery) district in the center of Eyupsultan. As Suleyman Çelebi stated, “the valiant ones worked in the Tannery”. For this reason, it is possible to say that there were tanners among the disciples and followers of Mullah Çelebi Dervish Lodge.Mullah Çelebi Dervish Lodge was built by Mehmed Vusuli Efendi, who belonged to the scholar class in the Ottoman Empire. Mehmed Vusuli Efendi, who served as a professor in various madrasahs, served as a kādī in cities like Konya, Kutahya and Istanbul. Mehmed Vusuli Efendi was called “Mullah” because of his madrasah origin and “Çelebi” because of being a member of the scholar class. For this reason, dervish lodge in question was known as Mullah Çelebi Dervish Lodge in his honor. Sources mention the religious, knowledgeable and modest personality of Mehmed Vusuli Efendi. In this sense, the establishment of a dervish lodge by someone from the scholar class is important in terms of being a sign of the togetherness of dervish lodges and madrasahs in the Ottoman Empire. In addition to his scientific personality, Mehmed Vusuli Efendi was also an important figure who wrote works both as prose and as poetry, and made some translations into Turkish. In addition to the Dervish Lodges mentioned here, Mehmed Vusuli Efendi also established mosques and public baths in various places in Istanbul and was interested in charity works. Cemaleddin Server Revnakoglu stated that he was given the nickname “FındıklıÇelebi” because he had established a mosque in Fındıklı District.Mehmed Vusuli Efendi was the son-in-law of Aise Hubbi Hatun (d. 997/1589), who was one of the lady poets of the 16th century divan literature. Aise Hubbi Hatun was the granddaughter of Kanuni Sultan Suleyman’s foster brother Yahya Efendi from Beşiktaş. Aise Hubbi Hatun was also the wife of Semsi Çelebi, who was one of the grandchildren of Aksemseddin. In this sense, Aise Hubbi Hatun was a person who served in the palace during the reign of Selim II. According to the sources, Mullah Çelebi was appointed to a post that was as high as being the kādī of Istanbul with the help of Aise Hubbi Hatun, who was one of the prominent figures of the palace. For this reason, Mehmed Vusuli Efendi was also known as “Hubba/Hubbi Mullah”.In the present study of ours on Mullah Çelebi Dervish Lodge, one of the most prominent lady poets was Serife Zubeyde Fitnat Hanım (d. 1194/1780). In the sources, some authors discussed whether Fitnat Hanım’s tomb was in Mullah Çelebi Dervish Lodge. Since there is no inscription on it, the tomb of Mehmed Vusuli Efendi was assumed to belong to Fitnat Hanım. Actually, in the past, Istanbul Tombs and Museums Directorate hung a plate saying that the tomb in question belonged to Fitnat Hanim. However, Bilgin Turnalı revealed that the tomb of Fitnat Hanım was not in the Mullah Çelebi Dervish Lodge in his article with the title “The Tomb of the Poet Fitnat Hanım”.The archive sources, which we can examine on Mullah Çelebi Dervish Lodge, generally belong to the 18th century and onwards. For this reason, the information on the establishment years of the Dervish Lodge was not determined fully. However, some of the archive sources reported some revenues of Mullah Çelebi Dervish Lodge. For example, it was recorded in the archives that payments were made to this Dervish Lodge in Muharramiya activities. As it is known, ceremonies were held in the Ottoman Palace in the month of Muharram, which was the initial month of the Hijri calendar, and a number of people and institutions in Istanbul and its surroundings were paid by the Sultan under the name of “Muharramiyya”.In Mullah Çelebi Dervish Lodge, there were some prominent shaykhs like Mahmud Efendi and Nureddin Efendi. For example, since Mahmud Efendi had a lot of influence on the lodge, it was named after him for a period of time. Another prominent shaykh in the above-mentioned dervish lodge was Nureddin Efendi. As a matter of fact, he was closely interested in the maintenance and repair works of the dervish lodge and the activities related to the cults, and applied to Evkāf-i Humāyūn many times for repair works. Mehmed Esref Sabri Efendi, who was the shaykh before the last one in this dervish lodge, contributed to the training of many people of cult, especially Saadeddin Ceylan, who was the shaykh of Haki Baba Lodge. The last shaykh of Mullah Çelebi Dervish Lodge was Hafiz Hussein Kamil Efendi, who was the son-in-law of Mehmed Esref Sabri Efendi.When the physical condition of Mullah Çelebi Dervish Lodge is examined, it is understood that it was ruined in some periods in the history due to erosion; and for this reason, it had renovations. It was determined that Mullah Çelebi Dervish Lodge, which belonged to the Kadiriyye cult, remained until the last period of the Ottoman Empire; however, after the closure of the dervish lodges in 1925, it disappeared rapidly. In our present day, two tombs that belong to Mehmed Vusuli Efendi and Aise Hubbi Hatun and a graveyard where the members of the lodge were buried are left behind from this Dervish Lodge. As it is known, Dervish Lodges had an important place in the religious, scientific, political and economic life of the Ottoman society. In this article, which was planned to examine the Ottoman sufi culture, the historical course of Mullah Çelebi Dervish Lodge, its founder, shaykhs, physical location, etc. were discussed in the light of the archive sources. Propongo en las siguientes páginas dar cuenta de las posibles conexiones que existen entre lenguaje y economía, para poder desanudar los entramados que operan en el encuentro entre ambas disciplinas, de manera que nos sea posible esclarecer por qué existiría una relación tan significativa entre el modo de funcionamiento de la economía y el papel que juega el lenguaje en ella, especialmente desde el problema del intercambio como punto de encuentro entre ambas. Comenzando por un análisis del problema del valor (...) de Marx iremos desanudando el encuentro, las similitudes y diferencias que es posible establecer entre lenguaje y economía, tratando de dar respuesta a las siguientes preguntas: ¿Funciona la teoría del valor al modo en que la concibió Marx de manera similar al intercambio lingüístico? ¿Pensó Marx en su Crítica de la economía política la relación lenguaje-economía? ¿Qué papel ocupa la traducción en todo esto? Como segundo momento analizamos el problema de la circulación y el intercambio como momentos fundamentales del encuentro entre lenguaje y economía, a partir de dos narraciones que tienen a la figura de la moneda como eje central. Por un lado, el caso de “La moneda falsa” de Baudelaire y, por el otro, “El Zahir” de Borges. En ambos escritos es posible problematizar la relación ‘lengua-economía’ allí donde se encuentra en entredicho la circulación como proceso de intercambio que es posible interrumpir. ¿Nos presentan Borges y Baudelaire una posibilidad de pensar una interrupción de los procesos de circulación del capital, tal y como Marx los concibió? Değerli okuyucularımız, Cumhuriyet İlahiyat Dergisi’nin 24. Cilt 1. Sayısına hoşgeldi-niz. Bu sayımızla birlikte 23 yılı geride bırakmanın gururunu ve mutluluğunu yaşıyoruz. Akademi dünyasında değerli bilimsel çalışmalar yapmak kadar yapılan çalışmaları geniş bir okuyucu kitlesine ulaştırmak da önemlidir. Günümüzde neredeyse tüm bilimsel birikime online erişim vasıtasıyla ulaşmak mümkündür. Türkiye’de din bilimleri alanında yapılan araştırmalar da kütüphanelerin sınırlarını aşıp tüm dünyaya ulaşmayı hak etmekte-dir. Cumhuriyet İlahiyat Dergisi sahip olduğu format ve yayın ilkeleriyle uluslararası yayın kriterlerini karşılayarak son beş yılda çok hızlı bir (...) ivme kazanmış ve ilim dünyasının dikka-tini çekmeyi başarmıştır. Dergimiz bünyesinde geliştirilen İsnad Atıf Sistemi ve dergimizin öncülüğünde gerçekleştirilen çalıştaylar ile de İlahiyat Alan Dergilerine örneklik teşkil et-mektedir. Bu anlamda dergimizin hem yeni bir ekol oluşturduğunu hem de yazarlarımızdan aldığımız çok sayıda olumlu geri bildirimlere dayanarak akademik yayıncılığın kalitesini artıran bir okul vazifesi gördüğünü söylemek mümkündür. Yaklaşık iki yıldır süren izleme sürecinin sonunda dergimizin AHCI veya SSCI indekslere kabul edilme durumu bu yılın sonuna kadar sonuçlanacaktır. Web of Science temsilcileriyle görüşmele-rimiz ve dergi olarak akademik, etik ve teknik her türlü gerekliliği yerine getirmiş olmamız nedeni ile olumlu bir sonuç beklemekteyiz. 15 Haziran ve 15 Aralık’ta olmak üzere yılda 2 sayı ve 1 özel sayı yayınlamayı mis-yon edinmiş olan dergimiz yeni yayın döneminde de yoğun bir ilgiye mazhar olmuştur. 1ocak – 15 Mart 2020 döneminde Din Bilimlerinin birçok alanından 86 makale değerlendi-rilmek üzere dergimize ulaşmıştır. Yayın ilkelerimiz ve İsnad Atıf Sistemi gözönünde bulun-durularak gerçekleştirilen ön kontrolden sonra makaleler intihal tespit programı kullanıla-rak kontrol edilmiştir. Ön kotrolü tamamlanan ve benzerlik oranı %15’in altında olan maka-leler hakem değerlendirme sürecine gönderilmiştir. Bu sayımızda, söz konusu 86 çalışma içinden ön değerlendirme ve intihal taramasın-dan geçen, hakemlerimizin de akademik içerik açısından yayımlanmasını uygun bulduğu 25 orijinal araştırma makalesi sizlerin dikkatine sunulmuştur. The subject “rule”, which is one of the most fundamental issues of the Islamic legal theory (usūl al-fiqh), has been in the center of methodological debates. There is one important term in this regard, which should be studied very carefully: Khiṭāb(speech) of the God. It is because that, especially since the first period of Islam, it has been taken with some significant terms in the field of Kalāmsuch as Husn (pretty; good), Qubh (ugly; evil), and the quality of God’s talk. Yet, adopting this term in the description of the “rule” shows that Fiqh is based on divine inspiration, and it also emphasizes that even though there are some differences in details, wisdom of human being is not ignored when adjudicating. Moreover, it suggests that the validity or methodological accuracy of the “rule” which is adjudicated with ruling case is related to the connection through the term speech or divine inspiration. In this regard, Kalāmdimension of the term and its affect to legal theoretical discussions are very important in terms of historical process of the definition of the “rule” in Islamic law. In this study, I tried to examine whether or not the term “khiṭābof the God” which is used in the definition of the “rule” formed a limitation for consideration of legal evidence in Islamic law and if there is any limitation for the legal evidence regarding being only in the Qur’ān and the Sunnah due to this definition.SummaryThe “hukm (rule, arbritation, judgment, God’s will)”-as the backbone notion in usūl al-fiqhis one of the significant key notions discussed in the legal theory. Specifically, the term “khitabullah” mentioned in the definition of hukmis noteworthy to investigate. Since the early formation period of Islamic law, the term khitabullahhas been embraced along with the theological subjects: “husnand qubuh(the good and evil) and kalām(the attribute of speech to Allah)”. The term “khitabullah” in the definition of hukmemphasizes that indeed the source of fiqhis the revelation (wahy) and also emphasizes that the function of reason (‘aql) is not ignored in the process of adjudication- even if there are some nuances in details.Additionally, it presents that the validity or methodological accuracy of the “rule” which is adjudicated with ruling a case is connected to the term speech (khitāb), or in other words to revelation (wahy).On the whole, in the legal theory, the rule of Sharī‘ah is defined as God’s khitab(the communication of God), which means the demand of God relating to the acts of those who are subject of law or the effect of the khitābon the acts of those persons. Although, in the early formative period various explanations were made about what the rule is, it can be understood that the present definition of hukmbegan to evolve towards the end of the 5thcentury (A. H.). It is clear that al-Ghazālī had an impact on the formation of this definition. It is because al-Ghazālī defined the rule of Sharī‘ahas “the communication from God relating to an act of the person who is the subject of law”. After al-Ghazālī, al-Rādī and al-Baydāwī added to al-Ghazālī’s definition the words “iqtidā and takhyīr” and Ibn Hājib added “wad‘an”. Whereas in the Mutakallimun(theologians) tradition, Ibn Hacib's definition was preferred, Fuqaha(jurists) tradition chose two definitions-resembling each other: “Those coming to exist with the khitāb” and “the effect of God’s khitāb”.Along with al-Ghazālī’s definition, the concept of khitābcarved out a niche for itself in it and became the main element of the definition. It is understood that some discussions in the field of theology, such as husn-qubhand God’s attribute of speech have been effective on the interpretation of the concept of khitāb. The Ash‘arilegal theorists argue that the good and evil are not attributes of the self / the acts, whereas the Maturidi legal theorists argue that the exploration and determination of these attributes is rational and thus, the verdict reached via this rationale is lawful. The Maturidi legal theorists initiated the concept of being subject of law with the concept Sharī‘ah and in the line with this opinion; they defined hukmon the basis of khitāb. On the other hand, the Mutazilites’ claiming the attribute of good and evil are inherent feature of the act, did not define hukmon the basis of the khitābaccording to their theological understanding. The word of khitābassessed with God’s eternal speech (al-kalām al-azalī) has been approached from various aspects: for instance, whether the presence of the addressee is mandatory. The early Asharites scholars (mutaqaddimun), in particular Imam Asharī, did not entitle the eternal speech as khitāb. They consider that the presence of the interlocutor is necessary in the conversion of Kalāminto khitāb. The mutaakhirunAsharites (successors of the early Asharites scholars) did not consider the presence of the interlocutor necessary, thus they viewed the eternal speech as khitāb. The former identification of the hukmwith khitābby the early Ashari legal theorists caused to the problem of whether hukmis adventitious or not. Therefore, this approach was criticised by the Mutazilites. On the other hand, the Maturidi and Mutezilite legal theorists accept that hukmis adventitious; hence they do not consider as a problem naming the eternal speech of God as khitāb.When the historical course is examined, it can be said that one of the important aspects of the development of hukm’s definition is the use of khitāb. Khitābin some cases is used without possessive construction, in other cases it is used with possessive construction with God, or in possessive construction with shar’ or Shāri’. The most important one within these possessive constructions is the notion “khitaballah”. Therefore, it is necessary for khitaballahto be approached from the angle of the legal theory. In comparison to other terms, this notion narrowed the scope of the rule down. In the meanwhile, it raised the question: how the rule deduced via legal evidences can be incorporated in khitāb? As a consequence of this question, some legal theorists, such as Tūfī, proposed another definition by adducing this question.Although it is commonly accepted that the rules deduced via other evidences are within the context of the khitāb, there are also different descriptions about the concept of khitaballah. The rule is not limited to khitaballahin the conception of traditional interpretation accepting the khitābas eternal speech or literal speech (al-kalām al-lafzī). Because either all evidences are within the context of the khitāb,which is the eternal speech or other evidences are within the context of the khitāb,which is the literal speech. Thus, each result coming to exist with the other evidences is part of the Islamic law. But not all of these rules are considered equal to each other. Because each rule which is deduced from indisputable origin (qatii al-thubut) and is deduced from completely explicit sources (qatii al-dalala) are accepted as the word of God or the Prophet. On the other hand, other rules deduced via jurisprudence- in other words by jurist’s own value of judgment is viewed as the virtual rule (al-hukm al-zāhir). Such rules do not express absolute certainty. It is unacceptable for these rules to be described as the word of God or the Prophet. In this way, it is clearly understood that the concept of khitaballahmentioned in the description do not introduce restriction to the evidences ofSharī‘ah.We do not see a contradiction when the indefinite rules of Islamic law included in the context of khitāb. Because ijtihāddoes not aim to produce a new rule, on the contrary it functions in order to find out the already existing rules. The legitimacy of the rule obtained through ijtihādemerges from the way that this rule is deduced from the khitāb,which directly or indirectly represents the divine will. In addition, according to us, this legitimacy is not merely limited to versification and conception of the khitāb, but it also includes the function of the reason in (reasonable of the) khitāb. As a matter of fact, trying to solve unlimited cases with limited texts is difficult- in fact this is impossible. The majority of the legal theorists also share this opinion. Then, there is no obstacle in accepting that each rule obtained by authentic source and methodology can be considered part of Islamic law by implicating the rule in the context of khitāb(which represents the divine will) - although it may contain error and presumption. This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)

En cet article nous analysons les notions de taqiyya et kitmān telles qu’elles ont été élaborées par des auteurs ismaéliens des 10e et 11e siècles. Tout au long du présent « cycle d’occultation », la « science véritable » est voilée sous la lettre des textes révélés et des lois qui en découlent. Seuls les imāms et leurs disciples ont accès à cette science, mais ils n’ont pas le droit de la divulguer au tout venant. Cette obligation de garder le (...) secret fait partie du sermon d’allégeance que chaque Ismaélien doit prêter avant le début de son initiation. Mais même les imams ont été forcés d’agir avec prudence et en secret. À certains moments, ils ont été obligés d’entrer en occultation , en cachant leur véritable identité et leur lieu de résidence. Cette pratique de taqiyya et kitmān est présentée comme le sens caché des prescriptions coraniques relatives au jeûne du Ramadan. La rupture illicite du jeûne signifie la transgression des règles de la taqiyya, tandis que le ‘Id al-fiṭr symbolise l’abolition finale de l’obligation de la taqiyya. Les auteurs fatimides interprètent l’avènement de ‘Abd Allāh al-Mahdi et la fondation de l’état fatimide en Ifrīqiya comme un signe annoncant le ‘Id al-fiṭr, qui aura lieu avec l’apparition du Qā’im lors de la Grande Résurrection. En ouvrant un nouveau « cycle de manifestation », il abrogera toutes les eligions et les lois exotériques. La science sera alors directement accessible, sans zāhir ni bāṭin. Par conséquent, il ne sera plus nécessaire d’observer la taqiyya et le kitmān. In Sufism, the subject of love or divine love is considered as one of the most valuable concepts and the most important foundations on which the Sufis build their way of knowing Allah. For this reason, it has aroused the interest of many people, especially mystical and literary circles, from different religions, languages, races and cultures since ancient times. If there were no conversation or love, many of the literary texts would not exist today. This phenomenon, which has been handled (...) from different perspectives from past to present, has been subjected to different evaluations, sometimes in a literary text, and sometimes by writing separate treatises and books about it. One of the personalities who dealt with this subject in detail is Ibn Debbâg al-Qayravani, one of the Sufis of the 7th century Hijri. Ibn Debbâğ, like his predecessors Fârâbî, Tevhîdî and Ghazali, is one of the Sufis who consider love together with the theory of beauty and perfection. But what makes it different is that besides the theory of beauty and perfection, the states of lovers, the ways to reach genuine love, the parts of love, the truth of perfection and beauty, spiritual love, the pleasures of fellow devotees... In addition, his recording of mystical states and maqams with shar'i measures, his systematic handling of zahir-bâtın, latîf-kesîf, lofty-suflî concepts and associating them with love form a collection of his ideas. In fact, Ibn Debbâg sheds light on the understanding of Sufism of the period in which he lived, with the way he handled and handled the subject. While all these reveal the importance of our study, they are also the issues that determine its method. On the other hand, the absence of any academic study related to Ibn Debbâg and his understanding of love in our country is one of the main reasons why we prefer this subject. (shrink)

Tasavvuf erbâbı tabîatleri gereği mâddî unsurlardan ziyâde mânevî değerleri muhafaza etmeye ve geliştirmeye çalışırlar. Fakat tasavvufî çevrelerin sosyal bir yapıya bürünmeleriyle berâber düşüncelerini ve değerlerini sembolize etmek için mâddî bir kısım edevât da kullanmışlardır. Bunların başında keşkül, teber, tahta kılıç, asâ, gül, hırka gibi unsular gelir. Bu çalışmamızda dervîşlerin kullandıkları mâddî edevâttan birisi olan tahta kılıç ve ifâde ettiği mânâlara bakacağız ve örnekler üzerinden tahlîl etmeye çalışacağız. Tasavvuf ehli tahta kılıç ile ilgili bir hadîs-i şerîfden yola çıkarak mânevî bir disiplin, (...) ahlakî bir prensip ve nefsânî bir terbiye metodu ortaya koymuşlardır. Yeri geldiğinde cihâd ve mücâhede için zāhir kılıcının yanı sıra bâtın kılıcını kullanmışlardır. Manevî kılıcı sembolize eden tahta kılıcın kullanımına dâir tespit ettiğimiz ilk örnek sahābe döneminde Muhammed b. Mesleme’ye aittir. Yaygın bir şekilde kullanımı ise 1200’lü yıllarda büyük tarîkatların kurulduğu dönemde yânî Abbâsî hilâfeti döneminde olmuştur. Memlüklü dönemi kaynaklarından okuduğumuz kadarıyla Yûsuf Selahaddîn-i Eyyûbî ve berâberindeki kalabalık dervîş gurubu bu unsuru yaygın olarak kullanmışladır. Yûsuf Selahaddîn Eyyûbî’nin hem Bağdâd’ta iken hem de Mısır’a sefer düzenlerken berâberindeki kalabalık derviş gurubuyla birlikte zikirler eşliğinde tahta kılıçla yürüdükleri kaydedilmiştir. Bektâşî Velâyetnâmelerinde Anadolu Selçukluları döneminde yaşayan Hacı Bektâş-i Velî’nin himmetleriyle Saru Saltuk’un tahta kılıç kullanarak mânevî bir savaş verdiğini görüyoruz. Velâyet-nâmelerde tahta kılıç kullanımına dâir pek çok örnek vardır. 20 yüzyılda da pek çok dergâh ve câmîde bu tür bir kılıcın sembolik olarak kullanıldığını bizzât müşâhede ettik. (shrink)

In recent years in Turkey, it has been attempted to ensure that students who need special education are educated through inclusion. In the meanwhile, it became important to reveal scientifically the educational theories on which the inclusive education is based and the approach of Islam towards inclusive education that somehow has an influence on our national education policy. This study aims to examine the educational theories on which the inclusive education is based and the Islamic approach towards inclusive education. The (...) data of the study was collected by literature review. As a result, it is possible to say that the underlying theories of inclusive education are integrated education theory, cognitive democrative theory and dysontogenesis theories. In addition, although there are no specific verses for inclusive education in the Qurʾān and the Sunnah, it can be said that Islam has an positive approach to the inclusive education in general. Depending on this result, formal education should be conducted in the context of the principle of “least restricted education environment”.Summary: It is a matter of controversy about how education that increases the potential of human beings can be given to people who differ from their peers and who need special education. In recent years, there have been two prominent views in literature on this issue: The first is the ‘discriminatory’ view, which advocates that individuals with special needs should receive education in special spaces with similar students. The second is the ‘integrative view’, which states that these students should receive inclusive education with their peers. This view defends that students with special needs should be educated in separate boarding/day special education schools and special education classes within the normal schools. Recently in Turkey it is aimed to provide education to the students who need special education mostly by means of inclusion as an alternative to the first group. For this education, which is held with the claim of a less restricted environment, the conditions of the students are constantly improved with new regulations.This study aims to reveal the theories that can be the basis of inclusive education and Islam's approach to inclusive education. In this study, I will try to find answers to the following questions.1. What are the educational theories and claims that can be the basis of inclusive education?2. What are the principles of inclusive education in the Qur’an and Sunnah?This study is important in terms of revealing general opinions that may be the basis of theoretical foundations of inclusive education and examining Islam’s approach to inclusive education. The study, which was prepared by examining the English and Turkish literature available within the scope of the possibilities, was designed with theoretical analysis method. Although ‘accessibility’, which is considered among the shortcomings of theoretical studies in literature, is an important limitation for this study, the fact that it constitutes a theoretical ground for future studies and fills an important gap in the literature determines the importance of the study.Integrated education theory, cognitive democratic theory and dyontogenesis theories can be regarded as the establishing theoretical foundations of inclusive education. Integrated education theory is based on Whitehead’s philosophy of education. This philosophy sees the individual as a whole. It does not intend to make people have a profession or make money by simply using their intelligence. Instead, it helps to ensure that both the individual and society as a whole are happy by helping them to make the most of their potential. This model is based on developing emotion, mind, body, and spirituality as a whole. The distinctness and sacredness of human life and the need to know about this sacredness are the main pillars of integrated education theory. In this model all people are seen equal. According to this theory, the “natural” as well as the “beautiful” is appreciated. Therefore, no one feels bad in such an environment because of its differences. Because of the value given to them, each individual’s love of learning and ideals remain alive. The individual makes use of his/her mind to make a connection between the meaning of life and the school.Cognitive democratic theory asserts that educational arrangements should be made to prevent any feelings of alienation, oppression, and insignificance by considering different groups in education. This theory, which emphasizes the phenomenon of democracy and citizenship, aims at social cohesion in the light of epistemological principles. The theory is based on the fact that social change and change in education support each other. According to the theory, the formation of democratic citizenship is only possible if the school environment is a place where students can internalize democratic values. This is achieved by equal consideration of each segment at different levels. According to this theory, elements such as classroom environment, discipline, program, rights, participation in decisions, educational activities should be organized according to democratic values. In such an environment, different special education students find a place for themselves.Vygotsky's dysontogenesis thesis is based on his theory of social learning. His theory provides a methodological framework for inclusion in special education. The theory states that information is obtained through social communication. In this theory, knowledge is an element that is acquired together with other people rather than something that happens in the human mind. According to this theory, instead of focusing on the brain (head), where social knowledge is formed, self, mind, emotion should be included in education. Also, disability is a social deviation rather than a biological disease. Social relations and the environment mostly shape this deviation. Therefore, the abnormal child approach that has become a place in the society should be abandoned. The theory opposes the concept of mental retardation. Because mental disability should be explained by the differences in mental development. According to this theory, mental retardation is a social problem; education should be provided with appropriate methods over the examples that can be experienced in a commonplace with their peers. Distracting the student from his/her normal peers due to his/her differences, creates negative social conditions and harms his/herself.As far as I have examined, there is no direct Qur’anic verse or phrase about inclusive education for the disabled. However, there are verses regarding the integration and solidarity of the society on righteousness. Principles for inclusive education can be drawn from these verses. The Prophet valued the disabled and settled the principles on how society should treat them. He frequently visited them, enabled them to employ appropriate jobs, determined the conditions of the economic order by considering them, and dignified them with honor. In other words, he tried to make provisions to prevent the disabled from being separated from society. For example he urged Zahir bin Itban to continue trade, asked Abdullah Ibn Umm Mektum to come to community prayers, thus he sought different ways to integrate disabled people into society. These practices can be seen as a positive outlook towards the mainstreaming education of today. In the period of the four great caliphs, practices for mainstreaming education continued. (shrink)

Understanding the nusus and the interpretation of their texts has been at the center of the activities of many schools and ulama in fiqh studies, and as a result, each school of usool has sought to find a method suitable for their own understanding in order to understand and interpret the nusus in a sahih way. For this purpose, fiqh schools have developed some unique methods. It can be said that the main differences among the hukms that fiqh schools rely (...) on are generally due to these methodological differences. One of the efforts to understand and interpret through the linguistic structures and patterns of the nusus is tawīl. For this reason, it is necessary to know conceptions of tawīl in order to accurately determine the hukm giving methods of fiqh schools. In this context, the thought of Zâhiri Ṭawīl, which is based on the zâhiri meaning of the words in the language and aims to solve the meaning pattern of the nusus within the framework of the rules of the language, is important. To this end, the tawīl understanding of Ibn Hazm (d. 543/1148), one of the leading ulama of Zâhiri thought, has an important position in the determination of their understanding of fiqh and usool. For this purpose, by searching the works of Ibn Hazm, how his understanding of tawīl, which he used as a method, is reflected in his fiqh thought, will be examined through his fiqhi inferences. The Qur’an used their language when addressing the societies. The Qur'an especially, on the one hand, has used the language they use to convey its messages to its interlocutors in a correct and understandable way, on the other hand, it has used a unique style without departing from the natural structure of the language in unseen matters due to the nature of religious language. Therefore, it is necessary to take into account the words of the texts in order to understand and interpret the language used. The word tawīl was used by the ilm circles in the first period to mean the same as the word tafsir and in naming the works written as the Qur’an tafsir, the word tawīl was preferred instead of tafsir. Mâturîdî, the writer of the first dirayah tafsir, which points to the distinction between tafsir and tawīl, defines the word tafsir as 'to express exactly what is the meaning and purpose of the Qur'an, which is the divine word' and states that tafsir can be done only by the the Ṣaḥābah who knows Quran and Sunnah well. According to one of the many theses about the origin of language, it is God given. In other words, language has been taught to man by a supreme power (Allah). Ibn Hazm also defends this view. According to Ibn Hazm, the basic elements / elements of the language were taught by Allah to Adam (a.s), and then people developed this language in proportion to their needs. Therefore, the indications of the words depend on the declarations of God and linguistic experience. As a matter of fact, Allah has attributed new meanings to words such as salat, allegiance, hajj and similar words used for other meanings in the custom of language, and the new meanings attributed to them are accepted as the truth for the meanings of these words. Usûlists who adopted the method of fuqaha in usool, in the methods of istinbat of hukm out of sharii dalils, have generally made the taqseem of the words in terms of the meaning they were given to as âm, khâs, mushtarak and muavval while their taqsseem in terms of the words’ being used or not in the sense they were given was haqiqat, majaz, sarih and kinayah. Compared to other schools, the issue of tawīl has a different meaning according to the Zâhirî usûlists and faqih who base on the zâhiri khitab. Since the zâhir of the nusus is primary and essential, there should be a certain usool, principle and rule to give up the zâhir of the nusus and to switch to another possible meaning. Ibn Hazm states that there are different opinions among the usûlists about whether the imperative form is indicant of hukm. He also says that according to some Hanafi, Malikî and Shafii usûlists, as long as there is no evidence showing that it is wujub, tahrim, nedb, ibahâ and karahah, then the imperative form cannot be views as indicating a hukm.
