A long and vehement dispute once raged about the reality of universals. Are they only mental creations, forged by the human brain, without any reality outside them, or have they some independent existence apart from their mental reality? Anyhow, there was an apparent contradiction between die universal character of our ideas and the individual character of concrete things. (...) The Scholastics solved this problem by drawing clear distinctions. An idea is an abstraction; as soon as it becomes applicable to a number of objects or things in the same sense, it is a universal idea. The "direct universal" (universale directum seu metaphysicum) as such has no existence apart from our minds, because an existing thing is always bound up with concrete, determining, individualizing notes, and it is these very circumstances or accidents which are ignored by the mind as it strips the thing of its individual characteristics. When the mind reflects on this "direct universal," i.e., on the abstract essence of the thing, it sees that this is to be found in many more things and that it is identical in all those things, and in this way the "reflex or logical universal" is formed (universale reflexum seu logicum). This same essence or quiddity is not really different from the thing itself, but the mind makes abstraction of all accidents, and this foundation makes it possible to apply this idea in die same sense to all other beings of the same kind, whether they are actually existing or not. In other words the universal as a universal has only reality in the mind but it has a foundation or a ground in the thing itself. Newman was not so well acquainted with Scholasticism that he knew and mastered the solution of the problem. As a matter of fact he approached it from quite another angle. CAP.419 sistent with each other, they apparenüy imply a negation of the objective reality of universals. This makes it necessary to compare the texts and to explain his meaning. a. Newman Inconsistent. We should never lose sight of the fact that Newman had no intention at all to enter the province of philosophy in the restricted sense of the word. "I am only contemplating the mind as it moves in fact, by whatever hidden mechanism,"1 that is what could be put as a heading to every page of the Grammar of Assent. And when he virtually deals with metaphysics, he wants us to consider his statements as hypotheses, or as propositions stated only by the way, and in this department he always wishes "to speak under correction." This explains how he could refer to the universale metaphy sicum and the universale directum in a very correct way without realizing he was teaching Scholastic doctrine. As far as I know, it is Professor Walgrave who has first drawn attention to this fact,2 when he dealt with Newman's alleged conceptualism. Newman states that "even one act of cruelty, ingratitude, generosity or justice reveals to us at once intensive the immutable distinction between those qualities and their contraries; that is, in that particular instance and pro bac vice."3 The same holds for the opposites: right and wrong, true and false, just and unjust, beautiful and deformed.4 In one experience, therefore, he sees a thing as an immutable, absolute quiddity, which objectively and in the same sense belongs to all possible things of the same kind, although the mind does not yet explicidy confirm this universal applicability. The contemplated quality remains limited to the particular case; but in its absoluteness it is stripped of all individual, changeable and concrete characteristics. This is the metaphysical universal of the Scholastics. But Newman also mentions the logical universal when he says: "As we form our notion of whiteness from the actual sight of snow, a lily or a cloud, so, after experiencing the sentiment of approbation which arises in us on the sight of certain... Quite honestly, it is not easy to see what all the fuss is about. Sir Julian Huxley was clearly impressed. “A landmark in modern thought which we cannot afford to pass by” wrote John Stewart Collis in the Sunday Times, and the following week Arnold Toynbee in the Observer wrote: “This is a great book. If it is eclipsed by anything, it is by the spirit of the author, which shines through it”. The French reaction to the original text was (...) at least equally enthusiastic. André Rousseaux in Figaro Littéraire says: “Not since the 12th. Century has there been such a satisfying exposition of the perfect understanding between the material world and that of Christ Incarnate”. One wonders how much of the enthusiasm is due to the fact that Father Teilhard was not allowed to publish his philosophical thought in his own lifetime. The facts of his life are well known. Born in 1881, he joined the Jesuits in 1899 and was ordained. in 1912. Prehistory, geology, palaeontology, anthropology, were his chief intellectual interests, and he took his doctorate in the Sorbonne in 1922. He became professor of geology in the Institut Catholique in Paris and in 1923 went with Pére Licent S.J. to China on a palaeontological mission. The detail is given by Sir Julian in the introduction, in the course of which he pays Père Teilhard many felicitous tributes, notably that he was “a dedicated Christian priest.” On his return to France, Sir Julian tells us, “some of the ideas which he had expressed in his lectures about original sin and its relation to evolution, were regarded as unorthodox by his religious superiors, and he was forbidden to continue teaching.” He spent the next twenty years mostly in China with occasional scientific visits to India, Burma, Java, Abyssinia and the United States. In this paper I analyze Avicenna’s considerations from a metaphysical perspective, and the importance that metaphysics has in the education of human desire. This education must be developed on metaphysical grounds because human being’s most proper desire does not match that of our sensitive desires. Thus, metaphysics as an essential feature of the education of human desire might allow us to distinguish different kinds of men. In many research studies, tumor biopsies are an unavoidable requirement for achieving key scientific aims. Yet some commentators view mandatory research biopsies as coercive and suggest they should be optional, or at least optional until further data are obtained regarding their scientific usefulness. Further complicating the ethical picture is the fact that some research biopsies offer a potential for clinical benefit to trial participants. We interviewed and surveyed a convenience sample of participants in phase I clinical trials at a (...) single institution. Our primary aim was to describe phase I participants’ understanding of whether a research biopsy offered them the prospect of medical benefit. We also endeavored to describe participants’ views about biopsies—specifically, the benefits of biopsies, if any, and whether biopsies were acceptable, risky, or discouraged trial participation. Finally, we collected data on demographics and attitudes to see if any strong correlations with misunderstanding, acceptability, or riskiness existed. Overall, the respondents tended to view research biopsies as acceptable, though they did not succeed in identifying the lack of benefit of a research biopsy. These findings call for renewed efforts in consent conversations and documents to carefully describe the benefits, or lack thereof, of research biopsies. (shrink)

This paper has been prompted by the conviction that a number of ethical and political doctrines in Plato remain obscure and somewhat unintelligible unless related to the contemplative experience of the Platonic philosopher. 1 I shall concentrate here on one such doctrine, the distinction between philosophic and popular virtue, especially as it appears in the Phaedo and the Gorgias . But in order first to clarify our conception of the relationship between contemplation and virtue, I shall examine the fourteenth-century (...) English classic, The Cloud of Unknowing , which is mainly concerned with the practice of contemplation and only remotely connected with Plato. 2 One finds in The Cloud a perceptive account of the contemplative's acquisition of ‘perfect’ virtue which enables us to see the distinction between philosophic and popular virtue in Plato in a fresh light. After discussing the important passage in the Phaedo where the distinction is drawn, I shall criticise the account of virtue in Plato given by D. Z. Phillips and H. O. Mounce in Moral Practices where the contemplative context is minimised by their endeavour to see morality wholly in terms of conventions . 3 In this section, the argument between Socrates and Polus in the Gorgias will be discussed in light of the way Phillips and Mounce distinguish their respective ethical positions. The object of the paper is not only to point to the significance of contemplation in Plato's ethics which has been overlooked by many modern philosophers, but also to note the way our understanding of the dialogue form in Plato depends on the unique perspective of the contemplative philosopher. It is well known that the medieval scholastics did not begin their philosophy systematically with an explicit theory of knowledge. Unfortunately many people have concluded from that fact that the very idea of an epistemology, and especially the idea of a critique of knowledge, was completely foreign to them. Within recent years authors such as Professor Van Steenberghen and Father Copleston have done a great deal to spread a correct understanding of St. Thomas’s views on this matter. (...) Much evidence might be adduced from the principal work of John Duns Scotus to show that he also took steps to justify man’s spontaneous conviction that some natural knowledge of truth with certainty can be attained. While new generations of implantable brain computer interface devices are being developed, evidence in the literature about their impact on the patient experience is lagging. In this article, we address this knowledge gap by analysing data from the first-in-human clinical trial to study patients with implanted BCI advisory devices. We explored perceptions of self-change across six patients who volunteered to be implanted with artificially intelligent BCI devices. We used qualitative methodological tools grounded in phenomenology to conduct in-depth, semi-structured interviews. Results (...) show that, on the one hand, BCIs can positively increase a sense of the self and control; on the other hand, they can induce radical distress, feelings of loss of control, and a rupture of patient identity. We conclude by offering suggestions for the proactive creation of preparedness protocols specific to intelligent—predictive and advisory—BCI technologies essential to prevent potential iatrogenic harms. In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein’s treatment of solipsism in his Tractatus Logico- Philosophicus. In that work Wittgenstein can be seen to express an unusually profound understanding of the problems faced in trying to give an account of how we, who are subjects, identify ourselves as objects in the world. We have (...) in his compressed remarks, the kernels of a number of arguments which all come together to form what can be called the problem of self-identification. I want to argue that the solipsism of the Tractatus arises at least in part as a solution to, or – to put it less optimistically – as a symptom or articulation of this problem. In approaching Wittgenstein’s early discussion of solipsism in this way I will obviously be in disagreement with some other interpretations of the work. For example, there are those who think that there is no ‘solipsism of the Tractatus’.1 In fact, the Tractarian arguments presented below as motivating solipsism have been seen as fulfilling the quite opposite function of refuting it. I do not intend in this piece to engage with alternative interpretations. Let me say a little bit about why I have granted myself the licence not to do so. First, the focus of my concern with solipsism is on how it connects with what I have called the problem of self-identification. Synthetic biology is an increasingly high‐profile area of research that can be understood as encompassing three broad approaches towards the synthesis of living systems: DNA‐based device construction, genome‐driven cell engineering and protocell creation. Each approach is characterized by different aims, methods and constructs, in addition to a range of positions on intellectual property and regulatory regimes. We identify subtle but important differences between the schools in relation to their treatments of genetic determinism, cellular context and complexity. These distinctions tie (...) into two broader issues that define synthetic biology: the relationships between biology and engineering, and between synthesis and analysis. These themes also illuminate synthetic biology's connections to genetic and other forms of biological engineering, as well as to systems biology. We suggest that all these knowledge‐making distinctions in synthetic biology raise fundamental questions about the nature of biological investigation and its relationship to the construction of biological components and systems. In April 1741 there appeared a slim volume entitled An Apology for the Life of Mrs Shamela Andrews by a certain Mr Conny Keyber, whose name is generally supposed to conceal that of the novelist Henry Fielding. Shamela, to give the book its more familiar title, was a parody of Samuel Richardson's epistolary novel Pamela: or Virtue Rewarded, which had been published to great acclaim the previous year. In a series of letters purportedly sent to each other by the (...) main characters, the story unfolds of the honest servant-girl Pamela, her efforts to avoid seduction by her master Mr B., and her eventual marriage to him. Fielding's chief target was the morality of the book , but in passing he drew cruel attention to some of the pitfalls of the epistolary form as a vehicle for narrative. One passage in particular deserves quotation, from Letter VI, which Shamela writes to her mother at twelve o'clock on Thursday night: Mrs Jervis and I are just in Bed, and the Door unlocked; if my Master should come – Odsbods! I hear him just coming in at the Door. You see I write in the present Tense, as Parson Williams says. Well, he is in Bed between us, we both shamming a Sleep, he steals his Hand into my Bosom, which I, as if in my Sleep, press close to me with mine…. (shrink)

As a whole these essays take their cue from the later Wittgenstein in an effort to get beyond the verifiability/falsifiability cul-de-sac and to "get clear" on some religious concepts by exploring religious language at work. The opening two essays, by E. Heller and P. Holmer, are the only two that deal directly with Wittgenstein. Heller shows some interesting parallels between Wittgenstein and Nietzsche, but largely these essays are for introductory purposes. Although Wittgenstein's presence is felt in the remaining essays, (...) his name is seldom mentioned. Ian Ramsey has two contributions, one on paradox and one on religion and science. He is up to his usual method of making plausible suggestions by means of careful distinctions, always with a careful eye on the phenomenology of the religious universe of discourse. F. Ferré explores the notion of "models" as it works in science and sees how this concept can work in the examination of religious language. T. McPherson uses a distinction between literal, semiotic, and symbolic meaning to explore religious assertions and analogy. R. C. Coburn suggests that a neglected use of theological statements is to answer the limiting questions of religion in a manner that is logically complete. B. Mitchell talks about justifying religious belief in answer to MacIntyre's charge that such a project reveals a basic misunderstanding of religious discourse. There are two intriguing essays by Wm. Poteat, one of which draws an analogy between birth and suicide to build a doctrine of creation. C. B. Daly writes on metaphysics and the limits of language. In O'Regan & Noë's (O&N's) account for the phenomenal experience of seeing, awareness is equated to what is within the current focus of attention. They find no place for a distinction between phenomenal and access awareness. In doing so, they essentially present a dualistic solution to the mind-brain problem, and ignore that we do have phenomenal experience of what is outside the focus of attention.

On the passage spaced Archer-Hind writes: ‘It seems to me that needless difficulty has been raised over this sentence; Хαρέντως έҳων simply means “having his body in a good state,” and to this τοαύτη refers. If the body were in a healthy condition at death and at a healthy age, it would hold out longer, says Plato, against decomposition. Mr. Cope, I think, is quite correct in translating “If a man dies with his body in a vigorous state and (...) at a vigorous period of his life, a very considerable time indeed.” The following sentence συμπεσòν … χρόνον is bracketed by Schanz after Ast. I see no sufficient reason for doing so; the yap is certainly not very obvious but may be explained thus; for if a body is embalmed it remains nearly whole for an indefinite time. Hirschig brackets ώσμερ … ταριχενθέντες very superfluously. Plato says the body of a healthy man who dies in the prime of life lasts a good while; an Egyptian mummy lasts an indefinite time; even without this some parts of the human frame are almost indestructible.’. Therefore, the source of all information that is not based on observation and mutawatir khabars. The part that expresses certain information in the news is mutawatir.One of the scholars who discussed the details of the news in the Hijri 4th century and took a detailed view of it in his works is Qādi Abd al-Jabbar (415/1025). He has opened independent titles in his works on the value of news and knowledge of the news, and has based his views on this subject in various ways, using the methods of Islam as the basic sources of Islam, using the methods of intelligence and transportation against the Sumenians who do not accept the news as a source of information and Berahime who do not accept the prophethood of the prophethood. He was the advocate of ân, Sunnah and icma.In this study, the modest theory of Qādi Abd al-Jabbar is emphasized. His views were based on his work, al-Mughni, which had an encyclopedic identity. Qâdi, tried to put the modest news on a rational basis both in order to combat those who do not see the news as a source of information and to base the basic sources of Islam. Synthetic biology is an increasingly high-profile area of research that can be understood as encompassing three broad approaches towards the synthesis of living systems: DNA-based device construction, genome-driven cell engineering and protocell creation. Each approach is characterized by different aims, methods and constructs, in addition to a range of positions on intellectual property and regulatory regimes. We identify subtle but important differences between the schools in relation to their treatments of genetic determinism, cellular context and complexity. These distinctions tie (...) into two broader issues that define synthetic biology: the relationships between biology and engineering, and between synthesis and analysis. These themes also illuminate synthetic biology's connections to genetic and other forms of biological engineering, as well as to systems biology. We suggest that all these knowledge-making distinctions in synthetic biology raise fundamental questions about the nature of biological investigation and its relationship to the construction of biological components and systems. The titles of the essays included are: 1) The Birth of the Writings and Constitution of the Canon (...) ; 2) Francis, Theology and the Letter to brother Anthony ; 3) Anthony cites Francis: the Epilogue of the Sunday Sermons and the Early Rule XVI ; 4) The Writings between Francis and his secretaries: a Knot to be Untied ; 5) Concerning the Autographs of brother Francis: Doubts, Verifications and Confirmations ; 6) Concerning the Authenticity of the Writings of Francis to the "Poor Ladies" ; 7) The Lesser Brothers and Books: Concerning the Exegesis of "the books necessary to fulfill their office" and "Those who do not know how to read" . Each of the essays displays a careful methodology and appreciation for the evangelical content of the texts.The first essay deals with the establishment of the "canon" of Francis's writings in which the author demonstrates that the writings are born and develop from Francis's relationship with the Word of God. In this context, "writing" takes on the character of an "essential moment" in Francis's relationship with the Word , with God and with the brotherhood. This explains for Paolazzi, the passion with which Francis recommends the writings to those to whom they are addressed.The second and third essays are related to Anthony of Padua and the writings. The second essay deals with the content and authenticity of the Letter to Anthony, included by Kajetan Esser in the canon of Francis's writings. Paolazzi argues that the expression, "Brother Anthony my bishop" goes back to Francis himself. He suggests that Anthony's request for permission to teach reflects the concern of the novice who had permission from his minister to have a breviary, but was uncomfortable and needed Francis's explicit permission , a characteristic of the tension in the brotherhood upon Francis's return from Egypt in 1220. The conditions Francis places on the teaching of Anthony reflect Francis's concern that the Word of God not be approached purely from an intellectual perspective, but rather as a Word which must transform life. The third essay attempts to demonstrate that the Epilogue to Anthony's Sunday Sermons integrates sections of chapter 17 of the Early Rule. Paolazzi concludes this careful lexical study with the affirmation that Anthony had the Early Rule's exhortation to preachers in chapter 17 before his eyes as he concluded his Opus Evangeliorum .In the fourth essay Paolazzi tackles the question of the role played by secretaries in the production of the Writings of Francis. Scholars, including Esser, have suggested that because of his health and/or because of his status as "illiterate," Francis depended on secretaries to put his thoughts on paper. Paolazzi approaches the question by citing a saying attributed to Francis from the Mirror of Perfection . That this saying goes back to the historical Francis Paolazzi concludes based on both the content and the fact that it reflects Francis's literal approach to the Gospel. The saying states that Francis wanted no one to call him good, father or master because of the teaching of Christ in the Gospel who said that only God should be addressed with these titles . He then studies the usage and appearance of these three terms in the Writings of Francis, which confirm a consistent usage in accord with this saying. This demonstrates that the Writings reflect the "speech" of Francis and not simply his conceptual thought. The controversy over the meaning and parameters of Franciscan poverty is one of the most widely discussed issues in medieval historiography, both within the Franciscan order as well as outside of it, both during the Middle Ages as well as among contemporary scholars even today. Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily (...) concerned with the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. Liberal theory seeks to achieve toleration, civil peace, and mutual respect in pluralistic societies by making public policy without reference to arguments arising from within formative ideals about what gives value to human life. Does it make sense to set aside such conceptions of the good when it comes to controversies about stem cell research and the genetic engineering of people or animals? Whether it is reasonable to bracket our worldviews in such cases depends on how we answer the moral (...) questions that the use of these biotechnologies presuppose. I argue that the moral language of liberal justice – of rights and duties, interests and opportunities, freedom and consent, equality and fairness – cannot speak to these underlying concerns about what the human embryo is, why the natural lottery matters to us, and whether 'animal nature' is worth preserving. I conclude that liberal theory is incapable of furnishing a coherent or desirable account to govern the way we use our emerging powers of biotechnology. (shrink)

Lifestyle diseases constitute an increasing proportion of health problems and this trend is likely to continue. A better understanding of the responsibility argument is important for the assessment of policies aimed at meeting this challenge. Holding individuals accountable for their choices in the context of health care is, however, controversial. There are powerful arguments both for and against such policies. In this article the main arguments for and the traditional arguments against the use of individual responsibility as a criterion for (...) the distribution of scarce health resources will be briefly outlined. It is argued that one of the most prominent contemporary normative traditions, liberal egalitarianism, presents a way of holding individuals accountable for their choices that avoids most of the problems pointed out by the critics. The aim of the article is to propose a plausible interpretation of liberal egalitarianism with respect to responsibility and health care and assess it against reasonable counter-arguments. (shrink)

It can be creepy to notice that something human-looking is not real. But can sensitivity to this phenomenon, known as the uncanny valley, be predicted from superficially unrelated traits? Based on results from at least 489 participants, this study examines the relation between nine theoretically motivated trait indices and uncanny valley sensitivity, operationalized as increased eerie ratings and decreased warmth ratings for androids presented in videos. Animal Reminder Sensitivity, Neuroticism, its Anxiety facet, and Religious Fundamentalism significantly predicted uncanny valley (...) sensitivity. In addition, Concern over Mistakes and Personal Distress significantly predicted android eerie ratings but not warmth. The structural equation model indicated that Religious Fundamentalism operates indirectly, through robot-related attitudes, to heighten uncanny valley sensitivity, while Animal Reminder Sensitivity increases eerie ratings directly. These results suggest that the uncanny valley phenomenon may operate through both sociocultural constructions and biological adaptations for threat avoidance, such as the fear and disgust systems. Trait indices that predict uncanny valley sensitivity warrant investigation by experimental methods to explicate the processes underlying the uncanny valley phenomenon. (shrink)

Teilhard’s cosmological speculation is a valuable basis for an environmental ethics that perceives individual natural objects as good in themselves and the world as good in itself. Teilhard perceives man as fundamentally part of a cosmic environmental whole that is greater than mankind taken individually or collectively. His holistic views on human biological and psychological and social evolution are, I argue,compatible with a biocentric environmental ethics. I discuss some similarities and differences with the views of the deep ecology (...) movement. I show that Teilhard’s hierarchical system is not humanistically oriented in a way that need be interpreted by Teilhardians as contrary to environmental well-being. I argue that Teilhard’s sympathies toward transportation technology, including the automobile, can be interpreted in his holistic manner. I conclude that Teilhard’s theocentric views are also a basis for supporting an environmental ethics which is both optimistic and not anthropocentric. (shrink)

In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein.

The recent interest in wisdom in professional health care practice is explored in this article. Key features of wisdom are identified via consideration of certain classical, ancient and modern sources. Common themes are discussed in terms of their contribution to ‘clinical wisdom’ itself and this is reviewed against the nature of contemporary nursing education. The distinctive features of wisdom (recognition of contextual factors, the place of the person and timeliness) may enable their significance for practice to be promoted in more (...) coherent ways in nursing education. Wisdom as practical knowledge (phronesis) is offered as a complementary perspective within the educational preparation and practice of students of nursing. Certain limitations within contemporary UK nursing education are identified that may inhibit development of clinical wisdom. These are: the modularization of programmes in higher education institutions, the division of pastoral and academic support and the relationship between theory and practice. (shrink)

This paper attempts to respond to a call to find an ontological basis for establishing African legal theory. The African world of my choice is the Igbo world of South-east Nigeria. It is a world I want to examine to see how its material and theoretical structures help articulate a philosophy of law in terms of projecting a consistent understanding of law subjects and the foundations of their rights. The author acquired in May of 1965 a copy of Karl Rahner’s observations on the latest draft of “Schema XIII” which would becomeGaudium et Spes. The title was “Anmerkungen zum Schema DE ECCLESIA IN MUNDO HUIUS TEMPORIS (in der Fassungvom 28.5.65).” After the third session of Vatican II serious work remained to be done on that text. Among several meetings was onelong and important occurred at Ariccia in the Alban hills outside Rome. Rahner could not attend because he could (...) not miss so manylectures at the University of Munich. He sent written comments. That document is a valuable source for the research of the theologicalbackground of Gaudium et Spes. Rahner’s observations fall into three subheadings: remarks on the Latin syntax and style; generalobservations on the underlying theological principles; detailed observations on particular points. Bernhard Deister’s book Anthropologie im Dialog is a comparison of aspects of Karl Rahner’s theology with the psychology of Carl Rogers. Here the dialogue partner of the German philosophical theologian is an American psychologist of influence. The author begins: “These pages present two exemplary pictures of the human person, from theology and psychology. They unfold their approaches in an interdisciplinary dialogue.” The following pages summarize this comparison. Both thinkers see the human being as an active subject living in the tensions (...) between individuality and relation­ship, and then between immanence and transcendence. Building on this, Rogers’ psychology centers on the dynamics and emotions accompanying life with social groups, while Rahner is frequently involved in drawing particular theological disciplines like moral theology or ecclesiology forward into creative reflections on tradi­tion, spirituality, and praxis amid church and society. Elimination of state laws that preempt local antismoking ordinances is a national health objective. However, the tobacco industry and its supporters have continued to pursue statelevel preemption of local tobacco control ordinances as part of an apparent strategy to avoid the difusion of grassroots antismoking initiatives. And, an increasing number of challenges to local ordinances by the tobacco industry and persons supported by the tobacco industry are being decided in state supreme courts and courts of appeals. The outcomes of (...) seemingly similar cases about the validity of local smoke-free air ordinances vary signifcantly by state. This paper examines the common and unique aspects of the decisions and the potential implications of court rulings on preemption for future state tobacco control eforts and achievement of national health objectives around the elimination of preemption. Using a search strategy developed for the Centers for Disease Control and Prevention's State Tobacco Activities Tracking and Evaluation System, cases where a state or federal appellate level court made a fnding on the validity of a local smoke-free air ordinance or regulation were identifed in 19 states. In contrast to previous studies, we found that cases in approximately half of states were decided for local governments. We also found that across the states, courts were considering similar factors in their decisions including the extent to which: the local government possessed the authority to pass the ordinance, the ordinance conficted with the state constitution, and state statutes preempt the ordinance. The aims of the paper are (i) to introduce a framework for reasoning about equity in health distribution before and after interventions, and (ii) to assess various Gini measures applied to healthy life expectancy against explicit normative concerns. Part 1 discusses different ways of measuring pure health inequality and suggests that a modified Gini measure could be used to measure inequity in health before and after treatment. Part 2 introduces a framework for reasoning about distributions of health. Part 3 (...) discusses three normative concerns that any acceptable measure of inequity should satisfy. Part 4 describes the standard Gini measure for measuring pure inequalities in healthy life expectancy. It also examines Wagstaff's Extended Gini measure of health inequity and discusses how it can be used to make priority weights to the worst off explicit. The final section expresses some programmatic worries and possible applications. It is argued that the impact of interventions should be evaluated both in terms of reduced inequity (as measured by the Extended Gini or the Extended Proportional Gini) and improved efficiency (measured by gains in average healthy life expectancy). Measurement of pure health inequity could supplement cost-effectiveness analysis as a basis for fair priority setting. (shrink)

Indeed this character, coupled with his great subsequent influence up to the Renaissance, is often considered a key reason for the charge that Aristotle produced a set-back of one thousand years in the development of physics. Our purpose here is to attempt to put in a balanced perspective the Aristotelian doctrine and ancient anticipations of the concept of inertia; no attempt is made to study the (...) medieval period. “... it ain't likely to have a radius of exactly zero,” is the conclusion of H. G. Dehmelt(1) from his Nobel Prize (1989) winning observations on trapped electrons. There are small discrepancies between Dehmelt's observations and the theoretical predictions of quantum electrodynamics (QED), which assumes that the electron is a point particle. Here we present evidence in support of Dehmelt's contention that the electron has a structure. Essentially, we point out that the nonrelativistic limit of QED is (...) at variance with a fundamental principle underlying all of physics, viz. the second law of thermodynamics. (shrink)

Internet-based health research is increasing, and often offers financial incentives but fraudulent behavior by participants can result. Specifically, eligible or ineligible individuals may enter the study multiple times and receive undeserved financial compensation. We review past experiences and approaches to this problem and propose several new strategies. Researchers can detect and prevent Internet research fraud in four broad ways: through the questionnaire/instrument ; through participants' non-questionnaire data and seeking external validation through computer information,, and 4) through study design. These approaches (...) each have pros and cons, and raise ethical, legal, and logistical questions, given that ethical tensions can emerge between preserving the integrity of research vs. protecting the privacy and confidentiality of study respondents. While past discussions concerning the ethics of online research have tended to focus on the participants' ability to trust the researchers, needs now arise to examine researchers' abilities to trust the participants. This analysis has several critical implications for future practice, policy, and research. (shrink)

In the introductory remarks to his inaugural lecture Professor Isaiah Berlin laments that so little attention is payed by professional philosophers to studies “about the ends of life”. Studies such as those to which the Chichele Chair of Social and Political Theory is dedicated “spring from and thrive on discord”. He observes.

To stimulate research and innovation (R&I), to contribute to the solution of societal challenges and to align R&I with societal values, the European Commission has launched the governance framework of Responsible Research and Innovation (RRI). RRI figures in many high-level EU policies as a means to promote smart growth, and a growing community of R&I practitioners from both the public and private sectors appears committed to it. Although debates on what RRI precisely entails have not reached closure yet, RRI provides (...) an interesting avenue to explore ways of making R&I more societally germane. While recognizing the usefulness of keeping critical reflection on RRI’s meaning alive, we suggest that to make the step from theorizing to implementation, RRI could benefit from a clearer conceptualization. This chapter presents the iterative trajectory in conceptualizing RRI followed as part of RRI Tools, one of a number of EC-funded research projects and support acts aimed at fleshing out what RRI can and should be, and the conceptualization of RRI that this led to. It suggests that RRI is best captured if in R&I governance attention is paid to the five p’s of Purpose, Products, Processes, Preconditions and People, and that further elaborations on the meaning of RRI should happen in dialogue with attempts at practicing RRI. For the University of Turin’s series Philosophica varia he edited a second text of the Romantic Idealist’s Conferences at Stuttgart. That volume was begun by an introduction of a hundred pages containing a masterful presentation of Schelling’s thought at that crucial moment. With Le fondement Vetö, professor at Abidjan, Ivory Coast, gives us a full exposition of Schelling’s many faceted thought. This exposition is arranged (...) around the ultimate source and goal of his thought. In the early systems Schelling called it "consciousness of self" or "the absolute," but Vetö employs as the leitmotif for his book, Grund. This volume is not a precise analysis of the primal and turbulent ground of reality in one or another period of Schelling’s enterprise; it is, rather, a study of richness of Schelling’s thought arranged around the explanation of this term, both from within the various systems of Schelling and from without through his philosophical contemporaries. Genomics provides information on genetic susceptibility to diseases and new possibilities for interventions which can fundamentally alter the design of fair health policies. The aim of this paper is to explore implications of genomics from the perspective of equal opportunity ethics. The ideal of equal opportunity requires that individuals are held responsible for some, but not all, factors that affect their health. Informational problems, however, often make it difficult to implement the ideal of equal opportunity in the context (...) of healthcare. In this paper, examples are considered of how new genetic information may affect the way individual responsibility for choice is assigned. It is also argued that genomics may result in relocation of the responsibility cut by providing both new information and new technology. Finally, how genomics may affect healthcare policies and the market for health insurance is discussed. (shrink)

A few weeks ago I received a copy of the PHILOSOPHICAL STUDIES, containing a review of my book John Henry Newman, Our Way to Certitude, written by Fr. Boekraad. It was very unfavourable so that anybody reading it is sure to make up his mind never to buy the book.

This article is an attempt to evaluate the Oregon plan from the perspective of a Scandinavian national health care system. The Nordic welfare states are marked by a strong emphasis on equality. As an example of an egalitarian system we present the Norwegian health care model in part one. In part two, the arguments in favor of a one tier system in Norway are presented and compared to Oregon's two tier system. Although we argue, in part three, that a (...) comparison of the degree of explicitness in the prioritization process shows that Norway has much to learn from Oregon, we do believe that the Norwegian system has some attractive elements that may function as an important corrective. In part four we present the Norwegian Guidelines for priority-setting and discuss the weight assigned to the severity of disease criterion. It is argued that the exclusion of information about the severity of disease partly explains the counterintuitive ranking of treatment-condition pairs in Oregon's initial method based on the principle of health maximization. A normative analysis of the conflicting norms of efficiency and equality of results is called for. The final part of the paper is devoted to the problem of rigidity. Henry J. Aaron has argued that the Oregon system is insensitive to inter-individual variations within each diagnosis-treatment pair. This objection is a severe one, since the system might end up treating patients unfairly on the individual level. To overcome this problem, we suggest a selection rule that should be more capable of dealing with the problem of rigidity. (shrink)
