Almost 160 years after the American Civil War, where the Union defeated the Confederacy and ended slavery in the United States, approximately 1,910 tributes remain to Confederate military leaders located on public property in the 11 original Confederate states, particularly in cities with an exceptionally high density of Black residents. To Blacks, this iconography delivers a clear message of White supremacy. Six states have enacted laws to protect and preserve these memorials, making it almost impossible to use the court system (...) to move them to private property. This paper explores connections between support for a myth called the Lost Cause, which is a revisionist history intended to spread misinformation about the true cause of the American Civil War, and attitudes toward placement of Confederate symbols on public land. We show that there is significant belief in the Lost-Cause myth among many White U.S. Southerners. Furthermore, we find those who believe most in the myth are the least likely to want to move the monuments or end taxpayer support for their maintenance. (shrink)

Despite much research on the relationship between awareness and dementia little can be concluded concerning their relationship and the role of other factors. It is likely that studies capture different phenomena of awareness. This study aimed at identifying and delineating such variation by analysing data from three questionnaires obtained during the longitudinal study of awareness in 101 people with early-stage dementia. The data concerned awareness in relation to memory, activities of daily living and socio-emotional function. Significant differences in patterns of (...) discrepancies were obtained. This suggests that the awareness phenomena involved were structurally different; and that, in turn, this may reflect variation in the intrinsic linking between awareness and its ‘object’ . The identification of such differences is necessary so that appropriate methodologies can be applied to the study of awareness in different contexts. (shrink)

Although Rawls insists that his argument for his theory of justice neither addresses nor requires that we settle in advance any of the deep questions of philosophy, there are nonetheless more subtle ways in which his work may bear on such questions. The article explores how Rawls’s work may advance our thinking on the general philosophical question of how language affects thought, by enabling us to assess the conceptual consequences of two alternative metaphors for describing our activity when we engage (...) in critical self-reflection. The effects on our thinking of our common use of the metaphor of ‘stepping back’ to describe this activity are contrasted with those of an alternative metaphor suggested by Rawls’s work. The resulting conclusions are then employed to illuminate Rawls’s reply to an interesting objection to his theory raised by Michael Sandel. (shrink)

One threat against moral realism comes from evolutionary theory, which suggests that our moral beliefs are unconnected to any facts that would make them true. Contemporary realist theories of value claim to be compatible with natural science. In this paper, I call this claim into question by arguing that Darwinian considerations pose a dilemma for these theories. The main thrust of my argument is this. Evolutionary forces have played a tremendous role in shaping the content of human evaluative attitudes. The challenge for realist theories of value is to explain the relation between these evolutionary influences on our evaluative attitudes, on the one hand, and the (...) independent evaluative truths that realism posits, on the other. Realism, I argue, can give no satisfactory account of this relation. On the one hand, the realist may claim that there is no relation between evolutionary influences on our evaluative attitudes and independent evaluative truths. But this claim leads to the implausible skeptical result that most of our evaluative judgements are off track due to the distorting pressure of Darwinian forces. The realist’s other option is to claim that there is a relation between evolutionary influences and independent evaluative truths, namely that natural selection favored ancestors who were able to grasp those truths. But this account, I argue, is unacceptable on scientific grounds. Either way, then, realist theories of value prove unable to accommodate the fact that Darwinian forces have deeply influenced the content of human values. After responding to three objections, the third of which leads me to argue against a realist understanding of the disvalue of pain, I conclude by sketching how antirealism is able to sidestep the dilemma I have presented. Antirealist theories of value are able to offer an alternative account of the relation between evolutionary forces and evaluative facts —
an account that allows us to reconcile our understanding of evaluative truth with our understanding of the many non-rational causes that have played a role in shaping our evaluative judgements. (shrink)

Eros and Illness explores the place of desire in illness. We urgently need such an exploration because illness is no longer simply a natural feature of the human condition. Most people fall ill, but illness now falls under the supervision of biomedicine, a science-based, state-regulated system dominated by the new molecular gaze. The use of a person's distinctive genetic data to guide treatment and to forestall disease--called "personalized medicine"-- reflects how the molecular gaze can produce valuable advances in biomedical healthcare. Erik Wielenberg recently invoked the parent-child analogy in an argument against Christian theism. The argument relies on the claim that a loving parent would never allow her child to feel abandoned in the midst of what feels like gratuitous suffering. In this paper, I offer three clear counterexamples to Wielenberg’s central premise. At the same time, a successful counterexample does not a robust theology of suffering make. To that end, and with a careful eye towards anti-theodical concerns, I defend the (...) need for a more proactive Christian philosophical examination of the role of suffering in a meaningful life. Although the concept of HAPPINESS plays a central role in ethics, contemporary philosophers have generally given little attention to providing a robust account of what this concept entails. In a recent paper, Dan Haybron sets out to accomplish two main tasks: the first is to underscore the importance of conducting philosophical inquiry into the concept of HAPPINESS; the second is to defend a particular account of happiness—which he calls the ‘emotional state conception of happiness’—while pointing out weaknesses in the primary (...) competing accounts of happiness, including the hedonistic account. I argue against his claim that the emotional state conception of happiness is superior to the hedonistic conception of happiness. In the course of defending the hedonistic account of happiness against Haybron's attacks, I provide my own explanation for why the study of happiness is important to ethics. (shrink)

This book takes an interdisciplinary, transnational and cross-cultural approach to reflect on, critically examine, and challenge the surprisingly robust practice of making art after death in an artist's name, through the lenses of scholars from the fields of art history, economics and law, as well as practicing artists. Works of art conceived as multiples, such as sculptures, etchings, prints, photographs and conceptual art, can be - and often are - remade from original models and plans long after the artist has (...) passed. Recent sales have suggested a growing market embrace of posthumous works, contemporaneous with questioning on the part of art history. Legal norms seem unready for this surge in posthumous production and are beset by conflict across jurisdictions. Non-Western approaches to posthumous art, from Chinese emulations of non-living artists to Native American performances, take into account rituals of generational passage and emotional aspects foreign to Western ideas. The case for an eco-emancipatory politics to release the Earth from human domination and free us all from lives that are both exploitative and exploited Human domination of nature shapes every aspect of our lives today, even as it remains virtually invisible to us. Because human beings are a part of nature, the human domination of nature circles back to confine and exploit people as well—and not only the poor and marginalized but also the privileged and affluent, even in the (...) world’s most prosperous societies. Although modern democracy establishes constraints intended to protect people from domination as the arbitrary exercise of power, it offers few such protections for nonhuman parts of nature. The result is that, wherever we fall in human hierarchies, we inevitably find ourselves both complicit in and entrapped by a system that makes sustainable living all but impossible. It confines and exploits not only nature but people too, albeit in different ways. In Eco-Emancipation, Sharon Krause argues that we can find our way to a better, freer life by constraining the use of human power in relation to nature and promoting nature’s well-being alongside our own, thereby releasing the Earth from human domination and freeing us from a way of life that is both exploitative and exploited, complicit and entrapped. Eco-emancipation calls for new, more-than-human political communities that incorporate nonhuman parts of nature through institutions of representation and regimes of rights, combining these new institutional arrangements with political activism, a public ethos of respect for nature, and a culture of eco-responsibility. In Science as Social Knowledge, Helen Longino offers a contextual analysis of evidential relevance. She claims that this "contextual empiricism" reconciles the objectivity of science with the claim that science is socially constructed. I argue that while her account does offer key insights into the role that values play in science, her claim that science is nonetheless objective is problematic.

Most agree that when it comes to so-called 'first-order' normative ethics and political philosophy, constructivist views are a powerful family of positions. When it comes to metaethics, however, there is serious disagreement about what, if anything, constructivism has to contribute. In this paper I argue that constructivist views in ethics include not just a family of substantive normative positions, but also a distinct and highly attractive metaethical view. I argue that the widely accepted 'proceduralist characterization' of constructivism in ethics is (...) inadequate, and I propose what I call the 'practical standpoint characterization' in its place. I then offer a general taxonomy of constructivist positions in ethics. Since constructivism's standing as a family of substantive normative positions is relatively uncontested, I devote the remainder of the paper to addressing skeptics' worries about the distinctiveness of constructivism understood as a metaethical view. I compare and contrast constructivism with three other standard metaethical positions with which it is often confused or mistakenly thought to be compatible: realism; naturalist reductions in terms of an ideal response; and expressivism. In discussing the contrast with expressivism, I explain the sense in which, according to the constructivist, the distinction between substantive normative ethics and metaethics breaks down. I conclude by distinguishing between two importantly different debates about the mind-dependence of value. I argue that a failure to make this distinction is part of what explains why the possibility of constructivism as a metaethical view is often overlooked. (shrink)

In many ways set theory lies at the heart of modern mathematics, and it does powerful work both philosophical and mathematical – as a foundation for the subject. However, certain philosophical problems raise serious doubts about our acceptance of the axioms of set theory. In a detailed and original reassessment of these axioms, Sharon Berry uses a potentialist approach to develop a unified determinate conception of set-theoretic truth that vindicates many of our intuitive expectations regarding set theory. Berry further (...) defends her approach against a number of possible objections, and she shows how a notion of logical possibility that is useful in formulating Potentialist set theory connects in important ways with philosophy of language, metametaphysics and philosophy of science. In this chapter, the author's unplanned venture into public philosophy began in the mid‐to‐late 1980s, just as Ronald Reagan was insisting that a certain famous wall be torn down. Various European thinkers and political philosophers in America, along with a few people working in the author's own tradition, like Robert Nozick and Peter Singer, had already begun to work in the nascent movement of “applied philosophy,” and in a public way. The author's early work in philosophy had been solidly within (...) the analytical tradition, with a special interest in religion, focused mainly on metaphysics and, secondarily, epistemological issues. Public philosophy can be rekindled in our time by any number of means and across a wide variety of topics. This chapter asks the reader to contrast justice with some of the other central virtues—for instance, prudence, courage, temperance, or wisdom. Justice is different. Unlike these others, it is principally a social virtue; its interpersonal element is central. Other virtues, such as generosity, as well as benevolence or charity, are also interpersonal. But unlike justice, acts of generosity or benevolence are not owed to specific people. One ought to help others, but the choice of when and where to act benevolently (...) is for the most part up to the individual. In modern terms their requirements are duties of imperfect obligation; those of justice are for the most part owed to specific individuals. The thesis that the norms of justice are not always preemptive reasons may appear much less plausible regarding certain central norms of justice, for instance, the principle prohibiting the intentional killing of nonthreatening innocent persons.
