Numerous studies have shown almost uniformly positive opinions among patients and physicians regarding theconceptof advance directives (either a healthcare proxy or living will). Several of these studies have also shown that the actual use of advance directives is significantly lower than this enthusiasm would suggest, but they have not explained the apparent discordance. Nor have researchers explained why members of minority groups are much less likely to complete advance directives than are white patients. In this study, we used a focus (...) group methodology to examine the ways in which diverse populations of patients view the medical, philosophical, and practical issues surrounding advance directives. We were motivated by the significantly lower prevalence of advance directives among African-American and Hispanic patients at one urban teaching hospital (18% for Caucasians, 4% for African-Americans, and 2% for Hispanics). Our premise was that African-American and Hispanic populations, who have had higher rates of morbidity and mortality across numerous disease categories, and historically have had limited access to care and opportunities to discuss health concerns, may be more suspicious about the right of autonomy that an advance directive is designed to ensure. We may begin to grasp the importance of exploring the relations between literary studies and the sciences by reflecting on some of the implications of a recent scholarly publication in literary theory. The example that I have in mind is an article by Ruth Salvaggio, entitled "Shakespeare in the Wilderness; or Deconstruction ithe Classroom," which was included in an anthology called Demarcating the Disciplines. In her article Salvaggio reproduces and comments on a paper written by Andrew Scott Jennings, a (...) second-year student in an American university who was enrolled in her survey course on British literature. The paper, she convincingly argues, ably embodies five major features of deconstructive criticism. Although she admits to having taught deconstruction ithe course, she claims that she did not encourage the members of the class to write deconstructive papers, and thus was quite surprised when she received a student essay that boldly reduced Shakespeare's sonnet 104 to the formula: "i + i + i = + 0," concluding that interpreting the poem is a "silly game." Salvaggio comments: "Iwasn't quite prepared. But I am now moving toward acceptance, maybe even welcome. And I am changing many of my assumptions". In his introduction to the volume, Samuel Weber would seem to approve of Salvaggio's willingness to let the sophomore's essay demolish her previous assumptions about the goals and meaning of literary criticism. According to Weber, his volume "assembles protocols of an alteration at work in what is perhaps the beginning of an institution turning itself inside out". It would seem that Salvaggio's account of what Weber refers to as "the confrontationf a college teacher of literature with a strange and remarkable undergraduate paper" deserves to be printed along with one of Derrida's readings of Hegel because both texts contribute to the deconstructive enterprise by exploring the relations between the reading and writing of texts and the operations of the institution. This chapter argues that there is a particular kind of ‘internal’ commitment typically made in the context of romantic love relationships that has striking meta-normative implications for how we understand the role of the will in practical normativity. Internal commitments cannot plausibly explain the reasons we have in committed relationships on the usual model—as triggering reasons that are already there, in the way that making a promise triggers a reason via a pre-existing norm of the form ‘If you make a (...) promise to x, then you have a reason to x’. Instead, internal commitments are that in virtue of which one has the special reasons of committed relationships; they are the grounds of such reasons. Despite the considerable body of scholarship and practice on interconnected systems of dominance and its effects on women in different social locations, Chicanas remain “outside the frame” of mainstream academic feminist dialogues. This article provides an overview of the contributions of Chicana intersectional thought, research, and activism. We highlight four major scholarly areas of contribution: borders, identities, institutional inequalities, and praxis. Although not a full mapping of the Chicana/latina presence in intersectionality, it proffers the distinctive features and themes defining the (...) intersectional terrain of Chicana feminism. On 26 February 2020, the German Constitutional Court rejected a law from 2015 that prohibited any form of ‘business-like’ assisted suicide as unconstitutional. The landmark ruling of the highest federal court emphasised the high priority given to the rights of autonomy and free personal development, both of which constitute the principle of human dignity, the first principle of the German constitution. The ruling echoes particularities of post-war Germany’s end-of-life debate focusing on patient self-determination while rejecting any discussion of active assistance (...) to die through a lethal injection administered by a doctor. This brief report discusses the ruling in the light of the broader sociopolitical and historical context of the German end-of-life debate. (shrink)

In this paper we challenge the idea that valid consent is the golden standard by which a sexual encounter is deemed ethical. We begin by reviewing the recent public focus on consent as an ethical standard, and then argue for a standard that goes beyond legalistic and contractual foci. This is the standard of mutuality which extends beyond the assurance that all parties engaging in a sexual encounter are informed, autonomous, and otherwise capable of making a valid choice: one must (...) also encounter the other with care and loving attention. We develop this claim using Iris Murdoch’s concept of an attitude of “loving attention,” which differentiates our view from the duty of due diligence to ensure that each person is a willing participant in sex, that the rights of others have not been violated, as emphasized by Dougherty. We also address three objections to using mutuality as a measure of ethical sex, namely that it is patronizing, that it is a maximalist position that puts too great a burden on individuals and inhibits their freedom, and that it is an ideal rather than a requirement. We then look at three examples that test the construct of mutuality: the typical college hook-up, sex work, and anonymous sex through glory holes and similar set-ups. (shrink)

This paper aims to reconstruct Francis Hutcheson's thinking about liberty. Since he does not offer a detailed treatment of philosophical questions concerning liberty in his mature philosophical writings I turn to a textbook on metaphysics. We can assume that he prepared the textbook during the 1720s in Dublin. This textbook deserves more attention. First, it sheds light on Hutcheson's role as a teacher in Ireland and Scotland. Second, Hutcheson's contributions to metaphysical disputes are more original than sometimes assumed. To appreciate (...) his independent thinking, I argue, it is helpful to take the intellectual debates in Ireland into consideration, including William King's defence of free will and discussions of Shaftesbury's views in Robert Molesworth's intellectual circle. Rather than taking a stance on the philosophical disputes about liberty, I argue that Hutcheson aims to shift the focus of the debates towards practical questions concerning control of desire, cultivation of habits, and character development. What kind of affective phenomenon is religious zeal and how does it relate to other affective phenomena, such as moral anger, hatred, and love? In this paper, I argue that religious zeal can be both, and be presented and interpreted as both, a love-like passion and an anger-like emotion. As a passion, religious zeal consists of the loving devotion to a transcendent religious object or idea such as God. It is a relatively enduring attachment that is constitutive of who the (...) zealot is, and it expresses itself in a distinctive set of mental and behavioral dispositions. Most importantly, it motivates uncompromising actions and involves intense, hot, and deep emotions. As an anger-like emotion, religious zeal is an occurrent affective state of mind that is intentionally directed towards a specific object, characteristically a person or group of persons. It condemns the violation of a religious norm that is taken to be of absolute validity and general applicability. It motivates an action aiming at vengeance and retaliation, and it involves intense and hot feelings of hostility towards its object. I argue that rather than reducing the complex phenomenon of religious zeal to one of these two manifestations, we should reflect upon the question of how the two distinct conceptualizations relate to each other. Charles Taylor is one of the most influential and prolific philosophers in the English-speaking world today. The breadth of his writings is unique, ranging from reflections on artificial intelligence to analyses of contemporary multicultural societies. This thought-provoking introduction to Taylor's work outlines his ideas in a coherent and accessible way without reducing their richness and depth. His contribution to many of the enduring debates within Western philosophy is examined and the arguments of his critics assessed. Taylor's reflections on the topics (...) of moral theory, selfhood, political theory and epistemology form the core chapters within the book. Ruth Abbey engages with the secondary literature on Taylor's work and suggests that some criticisms by contemporaries have been based on misinterpretations and suggests ways in which a better understanding of Taylor's work leads to different criticisms of it. Processing the various features from different feature maps and modalities in coherent ways requires a dedicated integration mechanism . Many authors have related feature binding to conscious awareness but little is known about how tight this relationship really is. We presented subjects with asynchronous audiovisual stimuli and tested whether the two features were integrated. The results show that binding took place up to 350 ms feature-onset asynchronies, suggesting that integration covers a relatively wide temporal window. We also asked subjects to (...) explicitly judge whether the two features would belong to the same or to the different events. Unsurprisingly, synchrony judgments decreased with increasing asynchrony. Most importantly, feature binding was entirely unaffected by conscious experience: features were bound whether they were experienced as occurring together or as belonging to a separate events, suggesting that the conscious experience of unity is not a prerequisite for, or a direct consequence of binding. Communication is an integral part of nursing practice—with patients and their relatives, other nurses and members of the healthcare team, and ancillary staff. Through interaction with the ‘other’, language and silence creates and recreates social realities. Acceptance, rejection or modification of social realities depends on what is expressed and by whom. Narratives that are offered can tell of some experiences and not others. Some nurses choose to be silent while others are silenced. In nursing situations recognising and allowing silence to (...) speak is a challenging but uniquely personal experience that embraces reflection in and on experiences, practice and self as a person and a professional. If enabled and truly heard, silence can speak more loudly than the hubbub of daily practice, allowing us to collectively question and challenge inherent assumptions and biases as professionals, and as a profession. Through a microcosm of Newly Graduated Nurses' lived experiences of nursing situations and expressions of silence individuals' discomfort and private efforts to ascribe meaning to experiences are reflected on. Returning to silence is to return to a constant process of professional transformation that can enable ways of knowing and being that can reform our profession from within and enable us to cast off shackles that bind us to a shameful cultural underbelly. In February 2020, the British Medical Association will be surveying members for their views on what the BMA’s position on physician-assisted dying should be. The BMA is currently opposed to physician-assisted dying in all its forms, a position that was agreed in 2006 at the annual representative meeting, the Association’s policy-making conference.1 As previously reported in Ethics briefing,2 the decision to survey members follows a motion passed at last year’s ARM which called on the BMA to “carry out a poll (...) of members to ascertain their views on whether the BMA should adopt a neutral position with respect to a change in the law on assisted dying”. The results from the survey will not determine BMA policy. Rather, the results be published ahead of this year’s ARM and provided to those attending to inform a debate and discussion on the BMA’s policy position. In _Feminist Interpretations of John Rawls_, Ruth Abbey collects eight essays responding to the work of John Rawls from a feminist perspective. An impressive introduction by the editor provides a chronological overview of English-language feminist engagements with Rawls from his Theory of Justice onwards. She surveys the range of issues canvassed by feminist readers of Rawls, as well as critics’ wide disagreement about the value of Rawls’s corpus for feminist purposes. The eight essays that follow testify to the continuing (...) ambivalence among feminist readers of Rawls. From the perspectives of political theory and moral, social, and political philosophy, the essayists address particular aspects of Rawls’s work and apply it to a variety of worldly practices relating to gender inequality and the family, to the construction of disability, to justice in everyday relationships, and to human rights on an international level. Several debates of the last years within the research field of contemporary realism – known under titles such as "New Realism," "Continental Realism," or "Speculative Materialism" – have shown that science is not systematically the ultimate measure of truth and reality. This does not mean that we should abandon the notions of truth or objectivity all together, as has been posited repeatedly within certain currents of twentieth century philosophy. However, within the research field of contemporary realism, the concept of objectivity (...) itself has not been adequately refined. What is objective is supposed to be true outside a subject’s biases, interpretations and opinions, having truth conditions that are met by the way the world is. The volume combines articles of internationally outstanding authors who have published on either Idealism, Epistemic Relativism, or Realism and often locate themselves within one of these divergent schools of thought. As such, the volume focuses on these traditions with the aim of clarifying what the concept objectivity nowadays stands for within contemporary ontology and epistemology beyond the analytic-continental divide. Beginning with the prevalent idea that creativity is the ability to make or do things having valuable novelty, the paper explores a variety of axiological and novelty conditions and defends an instrumental success condition. I discuss Robert K. Merton's distinction between 'originality' and 'priority', and Margaret Boden's similar distinction between historical and psychological creativity, as well as Thomas Reid's and Bruce Vermazen's remarks on relations between novelty and value.

In this chapter, I discuss Locke’s contributions to moral psychology. I begin by examining how we acquire moral ideas, according to Locke. Next, I ask what explains why we act morally. I address this question by showing how Locke reconciles hedonist views concerning moral motivation with his commitment to divine law theory. Then I turn to Shaftesbury’s criticism that Locke’s moral view is a self-interested moral theory that undermines virtue. The emergence of urban tech economies calls attention to the multidimensional spatiality of ecosystems made up of people and organizations that produce new digital technology. Since the economic crisis of 2008, city governments have aggressively pursued economic growth by nurturing these ecosystems. Elected officials create public-private-nonprofit partnerships to build an “innovation complex” of discursive, organizational, and geographical spaces; they aim not only to jump-start economic growth but to remake the city for a new modernity. But it is difficult to insert (...) tech production space into the complicated urban matrix. Embedded industries and social communities want protection from expanding tech companies and the real estate developers who build for them. City council members, state legislators, and community organizations oppose the city government’s attempts to satisfy Big Tech companies. While the city’s density magnifies conflicts of interest over land-use and labor issues, the covid-19 pandemic raises serious questions about the city’s ability to both oppose Big Tech and keep creating tech jobs. According to what is now the standard account in the history of psychology, in the 1880s William James and the Danish physician Carl Georg Lange independently developed a strikingly new theory, commonly referred to as the ‘James–Lange’ theory of emotion. In this paper it is argued that this standard account is highly misleading. Lange's views on affect in his Om Sindsbevægelser were more cautious than James allowed, and not open to criticisms that have often been levelled against the theory of (...) emotion that James claimed he shared with Lange. In fact, Lange argued for distinctions that James did not mention in his discussion of Lange's work. Even with regard to the primary emotions, the two thinkers’ explanatory models diverged significantly. The contrast between James and Lange on affect is especially striking in their respective discussions of topics in aesthetics, as is established with reference to Lange's little-known Bidrag til Nydelsernes fysiologi som grundlag for en rationel æstetik. The recognition and incorporation of evidence-based neuroscientific concepts into creative arts therapeutic knowledge and practice seem valuable and advantageous for the purpose of integration and professional development. Moreover, exhilarating insights from the field of neuroscience coincide with the nature, conceptualization, goals, and methods of Creative Arts Therapies, enabling comprehensive understandings of the clinical landscape, from a translational perspective. This paper contextualizes and discusses dynamic brain functions that have been suggested to lie at the heart of intra- and inter-personal processes. Touching (...) upon fundamental aspects of the self and self-other interaction, the state-of-the-art neuroscientific-informed views will shed light on mechanisms of the embodied, predictive and relational brain. The conceptual analysis introduces and interweaves the following contemporary perspectives of brain function: firstly, the grounding of mental activity in the lived, bodily experience will be delineated; secondly, the enactive account of internal models, or generative predictive representations, shaped by experience, will be defined and extensively deliberated; and thirdly, the interpersonal simulation and synchronization mechanisms that support empathy and mentalization will be thoroughly considered. Throughout the paper, the cross-talks between the brain and the body, within the brain through functionally connected neural networks and in the context of agent-environment dynamics, will be addressed. These communicative patterns will be elaborated on to unfold psychophysiological linkage, as well as psychopathological shifts, concluding with the neuroplastic change associated with the formulation of CATs. The manuscript suggests an integrative view of the brain-body-mind in contexts relevant to the therapeutic potential of the expressive creative arts and the main avenues by which neuroscience may ground, enlighten and enrich the clinical psychotherapeutic practice. Núñez and colleagues (2019) question whether cognitive science still exists “as a coherent academic field with a well‐defined and cohesive interdisciplinary research program.” This worry may be premature on two grounds. First, we are not convinced that the Lakatosian criterion of coalescence around a core framework is the best standard for judging whether a field is well‐defined and productive. Second, although we acknowledge that cognitive science is not as visible as we would like, we doubt that this low profile accurately (...) reflects the state of actual research and teaching programs based on the cognitive science approach. We argue that the central goal of critical thinking is the making of reasoned judgments. Arriving at reasoned judgments in most cases is a dialectical process involving the comparative weighing of a variety of contending positions and arguments. Recognizing this dialectical dimension means that critical thinking pedagogy should focus on the kind of comparative evaluation which we make in actual contexts of disagreement and debate.

In his little-known essay published posthumously in 1849, Über die Eintheilung der schönen Künste, Bernard Bolzano proposes an explication of the concept of beautiful art as well as a classification of these arts. Bolzano’s divisions allowed him not only to provide a principled and comprehensive classification of actual, well-established arts, but also to anticipate kinds of beautiful art that would not exist or be widely recognized until decades after his death, such as moving pictures, abstract paintings, and what he called (...) ‘the arts of pure thought’. In the burgeoning literature on thought experiments (e.g., Cohen 2005; Freese 1995; Gendler 2000; Häggqvist 1996, 2009; Ierodiakonou and Roux 2011; Sorensen 1992), examples are drawn from almost all areas of philosophy. One exception, however, is aesthetics. There are good reasons why this is so: there are very few interesting theory‐ oriented thought experiments in aesthetics, which is unsurprising since there are few well‐developed theories to test in this field (see Chapter 34, Applied Aesthetics). We argue in this chapter, however, (...) that theory‐centered thought experiments are not the only kinds of thought experiments, and that the practical and productive thought experiments that are prevalent in aesthetics are also worthy of some attention. The outline of this chapter is as follows. First we describe in some detail the single most influential theoretical thought experiment in aesthetics. We assess this experiment in epistemic terms, and with this case in view discuss the distinction between theoretical and practical or productive thought experiments. Examples of the latter are introduced so as to illustrate the importance of that distinction. (shrink)

On e recent change in the Society of Professional journalists Code of Ethics emphasizes that journalists should consider minimizing harm to society. This emphnsis follows more than a decade of thinking by educators who have called for teaching journalism students moral philosophy and moral reasoning decision making models-models that generally examine potential harm that surrounds newsroom decisions. This study, a quasi-experiment, examines pretest and posttest results of 210 students in 9 sections of n mass media ethics class taught over 6 (...) different semesters. After taking the course, which emphasized moral reasoning, students were more likely to make decisions that minimized harm, while gaining certainty in their answers. Diflerences between news-editorial and public relntions students are noted. Essays written by the students support the finding that education in moral reasoning can be effective in the development ofstudent journalists and their sense ofresponsibility to society. (shrink)

Women’s health activists laid the groundwork for passage of the law that created the U.S. Food and Drug Administration in 1906. The pharmaceutical and food industries fought regulatory reforms then and continue to do so now. We examine public health activism in the Progressive Era, the postwar era and the present day. The women’s health movement began in the 1960s, and criticized both the pharmaceutical industry and the medical establishment. In the 1990s, patient advocacy groups began accepting industry funds; thousands (...) of commercially-funded groups now dominate the advocacy landscape. As pharma funding became normalized, concerns arose regarding a) the lack of transparency and public accountability regarding funding, b) the distortion of groups’ agendas, and c) the ability of pharma-funded groups to dominate the discourse and override less well-resourced patient and health advocacy groups. Although industry-funded groups argue that funding allows them to provide useful services, the trade-off in health risks, exorbitant prices and distorted information is far too high. Sincerity is beside the point; patients and the industry have differing interests when it comes to drug safety and efficacy, drug information and drug prices. A growing resistance movement is asserting the values of its activist predecessors and opposing the prevailing culture of pharma-funded advocacy. (shrink)

The concepts of Utility and Universality form an answer to the utilitarian topology of Utility and the General Good. Starting from the realization that utility cannot be determined materially, but only formally, the very premise of utilitarian philosophy has to be abandoned. The greatest good is not the good of the greatest number, but the universal good.
