This book aims to develop the tradition of philosophical hermeneutics, the theoretical account of interpretive (as opposed to explanatory) understanding--the account of meanings and contexts rather than causes and predictions--usually restricted to the domain of literary and textual analysis, in new directions by exploiting its potential as an instrument of critique. It refutes commonly held claims that hermeneutic analyses are necessarily relativistic, Eurocentric, or critically impotent and demonstrates how hermeneutic procedures can inform analyses of urgent current and cross-cultural issues such (...) as the biology of race, female genital excision, and the so-called "culture of poverty" thesis. Lorenzo Simpson demonstrates that a robust methodology of philosophical hermeneutics is well positioned to intervene in critical political and social issues in global ethics and justice in concert with critical theory's emancipatory aims. The Self and its Disorders develops a philosophical and interdisciplinary approach to the formulation of an “integrative” perspective in psychiatry. In contrast to some integrative approaches that focus on narrow brain-based conceptions, or strictly on symptomology, this book takes its bearings from embodied and enactive conceptions of human experience and builds on a perspective that understands self as a self-pattern—a pattern of processes that include bodily, experiential, affective, cognitive-psychological, reflective, narrative, intersubjective, ecological, and normative factors. It provides a philosophical analysis (...) of the notion of self-pattern, framed in terms of dynamical organization. It then draws on phenomenological, developmental, clinical, and experimental evidence to propose a method for studying the effects of psychopathologies on the self-pattern, and includes discussions of network theory, predictive processing models, and the role of narrative. This book explores the hypothesis that psychiatric disorders are self-disorders, and includes specific discussions of schizophrenia, anxiety disorders, depression, borderline personality disorder, obsessive compulsive disorder and autism spectrum disorder, as well as traumatic effects of torture and solitary confinement. Other topics include diagnostic classification, symptom overlap, and transdiagnostic complexity. This new introduction by Shaun Gallagher gives students and philosophers not only an excellent concise overview of the state of the field and contemporary debates, but a novel way of addressing the subject by looking at the ways in which phenomenology is useful to the disciplines it applies to. Gallagher retrieves the central insights made by the classic phenomenological philosophers (Husserl, Heidegger, Merleau-Ponty, Sartre, and others), updates some of these insights in innovative ways, and shows how they directly relate (...) to ongoing debates in philosophy and psychology. Although linguistic nativism has received the bulk of attention in contemporary innateness debates, moral nativism has perhaps an even deeper ancestry. If linguistic nativism is Cartesian, moral nativism is Platonic. Moral nativism has taken a backseat to linguistic nativism in contemporary discussions largely because Chomsky made a case for linguistic nativism characterized by unprecedented rigor. Hence it is not surprising that recent attempts to revive the thesis that we have innate moral knowledge have drawn on Chomsky’s framework. I’ll argue, however, (...) that the recent attempts to use Chomsky-style arguments in support of innate moral knowledge are uniformly unconvincing. The central argument in the Chomskian arsenal, of course, is the Poverty of the Stimulus (POS) argument. In section 1, I will set out the basic form of the POS argument and the conclusions about domain specificity and innate propositional knowledge that are supposed to follow. In section 2, I’ll distinguish 3 hypotheses about innateness and morality: rule nativism, moral principle nativism, and moral judgment nativism. In sections 3-5 I’ll then consider each of these hypotheses in turn. I’ll argue that while there is some reason to favor rule nativism, the arguments that moral principles and moral judgment derive from innate moral knowledge don’t work. The capacity for moral judgment is better explained by appeal to innate affective systems rather than innate moral knowledge. In the final section, I’ll suggest that the role of such affective mechanisms in structuring the mind complicates the standard picture about poverty of the stimulus arguments and nativism. For the affective mechanisms that influence cognitive structures can make contributions that are neither domain general nor domain specific. (shrink)

The Sentimental Life of International Law is about our age-old longing for a decent international society and the ways of seeing, being, and speaking that might help us achieve that aim. This book asks how international lawyers might engage in a professional practice that has become, to adapt a title of Janet Malcolm's, both difficult and impossible. It suggests that international lawyers are disabled by the governing idioms of international lawyering, and proposes that they may be re-enabled by speaking different (...) sorts of international law, or by speaking international law in different sorts of ways. In this methodologically diverse and unusually personal account, Gerry Simpson brings to the surface international law's hidden literary prose and offers a critical and redemptive account of the field. He does so in a series of chapters on international law's bathetic underpinnings, its friendly relations, the neurotic foundations of its underlying social order, its screened-off comic dispositions, its anti-method, and the life-worlds of its practitioners. Finally, the book closes with a chapter in which international law is re-envisioned through the practice of gardening. This chapter addresses two questions. First, can phenomenology be naturalized? Second, if so, how? It employs the term ‘phenomenology’, and understands the question in this second sense. At the same time, responses to the question about naturalising consciousness and the question about naturalising phenomenology, in this second sense, are interlaced. Edmund Husserl has been careful about how he defined phenomenology, distinguishing it from a naturalistic enterprise. The Centre de Recherche en Epistémologie Appliquée proposal shows that a sufficiently complex mathematics can (...) help the translation of data from phenomenological and naturalistic realms. Neuroscientists often attract to personal-level practices and phenomenological experiences in establishing their experiments, and in many cases the only way to define the explanadum is in terms of phenomenology. The ‘truth’ of naturalism is not the naturalism which Husserl cautioned against, but a redefined non-reductionist naturalism that correlates with a redefined phenomenology. (shrink)

The basis of property rights is a central problem in political philosophy. The core philosophical dispute concerns whether property rights are natural facts, independent of human conventions. In this article, we examine adult judgments on this issue. We find evidence that familiar property norms regarding external objects (e.g., fish and strawberries) are treated as conventional on standard measures of authority dependence and context relativism. Previous work on the moral/conventional distinction indicates that people treat property rights as moral rather than conventional (...) (e.g., Dahl & Waltzer, 2020; Nucci & Turiel, 1993; Tisak & Turiel, 1984). However, these studies explicitly assume that one person owns property that another steals. Study 1 explores judgments of authority dependence regarding ownership in cases that explicitly appeal to stealing and prior ownership as compared to cases that omit such explicit appeals. We find that participants tend to treat ownership as authority dependent when explicit appeals to stealing are absent, but not when the explicit appeals are present. Study 2 examines intuitions about authority dependence of ownership violations as compared to canonical conventional and harm-based moral violations. We find that ownership violations are treated as more authority dependent than harm-based moral violations. This all suggests that some central property norms are treated as conventional. However, we also find that the conventionality of property norms is restricted in several ways. In study 3, we find that people do not treat norms of self-ownership as conventional. Other people cannot take your hair or skin cells even if the teacher says it's okay. Study 4 uses a measure of context relativism to examine the conventionality of ownership norms, comparing different possible norms of ownership. We find that participants regard takings that are violations in their own culture as permissible in other cultures; however, only some foreign norms are deemed acceptable. In study 5 we find another limitation – participants think it's impermissible to take resources from someone based on a new property norm that is retrospectively imposed. Finally, in study 6 we explore whether some takings might be judged to be morally (non-conventionally) wrong as a function of scarcity. We find that when asked about another culture that allows taking, participants tend to say that taking a food item from the person who caught it is permissible when the food is plentiful, but not when the food is scarce. Miller analyzes the relationship between consent and autonomy by offering three pictures. For autonomy, Miller distinguishes between procedural, substantive, and weak substantive autonomy. The corresponding views of consent are what Miller has termed as consensual minimalism, consensual idealism, and consensual realism. The requirements of sexual consent under consensual minimalism are a voluntary informed agreement. However, feminist critiques reveal the inadequacies of this simple position. Consensual idealism, which corresponds with substantive autonomy, offers a robust picture where consent and autonomy must be (...) based on non-oppression. However, this view is considered too ideal and it ignores context. Weak substantive autonomy takes into account the context in the sexual domain. Correspondingly, consensual realism takes into account the context and still fulfills the requirements of consent. (shrink)

Few debates in environmental philosophy have been more heated than the one over the nature of wilderness. And yet, when one surveys the present scene, one finds that a variety of different conceptions of wilderness are still quite popular – some more so in certain professions than others. In this paper, I look at three popular conceptions of wilderness with an eye toward sussing out the good and the bad them. I look at what I call (1) the folk view (...) of wilderness, (2) Leopold’s conception of wilderness, and (3) the legal conception of wilderness (as found in the Wilderness Act of 1964). In the final part of the paper, I sketch out a sort of spectrum account of wilderness, one that I argue allows us to capture more cases of wilderness and might serve as a useful tool in future conservation efforts. Environmental philosophy uncovers the ethical relationships existing between humans and the living and non-living world. It reveals the nuances of our scientific ecological concepts. Williams (1970) argues that our intuitions about personal identity vary depending on how a given thought experiment is framed. Some frames lead us to think that persistence of self requires persistence of one's psychological characteristics; other frames lead us to think that the self persists even after the loss of one's distinctive psychological characteristics. The current paper takes an empirical approach to these issues. We find that framing does affect whether or not people judge that persistence of psychological characteristics is (...) required for persistence of self. Open-ended, abstract questions about what is required for survival tend to elicit responses that appeal to the importance of psychological characteristics. This emphasis on psychological characteristics is largely preserved even when participants are exposed to a concrete case that yields conflicting intuitions over whether memory must be preserved in order for a person to persist. Insofar as our philosophical theory of personal identity should be based on our intuitions, the results provide some support for the view that psychological characteristics really are critical for persistence of self. This paper presents an account of the ethical and conceptual relationship between free speech and press freedom. Many authors have argued that, despite there being some common ground between them, these two liberties should be treated as properly distinct, both theoretically and practically. The core of the argument, for this “unbundling” approach, is that conflating free speech and press freedom makes it too easy for reasonable democratic regulations on press freedom to be portrayed, by their opponents, as part of a (...) programme of illiberal censorship. While we acknowledge the important grain of truth in that argument, we try to show how the alternative, “unbundling” approach can also be used to undermine or mischaracterise democratically justifiable opposition to media regulations in despotic regimes. In light of the problems on both sides, we defend a contextually-variable account of the relation between these two liberties. (shrink)

This chapter develops a social epistemological analysis of Web‐based search engines, addressing the following questions. First, what epistemic functions do search engines perform? Second, what dimensions of assessment are appropriate for the epistemic evaluation of search engines? Third, how well do current search engines perform on these? The chapter explains why they fulfil the role of a surrogate expert, and proposes three ways of assessing their utility as an epistemic tool—timeliness, authority prioritisation, and objectivity. “Personalisation” is a current trend in (...) Internet‐delivered services, and consists in tailoring online content to the interests of the individual user. It is argued here that personalisation threatens the objectivity of search results. Objectivity is a public good; so there is a prima facie case for government regulation of search engines. (shrink)

This paper, in opposition to the standard theories of social cognition found in psychology and cognitive science, defends the idea that direct perception plays an important role in social cognition. The two dominant theories, theory theory and simulation theory , both posit something more than a perceptual element as necessary for our ability to understand others, i.e., to “mindread” or “mentalize.” In contrast, certain phenomenological approaches depend heavily on the concept of perception and the idea that we have a direct (...) perceptual grasp of the other person’s intentions, feelings, etc. This paper explains precisely what the notion of direct perception means, offers evidence from developmental studies, and proposes a non-simulationist interpretation of the neuroscience of mirror systems. How the concept of primary intersubjectivity gets re-incorporated, or indeed, re-cognized in Honneth’s conception of recognition, however, is a complex issue that Iexplore in this essay. It is linked to questions not only about child development, but also about whether one should understand recognition in terms of a summons, following Fichte, or in terms of a struggle, as Honneth, following Hegel, suggests, or (...) in terms of a gift, as Ricoeur, following Hénaff suggests. Despite the declarations of international documents on minority language rights, provision is patchy for supporting minority languages in the UK, where since the 1980s governments have deliberately or unwittingly greatly raised the profile and comparative standing of English. The partial exception to this trend has been the treatment of indigenous/regional minority languages, stimulated by policies of devolution intended to revive or create a sense of national identity, and to redress perceived historic linguistic injustices. In a multicultural state or region these (...) apparently reasonable goals appear to conflict with current views of citizenship that argue for inclusiveness and equal treatment for all under the law. In particular, the question arises why indigenous minority languages should receive official support and funding that is denied to speakers of minority ethnic languages. In this article, I examine various justifications offered for this, including higher population levels, the geographical concentration of indigenous speakers, the long historical ties between regional language and culture, and the notion of promotional rights. I attempt to show each argument lacks force and ignores the fact of natural language change. I argue for an approach to indigenous languages that weights support and funding according to a range of factors including the number of minority speakers, their perceived need and the benefits that would flow from funding. Support from the local community and private sources could also be encouraged. (shrink)

This chapter sketches the outlines of what a reasonable form of nativism might look like. The neuroconstructivists' challenge indicates that some misunderstanding continues to exist among certain self-titled nonnativists over what it is that practicing nativists actually claim, together with a mistaken belief that current neurodevelopmental data is not or cannot be compatible with the nativist program. Both these issues are addressed by first providing further explication of the claims of practicing nativists, and then showing how these claims provide the (...) basis for a reasonable nativism that is fully cognizant of and consistent with empirical data from all the developmental sciences, neuroconstructivism included. In Political Theology the "Modern Way": The Case of Jacques Almain (d. 1515), Shaun Retallick provides the first monograph on this late medieval philosopher-theologian and conciliarist, and his thought. He demonstrates that Almain's political theology, of which ecclesiology is a sub-discipline, is strongly impacted by the Via moderna. At the heart of his political theology is the individual and his or her will. Yet, the individual is rarely viewed in isolation from others; there is a strong emphasis on community (...) and on the religious and secular bodies through which it is realized. But these bodies, including the Church, are understood in collectivist rather than corporatist terms, which tends to a quite radical form of conciliarism. (shrink)

This article addresses questions about the sense of agency and its distinction from the sense of ownership in the context of understanding schizophrenic thought insertion. In contrast to “standard” approaches that identify problems with the sense of agency as central to thought insertion, two recent proposals argue that it is more correct to think that the problem concerns the subject’s sense of ownership. This view involves a “more demanding” concept of the sense of ownership that, I will argue, ultimately depends (...) on the sense of agency. In this regard, the sense of agency still appears to be the originating problem. (shrink)

Medieval interpretations of hylomorphism, in which substances are conceived as metaphysical composites of prime matter and substantial form, are receiving attention in contemporary philosophy. It has even been suggested that a recovery of Aquinas's conception of prime matter as a ‘pure potentiality’, lacking any actuality apart from substantial form, may be expedient in hylomorphic interpretations of quantum mechanics. In this paper, we consider a recent hylomorphic interpretation of non-relativistic quantum mechanics, the theory of Cosmic Hylomorphism, which does not explicitly invoke (...) any notion of prime matter in its original formulation. We argue that prime matter does in fact play a role in constituting and individuating particles in this theory. However, we demonstrate that the notion of prime matter which features in the extended version of Cosmic Hylomorphism that we propose here is distinct from Aquinas's conception of prime matter, inasmuch as it has discrete metaphysical parts. It provides insight into the colonial relationship between them. Emphasizing the colonial relationship between the Inners and the Belt gives us insight into why attempts to forge a peaceful alliance between Earth, Mars, and the Belt fail time and time again. If we understand the Belt's attack as transcending mere bloodthirst and demolishing the unquestioned (...) colonial system that denies their very humanity, the case for anti‐colonial violence becomes much more compelling. Marco's vision of the future, in which Earth and Mars keep to their planets and a self‐determining Belt can finally live free of persecution, is juxtaposed against Avasarala's vision of peace in Luna Station. Moral expressivists think that moral thoughts and sentences don’t represent or describe the world, at least not in any interesting sense. Global expressivists think that _no_ thoughts or sentences represent the world; local expressivists think that some do and others don’t. Huw Price has influentially argued that local expressivism collapses into global expressivism, due both to the effects of minimalist theories of representation and similar concepts, and to an unappreciated consequence of the success of specific expressivist theories like moral expressivism. (...) In this paper I argue that Price’s arguments don’t succeed. While they can be fixed, doing so makes them miss their intended target. Local expressivists should therefore not be worried by Price’s arguments. (shrink)

This essay explains some basic concepts about BDSM, and it responds to two important objections to it. The first is the psychological objection—that BDSM practitioners suffer from mental disorders—and the second is the ethical objection—that BDSM practitioners have morally compromised desires because of the kinds of activities they desire to participate in, especially ones that involve roles that dip into tortured oppressive histories (e.g., "rape" scenes, "master-and-slave" scenes). The paper argues that both objections fail, and, more specifically focusing on the (...) ethical objection, argues that BDSM desires are psychologically, conceptually, and phenomenologically different from their seeming counterpart real-life desires that are truly ethically defective. Finally, the paper argues that BDSM practitioners, in having to always understand, explore, and justify their desires (especially to a majority that is hostile to them), have an interesting chance to lead rich, flourishing lives. The new field of experimental philosophy has emerged as the methods of psychological science have been brought to bear on traditional philosophical issues. Oxford Studies in Experimental Philosophy is the place to go to see outstanding new work in the field. It features papers by philosophers, papers by psychologists, and papers co-authored by people in both disciplines. The series heralds the emergence of a truly interdisciplinary field in which people from different disciplines are working together to address a shared set (...) of questions. This new volume of Oxford Studies in Experimental Philosophy showcases the continuing development of the field. The submitted papers go ever more deeply into some of the issues that have long been central topics of experimental philosophy research (epistemic intuitions, metaethical intuitions, intuitions about causation) but also venture into new topics that illustrate the broadening the scope of experimental philosophy research (slurs, experimental economics, Socratic questionnaires). The volume concludes with three specially commissioned essays reviewing recent work on three central topics: causal judgment, knowledge ascription, and the experimental philosophy of consciousness. The last two decades have seen two significant trends emerging within the philosophy of science: the rapid development and focus on the philosophy of the specialised sciences, and a resurgence of Aristotelian metaphysics, much of which is concerned with the possibility of emergence, as well as the ontological status and indispensability of dispositions and powers in science. Despite these recent trends, few Aristotelian metaphysicians have engaged directly with the philosophy of the specialised sciences. Additionally, the relationship between fundamental Aristotelian concepts—such (...) as "hylomorphism", "substance", and "faculties"—and contemporary science has yet to receive a critical and systematic treatment. _Neo-Aristotelian Perspectives on Contemporary Science _aims to fill this gap in the literature by bringing together essays on the relationship between Aristotelianism and science that cut across interdisciplinary boundaries.
