Pretende-se abordar como os argumentos luteranos ─ de natureza constitucional das "magistraturas inferiores" e de direito privado ─ acerca do direito de resistência, desenvolvidos no final da década de 1520 e início de 1530, foram recepcionados no _Segundo Tratado Sobre o Governo Civil_, de John Locke, escrito no século XVII. O argumento de direito privado compreende que todo governante que abandona as boas ações e se dedica a cometer atos tirânicos se despoja de sua autoridade e, consequentemente, deve ser tratado (...) como uma pessoa privada, portanto, sujeita ao lícito revide, o que configura uma espécie de legítima defesa. O argumento constitucional das "magistraturas inferiores" afirma a possibilidade de órgãos intermediários entre o governante e o povo estarem legitimados para oferecer resistência às tiranias. Em John Locke, ambos os argumentos objetivam a solução do problema da tirania para se obter liberdade política e religiosa. (shrink)

O presente estudo busca examinar alguns dos debates socrático-platônicos sobre a opinião pública diante da busca da verdade, e seu impacto político, particularmente para a democracia, que depende da noção de liberdade. Depois de se entender o avanço da visão de Platão sobre o problema da opinião e a impossibilidade de seu sobrepujamento geral, discute-se a visão do autor sobre o regime que dá poder ao demos e, ao final, que tipo de aprendizado se pode daí extrair para as democracias (...) contemporâneas. Conflitos desse tipo sáo capazes de causar inconsistências nas normas de certos sistemas morais, como por exemplo, os preponderantemente racionalistas. Partindo desse problema, os autores que se dispõe a trabalhar este tema demonstram opiniões divididas: alguns optam por defender a genuinidade dos conflitos morais insolúveis e consideram as eventuais inconsistências na teoria moral como secundárias, enquanto outros optam por salvaguardar a lógica do pensamento e das teorias morais, negando os conflitos morais insolúveis. Este artigo busca esboçar tal “divisáo” entre os autores, ao explorar brevemente as argumentações de ambas as partes. Por fim, fica demonstrado que uma discussáo sobre consistência e conflitos morais precisa considerar tanto a esfera metaética quanto a esfera normativa da ética. (shrink)

La vida entera de muchos ensayistas transcurre sin dar jamás con un tema. Este ensayo no sólo se topa con un tema, sino que incluso se da el lujo de aprovecharlo. El tema es la felicidad. Sin embargo, La herida de Spinoza es un libro de ?losofía, no de autoayuda. Parte de algunas conclusiones recientes de la neurología, en particular de las investigaciones de Antonio Damasio acerca de la impertinencia de la secular división entre mente y cuerpo. El propio Damasio (...) vincula sus investigaciones con las ideas que Spinoza expuso en su Ética. Para Damasio, la tranquila aceptación de la muerte, una de las señas de identidad de la ética de Spinoza –de hecho, la «herida» de Spinoza–, resulta «irritante». Ese comentario de Damasio parece inocuo, pero para Vicente Serrano no lo es, sino que apunta a una especie de «desajuste», a una extraña incomprensión de la diferencia última de la ética spinozista. A partir de ahí el autor no se propone criticar solamente esa y otras lecturas de Spinoza, sino que plantea además una amplia crítica a la modernidad, y también a la posmodernidad. La herida de Spinoza se convierte entonces en una revisión de la historia entera de la ?losofía en esa zona en que ética y metafísica (u ontología) se superponen. Aunque el proyecto parece apabullante, el autor se asegura de estar bien equipado. Por una parte suprime el aparato académico, lo que le permite ser más breve y directo, y por otra echa mano de una erudición notable y, sobre todo, de una capacidad absolutamente inusual de explicación. Si hubiera que buscar parangones a esa capacidad, no quedaría más remedio que acudir a Rüdiger Safranski. El autor, sin embargo, no hace biografías, ni siquiera historia de la ?losofía como tal, sino que intenta ?losofar de la mano de los más grandes pensadores de la historia. El ensayo se completa con la inclusión de una pieza maestra: los afectos. Los afectos serían la respuesta posible de la ?losofía al problema de la biopolítica. La progresión de la modernidad no sólo implica la desaparición de la naturaleza, sino la sustitución absoluta de los afectos por la voluntad (de voluntad). Si la vuelta a la naturaleza es imposible, e incluso indeseable –dado que la naturaleza no fue nunca más que una metáfora–, Serrano se inspira en Foucault para proponer una «vuelta» a los afectos como la pieza fundamental que cierra la reflexión sobre el poder. «Un ensayo en el sentido más ágil del término, obra a mitad de camino entre lo reflexivo y lo literario… Bien pensado y bien escrito, muchísimo más de lo que se ha vuelto habitual en nosotros» (Gabriel Albiac, Leer). «La cuestión de fondo teórica –a qué responde la religión y qué problemas de comprensión existencial atiende o atendía– es algo mucho más complejo y creo que más apasionante. Un buen tratamiento filosófico de la cuestión es el que ofrece Vicente Serrano en La herida de Spinoza, reciente ganador del Premio Anagrama de Ensayo… Serrano explora las consecuencias posmodernas del abandono de las religiones: un tema más sugestivo que la refutación de las iglesias...» (Fernando Savater, El País). «Iniciado como un arroyo para abrirse en un delta que abarca toda la modernidad filosófica, la obra de Serrano analiza, sin pedantería ni falsas oscuridades, las inflexiones que han tenido los conceptos de religión, deseo, naturaleza, esperanza, progreso, poder y felicidad» (Juan Malpartida, ABC). «Entre quienes lo lean sumará cientos de fascinados. Reflito sobre o pseudodiscurso de apaziguamento e igualdade, além de pontuar as aproximações no que se refere à linguagem e discurso entre os textos dos três autores e aponto as expressões de raiva e/ou vingança e o tom de denúncia que caracterizam os textos. El Estado de Hegel es el Estado de Derecho. Sin embargo en su Filosofía del Derecho se encuentran fundamentos decisivos para una teoría del Estado Social. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. A este problema la sociedad es incapaz de darle una solución. (shrink)

This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. The death of George Floyd in May 2020 sparked an unprecedented global wave of protests that appeared to mark a turning point in the battle against racial injustice. But protests against racism are not new; each comes and soon passes into the archives of history, leaving few lasting changes in its wake. What was different about the death of Floyd was that the graphic manner of its unfolding was captured on film: the slow act of wilful suffocation, and how the (...) entire world was seemingly invited to witness the torment and the execution of this man, in broad daylight, even as he cried I can't breathe. However, this discussion attempts to move beyond that moment of death, the protests that followed and the distracting debate about statues and monuments to argue that the death of Floyd must be seen as the culmination of the process of systemic and structural racism. It aims to show how racism shifted from the black body as the visible and material target of racial oppression to air/breath, and how suffocation became the characteristic feature as well as the weapon of contemporary racial injustice. En el presente artículo se analiza la visión de Leocata sobre el cogito cartesiano. Se destaca su lectura del sum desde el acto de ser del creacionismo de Santo Tomás y su mayor evidencia para el intelecto humano, al mismo tiempo que una nueva versión de la “idea de ser infinito” que lleva a una nueva reconsideración del argumento ontológico de Descartes. Se concluye con un llamado al debate sobre esta relectura.

Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Humans, animals, and the environment face a universal crisis: antimicrobial resistance. Addressing AR and its multi-disciplinary causes across many sectors including in human and veterinary medicine remains underdeveloped. One barrier to AR efforts is an inconsistent process to incorporate the plenitude of stakeholders about what AR is and how to stifle its development and spread—especially stakeholders from the animal agriculture sector, one of the largest purchasers of antimicrobial drugs. In 2019, The Wellcome Trust released Reframing Resistance: How to communicate about (...) antimicrobial resistance effectively, which proposed the need to establish a consistent and harmonized messaging effort that describes the AR crisis and its global implications for health and wellbeing across all stakeholders. Yet, Reframing Resistance does not specifically engage the animal agriculture community. This study investigates the gap between two principles recommended by Reframing Resistance and animal agriculture stakeholders. For this analysis, the research group conducted 31 semi-structured interviews with a diverse group of United States animal agriculture stakeholders. Participants reported attitudes, beliefs, and practices about a variety of issues, including how they defined AR and what entities the AR crisis impacts most. Exploration of Reframing Resistance’s Principle 2, “explain the fundamentals succinctly” and Principle 3, “emphasis that this is universal issue; it can affect anyone, including you” reveals disagreement in both the fundamentals of AR and consensus of “who” the AR crisis impacts. Principle 2 may do better to acknowledge that animal agriculture stakeholders espouse a complex array of perspectives that cannot be summed up in a single perspective or principle. As a primary tool to combat AR, behavior change must be accomplished first through outreach to stakeholder groups and understanding their perspectives. (shrink)

This article is a libertarian critique of incest laws. On the basis of the libertarian “harm principle”, one must ask what exactly is the harm that incest brings forth. Traditionally, anthropologists have tried to rationalize the incest taboo in various theories, and lawmakers have used these principles as grounds for the criminalization of incest. These principles are the preservation of family structure, the enhancement of alliances and the avoidance of genetic risks. While I acknowledge that these rationalizations are plausible, I (...) argue that they are still not sufficient grounds for the preservation of incest laws, and consequently, there is an ethical need to reform them. Both Frege's Grundgesetze, and Lagrange's treatises on analytical functions pursue a foundational purpose. Still, the former's program is not only crucially different from the latter's. It also depends on a different idea of what foundation of mathematics should be like . Despite this contrast, the notion of function plays similar roles in their respective programs. The purpose of my paper is emphasising this similarity. In doing it, I hope to contribute to a better understanding of Frege's logicism, especially in relation (...) to its crucial differences with a set-theoretic foundational perspective. This should also spread some light on a question arisen by J. Hintikka and G. Sandu in a widely discussed paper, namely whether Frege should or should not be credited with the notion of arbitrary function underlying our standard interpretation of second-order logic. In section 1, I account for Lagrange's notion of function. In section 2, I advance some remarks on connected historical matters. This will provide an appropriate framework for discussing the role played by the notion of function in Frege's Grundgesetze. Section 3 is devoted to this. In this article I ask what recent moral psychology and neuroscience can and can’t claim to have discovered about morality. I argue that the object of study of much recent work is not morality but a particular kind of individual moral judgment. But this is a small and peculiar sample of morality. There are many things that are moral yet not moral judgments. There are also many things that are moral judgments yet not of that particular kind. If moral things (...) are various and diverse, then empirical research about one kind of individual moral judgment doesn’t warrant theoretical conclusions about morality in general. If that kind of individual moral judgment is a peculiar and rare thing, then it is not obvious what it tells us about other moral things. What is more, it is not obvious what its theoretical importance is to begin with—that is, why we should care about it at all. In light of these arguments, I call for a pluralism of methods and objects of inquiry in the scientific investigation of morality, so that it transcends its problematic overemphasis on a particular kind of individual moral judgment. The history of the field of business ethics in the U.S. remains understudied and misunderstood. In this article I begin to remedy this oversight about the past, and I suggest how it can be beneficial in the present. Using both published and unpublished primary sources, I argue that the business ethics field emerged in the early twentieth century, against the backdrop of the establishment of business schools in major universities. I bring to light four important developments: business ethics lectures at (...) the University of California and Yale University, Leon Marshall’s curriculum at the College of Commerce of the University of Chicago, and the William A. Vawter Foundation on Business Ethics at Northwestern University. Then, I consider the payoffs of my historical account for business ethics theory, pedagogy, and practice. Specifically, I present four implications of my account under these headings: business ethics as a public problem; the place of ethics in business schools; historicizing business ethics; and historical self-knowledge. Concepts of decision, choice, decision-maker, and decision-making are common practical tools in both social science and natural science, on which scientific knowledge, policy implications, and moral recommendations are based. In this article I address three questions. First, I look into how present-day social scientists and natural scientists use decision/choice concepts. What are they used for? Second, scientists may differ in the application of decision/choice to X, and they may explicitly disagree about the applicability of decision/choice to X. Where exactly do (...) these disagreements lie? Third, I ask how scientists should use decision/choice concepts. What are they correctly and incorrectly used for? I argue that scientists must responsibly attend to a methodological demand: you have to have a principled, non-ad hoc, well-argued-for way of telling where decision/choice applicability ends. Thus, I aim to minimize the risk of conceptual stretching and foster responsible conceptual practices in a large body of scientific work. (shrink)

Our starting point is a somewhat obscure incident which has lately attracted some attention. The year is 429 B.C., and the place is Athens in the third year of the Peloponnesian war. The plague, which had broken out only a year before, was still claiming its victims. Yet military operations were in full swing, and the general Phormio operating in the Corinthian gulf against a Peloponnesian fleet was able to score an impressive victory. The Lacedaemonians were deeply dissatisfied. This was (...) the first sea-fight they had been engaged in, and they found it hard to believe that their fleet was so much inferior to that of the Athenians. They dispatched three advisers to Knemos, the admiral in charge, instructing them to make better preparations for another sea-fight. Additional ships were solicited from the allies, and those already at hand were prepared for battle. It is at this point that the incident in question occurred. Not to prejudge the issue, I quote the text in full leaving the controversial phrases untranslated: 4. And Phormio on his part sent messengers to Athens to give information of the enemy's preparations and to tell about the battle which they had won, urging them also to send to him speedily as many ships as possible, since there was always a prospect that a battle might be fought any day. 5. So they sent him twenty ships, but gave τ δ κυμξοντι special orders to sail first to Crete. Nικας γρ Kρς Γορτνιος πρξενος ν persuaded them to sail against Cydonia, a hostile town, promising to bring it over to the Athenians; but he was really asking them to intervene to gratify the people of Polichne, who are neighbours of the Cydonians. 6. El presente trabajo se propone subrayar la relevancia filosófica del amor acudiendo al desarrollo analítico que del mismo realiza Harry G. Frankfurt. Para ello nos valdremos de la categorización que establece Bennett Helm y encuadraremos la teoría de Frankfurt dentro de una categoría concreta: la del amor como «gran preocupación» [«robust concern»]. Esto nos servirá para atender a la psicología moral de dicho autor y al peso decisivo que el amor juega en la misma; revestido aquel, como afirma Frankfurt, de (...) una autoridad tal que dota de sentido último a nuestro razonamiento práctico. Finalmente, y expuesta la relevancia del amor dentro de todo este proceso, se procederá a discutir de la mano de Jonathan Lear si el amor posee la autoridad que Frankfurt le asigna. (shrink)

Durkheim's underdeveloped notion of fatalism is the keystone for a bridge between two conceptual categories central to Marxian and Durkheimian theory: alienation and anomie. Durkheim does not necessarily disagree with Marx that excessive regulation can be socially damaging but chooses to highlight the effects of under-regulation. A Durkheimian critique of overregulation becomes possible if we turn away from anomie and toward Durkheim's idea of fatalism—a concept that I will argue here is unexpectedly consistent with Marx's notion of alienation. We can (...) infer that Durkheim presents us with a notion of an “optimal” human condition that exists between anomie and fatalism. The structure of modern societies, it will be argued, is characterized not just by excessive control leading to alienation or by a lack of integrative restraint leading to anomie but also by active efforts to optimally regulate social life. This paper looks broadly at the theme of corporate governance in Mexico. It begins with a brief analysis of the historical corporate governance model in Mexico, including the governance structures, the banking and financial systems, ownership and control patterns, industrial policy, and industrial relations. The paper then examines how and why these various aspects of corporate governance have been changing with processes of economic liberalization currently under way. Finally, it analyzes the consequences of changes in the model of corporate governance (...) for the country's development (e.g. increased consumer goods for middle class consumers, increased disclosure by domestic corporations, less support for corporate social programs, etc.). Tem-se como hipótese que a internet se trata de uma ferramenta capaz de viabilizar a participação política dos cidadãos. ABSTRACT Mohism has been called the most religious of all Chinese philosophies. Living up to that name, it developed unique proofs for the existence of the spiritual realm within a distinctly Chinese context. The Mozi uses testimonies from China’s mythic history to prove the existence of spirits. But beyond these cultural proofs, the Mozi also introduces a logical argument that is very similar to Pascal’s wager. Beyond these four explicit arguments, the Mozi also contains a fifth proof based on the (...) existence of a supernatural order that exists in the structure of the world. (shrink)

Bullfighting debates in Spain are increasingly intense. Defenders of bullfighting as sport and as art, typically argue that many of the country’s most esteemed intellectual and artistic figures were bullfight enthusiasts. This is admittedly true, but by the same token Spain has a long tradition of anti-bullfighting thought. One prominent critic of bullfighting in the eighteenth century was Gaspar Melchor Jovellanos. Often considered the best representative of the Spanish Enlightenment, Jovellanos did not address bullfighting as a central concern. But, in (...) some writings, he did level important criticisms against this sort of spectacle. Defenders of bullfighting frequently argue that Jovellanos’ critique of bullfighting relies mostly on economic arguments. While it is true that Jovellanos offered economic reasons to oppose bullfighting, a closer reading of his works reveals that he had a larger concern with the violent nature of bullfighting, which cohered with his Enlightenment philosophy. La noción misma de igualdad llevaría a la conclusión paradójica de que las sociedades igualitarias son superiores a las sociedades jerárquicas. Igualmente, amerita destacar la singularidad de Occidente respecto a otras culturas. Shaming is defended by some as a necessary measure of social control. But shaming is unjust to the extent that it is disproportionate, and largely counterproductive. While much progress has been made, people with disabilities are still frequently at the receiving end of shaming. This is manifest in disregard for accommodation requests, condescending attitudes and overall lack of empathy towards people with disabilities. These trends are also manifest in clinical settings. Medical staff and healthcare workers need to seriously consider this (...) state of affairs and embrace attitudinal changes and policies that contribute to a more welcoming atmosphere towards the disabled, and consequently curb the shaming to which they have been traditionally exposed.
