Court rulings are among the most important documents in all legal systems. This article describes a study in which natural language processing is used for the automatic characterization of Spanish judgments that deal with the physical custody (joint or individual) of minors. The model was trained to identify a set of elements: the type of custody requested by the plaintiff, the type of custody decided on by the court, and eight of the most commonly used arguments in this type of (...) judgment. Two jurists independently annotated more than 3000 judgments, which were used to train a model based on transformers. The main difficulties encountered in this task were the complexity of the judicial language and the need to work with appellate court rulings that have a more complicated structure than decisions at first instance. For the complete court rulings, the F1 score of the inter-annotator agreement ranged from 0.60 to 0.86 and the Kappa index from 0.33 to 0.73. The F1 score of the agreement between the model and the annotators ranged from 0.66 to 0.93 and the Kappa index from 0.57 to 0.80. These results in which the model performance exceeds even the inter-annotator agreement show the high ability of transformers to identify abstract entities in legal texts. (shrink)

Now that the usage and meaning of urban spaces have been dramatically challenged by the global pandemic, several debates and reflections are going on around the manner in which cities – both as concerns the public and the private spaces – have been designed. The article observes how “urban-human face” representations have served different models of urbanity across times and cultures. Using a framework deriving from semiotics of culture, according to which the city represents a model of the world, the (...) article attempts to interpret how portraits of faces have been modelling the city through different urban faciality mechanisms. The focus is on a sample of what we call ‘urban-human faces’, ranging from Soviet propaganda posters to the digital #selfiecity project. The expression refers to series of representations that bring together the city and the face. It can be argued that both the city and the face, produced at a specific historical and cultural moment, with their figurative and plastic elements, deploy the struggle for the city ownership and authorship. Nonetheless, the commensurability of the city and the face can be just based on the fact that both semiotic configurations represent an excess with the help of cartographic reproduction (the city) and the portrait (the face), respectively. A city can be represented by a face to the extent to which it is also multifaceted as a polylogue. On the basis of such instable commensurability, the article will ultimately attempt to bring together the semiotics of the face and the semiotics of the city. (shrink)

From my perspective, your book, especially Part I: Conceptual Framework , is in both orientation and content an essay in “systems theory.” My connection to what you have written is still more direct. I’m working on a book which integrates systems ideas and theories around the theme of “imperfection.” This is close to (...) the centrality of “fallibility” in your framework, since “imperfection” is to ontology what “fallibility” is to epistemology. This work contrasts Giovanni Sartor’s view of inferential semantics of legal concepts with a probabilistic model of theory formation. The work further explores possibilities of implementing Kemp’s probabilistic model of theory formation in the context of mapping legal concepts between two individual legal systems. For implementing the legal concept mapping, we propose a cross-categorization approach that combines three mathematical models: the Bayesian Model of Generalization, the probabilistic model of theory formation, i.e., the Infinite Relational Model first introduced by Kemp et (...) al. and its extended model, i.e., the normal-IRM proposed by Herlau et al.. We apply our cross-categorization approach to datasets where legal concepts related to educational systems are respectively defined by the Japanese- and the Danish authorities according to the International Standard Classification of Education. The main contribution of this work is the proposal of a conceptual framework of the cross-categorization approach that, inspired by Sartor, attempts to explain reasoner’s inferential mechanisms. The previous studies have shown that human infants and domestic dogs follow the gaze of a human agent only when the agent has addressed them ostensively—e.g., by making eye contact, or calling their name. This evidence is interpreted as showing that they expect ostensive signals to precede referential information. The present study tested chimpanzees, one of the closest relatives to humans, in a series of eye-tracking experiments using an experimental design adapted from these previous studies. In the ostension conditions, a (...) human actor made eye contact, called the participant’s name, and then looked at one of two objects. In the control conditions, a salient cue, which differed in each experiment (a colorful object, the actor’s nodding, or an eating action), attracted participants’ attention to the actor’s face, and then the actor looked at the object. Overall, chimpanzees followed the actor’s gaze to the cued object in both ostension and control conditions, and the ostensive signals did not enhance gaze following more than the control attention-getters. However, the ostensive signals enhanced subsequent attention to both target and distractor objects (but not to the actor’s face) more strongly than the control attention-getters—especially in the chimpanzees who had a close relationship with human caregivers. We interpret this as showing that chimpanzees have a simple form of communicative expectations on the basis of ostensive signals, but unlike human infants and dogs, they do not subsequently use the experimenter’s gaze to infer the intended referent. These results may reflect a limitation of non-domesticated species for interpreting humans’ ostensive signals in inter-species communication. (shrink)

The cellular basis of motor learning in the cerebellum has been attributed mostly to long-term depression (LTD) at excitatory parallel fiber (PF)-Purkinje cell (PC) synapses. LTD is induced when PFs are activated in conjunction with a climbing fiber (CF), the other excitatory input to PCs. Recently, by using whole-cell patch-clamp recording from PCs in cerebellar slices, a new form of synaptic plasticity was discovered. Stimulation of excitatory CFs induced a long-lasting (usually longer than 30 min) of 30 sec) and the (...) durations of RP (>30 min) strongly suggests that some intracellular biochemical machinery is involved. Pharmacological evidence suggests that protein kinases are involved in RP of inhibitory synapses and LTD of excitatory PF synapses. Besides the well-described LTD, RP could be a cellular mechanism that plays an important role in motor learning. (shrink)

By questioning the attribution of a primary role to the eyes as bearers of identity within traditional Western culture, this paper will problematize the agentivity performed by the lower mereology of the face, identified with the mouth-nose assemblage. In particular, the study will focus on the manipulation of such facial spatiality through the intervention of three “lower face” artifacts: the grill, the ball gag and the gas mask. This piece of work will examine their plastic and figurative dimensions in the (...) technological interaction with the facial organs. Furthermore, we will take into consideration the sociocultural context of wearability performed by the different bearers with the aim of grasping the identity shift that the artifacts trigger. The study, therefore, will organize the corpus as a sequence that starts inside the oral cavity where the grill is worn; then moves to a progressive exteriority with the ball gag that emerges from the mouth through the straps fastened around the head; eventually dealing with the exterior projection operated by the gas mask which by means of its filters portends beyond the anatomical face. Ultimately the three artifacts are presented as a threefold articulation of a liminal agency towards an expanded form of humanity including animality embedded within and without the space of meaning represented by the face. ZusammenfassungMit der Frage, unter welchen Bedingungen die Entscheidung eines Patienten als hinreichend autonom und sein Informed Consent damit als valide betrachtet werden darf, wird ein Kernproblem der Medizinethik an- gesprochen. In der aktuellen Literatur mehren sich in diesem Zusammenhang die Forderungen nach immer differenzierteren Aufklärungsverpflichtungen des Arztes. Dabei wird übersehen, dass diese im klinischen Alltag aufgrund der begrenzten zeitlichen und personellen Ressourcen kaum zu realisieren sind. In dieser Arbeit wird ein Konzept beschrieben, das eine bedarfsgerechte Aufklärung ermöglichen soll. Seine Leitidee (...) besteht darin, die Schwierigkeit einer Entscheidung als Maßstab für die Bestimmung der in dem jeweiligen Kontext als hinreichend geltenden Entscheidungsautonomie zu definieren. Der Schwierigkeitsbegriff wird über die der Entscheidungssituation zuzuordnenden Wertekonkurrenz, d.h. der Anzahl und dem Gewicht der eine Entscheidung mitbeeinflussenden Werte, expliziert. Definiton of the problem: The current literature concerning the topic of ”informed consent” confronts physicians with a growing demand for extended and sophisticated disclosure duties. Often enough they hardly seem to be feasible, not least because of an actual lack of personnel and time. The problem is to find a realisable way to balance these theoretical and practical considerations. Arguments: The fundamental idea of the concept presented here consists of using the difficulty of a certain decision as standard for determining (...) the required extent of the patient’s actual decisional autonomy. As the prominent aspect of this difficulty of decision-making, the occurrence of conflicting values – termed ”value concurrence”– is identified. Conclusion: Structuring physician-patient-communication in accordance with this ”value-concurrence” should prove to be applicable in the clinical context without neglecting important ethical reflections. Ātman (soul) and Nairātmya (no soul) are, for the Brahmanical schools and the Buddhists respectively, equally fundamental tenets which neither side can concede to the other. Among the 16 formulations presented by Uddyotakara, the fifteenth, which is a proof of Ātman and is originally an indirect proof ( avīta/āvīta ), is presented in a prasaṅga -style, and contains double negation ( na nairātmyam ) in the thesis. However, it is perhaps Dharmakīrti who first transformed it into a normal style ( (...) sātmakam ). He is well aware of the law of excluded middle, and insisits that the negation is paryudāsa . On the Nyāya side, Uddyotakara at least seems to be unaware of the law of the logical equivalence of contraposition concerning pervasion ( vyāpti ). After Uddyotakara, however, Vyoman (Vyomaśiva), Bhāsarvajña and Vācaspatimiśra, all seem to be well aware of it. Dharmakīrti, in his conter-argument against the proof of ātman , discusses the negative expressions ‘‘ nairātmya ” and ‘‘ a-nairātmya ” Dharmakīrti here uses two logical arguments skillfully and tactically. As a critic of both the authenticity of the Veda and the existence of ātman , he insists on the theory of dichotomy and the equivalence of anvaya and vyatireka , whereas as an apologist he denies the application of these theories to the relation between the existence of ātman and the concept of nairātmya , because for him as a Buddhist the latter is not a negative but essentially positive state of affairs. This paper aims to explore the association between over-indebtedness and two facets of well-being – life satisfaction and emotional well-being. Although prior research has associated over-indebtedness with lower life satisfaction, this study contributes to the extant literature by revealing its effects on emotional well-being, which is a crucial component of well-being that has received less attention. Besides subjective well-being, reported health, and sleep quality were also assessed. The findings suggest that over-indebted consumers have lower life satisfaction and emotional well-being, as (...) well as poorer health and sleep quality. Furthermore, over-indebtedness impacts life satisfaction and emotional well-being through different mechanisms. Consumers decreased perceived control accounts for the impact of over-indebtedness on both facets of well-being. Financial well-being, partly mediates the impact of indebtedness status on overall life satisfaction. The current study contributes to research focusing on the relationship between indebtedness, well-being, health, and sleep quality, and provides relevant theoretical and practical implications. This paper addresses whether overindebted and non-overindebted consumers differ in their attitude toward money and how this attitude impacts three different financial behavior categories: record keeping, adjusting balance, and monitoring balance. Overindebted consumers were recruited via an NGO for consumer defense and were categorized into two subgroups: consumers who became overindebted due to internal causes and consumers who became overindebted due to external causes. Non-overindebted consumers were a convenience sample. Non-overindebted consumers showed more positive attitudes toward money than both groups (...) of overindebted consumers and overindebted due to external causes showed more positive attitudes than overindebted consumers due to internal causes. All groups share similar financial management behaviors except for monitoring balance, which was more frequent among non-overindebted consumers. Furthermore, a regression analysis indicates that money attitudes helped explain financial behavior differences between consumers above and beyond their indebtedness status. Consumers’ attitude predicted financial behaviors, even when controlling for relevant socioeconomic variables. Further analyses comparing money attitudes and financial behavior for the three subgroups showed no differences. (shrink)

Résumé La recherche économique contemporaine a perdu (de) sa puissance explicative. Bien que cela transparaisse déjà depuis un bon moment, ce n’est que depuis la récente crise économique que cet état de fait est reconnu de manière plus générale. Cependant, plusieurs initiatives ont étés lancées dans l’espoir d’améliorer la situation. Une initiative phare fut celle qu’a lancée George Soros, à partir du constat suivant: si la réflexivité est une composante majeure de la réalité sociale, les contributions dominantes actuelles en économie (...) n’intègrent pas cette dimension. Le propos de mon article est de montrer que si Soros nous donne un éclairage pertinent, il ne pousse pas assez loin son raisonnement. L’essence de son message risque de se perdre en conséquence de certains propos qu’il faut mettre en doute et qui ne sont peut-être pas nécessaires à son argumentation centrale – des propos que l’on peut retrouver ailleurs dans la quête d’alternatives, et qui méritent à ce titre une attention particulière. Let me begin by saying that I think that George Soros is right in identifying fallibility and reflexivity as important phenomena in economic life, and in social life more generally, and as phenomena that mainstream economic theory has largely ignored. I also agree with Soros that economics is an uncertain science. And I think that Soros himself, being one of the world's wealthiest men and most generous philanthropists, deserves credit for being ready and willing to think for himself. It would (...) be all too easy for him to trot out conventional wisdom about market efficiency, privatization, and the like – safely under-written by economic science. It is much more difficult to question the conventional wisdom, let alone its theoretical foundations. Soros does both. Better yet, he takes the trouble to write down his ideas for public consideration and to respond to requests from academic journals to debate their significance – while he could just as easily be lounging on a yacht eating caviar for the rest of his days. Thus said, I do not agree with everything Soros says in his ‘Fallibility, reflexivity, and the human uncertainty principle’ and in what follows I will focus upon what I regard as misconceptions in what he says about fallibility, reflexivity, and scientific method. I will attribute these disagreements to misunderstandings of some of the ideas of our mutual mentor – Sir Karl Popper. In doing so, I hope to show that some of Soros' ideas may be closer to Popper's than Soros thinks, that reflexivity may not be as exclusive to social science as Soros thinks, and that it may not require a scientific method of its own. Getting clear about this may leave us with a somewhat different view of science. (shrink)

George Soros makes an important analytical contribution to understanding the concept of reflexivity in social science by explaining reflexivity in terms of how his cognitive and manipulative causal functions are connected to one another by a pair of feedback loops (Soros, 2013). Fallibility, reflexivity and the human uncertainty principle. Here I put aside the issue of how the natural sciences and social sciences are related, an issue he discusses, and focus on how his thinking applies in economics. I argue that (...) standard economics assumes a ‘classical’ view of the world in which knowledge and action are independent, but that we live in a complex reflexive world in which knowledge and action are interdependent. I argue that Soros's view provides a reflexivity critique of the efficient market hypothesis seen as depending on untenable claims about the nature of random phenomena and the nature of economic agents. Regarding the former, I develop this critique in terms of Cauchy distributions; regarding the latter I develop it in terms of rational expectations and rational addiction reasoning. (shrink)
